1 Introduction
1.1 Background
To assist with the submission of a Planning Application for the railway bridge east of
Birmingham Road, Lichfield, Amey has been commissioned by Staffordshire County
Council to undertake a preliminary assessment into the potential noise impacts from the
construction of this phase of the proposed Lichfield Southern Bypass.
1.2 Objectives
The assessment aims to:
• Provide a description of the study area;
• Identify the location of sensitive receptors;
• Identify and provide an outline of the construction programme;
• Identify noisy activities;
• Highlight the risks posed by these activities;
• Provide an outline of possible mitigation measures.

2 Legislation and Guidelines
2.1 General
National Planning Policy Framework
2.1.1 Paragraph 123 of the National Planning Policy Framework (NPPF) states that
planning policies and decisions should aim to:
· avoid noise from giving rise to significant adverse impacts on health and
quality of life as a result of new development;
· mitigate and reduce to a minimum other adverse impacts on health and
quality of life arising from noise from new development, including through
the use of conditions;
· recognise that development will often create some noise and existing
businesses wanting to develop in continuance of their business should not
have unreasonable restrictions put on them because of changes in nearby
land uses since they were established; and
· identify and protect areas of tranquillity which have remained relatively
undisturbed by noise and are prized for their recreational and amenity value
for this reason.
2.1.2 The Noise Policy Statement for England (NPSE) describes the effective management
and the control of environmental, neighbour and neighbourhood noise within the
context of Government policy on sustainable development. The main aims of the
policy statement are to:
· Avoid significant adverse impacts on health and quality of life.
· Mitigate and minimise adverse impacts on health and quality of life.
· Where possible, contribute to the improvement of health and quality of life.
2.1.3 The Planning Practice Guidance on Noise (PPG-N) to the NPPF provides more detail
on when noise may be a concern. It clarifies that the determination of noise effects
should include the effects during the construction phase wherever applicable.

2.2 Temporary (construction) noise and vibration
Environmental Protection Act 1990
2.2.1 Under Part III of the Environmental Protection Act 1990, local authorities have a
duty to investigate noise complaints in relation to premises (including land and
buildings) and vehicles, machinery or equipment. The Noise and Statutory Nuisance
Act 1993 amended Part III of the Environmental Protection Act 1990, by placing
additional definitions in the list of statutory nuisances in Section 79 of the
Environmental Protection Act. The definitions relate to nuisance caused by
stationary vehicles, machinery and equipment on the street.
2.2.2 If a local authority’s Environmental Health Officer is satisfied that a complaint
amounts to a statutory nuisance, the authority must serve an abatement notice on
the person responsible or, in certain cases, the owner or occupier of the property.
The notice could require that the noise or nuisance be stopped altogether, the
sound level reduced, or limited to certain times of the day.
Control of Pollution Act 1974
2.2.3 The Control of Pollution Act 1974 (CoPA) Section 61 sets out the procedures for
obtaining ‘prior consent’ for construction works, including the agreement of noise
limits. Applications for ‘prior consent’ should be made to the relevant local authority
and should contain a method statement detailing how the works will be carried out
as well as a procedure to ensure noise is kept to a minimum.
2.2.4 Under Section 60 of the Act, the local authority serves the notice on the developer
to limit noise and vibration impacts (usually as a result of complaints being
received). These notices cannot be served if a Section 61 consent already exists (in
which case, prosecution is for breach of S61 rather than for breach of S60 notice).
Section 71 of the Act details the approved codes of practices used to minimise noise
and Section 72 defines best practicable means (BPM).

The Control of Noise (Code of Practice for Construction and Open Sites)
(England) Order 2015
2.2.5 The Control of Noise Order 2015 approves BS 5228:2009+A1:2014 Part 1 Noise and
Part 2 Vibration (Ref. 8 and 9) for the purpose of giving guidance on appropriate
methods for minimising noise and vibration in relation to Section 71 of CoPA.

