Call to Order: There being a quorum present, Chairperson Polischeck called the meeting to order at 8:30 a.m.

Chapter 91, HRS, Adjudicatory Matters: Chairperson Polischeck called for a recess from the Board’s meeting at 8:35 a.m.

to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements a. In the Matter of the Contractors’ Licenses of Hardesty & Associates, Inc.,

and William S. Hardesty; CLB 2015-173-L Respondents Hardesty & Associates, Inc. (“Respondent Hardesty & Associates Inc.) and William S. Hardesty (“Respondent Hardesty”) are licensed under license numbers CT-21976 and CT-21977, respectively. Respondents licenses were issued on May 18, 1999; and expires on September 30, 2018. At all relevant times herein, Respondent Hardesty was the responsible managing employee for Respondent Hardesty & Associates, Inc. RICO received a complaint alleging that Respondent Hardesty was not in residence in the State of Hawaii during the time periods in which Respondent Hardesty & Associates, Inc. was working on a project to construct the Sketchers stores at the Ala Moana Shopping Center in Honolulu, Hawaii and at the Waikele Premium Outlets in Honolulu, Hawaii. If proven at an administrative hearing, the allegations would constitute violations of the following rules:

• HAR 16-77-71(a)(4) (RME shall be in residence in Hawaii during the period the project is under construction; and

• HAR 16-77-71(a)(5) (RME shall be responsible for any violation of HAR). Respondents do not admit to violating any law or rule, and agree to pay an administrative fine in the amount of $10,000.00. After discussion, it was moved by Mr. Lee, seconded by Mr. Isemoto, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

2. Board’s Final Order

a. In the Matter of the Contractor’s Licenses of Guy M. Menor and KFP Enterprises, LLC; CLB 2014-12-L

Respondents Guy M. Menor (“Respondent Guy M. Menor”) and KFP Enterprises, LLC (“Respondent KFP Enterprises, LLC”) are licensed under license numbers CT-20221 and CT-29415, respectively. Respondent Guy M. Menor’s license was issued on February 16, 1996; and is set to expire on September 30, 2018. Respondent KFP Enterprises, LLC’s license was issued on October 20, 2008; and is set to expire on September 30, 2018. On or about August 30, 2013, Respondents entered into an Authorized Service Agreement with Sears, Roebuck and Co. (“Sears”) in which Respondents agreed to provide installation services for appliances sold by Sears. Water heaters sold by Sears in 2013 and 2014 were installed by Respondents’ employee, Alan Sherman. At all relevant time herein, Sherman was not a licensed contractor. The Hearings Officer recommends that the Board find and conclude that there are no genuine issues of material fact, and that the Petitioner is entitled to, as a matter of law, to an order concluding that Respondents violated the following laws:

• HRS 444-17(12) (Wilful failure in any material respect to comply with this chapter or the rules adopted pursuant thereto);

• HRS 444-17(17) (Entering into a contract with an unlicensed contractor involving work or activity for the performance of which licensing is required under this chapter;

• HRS 436B-19(6) (Aiding and abetting an unlicensed person to directly or indirectly perform activities requiring a license;

• HRS 436B-19(7) (Professional misconduct, incompetence, gross negligence, or manifest incapacity in the practice of the licensed profession or vocation;

• HRS 436B-19(8) (Failure to maintain a record or history of competency, trustworthiness, fair dealing, and financial integrity);

• HRS 436-B-19(12) (Failure to comply, observe, or adhere to any law in a manner such that the licensing authority deems the applicant or holder to be an unfit or improper person to hold a license; and

• HRS 438B-19(17) (Violating this chapter, the applicable licensing laws, or any rule or order of the licensing authority).

For the violations found, the Hearings Officer recommends that Respondents’ contractors’ licenses be revoked and that Respondents be required to immediately submit all indicia of licensure as a contractor in the State of Hawaii to the Executive Officer of the Board. The Hearings Officer also recommends that Respondents be ordered to pay a fine of $1,000.00. After discussion, it was moved by Mr. Lee, seconded by Mr. Konishi, and unanimously carried to approve the Board’s Final Order in the above case.

Following the Board’s review, deliberation and decisions in these matters, pursuant to HRS chapter 91, Chairperson Polischeck announced that the Board was reconvening to its open meeting at 8:40 a.m. Committee Reports: 1. Scope of Activity Committee Nathan T. Konishi, Chairperson

a. Regulated Industries Complaints Office

Requests a determination on what classification(s) is required to install a bowling alley.

b. G. Joe Pries

Requests a clarification on the scope of work for C-33 (Painting/Decorating) vs. C-42 (Roofing) contractor. He understands that a C-33 license cannot apply paint to a roof (metal roof) on a commercial or residential building, and that it is necessary for a C-42 contractor to apply paint to a metal roof. Is he correct?

