1. Call to Order

Mayor Dodd called the meeting to order at 7:00p.m. 2. Roll Call

3. Approval of Agenda

No changes. 4. Minutes of Previous Meeting

Motion by Klapper, second by Charles to approve the minutes from the May 28 2020 Public Hearing and Common Council Meeting. Motion carried unanimously on call of roll.

5. Department Report – Municipal Services and Utilities

Storm Damager Report Director of Public Works/Utilities Manager Jahncke informed Council that 110 city trees, 60 street trees and 50 park trees were damaged by last week’s storm. As of Tuesday, trees were cleared and removed from the right-of-way. Pick up will be taking place for the next 4 – 5 weeks. Damaged trees will be removed and will be stump grind. Capital Projects Update Work continues on the U.S. Hwy. 51 project, Village Road, and Boeck Road. Winnebago Avenue was to begin today. Once Winnebago Avenue is complete, work on the Alleys will begin. The work on U.S. Hwy. 51may eliminate the chlorination project in Ward 1 as flow rates will be much improved with the installation of larger pipe.

June 2 Storm City Administrator Murphy informed Council that 800 homes lost power due to the storm. There was an issue with the generator exhaust system causing the Municipal Building to fill with carbon monoxide. Council will look at approving Declaring a State of Emergency Disaster Declaration for the storm, which makes the city eligible for reimbursement through the State of Wisconsin Disaster Fund. Costs related to the storm will be tracked for reimbursement. The storm did not qualify for FEMA funding, so there will be no funding available for residential property owners. City Allocation of CARES Reimbursement Grant The City is eligible for reimbursement funding in the amount of $165,599 through the CARES Reimbursement Grant. This is for unbudgeted expenses relative to the Coronavirus response. It does not cover loss of revenue. The City is also eligible for a Subgrant from the Wisconsin Elections Commission of approximately $5000 to cover unbudgeted expenses for fall election preparations.

B. Recommendation from Park and Recreation Board Memorandum of Agreement for Phase II of Portage Skateboard Park Motion by Charles, second by Klapper to approve the Memorandum of Agreement

for Phase II of Portage Skateboard Park. City Administrator Murphy explained that Portage Family State Park is responsible for 100% of the funding for the project. Kyle Little, Portage Family Skate Park President, informed the Council of the group’s fundraising to date. The group is within $2,900 of their goal; and hope to have a buffer in the event of any overruns on the project. City Administrator Murphy explained that the city will provide some oversite as the remainder of the park will remain open during construction. Motion carried unanimously on call of roll.

C. Recommendations from Finance/Administration Committee 1. Monthly Claims

Motion by Nachreiner, second by Hahn to approve payment of claims in the amount of $1,074,104.73. Motion carried unanimously on call of roll.

D. Consider Proclamation Declaring a State of Emergency Disaster Declaration Motion by Charles, second by Radant to approve the Proclamation Declaring a State of Emergency Disaster Declaration. City Administrator Murphy explained approval of the Declaration makes the city eligible for reimbursement through the State of Wisconsin Disaster Fund. Costs listed in the Declaration are estimates; actual costs will be available at the end of the clean-up. Motion carried unanimously on call of roll.

1. Roll Call The meeting was called to order by Nachreiner at 5:30p.m.

2. Approval of minutes from previous meeting held on May 11, and May 21, 2020. Motion by Hahn, seconded by Monfort to approve the minutes from the May 11 and May 21, 2020 meetings. Motion passed unanimously on call of roll.

3. Discussion and possible recommendation on claims. Murphy presented claims in the amount of $1,074,104.73 noting $296,966.84 relates to capital items and $17,233.10 relate to WI St Land Acq. Motion by Hahn, second by Maass to approve claims in the amount of $1,074,104.73. Motion passed unanimously on call of roll.

4. Discussion and possible recommendation on proposals for Replacement of Council Chamber Sound system. Murphy reviewed the 2 proposals from Fearings and Wisconsin Audio Video(WAV). Initial proposals from both firms were reviewed by the Cable Commission in October, 2019. However, the WAV proposal was for complete audio system replacement whereas the Fearings proposal included partial replacement. These updated proposals represent complete system replacement and are consider equal in scope. The Fearings proposal is $42,782.12 whereas the WAV proposal is $44,052.11. The committee would like the proposals to be updated as they are over 30 days old and sent back to the Cable Commission to select a vendor. Several members expressed dissatisfaction with Fearings and felt the WAV proposal better suited our needs. $45,000 is included in the 2020 Capital Budget for this project (funded via proposed short term loan). Motion by Hahn, second by Maass to approve the replacement of the City Hall sound system for a cost not to exceed $45,000 and refer proposals to the Cable Commission for final selection. Motion passed unanimously on call of roll.

5. Budget Time Schedule Nachreiner discussed the Budget Review Schedule with the committee and expressed his desire to have the reviews be conducted in-person.