3 Location
3.1 Site Description
3.1.1 The site is located to the east of the existing roundabout junction of the A5127
Birmingham Road and A461 Falkland Road and is split either side of the Cross City
railway line at approximately BNGR: SK115080. There is residential development to
the north west and north east of the site with arable land to the south.
3.1.2 The proposed scheme involves the construction of a road bridge through the
existing railway embankment with a new link to the existing Birmingham Road
roundabout. Future plans associated with a proposed housing development will
provide a new road to the east to form a new junction with London Road. A
temporary haul road will be used to access the site from London Road.
3.2 Location of sensitive receptors
3.2.1 The nearest sensitive receptors to the site are located on the west side of the
railway in Foxglove Close and on the east side in Shortbutts Close; the closest being
approximately 40 metres away.
3.2.2 As the works will require the construction of a temporary haul road, there are also a
number of receptors located within 100 metres of the route. These are homes
located in Sanders Way, Wordsworth Close, Shortbutts Lane and Marsh Lane.
There are no schools or hospitals within 500 metres of the works location.

3.3 Noise Important Areas
3.3.1 A desk study search for Noise Action Planning Important Areas was undertaken on
the government website https://data.gov.uk/dataset/noise-action-planning-important-
areas-round-2-england1. The location of sensitive receptors was determined using
Google Instant Street View https://www.instantstreetview.com/ and the baseline road
traffic noise and rail traffic noise levels were was gained from Extrium interactive noise
map http://www.extrium.co.uk/noiseviewer.html
3.3.2 The proposed scheme has been identified as not being within a Noise Action
Planning Important Area (Figure 3).

4 Noise Scape
4.1 Noise Maps
4.1.1 In order to identify the existing noise climate, noise maps have been taken from
Extrium England Noise Map Viewer (http://www.extrium.co.uk/noiseviewer.html)
4.1.2 Noise levels for road and rail traffic are shown in Figures 4 to 7. The noise levels
were obtained from modelling on a 10 metre grid with a receptor height of 4 metres
above ground.
4.1.3 The maps show LAeq, day (16hr) and Lnight (8hr) levels. The LAeq, 16hr is the
annual average noise level for the 16 hour period between 07:00 and 23:00. Lnight
is the night time annual average noise level where night is defined as the period
from 23:00 to 07:00.
4.1.4 This data is a product of the strategic noise mapping exercise undertaken by Defra
in 2012 to meet the requirements of the Environmental Noise Directive (Directive
2002/49/EC) and the Environmental Noise (England) Regulations 2006 (as
amended).
4.2 Baseline Road Noise
4.2.1 The estimated LAeq, 16hr from road traffic (Figure 4) for dwellings on Foxglove
Close and Marsh Lane is 60.0 to 64.9 dB.
4.2.2 The estimated Lnight from road traffic (Figure 5) for the homes on Foxglove Close
and Marsh Lane is 50.0 to 54.9 dB.
4.2.3 The road noise level estimates for properties in Shortbutts Close and Wordsworth
Close are not available.

4.3 Baseline Rail Noise
4.3.1 The estimated LAeq, 16h from rail traffic (Figure 6) for dwellings on Shortbutts
Close is 60.0 to 64.9 dB.
4.3.2 The estimated Lnight from rail traffic (Figure 7) for dwellings on Shortbutts Close is
50.0 to 54.9 dB.
4.3.3 Rail noise estimates for dwellings on Foxglove Close, Marsh Lane and Wordsworth
Close is not available.

