Renewing under the new Endorsement system has presented contractors with new license requirements and a new form to complete for license renewals. “We have a more comprehensive renewal process than we’ve had in the past, due to the endorsement system,” says Kristie Patton, Licensing & Customer Service Unit Manager. “It is important for contractors to read the new instructions in order to understand how to fill out the new form completely.” The CCB is receiving a number of incomplete renewal forms which must be returned to the licensee to complete. This delays the renewal of the license. The most common error is returning the form to the CCB without including the new bond. The new endorsement system requires the purchase of a new bond or bonds, which match the new endorsement or endorsements that contractors have chosen for their business. The amounts for all bonds have changed. Other sections of the renewal form that have been commonly overlooked by renewing licensees are the court judgments and convictions section, and the RMI signature section. If the licensee has no judgments or convictions, “not applicable” (NA) must be selected in order to complete that section. How does a construction business starta safety program? Oregon OSHAprovides safety and health programassistance with confidentialconsultation services. The agency alsooffers workshops around the state,including some Spanish–languageclasses, on topics that range fromvehicle safety to OSHA recordkeepingand fall protection. Online courses, on-site education, newsletters, and otherpublications are some of the freeofferings.

According to OSHA, R & HConstruction, Inc. in Portland started

working with Oregon OSHA more thanfive years ago when the companyjoined the Safety and HealthAchievement Recognition Program(SHARP). SHARP provides anincentive for Oregon employers towork with their employees to find andcorrect hazards, develop andimplement effective safety and healthprograms, and continuously improve.The ultimate goal of SHARP is toencourage employers to become self-sufficient in managing workplacesafety and health issues. The Construction Contractors Board(CCB) has stepped up efforts to findunlicensed contractors. In Februarythe CCB partnered with Portland FOXaffiliate (KPTV) to conduct a sting inthe Portland area. Last month, theCCB partnered with the Oregon HomeBuilders Association and conducted asting in the Eugene/Springfield area.

Prior to the stings, the CCB obtainedleads of unlicensed constructionactivity from advertisements, publiccomplaints, Craig’s list, publicbulletin boards, and other unnamedsources.

In each operation, suspectedunlicensed contractors were invited tooffer bids for improvements andrepairs. In Portland, CCB’sInvestigators and Compliance Officersreceived nine bids for constructionwork. All were found in violation ofOregon’s construction contractinglaws (working without a license). InEugene, seven of the eight bids werefound in violation.

“Illegal activity doesn’t just hurt theconsumer,” says Robert Rambo, CCBField Investigation Manager. “It hurts

the legitimate contractors that workhard to stay in compliance only to getundercut by those who don’t. The CCBis committed to finding and penalizingthose working illegally.”

The CCB has stepped up its proactiveefforts throughout the state to addressillegal activity. These efforts includerandom jobsite checks at any giventime, on any day of the week; multi-agency enforcement sweeps (saturationof targeted areas to check jobsites forillegal activities); and additionalenforcement stings.

“These efforts are designed to addressunlicensed activity, as well as otherillegal practices that may put Oregonworkers at risk, and provide an unfaircompetitive advantage to outlawcontractors hiring workers under thetable,” says Craig P. Smith, CCBAdministrator. “The CCB shares itsfindings with other state agencies tohelp penalize violators to the fullestextend of the law.”

Tell CCB if You Owe a Court JudgmentBeginning January 1, 2008, Oregon requires that a contractor must send the Board a copy of certain court judgments. Acontractor must send a copy of any judgment ordering the contractor to pay damages relating to construction or proposedconstruction. This requirement applies if the damages are for:

• Breach of contract• Negligent work or• Improper work

The requirement includes court judgments and court orders upholding arbitration awards.

You must send CCB a copy of the judgment, unless you pay the judgment within 30 days or appeal the judgment. You shouldmake sure that CCB receives the copy of the judgment no more than 45 days after it is recorded. If you fail to send the CCBa copy of the judgment, the CCB may impose a civil penalty. Craigslist has grown into a world-wideadvertising platform for both legal and,sometimes, illegal services.

The CCB recognizes the frustration oflicensed contractors when unlicensedcontractors advertise on craigslist. Thisillegal activity undermines the successof the construction industry, putsconsumers at risk, and takes businessaway from legitimate contractors.

