ID and the Bidder’s PCAB ID as indicated in the email subject and filename of the

OPENING OF BID

The BAC Secretariat must download the electronic bid from the eBid Portal and open

it using the password provided by the bidder during the actual bid opening.

(Section 4.2.b of GPPB Res. No. 9-2020). The password shall only be disclosed by the bidder

verbally or in writing during the actual opening which may be done in person or through

videoconferencing, webcasting or other similar technology available.

The password protected archive file (technical and financial proposal) submitted must be

opened using the password provided by the bidder and must be successfully

opened/accessed by the BAC.

Bidder shall be given a maximum of three (3) attempts or a period of 15 minutes,

whichever comes first to provide correct password, except in unforeseen justifiable

circumstances, otherwise the bidder shall be disqualified. The bidder may also be subjected

to sanction under D.O 17 series of 2015 (strike policy) as may be warranted under

circumstances.

For a hybrid system of submission where electronic and manual bids were received for a

particular Contract, electronic bids must be opened first before the manual bids. The

same applies to the Technical and Financial archive files in the electronic bids, which shall

opened prior to the Technical and Financial Envelopes in the manual bids.

If a bidder committed typographical errors in the submission of electronic bid, and/or

attached files in the wrong format (e.g. not password-protected), the bid shall be accepted,

provided that the bidder or its duly authorized representative shall acknowledge such

condition of the bid as submitted. The BAC shall assume NO responsibility for the

misplacement of the contents of the improperly sealed or marked bid, or

improperly compressed or password-protected folder, or for its premature

opening.

As additional security feature, downloading of submitted electronic bids and other attachment

directly from the email shall be disabled, and will be allowed only thru the eBid Portal.

If an electronic bid or file was found to be damaged and could not be

extracted/opened, the bid shall be considered “Failed”.

In case of a non-participation and withdrawal of bids, the BAC Secretariat shall check the

Legal Documents 1. Valid PhilGEPS Registration Certificate(Platinum Membership) – all pages 2. Registration Certificate from the Securities and Exchange Commission (SEC), Department of

Trade and Industry (DTI) for sole proprietorship or Cooperative Development Authority (CDA) for cooperatives or its equivalent documents.

3. Mayor’s or Business Permit issued by the City or Municipality where the principal place of business of the prospective bidders is located, or the equivalent document for Exclusive Economic Zone or Areas

4. Tax Clearance per EO No. 398, s. 2005 as finally reviewed and approved by Bureau of Internal Revenue.

TECHNICAL DOCUMENTS

1. Statement of prospective bidders of all its on-going government and private contracts, including contracts awarded but not yet started, if any, whether similar or not similar in nature and complexity to the contract to be bid, and

2. Statement of bidder’s Single Largest Completed Contract (SLCC) similar to the contract to be bid,

except under conditions provided under the rules, and 3. Philippine Contractors Accreditation Board (PCAB) License or Special PCAB License in case of

Joint Ventures 4. Original Copy of Notarized Bid Security, if in the form of Surety Bond, submit also a certification

issued by Insurance Commission; or Original Copy of Notarized Bid Securing Declaration (Form DPWH-INFR-09, 19, or 11, as applicable

Bid Securing Declaration (using Form DPWH-INFR-12) or any form of Bid Security in an amount equal to a percentage of the ABC in accordance with the following schedule (IRR Section 27.2):

1. Cash or cashier’s/manager’s check issued by a Universal or Commercial Bank - 2% of ABC

2. Bank draft/guarantee or irrevocable letter of credit issued by a Universal or Commercial Bank

(Use Form DPWH-INFR-10 or 11) - 2% of ABC

3. Surety bond callable on demand issued by a surety or insurance company duly certified by

the Insurance Commission as authorized to issue such security - 5% of ABC

o Bids and bid securities shall be valid within 120 calendar days from the opening of

bids and it should be specified within the bid security.

