    Bid 19-020, Construction of Employee Fitness and Wellness Center for the County of El Paso (Re-Bid)

    This addenda has been issued to notify vendors of the following:

    In accordance with Chapter 2270 of the Texas Government Code, a company, other than a sole proprietorship, with ten or more full time employees is required to certify in writing that it does not boycott Israel and will not boycott Israel during the term of the contract, if the contract has a value of $100,000 or more.

    The following is a recap of the pre-bid conference held on Thursday, May 16, 2019:

    1. What does the ‘(8 hours) per diem wage rate’ consist of, what does it mean? Is it perday or per hour?

    RESPONSE: Wages listed on the ‘per diem’ column of the Prevailing WageRates are per day.

    2. What is the distance for the prevailing wage rate? For example does Las Cruces fallunder this?

    RESPONSE: Section 2258.021 of the Texas Local Government Code assignsworkers on public work contracts for the County the right to be paid theprevailing wage in the “Locality in which the work is performed.” Section2258.001(1)(B) states that “Locality in which the work is performed” meansthe geographical limits of the political subdivision awarding the contract for apublic work.     RESPONSE: Yes, certified payroll will be required.

    4. What are the security measures for entering the building?

    RESPONSE: There will need to be coordination with Sheriff Security and Facilities to maintain secure access to the building. Front entrance to building must always remain accessible to the public.

    5. Do building entrances have to be ADA compliant?

    RESPONSE: Yes, all building entrances must remain ADA compliant.

    6. Will workers be required to check in with security every time they are enter the building

    from any entry point?

    RESPONSE: Yes, proper procedures must be followed whenever entering the building. Further coordination can be undertaken if the need arises.

    7. How strictly will tools be monitored?

    RESPONSE: Strict tool inventory is not a foreseeable procedure. However, varying threat levels may affect security conditions and procedures.

    8. What is the approximate time to enter the building and start work, from check-in to

    work site?

    RESPONSE: It will not take long, normal screening time will take a few minutes. Using an on-site drop box and other approved accommodations can be implemented to reduce the time needed to check in.

    9. How long will it take to bring in material?

    RESPONSE: Further planning and coordination can be undertaken for best time-saving solution.

    10. Will the awarded vendor need to work after-hours or overtime?

    RESPONSE: It will fall upon the awarded vendor to decide whether overtime work will be required. Minimum of one week notice must be given to the County before any afterhours work can be conducted.

    11. Will parking be provided?

    RESPONSE: There is no available parking. Parking will need to be coordinated through the vendor’s own efforts.

    12. Will vendor be responsible for permits for parking?

    RESPONSE: Yes, vendor will be responsible for obtaining parking and other necessary permits.

    13. Is there a staging area available?

    RESPONSE: There is no staging area available. Staging area will need to be coordinated through the vendor’s own efforts.

    14. Will areas need to be fenced off?

    RESPONSE: There will need to be coordination between vendor and City.

    15. Do employees need to carry an ID/Badge?

    RESPONSE: Yes, vendor employees need to be badged while on County premises.

    16. Would a vest with the name company be sufficient?

    RESPONSE: Yes, a noticeable logo on a vest is acceptable.

    17. Will the awarded vendor need to bring in their own porta-potty?

    RESPONSE: Yes, for a large project vendor will need to bring in their own porta-potty for on-site use. Due to security reasons it would be best to reduce the number of building entries/exits.

    18. Will there be a sheriff posted on the entrance to the job site?

    RESPONSE: Depending on vendor activity an individual from Sheriff’s Office or Facilities Department will be stationed to monitor the entrance.

    19. Can afterhours work be conducted?

    RESPONSE: Work to be done before or after building working hours will need to be coordinated. Minimum of one week notice must be given to the County before any afterhours work can be conducted.

    20. What are the County Courthouse working hours?

    RESPONSE: Normal operating hours for the Courthouse are 7 a.m.-5 p.m. Monday-Friday.

    21. Would there be any issues closing off parts of the sidewalk?

    RESPONSE: Closing off the sidewalk would need to be coordinated. There must still be proper routing and accessibility to the Courthouse.

    22. Will the vendor be permitted to work in hallways during normal working hours?

    RESPONSE: Hallway work will be coordinated on a case-by-case basis. Loud work may disrupt some offices.

    23. Are there liquidated damages?

    RESPONSE: Liquidated damages are in the sum of $750.00 for each consecutive calendar day thereafter the agreed upon date of project completion.

    24. If work needs to be stopped, will there be prorated days of completion?

    RESPONSE: Prorated days will be mitigated on a case-by-case basis.

    The Purchasing Department has received the following questions:

    1. The solicitation states that there is Telecom/IT work involved but there was no mention of it in the bid. Will there be telecom/IT work on this project?

    RESPONSE: Yes, I.T. is required in this project. I.T. requirements are included in the electrical drawings.

