Publics affected:public or private persons organising or selling a transport service (particularly transportfirms, moving firms, taxis, hire firms for chauffeur cars or powered two- or three-wheeled vehicles, regional

authorities providing transport services directly or groups thereof, messenger services, travel agencies);

beneficiaries of such services.

Purpose: informing the beneficiary of the transport service of the quantity of carbon dioxide emitted by the

means of transport used.

Date of effect: information must be provided from a date to be defined in an order by the Minister of

ransport, depending on the means of transport and the si!e of the company, between " st #uly and $"

%ecember &'"$.

Notice: the decree applies for transport services for passengers, goods or moving purposes, carried outusing one or several means of transport, departing from or travelling to a location in rance, with the

exception of transport services organised by public or private persons on their own behalf.

he decree defines the principles of a common calculation method for all means of transport (rail or guided,

road, inland, maritime, air). he decree specifies the procedure for informing the beneficiary. rders by the

Minister of transport shall provide details of specific elements for the method and particularly define the

reference values to be used in calculations.

Chapter I: Scope

Article 1

5ccording to this decree, the term4

"6 7Service provider74 refers to any person sub8ect to the obligation mentioned in article 2*

26 79eneficiary74 refers to the person purchasing the tic:et for the transport of passengers, or,should no tic:et e)ist, the passenger* refers to the co.contractor of the service provider for the

transport of goods*

&6 7Means of transport74 refers to any po1ered device used to transport passengers or goods using

rail or guided, road, inland, maritime or air means of transport*

-6 7Segment74 refers to any part of the route ta:en or to be ta:en by a transport service over 1hich

the person or goods is!are carried by the same means of transport*

/6 7Source of energy74 refers to any fuel, electricity or any other type of energy used to run a means

of transport

Article 2

5ny private or public person organising or selling a transport service for passengers, goods or

moving purposes carried out using one or several means of transport, departing from or travelling to

;rance, shall be sub8ect to the provisions of article + "-&".& of the transport code, 1ith the

e)ception of services organised on behalf of the private or public person

Secondary operations for transport services such as handling operations for goods or short.term

assistance for the means of transport, using devices other than the means of transport, the

construction and maintenance of means of transport, and the construction and maintenance ofinfrastructures

Article 12

The service provider shall provide the beneficiary 1ith sincere, clear and unambiguous information,

by any means considered appropriate

Cith goods transport services, the service provider shall provide the information on the date agreed

bet1een parties, or, failing this, 1ithin t1o months of the completion of the e)ecution of the

service

Cith passenger transport services, the service provider shall provide the information prior to the

purchase of the tic:et, and if no tic:et is issued, at the completion of the e)ecution of the service at

the latest

Cith passenger transport 1ith no indicated point of departure or destination or sub8ect to a

subscription or 1ith no tic:et issued, the information can ta:e the form of a (uantity of carbon

dio)ide for the 8ourney or distance covered and must be notified on the basis of a display on.board

the means of transport or in stations 1here passengers board the means of transport

Article 13

The service provider may provide the beneficiary 1ith information e)plaining the calculation

method and sources of energy used by any means considered appropriate

The Minister of Transport shall establish a report on the implementation of this decree before "

anuary 20">, particularly on the application of part 26 of ? of article This report shall be made

public