Mr. Jeffrey S. Masatsugu, Painters Labor Management Fund, stated that a C-33 Painting and decorating contractor’s license can apply paint to a roof (metal roof) on a commercial or residential building. Mr. Dean Nagatoshi, Painting and Decorating Contractors of America, Hawaii Council (PDCA of Hawaii), agreed with Mr. Masatsugu’s statement and offered to answer any questions.

c. Department of Land & Natural Resources (“DLNR”)

Requests a determination whether an "A" licensed, general engineering contractor can perform rockfall mitigation work for DLNR Job No. F54C658C Wailua River State Park Rockfall Mitigation, Wailua, Kauai. Hawaii State eProcurement (HlePRO) Solicitation No. B 17002077 was released on June 26, 2017 for the installation of temporary safety/catchment fence, vegetative clearing, and installation of a ring net drapery system to prevent falling rocks. Due to the nature of this work, DLNR is requiring that bidders possess a valid State specialty contractors

license, C-68RL.

Mr. Brian Chang, DLNR, stated that the Wailua River Rockfall site is a 300-foot high steep slope with major landscaping and rocks hanging loose at the bend. This puts the safety of the public at risk because people are kayaking below this slope. The ring net drapery is the primary rockfall mitigation system in this project. The installation of the ring net drapery system requires special expertise not only for the safety of the public, but also for the workers who are working at heights on ropes. The ring net drapery system is extremely heavy and is installed with a large number of anchors. This system has been inspected by the City and County and their team of experts. The ring net drapery system is 70 feet wide and 290 feet long.

Mr. Chang related that an “A” General engineering contractor is asking if they can perform the rockfall mitigation work without the C-68RL Rockfall mitigation classification. It is Mr. Chang’s understanding that the C-68RL Rockfall mitigation contractor is required to perform this work. If the “A” General engineering contractor bids on the project it must subcontract to the C-68RL Rockfall mitigation contractor due to the specialized expertise required and safety issues involved in this project. Mr. Chang asked the Board if the “A” General engineering contractor can self-perform the rockfall mitigation work. The Board asked if the solicitation requires bidders to list other qualifications or previous experience to perform the work. Mr. Chang responded no, because it causes bid protests. Mr. Chang stated that contractors that want to perform rockfall mitigation should just get the C-68RL Rockfall mitigation contractor’s license. He believes that the crew and the public are put at risk if the contractor does not have the C-68RL Rockfall mitigation classification. The Board stated that the C-68RL Rockfall mitigation classification is the correct license for this project and noted that the project owner is requiring a C-68RL Rockfall mitigation contractors license for this specific project.

d. Ronald Goff

Requests a determination on whether his ES license allows him to pull an owner-builder electrical permit for a photovoltaic installation on his home even though he is not on title as the legal property owner or lessee. He and his wife of 30 years both live fulltime at this residence. The mortgage and deed are in his wife’s name.

e. Jim Palumbo

Requests a confirmation that aluminum sunshade installation indeed does fall within our C-22 jurisdiction. To his knowledge the aluminum sunshades would fall under "products affiliated with the glass and glazing industry" since it is manufactured, fabricated, and supplied by our

aluminum window framing/glazing supplier to match the windows that will be installed on this project. The closest mention of “sunshades” or “aluminum sunshade” would be "metal awning" or "roller shade" which neither of these items preform the same function as a "aluminum sunshade". Mr. Jim Palumbo, Diamond Glass and Metals LLC, stated that he has been installing aluminum sunshades for the past 20 years and all the aluminum sunshades come from the window manufacturer to match the window frame. The Board noted that aluminum sunshades can be mounted to the window frame or above the window frame; and asked if he is only mounting the aluminum sunshades to the window frame. Mr. Palumbo stated that there are two types of sunshade installation: curtain wall frame which is attached to the window frame; and sunshades that are made to match the window frame and go above the window. The Board asked Mr. Palumbo to clarify whether the sunshades that go above the window are anchored to blocking in the wall of the building. Mr. Palumbo responded, yes. Mr. Jeffrey S. Masatsugu, Glaziers Stabilization Fund stated that he supported Mr. Palumbo’s position that the installation of aluminum sunshades is within the scope of the C-22 Glazing and tinting contractor as it is an allied product affiliated with the glazing industry. He distributed photographs showing the sunshades installed by C-22 Glazing and tinting contractors and went on the say that the C-22 description does not restrict where allied products affiliated with the glazing industry can be attached. Mr. Masatsugu also offered to have a representative from the Stabilization Fund testify, at a future meeting, that his company has long history of experience installing sunshades on to buildings. f. Regulated Industries Complaints Office