5 Construction Programme
5.1 General
5.1.1 The details below provide an indicative programme for the works highlighting where
potential noise impact could occur. Recommendations for mitigation measures are
also provided and it is the intention that the contractor will develop these measures
further to incorporate them into a Construction Environmental Management Plan
(CEMP) including the undertaking of a detailed construction noise assessment
5.2 January 2019 – Statutory Undertakers diversions
5.2.1 In advance of the main construction works, Statutory Undertakers diversions works
will be required. These works will be to the east of the site and be carried out
during the daytime period with an anticipated duration of 8 weeks.
5.2.2 The exact nature of the works has yet to be fully explored but is likely to involve
trench excavations and reinstatements which may have a noise impact on
properties on and near to London Road. The noise impact would be expected to be
minor.
5.3 January, February 2019 - Haul Road & compound construction
5.3.1 The planned works will involve the construction of a haul road accessed off London
Road leading to the east side of the railway embankment. This is to allow for the
future transport of materials to the main works site. The haul road works will
require excavation to a depth of around 450mm to enable the construction of a
stone based route. The estimated duration of these works is 8 weeks. The site
compound will require the erection of site offices and equipment storage buildings.
5.3.2 Works will be carried out during the daytime between the hours of 07:00 and 17:30
and have the potential for some noise disturbance. The main noise impact during
this phase will primarily be on the residents on Marsh Lane and Wordsworth Close.

5.3.3 Construction of the haul road will require the use of HGVs, excavators, rollers and
other equipment. The contractor will need to ensure that the haul road is properly
constructed and maintained to ensure no uneven surface which could cause noise
and vibration impacts. Speed limits on site will be set to 10 mph so that noise from
construction vehicles is kept to a minimum.
5.3.4 The activities associated with the construction and use of the haul road, are
predicted to have a limited noise impact on nearby homes and residences during
the construction of the haul road and minor impact during the construction of the
compound. There may be some perceptible vibration associated with the
compaction of the haul road.
5.4 March - April 2019 – Piling platform and plateau construction
5.4.1 To facilitate the positioning of the new bridge deck, construction of temporary
plateaus and piling platforms on either side of the railway will be necessary. These
will be ramped and approximately 3 to 4 metres in height. Construction materials
will be brought on to site using the Birmingham Road access and the haul road with
the plateau construction requiring the use of excavators, rollers and HGVs. The
anticipated duration of the construction work is around 8 weeks.
5.4.2 Some noise from these activities is likely with the main impact being primarily
focussed on the properties closest to the compound in Foxglove Close and
Shortbutts Close. To minimise the noise impact, works will be carried out during
daytime hours only between 07:00 and 17:30. To further reduce the noise impact,
the 10 mph speed limit on the haul road will be enforced.
5.4.3 The noise impact from construction activities is predicted to be moderate at this
stage of the scheme.
5.5 May, June 2019 - Piling and removal of piling platform
5.5.1 Due to the nature of the works being close to the existing railway, the piling work
required for the new bridge will need to be carried out during a series of four
railway possessions. These are likely to be from around 22:00 on a Saturday
evening until 06:00 Sunday morning.

5.5.2 The piling works will use continuous flight auger (CFA) system to drill into the
bedrock to a depth of between 10 to 17 metres. The construction will involve the
use of a piling rig, concrete pump and associated plant and equipment including
generators to provide power for task lighting.
5.5.3 The noise impact from the construction at this stage is expected to be significant for
dwellings in Foxglove Close and Shortbutts Close. To reduce the levels of noise at
nearby homes, temporary screens will need to be erected and the mitigation as
detailed in Section 5 be fully utilised.
5.5.4 It will be important for the contractor to liaise with homeowners and residents of
Foxglove Close and Shortbutts Close in order to fully identify the impacts from the
works, to seek feedback and to detail the mitigation methods to minimise the
impact as far as is practicable.
5.5.5 As the nature of the works and the phasing are critical in terms of timings, it is
important that the contractor liaises with the Lichfield District Council Environmental
Health Officer and it is recommended that a s61 Prior Consent Application under the
Control of Pollution Act 1974 is sought.
5.5.6 Upon completion of the piling, the platform will be removed with use of 360°
excavators and lorries. Works will be carried out during the daytime only.
5.6 July to December 2019 – Bridge Deck construction
5.6.1 The construction of the steel bridge deck and ballast walls will be carried out within
the compound area to the east side of the railway. Materials will be brought in via
the haul road and the works will generally be light construction and include welding
and bolting. Works will be carried out during the daytime only and anticipated to
take 24 weeks.
5.6.2 It is expected that the contractor will utilise the noise screening benefit of the
existing plateau where the works are carried out and the movement of HGVs and
other plant will be limited to reduce the noise at nearby homes.

