Rule 1

(ii) “Pro to col” me ans the Pro to col Re la ting to theMad rid Ag re e ment Con cer ning the In ter na tio -nal Re gis tra tion of Marks, adop ted at Mad rid on June 27, 1989;

(iii) “Con trac ting Par ty” me ans any co un try par ty to the Ag re e ment or any Sta te or in ter go ver nmen -tal or ga ni za tion par ty to the Pro to col;

(xiv) “ba sic re gis tra tion” me ans the re gis tra tion of amark that has been ef fec ted by the Of fi ce of aCon trac ting Par ty and that con sti tu tes the ba -sis for the in ter na tio nal ap pli ca tion for the re -gis tra tion of that mark;

(xv) “de sig na tion” me ans the re qu est for ex ten sionof pro tec tion (“ter ri to rial ex ten sion”) un der Ar -tic le 3ter(1) or (2) of the Ag re e ment or un der Ar -tic le 3ter(1) or (2) of the Pro to col, as the casemay be; it also me ans such ex ten sion as re cor -ded in the In ter na tio nal Re gis ter;

(xvi) “de sig na ted Con trac ting Par ty” me ans a Con -trac ting Par ty for which the ex ten sion of pro tec -tion (“ter ri to rial ex ten sion”) has been re qu es ted un der Ar tic le 3ter(1) or (2) of the Ag re e ment orun der Ar tic le 3ter(1) or (2) of the Pro to col, as the case may be, or in res pect of which such ex ten -sion has been re cor ded in the In ter na tio nal Re -gis ter;

Rule 2

Com mu ni ca tion with the In ter na tio nal Bu re au

Com mu ni ca tions ad dres sed to the In ter na tio nal Bu -re au shall be ef fec ted as spe ci fied in the Ad mi nis tra ti ve In struc tions.

Rule 3

Re pre sen ta tion Be fo re the In ter na tio nal Bu re au

(1) [Re pre sen ta ti ve; Ad dress of Re pre sen ta ti ve;Num ber of Re pre sen ta ti ves](a) The ap pli cant or the hol der may have a re pre sen ta -

ti ve be fo re the In ter na tio nal Bu re au.(b) The ad dress of the re pre sen ta ti ve shall be,

(i) in res pect of an in ter na tio nal ap pli ca tion go ver -ned ex clu si ve ly by the Ag re e ment, in the ter ri to ryof a Con trac ting Par ty bo und by the Ag re e ment;

(ii) in res pect of an in ter na tio nal ap pli ca tion go ver -ned ex clu si ve ly by the Pro to col, in the ter ri to ryof a Con trac ting Par ty bo und by the Pro to col;

(iii) in res pect of an in ter na tio nal ap pli ca tion go ver -ned by both the Ag re e ment and the Pro to col, inthe ter ri to ry of a Con trac ting Par ty;

(iv) in res pect of an in ter na tio nal re gis tra tion, inthe ter ri to ry of a Con trac ting Par ty.

(c) The ap pli cant or the hol der may have one re pre sen -ta ti ve only. Whe re the ap po in tment in di ca tes se ve -ral re pre sen ta ti ves, only the one in di ca ted firstshall be con si de red to be a re pre sen ta ti ve and bere cor ded as such.

(d) Whe re a part ner ship or firm com po sed of at tor ne ysor pa tent or tra de mark agents has been in di ca tedas re pre sen ta ti ve to the In ter na tio nal Bu re au, itshall be re gar ded as one re pre sen ta ti ve.

(2) [Ap po in tment of the Re pre sen ta ti ve](a) The ap po in tment of a re pre sen ta ti ve may be made

in the in ter na tio nal ap pli ca tion, or in a sub se qu entde sig na tion or a re qu est un der Rule 25.

(b) The ap po in tment of a re pre sen ta ti ve may also bemade in a se pa ra te com mu ni ca tion which may re -la te to one or more spe ci fied in ter na tio nal ap pli ca -tions or in ter na tio nal re gis tra tions of the same ap -pli cant or hol der. The said com mu ni ca tion shall bepre sen ted to the In ter na tio nal Bu re au(i) by the ap pli cant, the hol der or the ap po in ted re -

pre sen ta ti ve, or(ii) by the Of fi ce of the Con trac ting Par ty of the hol -

der.The com mu ni ca tion shall be sig ned by the ap pli cant or thehol der, or by the Of fi ce thro ugh which it was pre sen ted.

(3) [Ir re gu lar Ap po in tment] (a) Whe re the ad dress of the pur por ted re pre sen ta ti ve

is not in the ter ri to ry re le vant un der pa ra -graph (1)(b), the In ter na tio nal Bu re au shall tre atthe ap po in tment as if it had not been made andshall in form ac cor din gly the ap pli cant or hol der,the pur por ted re pre sen ta ti ve and, if the sen der ortrans mit ter is an Of fi ce, that Of fi ce.

(b) Whe re the In ter na tio nal Bu re au con si ders that theap po in tment of a re pre sen ta ti ve un der pa ra graph (2)is ir re gu lar, it shall no ti fy ac cor din gly the ap pli cantor hol der, the pur por ted re pre sen ta ti ve and, if thesen der or trans mit ter is an Of fi ce, that Of fi ce.

(c) As long as the re le vant re qu i re ments un der pa ra -graphs (1)(b) and (2) are not com plied with, the In -ter na tio nal Bu re au shall send all re le vant com mu -ni ca tions to the ap pli cant or hol der him self.

(4) [Re cor ding and No ti fi ca tion of Ap po in tment of aRe pre sen ta ti ve; Ef fec ti ve Date of Ap po in tment]

(a) Whe re the In ter na tio nal Bu re au finds that the ap -po in tment of a re pre sen ta ti ve com plies with the ap -pli cab le re qu i re ments, it shall re cord the fact thatthe ap pli cant or hol der has a re pre sen ta ti ve, as well as the name and ad dress of the re pre sen ta ti ve, inthe In ter na tio nal Re gis ter. In such a case, the ef fec -ti ve date of the ap po in tment shall be the date onwhich the In ter na tio nal Bu re au re ce i ved the in ter -na tio nal ap pli ca tion, sub se qu ent de sig na tion, re -qu est or se pa ra te com mu ni ca tion in which the re -pre sen ta ti ve is ap po in ted.

(b) The In ter na tio nal Bu re au shall no ti fy the re cor dingre fer red to in sub pa rag raph (a) to both the ap pli cantor hol der and the re pre sen ta ti ve. Whe re the ap po in -tment was made in a se pa ra te com mu ni ca tion pre -sen ted thro ugh an Of fi ce, the In ter na tio nal Bu re aushall also no ti fy the re cor ding to that Of fi ce.

(5) [Ef fect of Ap po in tment of a Re pre sen ta ti ve]

(a) Ex cept whe re the se Re gu la tions ex pres sly pro vi deot her wi se, the sig na tu re of a re pre sen ta ti ve re cor -ded un der pa ra graph (4)(a) shall rep la ce the sig na -tu re of the ap pli cant or hol der.

(b) Ex cept whe re the se Re gu la tions ex pres sly re qu i rethat an in vi ta tion, no ti fi ca tion or ot her com mu ni -ca tion be ad dres sed to both the ap pli cant or hol derand the re pre sen ta ti ve, the In ter na tio nal Bu re aushall ad dress to the re pre sen ta ti ve re cor ded un derpa ra graph (4)(a) any in vi ta tion, no ti fi ca tion or ot -her com mu ni ca tion which, in the ab sen ce of a re -pre sen ta ti ve, wo uld have to be sent to the ap pli cant or hol der; any in vi ta tion, no ti fi ca tion or ot her com -mu ni ca tion so ad dres sed to the said re pre sen ta ti veshall have the same ef fect as if it had been ad dres -sed to the ap pli cant or hol der.

(c) Any com mu ni ca tion ad dres sed to the In ter na tio nal Bu re au by the re pre sen ta ti ve re cor ded un der pa ra -graph (4)(a) shall have the same ef fect as if it hadbeen ad dres sed to the said Bu re au by the ap pli cant or hol der.

(6) [Can cel la tion of Re cor ding; Ef fec ti ve Date of Can -cel la tion]

(a) Any re cor ding un der pa ra graph (4)(a) shall be can -cel led whe re can cel la tion is re qu es ted in a com mu -ni ca tion sig ned by the ap pli cant, hol der or re pre -sen ta ti ve. The re cor ding shall be can cel led exof fi cio by the In ter na tio nal Bu re au whe re a new re -pre sen ta ti ve is ap po in ted or, in case a chan ge inow ner ship has been re cor ded, whe re no re pre sen -

ta ti ve is ap po in ted by the new hol der of the in ter na -tio nal re gis tra tion.

(b) Sub ject to sub pa rag raph (c), the can cel la tion shallbe ef fec ti ve from the date on which the In ter na tio nalBu re au re ce i ves the cor res pon ding com mu ni ca tion.

(c) Whe re the can cel la tion is re qu es ted by the re pre -sen ta ti ve, it shall be ef fec ti ve from the ear lier of thefol lo wing:(i) the date on which the In ter na tio nal Bu re au re -

ce i ves a com mu ni ca tion ap po in ting a new re -pre sen ta ti ve;

(ii) the date of the ex pi ry of a pe riod of two monthsco un ted from the re ce ipt of the re qu est of the re -pre sen ta ti ve that the re cor ding be can cel led.

Un til the ef fec ti ve date of the can cel la tion, all com mu -ni ca tions re fer red to in pa ra graph (5)(b) shall be ad -dres sed by the In ter na tio nal Bu re au to both the ap pli -cant or hol der and the re pre sen ta ti ve.

(d) The In ter na tio nal Bu re au shall, upon re ce ipt of a re -qu est for can cel la tion made by the re pre sen ta ti ve,no ti fy ac cor din gly the ap pli cant or hol der, and addto the no ti fi ca tion co pies of all com mu ni ca tions sent to the re pre sen ta ti ve, or re ce i ved by the In ter na tio -nal Bu re au from the re pre sen ta ti ve, du ring the sixmonths pre ce ding the date of the no ti fi ca tion.

(e) The In ter na tio nal Bu re au shall, once the ef fec ti vedate of the can cel la tion is known, no ti fy the can cel la -tion and its ef fec ti ve date to the re pre sen ta ti ve who sere cor ding has been can cel led, to the ap pli cant or hol -der and, whe re the ap po in tment of the re pre sen ta ti ve had been pre sen ted thro ugh an Of fi ce, to that Of fi ce.

Rule 4

Cal cu la tion of Time Li mits

(1) [Pe riods Ex pres sed in Ye ars] Any pe riod ex pres -sed in ye ars shall ex pi re, in the re le vant sub se qu entyear, in the month ha ving the same name and on theday ha ving the same num ber as the month and the dayof the event from which the pe riod starts to run, ex ceptthat, whe re the event oc cur red on Feb ru a ry 29 and inthe re le vant sub se qu ent year Feb ru a ry ends onthe 28th, the pe riod shall ex pi re on Feb ru a ry 28.