Requests a determination whether the following work is “incidental and supplemental” to the C-5 Cabinet, millwork, and carpentry remodeling and repairs classification or out-of-scope:

A C-5 contractor completed a kitchen/bathroom remodel, and in the process replaced an 8’ 4X12 beam in the kitchen ceiling. The joists were required to be raised slightly to install the beam and inadvertently cracked a wall in the unit above.

g. University of Hawai’i at Hilo Requests a determination whether a C-2 Mechanical Insulation Contractor can perform the removal and installation of formed metal wall panels as “incidental and supplemental” to the installation of the thermal insulation. Mr. Michael Lum, University of Hawai’i at Hilo (“UH”) stated that the metal siding and thermal insulation would be stripped from the UH telescope Mauna Kea domes and new thermal insulation would be installed.

Mr. Konishi asked if the exterior panels would be removed. Mr. Lum answered, yes. Mr. Kagawa asked why the panels were being removed. Mr. Lum answered that the panels are removed to access the thermal insulation. He went on to say that the contractor would be using most of the existing girts and replacing some aluminum with steel. Mr. Konishi asked which contractor would be replacing the girts. Mr. Lum answered that the general contractor, Bodell Construction, has a C-48 Structural steel classification and will be installing the girts.

Executive Session: At 9:01 a.m., it was moved by Mr. Isemoto, seconded by Mr. Lee, and

unanimously carried to enter into executive session pursuant to HRS section 92-5(a)(1) to consider and evaluate personal information relating to individuals

applying for professional or vocational licenses cited in HRS section 26-9, and to consult with James C. Paige, deputy attorney general, on questions and issues pertaining to the Board’s powers, duties, privileges, immunities, and liabilities pursuant to HRS section 92-5(a)(4).

At 10:33 a.m., it was moved by Mr. Konishi, seconded by Mr. Isemoto, and

unanimously carried to move out of executive session and to reconvene to the Board’s regular order of business.

Committee Reports: 1. Scope of Activity Committee Nathan T. Konishi, Chairperson

a. Regulated Industries Complaints Office

Requests a determination on what classification(s) is required to install a bowling alley.

Recommendation: The C-25 Institutional and commercial equipment or “B” General building contractor’s license is required to install the bowling alley system, provided that the C-25 contractor cannot make any modifications to the building’s structural components; and the C-13 Electrical contractor is required for any electrical work. b. G. Joe Pries

Requests a clarification on the scope of work for C-33 (Painting/Decorating) vs. C-42 (Roofing) contractor. He understands that a C-33 license cannot apply paint to a roof (metal roof) on a commercial or residential building, and that it is necessary for a C-42 contractor to apply paint to a metal roof. Is he correct?

Recommendation: Mr. Pries’ understanding as stated above is not correct; and that both the C-33 Painting and decorating and the C-42 Roofing contractor may apply paint to a metal roof on a commercial or residential building.

Recommendation: The C-22 Glazing and tinting contractor may install aluminum sunshades that are incorporated into the design load of the window frame system.

Requests a determination whether the following work is “incidental and supplemental” to the C-5 Cabinet, millwork, and carpentry remodeling and repairs classification or out-of-scope:

A C-5 contractor completed a kitchen/bathroom remodel, and in the process replaced an 8’ 4X12 beam in the kitchen ceiling. The joists were required to be raised slightly to install the beam and inadvertently cracked a wall in the unit above. Recommendation: Replacing an 8’ 4X12 beam in the kitchen ceiling involves changes or additions to the building's or structure's basic components and is not in the scope of the C-5 Cabinet, millwork, and carpentry remodeling and repairs contractor.

g. University of Hawai’i at Hilo Requests a determination whether a C-2 Mechanical Insulation Contractor can perform the removal and installation of formed metal wall panels as “incidental and supplemental” to the installation of the thermal insulation.

Recommendation: The installation of the formed metal wall panels is not “incidental and supplemental” to the performance of the C-2 Mechanical insulation contractor’s installation of the thermal insulation on the Modernization & Repair of UH Telescopes on Mauna Kea Project (“Project”); and that the C-1 Acoustical and insulation classification is the appropriate classification to perform the thermal installation work on the Project.

Correspondence: Siemens Corporation requests the return of a Parent Guaranty Agreement

In 2005, Siemens Corporation executed a Parent Guaranty Agreement (“Agreement”) for the benefit of the State of Hawaii Contractors License Board (“Board”) for the benefit of its then wholly-owned subsidiary, Siemens Logistics and Assembly Systems, Inc. The Agreement was provided a s a condition of the Board to issue a contractor’s license to Siemens Logistics and Assembly Systems, Inc. which was effective December 1, 2005 and expired on September 30, 2006. Siemens Corporation requests the return of the Agreement.