Coronavirus and the move to reduced library hours allowed time for the transition of staff into new positions to occur in a more relaxed setting: Chris Baker added the Adult Services Librarian role, Pam Lathrop-Roets added the role of Teen Services Librarian and Linda Floeter has moved from Circulation Clerk to Library Assistant-Public Ser-vices. Store rooms have been cleaned and cleared, computer workstations are being updated and distanced, using laptops and carrels, weeding in adult fiction and nonfic-tion is nearly completed for the first time in many years and even displays and pro-

gramming are looking differently and appealing to unique audiences using the re-strictions and precautions necessitated by the pandemic.

5. Staff Reports a. Phased library reopening plans

New reopening guidelines have been received from DPI. Number of people allowed in library at one time by appointment will begin increasing next week. Time between ap-pointments will be reduced. Library hours may be expanded into the later afternoons. Curbside Pick-up will be phased out. Holds will begin to be filled for other libraries. Bookdrop remains open and items are quarantined for 72 hours.

6. Old Business a. Discussion and possible action on landscaping progress, strategy and com-

pletion Edgewater Home & Garden reseeded and repositioned edging. Landscaping fabric, seeds and straw mats have been purchased to use after weeding completed. Motion by Vehring, second by Eppinger to pay the remaining 10% of Edgewater Home & Gar-den’s total bill ($623) which was withheld until landscaping work was satisfactorily completed. Motion passed.

7. New Business a. Discussion and possible action on the election of Library Board officers Motion by Vehring, second by Schultz for the current slate of officers to remain for an-

5. Discussion on how COVID-19 has affected tourism revenue versus budget cancellation of events partially funded by tourism dollars The Commission has seen a significant cut to the amount of room tax dollars that have

been received due to the pandemic and the Safer at Home order. Marianne gave an overview of funds we have paid and what we still need to pay this year. Discussion took place on cancellation of events and how to proceed with advertising at this time. Funds will not be issued for events if they do not take place, especially since these funds are to be used toward marketing the event. Organizations will receive their direct allocation funds. The Commission agreed to move forward with any advertising that was under contract and hold any other advertising until the next meeting in July. At this meeting, we will review the room tax revenues that have been paid. We need to be resourceful and make cuts where needed, but still find ways that we can promote the community and increase overnight stays. Marianne referenced the opportunity that we are using with the Wisconsin Department of Tourism and the ability to have matching funds with our advertising It was also suggested at the next meeting we discuss contacting the organizations that have received tourism funds this year to make them aware of the decrease in tourism revenues and how that will impact their budget requests in the future. 6. Discussion and action on 2020 tourism marketing activities including the canoe Marianne informed the Commission that the FAST Corporation was deemed a non-essential business and needed to close during the Safer at Home order. This meant that our canoes were not created as scheduled. They are now back open and have been able to complete the canoe mold currently. We have the option to build the canoes now for delivery in September/October or wait and delivery can be in January 2021. The remaining payment would be due when the canoes are completed. The Commission decided to wait and have the canoes delivered in January 2021.

2. Approval of minutes of October 30, 2019 meeting. Motion by Maass, seconded by Radant to approve minutes from the October 30, 2019 meeting. Motion passed unanimously on call of roll.

3. Appointment of Vice-Chairperson Welsh opened the floor to nominations for Vice-Chairperson. Shimpach offered to serve as Vice Chairperson, Maass also offered to be Vice Chair. Motion by Radant, second by Maass to appoint Maass as Vice Chairperson. Motion carried unanimously on a call of the roll.

4. Discussion and Possible Action on Proposals to Replace Audio System-Council Chambers Murphy commented that the Committee met on proposals from Fearings and WAV in October, 2019 but was directed to obtain a proposal from Fearings for full replacement of audio system as initial proposal was for replacement of components only. Murphy asked both firms to provide brief summaries of their respective proposals. D. Boyle, WAV provided overview indicating that their proposal is full replacement of audio system, including wiring. Mazzara indicated their proposal is fully digital and compatible with existing components. Proposal included training for Brightsign. Proposal amount is $44,052.11. E. Tresner, Fearings stated their proposal is essentially the same as WAV with full replacement of existing system with compatible, digital system. Proposal also included training for Brightsign. Proposal amount is $42,782.12. Maass confirmed if both proposals included replacement of existing wiring. WAV & Fearings confirmed full replacement of existing wiring. Wireless microphones were

not replaced in either proposal, wireless antenna will be extended in both proposals. Murphy noted Brightsign training was originally requested as part of the proposals however, staff has obtained training therefore, this will not be requested. Fearings indicated there will be a $372 deduct if training is not requested; WAV indicated a $405 deduction if no training is requested. Motion by Maass, second by Radant to award the WAV proposal for the revised amount of $43,647.11 (without Brightstar Training). Maass stated she supports the WAV proposal as she felt service received from Fearings has been unsatisfactory. Radant commented that current system has not been satisfactory for as long as he can remember, Knebel agreed. Welsh commented that he believed service from Fearings has been satisfactory. Motion carried 4-1 with Shimpach voting no.