(2) [Pe riods Ex pres sed in Months] Any pe riod ex pres -sed in months shall ex pi re, in the re le vant sub se qu entmonth, on the day which has the same num ber as theday of the event from which the pe riod starts to run, ex -cept that, whe re the re le vant sub se qu ent month has no day with the same num ber, the pe riod shall ex pi re onthe last day of that month.

The ap pli cant or the hol -der, as the case may be, may an nex to the in ter na tio -nal ap pli ca tion, or to a re qu est for the re cor ding of asub se qu ent de sig na tion or of a chan ge, a pro po sedtrans la tion of any text mat ter con ta i ned in the in ter -na tio nal ap pli ca tion or the re qu est. If the pro po sedtrans la tion is not con si de red by the In ter na tio nal Bu -re au to be cor rect, it shall be cor rec ted by the In ter na -tio nal Bu re au af ter ha ving in vi ted the ap pli cant or thehol der to make, wit hin one month from the in vi ta tion,ob ser va tions on the pro po sed cor rec tions.

(b) Not wit hstan ding sub pa rag raph (a), the In ter na tio -nal Bu re au shall not trans la te the mark. Whe re, in

Rule 7

Whe re that Con trac ting Par ty re qu i res thedec la ra tion to be sig ned by the ap pli cant him self and to be made on a se pa ra te of fi cial form an ne xed to the in -ter na tio nal ap pli ca tion, the no ti fi ca tion shall con ta ina sta te ment to that ef fect and shall spe ci fy the exactwor ding of the re qu i red dec la ra tion. Whe re the Con -trac ting Par ty fur ther re qu i res the dec la ra tion to be inEn glish even if the in ter na tio nal ap pli ca tion is inFrench, or to be in French even if the in ter na tio nal ap -pli ca tion is in En glish, the no ti fi ca tion shall spe ci fy there qu i red lan gu a ge.

(3) [No ti fi ca tion](a) Any no ti fi ca tion re fer red to in pa ra graph (2) may be

made at the time of the de po sit by the Con trac ting Par -ty of its in stru ment of ra ti fi ca tion, ac cep tan ce or ap -pro val of, or ac ces sion to, the Pro to col, and the ef fec ti -ve date of the no ti fi ca tion shall be the same as the date of en try into for ce of the Pro to col with res pect to theCon trac ting Par ty ha ving made the no ti fi ca tion. Theno ti fi ca tion may also be made la ter, in which case theno ti fi ca tion shall have ef fect three months af ter its re -ce ipt by the Di rec tor Ge ne ral, or at any la ter date in di -ca ted in the no ti fi ca tion, in res pect of any in ter na tio -nal re gis tra tion who se date is the same as or is la terthan the ef fec ti ve date of the no ti fi ca tion.

(b) Any no ti fi ca tion made un der pa ra graph (1), as infor ce be fo re Oc to ber 4, 20011), or pa ra graph (2)may be wit hdrawn at any time. (1) [Pre sen ta tion] The in ter na tio nal ap pli ca tion shall be pre sen ted to the In ter na tio nal Bu re au by the Of fi ceof ori gin.

(2) [Form and Sig na tu re](a) The in ter na tio nal ap pli ca tion shall be pre sen ted on

the of fi cial form in one copy.(b) The in ter na tio nal ap pli ca tion shall be sig ned by the

Of fi ce of ori gin and, whe re the Of fi ce of ori gin so re -qu i res, also by the ap pli cant. Whe re the Of fi ce ofori gin does not re qu i re the ap pli cant to sign the in -ter na tio nal ap pli ca tion but al lows that the ap pli -cant also sign it, the ap pli cant may do so.

(iv) that the ap pli cant has a real and ef fec ti ve in -dus trial or com mer cial es tab lis hment in theter ri to ry of the Con trac ting Par ty who se Of fi ceis the Of fi ce of ori gin.

(vi) that the go ods and ser vi ces in di ca ted in the in -ter na tio nal ap pli ca tion are co ve red by the list of go ods and ser vi ces ap pe a ring in the ba sic ap pli -ca tion or ba sic re gis tra tion, as the case may be.

(e) Whe re the in ter na tio nal ap pli ca tion is ba sed on two or more ba sic ap pli ca tions or ba sic re gis tra tions,the dec la ra tion re fer red to in sub pa rag raph (d)shall be de e med to ap ply to all tho se ba sic ap pli ca -tions or ba sic re gis tra tions.

on a se pa ra te of fi cial form an ne xed to the in ter -na tio nal ap pli ca tion, or

(ii) be in clu ded in the in ter na tio nal ap pli ca tion.

Rule 10

Fees Con cer ning the In ter na tio nal Ap pli ca tion

(1) [In ter na tio nal Ap pli ca tions Go ver ned Ex clu si ve ly by the Ag re e ment] An in ter na tio nal ap pli ca tion go ver -ned ex clu si ve ly by the Ag re e ment shall be sub ject tothe pa y ment of the ba sic fee, the com ple men ta ry feeand, whe re ap pli cab le, the sup ple men ta ry fee, spe ci -fied in item 1 of the Sche du le of Fees. Tho se fees shallbe paid in two in stal ments of ten ye ars each. For thepa y ment of the se cond in stal ment, Rule 30 shall ap ply.

(2) [In ter na tio nal Ap pli ca tions Go ver ned Ex clu si ve ly by the Pro to col] An in ter na tio nal ap pli ca tion go ver nedex clu si ve ly by the Pro to col shall be sub ject to the pa y -ment of the ba sic fee, the com ple men ta ry fee and/orthe in di vi du al fee and, whe re ap pli cab le, the sup ple -men ta ry fee, spe ci fied or re fer red to in item 2 of theSche du le of Fees. Tho se fees shall be paid for ten ye ars.

(b) Sub ject to sub pa rag raph (c), whe re the Of fi ce of ori -gin re ce i ves a re qu est to pre sent to the In ter na tio -nal Bu re au an in ter na tio nal ap pli ca tion go ver nedby both the Ag re e ment and the Pro to col be fo re the

mark which is re fer red to in that re qu est is re gis te -red in the re gis ter of the said Of fi ce, thein ter na tio nal ap pli ca tion shall be tre a ted as an in -ter na tio nal ap pli ca tion go ver ned ex clu si ve ly by thePro to col, and the Of fi ce of ori gin shall de le te the de -sig na tion of any Con trac ting Par ty bo und by theAg re e ment.

(c) Whe re the re qu est re fer red to in sub pa rag raph (b)is ac com pa nied by an ex press re qu est that the in -ter na tio nal ap pli ca tion be tre a ted as an in ter na tio -nal ap pli ca tion go ver ned by both the Ag re e mentand the Pro to col once the mark is re gis te red in there gis ter of the Of fi ce of ori gin, the said Of fi ce shallnot de le te the de sig na tion of any Con trac ting Par tybo und by the Ag re e ment and the re qu est to pre sentthe in ter na tio nal ap pli ca tion shall be de e med tohave been re ce i ved by the said Of fi ce, for the pur po -ses of Ar tic le 3(4) of the Ag re e ment and Ar tic le 3(4)of the Pro to col, on the date of the re gis tra tion of themark in the re gis ter of the said Of fi ce.

(2) [Ir re gu la ri ties to Be Re me died by the Ap pli cant]

(a) If the In ter na tio nal Bu re au con si ders that the in -ter na tio nal ap pli ca tion con ta ins ir re gu la ri ties ot -her than tho se re fer red to in pa ra graphs (3), (4) and(6) and in Ru les 12 and 13, it shall no ti fy the ap pli -cant of the ir re gu la ri ty and at the same time in formthe Of fi ce of ori gin.

(b) Such ir re gu la ri ties may be re me died by the ap pli cantwit hin three months from the date of the no ti fi ca tionof the ir re gu la ri ty by the In ter na tio nal Bu re au. If anir re gu la ri ty is not re me died wit hin three months from the date of the no ti fi ca tion of that ir re gu la ri ty by theIn ter na tio nal Bu re au, the in ter na tio nal ap pli ca tionshall be con si de red aban do ned and the In ter na tio nal Bu re au shall no ti fy ac cor din gly and at the same timethe ap pli cant and the Of fi ce of ori gin.

(3) [Ir re gu la ri ty to Be Re me died by the Ap pli cant orby the Of fi ce of Ori gin]

(a) Not wit hstan ding pa ra graph (2), whe re the fees pa y ab -le un der Rule 10 have been paid to the In ter na tio nalBu re au by the Of fi ce of ori gin and the In ter na tio nalBu re au con si ders that the amo unt of the fees re ce i vedis less than the amo unt re qu i red, it shall no ti fy at thesame time the Of fi ce of ori gin and the ap pli cant. Theno ti fi ca tion shall spe ci fy the mis sing amo unt.

(b) The mis sing amo unt may be paid by the Of fi ce of ori -gin or by the ap pli cant wit hin three months from thedate of the no ti fi ca tion by the In ter na tio nal Bu re au. If the mis sing amo unt is not paid wit hin three monthsfrom the date of the no ti fi ca tion of the ir re gu la ri ty bythe In ter na tio nal Bu re au, the in ter na tio nal ap pli ca -tion shall be con si de red aban do ned and the In ter na -tio nal Bu re au shall no ti fy ac cor din gly and at thesame time the Of fi ce of ori gin and the ap pli cant.

(4) [Ir re gu la ri ties to Be Re me died by the Of fi ce of Ori gin]

(a) If the In ter na tio nal Bu re au

(i) finds that the in ter na tio nal ap pli ca tion does notful fill the re qu i re ments of Rule 2 or was not pre -sen ted on the of fi cial form pre scri bed un derRule 9(2)(a),

(iii) con si ders that the in ter na tio nal ap pli ca tioncon ta ins ir re gu la ri ties re la ting to the en tit le -ment of the ap pli cant to file an in ter na tio nal ap -pli ca tion,

(iv) con si ders that the in ter na tio nal ap pli ca tioncon ta ins ir re gu la ri ties re la ting to the dec la ra -tion by the Of fi ce of ori gin re fer red to inRule 9(5)(d),

(v) [De le ted]

(vi) finds that the in ter na tio nal ap pli ca tion is notsig ned by the Of fi ce of ori gin, or

(vii) finds that the in ter na tio nal ap pli ca tion doesnot con ta in the date and num ber of the ba sicap pli ca tion or ba sic re gis tra tion, as the casemay be,

it shall no ti fy the Of fi ce of ori gin and at the sametime in form the ap pli cant.

(b) Such ir re gu la ri ties may be re me died by the Of fi ce ofori gin wit hin three months from the date of no ti fi ca -tion of the ir re gu la ri ty by the In ter na tio nal Bu re au. Ifan ir re gu la ri ty is not re me died wit hin three monthsfrom the date of the no ti fi ca tion of that ir re gu la ri ty bythe In ter na tio nal Bu re au, the in ter na tio nal ap pli ca -tion shall be con si de red aban do ned and the In ter na -tio nal Bu re au shall no ti fy ac cor din gly and at thesame time the Of fi ce of ori gin and the ap pli cant.

(5) [Re im bur se ment of Fees] Whe re, in ac cor dan cewith pa ra graphs (2)(b), (3) or (4)(b), the in ter na tio nalap pli ca tion is con si de red aban do ned, the In ter na tio -nal Bu re au shall re fund any fees paid in res pect of thatap pli ca tion, af ter de duc tion of an amo unt cor res pon -ding to one-half of the ba sic fee re fer red to initems 1.1.1, 2.1.1 or 3.1.1 of the Sche du le of Fees, tothe par ty ha ving paid tho se fees.