    2. The plans call for electrical work but the drawings seem to be missing. Will the plans be made available?

    RESPONSE: Yes, electrical drawings E.0 Electrical Legend, E1.1 Overall Electrical Plan, E2.1 Enlarged Floor Plan, E2.2 Electrical Plans, and E3.1 Overall HVAC Equipment Plan attached.

THE COMPLETED SYSTEM SHALLOPERATE SATISFACTORILY IN EVERY RESPECT. MAKEANY REPAIRS OR ADJUSTMENTS NECESSARY TO THIS ENDTO THE SATISFACTION OF THE OWNER.

    9. AT THE COMPLETION OF THIS PROJECT, THECONTRACTOR SHALL PROVIDE THE OWNER WITH ONE (1)COMPLETE AND FINAL CORRECTED SER OF WORKINGDRAWINGS. THIS SET OF WORKING DRAWINGS SHALL BENEW, UNUSED AND IN GOOD CONDITION ACTUAL CIRCUITNUMBERS SHALL BE RECORDED ON THE AS-BUILTDRAWINGS.

    10. THE WORK PERFORMED SHALL BE GUARANTEED, FOR APERIOD OF ONE YEAR AFTER FINAL ACCEPTANCEAGAINST FAULTY WORKMANSHIP AND/OR MATERIALS. ANYFAILURE OR TROUBLE DUE TO SUCH CAUSES WITHIN THEPERIOD OF THE GUARANTEE SHALL BE MADE GOOD UPONDEMAND OF THE OWNER AND WITHOUT COST TO THEOWNER.

    11. SITE OBSERVATION BY THE ENGINEER IS FOR THEEXPRESS PURPOSE OF VERIFYING COMPLIANCE BY THECONTRACTOR WITH THE CONTRACT DOCUMENTS, ANDSHALL NOT BE CONSTRUED AS CONSTRUCTION SUPERVISION OR INDICATION OF APPROVAL OF THE MANNER ORLOCATION IN WHICH THE WORK IS BEING PERFORMED ASBEING A SAGE PRACTICE OR PLACE.

    12. THE CONTRACTOR SHALL THOROUGHLY EXAMINE THESITE AND SATISFY HIMSELF AS TO THE CONDITIONSUNDER WHICH THE WORK IS TO BE PERFORMED. THECONTRACTOR SHALL VERIFY AT THE SITE ALLMEASUREMENTS AFFECTING HIS WORK AND SHALL BERESPONSIBLE FOR THE CORRECTNESS OF THE SAME. NOEXTRA COMPENSATION WILL BE ALLOWED TO THECONTRACTOR FOR THE EXPENSES DUE TO HIS NEGLECTTO EXAMINE OR FAILURE TO DISCOVER CONDITIONSWHICH AFFECT THIS WORK.     13. PROVIDE TYPE-WRITTEN CIRCUIT DIRECTORIES FOR ALLNEW ELECTRICAL PANELS AND AND FOR ALL EXISTINGELECTRICAL PANELS THAT HAVE BEEN UPDATED WITHTHE NEW CIRCUITS.

    14. GENERAL CONTRACTOR IS RESPONSIBLE FOR LOCATINGALL UTILITIES, PIPING, CONDUITS, ETC., PRIOR TO STARTOF CONSTRUCTION WITH THE EXECUTION OF THECONTRACTOR AGREES TO INDEMNIFY THE ARCHITECT,ENGINEER, AND OWNER FROM ANY ACTION ARISING AS ARESULT OF DAMAGE TO ANY EXISTING UTILITIES.

    15. EVERY BRANCH CIRCUIT SHALL BE PROVIDED WITH ASEPARATE, DEDICATED NEUTRAL IN ACCORDANCE WITHNEC, WETHER SHOWN ON DRAWINGS OR NOT.

    16. CONTRACTOR SHALL INSTALL EQUIPMENT AS PERMANUFACTURER REQUIREMENTS.

    17. ALL LIGHTS FIXTURES SHALL BE HUNG FROM AND/ORFASTENED TO THE BUILDING STRUCTURAL NOT FROMCEILING.

    18. PROVIDE ARC-FLASH LABELING ON ALL NEW ELECTRICALPANELS. ALL LABELING SHALL BE DONE USING ANNEX HOF NFPA 70E, 130.5(D); OR BY CALCULATIONS.

    19. PROVIDE UN-SWITCHED HOT CONDUCTOR TO ALLEMERGENCY BATTERIES OF FIXTURES. THIS HOTCONDUCTOR SHALL BYPASS ANY SWITCHES, OCCUPANCYSENSORS, AND LIGHTING CONTROL RELAYS. TYPICAL

    20. REFER TO MECHANICAL AND PLUMBING DRAWINGS FOREXACT LOCATIONS OF HVAC AND PLUMBING EQUIPMENT.

    24.