Murphy thanked both firms for their proposals and their participation and patience

with the process, which was delayed due to the COVID-19 outbreak. 5. Adjourn

3. Discussion and possible action on the granting of a Conditional Use permit to Daniel Sparling 424 W. Conant Street, Parcel #1766. Director Sobiek reported that Daniel Sparling, has submitted a Conditional Use permit (CUP) application to allow bee keeping at his residence at 424 W. Conant Street (Parcel #1766). City Code, Sec 6-121, requires the bee hive; stand or box located no closer than 20 ft. to any property boundary and may only be located in a rear yard. If bee colonies are kept within 50 ft. of any property boundary, a barrier must be installed and maintained that prevents bees from flying through it, no less than 5 ft. high along the exterior edge of the property boundary. Said barrier may be either natural planting or artificial. A concept site plan has been submitted. The plan shows two bee hives kept in the back yard with a screen around. The bee hives, as shown, are more than 20 ft., but less than 50 ft. from any property boundary. One nearby resident who lives on W. Pleasant Street (Parcel #1762) across the alley from the applicant contacted the City to indicate she is allergic to bee stings. She indicated her opposition to this Conditional Use permit application being approved. I asked that a doctor’s letter be provided to corroborate her allergy but, to date, this has not been provided. In light of the this neighbor’s concern and the fact that this is the City’s first bee keeping CUP application in recent memory, I asked Alderperson Marty Havlovic, a bee keeping expert and consultant and former UW-Extension Community Development/Agriculture instructor, to share some information that would be helpful in understanding bee keeping. Alderperson Havlovic shared the following comments and suggestions:

• Honey bees travel about 2 miles in search for pollen and water and may travel up to 6 miles if need be.

• The Plan Commission may want to restrict the number of hives a person can have. I would limit it to 2 hives per property. Keeping the number this low will help lower neighbor concerns and fears.

• The Plan Commission may want to instruct the beekeeper to position his hive so that the opening to the hive faces his property and that s/he construct a 5 foot barrier about 6 feet from the opening so that the bees are forced to fly up and off the ground when they leave the hive and therefore do not bother animals/people as much. The sooner you get them flying up in the air and on their way to search for pollen, the fewer problems you'll have with animals and people on the ground level.

• Only the worker bees (not the queen or drones) will sting. And they only sting if the hive is provoked. American bees are not that aggressive. And there are NO Africanized bees in Wisconsin. A good beekeeper in the USA can handle his/her bees without worry of stings.

• Honey bees will swarm in Spring or early Summer because the populations are large and this is the usual time a bee colony will divide or split into two. A good beekeeper knows to split his/her colony or add more deep boxes to give space to the colony. People will see these swarms in a tree and be afraid. Bees that are swarming do not sting unless they are provoked by someone poking them with a stick or spraying them.

• There is a lot of fear about bees that is unfounded. I would ask the complaining neighbor if he/she is truly allergic to bees, if he/she has done allergy tests. Also there are over 500 species of bees in the USA and the sting from some of these bees (bumble, carpenter, mason, leaf-cutters, wasps, hornets, etc.) may be more painful or fatal than the sting from a honey bee.

Staff recommends approval of this Conditional Use permit, with the following conditions:

• No more than 2 hives allowed on the property with the positioning of the hives’ opening facing the inside of the applicant’s property toward the house.

• Applicant shall construct a 5 foot barrier about 6 feet from

the bee hive opening so that the bees are forced to fly up and off the ground when they leave the hive and therefore do not bother animals/people as much.

• Applicant shall keep bees in accordance with City Code, Sec 6-121, and Wisconsin Statute, Chap 94.76, regulating the keeping of bees.

In accordance with Section 90-62 (1) of the City’s Code of Ordinances, I, as Zoning Administrator, present the following findings:

1. The Conditional Use is in harmony with the recommendations of the comprehensive plan.

2. The Conditional Use will not result in substantial or undue

adverse impact on nearby property, the character of the neighborhood, environment, parking, public improvements, public property, or other matters affecting the public health, safety, or general welfare, either as they now exist or as they may be in the future.

3. The Conditional Use maintains the desired consistency of

land uses and development related to the environs of the subject property.

4. The Conditional Use is located in an area that will be

adequately served by, and will not impose an undue burden on any of the improvements, facilities, utilities or services provided by public agencies serving the subject property.

5. The potential public benefit outweigh any and all potential

adverse impacts of the proposed conditional use, after taking into consideration the applicant’s proposal and any requirements recommended by the applicant to ameliorate such impacts.

Sulik inquired as to whether a land use such as a community garden might be better suited to allowing the keeping of bees. Director Sobiek responded that a Community Garden land use, as defined in the City Code, would be another land use option specifically allowing bee keeping.