(6) [Ot her Ir re gu la ri ty With Res pect to the De sig na -tion of a Con trac ting Par ty Un der the Pro to col]

(a) Whe re, in ac cor dan ce with Ar tic le 3(4) of the Pro to -col, an in ter na tio nal ap pli ca tion is re ce i ved by theIn ter na tio nal Bu re au wit hin a pe riod of two months from the date of re ce ipt of that in ter na tio nal ap pli -ca tion by the Of fi ce of ori gin and the In ter na tio nalBu re au con si ders that a dec la ra tion of in ten tion touse the mark is re qu i red ac cor ding to Rule 9(5)(f)but is mis sing or does not com ply with the ap pli -cab le re qu i re ments, the In ter na tio nal Bu re au shall prom ptly no ti fy ac cor din gly and at the same timethe ap pli cant and the Of fi ce of ori gin.

(b) The dec la ra tion of in ten tion to use the mark shallbe de e med to have been re ce i ved by the In ter na tio -nal Bu re au to get her with the in ter na tio nal ap pli ca -tion if the mis sing or cor rec ted dec la ra tion is re ce i -ved by the In ter na tio nal Bu re au wit hin the pe riodof two months re fer red to in sub pa rag raph (a).

(c) The in ter na tio nal ap pli ca tion shall be de e med notto con ta in the de sig na tion of the Con trac ting Par tyfor which a dec la ra tion of in ten tion to use the markis re qu i red if the mis sing or cor rec ted dec la ra tion is

re ce i ved af ter the pe riod of two months re fer red toin sub pa rag raph (b). The In ter na tio nal Bu re aushall no ti fy ac cor din gly and at the same time theap pli cant and the Of fi ce of ori gin, re im bur se anyde sig na tion fee al re a dy paid in res pect of that Con -trac ting Par ty and in di ca te that the de sig na tion ofthe said Con trac ting Par ty may be ef fec ted asa sub se qu ent de sig na tion un der Rule 24, pro vi dedthat such de sig na tion is ac com pa nied by the re qu i -red dec la ra tion.

(7) [In ter na tio nal Ap pli ca tion Not Con si de red asSuch] If the in ter na tio nal ap pli ca tion is pre sen ted di -rect to the In ter na tio nal Bu re au by the ap pli cant ordoes not com ply with the re qu i re ment ap pli cab le un -der Rule 6(1), the in ter na tio nal ap pli ca tion shall not becon si de red as such and shall be re tur ned to the sen -der.

Rule 12

Ir re gu la ri ties With Res pectto the Clas si fi ca tion of Go ods and Ser vi ces

(1) [Pro po sal for Clas si fi ca tion](a) If the In ter na tio nal Bu re au con si ders that the re qu -

i re ments of Rule 9(4)(a)(xiii) are not com plied with,it shall make a pro po sal of its own for the clas si fi ca -tion and gro u ping and shall send a no ti fi ca tion ofits pro po sal to the Of fi ce of ori gin and at the sametime in form the ap pli cant.

(b) The no ti fi ca tion of the pro po sal shall also sta te theamo unt, if any, of the fees due as a con se qu en ce ofthe pro po sed clas si fi ca tion and gro u ping.

(2) [Opi nion Dif fe ring From the Pro po sal] The Of fi ceof ori gin may com mu ni ca te to the In ter na tio nal Bureau an opi nion on the pro po sed clas si fi ca tion andgro u ping wit hin three months from the date of the no ti -fi ca tion of the pro po sal.

(3) [Re min der of the Pro po sal] If, wit hin two monthsfrom the date of the no ti fi ca tion re fer red to in pa ra -graph (1)(a), the Of fi ce of ori gin has not com mu ni ca tedan opi nion on the pro po sed clas si fi ca tion and gro u -ping, the In ter na tio nal Bu re au shall send to the Of fi ceof ori gin and to the ap pli cant a com mu ni ca tion re i te ra -ting the pro po sal. The sen ding of such a com mu ni ca -tion shall not af fect the three-month pe riod re fer red toin pa ra graph (2).

(4) [Wit hdra wal of Pro po sal] If, in the light of the opi -nion com mu ni ca ted un der pa ra graph (2), the In ter na -tio nal Bu re au wit hdraws its pro po sal, it shall no ti fy the Of fi ce of ori gin ac cor din gly and at the same time in form the ap pli cant.

(5) [Mo di fi ca tion of Pro po sal] If, in the light of theopi nion com mu ni ca ted un der pa ra graph (2), the In -ter na tio nal Bu re au mo di fies its pro po sal, it shall no ti -fy the Of fi ce of ori gin and at the same time in form theap pli cant of such mo di fi ca tion and of any con se qu entchan ges in the amo unt in di ca ted un der pa ra -graph (1)(b).

(6) [Con fir ma tion of Pro po sal] If, not wit hstan dingthe opi nion re fer red to in pa ra graph (2), the In ter na tio -

(a) If no opi nion has been com mu ni ca ted to the In ter -na tio nal Bu re au un der pa ra graph (2), the amo untre fer red to in pa ra graph (1)(b) shall be pa y ab le wit -hin four months from the date of the no ti fi ca tion referred to in pa ra graph (1)(a), fa i ling which the in -ter na tio nal ap pli ca tion shall be con si de red aban -do ned and the In ter na tio nal Bu re au shall no ti fy the Of fi ce of ori gin ac cor din gly and at the same time in -form the ap pli cant.

(b) If an opi nion has been com mu ni ca ted to the In ter -na tio nal Bu re au un der pa ra graph (2), the amo untre fer red to in pa ra graph (1)(b) or, whe re ap pli cab le,pa ra graph (5) shall be pa y ab le wit hin three monthsfrom the date of the com mu ni ca tion by the In ter na -tio nal Bu re au of the mo di fi ca tion or con fir ma tion of its pro po sal un der pa ra graph (5) or (6), as the casemay be, fa i ling which the in ter na tio nal ap pli ca tionshall be con si de red aban do ned and the In ter na tio -nal Bu re au shall no ti fy the Of fi ce of ori gin ac cor -din gly and at the same time in form the ap pli cant.

(c) If an opi nion has been com mu ni ca ted to the In ter -na tio nal Bu re au un der pa ra graph (2) and if, in thelight of that opi nion, the In ter na tio nal Bu re au withdraws its pro po sal in ac cor dan ce with pa ra -graph (4), the amo unt re fer red to in pa ra -graph (1)(b) shall not be due.

Rule 13

Ir re gu la ri ties With Res pectto the In di ca tion of Go ods and Ser vi ces

(1) [Com mu ni ca tion of Ir re gu la ri ty by the In ter na tio -nal Bu re au to the Of fi ce of Ori gin] If the In ter na tio nalBu re au con si ders that any of the go ods and ser vi ces isin di ca ted in the in ter na tio nal ap pli ca tion by a termthat is too va gue for the pur po ses of clas si fi ca tion or isin com pre hen sib le or is lin gu is ti cal ly in cor rect, it shallno ti fy the Of fi ce of ori gin ac cor din gly and at the sametime in form the ap pli cant. In the same no ti fi ca tion, theIn ter na tio nal Bu re au may sug gest a sub sti tu te term,or the de le tion of the term.

(2) [Time Al lo wed to Re me dy Ir re gu la ri ty]

(a) The Of fi ce of ori gin may make a pro po sal for re me -

dy ing the ir re gu la ri ty wit hin three months from thedate of the no ti fi ca tion re fer red to in pa ra graph (1).

(b) If no pro po sal ac cep tab le to the In ter na tio nal Bureau for re me dy ing the ir re gu la ri ty is made wit -hin the pe riod in di ca ted in sub pa rag raph (a), theIn ter na tio nal Bu re au shall in clu de in the in ter na -tio nal re gis tra tion the term as ap pe a ring in the in -ter na tio nal ap pli ca tion, pro vi ded that the Of fi ce ofori gin has spe ci fied the class in which such termsho uld be clas si fied; the in ter na tio nal re gis tra tionshall con ta in an in di ca tion to the ef fect that, in theopi nion of the In ter na tio nal Bu re au, the spe ci fiedterm is too va gue for the pur po ses of clas si fi ca tionor is in com pre hen sib le or is lin gu is ti cal ly in cor rect, as the case may be. Whe re no class has been spe ci -fied by the Of fi ce of ori gin, the In ter na tio nal Bu re au shall de le te the said term ex of fi cio and shall no ti fythe Of fi ce of ori gin ac cor din gly and at the same time in form the ap pli cant.

Rule 14

Re gis tra tion of the Markin the In ter na tio nal Re gis ter

(1) [Re gis tra tion of the Mark in the In ter na tio nal Re -gis ter] Whe re the In ter na tio nal Bu re au finds that thein ter na tio nal ap pli ca tion con forms to the ap pli cab lere qu i re ments, it shall re gis ter the mark in the In ter na -tio nal Re gis ter, no ti fy the Of fi ces of the de sig na tedCon trac ting Par ties of the in ter na tio nal re gis tra tionand in form the Of fi ce of ori gin ac cor din gly, and send acer ti fi ca te to the hol der. Whe re the Of fi ce of ori gin sowis hes and has in for med the In ter na tio nal Bu re au ac -cor din gly, the cer ti fi ca te shall be sent to the hol derthro ugh the Of fi ce of ori gin.

(2) [Con tents of the Re gis tra tion] The in ter na tio nalre gis tra tion shall con ta in

(i) all the data con ta i ned in the in ter na tio nal ap -pli ca tion, ex cept any pri o ri ty cla im un derRule 9(4)(a)(iv) whe re the date of the ear lier fi -ling is more than six months be fo re the date ofthe in ter na tio nal re gis tra tion,

(ii) the date of the in ter na tio nal re gis tra tion,(iii) the num ber of the in ter na tio nal re gis tra tion,(iv) whe re the mark can be clas si fied ac cor ding to

the In ter na tio nal Clas si fi ca tion of Fi gu ra ti veEle ments, and un less the in ter na tio nal ap pli -ca tion con ta ins a dec la ra tion to the ef fect thatthe ap pli cant wis hes that the mark be con si de -red as a mark in stan dard cha rac ters, the re le -vant clas si fi ca tion sym bols of the said Clas si fi -ca tion as de ter mi ned by the In ter na tio nalBu re au,

(v) an in di ca tion, with res pect to each de sig na tedCon trac ting Par ty, as to whet her it is a Con trac -ting Par ty de sig na ted un der the Ag re e ment ora Con trac ting Par ty de sig na ted un der the Pro -to col.

