Remember: Positive treatment is preferable, but negative treatment can still be used. You need to check which parts of the case have resulted in the negative treatment. You can still use other parts of the case which are not part of that treatment.

Parts of the CaseBase Entry

• CaseBase (and FirstPoint) are great resources as they summarise the case, and list for us which cases have been mentioned in the judgement as well as what signal they are given.

It means that you don’t have to read the judgement to see the following things:

• Catchwords and Digest: Catchwords identify the main areas of law dealt with and provide the legal context of the primary case. The Digest summarises the findings and main points of law of the case.

• Cases referring to this case: Cases later than this case that have considered this case. The annotation appearing before the case name indicates how the primary decision was treated in each of these cases.

• Cases considered by this case: Cases that were referred to or considered by the primary case are listed under this heading.

• Legislation considered by this case Listed here are the legislative provisions referred to in the primary case.