Miller asked the applicant where additional bee hives would be located if his current two bee hives would be divided, assuming the Conditional Use permit was granted. Mr. Sparling responded that he has a friend living in a township outside of the city of Portage that could accommodate the keeping of additional bee hives.

Miller asked the applicant what beekeeping experience he has in dividing bee hives. Mr. Sparling stated that he has one year of experience dividing hives while keeping bees in a city in Alberta, Canada.

Barthen stated that he has experience in the keeping of bees in another country. Based on this experience, he believes bees can be kept

peaceably in a residential neighborhood, and is in support of approving the Conditional Use permit.

Egan inquired as to whether Ms. Semsonson has a doctors letter that states she is allergic to bees. Ms. Semonson indicated that she was unable to obtain the doctor’s letter until the past day or so. She could text or email the letter if needed.

Sulik expressed concern about allowing the keeping of bees in a residential neighborhood such as this. He inquired whether the Plan Commission could impose a sunset provision or end date in granting this conditional use application. Director Sobiek stated that the Plan Commission can put certain conditions on a conditional use, and has authority to revoke a conditional use that is granted.

Administrator Murphy concurred, stating that the Plan Commission can require a review of the conditional use permit granted within a certain period of time.

Ms. Semonson indicated that there are many bees currently in her back yard.

Charles asked for clarification on whether the applicant was keeping bees on his property at the current time. Director Sobiek indicated that the applicant initially had two bee hives in his back yard but removed them to a rural location outside of Portage when asked to do so, while action on his Conditional use permit was pending.

Mr. Sparling corroborated this but indicated that bees often return to their previous area of habitation. Consequently, the bees may be traveling to his backyard and nearby residents’ properties from the several miles that the bee hives are currently domiciled at.

Miller expressed concern about granting this conditional use permit given that the applicant’s property is two blocks from St. Mary’s School.

Motion by Charles, second by Sulik, to deny approval of the Conditional Use permit application for Daniel Sparling for bee keeping, Parcel #1766, 740 W. Conant Street. Motion passed on a call of the roll with Dodd, Charles, Egan, Miller and Sulik voting Yes, and Barthen and Zirbes voting No.

4. Discussion and possible action on granting a Conditional Use permit

to Joseph Janas, for vehicle sales, 116 Brook Street, Parcel #194.01.

Director Sobiek reported that Joseph Janas has submitted a Conditional Use permit (CUP) application to allow vehicle sales at 116 Brook Street (Parcel # 2481.01). Mr. Janas currently owns and operates a vehicle dealership, Portage Motors, at 515 E. Wisconsin St. He is selling this

There will be no outside storage and no change in the footprint of the current building. The site map shows a maximum 41 stalls to accommodate vehicles for sale, and customer parking for 6 customer vehicles meeting City code requirements. We have received no public comments or inquiries as a result of the public hearing notice for this CUP application. Staff recommends approval of this CUP. In accordance with Section 90-62 (1) of the City’s Code of Ordinances, I, as Zoning Administrator, present the following findings:

#159 and Parcel #146.D, 904 Superior Street

Director Sobiek reported that Crawford Oil has submitted a site plan, including exterior elevations, exterior rendering, and elevation for a 4,200 sf, 30’ by 140’, accessory building at 904 Superior Street, Parcel #146.D. The site plan also shows proposed asphalt pavement proposed over an area of gravel near and adjacent to the proposed accessory building. The proposed cold storage building will be a metal panel building as shown in the rendering. In tandem, this site plan also shows a 285’ by 88’ gravel pad on Parcel #159, a vacant parcel on Superior Street adjacent to the canal. This gravel area will be used for liquid propane tank storage. In addition a stormwater pond will be constructed to the north of the gravel pad to meet City stormwater management requirements. This gravel pad will be used for outdoor storage and requires a conditional use permit for this proposed use in this M-1 Industrial zoning district. A Conditional Use permit has been applied for with a public hearing and action scheduled for the July 20 Plan Commission meeting. The proposed driveway and curb cut (Superior Street) shown will allow vehicle access to the parcel. Current off street parking allows this new storage building to meet City Code for storage use. Landscaping plan shows 7 medium and large deciduous trees to complement the existing trees to allow applicant to meet the minimal landscaping requirements in this M-1 Industrial zoning district. No exterior lighting plan was submitted. The stormwater management plans meet City Code requirements. . Land use requirements in City Code require screening along the southern side lot line bordering a residential property, as well as the front and north side areas as no ordinary structural screening is available. Lastly, the site plan for Parcel #159 does not comply with the 10’ paved surface area setback from a right-of-way required in this M-1 Industrial zoning district. Staff recommend amending this site plan so the gravel area setback is at least 10’ from the Superior Street right-of-way. Staff recommends approval of this site plan contingent upon approval of a Conditional Use permit for outdoor storage on Parcel #159 with screening that meets City Code requirements, and amending the site plan to show a minimum 10’ paved surface right-of-way from the Superior Street right-of-way.