Date of the In ter na tio nal Re gis tra tion

(1) [Ir re gu la ri ties Af fec ting the Date of the In ter na tio -nal Re gis tra tion] Whe re the in ter na tio nal ap pli ca tionre ce i ved by the In ter na tio nal Bu re au does not con ta inall of the fol lo wing ele ments:

(i) in di ca tions al lo wing the iden ti ty of the ap pli -cant to be es tab lis hed and suf fi cient to con tactthe ap pli cant or his re pre sen ta ti ve, if any,

(ii) the Con trac ting Par ties which are de sig na ted,(iii) a rep ro duc tion of the mark,(iv) the in di ca tion of the go ods and ser vi ces for

which re gis tra tion of the mark is so ught,the in ter na tio nal re gis tra tion shall bear the date onwhich the last of the mis sing ele ments re a ched the In -ter na tio nal Bu re au, pro vi ded that, whe re the last of the mis sing ele ments re a ches the In ter na tio nal Bu re auwit hin the two-month time li mit re fer red to in Ar tic -le 3(4) of the Ag re e ment and Ar tic le 3(4) of the Pro to col,the in ter na tio nal re gis tra tion shall bear the date onwhich the de fec ti ve in ter na tio nal ap pli ca tion was received or, as pro vi ded in Rule 11(1), is de e med tohave been re ce i ved by the Of fi ce of ori gin.

ting Par ty pur su ant to Ar tic le 5(2)(b) and (c), firstsen ten ce, of the Pro to col, the Of fi ce of that Con trac -ting Par ty shall, whe re it has be co me ap pa rent withre gard to a gi ven in ter na tio nal re gis tra tion de sig -na ting that Con trac ting Par ty that the op po si tionpe riod will ex pi re too late for any pro vi sio nal re fu sal ba sed on an op po si tion to be no ti fied to the In ter na -tio nal Bu re au wit hin the 18-month time li mit re fer -red to in Ar tic le 5(2)(b), in form the In ter na tio nalBu re au of the num ber, and the name of the hol der,of that in ter na tio nal re gis tra tion.

(b) Whe re, at the time of the com mu ni ca tion of the in for -ma tion re fer red to in sub pa rag raph (a), the da tes onwhich the op po si tion pe riod be gins and ends areknown, tho se da tes shall be in di ca ted in the com mu -ni ca tion. (b) A no ti fi ca tion of pro vi sio nal re fu sal shall re la te toone in ter na tio nal re gis tra tion, shall be da ted andshall be sig ned by the Of fi ce ma king it.

(2) [Con tent of the No ti fi ca tion] A no ti fi ca tion of pro -vi sio nal re fu sal shall con ta in or in di ca te

(4) [Re cor ding; Trans mit tal of Co pies of No ti fi ca -tions] The In ter na tio nal Bu re au shall re cord the pro vi -sio nal re fu sal in the In ter na tio nal Re gis ter to get herwith the data con ta i ned in the no ti fi ca tion, with an in -di ca tion of the date on which the no ti fi ca tion was sentor is re gar ded un der Rule 18(1)(d) as ha ving been sentto the In ter na tio nal Bu re au and shall trans mit a copythe re of to the Of fi ce of ori gin, if that Of fi ce has in for -med the In ter na tio nal Bu re au that it wis hes to re ce i vesuch co pies, and, at the same time, to the hol der.

(5) [Con fir ma tion or Wit hdra wal of Pro vi sio nal Re fu -sal]

(a) An Of fi ce which has sent to the In ter na tio nal Bureau a no ti fi ca tion of pro vi sio nal re fu sal shall,once all pro ce du res be fo re the said Of fi ce re la tingto the pro tec tion of the mark have been com ple ted,send to the In ter na tio nal Bu re au a sta te ment in di -ca ting eit her

(i) that pro tec tion of the mark is re fu sed in theCon trac ting Par ty con cer ned for all go ods andser vi ces,

(ii) that the mark is pro tec ted in the Con trac tingPar ty con cer ned for all go ods and ser vi ces re -quested, or

(iii) the go ods and ser vi ces for which the mark ispro tec ted in the Con trac ting Par ty con cer ned.

(b) Whe re, fol lo wing the sen ding of a sta te ment in ac -cor dan ce with sub pa rag raph (a), a fur ther de ci sionaf fects the pro tec tion of the mark, the Of fi ce shall,to the ex tent that it is awa re of that de ci sion, sendto the In ter na tio nal Bu re au a fur ther sta te ment in -di ca ting the go ods and ser vi ces for which the markis pro tec ted in the Con trac ting Par ty con cer ned.

(c) The In ter na tio nal Bu re au shall re cord any sta te -ment re ce i ved un der sub pa rag raph (a) or (b) in theIn ter na tio nal Re gis ter and shall trans mit a copythe re of to the hol der.

(d) The Of fi ce of a Con trac ting Par ty may, in a dec la ra -tion, no ti fy the Di rec tor Ge ne ral that, in ac cor dan -ce with the law of the said Con trac ting Par ty, (i) any pro vi sio nal re fu sal that has been no ti fied to

the In ter na tio nal Bu re au is sub ject to re view bythe said Of fi ce, whet her or not such re view hasbeen re qu es ted by the hol der, and

(ii) the de ci sion ta ken on the said re view may be the sub ject of a fur ther re view or ap pe al be fo re theOf fi ce.

Whe re this dec la ra tion ap plies and the Of fi ce is not in apo si tion to com mu ni ca te the said de ci sion di rec tly tothe hol der of the in ter na tio nal re gis tra tion con cer ned,the Of fi ce shall, not wit hstan ding the fact that all pro -ce du res be fo re the said Of fi ce re la ting to the pro tec tionof the mark may not have been com ple ted, send thesta te ment re fer red to in sub pa rag raph (a) to the In ter -na tio nal Bu re au im me dia te ly fol lo wing the said de ci -sion. Any fur ther de ci sion af fec ting the pro tec tion ofthe mark shall be sent to the In ter na tio nal Bu re au inac cor dan ce with sub pa rag raph (b).(e) The Of fi ce of a Con trac ting Par ty may, in a dec la ra -

tion, no ti fy the Di rec tor Ge ne ral that, in ac cor dan -ce with the law of the said Con trac ting Par ty, any ex of fi cio pro vi sio nal re fu sal that has been no ti fied tothe In ter na tio nal Bu re au is not open to re view be fo -re the said Of fi ce. Whe re this dec la ra tion ap plies,any ex of fi cio no ti fi ca tion of a pro vi sio nal re fu sal bythe said Of fi ce shall be de e med to in clu de a sta te -ment in ac cor dan ce with sub pa rag raph (a)(i) or (iii).

(6) [Sta te ment of Grant of Pro tec tion](a) An Of fi ce which has not com mu ni ca ted a no ti fi ca -

tion of pro vi sio nal re fu sal may, wit hin the pe riodap pli cab le un der Ar tic le 5(2) of the Ag re e ment orAr tic le 5(2)(a) or (b) of the Pro to col, send to the In -ter na tio nal Bu re au any of the fol lo wing:(i) a sta te ment to the ef fect that all pro ce du res be -

fo re the Of fi ce have been com ple ted and thatthe Of fi ce has de ci ded to grant pro tec tion to themark that is the sub ject of the in ter na tio nal re -gis tra tion;

(ii) a sta te ment to the ef fect that the ex of fi cio exa -mi na tion has been com ple ted and that the Of fi -ce has fo und no gro unds for re fu sal but that the pro tec tion of the mark is still sub ject to op po si -tion or ob ser va tions by third par ties, with an in -di ca tion of the date by which such op po si tionsmay be fi led;

Rule 18

Ir re gu lar No ti fi ca tions of Pro vi sio nal Re fu sal

(1) [Con trac ting Par ty De sig na ted Un der the Ag re e -ment](a) A no ti fi ca tion of pro vi sio nal re fu sal com mu ni ca ted

by the Of fi ce of a Con trac ting Par ty de sig na ted un -der the Ag re e ment shall not be re gar ded as such bythe In ter na tio nal Bu re au(i) if it does not con ta in any in ter na tio nal re gis tra -

tion num ber, un less ot her in di ca tions con ta i -ned in the no ti fi ca tion per mit the in ter na tio nalre gis tra tion to which the pro vi sio nal re fu sal re -la tes to be iden ti fied,

(ii) if it does not in di ca te any gro unds for re fu sal, or(iii) if it is sent too late to the In ter na tio nal Bu re au,

that is, if it is sent af ter the ex pi ry of one year from the date on which the re cor ding of the in ter na tio -nal re gis tra tion or the re cor ding of the de sig na -tion made sub se qu en tly to the in ter na tio nal re -gis tra tion has been ef fec ted, it be ing un der sto odthat the said date is the same as the date of sen -ding the no ti fi ca tion of the in ter na tio nal re gis tra -tion or of the de sig na tion made sub se qu en tly.

(b) Whe re sub pa rag raph (a) ap plies, the In ter na tio nalBu re au shall ne ver the less trans mit a copy of theno ti fi ca tion to the hol der, shall in form, at the sametime, the hol der and the Of fi ce that sent the no ti fi -ca tion that the no ti fi ca tion of pro vi sio nal re fu sal isnot re gar ded as such by the In ter na tio nal Bu re au,and shall in di ca te the re a sons the re for.

(c) If the no ti fi ca tion(i) is not sig ned on be half of the Of fi ce which com -

mu ni ca ted it, or does not ot her wi se com ply with the re qu i re ments of Rule 2 or with the re qu i re -ment ap pli cab le un der Rule 6(2),

(ii) does not con ta in, whe re ap pli cab le, the de tailsof the mark with which the mark that is the sub -ject of the in ter na tio nal re gis tra tion ap pe ars tobe in con flict (Rule 17(2)(v) and (3)),

(iii) does not com ply with the re qu i re ments ofRule 17(2)(vi),

(iv) does not com ply with the re qu i re ments ofRule 17(2)(vii), or

(v) [De le ted](vi) does not con ta in, whe re ap pli cab le, the name

and ad dress of the op po nent and the in di ca tionof the go ods and ser vi ces on which the op po si -tion is ba sed (Rule 17(3)),

the In ter na tio nal Bu re au shall, ex cept whe re sub pa -rag raph (d) ap plies, no net he less re cord the pro vi sio nalre fu sal in the In ter na tio nal Re gis ter. The In ter na tio nalBu re au shall in vi te the Of fi ce that com mu ni ca ted thepro vi sio nal re fu sal to send a rec ti fied no ti fi ca tion wit -hin two months from the in vi ta tion and shall trans mitto the hol der co pies of the ir re gu lar no ti fi ca tion and ofthe in vi ta tion sent to the Of fi ce con cer ned.

(d) Whe re the no ti fi ca tion does not com ply with the re -qu i re ments of Rule 17(2)(vii), the pro vi sio nal re fu -sal shall not be re cor ded in the In ter na tio nal Re gis -ter. If ho we ver a rec ti fied no ti fi ca tion is sent wit hinthe time li mit re fer red to in sub pa rag raph (c), itshall be re gar ded, for the pur po ses of Ar tic le 5 ofthe Ag re e ment, as ha ving been sent to the In ter na -tio nal Bu re au on the date on which the de fec ti veno ti fi ca tion had been sent to it. If the no ti fi ca tion isnot so rec ti fied, it shall not be re gar ded as a no ti fi -ca tion of pro vi sio nal re fu sal. In the lat ter case, theIn ter na tio nal Bu re au shall in form, at the sametime, the hol der and the Of fi ce that sent the no ti fi -ca tion that the no ti fi ca tion of pro vi sio nal re fu sal isnot re gar ded as such by the In ter na tio nal Bu re au,and shall in di ca te the re a sons the re for.

