INTRODUCTION

Background

In November 2009 Council adopted the “Community Delivery Program 2010-2015”. This program

recognises and builds on the many existing Council efforts to promote the well being of community

members and effectively meeting their needs through social planning.

One of the identified objectives within the Community Delivery Program is Community Safety.

The, Community Safety and Crime Prevention Plan 2011-14, Keeping Our Community Safe (the Plan)

identifies Council’s intention to address and implement community safety and crime prevention

strategies within the valley in the next four (4) years and forms a sub-plan underneath the

Community Delivery Program.

Aim

The Plan recognises the importance of feeling safe and minimising the impact of crime on the

community. The Plan acknowledges that State Government has a primary role in law enforcement,

policing, community safety and crime prevention; whilst Council has a complimentary role in keeping

people safe.

The Plan aims to recognise this and build on Council efforts to promote safety in the community and

effectively meet their needs. The Plan outlines actions identified as part of Council’s complimentary

role over the next four (4) years.

This plan: -

Outlines the key crimes within the Macleay Valley Outlines desired outcomes and actions for Council to work towards a safe community Improves coordination between Council, Police and other key stakeholders Informs the community on how crime prevention and community safety is being addressed

What is community safety?

Community safety aims to “increase the ability of people to go about daily life with little fear for their own safety, or of others” (Penrith City Council) Safer Communities are ones where all individuals make daily economic and social choices without the fear of becoming a victim of crime or of feeling unsafe. Community safety tackles issues that are both real and perceived. Given that both real and perceived fears can impact on the value of community life, community safety programs aim to provide individual communities with the ability to address their own safety concerns, using a number of innovative approaches.

Community safety is linked to a quality of life where the community live without fear or hindrance

from crime.

What is crime prevention?

Crime prevention is any measure taken to prevent crime before it occurs. The primary focus is more

upon the causes of crime rather than the effects.

The intention of crime prevention is to reduce factors that can lead to a crime taking place in the

attempt to reduce victimisation and to deter crime and criminals.

NSW State Governments role in community safety and crime prevention

The NSW State Government has the primary leadership role for the delivery of law enforcement,

policing, community safety and crime prevention to the people of the Macleay Valley.

In the “2009 NSW State Plan”, the NSW Government outlined their identified priorities as part of

“Keeping People Safe”. These priorities are as follows:-

Reduce rates of crime, particularly violent crime Reduce levels of anti-social behaviour Reduce re-offending Improve the efficiency of the court system

The NSW State Government through the Department of Justice and Attorney General works with

Local Government by endorsing Council’s Community Safety and Crime Prevention Plans. This

endorsement permits Council to pursue funding avenues through the Department to assist in

addressing identified priorities.

Kempsey Shire Council’s role in community safety and crime prevention

Local Government is ideally positioned to provide a complimentary role in addressing community

safety and crime prevention.

As the level of Government closest to the people, Council has a leadership role in presenting local

concerns and issues to State Government; whilst also working in conjunction with the community

and government agencies to address actions identified as impacting on the safety of the local

community.

Council’s role in the implementation of the Plan over the next four years is to be a facilitator,

advocate, supporter or provider of service, activities or events, which will build on the existing

capacity of the community to affect change by themselves.

Asset Based Community Development approach works on the principles of identifying and mobilising

community strengths, skills and knowledge rather than focusing on an inability to affect change or

what is lacking within the community. Through focusing on the strengths of the Macleay, which are

numerous, key challenges can be met.

Council would like to acknowledge the contribution of all residents and service providers who agreed

to participate in interviews, provided written submissions and/or attended the community meetings

in relation to preparing the Plan.

COMMUNITY ENGAGEMENT

Key challenges & opportunities for effecting change on crime and improving personal safety within

the Macleay Valley were identified through a comprehensive ‘Community and Organisational

Engagement Strategy‘. This data was then considered, in conjunction with key local and state plans

in order to formulate desired outcomes and actions of the Plan.

The Community Engagement Strategy was developed in a holistic way in consultation with local

residents, community groups, government and non-government agencies. Alignment with key

stakeholder’s strategic management plans were a major consideration when compiling the Plan.

In addition to this, residents of the ten village communities of Bellbrook, Crescent Head,

Frederickton / Collombatti, Gladstone, Hat Head, Smithtown, South West Rocks, Stuarts Point,

Willawarrin and Kempsey Township were consulted through a series of community meetings as part

of the Macleay Valley ~ Explore the Possibilities Project. Local Community Plans for these

communities form companion documents to the Plan.