The CCB conducts regular reviews ofcraigslist to find illegal contractorsadvertising for work without a license.Electronic mail warnings, writtenwarning notices, or orders imposing acivil penalty are sent to the offendingparty. They are also informed of thelaws that require licensing of anyonewho intends to work as a contractor inthe State of Oregon. Those who aren’talready presented with a fine, areinformed of the penalties forcontinuing to work or advertise withouta license. They are also given

The advertisements are then“flagged as prohibited” on craigslist.Along with notifying those who areworking illegally, the CCB alsocontacts legitimate contractors whoadvertise on craigslist, thanking themfor complying with OregonConstruction Laws and supporting theindustry. EPA Issues New Rule to Help Stop Childhood Lead Poisoning:Important Requirements for Contractors

The U.S. Environmental ProtectionAgency (EPA) recently issued a newrule, called the “Lead: Renovation,Repair, and Painting Rule.” The newrule aims to protect children from lead-based paint hazards created byrenovation and remodeling projects inplaces they frequent, including homes,day cares and schools.

This is the most important effort in thelast decade to help fight lead poisoningin young children. Exposure to leadcan cause serious behavior and learningproblems in children. The mostcommon way children get leadpoisoning is through exposure to lead-contaminated dust.

The new rule requires that contractorsand maintenance professionals becertified, that their employees betrained, and that they follow protectivelead-safe work practice standards. Therule focuses on housing, childcarefacilities, or schools built before 1978,where children under the age of six arepresent, or where an expectant motherresides.

The rule will require contractorsworking in the types of facilities listedabove to follow simple, effective workpractices. These include postingwarning signs, restricting occupantsfrom work areas, and containing workareas to prevent dust and debris fromspreading. These practices will help

protect children and pregnant womenfrom being exposed to dangerous levelsof lead. The rule also prohibits openflame burning or torching of lead-basedpaint.

Larger Bonds for Commercial Contractors – Level OneAfter July 1, 2008, every new andrenewing contractor license mustchoose an endorsement. If a contractorperforms work in connection with largecommercial structures (or developsland for that use), the contractor musthave a commercial contractorendorsement.

For a commercial general contractorlevel one (CGC1) or a commercialspecialty contractor, level one (CSC1),the new law requires a larger bond. ACGC1 must have a $75,000 suretybond, and a CSC1 must have a $50,000surety bond.

NOTE: Contractors endorsed as acommercial general contractor, leveltwo (CGC2), or a commercial specialtylevel two (CSC2) are required toprovide a $20,000 surety bond.

Some contractors have asked wherethey can find these bonds.

Any insurance company licensed to sellsurety bonds may issue these bonds. Sofar, Developers Surety & IndemnityCompany, Travelers Casualty & SuretyCompany, and Western SuretyCompany have sold the largest numberof these bonds.

Another company that sells a largerpercentage of all contractor bonds soldin Oregon is Contractors Bonding &Insurance Company (CBIC).

The companies usually sell their bondsthrough agents. If a contractor alreadyhas an insurance agent, that person isprobably the best source for purchasingthe larger bond. Another way to locatean agent is to look up a company’swebsite. There will ordinarily be a linkto a list of agents. If not, call thecompany for a list of agents. (Someagents may sell bonds for multiplecompanies.)

According to companies surveyed bythe CCB, the $50,000 bond should costaround $600 per year. The $75,000bond costs around $900 - $1,000 peryear. There may be discounts forbuying bonds for a period of more thanone year.

The companies we surveyed indicatedthat they “underwrite” the bond sales.This means that, like making a loan,the companies consider the credit statusof the bond purchaser. The companymay require the contractor to providea satisfactory corporate or personalfinancial statement. To purchase one ofthese larger bonds, a contractor mayneed a good credit score.

There will be contractors who do notqualify to purchase the larger bondfrom certain companies. Thosecontractors should consult their agents.Those larger bonds, if available, willlikely be more expensive.

Contractors that currently hold a CCBendorsement as a commercialcontractor, will be required to certifythat they have completed the requirednumber of continuing education hoursat their next renewal. For example, if acontractor became endorsed as acommercial contractor on July 1, 2008,they would complete continuingeducation and certify that they havedone so, at the next license renewal onJuly 1, 2010.

Continuing education is not requiredfor contractors endorsed as acommercial developer, or arecommercially endorsed contractorslicensed as electricians, plumbers,boiler/vessel pressure contractors, orelevator contractors.

How much continuing education isrequired for contractors with acommercial endorsement?The number of continuing educationhours for commercially endorsedcontractors, is dependent upon type ofendorsement and the number of keyemployees. (A key employee includesan employee or owner who is acorporate officer, manager,superintendent, foreperson, or leadperson.)

Important Continuing Education Information for CommercialContractors

The chart below is for commercialendorsements only and is based on atwo-year license period.

Where can contractors with acommercial endorsement findcontinuing education?The law allows continuing educationto be provided by colleges (communityor four-year), universities, tradeschools, trade associations,professional societies, privatecompanies (including manufacturers),public agencies, business associations,and in-house training programs.