(e) Any rec ti fied no ti fi ca tion shall, whe re the ap pli cab lelaw so per mits, in di ca te a new time li mit, re a so nab le un der the cir cum stan ces, for fi ling a re qu est for re -view of, or ap pe al aga inst, the ex of fi cio pro vi sio nalre fu sal or the pro vi sio nal re fu sal ba sed on an op po -si tion and, as the case may be, for fi ling a res pon seto the op po si tion, pre fe rab ly with an in di ca tion ofthe date on which the said time li mit ex pi res.

(f) The In ter na tio nal Bu re au shall trans mit a copy ofany rec ti fied no ti fi ca tion to the hol der.

(2) [Con trac ting Par ty De sig na ted Un der the Pro to col]

Rule 19

In va li da tions in De sig na ted Con trac ting Par ties

(1) [Con tents of the No ti fi ca tion of In va li da tion] Whe -re the ef fects of an in ter na tio nal re gis tra tion are in va li -da ted in a de sig na ted Con trac ting Par ty un der Ar tic -le 5(6) of the Ag re e ment or Ar tic le 5(6) of the Pro to coland the in va li da tion is no lon ger sub ject to ap pe al, theOf fi ce of the Con trac ting Par ty who se com pe tent aut -ho ri ty has pro no un ced the in va li da tion shall no ti fy theIn ter na tio nal Bu re au ac cor din gly. The no ti fi ca tionshall con ta in or in di ca te

(i) the aut ho ri ty which pro no un ced the in va li da -tion,

(ii) the fact that the in va li da tion is no lon ger sub -ject to ap pe al,

(iii) the num ber of the in ter na tio nal re gis tra tion,(iv) the name of the hol der,(v) if the in va li da tion does not con cern all the go -

ods and ser vi ces, tho se in res pect of which thein va li da tion has been pro no un ced or tho se inres pect of which the in va li da tion has not beenpro no un ced, and

(vi) the date on which the in va li da tion was pro no -un ced and, whe re po ssib le, its ef fec ti ve date.

(2) [Re cor ding of the In va li da tion and In for ma tion tothe Hol der and the Of fi ce Con cer ned] The In ter na tio -nal Bu re au shall re cord the in va li da tion in the In ter na -tio nal Re gis ter, to get her with the data con ta i ned in theno ti fi ca tion of in va li da tion, and shall in form ac cor din -gly the hol der. The In ter na tio nal Bu re au shall also in -form the Of fi ce that com mu ni ca ted the no ti fi ca tion ofin va li da tion of the date on which the in va li da tion wasre cor ded in the In ter na tio nal Re gis ter if that Of fi ce hasre qu es ted to re ce i ve such in for ma tion.

Rule 20

Res tric tion of the Holder’s Right of Dis po sal

(1) [Com mu ni ca tion of In for ma tion](a) The hol der of an in ter na tio nal re gis tra tion or the

Of fi ce of the Con trac ting Par ty of the hol der may in -form the In ter na tio nal Bu re au that the holder’sright to dis po se of the in ter na tio nal re gis tra tionhas been res tric ted and, if ap prop ria te, in di ca te the Con trac ting Par ties con cer ned.

(b) The Of fi ce of any de sig na ted Con trac ting Par ty mayin form the In ter na tio nal Bu re au that the holder’sright of dis po sal has been res tric ted in res pect ofthe in ter na tio nal re gis tra tion in the ter ri to ry of that Con trac ting Par ty.

(c) In for ma tion gi ven in ac cor dan ce with subpara -graph (a) or (b) shall con sist of a sum ma ry sta te -ment of the main facts con cer ning the res tric tion.

(2) [Par tial or To tal Re mo val of Res tric tion] Whe re the In ter na tio nal Bu re au has been in for med of a res tric -tion of the holder’s right of dis po sal in ac cor dan ce with

pa ra graph (1), the par ty that com mu ni ca ted the in for -ma tion shall also in form the In ter na tio nal Bu re au ofany par tial or to tal re mo val of that res tric tion.

(3) [Re cor ding] The In ter na tio nal Bu re au shall re -cord the in for ma tion com mu ni ca ted un der pa ra -graphs (1) and (2) in the In ter na tio nal Re gis ter andshall in form ac cor din gly the hol der, the de sig na tedCon trac ting Par ties con cer ned and, whe re the in for ma -tion has been gi ven by an Of fi ce, that Of fi ce.

Rule 20bis

Li cen ses

(1) [Re qu est for the Re cor ding of a Li cen se](a) A re qu est for the re cor ding of a li cen se shall be pre -

sen ted to the In ter na tio nal Bu re au on the re le vantof fi cial form by the hol der or, if the Of fi ce ad mitssuch pre sen ta tion, by the Of fi ce of the Con trac tingPar ty of the hol der or the Of fi ce of a Con trac tingPar ty with res pect to which the li cen se is gran ted.

(b) The re qu est shall in di ca te(i) the num ber of the in ter na tio nal re gis tra tion

con cer ned,(ii) the name of the hol der,(iii) the name and ad dress of the li cen see, gi ven in

ac cor dan ce with the Ad mi nis tra ti ve In struc -tions,

(iv) the de sig na ted Con trac ting Par ties with res pect to which the li cen se is gran ted,

(v) that the li cen se is gran ted for all the go ods andser vi ces co ve red by the in ter na tio nal re gis tra -tion, or the go ods and ser vi ces for which the li -cen se is gran ted, gro u ped in the ap prop ria teclas ses of the In ter na tio nal Clas si fi ca tion ofGo ods and Ser vi ces.

(c) The re qu est may also in di ca te(i) whe re the li cen see is a na tu ral per son, the Sta te

of which the li cen see is a na tio nal,(ii) whe re the li cen see is a le gal en ti ty, the le gal na -

tu re of that en ti ty and the Sta te and, whe re ap -pli cab le, the ter ri to rial unit wit hin that Sta te,un der the law of which the said le gal en ti ty hasbeen or ga ni zed,

(iii) that the li cen se con cerns only a part of the ter ri -to ry of a spe ci fied de sig na ted Con trac ting Par -ty,

(iv) whe re the li cen see has a re pre sen ta ti ve, thename and ad dress of the re pre sen ta ti ve, gi venin ac cor dan ce with the Ad mi nis tra ti ve In struc -tions,

(v) whe re the li cen se is an ex clu si ve li cen se or asole li cen se, that fact,

(vi) whe re ap pli cab le, the du ra tion of the li cen se.(d) The re qu est shall be sig ned by the hol der or by the

Of fi ce thro ugh which it is pre sen ted.

(2) [Ir re gu lar Re qu est] (a) If the re qu est for the re cor ding of a li cen se does not

com ply with the re qu i re ments of pa ra graph (1)(a),(b) and (d), the In ter na tio nal Bu re au shall no ti fy

(b) If the ir re gu la ri ty is not re me died wit hin threemonths from the date of the no ti fi ca tion of the ir re -gu la ri ty by the In ter na tio nal Bu re au, the re qu estshall be con si de red aban do ned, and the In ter na tio -nal Bu re au shall no ti fy ac cor din gly and at the same time the hol der and, if the re qu est was pre sen ted by an Of fi ce, that Of fi ce, and re fund any fees paid, af -ter de duc tion of an amo unt cor res pon ding toone-half of the re le vant fees re fer red to in item 7 ofthe Sche du le of Fees, to the par ty ha ving paid tho se fees.

(3) [Re cor ding and No ti fi ca tion] Whe re the re qu estcom plies with the re qu i re ments of pa ra graph (1)(a), (b)and (d), the In ter na tio nal Bu re au shall re cord the li -cen se in the In ter na tio nal Re gis ter, to get her with thein for ma tion con ta i ned in the re qu est, shall no ti fy ac -cor din gly the Of fi ces of the de sig na ted Con trac tingPar ties in res pect of which the li cen se is gran ted andshall in form at the same time the hol der and, if the re -qu est was pre sen ted by an Of fi ce, that Of fi ce.

(4) [Amen dment or Can cel la tion of the Re cor ding of a Li cen se] Pa ra graphs (1) to (3) shall ap ply mu ta tis mu -tan dis to a re qu est for the amen dment or can cel la tionof the re cor ding of a li cen se.

(5) [Dec la ra tion That the Re cor ding of a Gi ven Li cen -se Has No Ef fect]

(a) The Of fi ce of a de sig na ted Con trac ting Par ty whichis no ti fied by the In ter na tio nal Bu re au of the re cor -ding of a li cen se in res pect of that Con trac ting Par ty may dec la re that such re cor ding has no ef fect in the said Con trac ting Par ty.

(b) The dec la ra tion re fer red to in sub pa rag raph (a)shall in di ca te

(i) the re a sons for which the re cor ding of the li cen -se has no ef fect,

(ii) whe re the dec la ra tion does not af fect all the go -ods and ser vi ces to which the li cen se re la tes,tho se which are af fec ted by the dec la ra tion ortho se which are not af fec ted by the dec la ra tion,

(iii) the cor res pon ding es sen tial pro vi sions of thelaw, and

(iv) whet her such dec la ra tion may be sub ject to re -view or ap pe al.

(c) The dec la ra tion re fer red to in sub pa rag raph (a)shall be sent to the In ter na tio nal Bu re au be fo re theex pi ry of 18 months from the date on which the no -ti fi ca tion re fer red to in pa ra graph (3) was sent tothe Of fi ce con cer ned.

(d) The In ter na tio nal Bu re au shall re cord in the In ter -na tio nal Re gis ter any dec la ra tion made in ac cor -dan ce with sub pa rag raph (c) and shall no ti fy ac cor -din gly the par ty (hol der or Of fi ce) that pre sen tedthe re qu est to re cord the li cen se.

(e) Any fi nal de ci sion re la ting to a dec la ra tion made inac cor dan ce with sub pa rag raph (c) shall be no ti fiedto the In ter na tio nal Bu re au which shall re cord it inthe In ter na tio nal Re gis ter and no ti fy ac cor din gly

the par ty (hol der or Of fi ce) that pre sen ted the re qu -est to re cord the li cen se.

(6) [Dec la ra tion That the Re cor ding of Li cen ses in the In ter na tio nal Re gis ter Has No Ef fect in a Con trac tingPar ty](a) The Of fi ce of a Con trac ting Par ty the law of which

does not pro vi de for the re cor ding of tra de mark li -cen ses may no ti fy the Di rec tor Ge ne ral that the re -cor ding of li cen ses in the In ter na tio nal Re gis ter has no ef fect in that Con trac ting Par ty.

(b) The Of fi ce of a Con trac ting Par ty the law of whichpro vi des for the re cor ding of tra de mark li cen sesmay, be fo re the date on which this Rule co mes intofor ce or the date on which the said Con trac ting Par -ty be co mes bo und by the Ag re e ment or the Pro to -col, no ti fy the Di rec tor Ge ne ral that the re cor ding of li cen ses in the In ter na tio nal Re gis ter has no ef fectin that Con trac ting Par ty. Such no ti fi ca tion may bewit hdrawn at any time.