5.7 December 2019 – Roll Bridge Deck into position
5.7.1 In order to position the bridge deck and ballast walls in place, a rail possession is
required. This will be carried out over the three day Christmas period and it is likely
that works will be carried out during both the daytime and night time periods.
5.7.2 The positioning of the deck and ballast walls will be carried out using multi-axle
crawlers and two cranes. Generators are likely to be required in order to provide
lighting.
5.7.3 As construction noise has the potential for high impact on homes in Foxglove Close
and Shortbutts Close, temporary screens will be erected in order to mitigate noise.
5.7.4 The contractor will again be expected to liaise closely with residents and the
Lichfield District Council Environmental Health Officer and a s61 Prior Consent
Application under the Control of Pollution Act 1974 is recommended to be sought
due to the sensitive nature of the works.
5.8 January 2020 – Plateau removal
5.8.1 Following the bridge deck positioning, the two plateaus will require removal. This
will be limited to daytime operations only and require 360° excavators and lorries to
transport the material off site using the haul road and Birmingham Road. This stage
of the scheme is expected to take 2 weeks to complete.
5.8.2 As the plateaus are on either side of railway, the removal work will take place on
both sides simultaneously and the noise impact is likely to affect households located
on Foxglove Close, Shortbutts Close, Marsh Lane and Wordsworth Close.
5.8.3 Mitigation would include the adherence to the site speed limit of 10 mph, continued
maintenance of the haul road to ensure an even and smooth surface and general
measures such as avoidance of excessive engine revving and equipment left idling
when not in use.
5.9 January 2020 – Railway Embankment Excavation

5.9.1 The excavation of the railway embankment to effectively create the underpass will
require 360° excavators and HGV lorries to remove the material via the haul road
and possibly the Birmingham Road. The anticipated duration for this stage of the
works is 2 weeks.
5.9.2 The impact will be similar to the plateau removal with householders in Foxglove
Close, Shortbutts Close, Marsh Lane and Wordsworth Close potentially affected.
Good site practice and management will be required to ensure the impact is
minimised.
5.9.3 Mitigation should include adherence to site speed limits and the maintenance of the
haul road to ensure no uneven sections.
5.10 February 2020 – Retaining wall, finishing works to bridge
5.10.1 The construction activity associated with the bridge finishing works would take place
during the daytime for around 12 weeks.
5.10.2 Works would involve some contiguous piling for the retaining walls and some
brickwork on both the east and west side of the railway. This could affect
households on Foxglove Close and Shortbutts Close. The works are predicted to
have a moderate impact with regards to construction noise. The contractors would
be expected to follow the mitigation guidance as set out in section 5.
5.11 March 2020 – Drainage, kerbing, surfacing and lighting
5.11.1 The final construction operations would be the finishing works and would take place
during the daytime for around 12 weeks.
5.11.2 The works will consist of activities primarily to the west of the site with low level
construction noise potentially affecting households in Foxglove Close and possibly
Shortbutts Close.
5.11.3 The contractor would be expected to carry out the works using best practice
measures detailed in Section 5 to minimise the potential impact on residents.

6 Identification of potentially noisy activities
6.1 Assessment of the temporary effects of construction
6.1.1 Indicative construction activities for each phase of the scheme have been identified
and assigned an indictor with regard to the potential for noise impact.
6.1.2 These are minor, moderate or major. Minor is defined as unlikely to have any
adverse impact on people and major as likely to adversely affect people’s amenity
and require mitigation to minimise effect. Details are provided in Table 1 below:

6.2 Key areas of potential noise impact
6.2.1 The preliminary noise assessment has identified the key activities that are required
to be carried out and the potential likelihood for noise impact. The report has
identified a number of areas where the potential is considered as significant and the
impact as major.
6.2.2 The contractor will be required to address these concerns and it is recommended
that a detailed noise impact report on these main concerns is carried out. The key
activities are:
i. Operation and use of the haul road.
ii. Piling works.
iii. Bridge deck and ballast wall positioning.

