carried to approve the April 24, 2015 Executive Session meeting minutes, the June 8, 2015 Applications Committee and Executive Session meeting minutes, and the May 22, 2015 Board meeting minutes as circulated.

1. Settlement Agreements

a. In the Matter of the Contractor’s License of Andrew L.

Dixon, individually and doing business as Pacific Style Construction; CLB 2014-373-L; CLB 2015-96-L; and CLB 2015-138-L

RICO received complaints and alleges that Andrew L. Dixon, dba Pacific Style Construction (“Respondent”) failed to complete projects and may have diverted funds received for completion of specific projects. If proven at an administrative hearing before the Board, the allegations would constitute violations of the following laws:

HRS section 444-17(11) (failure to complete construction project for agreed price); and

HRS section 444-17(4) (diversion of funds received for completion of specific construction projects).

Respondent admits to violating HRS section 44-17(11), and due to his inability to pay debts, will close Pacific Style Construction and bankruptcy may be pursued. Respondent agrees to the voluntary surrender of his contractor’s license. Respondent understands that he shall not apply for a new license until the expiration of at least five years from the effective date of the surrender of his license, and if he desires to become licensed again, Respondent must apply for a new license, pursuant to and subject to all applicable laws and rules in effect at the time. After discussion, it was moved by Mr. Kamai, seconded by Mr. Polischeck, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case. b. In the Matter of the Contractors’ Licenses of KNM

Construction Corp.; Jeremy R. Abe, RME; CLB 2013-437-L; CLB 2013-438-L; CLB 2013-447-L; CLB 2013-449-L; CLB 2013-470-L; CLB 2014-7-L

KNM Construction Corp. and Jeremy R. Abe (“Respondents”) were licensed December 8, 2008, the licenses were inactive effective October 15, 2013, and expired on or about September 30, 2014. Respondents were licensed in the “B” General Building, C-31 Masonry, and C-17 Excavating, grading and trenching classifications. On or about November 6 and 14, 2013, RICO received complaints from five homeowners of separate projects alleging that Respondents failed to honor their contracts and abandoned or failed to complete the work contracted for.

On or about January 23, 2014, RICO received a complaint from another homeowner alleging that Respondents failed to honor their contract and abandoned or failed to complete the work contracted for. If proven at an administrative hearing before the Board, the allegations would constitute violations of the following laws:

HRS section 444-17(11) (failure of a licensee to complete in a material respect any construction project or operation for the agreed price if the failure is without legal excuse); and

HRS section 444-17(13) (willful failure or refusal to prosecute a project or operation to completion with reasonable diligence).

Respondents do not admit to violating any law or rule, but agree to the voluntary revocation of Respondents’ licenses, effective immediately upon the approval of the Settlement Agreement by the Board. Respondents understand that they cannot apply for new licenses until the expiration of at least five years after the effective date of the revocation. Respondents also understand that if they desire to become licensed again, Respondents must apply to the Board for new licenses pursuant and subject to HRS sections 92-17, 436B-21, and all other applicable laws and rules in effect at the time. It was moved by Mr. Lee, seconded by Mr. Kagawa, and unanimously carried to defer the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case. c. In the Matter of the Contractor Licenses of MBL & Sons,

Inc. and Robert B. Laubach; CLB 2013-168-L

MBL & Sons, Inc. and Robert B. Laubach (“Respondents”) held contractor licenses in the C-42 Roofing and C-60 Solar power systems classifications. On or about January 7, 2013, Respondents entered into a contract with TGUHI1/The Green Utility, Inc. which provided that Respondents would be responsible for the procurement, construction and installation of a new solar energy facility photovoltaic system at a condominium complex in Kailua-Kona, Hawaii.

On or about April 5, 2013 Respondents aided and abetted three individuals who did not possess a contractor’s license to perform

contracting work. (Respondents were not licensed in the C-13 Electrical classification.)

Respondents admit to the veracity of the allegations and that they violated the following statute(s) and/or rule(s):

HRS section 444-17(9.3) (aiding and abetting an unlicensed person);

HAR section 16-77-33(c) (out of scope activity); and

HAR section 16-77-71(a)(5) (RME responsible for violations committed by contractor).