Rule 21

Rep la ce ment of a Na tio nal or Re gio nalRe gis tra tion by an In ter na tio nal Re gis tra tion

(1) [No ti fi ca tion] Whe re, in ac cor dan ce with Ar tic -le 4bis(2) of the Ag re e ment or Ar tic le 4bis(2) of the Pro -to col, the Of fi ce of a de sig na ted Con trac ting Par ty hasta ken note in its Re gis ter, fol lo wing a re qu est made di -rect by the hol der with that Of fi ce, that a na tio nal or are gio nal re gis tra tion has been rep la ced by an in ter na -tio nal re gis tra tion, that Of fi ce shall no ti fy the In ter na -tio nal Bu re au ac cor din gly. Such no ti fi ca tion shall in -di ca te

(i) the num ber of the in ter na tio nal re gis tra tioncon cer ned,

(b) Whe re the Con trac ting Par ty of the hol der is bo undby the Ag re e ment, the hol der may de sig na te, un der

(2) [Pre sen ta tion; Form and Sig na tu re](a) A sub se qu ent de sig na tion shall be pre sen ted to the

In ter na tio nal Bu re au by the hol der or by the Of fi ceof the Con trac ting Par ty of the hol der; ho we ver,(i) whe re Rule 7(1), as in for ce be fo re Oc to ber 4,

2001, ap plies, it must be pre sen ted by the Of fi -ce of ori gin;

(ii) whe re any of the Con trac ting Par ties are de sig -na ted un der the Ag re e ment, the sub se qu ent de -sig na tion must be pre sen ted by the Of fi ce of theCon trac ting Par ty of the hol der.

(b) The sub se qu ent de sig na tion shall be pre sen ted onthe of fi cial form in one copy. Whe re it is pre sen tedby the hol der, it shall be sig ned by the hol der. Whe -re it is pre sen ted by an Of fi ce, it shall be sig ned bythat Of fi ce and, whe re the Of fi ce so re qu i res, alsoby the hol der. Whe re it is pre sen ted by an Of fi ceand that Of fi ce, wit ho ut re qu i ring that the hol deralso sign it, al lows that the hol der also sign it, thehol der may do so.

(b) Whe re the sub se qu ent de sig na tion con cerns aCon trac ting Par ty that has made a no ti fi ca tion un -der Rule 7(2), that sub se qu ent de sig na tion shallalso con ta in a dec la ra tion of in ten tion to use themark in the ter ri to ry of that Con trac ting Par ty; thedec la ra tion shall, as re qu i red by the said Con trac t -ing Par ty,(i) be sig ned by the hol der him self and be made on

a se pa ra te of fi cial form an ne xed to the sub se qu -ent de sig na tion, or

(ii) be in clu ded in the sub se qu ent de sig na tion.(c) The sub se qu ent de sig na tion may also con ta in

(i) the in di ca tions and trans la tion or trans la tions,as the case may be, re fer red to in Rule 9(4)(b),

(ii) a re qu est that the sub se qu ent de sig na tion takeef fect af ter the re cor ding of a chan ge or a can -cel la tion in res pect of the in ter na tio nal re gis -tra tion con cer ned or af ter the re ne wal of the in -ter na tio nal re gis tra tion.

(d) Whe re the in ter na tio nal re gis tra tion is ba sed on aba sic ap pli ca tion, a sub se qu ent de sig na tion un derthe Ag re e ment shall be ac com pa nied by a dec la ra -tion, sig ned by the Of fi ce of ori gin, cer ti fy ing thatthe said ap pli ca tion has re sul ted in a re gis tra tionand in di ca ting the date and num ber of that re gis -tra tion, un less such a dec la ra tion has al re a dy been re ce i ved by the In ter na tio nal Bu re au.

(4) [Fees] The sub se qu ent de sig na tion shall be sub -ject to the pa y ment of the fees spe ci fied or re fer red to initem 5 of the Sche du le of Fees.

(5) [Ir re gu la ri ties](a) If the sub se qu ent de sig na tion does not com ply with

the ap pli cab le re qu i re ments, and sub ject to pa ra -graph (9), the In ter na tio nal Bu re au shall no ti fythat fact to the hol der and, if the sub se qu ent de sig -na tion was pre sen ted by an Of fi ce, that Of fi ce.

(b) If the ir re gu la ri ty is not re me died wit hin threemonths from the date of the no ti fi ca tion of the ir re -gu la ri ty by the In ter na tio nal Bu re au, the sub se qu -ent de sig na tion shall be con si de red aban do ned,and the In ter na tio nal Bu re au shall no ti fy ac cor din -gly and at the same time the hol der and, if the sub -se qu ent de sig na tion was pre sen ted by an Of fi ce,that Of fi ce, and re fund any fees paid, af ter de duc -tion of an amo unt cor res pon ding to one-half of theba sic fee re fer red to in item 5.1 of the Sche du le ofFees, to the par ty ha ving paid tho se fees.

(c) Not wit hstan ding sub pa rag raphs (a) and (b), whe rethe re qu i re ments of pa ra graph (1)(b) or (c) are notcom plied with in res pect of one or more of the de sig -na ted Con trac ting Par ties, the sub se qu ent de sig -na tion shall be de e med not to con ta in the de sig na -tion of tho se Con trac ting Par ties, and anycom ple men ta ry or in di vi du al fees al re a dy paid inres pect of tho se Con trac ting Par ties shall be re im -bur sed. Whe re the re qu i re ments of pa ra graph (1)(b) or (c) are com plied with in res pect of none of the de -sig na ted Con trac ting Par ties, sub pa rag raph (b)shall ap ply.

(6) [Date of Sub se qu ent De sig na tion](a) A sub se qu ent de sig na tion pre sen ted by the hol der

di rect to the In ter na tio nal Bu re au shall, sub ject tosub pa rag raph (c)(i), bear the date of its re ce ipt bythe In ter na tio nal Bu re au.

(b) A sub se qu ent de sig na tion pre sen ted to the In ter -na tio nal Bu re au by an Of fi ce shall, sub ject to sub -pa rag raph (c)(i), bear the date on which it was re ce i -ved by that Of fi ce, pro vi ded that the saidde sig na tion has been re ce i ved by the In ter na tio nalBu re au wit hin a pe riod of two months from that

(7) [Re cor ding and No ti fi ca tion] Whe re the In ter na -tio nal Bu re au finds that the sub se qu ent de sig na tioncon forms to the ap pli cab le re qu i re ments, it shall re -cord it in the In ter na tio nal Re gis ter and shall no ti fy ac -cor din gly the Of fi ce of the Con trac ting Par ty that hasbeen de sig na ted in the sub se qu ent de sig na tion and atthe same time in form the hol der and, if the sub se qu entde sig na tion was pre sen ted by an Of fi ce, that Of fi ce.

(8) [Re fu sal] Ru les 16 to 18 shall ap ply mu ta tis mu -tan dis.

(9) [Sub se qu ent De sig na tion Not Con si de red asSuch] If the re qu i re ments of pa ra graph (2)(a) are notcom plied with, the sub se qu ent de sig na tion shall not be con si de red as such and the In ter na tio nal Bu re au shallin form the sen der ac cor din gly.

Rule 25

Re qu est for Re cor ding of a Chan ge;Re qu est for Re cor ding of a Can cel la tion

(1) [Pre sen ta tion of the Re qu est](a) A re qu est for re cor ding shall be pre sen ted to the In ter -

na tio nal Bu re au on the re le vant of fi cial form, in onecopy, whe re the re qu est re la tes to any of the fol lo wing:(i) a chan ge in the ow ner ship of the in ter na tio nal

re gis tra tion in res pect of all or some of the go -ods and ser vi ces and all or some of the de sig na -ted Con trac ting Par ties;

(ii) a li mi ta tion of the list of go ods and ser vi ces inres pect of all or some of the de sig na ted Con trac -ting Par ties;

(iii) a re nun cia tion in res pect of some of the de sig -na ted Con trac ting Par ties for all the go ods andser vi ces;

(iv) a chan ge in the name or ad dress of the hol der;

(v) can cel la tion of the in ter na tio nal re gis tra tion inres pect of all the de sig na ted Con trac ting Par -ties for all or some of the go ods and ser vi ces.

(b) Sub ject to sub pa rag raph (c), the re qu est shall bepre sen ted by the hol der or by the Of fi ce of the Con -trac ting Par ty of the hol der; ho we ver, the re qu estfor the re cor ding of a chan ge in ow ner ship may bepre sen ted thro ugh the Of fi ce of the Con trac tingPar ty, or of one of the Con trac ting Par ties, in di ca -ted in the said re qu est in ac cor dan ce with pa ra -graph (2)(a)(iv).

(c) The re qu est for the re cor ding of a re nun cia tion ora can cel la tion may not be pre sen ted di rec tly by thehol der whe re the re nun cia tion or can cel la tion af -fects any Con trac ting Par ty who se de sig na tion isgo ver ned by the Ag re e ment.

(d) Whe re the re qu est is pre sen ted by the hol der, itshall be sig ned by the hol der. Whe re it is pre sen tedby an Of fi ce, it shall be sig ned by that Of fi ce and,whe re the Of fi ce so re qu i res, also by the hol der.Whe re it is pre sen ted by an Of fi ce and that Of fi ce,wit ho ut re qu i ring that the hol der also sign it, al -lows that the hol der also sign it, the hol der may doso.

(2) [Con tents of the Re qu est]

(a) The re qu est for the re cor ding of a chan ge or the re -qu est for the re cor ding of a can cel la tion shall, inad di tion to the re qu es ted chan ge or can cel la tion,con ta in or in di ca te

(i) the num ber of the in ter na tio nal re gis tra tioncon cer ned,

(ii) the name of the hol der, un less the chan ge re la -tes to the name or ad dress of the re pre sen ta ti ve,

(iii) in the case of a chan ge in the ow ner ship of thein ter na tio nal re gis tra tion, the name and ad -dress, gi ven in ac cor dan ce with the Ad mi nis tra -ti ve In struc tions, of the na tu ral per son or le galen ti ty men tio ned in the re qu est as the new hol -der of the in ter na tio nal re gis tra tion (he re i naf ter re fer red to as “the trans fe ree”),

(iv) in the case of a chan ge in the ow ner ship of thein ter na tio nal re gis tra tion, the Con trac ting Par -ty or Par ties in res pect of which the trans fe reeful fi lls the con di tions, un der Ar tic les 1(2) and 2of the Ag re e ment or un der Ar tic le 2 of the Pro to -col, to be the hol der of an in ter na tio nal re gis tra -tion,

(v) in the case of a chan ge in the ow ner ship of thein ter na tio nal re gis tra tion, whe re the ad dress ofthe trans fe ree gi ven in ac cor dan ce with item (iii) is not in the ter ri to ry of the Con trac ting Par ty,or of one of the Con trac ting Par ties, gi ven in ac -cor dan ce with item (iv), and un less the trans fe -ree has in di ca ted that he is a na tio nal of a Con -trac ting Sta te or of a Sta te mem ber ofa Con trac ting Or ga ni za tion, the ad dress of the

(vi) in the case of a chan ge in the ow ner ship of thein ter na tio nal re gis tra tion that does not re la te to all the go ods and ser vi ces and to all the de sig na -ted Con trac ting Par ties, the go ods and ser vi cesand the de sig na ted Con trac ting Par ties towhich the chan ge in ow ner ship re la tes, and

(vii) the amo unt of the fees be ing paid and the met -hod of pa y ment, or in struc tions to de bit the re -qu i red amo unt of fees to an ac co unt ope nedwith the In ter na tio nal Bu re au, and the iden ti fi -ca tion of the par ty ef fec ting the pa y ment or gi -ving the in struc tions.