5. Project requirement which shall include the following:

a. Organizational Chart for the Contract to be Bid ((Form DPWH-INFR-12)

b. List of Contractor’s Key Personnel (e.g. Project Manager, Project Engineer, Materials

Engineer and Foreman) to be assigned to the contract to be bid with their complete

qualification experience date (Form DPWH-INFR-13)

c. List of Contractor’s Major Equipment units, which owned, leased, and/or under purchase

agreements, supported by proof of ownership or certification of availability of equipment

from the equipment lessor/vendor for the duration of the project, as the case may be, (For

DPWH-INFR-14)

d. Original duly signed Omnibus Sworn Statement (OSS), Form DPWH-INFR-15

e. And if applicable, original notarized Secretary’s Certificate in case of a corporation,

partnership or cooperative; or Original Special Power of Attorney of all members of the joint

venture giving full power and authority to its officer to sign the OSS and do acts to represent

the Bidder

Class “B” Documents

If Applicable, Duly signed Joint Venture Agreement (JVA) in accordance with R.A No. 4566

and its IRR in case of the joint venture is already in existence

THE FINANCIAL COMPONENT ENVELOPE

The Financial Proposal shall contain the following:

1. Original of duly signed and accomplished Financial Bid Form

2. Original of duly signed Bid Prices in the Bill of Quantities (Forms DPWH-INFR-16 and 17)

3. Duly accomplished Detailed Estimates For, including Summary Sheets indication the unit

prices of construction materials, labor rates and equipment rental used in coming up with the

bid and

4. Duly Signed Cash Flow by Quarter (Form DPWH-INFR-18)

REMINDER TO BIDDERS

There should be table of contents and then documents should be paginated and bookbinded

with ear tags pursuant to D.O. 90 series of 2002.

Duly signed Proposal booklet should be attached in the Technical Envelope

There should be documentary stamps on bidders bond and all other notarized documents. No

documentary stamp would mean outright rejection of the bid

Materials Engineer should be accredited and certificate of accreditation should be updated,

intended for the specific project

The estimates and the summary sheet must be in detail

The Contractor’s authorized representative must present their valid company and any

government-issued ID.

Duly Notarized Affidavit of Site Inspection.

The Construction Safety & Health Program intended for the specific project only must be

attached in the technical documents. The Construction Safety & Health Program should also

be complete and in accordance with DOLE Checklist and DOLE D.O. no. 13 series of 1998. It

includes the DOLE Application Form, Construction Safety & Health Officer, First Aider, TESDA

Certificate of Heavy Equipment Operator and/or Critical Workers, Testing & Inspection of

Heavy Equipment (if applicable), and other pertinent documents for the approval of the

program.

Updated CPES rating or latest certification coming from the CPES that no rating was

conducted for the past years, intended for the specific project to be bid.

Include the minimum materials testing equipment in the technical documents pursuant to

D.O. no. 80 series of 1990 and reiterated in D.O. 138 series of 2015.

Clear photocopies of TIN ID and latest PRC ID of the Project Manager, Project Engineer and

Materials Engineer assigned to the project to be bid. It will be used as a reference in updating

details in the CWA.

Engr. Derada read the CRITERIA OF ELIGIBILITY SCREENING, PRELIMINARY

EXAMINATION OF BIDS, EVALUATION OF BIDS AND POST QUALIFICATION

1. As per 2016 Revised IRR of RA 9184 and latest GPPB, Issuances The first envelope

shall be opened to determine the compliance with the documents required to be

submitted for eligibility and for the technical requirements as prescribed in the IRR.

The BAC checked the submitted documents of each bidder against the checklist of

requirements to ascertain if they are all present, using pass/fail criterion. For every

document required that is present, it shall be rated “passed”, but in case of failure to

include any of the requirements resulting to incomplete required document, it shall

be considered “failed”. Otherwise, the BAC shall rate the first envelope “passed”.

2. Immediately after determining the compliance of the first envelope, the BAC shall

open the second envelope or the Financial documents using again the Pass/Fail

criterion in determining compliancy based on the checklist requirements

3. When the bid price exceed the Approved Budget for the Contract (ABC), it is

automatically rated as “Failed”.

4. All bids shall be subject for evaluation and the Lowest Calculated Bid or the Highest

Rated Bid shall undergo post-qualification to determine whether the bidder concerned

complies with and is responsive to all the requirements and condition as specified in

the bidding documents

ADDITIONAL INFORMATION

ENTERING INTO CONTRACT REQUIREMENTS TO BE COMPLIED BY THE WINNING BIDDER

1. Construction Methods (Use Form DPWH-INFR-45)

2. Construction Schedule in the form of Precedence Diagram and Bar Chart with S-Curve and
