I hereby state upon my oath that I have reason to believe and do believe that heretofore, and beforethe making and fiiing of 1bis Complaint, that on or about May 17,2015, in McLennan County, Texas, thesaid · did then -- - and there, as a member of a crlininal street gang, commit or conspire to commit DIUl'der, capital murder, or aggrava~ assault, against thelaws of theState. My probable cause for saidbelief and accusation is as tbllows: Three or more members andassociates of the Cossacks Motorcycle Club (Cossacks) wete in the paddng lot of the Twin Peaks restaurant in Waco, McLennan County Texas. Three or more members and· associates of the Bandidos Motorcycle Club (Bandidos) arrived in the padc:ing lot of the Twin Peaks restaurant and engaged in an altercation with the maben Bild associates of the Cossacks. During the course of the altercation, members andassociates of theCossacks and Bandidos brandished andused firearms, knives or other unknown edged weapons, batons, clubs, btassknuckles 1 andother weapons. The weapons were ust.d to threateit and/orassault the opposing &ctions. ·eossacks andBandidos disc.barged 6reatms at one another. Members of the Waco Police Department attempted to stop the altercation andwere fired upon by Banclidos and/or Cossacks. Waco Police Officers returned striking multiple gang members. During the exchange of gunfire, multiple pmons where shot.Ninep~le died as a resultof the . shooting between the members of thebiker gangs. Multiple other people were injured as a result of the altercation. The members and associates ofthe Cossacks andBandidos were wearing common identifying distinctive signs or S}'Dlbols aodlor bad an identifiable leadership and/or continuously orregularly associate in the commission of criminal activities. The Texas Department of PublicSafety JDaintains a database containing information identifying the Cossacb and their ass~ciates as a criminal street gangandtheBandidos and their associates as a criminal street gang.

After the altercation, the subject was apprehended at the scene, while wearing common identifying distinctive signs or symbols or bad an identifiable leadership or continuously or regularly associate in the commission of criminal activities.

After the altercation, firearms, knives or other uoknown edged weapons, batons, clubs, brass knuckles, and other weapons were recovered from members and associates of both criminal street gangs.

Multiple motorc~les with conunon identifying signs or symbols of the Cossaclcs and Bandidos and their associates were recovered at the scene. Additional weapons including: firearms, ammunition, knives, brass knuckles, and other weapons were fo\Dld on the motorcycles •
