The State Oil and Gas Board met in the Secretary of State's Office at 1830 P. N.. Anton. 1957.
PRESENT: Bob Les, Elmcutive Secretary to the Governor; Ed T. Elkins, State Treasurer; Bend Mintener, Assistant Attorney General; F. A. Allbee, State Auditor; Bernard Linn, Commissioner of School and Public Lands; Clara Halls, Secretary of State and Oil and Gas Board.
The meeting was called to order by Bob Lee, Executive Secretary to Governor Foss.
Mrs. Clara Halls, presented to the Board Notice of Intention to Drill for Oil and Gas, dated July 25, 1957, filed by Samuel Gary of 1121 Mile High Center, Denver. Colorado, covering the Pettegrew Well, No. 1, located on Section 30, Teemehip lIS, Range 7E, Fall River County, South Dakota. The well is located 66o' North and 1979' West from the SE Corner of Section 30, Township 11S, Range 7E of the B H M Meridian, Fall River County, South Dakota. Said well is covered by bond in the amount of t3,000.00 executed by the Fidelity and Casualty Company of New York as Surety. Mr. Bernard Linn moved that the application be approved and permit granted. which permit shall require Mr. Samuel Gary of 1121 Mile High Center, Denver, Colorado to furnish to Dr. Allen F. Agnew, State Geologist, a complete set of cuttings and if *nimble two sets of Geophysical Logs be furnished to the Secretary of the Oil and Gas Board, Pierre, South Dakota.

Discussion
Samuel (Aryls twelve well program east and southeast of the Black Hills is completed. The question arises of why no shows in any of the wells. I as unable to come up with any logical answer. The variability in the sends, at least the Mowry 4 Newcastle, was pre-viously recognised and these wells further demonstreted the presence of etretigraphic trap conditions. The dark shales above and below the sands are the Berne as in the Powder River Basin and Denver Rosin where they are considered to be ideal source beds for oil. Also, there appear to be noses present on which one could reasonably expee oil to be found, In other words, all the conditions for an oil pro-vince appear to be present, but still no oil has been found in the Cretaseotts so tar in this area. This does not mean that there never will be, but there have been enough wells drilled without shows now to make the area quite discounting.
The deeper objectives are practically untested in the area covered by these wells. There is ease Pennsylvanian production in SW Custer Co, and a recent Atlantic well in eastern Pennington Co., had ;thews of oil is the Miseissippian.e: There is a rumor of a deep test that may be drilled in Pall River Co., not too far north of this well, If this doesn't happen there is always the chance of a deep test being drilled somewhere in the arse.
concerning the acreage, my recommendation would be to give up the acreage with only the ;Mellow rights. The other leases that have so depth restrictions might be worth keeping fora while, at least until the ramrod deep test is either drilled or it bosoms, apparent that it won't be drilled,

The State Oil and Gas Board held a meeting in the Governor's Reception Room at 11:00 otclock A. M. March 31, 1958.
PRESENT: Maxine Isenberg, Administrative Assistant to Governor Foss; Ed. T. Elkins, State Treasurer; E. D. Barron, Assistant Attorney General; Buford Gray, Deputy State Auditor; Bernard Linn, Commissioner of School and Public Lands; Clara Halls, Secretary of State.
The meeting was called to order by Mrs. Isenberg, Administrative Assistant.
Mrs. Halls, Secretary of the Board, presented to the Board Notice of Intention to Abandon the Gary #1 Pettegrew Well, located on Section 30, Township 11 South, Range 7 East, Fall River County, South Dakota, together with Well Plugging Affidavit of said well. After a short discussion it was moved by Mr. Linn and seconded by Mr. Elkins that the Well Plugging Affidavit and Notice of Intention to Abandon the Gary #1 Pettegrew Well, located 660 feet North and 1979 feet West of the SE corner of the SW Quarter of the SE Quarter of Section 30, Township 11 South, Range 7 East of the Black Hills Principal. Meridian, Fall River County, South Dakota, be approved and the liability under bond executed by Fidelity and Casualty Company of New York as Surety and Samuel Gary as Principal, in the amount of $3,000.00 conditioned upon compliance with the law and rules and regulations of the Oil and Gas Board concerning wells to be drilled in Fall River County, South Dakota, be, and the same is hereby terminated and at an end from and after this date, and the bond of $3,000.00, given in connection with the drilling of said well, be released.

You are ahsolutely right that we had both copies of the plugging affidavit in our files. Appareutly I had signed the plugging affidavit December 24, 1957, and then noticed that the cuttihgs had not yet been received. Therefore T put the two copies of the af-fidavit in our files until the cuttings cid come in.
As T rentioned in my letter of March 18, the cuttings were receives sumeLime in late Janudry or early Fehru;,ry, and therefore I am returning to you the well plugging affidavit, approved.

Dear Mr. Pettegrew:
I have been advised that VW Samuel Gary has obtained a Permit to Drill for Oil and Gas on your land in Section 30 , T 11 S, R 7 E.
Occasionally, owners of land consider converting abandoned oil wells into water wells. Please advise me whether or not you intend to convert the oil well drill hole on your land into a water well if water is encountered and the drill hole is abandoned as an oil well.
If you are considering making a water well out of the aban-doned oil well drill hole, special considerations are necessary to comply with the State's oil and water laws. The abandoned oil hole must be properly plugged and the water well properly constructed. All conversion work will be at your expense. The cost will vary, depending upon the characteristics of the drill hole, but such cost will be in the neighborhood of $5,000 or more. Usually another driller and drill rig will have to be arranged for. This other drill rig and casing and other materials will have to be on hand to take over immediately after the special oil well plugging is completed, because the drill hole cannot be left open for any appreciable length of time without spoiling it. Approval of plans for construction of the water well will be required, and a bond covering proper construction may be required. Also, a water right may be required. All of these arrangements take considerable time to accomplish.
Please advise me immediately if you plan to convert the oil well drill hole into a water well, We both hope that a producing oil well results from the drill hole on your land; however, if not and you are planning on a water well, we must start making arrangements now.