Sulik stated his support for screening on the Parcel #159 site plan. He also expressed concern about the Parcel #159 site plan in light of the upcoming Canal project and path of the Ice Age Trail parallel to the railroad bridge. Director Jahncke clarified that the Ice Age Trail does go under the rail road bridge but follows on private property by agreement with the private property owners Kory Anderson stated that there are already existing trees that provide some screening along the north and south boundaries of Parcel #159. He also stated that because of semi-truck turning movements and maneuvering needed to load and unload the liquid propane gas tanks safely on the parcel, a wider access driveway and a reduced pavement setback are needed. Director Sobiek stated he advised the applicant to submit a variance application for the 10’ paved surface setback requirement to the Board of Zoning Appeals. Mayor Dodd inquired if the Plan Commission could approve the site plan for Parcel #146.D, while taking no action on the site plan for Parcel #159. Director Sobiek stated the Plan Commission could do so. Administrator Murphy concurred. Sulik inquired if the Plan Commission has the authority to table action on this site plan and consider action on it at a future meeting. Mayor Dodd said he preferred that the Plan Commission take no action. In this event, a new or revised site plan can be considered as an agenda item at a future meeting. Motion by Charles, second by Miller, to approve the site plan for Crawford Oil on Parcel #146.D, 904 Superior Street, as submitted, and take no action on the site plan for Parcel #159. Motion passed unanimously on a call of the roll.

6. Discussion and possible action on Site Plan for Lynn Properties Director Sobiek reported that Lynn Properties, LLC has submitted a site plan for a new one story 60’ by 100’, 7,488 sf accessory building in the rear of Parcel #3083, 2756 New Pinery Road. The parcel is zoned B-3 Interchange Business and is the site of La Tolteca Restaurant. The plans include an existing site plan, exterior elevations, parking, exterior lighting, and drainage/stormwater management plan. The proposed unheated building will be 30’ in height, with 3 sets of overhead and utility doors on the east side of the building.

The exterior rendering of the building show it to be a metal exterior in tan and green. No utilities other than basic electric power to the building. The parcel’s parking stall count is 87, with 50 stalls required by La Tolteca Restaurant. Two existing 15’ light poles will remain in the rear of the restaurant building and back parking area to provide sufficient lighting. No landscaping plan was included in the site plan. The applicant asks that no landscaping be required for this building since is set back off the main street corridor, limiting the visibility and value of any landscaping. The landscaping point value required by Code is 302 points; 195 points for building foundation perimeter and 110 points for street frontage. The stormwater management plan submitted plan meets City Code requirements. Staff recommends approval of this site plan, contingent upon submittal of a landscaping plan meeting. Zirbes inquired if the proposed building was related to the La Tolteca Restaurant, or another principle land use. Director Sobiek indicated that equipment, including maintenance and snow removal equipment, for La Tolteca Restaurant would be stored there, as well as for maintaining other Lynn Properties, LLC properties. He also pointed out that Lynn Properties owns the parcel and leases it to the restaurant. As such it would be considered an accessory structure, and an allowed. Administrator Murphy concurred. Motion by Miller, second by Charles, to approve the site plan as submitted by Lynn Properties, LLC, for 2756 New Pinery Road, Parcel #3083, contingent upon submittal of a landscaping plan meeting City Code as approved by Staff. Motion passed unanimously on a call of the roll.

7. Discussion and possible action on CSM for Walmart Real Estate Business Trust, Parcel #3094.07. Director Sobiek reported that Cave Enterprises Operations LLC, Chicago, IL has submitted a CSM for their new one story 3,252 sf Burger King Restaurant to be constructed on the Walmart Lot 1 (CSM 3903), Parcel #3094.07, 2960 New Pinery Road. The CSM delineates the Lot1 for this new development and Lot 2 for the Walmart store and meets the bulk zoning requirements for parcels zoned B-3 Interchange business. Staff recommend approval of the CSM, as submitted.

8. Site Plan for Burger King Development

Director Sobiek reported that Cave Enterprises Operations LLC, Chicago, IL has submitted a site plan for their new one story 3,252 sf Burger King Restaurant to be constructed on the Walmart Lot 1 (CSM 3903), Parcel #3094.07, 2960 New Pinery Road. The plans include an existing site/demolition plan, site plan, interior floor plans showing configuration and usage, exterior elevations, building sections, exterior lighting and photometric plan, landscaping, utility plans, grading, stormwater management and erosion control plan, exterior rendering, drive-thru queuing and exterior signage. 28 total parking stalls are shown, including 2 ADA handicapped parking and loading, are shown meeting City Code for restaurant use. A bike loop to park and secure bicycles is also noted on the plan. A main entrance is shown on the north side of the building facing the parking lot, with a concrete sidewalk walkway. Vehicle ingress and egress is shown from the west via the Walmart Lot 2 drive aisle, and from the east via the frontage road. The exterior lighting plans shows 3 pole mounted LED fixtures in the new north parking lot area. 3 pole mounted LED fixtures are shown along the southern drive thru drive aisle. A photometric lighting plan included shows the exterior lighting plan meets the City’s lighting code. Landscaping plan provides 595 points, including 4 flowering pears, 3 Honey Locust, 2 deciduous trees, 3 Arbor Vitae, 46 medium and large shrubs (Virburnum, Yew and Rose), and 40 perennial plant plantings for foundation, street frontage, and paved surface landscaping requirements. Landscaping plan meets and exceeds the Landscaping Code requirement of 594 points. Exterior wall signage and a ground sign are shown meeting City code requirements. The current site with this development feeds into the adjacent Walmart regional stormwater detention pond which it was designed for. Staff recommends a stormwater detention pond maintenance agreement between Walmart and the City, relative to accepting stormwater discharge for this development.