Critical to the success of the Plan is alignment with other key strategic planning documents from

within Council and state government departments. Where possible, this plan has taken into

PRIORITY CRIME ANALYSIS

Crime can have a devastating effect on the lives of victims, perpetrators and local communities.

The factors that influence crime and criminal activity are varied and complex and require a range of

strategies and initiatives to address these issues.

The NSW State Government indicates that there are four approaches to crime prevention and

community strengthening:

- Criminal justice approaches, by which a strong and well-equipped Police Force enforces the law, and a tough but fair justice system convicts offenders and holds them accountable for their actions;

- Situational approaches, which reduces opportunities for criminal activity and anti-social behaviour through well-designed public spaces and the effective coordination of services;

- Community approaches, involving interventions which seek to change the social conditions that influence offending; and

- Developmental or early intervention approaches, where the risk and protective factors related to offending at a later age are identified and addressed (Dept Premier and Cabinet; 2008).

In determining the type of approach to be undertaken to address crime and criminal activities, a

crime profile of the Kempsey Shire was developed. This crime profile guides the identification of the

priority crimes and corresponding strategies and initiatives to address the crimes.

In addition to the development of the Crime Profile, community perceptions of crime and criminal

activity were also considered.

Crime Profile

The purpose of the development of a crime profile is to determine the two priority crime categories

occurring within the Kempsey Shire. These categories will be addressed through the Plan and form

the basis of Council’s application to the Department of Justice and Attorney General for a Safer

Community Compact.

The crime profile for the Kempsey Shire was developed with the assistance of crime statistical

information gathered from the NSW Bureau of Crime Statistics and Research (BOSCAR), NSW Police

Service and advice from the Crime Prevention Division of the Department of Justice and Attorney

General.

Statistical analysis of the crime data indicated that crime within the Kempsey Shire has remained

stable with some crimes showing downward trends over the five year period from July 2004 to June

2009.

The only significant change to occur within this period has been an upward trend in Assault –

Domestic Violence related. Kempsey Local Government Area (LGA) was ranked the 4th highest in

New South Wales for this crime in the reporting period. This was determined by BOSCAR by

rankings based on NSW recorded crime statistics according to each LGA’s rate per 100,000 people.

Table 1 ~ Kempsey Local Government Area Priority Crimes provides an analysis of the BOSCAR data

which highlights the top 10 crime offences for the Kempsey Local Government area.

Local Crime Priorities

Due to anecdotal evidence the local crime priorities for Assault – DV related and Alcohol Related

Assault where further analysed. Information concerning both of these priority crimes is detailed in

the following pages.

Offence No.1- Assault – Domestic Violence related

The Crimes (Domestic and Personal Violence) Act NSW, 2007 defines ‘domestic violence offence’ as:

A personal violence offence committed by a person against another person with whom

the person who commits the offence has or has had a domestic relationship.

Crime Data Analysis

According to the NSW Bureau of Crime Statistics

and Research (BOSCAR) from 2007 to 2009

Kempsey Local Government Area (LGA) had a total

of 710 incidents of Assault – Domestic Violence

related crime (see Figure 1).

This equates to an average of 236.6 incidents of

Domestic Violence related assault each year.

The true incidence of domestic violence in the LGA

is unknown however anecdotal evidence

suggests that the level of violence occurring is

greater than that reported.

Time and Day of Criminal Activity

In trying to determine trends for the offence the BOSCAR 2008 Local Government Area Crime Report

Series Kempsey was utilised.

In analysing the frequency of DV Related Assaults it was observed that the majority of DV Related

Assaults occur between 6pm – 12am on a Thursday and 12am – 6am on a Saturday (Price 2009:12)

(see Figure 2 - Domestic Violence related assault incidents by time and day).

Location of Criminal Activity

Of the 296 recorded incidents of DV related Assaults occurring within 2008, 238 incidents occurred

within residential premises (Price 2009: 34). Furthermore the hotspot data indicates that the

highest density of crime occurred within the residential communities of West Kempsey and South

Kempsey (see Figure 3 - Hotspot map for Domestic Violence related Assault incidents).

Victims of Crime and Persons of Interest (POI)

Where the victim is female they are likely to be aged 20 – 29 years. Where the victim is male they

are likely to be aged 30 – 39 years. (Price 2009:25).

