A s a consequence o f a policy decision m ade in A p r i l , 1966, by the respondent, the C om m issioner o f Police o f the M etropolis , the police did not attempt to enforce section 32 (1 ) (a) o f the Betting, G a m in g and Lotteries A c t, 1963, in g am ing clubs in London. T h e applicant, a private citizen, com plained that illegal gam ing was being carried on, and applied to the D iv is ional Court for, inter alia , an order o f mandamus directing the respondent to reverse the po licy decision. Th e application

w-as refused and the applicant appealed to the Court o f A ppeal. In D ecem ber, 1967, the respondent ora lly announced a new policy o f enforcing, and steps w ere taken to enforce, section 32 (1 ) (a ) o f the

A ct, and he undertook on appeal that the p o licy decision o f A p ril , 1966, w ou ld be o ff ic ia lly revoked.O n the contentions that the respondent ow ed no duty to the public to enforce the law and had an

absolute discretion not to prosecute, and that the appeal was in a c rim inal cause o r m atter w ith in

section 31 (1 ) ( a ) o f the Supreme Court o f Judicature (C onsolidation) A ct, 1 9 2 5 ,1 so that the court was w ith o u t jurisdiction in the appeal:-