Fire Chief Simonson has reviewed this site plan and states it meets fire response requirements. Staff recommends approval of this site plan as submitted, contingent upon a stormwater detention pond maintenance agreement between Walmart and the City for this development. Motion by Charles, second by Miller, to approve the site plan, as submitted, by Cave Enterprises for the new Burger King Restaurant, for Walmart LOT 1, 2960 New Pinery Road, Parcel #3094.07, contingent upon approval of a maintenance agreement between Walmart and the City for the stormwater detention pond. 4. Discussion on Portage’s Status as an obligated Airport. Jahncke reviewed the memo. In 2016 the City of Portage began the Exhibit A survey project with the Wisconsin Bureau of Aviation. At the time we were told that this project would not obligate us. During a January of 2020 meeting the FAA responded that the Portage Municipal Airport was obligated. The BOA provided all of Portage’s recent airport projects and the FAA determined that the Exhibit A Survey federally obligated the Airport. The four grant assurances the project triggered were 23 – Exclusive Rights, 25- Airport Revenues, 30 – Civil Rights, and 31 Disposal of Land. These four grant assurances last as long as the airport is owned and operated as an airport. Exclusive rights – Is that the as long as the airport is operating as an airport that it sole use is an airport. Airport Revenues – Airport Revenues shall be used at the airport. Seeing that our expenditures are greater than the City’s revenues we follow this assurance. Civil Rights – That the Airport doesn’t discriminate based on race, creed, religion, and etc.

Disposal of land – If the City decides on building a new Airport that the sale of the existing Airport Land is used to fund the building of a new airport. There are three scenarios for the outcome of the Master Plan.

1. If the City decides to improve the existing airport site and stay at the existing site nothing new happens in terms of these four obligations.

2. If the City decides to move the airport we would have to use the sale of the land to build a new airport.

3. If the City decides to close the airport. This action would still require congressional approval but because the Master Plan identifies our deficiencies this could be supported by the FAA. The airport would cease operations and the grant assurances would disappear.

In summary the obligation is another hoop to jump through but the obligations would not affect any of the Master Plan final scenarios.

5. Discussion on the Quonset Hut Roof.

Jahncke reviewed the memo. On June 1, 2020 staff met with Dave Bartelt to evaluate the roofing system on the Quonset Hut. Dave stated in his report that the roof on the Quonset Hut should last for at least 5 years and that when time came to replace the roof he gave us three options in his report. There are some areas where Eric was concerned about moisture and Dave gave him some ideas to determine where the moisture is coming from. The moisture is most likely caused by condensation due to the change in temperatures. Eric will be running some tests to determine where the moisture is coming from. 6. Discussion on TDA’s Memo It was discussed that the potential July 9 meeting will be moved back to July 23 and a schedule will be created to coincide with the August commission meeting. 7. Discussion on Airport Manager’s Report Eris Peterson reviewed his report which was attached to the minutes. 8. Adjournment Maass called the meeting at 6:15p. Passed 6-0 on a call of roll.

May REPORT June 5, 2020 WORK COMPLETED:

Inside Work: Inspected all the fire extinguishers as I do every month! All ok.(inside as well as outside) Cleaned hangar (long way to go with this project) Look into 30K from feds(FAA) At commission meeting(5-20-2020) confirmed we have $30k to be reimbursed for(debt reduction, wages, utilities and ect) Took out old Air Conditioner –Found Rotted wall and replaced it, insulated wall and put foam in cracks. Cost was under $100. Painted ½ of the terminal (next week will finish it up).

Outside Work: Had to replace two bulbs on runway lighting later in the month (27th), Put wire in conduit at the end lights north end. We added one light to the end markers make them same as others (3 each side) Contacted Electric One for beacon, because it was not working. Replaced Bulb in Reil light it was getting dimmer. We got 2 Loads of wood chips to spread around. We made a path of wood chip from Silver Lake Dr. to the main entrance, went around signs and foundation of terminal. We sprayed runway 04/22 to kill grass in cracks, and sprayed weeds on field. Swiched to 91 Octane from swift!! With new fuel I had to learn how to change price on pumps. Blew off ramp, front stoop, and by pumps. Mowed as needed! We Mowed the grass to back taxi 04/22. Put up Flags for Memorial Day!! Removed some Tie downs.

