As I write to all of you from here, I am overwhelmed looking at what all we have managed to achieve in the very first two months of 2014! The month of January marked the completion of 5 years of RE/MAX in India, quite a milestone for each one of us and we at RE/MAX India are extremely thankful to all the Regional Owners, Regional Staff, Broker Owners & Broker Associates who joined us for the celebrations on the 19th, it was indeed a fun filled event. The celebrations were followed by a Regional Owners Review Meet wherein discussions on franchise sales, staff recruitment and training took center stage. In addition to the 5th Anniversary celebrations, another big milestone achieved in the month of January was the launch of a full fledged Agent Training program by the RE/MAX Academy of Real Estate for which a Train-the- Trainer with all the regional representatives was done and the first batch was launched successfully for Agents of RE/MAX Delhi NCR. This Agent training program will be replicated in each of the regions by the regional trainers. I am sure that each one of you will benefit from this excellent initiative taken up by our training team at the Headquarters. During the same time as the Train-the-Trainer for the Agent training program was conducted, we also had a Franchise Sales workshop which was conducted for Franchise Sales Consultants from the regions. February turned out to be an out and out training month for us at the National Headquarters which saw the first couple of weeks of the Continuing Agent training program being conducted as well as 5 days of Regional Owners Management training and 6 days of Franchise Owners Management training. While we had different sets of individuals getting trained with us at our Headquarters, we also had a group of Regional Owners/Directors comprising of Sahil Kapoor, Manan Choksi, Raj Koneru, C K Taneja & Joshua from India go to the World Headquarters for Regional Owners Management training which I am sure would have left them enriched and highly motivated. With the recent approval of the Real Estate (Regulation & Development bill) 2013 in the Union Cabinet, we can now look forward to words like timely delivery of projects, fair play in real estate, protection of the customers interests becoming a reality and our vision at RE/MAX India of professionalizing the Real Estate industry would be further complemented by this bill. The month of January marked the completion of 5 years of RE/MAX in India, quite a milestone for each one of us and we at RE/MAX India are extremely thankful to all the Regional Owners, Regional Staff, Broker Owners & Broker Associates who joined us for the celebrations on the 19th, it was indeed a fun filled event. From the Vice Chairman’s desk I still can’t believe that we have completed five years, it really does seem like it was yesterday when we signed our first few Master Regional Franchises, did our first convention in Jim Corbett with our first 100 Affiliates, won our first award as the “Fastest

growing Real Estate Franchises” and so on…when we look at the past 5 years, both Sam & I feel really proud of what all of us have been through together and achieved. It is for this very reason that we decided to pen down all of it in a magazine called “Exploring the journey so far”. The magazine is actually a treat to read as it really is a trip down the memory lane for all of us, so if you haven’t got your own copy yet then please get in touch with our team at the Headquarters. I would like to make a mention of the special guests who joined us for our 5th year celebrations at the Headquarters which did not only include the Regional Owners & Regional Staff but a few special Franchise

Owners like Anand, Prashant & Rohitraj as well. It was a pleasure having all of them join us for the celebrations! The newsletter of January & February talks about some new features that have been added on the website like the sellers portal, newsroom etc which you can check out in the “What’s new in marketing” section. We also have a special feature in our spotlight section on Mukundrajan who was declared as the winner of the “Most Promising Broker” for 2013 for crossing the 20 Agents mark. We hope you find reading all this and a lot more of regional and national updates interesting and informative! RE/MAX India celebrates its 5th Anniversary! The think tanks meet for Q1 Regional Owners Review Meet!

We express our sincere thanks to all the members of the RE/MAX family who joined us for the 5th anniversary celebrations, your presence made the event a fun filled networking event. The Chairman’s speech at the event had everyone in attendance reminiscing about the journey of 5 years that RE/MAX India has been through, his talk had each one of us reliving all the moments of happiness, struggle, splendor and challenges that we have faced in our journey so far and ensured that we were longing for making the coming years as much fun as the first five. . We would like to extend a special thank you to Larry Oberly, Vice President – Global Development for spending some quality time through a webinar with the Regional Owners & Regional Staff. His motivational talk and appreciation of the work put in by the Chairman, Vice Chairman & the Regional Owners had all of us pumped up and rearing to achieve our goals in 2014. Cheers to the next five!