Respondents agree to the voluntary surrender of Respondents’ licenses, which shall become effective immediately upon approval of this Settlement Agreement. Respondents also understand that they shall not apply for a new license until the expiration of at least five years from the effective date of the surrender of the licenses, and if they desire to become licensed again, Respondents must apply to the Board for a new license, pursuant to and subject to all applicable laws and rules in effect at the time. After discussion, it was moved by Mr. Polischeck, seconded by Mr. Matsuzaki, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

2. Board’s Final Orders a. In the Matter of the Application for a Contractor’s License

of Kip T. Woodrum, RME, of Network Power Solutions, Inc.; CLB-LIC-2014-002

Kip T. Woodrum of Network Power Solutions, Inc. requested a contested case hearing on the Board’s denial of his application for the C-13 Electrical classification. A hearing was held on February 26, 2015 and the Hearings Officer recommended that the Board affirm its decision to deny Mr. Woodrum’s application for the C-13 Electrical contractor’s license. The parties were provided an opportunity to file exceptions, but no exceptions were filed. After discussion, it was moved by Mr. Lee, seconded by Mr. Kagawa, and unanimously carried to adopt the Hearings Officer’s Final Order as the Board’s Final Order in this case.

pursuant to HRS chapter 91, Chairperson Akasaki announced that the Board was reconvening to its open meeting at 8:49 a.m.

Executive Session: At 8:50 a.m., it was moved by Mr. Konishi, seconded by Mr. Kamai, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in HRS section 26-9, and to consult with Rodney J. Tam, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:11 a.m., it was moved by Mr. Konishi, seconded by Mr. Kamai, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Recess: Chairperson Akasaki called for a short recess at 10:12 a.m. The Board reconvened at 10:20 a.m.

The agenda was taken out of order and continued with “Committee Reports, 6. Scope of Activity Committee”.

Committee Reports: 6. Scope of Activity Committee:

Nathan T. Konishi, Chairperson Shannon Barbour, Barbour Faux Finishes – Ms. Barbour is requesting determination on the license classification required to perform “faux finishing” and decorative painting with plasters, paints and glazes. Typically a primer set coat is applied, and then multiple layers of different plasters and/or glazes. The plasters are applied in a variety of ways; troweled, rolled, brushed, etc., and not all finishes have texture, as some are smooth. All finishes are for decorative purposes and serve no purpose in protecting a surface as in a “coating”.

Jeffrey Masatsugu on behalf of the Painting Industry of Hawaii Labor Management Cooperation Trust Fund (the “Fund”), a labor-management cooperation fund representing the International Union of Painters and Allied Trades, Painters Local Union 1791, testified that the Fund believes that the work described above requires the C-33 Painting and decorating contractor’s license.

Mr. Konishi stated that this matter is being deferred pending the submission of additional information on the surface(s) on which the “faux finish” is applied, whether the “faux finish” is applied to a finished wall, the

purpose of the base coat, and the specification data sheet on the materials used (including the base coat) and on the entire system.

Dave Terry, ATR Technologies, Inc. (“ATR”) – Mr. Terry is the RME for ATR Technologies, Inc. and both are licensed in the C-32 Ornamental, guardrail and fencing classification. Mr. Terry is requesting a determination on whether the C-32 contractor may install an aluminum frame guardrail system with a glass panel insert. The aluminum frame (posts, top rail and bottom rail) is the structural component that holds a glass infill panel. The same system will also hold insert panels made from plastic, wood, sheet metal, etc., depending on the project’s design.

Mr. Terry also asks that if the C-32 license cannot install this type of guardrail system, which classification is required to comply with the Board’s laws and rules. Dave Terry stated that he is the vice president and RME of ATR and has 30 years of experience installing this aluminum frame guardrail system. ATR is the manufacturer that has been in business for 52 years. He is also a structural engineer. Mr. Terry brought a small scale example of the aluminum frame guardrail system and explained that the prefabricated frame is installed first, then the glass is inserted into the frame and a close strip is put in place to hold the glass. The glass used is 1/4 inch to ¾ inches thick. The insert panels are also made of plexi-glass, wood, etc. Mr. Terry does not believe that safety is an issue because he has been performing this work for 30 years. Mr. Terry is on this project, a high rise in the downtown area, because the C-22 on the project decided that it did not want the job. The project owner asked him if he could install the railings. In order to install the railings, Mr. Terry applied for and obtained a C-32 license. All his work is installing railings and currently other states allow the C-32 to install this railing with glass inserts. Mr. Terry asked if he would quality for the C-22 license being that they do not do store fronts or other types of glazing work. He also asked if the Board would allow him to sit for the C-22 examination based on his 30 years of experience installing this aluminum frame guardrail system. The current project is underway and he would like to at least be able to continue and complete the project. He also stated that there is another similar project being performed by a C-32. He related that C-22 contractors did not bid on that job and it was awarded to the C-32. Mr. Lee asked if any caulking is required. Mr. Terry replied that there is no caulking – there are drain holes in the frame should rain get in the frame. It is not like a curtain wall that keeps water out. As the manufacturer, ATR provides the glass and frame. The frame is prefabricated to be assembled on the jobsite. Dwayne Arelliano of the Glaziers Union stated that he received letters of support for the C-22 from colleagues and glass owners, who are union and non-union shops. He also shared photos of various glass railings.

