unsuccessful men with talent. Genius will not; unrewarded genius is almost a proverb. Education will not; the world is full of educated derelicts. Persistence and determination alone are omnipotent.”

At BSD&J my cases included personal injury, wrongful death, medical mal-practice, insurance coverage and Bad Faith litigation.In January of 1986 I started my own law practice handling the same type of litigated cases.From 1986 to 2005 my law practice focused on litigating cases. I was, however, also mediating and arbitrating cases privately and as a Clark County District Court Arbitrator/Mediator. During that 19 years the firm grew from one attorney to nine lawyers. I was responsible or client development and retention. I supervised the lawyers and staff. I was also responsible for all billing, accounting and financial matters. In 1988 I built my law office at 525 S. 9th Street. I have practiced at that loca-tion for the past thirty years.In 2005 I began concentrating my practice on mediations and arbitrations. I also started spending more time with our fam-ily owned development and utility businesses operating in Pahrump, Nevada. For those businesses I have negotiated and drafted real estate agreements, leases, joint development agreements and utility annexation agreements. I have appeared before the Nye County Commission for zoning matters, use permits and the development agreements. I have also partici-pated in proceedings before the Public Utilities Commission of Nevada which have included annexation, tariff and rate case proceedings.In 2009 I participated in the legislative process to successfully pass a bill to streamline rate cases for small water and sewer utilities in Nevada.In 2012 I was involved in a serious motor vehicle accident that left me paralyzed. Fortunately, I have been able to continue serving as an Arbitrator and Mediator. I have also continued to help with the family businesses.

The other conference had to do with whether there was effec-tive waiver of NRCP 41(e).

Remember that honesty and integrity are the currency of our practice. Admit mistakes as soon as you discover them even if the mistake would not likely be discovered or alter the outcome of the case. Practice civility by staying focused on the case and not yourself or your opponent.Share a short story or anecdote from your legal career (in 200 words or less): Judge Mendoza advised me to become a trial attorney to overcome the real fear I had of speaking in public. My first weeks of appearing in Las Vegas Justice Court consisted of eating breakfast, showering, throwing-up and going to work. As I grew in self-confidence I began to take short-cuts in the courtroom. When defense counsel in a murder case asked to see the five-inch stack of crime scene and autopsy photographs I casually tossed them on his table in the courtroom and was promptly admonished by the Court not to throw things at opposing counsel. I realized the value of maintaining good relationships with all the court staff when I later read the transcript of the hearing and discovered the court reporter had omitted the entire incident from the record! One of my most memorable trials involved a legally blind eyewitness and a 911 phone call. The victim, legally blind, in bed for the evening with her glasses on the night stand, heard her house being broken into and called 911. As the assailant entered her bedroom with baseball bat in hand she gave a stunningly accurate description of the defendant to the 911 operator. I ob-tained permission to play the recording during my opening statement. The 911 operator then listened to the tape recording and authenticated its accuracy. The victim then listened to the recording and verified that it was her voice and accurately depicted what she saw. With the aid of glasses, she identified the defendant in court. I, of course, played the recording dur-ing my closing argument. After listening to the tape four times and with the in-court identification, the fact that the victim was legally blind did not deter the jury from conviction.

I have had the honor of being asked to teach other legal professionals locally, nationally, and internationally of the lessons I have learned, which I enjoy immensely.Equally important along this path, I have headed up various charitable organizations from Big Brothers and Sisters to the Nevada Law Foundation, to my present position as Chairman of Send Me On Vacation which has sent hundreds of under-served breast cancer survivors on healing empowerment vacations.

After many months of pre-trial discovery and trial briefs to the U.S. Tax Court, the IRS was willing to reduce deficiency by 80%. The day prior to the trial, while walking up and back the Washington Hilton’s walkways (about 1/4 mile each), Hank kept asking “are we right.” I continued answering affirmatively but kept advising an 80% concession should be seriously considered; could not guarantee success. Finally, Hank said, “F... them, go for it.” We won and the Internal Revenue Code was amended by adding § 483.

Blanket the HomelessJoin in our community service efforts to provide local homeless people with rescue blankets. A project of the Clark County Bar Association and the Clark County Law Foun-dation to benefit homeless people in our community. Monies donated for this cause will be used to purchase new blankets for distribution to local homeless people in the Las Vegas area.