(b) The re qu est for the re cor ding of a chan ge in the ow -ner ship of the in ter na tio nal re gis tra tion may alsocon ta in,

(i) whe re the trans fe ree is a na tu ral per son, an in -di ca tion of the Sta te of which the trans fe ree is ana tio nal;

(ii) whe re the trans fe ree is a le gal en ti ty, in di ca -tions con cer ning the le gal na tu re of that le galen ti ty and the Sta te, and, whe re ap pli cab le, theter ri to rial unit wit hin that Sta te, un der the lawof which the said le gal en ti ty has been or ga ni -zed.

(c) The re qu est for re cor ding of a chan ge or a can cel la -tion may also con ta in a re qu est that it be re cor dedbe fo re, or af ter, the re cor ding of anot her chan ge orcan cel la tion or a sub se qu ent de sig na tion in res -pect of the in ter na tio nal re gis tra tion con cer ned oraf ter the re ne wal of the in ter na tio nal re gis tra tion.

(3) [Re qu est Not Ad mis sib le] A chan ge in the ow ner -ship of an in ter na tio nal re gis tra tion may not be re cor -ded in res pect of a gi ven de sig na ted Con trac ting Par tyif that Con trac ting Par ty

(i) is bo und by the Ag re e ment but not by the Pro to -col, and the Con trac ting Par ty in di ca ted un derpa ra graph (2)(a)(iv) is not bo und by the Ag re e -ment, or none of the Con trac ting Par ties in di ca -ted un der that pa ra graph is bo und by the Ag re e -ment;

(ii) is bo und by the Pro to col but not by the Ag re e -ment, and the Con trac ting Par ty in di ca ted un -der pa ra graph (2)(a)(iv) is not bo und by the Pro -to col, or none of the Con trac ting Par tiesin di ca ted un der that pa ra graph is bo und by thePro to col.

(4) [Se ve ral Trans fe re es] Whe re the re qu est for there cor ding of a chan ge in the ow ner ship of the in ter na -tio nal re gis tra tion men tions se ve ral trans fe re es, thatchan ge may not be re cor ded in res pect of a gi ven de sig -na ted Con trac ting Par ty if any of the trans fe re es doesnot ful fill the con di tions to be hol der of the in ter na tio -nal re gis tra tion in res pect of that Con trac ting Par ty.

Rule 26

Ir re gu la ri ties in Re qu ests for Re cor dingof a Chan ge and for Re cor ding of a Can cel la tion

(1) [Ir re gu lar Re qu est] If the re qu est for the re cor ding of a chan ge, or the re qu est for the re cor ding of a can cel -la tion, re fer red to in Rule 25(1)(a) does not com ply withthe ap pli cab le re qu i re ments, and sub ject to pa ra -graph (3), the In ter na tio nal Bu re au shall no ti fy thatfact to the hol der and, if the re qu est was made by an Of -fi ce, to that Of fi ce.

(2) [Time Al lo wed to Re me dy Ir re gu la ri ty] The ir re gu -la ri ty may be re me died wit hin three months from thedate of the no ti fi ca tion of the ir re gu la ri ty by the In ter -na tio nal Bu re au. If the ir re gu la ri ty is not re me died wit -hin three months from the date of the no ti fi ca tion of the ir re gu la ri ty by the In ter na tio nal Bu re au, the re qu estshall be con si de red aban do ned, and the In ter na tio nalBu re au shall no ti fy ac cor din gly and at the same timethe hol der and, if the re qu est for the re cor ding of achan ge or the re qu est for the re cor ding of a can cel la -tion was pre sen ted by an Of fi ce, that Of fi ce, and re fund any fees paid, af ter de duc tion of an amo unt cor res pon -ding to one-half of the re le vant fees re fer red to in item 7of the Sche du le of Fees, to the par ty ha ving paid tho sefees.

(3) [Re qu ests Not Con si de red as Such] If the re qu i re -ments of Rule 25(1)(b) or (c) are not com plied with, there qu est shall not be con si de red as such and the In ter -na tio nal Bu re au shall in form the sen der ac cor din gly.

Rule 27

Re cor ding and No ti fi ca tionof a Chan ge or of a Can cel la tion;

(1) [Re cor ding and No ti fi ca tion of a Chan ge or ofa Can cel la tion](a) The In ter na tio nal Bu re au shall, pro vi ded that the

re qu est re fer red to in Rule 25(1)(a) is in or der,prom ptly re cord the chan ge or the can cel la tion inthe In ter na tio nal Re gis ter, shall no ti fy ac cor din glythe Of fi ces of the de sig na ted Con trac ting Par ties inwhich the chan ge has ef fect or, in the case of a can -cel la tion, the Of fi ces of all the de sig na ted Con trac t -ing Par ties, and shall in form at the same time thehol der and, if the re qu est was pre sen ted by an Of fi -ce, that Of fi ce. Whe re the re cor ding re la tes toa chan ge in ow ner ship, the In ter na tio nal Bu re aushall also in form the for mer hol der in the case ofa to tal chan ge in ow ner ship and the hol der of thepart of the in ter na tio nal re gis tra tion which hasbeen as sig ned or ot her wi se trans fer red in the caseof a par tial chan ge in ow ner ship. Whe re the re qu est for the re cor ding of a can cel la tion was pre sen ted bythe hol der or by an Of fi ce ot her than the Of fi ce ofori gin du ring the five-year pe riod re fer red to in Ar -tic le 6(3) of the Ag re e ment and Ar tic le 6(3) of thePro to col, the In ter na tio nal Bu re au shall also in -form the Of fi ce of ori gin.

(3) [Re cor ding of Mer ger of In ter na tio nal Re gis tra -tions] Whe re the same na tu ral per son or le gal en ti tyhas been re cor ded as the hol der of two or more in ter na -tio nal re gis tra tions re sul ting from a par tial chan ge inow ner ship, the re gis tra tions shall be mer ged at the re -qu est of the said per son or en ti ty, made eit her di rect orthro ugh the Of fi ce of the Con trac ting Par ty of the hol -der. The In ter na tio nal Bu re au shall no ti fy ac cor din glythe Of fi ces of the de sig na ted Con trac ting Par ties af fec -ted by the chan ge and shall in form at the same time the hol der and, if the re qu est was pre sen ted by an Of fi ce,that Of fi ce.

(4) [Dec la ra tion That a Chan ge in Ow ner ship Has NoEf fect]

(a) The Of fi ce of a de sig na ted Con trac ting Par ty whichis no ti fied, by the In ter na tio nal Bu re au, of a chan ge in ow ner ship af fec ting that Con trac ting Par ty maydec la re that the chan ge in ow ner ship has no ef fectin the said Con trac ting Par ty. The ef fect of sucha dec la ra tion shall be that, with res pect to the saidCon trac ting Par ty, the in ter na tio nal re gis tra tioncon cer ned shall re ma in in the name of the trans fe -ror.

(b) The dec la ra tion re fer red to in sub pa rag raph (a)shall in di ca te

(i) the re a sons for which the chan ge in ow ner shiphas no ef fect,

(ii) the cor res pon ding es sen tial pro vi sions of thelaw, and

(iii) whet her such dec la ra tion may be sub ject to re -view or ap pe al.

(c) The dec la ra tion re fer red to in sub pa rag raph (a)shall be sent to the In ter na tio nal Bu re au be fo re theex pi ry of 18 months from the date on which the no -ti fi ca tion re fer red to in sub pa rag raph (a) was sentto the Of fi ce con cer ned.

(d) The In ter na tio nal Bu re au shall re cord in the In ter -na tio nal Re gis ter any dec la ra tion made in ac cor -dan ce with sub pa rag raph (c) and, as the case maybe, re cord as a se pa ra te in ter na tio nal re gis tra tionthat part of the in ter na tio nal re gis tra tion whichhas been the sub ject of the said dec la ra tion, andshall no ti fy ac cor din gly the par ty (hol der or Of fi ce)that pre sen ted the re qu est for the re cor ding ofa chan ge in ow ner ship and the new hol der.

(e) Any fi nal de ci sion re la ting to a dec la ra tion made inac cor dan ce with sub pa rag raph (c) shall be no ti fiedto the In ter na tio nal Bu re au which shall re cord it inthe In ter na tio nal Re gis ter and, as the case may be,mo di fy the In ter na tio nal Re gis ter ac cor din gly, andshall no ti fy ac cor din gly the par ty (hol der or Of fi ce)that pre sen ted the re qu est for the re cor ding ofa chan ge in ow ner ship and the new hol der.

(5) [Dec la ra tion That a Li mi ta tion Has No Ef fect](a) The Of fi ce of a de sig na ted Con trac ting Par ty which

is no ti fied by the In ter na tio nal Bu re au of a li mi ta -tion of the list of go ods and ser vi ces af fec ting thatCon trac ting Par ty may dec la re that the li mi ta tionhas no ef fect in the said Con trac ting Par ty. The ef -fect of such a dec la ra tion shall be that, with res pect to the said Con trac ting Par ty, the li mi ta tion shallnot ap ply to the go ods and ser vi ces af fec ted by thedec la ra tion.

(b) The dec la ra tion re fer red to in sub pa rag raph (a)shall in di ca te(i) the re a sons for which the li mi ta tion has no ef -

fect,(ii) whe re the dec la ra tion does not af fect all the go -

ods and ser vi ces to which the li mi ta tion re la tes,tho se which are af fec ted by the dec la ra tion ortho se which are not af fec ted by the dec la ra tion,

(iii) the cor res pon ding es sen tial pro vi sions of thelaw, and

(iv) whet her such dec la ra tion may be sub ject to re -view or ap pe al.

(c) The dec la ra tion re fer red to in sub pa rag raph (a)shall be sent to the In ter na tio nal Bu re au be fo re theex pi ry of 18 months from the date on which the no -ti fi ca tion re fer red to in sub pa rag raph (a) was sentto the Of fi ce con cer ned.

(d) The In ter na tio nal Bu re au shall re cord in the In ter -na tio nal Re gis ter any dec la ra tion made in ac cor -dan ce with sub pa rag raph (c) and shall no ti fy ac cor -din gly the par ty (hol der or Of fi ce) that pre sen tedthe re qu est to re cord the li mi ta tion.

(e) Any fi nal de ci sion re la ting to a dec la ra tion made inac cor dan ce with sub pa rag raph (c) shall be no ti fiedto the In ter na tio nal Bu re au which shall re cord it inthe In ter na tio nal Re gis ter and no ti fy ac cor din glythe par ty (hol der or Of fi ce) that pre sen ted the re qu -est to re cord the li mi ta tion.