7 Noise Mitigation
7.1 Construction Environmental Management Plan (CEMP)
7.1.1 The contractor, as part of general requirements, will be required to produce a
Construction Environmental Management Plan (CEMP) to outline how impacts on
the environment and the surrounding community during the scheme’s construction
will be avoided, minimised or mitigated.
7.1.2 As part of the CEMP, the contractor is responsible for producing and maintaining a
register of environmental impacts including noise. A Noise Management Plan will
form part of the CEMP and will detail specifically how the noise impact will be
identified, controlled and mitigated.
7.2 Detailed Construction Noise Assessment
7.2.1 As part of the Noise Management Plan, in order to assess the full environmental
noise impact, the contractor will be required to undertake a detailed construction
noise assessment in accordance with guidance from BS 5228-1:2009+A1:2014
‘Code of practice for noise and vibration control on construction and open sites –
Part 1 Noise’.
7.2.2 The assessment will focus on the key areas of potential noise impact as identified as
likely to have a major or significant effect in section 6.2. The contractor is expected
to comply with the requirements of the Lichfield District Council as laid down under
Sections 60 and 61 of the Control of Pollution Act 1974 as amended by the Control
of Pollution Amendment Act 1989. The contractor will be required to seek a S61
Prior Consent with Lichfield District Council for these works.
7.3 General Noise mitigation
7.3.1 The Contractor shall employ ‘the best practicable means’ as defined in the Control of
Pollution Act 1974 and amended by the Control of Pollution Amendment Act 1989,
to minimise noise and vibration from his operations. Further advice shall be utilised
in line with measures described in BS 5228-1:2009+A1:2014 ‘Code of Practice for
Noise and Vibration Control on Construction and Open Sites – Part 1 Noise and BS
5228-2:2009+A1:2014 ‘Code of practice for noise and vibration control on

7.3.2 construction and open sites – Part 2: Vibration.
7.3.3 In the event that public complaints and noise measurements indicate that noise
levels have significantly risen at sensitive receptors, the Contractor would take all
reasonably practicable mitigation measures to reduce the noise impact and/or
prevent recurrence e.g. change the method of working, use mobile noise barriers.
7.3.4 Specific mitigation shall include:
· Audible reversing warning systems on mobile equipment and vehicles. When
reversing, mobile equipment and vehicles should travel in a direction away from
dwellings whenever possible.
· All compressors shall be sound reduced models fitted with properly lined and
sealed covers which shall be kept closed whenever the machines are in use.
· Equipment and machinery in intermittent use shall be shut down in intervening
periods of non-use or where this is impracticable they shall be throttled down to a
minimum.
· Unattended equipment outside normal working hours should, if possible, be
powered by electricity otherwise acoustic enclosures will be necessary to minimise
noise levels.
· Where possible, equipment with directional noise characteristics shall be
positioned to minimise noise at adjacent properties.
· Static machines shall be sited as far away as practicable from inhabited buildings
or other noise sensitive premises and/or behind temporary screens or enclosures.
· All vehicles and mechanical equipment used for the purpose of the works shall be
fitted with effective exhaust silencers and shall be maintained in good and
efficient working order.

8 Summary
8.1 Additional commitments
8.1.1 The preliminary noise assessment has identified a number of aspects of the scheme
which may have a noise impact on nearby noise sensitive receptors.
8.1.2 The contractor will be required to carry out and commit to a number of
undertakings before any site works commence. These are:
· Detailed construction noise assessment
· Noise Management Plan detailing mitigation proposals as part of the CEMP
· Liaise with Lichfield District Council Environmental Health in order to
formulate s61 Prior Consent applications for key aspects of the scheme.