Fuel Balance: We sold 671.27 gallons of fuel in April. Sold 409.14 gal. of 100LL 197.65 gal. of Swift and 64.48 gal. of 91 octane (new fuel)

Hangar News: Hangar #8 moved to Baraboo because he could build a hangar there (he rather have been in Portage).We do have a renter in # 8 for just one month and will fill it in July with Larry Fry’s (RV-8). Hangar #3 will be taking his airplane to Pennsylvania , and will be filled with Tom Benson’s Ultra Light . Hangar # 13 was rented by Steve Johnson’s (piper) and is open for June but will be filled in July by Richard Juarez. Hangar #15 Bill Robicheau sold his airplane and moved out 5-30-2020. This Hangar

#15 was filled with Steve Johnson’s airplane that was in hangar #13. We had a Storm with winds up to 70 MPH that ripped off the doors. This Storm peeled off the tin like a sardine can. We got bid on hangar doors that were damaged and replacing them would be $2000.00 that is $1000 per door. This bid was a different contractor that bid the same price as the doors that are scheduled to be replaced this summer. Lastly none of the hangar contracts have been signed or dated by the City. Airport Commission: Filed May’s report on the 8th of June with Aaron. May meeting with the Airport Commission was by remote audio. In the month of May we had about 177 Operations that I know of. Which is good. Best month since I have been here.

FAA/BOA report: Still looking to see if we are obligated to the FAA? Also still a-wait the Master plan!!

City Work: Again and still City Brush pile is getting taller and taller again at approach end of 22 and I will inform city! We still have car tires for city to take away!(near wind sock.) Parks Dept. is mowing 1 a week now! Unless it rains. EAA: Nothing to report still on lock down. (Next meeting 6-8-2020)

BUDGET: All bills have been passed to City and approved by the Airport Mgr. The budget should be on track so far. I have received the budget and Balance to the end of March

Summary of Proposed Changes This ordinance revises and simplifies the residency requirements for those individuals appointed to a City of Portage Board, Commission or Committee.

ORDINANCE NO. 20-08 ORDINANCE RELATIVE TO RESIDENCY REQUIREMENTS

Chapter 2 - Administration Article V. BOARDS, COMMITTEES & COMMISSIONS

The following sections shall be repealed and recreated as follows:

Section 2-36. – Standing committees; action on committee reports.

(b) Composition of committees. Each of the several standing committees, except the parks and recreation board, shall be composed of five (5) alderpersons with the chairperson to be designated by the mayor, except that for the human resources committee the mayor shall be the chairperson. The mayor and administrator shall serve as ex-officio members of each standing committee, except that the mayor is an official member of the human resources committee. All other sections shall remain as previously adopted. Section 2-142. Residency requirements for service on boards, commissions and committees

(1) All boards, commissions and committees of the City or Portage shall be constituted such that a majority of the members are residents of the City of Portage.

(2) For all appointments to boards, commissions and committees, preference shall be given to City of Portage residents, except for appointments to boards, commissions or committees that by ordinance, statute or other law, require membership of a person residing outside of the corporate limits of the City of Portage.

The CONSULTANT SERVICES will be performed for the DEPARTMENT's SW Region office located in Madison, WI and will be completed by December 31, 2021. Deliver PROJECT DOCUMENTS to 2101 Wright Street, Madison, WI 53704-2583, unless other directions are given by the DEPARTMENT. Compensation for all SERVICES provided by the CONSULTANT under the terms of the CONTRACT will be from the:

DEPARTMENT MUNICIPALITY For all contract services, a lump sum of $69,955.03.

Compensation for all SERVICES provided by the CONSULTANT under the terms of the CONTRACT shall be for an amount not to exceed $69,955.03.

The CONSULTANT does and will comply with the laws and regulations relating to the profession of engineering and will provide the desired engineering SERVICES.

This CONTRACT incorporates and the parties agree to all of the standard provisions of the Three Party Design Engineering Services Contract, dated July 1, 2015 and referenced in Procedure 8-15-1 of the State of Wisconsin Department of Transportation Facilities Development Manual. CONSULTANT acknowledges receipt of a copy of these standard provisions.

This CONTRACT incorporates all of the MANUALS defined in the CONTRACT.

The parties also agree to all of the Special Provisions which are annexed and made a part of this CONTRACT, consisting of 8 pages. Nothing in this CONTRACT accords any third part beneficiary rights whatsoever on any non-party that may be enforced by any non-party to this contract.

(4) Confer on an ongoing basis with all utility facility owners in the project vicinity to establish mutual understanding on design features of the project affecting utility facilities, and shall keep the DEPARTMENT and MUNICIPALITY informed of all such coordination activities.

F. MEETINGS

(1) An Operational Planning Meeting to discuss the organization and processing of the Services under this CONTRACT is not part of this CONTRACT and would be considered “Extra Services” if required.

