HAJJ CONTRACT & LIABILITY

EXCLOSION OF LIABILITY AND INDEMNITY

Where as Baggia Travels/A&A Travels located at 1450 Midland Ave # 202A Toronto Ontario M1P-4Z8, it’s officers, directors, employees, servants and volunteers, is in the business of providing Hajj and Umrah services and assisting the pilgrims to perform their Hajj and or Umrah in Saudi Arabia.

And Whereas you are entering into a legally binding agreement with Baggia/A&A Travels to provide the services.

And Whereas you confirm that you have been advised by Baggia/A&A Travels and that you recognise that Baggia/A&A Travels does not own, manage ,control, or operate any transportation vehicle, hotel, resort, restaurant, and other supplier, and is therefore not responsible for their acts and omissions and mistakes.

And Further Confirm that you have been advised that Baggia/A&A Travels conducts all its religious services under the Sunni Hanafi Thoughts of School. And that I may request special guidance under different School on a personal basis.

Now Therefore in Consideration of Baggia/A&A Travels providing the Services, I agree as follows

The responsibilities of Baggia Travels/A&A Travels as the tour operator or their agents are limited.

Baggia Travels/A&A Travels acts only as an agent for the passengers in all matters relating to travel arrangements and for the various companies over the lines of which tickets are available and the tours operate. i.e., airlines tickets, hotels,buses or any other services in connection with their tour. And as such, assumes no responsibility for any delay, change in schedule, loss, injury and damage to, or in respect to any persons or properties however caused or arising in connection with the services of any trains, vehicles, carriers, aircraft, motor or other conveyances or hotel which may used, whether wholly or in part in the performance of its duty to the passengers.

Baggia/A&A Travels assumes no liability whatsoever for injury, damage, loss, accident, delay or irregularity, whether physical or mental which may be occasioned either by reason of defect, through the acts or defaults of any company or person engaged in conveying passengers or in carrying out the arrangements of the tour, or as a direct or indirect result of acts of God, dangerous incidents in the air, sea, fire, breakdown in machinery or equipment, acts of governments or other authorities de jure or de facto, war, whether declared or not, hostilities, civil disturbances, strikes, riots, theft, pilferage, epidemics, quarantines, medical or customs regulations, or any act, omissions, negligence or commissions of any part supplying any of the services or accommodation, it’s agents, servants, employees, sub contractors or volunteers, or from any causes beyond Baggia/A&A Travels control, or from any loss or damage resulting from improper passports, visas, PR cards or other documents.

Baggia Travels/A&A Travels will not be responsible for failure to follow instructions, including but not limited to check-in and check-out times and baggage handling. In the event of flight delay or miss connection, it is the responsibility of the airlines to determine exactly what procedure will be followed. Baggia Travels/A&A Travels takes no responsibility of any additional costs due to delay of meals or failure to provide meal due to circumstances beyond their control during Hajj, Umrah or miss connection of confirm flights, baggage delay or transit layover hotel accommodations. All additional costs will be solely the responsibility of the passenger and Baggia/A&A travels will not be liable.

The policy chosen by that carrier shall be based on its procedures and shall not be the responsibility of Baggia Travels/A&A Travels and its affiliates will not be responsible for any person's missing any part of the program due to

his negligence or delay or absenteeism for anytime during the tour and will not be responsible for any additional expenses for the participant to rejoin the tour.

No refund will be given for any services rendered and not utilized. Reservations should be made with a package price payment in full. A valid passport and a deposit in the amount of _________, is due at the time of booking, booking without the above will not be considered final. All other Hajj required documents are due as will be requested at time of booking. Passenger's package payment will be refunded, minus $300 administration fee, if cancellation is received in writing 90 days prior to departure. No refunds will be provided if we receive the cancellation notice less than 60 days prior to the departure date without any exceptions.

I Further agree to release and forever discharge Baggia/A&A Travels from any and all actions, causes of action, claims and demands for upon or by reason of any damage, loss or injury to me and my property which may be sustained in consequence of the losses and expenses as aforementioned.

I Further agree to Indemnify and save harmless Baggia/A&A Travels against and from any and all claims and demands, actions and claims for contribution or indemnify, whether under any statute or otherwise, which may be made or brought against Baggia/A&A Travels including the costs of defence of such action and claim, as any such claim or demand relate to my Hajj/Umrah pilgrimage.

I further agree that Baggia/A&A Travels shall not be required to provide any refunds or adjustments for portions of the services not taken or used by me.

I further agree that I will comply with any reasonable directions and instructions issued to me by Baggia/A&A Travels or any of its representatives relating to the services.

I further agree that Baggia/A&A Travels shall have the exclusive right to withdraw or alter any arrangements in respect to my Hajj/Umrah pilgrimage, as it may be deem fit, no reasoning or explanation may be required for such actions and no refund will be made by Baggia/A&A Travels as a result of any such withdrawals or arrangements or for any unused.