Rule 28

Cor rec tions in the In ter na tio nal Re gis ter

(1) [Cor rec tion] Whe re the In ter na tio nal Bu re au, ac -ting ex of fi cio or at the re qu est of the hol der or of an Of -fi ce, con si ders that the re is an er ror con cer ning an in -ter na tio nal re gis tra tion in the In ter na tio nal Re gis ter, it shall mo di fy the Re gis ter ac cor din gly.

(2) [No ti fi ca tion] The In ter na tio nal Bu re au shall no -ti fy ac cor din gly the hol der and, at the same time, theOf fi ces of the de sig na ted Con trac ting Par ties in whichthe cor rec tion has ef fect.

(3) [Re fu sal Fol lo wing a Cor rec tion] Any Of fi ce re fer -red to in pa ra graph (2) shall have the right to dec la re ina no ti fi ca tion of pro vi sio nal re fu sal ad dres sed to the In -ter na tio nal Bu re au that it con si ders that pro tec tioncan not, or can no lon ger, be gran ted to the in ter na tio -nal re gis tra tion as cor rec ted. Ar tic le 5 of the Ag re e ment or Ar tic le 5 of the Pro to col and Ru les 16 to 18 shall ap -ply mu ta tis mu tan dis, it be ing un der sto od that the pe -riod al lo wed for sen ding the said no ti fi ca tion shall be

(1) [Fees](a) The in ter na tio nal re gis tra tion shall be re ne wed

upon pa y ment, at the la test on the date on which the re ne wal of the in ter na tio nal re gis tra tion is due, of(i) the ba sic fee,(ii) whe re ap pli cab le, the sup ple men ta ry fee, and,(iii) the com ple men ta ry fee or in di vi du al fee, as the

case may be, for each de sig na ted Con trac tingPar ty for which no re fu sal or in va li da tion is re -cor ded in the In ter na tio nal Re gis ter in res pectof all the go ods and ser vi ces con cer ned,

as spe ci fied or re fer red to in item 6 of the Sche du leof Fees. Ho we ver, such pa y ment may be made wit -hin six months from the date on which the re ne walof the in ter na tio nal re gis tra tion is due, pro vi dedthat the sur char ge spe ci fied in item 6.5 of the Sche -du le of Fees is paid at the same time.

(b) If any pa y ment made for the pur po ses of re ne wal isre ce i ved by the In ter na tio nal Bu re au ear lier thanthree months be fo re the date on which the re ne walof the in ter na tio nal re gis tra tion is due, it shall becon si de red as ha ving been re ce i ved three monthsbe fo re the date on which re ne wal is due.

(b) Whe re the hol der wis hes to re new the in ter na tio nalre gis tra tion in res pect of a de sig na ted Con trac ting

Par ty not wit hstan ding the fact that a re fu sal is re -cor ded in the In ter na tio nal Re gis ter for thatCon trac ting Par ty in res pect of all the go ods andser vi ces con cer ned, pa y ment of the re qu i red fees,in clu ding the com ple men ta ry fee or in di vi du al fee,as the case may be, for that Con trac ting Par ty, shall be ac com pa nied by a sta te ment that the re ne wal ofthe in ter na tio nal re gis tra tion is to be re cor ded inthe In ter na tio nal Re gis ter in res pect of that Con -trac ting Par ty.

(c) The in ter na tio nal re gis tra tion may not be re ne wedin res pect of any de sig na ted Con trac ting Par ty inres pect of which an in va li da tion has been re cor dedfor all go ods and ser vi ces un der Rule 19(2) or in res -pect of which a re nun cia tion has been re cor ded un -der Rule 27(1)(a). The in ter na tio nal re gis tra tionmay not be re ne wed in res pect of any de sig na tedCon trac ting Par ty for tho se go ods and ser vi ces inres pect of which an in va li da tion of the ef fects of thein ter na tio nal re gis tra tion in that Con trac ting Par ty has been re cor ded un der Rule 19(2) or in res pect ofwhich a li mi ta tion has been re cor ded un derRule 27(1)(a).

(d) The fact that the in ter na tio nal re gis tra tion is not re -ne wed in res pect of all of the de sig na ted Con trac tingPar ties shall not be con si de red to con sti tu te a chan -ge for the pur po ses of Ar tic le 7(2) of the Ag re e ment or Ar tic le 7(2) of the Pro to col.

(3) [In suf fi cient Fees]

(a) If the amo unt of the fees re ce i ved is less than theamo unt of the fees re qu i red for re ne wal, the In ter -na tio nal Bu re au shall prom ptly no ti fy at the sametime both the hol der and the re pre sen ta ti ve, if any,ac cor din gly. The no ti fi ca tion shall spe ci fy the mis -sing amo unt.

(b) If the amo unt of the fees re ce i ved is, on the ex pi ry ofthe pe riod of six months re fer red to in pa ra -graph (1)(a), less than the amo unt re qu i red un derpa ra graph (1), the In ter na tio nal Bu re au shall not,sub ject to sub pa rag raph (c), re cord the re ne wal,and shall re im bur se the amo unt re ce i ved to thepar ty ha ving paid it and no ti fy ac cor din gly the hol -der and the re pre sen ta ti ve, if any.

(c) If the no ti fi ca tion re fer red to in sub pa rag raph (a)was sent du ring the three months pre ce ding the ex -pi ry of the pe riod of six months re fer red to in pa ra -graph (1)(a) and if the amo unt of the fees re ce i vedis, on the ex pi ry of that pe riod, less than the amo -unt re qu i red un der pa ra graph (1) but is at le ast70 % of that amo unt, the In ter na tio nal Bu re aushall pro ce ed as pro vi ded in Rule 31(1) and (3). Ifthe amo unt re qu i red is not ful ly paid wit hin threemonths from the said no ti fi ca tion, the In ter na tio -nal Bu re au shall can cel the re ne wal, no ti fy ac cor -din gly the hol der, the re pre sen ta ti ve, if any, andthe Of fi ces which had been no ti fied of the re ne wal,and re im bur se the amo unt re ce i ved to the par ty ha -ving paid it.

(2) [Pa y ments]

(a) The fees in di ca ted in the Sche du le of Fees may bepaid to the In ter na tio nal Bu re au by the ap pli cantor the hol der, or, whe re the Of fi ce of the Con trac -ting Par ty of the hol der ac cepts to col lect and for -ward such fees, and the ap pli cant or the hol der sowis hes, by that Of fi ce.

(b) Any Con trac ting Par ty who se Of fi ce ac cepts to col -

lect and for ward fees shall no ti fy that fact to the Di -rec tor Ge ne ral.

(3) [In di vi du al Fee Pa y ab le in Two Parts](a) A Con trac ting Par ty that ma kes or has made a dec -

la ra tion un der Ar tic le 8(7) of the Pro to col may no ti -fy the Di rec tor Ge ne ral that the in di vi du al fee to bepaid in res pect of a de sig na tion of that Con trac tingPar ty com pri ses two parts, the first part to be paidat the time of fi ling the in ter na tio nal ap pli ca tion orthe sub se qu ent de sig na tion of that Con trac tingPar ty and the se cond part to be paid at a la ter datewhich is de ter mi ned in ac cor dan ce with the law ofthat Con trac ting Par ty.

(b) Whe re sub pa rag raph (a) ap plies, the re fe ren ces initems 2, 3 and 5 of the Sche du le of Fees to an in di vi -du al fee shall be con stru ed as re fe ren ces to the first part of the in di vi du al fee.

(c) Whe re sub pa rag raph (a) ap plies, the Of fi ce of thede sig na ted Con trac ting Par ty con cer ned shall no ti -fy the In ter na tio nal Bu re au when the pa y ment ofthe se cond part of the in di vi du al fee be co mes due.The no ti fi ca tion shall in di ca te(i) the num ber of the in ter na tio nal re gis tra tion

con cer ned, (ii) the name of the hol der,

(iii) the date by which the se cond part of the in di vi -du al fee must be paid,

(d) The In ter na tio nal Bu re au shall trans mit the no ti fi ca -tion to the hol der. Whe re the se cond part of the in di -vi du al fee is paid wit hin the ap pli cab le pe riod, the In -ter na tio nal Bu re au shall re cord the pa y ment in theIn ter na tio nal Re gis ter and no ti fy the Of fi ce of theCon trac ting Par ty con cer ned ac cor din gly. Whe re these cond part of the in di vi du al fee is not paid wit hin the ap pli cab le pe riod, the In ter na tio nal Bu re au shall no -ti fy the Of fi ce of the Con trac ting Par ty con cer ned,can cel the in ter na tio nal re gis tra tion in the In ter na -tio nal Re gis ter with res pect to the Con trac ting Par tycon cer ned and no ti fy the hol der ac cor din gly.

(a) Whe re the amo unt of the fees pa y ab le in res pect ofthe fi ling of an in ter na tio nal ap pli ca tion is chan gedbet we en, on the one hand, the date on which the re -qu est to pre sent the in ter na tio nal ap pli ca tion tothe In ter na tio nal Bu re au is re ce i ved, or is de e medto have been re ce i ved un der Rule 11(1)(a) or (c), bythe Of fi ce of ori gin and, on the ot her hand, the dateof the re ce ipt of the in ter na tio nal ap pli ca tion by theIn ter na tio nal Bu re au, the fee that was va lid on thefirst date shall be ap pli cab le.

(b) Whe re a de sig na tion un der Rule 24 is pre sen ted bythe Of fi ce of the Con trac ting Par ty of the hol der andthe amo unt of the fees pa y ab le in res pect of that de -sig na tion is chan ged bet we en, on the one hand, thedate of re ce ipt, by the Of fi ce, of the re qu est by thehol der to pre sent the said de sig na tion and, on theot her hand, the date on which the de sig na tion is re -ce i ved by the In ter na tio nal Bu re au, the fee that was va lid on the first date shall be ap pli cab le.

(c) Whe re pa ra graph (3)(a) ap plies, the amo unt of these cond part of the in di vi du al fee which is va lid onthe la ter date re fer red to in that pa ra graph shall beap pli cab le.

(d) Whe re the amo unt of the fees pa y ab le in res pect ofthe re ne wal of an in ter na tio nal re gis tra tion is chan -ged bet we en the date of pa y ment and the due dateof the re ne wal, the fee that was va lid on the date ofpa y ment, or on the date con si de red to be the date ofpa y ment un der Rule 30(1)(b), shall be ap pli cab le.Whe re the pa y ment is made af ter the due date, thefee that was va lid on the due date shall be ap pli cab -le.

(a) Whe re a Con trac ting Par ty ma kes a dec la ra tion un -der Ar tic le 8(7)(a) of the Pro to col that it wants to re -ce i ve an in di vi du al fee, the amo unt of the in di vi du al fee in di ca ted to the In ter na tio nal Bu re au shall beex pres sed in the cur ren cy used by its Of fi ce.

(b) Whe re the fee is in di ca ted in the dec la ra tion re fer -red to in sub pa rag raph (a) in a cur ren cy ot her thanSwiss cur ren cy, the Di rec tor Ge ne ral shall, af tercon sul ta tion with the Of fi ce of the Con trac ting Par -ty con cer ned, es tab lish the amo unt of the in di vi du -al fee in Swiss cur ren cy on the ba sis of the of fi cialex chan ge rate of the Uni ted Na tions.
