THIS AFFIDAVIT OF MARICON ESGUERRA y SANTIAGO WAS FREELY AND VOLUNTARY GIVEN BY THE LATTER IN THE INVESTIGATION OFFICE OF PAOMBONG POLICE STATION, PAOMBONG, BULACAN UNDER THE INQUIRY OF PO2 JOHN MADLANGTUTA THIS 6 th DAY OF NOVEMBER 2015, AT 7:00 O’CLOCK IN THE EVENING, BEFORE WITNESS PO1 CUSCUS BALUNGKAS AND PO1 MARIO MAURER. x--------------------------------------------------------------------------- ------------------------------------------------x QUESTION: AFTER BEING INFORMED OF YOUR RIGHT UNDER THE LAW, ARE YOU PREPARED NOW TO GIVE YOUR STATEMENTS? ANSWER : YES SIR. Q: Do you solemnly swear to tell the truth and nothing but the truth in this affidavit? A: Yes sir. Q: Please state your full name, age, occupation and other personal circumstances. A: My name is Maricon Esguerra y Santiago, 23 years of age, student, and a resident of No. 777 Sitio Ibayo, Sto. Rosario, Paombong, Bulacan. Q: Why are you here at the Paombong Police Station? A: I want to file a suit against Richard Dela Cruz y Trillanes, a resident of Sitio Ibayo, Sto. Rosario, Paombong, Bulacan. Q: Why do you want to file a suit against this person? A: Because he forcibly took away my laptop, a black ASUS X550L Series amounting to Php 42,000.00. Q: When and where did this incident happen? A: On 06 November 2015, around 5:00 in the afternoon in the veranda of our house at 777 Sitio Ibayo, Sto. Rosario, Paombong, Bulacan. Q: How did it happen? A: At the date time and place I mentioned, while I was with my friend Roanne May M. Manalo studying at the veranda of my house, Richard Dela Cruz walked by and suddenly grabbed my laptop. Luckily, I was able to resist it and struggled to get hold of it. However, Richard Dela Cruz pointed a knife at me and said: "BITAWAN MO YAN, SASAKSAKIN KITA." So, I was compelled to let go of it. Thereafter, Richard Dela Cruz ran away. Q: How did you know the person you’re accusing of robbing your laptop? A: We are residing in the same barangay. He is also a known standby in our neighborhood, an ex-convict, the subject of several barangay blotters, and he also has several theft cases filed before the Paombong MTC. He is quite famous in our neighborhood for being notorious that’s why people in our neighborhood know him quite well. Q: If you’ll be able to see this person you’re accusing of robbing your laptop, will you be able to recognize him? A: Yes sir. Q: Are there any person who witnessed this incident?