(2) A Final Plan Review Meeting by phone call with the MUNICIPALITY shall be held approximately 45 - 60 days ahead of the P.S. & E. submittal date.

(3) One (1) meeting by phone shall be held to plan, review, and coordinate the PROJECT with the DEPARTMENT and MUNICIPALITY'S staff.

(4) A coordination meeting with utilities having facilities on the PROJECT is not part of this CONTRACT and would be considered “Extra Services” if required.

G. LOCATING

Locating is not included in this CONTRACT. The development of alignments has been completed and a preferred alignment has been chosen based on work completed under the Preliminary and Environmental Documentation phase for Project ID 6996-05-27.

H. SURVEYS

Survey is not included in this CONTRACT. All survey data for this project shall use the survey data obtained under the Preliminary and Environmental Documentation phase for Project ID 6996-05-27. Any additional survey required to complete the final design of this project shall be considered “Extra Services”.

Soils and Subsurface Investigation is not included in this CONTRACT. The CONSULTANT shall base soils investigation on material that has been placed by the dredging operation. Any soils data shall be supplied to the CONSULTANT prior to the pavement design.

J. PATH PLANS

The CONSULTANT shall prepare Path Plans for the PROJECT which provide for a project length and location as depicted in the preliminary plan set completed under the Preliminary and Environmental Documentation phase for Project ID 6996-05-27.

Path Plans are the compilation of documents, reproducible drawings, depicting the location, character, dimensions, and relevant data necessary to the layout and construction of the prescribed work. Path Plans shall be designed in accordance with the current practices of the DEPARTMENT and in accordance with the principles, standards, and the practices adopted by the DEPARTMENT for the design of path plans, as specified in the MANUAL and shall be developed in accordance to, of be coordinated with the latest edition of the STANDARD SPECIFICATIONS for HIGHWAY and STRUCTURE CONSTRUCTION, of the DEPARTMENT.

This CONTRACT takes into account that the alignment and profile have been determined and completed under the Preliminary and Environmental Documentation phase for Project ID 6996-05-27 and will be used for this project.

Plans are subject to review and examination by the DEPARTMENT and MUNCPALITY.

Section II C (9) in the Standard Provision of the CONTRACT is amended to include the following plans:

K. STRUCTURE PLANS

Structure Plans are not included in this CONTRACT.

L. PLATS

(1) The CONSULTANT shall prepare a Right of Way Plat for temporary acquisition as defined in the MANUAL. The Right of Way Plat shall be prepared on 11-inch by 17-inch reproducible sheets. The CONSULTANT shall include the Right of Way Plat information on the Plan & Profile Sheets.

(2) The CONSULTANT shall use the most current tax records to determine ownership of properties and premises through over which a temporary Right of Way for the PROJECT is to be acquired.

(3) The CONSULTANT shall prepare Right of Way Descriptions for all individual parcels of land to be acquired as temporary Right of Way for the PROJECT. Descriptions shall be by metes and bounds in accordance with the provisions as set forth in the MANUAL, or in the case of platted property by suitable reference to the platted data. The Descriptions shall be tied to the PROJECT. The CONSULTANT shall prepare the descriptions on conveyance documents.

(4) The CONSULTANT shall submit the Right of Way Plat and Descriptions to the MUNICIPALITY for review and examination prior to being submitted to the DEPARTMENT.

(5) The CONSULTANT shall field locate and temporarily mark the temporary boundaries in a manner which will facilitate the appraisal of all affected parcels.

(1) The CONSULTANT shall submit the Plan Letter, Sample Proposal with the Highway Work Proposal and Special Provisions, Recommendation to Governor for Contract and Bond Approval Form, Utility Status Report, Certificate of Right of Way, Contract Time for Completion, News Release, and the Notes to Construction portion of the P.S.&E. electronically as specified in the MANUAL.

N. SERVICES PROVIDED BY THE MUNICIPALITY OR DEPARTMENT

The MUNICIPALITY or DEPARTMENT will provide to the CONSULTANT the following for the PROJECT:

1. As-built plans, as may be available

2. Known utility names and contacts

3. Soils data for path pavement design

O. PROSECUTION AND PROGRESS

(1) The CONSULTANT shall report on the progress of the PROJECT as stipulated in the contract agreement. Standard benchmarks, consistent with DEPARTMENT’S internal staff benchmarks, will be reported monthly to the DEPARTMENT. The actual start, projected or actual finish date, and percent of work complete will be included for all relevant benchmarks on any project report required for delivery to DEPARTMENT staff. The report can be delivered in electronic format consistent with current DEPARTMENT standards (Microsoft Project), or on paper.

(2) The CONSULTANT proposes to sublet these services to:

None.

(3) The following items of work will be completed and submitted to the DEPARTMENT by the indicated dates, if CONSULTANT has received the Notice to Proceed by August 1, 2020.