Mr. Arelliano stated that some of the things that Mr. Terry said are not correct. There were actually three C-22 licensees who bid on the project besides the C-32 licensees. He stated that Kula Glass bid on the project, and the C-22 that left the project was a signatory from the Big Island and left the project because there was an issue with the tie-backs and the railing area juts out a bit so this was an added cost to correct it.

Mr. Arelliano also stated that the aluminum frame guardrail system is a newer product; however, predominantly only glaziers install this type of system for safety reasons. Journeyman glaziers are trained for five years.

Mr. Lee asked if the three C-22 licensees bid on just the glass part or the railings also, and Mr. Arelliano replied that they bid on everything, the railing and the glass. California Glass with the C-22 was the leading railing company but they also got licensed in the C-32 because this came up.

Arnold Wong of the Ironworkers Stabilization Fund stated that Jayco was one of their signatories with the C-22 and C-32. He also testified that he believed that the C-22 is required.

Kika Bukoski, on behalf of the Hawaii Building and Construction Trades Council and Reginald Castanares, stated that they are in support of the glaziers and pointed out that the bidders, whether bidding on the glass work or the entire railing, all were licensed in the C-22 and C-32 classifications. Glen Kaneshige, President of Nordic PCL Construction, Inc. (“Nordic PCL”), submitted a letter to the Board yesterday and testified that it has been a past and customary practice of the installation of metal railings with an infill panel be performed by the C-32 contractors. The infill panel can be made of wood, metal, glass, or any other material, but the infill does not function to provide structural integrity of the metal railing system. He also stated that they are currently building two high-rises and should the Board decide that a C-22 is now required, it would be a departure from past and customary practice and would disrupt work that is currently in progress. He asked the Board to affirm that the installation of metal railings with glass infill are covered under the C-32 license.

Mr. Masatsugu stated that the rules are clear that any time you insert glass into a frame, it is glazing. Past history has been that the installation of glass falls under the C-22 licensees and those that did this type of work had both the C-22 and C-32. He asks for the specifics pertaining to any “incidental and supplemental” decision made by the Board.

Mr. Masatsugu also stated his concerns of potential conflict of interest that Board members may have as some are specialty or general

contractors, and some are public members affiliated with the construction industry.

Shannon Alivado of the General Contractors Association asked everyone to focus on Mr. Terry’s question and read the description of the C-32 classification. She emphasized that the C-32 description states the installation of all types of structural and non-structural units and “accessories”. The aluminum frame guardrail system is pre-fabricated and is not a safety issue. Ms. Alivado also stated that ATR has been doing this work in the United States and internationally. She asked that the Board answer Mr. Terry’s question in the affirmative.

Mr. Terry stated that according to DCCA’s licensee website, Jayco and Landsea do not have the C-22.

Mr. Konishi asked for the cost of the installation of glass. Mr. Terry stated that his approximate guess is that it costs $6.00 per linear foot of glass, with 15-20% of the cost of the job is for labor of the glasswork. The customer buys the structural system.

Mr. Lee asked if glass is “snapped in” for most aluminum railing systems. Mr. Terry responded that all aluminum frame systems that he is aware of are “snap in” glass and not wet glazing.

Mr. Arelliano stated that Mr. Terry is right that there are other railing systems that are “snap in”, but the ones in question are single pieces of glass that are put in separately, and the handling of the glass is a safety issue. They are not shipped as a unit, and each panel has to be taken out, cut to the right size, and glazed into the frame. The panels also have to be “spec’d out” correctly to withstand wind and some must be tempered and laminated. He stated that it is ludicrous to say that the C-32 can perform the installation of an aluminum frame guardrail system with a glass panel insert. Mr. Arelliano also stated that Jayco and Landsea are in fact licensed in the C-22 classification.

Mr. Lee asked Mr. Arelliano if this system did not have a glass insert would he be here today? Mr. Arelliano responded “no”.

Mr. Masatsugu asked Mr. Arelliano about the cost of the glass. Mr. Arelliano stated that usually the glass portion costs more than the metal railings. He also stated that maybe in this situation, there is minimal glass work, but there are other projects where glass is a major part of the system and is not an “accessory”. Mr. Arelliano stated that he spoke to Mr. Kaneshige, who is representing one of the project owners, and he agrees that a C-22 is required.