RE/MAX India organized it’s Q1 Regional Owners Review Meet at its National Headquarters post its 5th Anniversary celebrations. The meeting was attended by Sam Chopra, Saloni Chopra, Manpreet Grewal, Puneet Verma, Sahil Kapoor, Anmol Aggarwal, Manan Choksi, Aashil Patel, Bakianathun, Raj Koneru, Sumanth, Pranav Pandya, and some special guests like Anand Choksi, Rohitraj Keswani, Prashant Nair & Sukhjinder. The meeting focused basically on team recruitment and franchises sales. There were sessions taken up by Manpreet Grewal & Puneet Verma and also by some of the Regional Owners and Broker Owners on sharing of best practices from their regions & broker offices respectively. The team of Regional Owners had a good fulfilling day learning, networking, posing in RE/MAX jackets and spending some quality time at the Headquarters. We look forward to seeing the think tanks get together on the 11th of April in Ahmedabad for the Q2 Regional Owners Review Meet.

Inviting women Realtors in Indian Real Estate! With the wonderful thought of getting the people who actually are responsible for “making a house into home” to the brokerage business, Manpreet Grewal along with Monika Patni, Broker Owner of RE/MAX Realty Investmart, Gurgaon conducted a session at the RE/MAX India Headquarters wherein aspiring women entrepreneurs, housewives and stay-at-home moms were invited and were shown the vision of achieving their dream of becoming independent and successful entrepreneurs by joining the Real Estate brokerage business. The session highlighted the fact of how flexi timings and the chance to be your own boss with RE/MAX can help them achieve their dreams and still maintain a healthy work-life balance. The session was very well received and two of the attendees

are already in the process of joining Monika and Manish’s office. RE/MAX India joins hands with C K & Raashi Taneja as the Regional Owners of RE/MAX Haryana!

Regional Owners/ Directors get trained at the World Headquarters!

With training being an integral part of the RE/MAX philosophy for success, the month of February saw Raj Koneru, Sahil Kapoor, Joshua, C K Taneja and Manan Choksi visit the world headquarters to attend the Regional Owners Management training. The training was thoroughly enjoyed by each one of the attendees and it prove to be just the very thing required by them to either kick start their regions or take their regions to the next level of success. It was great to see Regional Owner/Directors like Manan Choksi & Sahil Kapoor go back to the classroom in order to re-train and re-energize themselves! We wish each one of them all the very best for 2014!

National Webinars Franchise Sales Workshop

The months of January & February saw a number of online webinars being conducted by RE/MAX Academy of Real Estate on various topics like “Working with sellers”, “Optimize your online marketing using facebook” and new joinee webinars for all the new members that joined the RE/MAX family in January & February. A number of such more webinars are in schedule for the coming months as well. So, stay tuned for the webinar e-mailers from the Headquarters for more information and ensures maximum participation from your regions!

The month of January saw multiple training sessions being conducted at the RE/MAX India Headquarters, one of which was exclusively on franchise sales conducted by Puneet Verma, Sahil Kapoor, Parul Chaudhary and Anmol Aggrawal which was attended by franchise sales consultants from different regions as well as some Regional Owners. Topics covered included reasons for franchise sales success, the franchise sales process, job roles of franchises sales consultant, telephone etiquettes and tele-calling tips, stories on franchise sales and the workshop was concluded with role plays on tele-calling and face to face meetings. A major stress was given on the practical know how of the sales processes and a number of mock sessions were a part of the workshop which were thoroughly enjoyed by the attendees. These training sessions are conducted with the sole motive of development of the RE/MAX regions into profitable centres and are an answer to all the problems the franchise sale people face while dealing with prospects.

This particular section on the website now helps the seller find a potential buyer by simply filling out an enquiry form which requires them to furnish basic information such as location, property type and the number of rooms. The Broker Owners of Delhi NCR region took a lot of marketing initiatives in the month of February. RE/MAX Galaxy Realty made an effective use of canopy as a marketing tool and was seen conducting activities in the New Friends Colony Community Center.

Q2. What is the profile of the Agents that you recruited? What background are they from?

Ans. For the profile of the agents, a major focus remains on associates who have worked as insurance agents in the past and fresher.

Q3. For a Broker Associate what is the unique proposition that you put forward to get them associated with you?

Ans. The unique proposition that we put forward to the associates to get linked with us is the one on one meetings that we conduct with them every week. This is majorly to tell them about the constant mentoring that would be provided to them as a part of the RE/MAX team. This is one value proposition that is not offered by anyone else in the market and this is something every fresher looks up. So a constant mentoring in terms of weekly one on one meeting with them is what attracts the associates to join our office. This is in addition to the state-of-the-art infrastructure, administrative support, large team at the office and other benefits that they get from joining our office.