What kind of CE qualifies?Topics for continuing educationinclude manner and means, andbusiness practices.

At this time, the CCB does not have alist of available continuing educationclasses.

Does this mean I should start takingeducation now?If you are currently endorsed as acommercial contractor, then yes, youshould begin taking and tracking thecontinuing education you and your keyemployees take so you can certify thehours required on your next renewal.

Will I have to start complying withcontinuing education if I obtain acommercial endorsement?

Yes. Once you become endorsed as acommercial contractor, you shouldbegin taking and tracking continuingeducation taken. You will be requiredto certify the continuing educationhours at the following renewal.

What about residential contractors?The continuing education program forcontractors with a residentialendorsement is in development.Oregon law provided most of therequirements for continuing educationfor contractors with commercialendorsements. Statute coveringresidential contractors is broad. TheContinuing Education System (CES)committee continues to meet with thegoal of developing a common senseprogram that serves both the businesscommunity and consumer interests.These are public meetings and can befound on the CCB website.

Civil Penalties Issued April 1, 2008 – June 30, 2008Submitted by Richard Blank, Enforcement Manager

The Oregon Construction Contractors Board (CCB) recently announced final orders assessing civil penalties issued toOregon contractors for violation of the Construction Contractors Law (ORS 701). Oregon law requires all constructioncontractors to be licensed with the CCB before they advertise, bid on, or perform construction, remodeling, or repair work.

The CCB issued 311 penalties between April 1, 2008 and June 30, 2008. The most common type of violation was operatingas a contractor while not licensed. Contractors receiving penalties include: (See Violations Key on pages 14 and 15.)

Home Inspector Standards of Behaviorfor Advertising ClarifiedThe Board has amended HomeInspector Standards of Behavior (OAR812-008-0201), effective July 1, 2008.The amended rule provides a clearerexplanation of the accepted methods ofadvertising and defines restrictions onreceiving financial compensation.

The amended rule makes it clear that:

• Home Inspectors are not restrictedfrom advertising their services, oradvertising to recruit employees andpersonnel.

• Home Inspectors cannot directly orindirectly, compensate realty agentsor other parties having a financialinterest in closing or settlement ofreal estate transactions in return forreferrals of home inspections or forbeing included on any list ofpreferred or recommended homeinspectors.

• Home Inspectors can utilize theoffering of discounts, credits, andadd-on services to customers in theiradvertising.

The amended rule also clarifies therestrictions on business activities thatmay involve receiving any form ofcompensation.

• Home Inspectors may not acceptcompensation, directly or indirectly,for recommending contractors,services, or products to customers orother parties having an interest ininspected properties.

• Home Inspectors cannot acceptfinancial or other consideration, suchas material or equipment fromsuppliers, for recommending orpromoting the use of a specificproduct during an inspection.

The Pacific Locksmith Association(PLA) has asked State RepresentativeLinda Flores (Clackamas) to draftlegislation that will upgrade regulationof the locksmith industry. StateRepresentative John Huffman (TheDalles) will co-sponsor the bill.

The association is seeking stricterlicensing and operating laws.

In 2007, the Better BusinessBureau reported thatlocksmith complaintstatistics rosenationwide by 75%from 2005 to 2006.Consumers reported beingovercharged, charged forunnecessary services, andintimidated.

What’s the buzz?

Knowing that unlicensed and illegalconstruction activity is bad forconsumers and legitimate contractors,the CCB established the FieldInvestigation Section in 2007, toprovide statewide coverage andimmediate response to complaints ofunlawful activity in the constructionindustry. The staff of 13 includes 11investigators, each assigned to theirown district in the state, where they arepositioned to respond to complaints ofillegal construction activity andconduct random checks of localconstruction sites. Sweeps and stingsare executed to find those involved inunlawful construction activity. TheField Investigation Section also

participates in jointinvestigations with other state, county,and city agencies, some of which leadto the filing of injunctions or criminalcharges.

Since January 1, 2008, the CCB hasconducted 4,220 job site checks, twosweeps, and two sting operations,leading to 490 referrals to the CCB’sEnforcement Section for administrativeaction. There have been a total of 151referrals to other agencies, includingthe Department of Justice, Departmentof Revenue, Oregon EmploymentDivision, Workers CompensationDivision, Building Codes Division, andthe Landscape Contractors Board.

This rule does not prohibit theinstallation on thermostatscontaining mercury on industrialequipment used for safetycontrols. (ORS 455.355) (OAR918-440-0510)

The 2001 Oregon Legislaturepassed The Oregon MercuryReduction Act which phased outthe use of mercury in certainconsumer products for whichthere are readily availablealternatives.
