RESOLUTION
WHEREAS:Pipeline5,whichbeganoperationin1953andisnowownedbyEnbridge,hastransportedAlbertacrudeoilandnaturalgasliquidsfromSuperior,Wisconsinthrough18Michigancounties,includingMackinacCounty,torefineriesprimarilyinSarnia,Ontario–adistanceof645milescrossingnumerouswetlands,20rivers,theStraitsofMackinacandtheSt.ClairRiveratMarysville,Michigan;andWHEREAS:theStateofMichiganandEnbridgearepartiestoanEasementAgreementrequiringEnbridgetooperatethepipelineinareasonableandprudentmannerandtoguaranteepaymentofalldamagesandcostsfromitsoperationofsaidline;andWHEREAS:thehistoryofpipelineleaksshowsthatthereissignificantriskofseveredamageandeconomiclosstogovernmententities,individuals,business,andtheenvironment,particularlyintheStraitsofMackinacandtheEasternUpperPeninsulaofMichigan;andWHEREAS:ClarkTownshipcomprisestwowaterfrontcommunitieslocatedwithintheLesCheneauxIslandsarchipelagocontiguoustotheStraitsofMackinacwhoseeconomiclivelihoodandqualityoflifeisintrinsicallylinkedtoourGreatLakesresource.Over40%ofitslaborforceisdirectlyrelatedtorecreationalactivityderivedfromthosewatersandsensitivecoastalwetlandswhichrepresents$192milliondollarsintaxablevaluewhichisthreatenedbythesafetyofEnbridgeLine5;andWHEREAS:Michiganhousebill4540is,withoutanybasis,infactgiventhatsuchinfrastructureisbothvisibleandassessabletothepublicatlargeservingonlytocircumventdisclosureofrelevantoperationalconditionsordeficienciesrelatedtothesafetyofcriticalenergyinfrastructureandthusdenyingthepublic’srighttoknow,and;WHEREAS:theMichiganPipelineSafetyAdvisoryBoardhascommissionedforthestudyofrisksassociatedwithLine5asrecommendedbytheMichiganPipelineTaskForce,and;

WHEREAS:manyoftherelatedriskstobeanalyzedbysuchareviewshouldhavealreadybeendocumentedprovidedEnbridgeisincompliancewith(Federal)PublicLaw112-90adopted1-3-2012andknownasthePipelineSafetyRegulatoryCertaintyandJobCreationActof2011,and;WHEREAS:theresponsibilityforassuringcompliancewithPublicLaw112-90isvestedwiththeSecretaryofTransportationwhichprescribesreportingrequirementsrelatedtoemergencyplans,safemanagement,andreplacementofcastironpipelines,leakdetection,andmaximumallowableoperatingpressurethresholdsamongotheradditionalregulatorystandards,and;WHEREAS:thecatastrophiceconomicimpacttotheStraitsregionhasnotbeencomprehensivelyinvestigated.NOWTHEREFOREBEITRESOLVED:theClarkTownshipBoardofTrusteesrequeststhatGovernorSnyderutilizetheState’sauthoritybyactingimmediatelytocauseLine5toberestrictedtonaturalgasliquidsonlyuntilsuchtimeitcanbeverifiedbyanindependentpanelassafeandfurtherthattheAttorneyGeneralpetitiontheU.S.SecretaryofTransportationforevidenceanddisclosureofEnbridge’scompliancewiththosestandardspromulgatedbyPublicLaw112-90.WefurtherurgetheAttorneyGeneraltopetitiontheU.S.EnvironmentalProtectionAgencytoconductathorougheconomicimpactstudy.Motionby:WellnitzandsupportedbyRutledge.Ayes:Sherlund,Rutledge,Reid,Carpenter,WellnitzNays:NoneAbsent:NoneAbstain:NoneI,SusanJ.Rutledge,certifythatthisdocumentisatrueandcorrectcopyofaresolutionpassedbytheClarkTownshipBoardofTrusteesattheirregularmeetingheldonMarch21,2016attheClarkTownshipHall,Cedarville,Michigan.___________________________________________SusanJ.RutledgeClarkTownshipClerk