Where the NSW Police Service has identified POI as committing the crimes the identified age range

for both female and male POI for DV Related Assaults is between 20 – 29 years (Price 2009: 36).

Offence No.2 – Alcohol Related Assault

The ABS defines assault as “the direct (and immediate/confrontational) infliction of force, injury or

violence upon a person or persons or the direct (and immediate/confrontational) threat of force,

injury or violence where there is an apprehension that the threat could be enacted”.

Alcohol is recorded in NSW Police data as an ‘associated factor’ to recorded incidents. It is

significantly under reported as in many instances, the person or persons responsible are not detected

and as such, it is difficult to establish whether alcohol was a factor in the offence. (NSW Police: 2010)

Crime Data Analysis

For the 2009/ 2010 financial year the Kempsey Local Government Area (LGA) had a total of 513

incidents (see Figure 4).

Time and Day of Criminal Activity

In trying to determine trends for the offence the NSW Police Service Local Government Area data

was utilised.

In analysing the day for Alcohol Related Assaults it was observed that there was a clear trend of

Alcohol Related Assaults occurring on all days however was more frequent from Friday’s through to

Monday’s (NSW Police 2010) (See Figure 5 – Alcohol Related Assault incidents by day of the week).

In analysing the time of the day for Alcohol Related Assaults it was observed that their was a clear

trend of Alcohol Relates Assaults occurring between 7pm (1901-2000) and 1am (1-100) (NSW Police

2010) (See Figure 6 – Alcohol Relates Assaults by time of day)

Location of Criminal Activity

Of the 513 recorded incidents of Alcohol Related Assault occurring within 2009, the hotspot data

indicates that the highest density of crime occurred within the West Kempsey CBD area (12.89%),

followed by residential communities of West Kempsey (8.89%) and South Kempsey (5.33%) (see

Figure 7 - Hotspot map for Assault Alcohol Related).

How was the priority crimes selected?

These crimes were chosen due to the ability to effect change to the priority offences and will form

the basis of Council’s application to the Department of Justice and Attorney General for a Safer

Community Compact.

Stakeholders

For the actions identified within the Plan to be effective, it requires all stakeholders to work

cooperatively together to achieve the identified outcomes. This will be achieved through the

facilitation role of the Community Safety Project Officer.

The Community Safety Project Officer will regularly liaise with the individual stakeholders and

various committees, both existing and those to be established, that will contribute to achieving the

identified outcomes.

Strategy: To educate residents in the Kempsey Shire the difference between alcohol free and prohibited zones and the consequences of drinking

in these areas

Outcome: Kempsey Shire has a high number of residents that continue to consume alcohol in public areas. This activity has the potential to lead

to antisocial behaviour and criminal activities due to intoxication. Through implementing AFZ and APZ’s it will assist in reducing the

occurrence of drinking offences.

PRO-ACTIVE CRIME PREVENTION STRATEGIES Kempsey Shire Council recognised that pro-active crime prevention programs are a key factor in the

success of in reducing crime and in providing a safer place to live. Council understands the importance

of community partnerships and seeks to develop links within the local community including schools,

health providers, local business and other groups to reduce the incidence and impact of crime.

Community consultation and education are key parts of this process.

This section of the Plan specifically targets strategies that addresses broader community safety and

focuses on areas such as safer community spaces, safer children and safer seniors.

PRO-ACTIVE CRIME PREVENTION STRATEGIES ACTION PLAN This section addresses concerns around general and community safety perceptions. These programs

will be subject to the identification of funding sources to enable them to be undertaken.

IMPLEMENTATION, MONITORING AND REPORTING FRAMEWORK

In recognition of the significance of crime prevention and community safety for the future of the

Kempsey Shire, the Director Community Engagement and Manager Community Relations will be

responsible for the monitoring of the Plan.

The Plan will be integrated into Council’s annual management plan over the following three year

period. Updates of the Management Plan, and subsequently the Community Safety and Crime

Prevention Plan, are provided to Council through progress reports in the monthly business agendas.

The Community Safety Project Officer will be accountable for the implementation and/or overseeing

of each identified strategy as well as building partnerships with stakeholders such as businesses, the

community sector and other tiers of government.

The Plan will be reviewed annually in line with the performance indicators and the release of

relevant crime statistics. These reviews will include an evaluation of each performance indicator and

identified milestones.