Q4. What are the different activities or practices in specific that you follow for retaining the associates in your office?

Ans. The best practice that my office conducts for the purpose of retention is the Technology Training Program that is conducted by Ms. Punithaveni. This training program is provided to all the new Broker Associates that get linked to our network. This also provides them an insight on RE/MAX LLC and RE/MAX India. Technology is one of the best tools that RE/MAX provides to its associates and we thoroughly believe that every associate should use it to the maximum extent because these are one of the certain factors that will contribute to the high success rates of the associates. It also keeps them updated with the latest technology and creates an edge over others in the market. We have other things as well like training, mentoring, rewards etc that contribute to retention. On the whole, there are lot of small small things that are done in our office to maintain a lively and productive atmosphere.

Q5. How many agents are there in your office and how much of time is spent on them?

Ans. Our office in total has 26 agents. The time spent on each agent is minimum thirty minutes in order to get the best out of them.

Q6. What advice do you have for other RE/MAX affiliates that they can make use of in terms of Recruitment Practices for their office?

Ans. My advice to all the RE/MAX affiliates would be the proper utilization of the RE/MAX technology and the Webinars that are being organized at different levels. Technology is one of the most unique and the best tool provided by RE/MAX and its active and efficient usage reaps the very best results. The webinar sessions can be used as a tool for recruitment by having Agent prospects attend them. One thing that I would like to mention is this that recruiting requires consistent efforts and for a Broker Owner there is nothing more important than recruitment.

Realty Bytes Rules to be framed to New Land Acquisition Act JAIPUR: The state government’s revenue department is gearing up for framing rules for the new Land Acquisition Act that has come into force from January 1 this year.

The new Bill, who replaced the 119-year-old obsolete legislation, proposes a unified policy for acquisition of land and adequate rehabilitation mechanism for all affected persons.

The implementation of the new Act is a cumbersome process as a number of rules will have to be drafted both by the Centre and the states and also invites comment from stakeholders including industries, NGOs and civil society. The ministry of rural development that introduced the Bill and got it approved in both the Houses of Parliament would set up a rules committee at the central level and after that the state governments will follow the guidelines in framing rules. The Act has come into force from January 1, but it would be notified in April only.

“The state government will have to set up committees for framing the rules and this would involve several departments. Several bodies will have to be set up and the state government will have to set up a state level Land Acquisition, Rehabilitation And resettlement Authority that would hear dispute arising out of acquisition,” said Tapesh Panwar, principal secretary, revenue.

The state government will also have to establish social impact assessment unit, a full-fledged office for rehabilitation and resettlement and also a state-level monitoring body. The new Act has given freedom to the states to complement it with their own laws as long as the provision of the original law was not diluted. The new Act only set up the bottom line for fair

compensation, rehabilitation and resettlement and the state would be free to improve it, said Panwar.

Panwar said there is a clause under which while acquiring land for the private companies the consent of 80% of the land owners will be required. He admitted that the consent of the 80% of the land owners and 70% consent of the landowners for public-private projects are cumbersome processes.

The new Act proposes that up to four times the market value should be paid to farmers and landowners for land acquired in rural areas and two times the market value in urban areas. In all such cases where notices under Section 4 and 6 were issued, the settlement of the compensation will be done according to the old Act and in such cases where the notices were not served to the land owners the compensation would be made under the new Act. The issue related to the land acquisition of 1,400 acres for the Mumbai-Delhi Industrial Corridor (DMIC) in Alwar district and also for the ring road in Jaipur will be done under the new Act. But all this will be done only after the local rules are framed.

The Regulatory Bill: a boom for Indian Real Estate Market The Real Estate (Regulation and Development) Bill, 2013, has been recently approved by the Union Cabinet. The Bill provides for a uniform regulatory environment, to protect consumer interests, help speedy adjudication of disputes and ensure orderly growth of the real estate sector and has been much awaited by all aspiring home buyers. The Real Estate (Regulation and Development) Bill, 2013 is a pioneering initiative to protect the interest of consumers, to promote fair play in real estate transactions and to ensure timely execution of projects. The Bill has been prepared by the Government after extensive consultations with States, experts and stakeholders. The Bill has been supported by the States along with Ministry of Consumer Affairs, the Competition Commission and Tariff Commission among others.