Mr. Kaneshige stated for the record that is not what he said to Mr. Arelliano. Mr. Kaneshige stated he did not say that a C-22 is

required. He stated that if the Board determined that a C-22 is required, they will apply for a C-22 license.

Mr. Leong asked Mr. Terry whether the glass insert is pre-fabricated or does it need to be cut to fit the frame? Mr. Terry responded that the glass is pre-fabricated and cut to fit the frame. Executive Officer Ito stated that the Board today received written testimony from Eric Hashizume, Vice President, Building Division, of Hawaiian Dredging Construction Company, Inc., that from their past projects and experience, believe the glass railing work be done by the C-32 contractor.

Recommendation: The C-32 Ornamental, guardrail, and fencing

contractor may install the pre-engineered, pre- fabricated aluminum frame guardrail system with various panel inserts, including glass panel inserts. The Board also noted that the C-32 is not precluded from subcontracting a C-22 Glazing and tinting contractor to insert the glass panels. Executive Officer Tamanaha also reminded Mr. Terry that he has to be in the State when the project is ongoing. Matt Tallacksen, Southern Acoustics – Mr. Tallacksen is requesting a determination on whether a contactor’s license is required to install Novawall Acoustic Wall Panels. The installation of the Novawall System includes stapling the Novawall trims to the drywall wall, stapling the fiberglass core, and tucking fabric into the Novawall trims. Mr. Masatsugu testified that custom wall painters feel it falls under the C-33 Painting and decorating or C-33a Wall coverings classifications as there is no finishing of the wall panels. Mr. Konishi related that the Scope Committee’s recommendation is that the C-1 Acoustical and insulation license is required.

Mr. Matsuzaki stated that the Board needs additional information on whether the finished product is installed or whether any on-site fabrication is required.

After a brief discussion, Mr. Konishi amended the Scope Committee’s recommendation to request additional information on the specific installation method of the stretched fabric. Matthew Maruyama, Board of Water Supply (“BWS”) – Mr. Maruyama requests a determination on the license classification required to install pump piping in a building, and verification of the Board’s prior ruling that all plumbing work within five feet of a building requires a C-37 Plumbing contractor’s license. Mr. Maruyama stated that he is a mechanical engineer and project engineer for BWS. They feel the C-37 is required as it covers all plumbing work and any incidental work that may come up. The project requires replacing the pump and piping, dewatering and draining water in existing lines and chlorinating the water. He clarified that the project also includes the installation of a pumping unit and valves, instrumentation gauge board, safety switches, replacing starters and wires which involves some electrical work, and chlorinating and sanitizing lines before putting it into service. They did not receive any pre-bid questions or concerns. Mr. Maruyama stated that a contractor had mentioned that the Board had made a prior determination that all plumbing work within five feet of a building requires a C-37 license. Matt Brady of the Plumbers and Fitters UA Local Union 675 stated that the C-37 covers the gamut of all plumbing work, but they must follow HRS chapter 448E for work within the building. He also stated that HRS chapter 448E of the Board of Electricians and Plumbers (“E&P”) requires one licensed plumber to one apprentice be on the job. Executive Officer Tamanaha corrected Mr. Brady that the one to one ratio is under HRS chapter 444, the Contractors License Board’s law. Mr. Kagawa stated that the five feet requirement is referred to in the E&P law and the Board only has jurisdiction to determine which contractor’s license is required to do certain types of work. The C-37 classification describes work that is performed within property lines.

Recommendation: The C-37 Plumbing or C-37e Treatment and pumping facilities contractor may install pump piping in a building. The Board also clarified that the C-37 and all C-37 sub-classification licensees (i.e., C-37a to C-37f licensees) may perform work within and up to the property lines. However, plumbing work that is performed within five feet of a building must be performed by an individual licensed pursuant to Hawaii Revised Statutes chapter 448E. Patrick Chun of BWS asked if the contractor who only has the C-37e can bid this work. The Board responded that the C-37 or C-37e contractor may perform this work, and as the project owner, it is their prerogative to state the classification that can bid on the project. Ryan Ward – Mr. Ward is requesting determination on whether a C-37e Treatment and pumping facilities contractor may replace existing pumps in a pump facility. The building, which houses the pumps, is not occupied by people. Recommendation: Yes, the C-37e contractor may replace the existing pumps in a pump facility. Gregg Serikaku of PAMCA asked for confirmation that the five feet rule is under HRS chapter 448E. The Board confirmed that the five feet rule is in the rules of the Board of Electricians and Plumbers.