The main features of the Draft Bill :

Applicability of the Bill:

The proposed Bill is limited in its applicability to residential real estate i.e. housing and any other independent use ancillary to housing. The two important definitions in this regard are: “real estate project means the development of a building or a building consisting of apartments, or converting an existing building or a part thereof into apartments, or the development of a colony into plots or apartments, as the case may be, for the purpose of selling all or some of the said apartments or plots or buildings and includes the development works there of” “apartment whether called dwelling unit, flat, premises, suite, tenement, unit or by any other name, means a separate and self-contained part of any immovable property located on one or more floors or any part thereof, in a building or on a plot of land, used or intended to be used for residential purposes, or for any other type of independent use ancillary to the purpose specified and includes any covered garage, whether or not adjacent to the building in which such apartment is located which has been provided by the promoter for the use of the

Establishment of Real Estate Regulatory Authority:

Establishment of one or more ‘Real Estate Regulatory Authority’ in each State/UT, or one Authority for two or more States/UT, by the Appropriate Government, with specified functions, powers, and responsibilities to exercise oversight of real estate transactions, to appoint adjudicating officers to settle disputes between parties, and to impose penalty and interest.

Registration of Real Estate Projects and Registration of Real Estate Agents:

Mandatory registration of real estate projects and real estate agents who intend to sell any immovable property, with the Real Estate Regulatory Authority;

Mandatory Public Disclosure of all project details:

Mandatory public disclosure norms for all registered projects, including details of the promoters, project, layout plan, plan of development works, land status, carpet area and number of the apartments booked, status of the statutory approvals and disclosure of proforma agreements, names and addresses of the real estate agents, contractors, architect, structural engineer etc.

Functions and Duties of Promoter:

Duty of promoters towards disclosure of all relevant information and adherence to approved plans and project specifications, obligations regarding veracity of the advertisement for sale or prospectus, responsibility to rectify structural defects, and to refund moneys in cases of default;

Compulsory deposit of seventy percent or such lesser percent as notified by the Appropriate Government, to cover the construction cost of the project, of funds received by the Promoter, in a separate bank account:

Provision to compulsorily deposit seventy percent or such lesser percent as notified by the Appropriate Government, of the amounts realized for the real estate project from the allottees, from time to time, shall be deposited in a separate account to be maintained in a scheduled bank within a period of fifteen days of its realization to cover the cost of construction and shall be used only for that purpose.

Functions of Real Estate Agents:

Real estate agents not to facilitate the sale of immovable property which are not registered with the Authority required under the provisions of the Act, obligation to keep, maintain and preserve books of accounts, records and documents, obligation to not involve in any unfair trade practices, obligation to facilitate the possession of documents to allottees as entitled at the time of booking, and to comply with such other functions as specified by Rules made in that regard;

Rights and Duties of Allottees:

Right to obtain information relating to the property booked, to know stage-wise time schedule of project completion, claim possession of the apartment or plot or building as per promoter declaration, refund with interest in case of default by the promoter, and after possession entitled to necessary documents and plans. Duty of allottees to make necessary payments and carry out other responsibilities as per the agreement;

Functions of Real Estate Regulatory Authority:

The Authority to act as the nodal agency to co-ordinate efforts regarding development of the real estate sector and render necessary advice to the appropriate Government to ensure the growth and promotion of a transparent, efficient and competitive real estate sector;

Fast Track Dispute Settlement Mechanism:

Establishment of fast track dispute resolution mechanisms for settlement of disputes, through adjudicating officers (an officer not below the rank of Joint Secretary to the State Government) to be appointed by the Authority, and establishment of an Appellate Tribunal to hear appeals from the orders of the Authority and the adjudicating officer;

Establishment of Central Advisory Council:

Establishment of Central Advisory Council to advise the Central Government on matters concerning implementation of the Act, with a mandate to make recommendations on major questions of policy, protection of consumer interest and to foster growth and development of the real estate sector. The Council to have among others, five representatives of State Governments, to be selected by rotation;

Establishment of Real Estate Appellate Tribunal:

Establishment of Real Estate Appellate Tribunal, by the appropriate government to hear appeals from the orders or decisions or directions of the Authority and the adjudicating officer. The Appellate Tribunal is to be headed by a sitting or retired Judge of the High Court with one judicial and one administrative/technical member;

Punitive Provisions:

Punitive provisions including de-registration of the project and penalties in case of contravention of the provisions of the Bill or the orders of the Authority or the Tribunal;

Power to make Rules and Regulations:

Appropriate Government to have powers to make rules over subjects specified in the Bill, and the Regulatory Authority to have powers to make regulations. RM/RS
