Introduction: Contact Information, Important Dates

Purpose This packet is intended to provide information to candidates interested in filing for City office and appearing on the May 19, 2020 Municipal Primary Election ballot. For each City office on the ballot, if no candidate receives a majority at the May Primary Election, the two candidates receiving the highest number of votes for each office appear on the November 3, 2020 General Election ballot. The candidate receiving the majority of votes cast at the General Election shall be elected. Candidates for City office elected at either the May Primary Election or the November General Election begin their term of office the following January (January 1, 2021).

Authority Use of this information packet is intended solely as a reference guide. Every effort has been made to present clear and accurate information. If you have any questions or suggestions for improvement, the Auditor's Office would appreciate your kindness in notifying us of any inaccuracies by phone, e-mail or in person.

Readers of this information packet should take note that the information contained herein should not be considered as having the same weight and authority as City Code or City Administrative Rules. Candidates are responsible for understanding and complying with the City Code and Administrative Rules, including all laws and required training applicable to participating candidates in the City’s new public campaign finance program (Open and Accountable Elections). Chapter 2: Filing for Office

A. Establish a Principal Campaign Committee

Appendix A of this packet contains the Oregon Secretary of State’s Candidate “Quick Guide,” which will help candidates determine if they need to establish a Candidate Committee.

A candidate may have only one Principal Campaign Committee at one time. Before filing a Principal Campaign Committee, any other existing committee (State, County or otherwise) must be closed.

Candidates Planning to Spend or Receive more than $750 If a candidate plans to receive or spend more than $750 during the entire campaign, he or she must form a Principal Campaign Committee and register it with the Secretary of State through the online campaign finance reporting system ORESTAR (www.sos.oregon.gov/elections) within 3 business days of spending or receiving money. The candidate must also set up a campaign account and submit the Campaign Account Information to the Secretary of State. All forms to set up committees are in Appendix B of this guide.

Candidates Planning to Spend or Receive less than $750 A candidate is not required to establish a campaign account, file a Statement of Organization or file contribution and expenditure transactions if all three of the following conditions are met:

• Candidate serves as the candidate’s own treasurer• Candidate does not have an existing candidate committee• Candidate does not expect to receive or spend more than $750 during a calendar year.

After reviewing and setting up campaign finance accounts and candidate committees as necessary, candidates can proceed to filing for office at City Hall.1

Note: a committee that files a Certificate of Limited Contributions and Expenditures is encouraged to enter its transactions in ORESTAR so that ORESTAR can assist in determining if the committee exceeds the $3,500 threshold.

1 All candidates must abide by the City’s Open and Accountable Elections program, which includes increased reporting deadlines in certain contested races and reporting some transactions to the Director through the City’s application.

B. Filing for City Office by Declaration & Fee: Option 1

Per City Code Section 2.08.060, a candidate may qualify to appear on the ballot either by filing a declaration of candidacy (A) accompanied by a filing fee or by filing a completed nominating petition (B). All candidates must file for office in person at this time.

Determinations about qualification to appear on the ballot as an official candidate will be made in writing to all filers after required forms are submitted and in the order received.

C. Filing for City Office by Nominating Petition (in lieu of filing fee)

A candidate may file for office by submitting the same candidate forms above and by completing a nominating petition. This procedure for filing is required by candidates seeking to qualify for matching public funding through the City’s Open and Accountable Elections program. There are four steps in this procedure are critical to successful filing and are outlined below:

First Step: City Forms and Requirements: AUD 120 – Filing of Candidacy (see appendix B)

Select Filing by Nominating Petition in Section III. of the form File with Elections Office

• Form SEL 121 – Nominating Petition FormFill out all portions, leave signature lines blankCandidates cannot circulate until written approval is given by Elections OfficeFile with Elections Office

Second Step: Circulation: After receiving written approval to circulate the nominating petition form, candidates gather at least 100 valid City of Portland registered voter signatures. Candidates are responsible for reviewing the circulator’s guide to gathering signatures and adhering by state and local regulations for this process.

Third Step: Submission of Documents and Petition: • Completed Petition - At least 100 signatures of registered City of Portland voters on

approved SEL 121 formFile all original signature sheets with Elections Office

• SEL 338 – Petition submission form, indicating the number of signatures collectedFile with Elections Office each time signatures are submitted for review

Fourth Step: Nominating Petition Review: Once all items in Part I and II above have been submitted, the Elections Office conducts a review of the signature forms and candidate qualifications for office. The office partners with the Multnomah County Elections division to determine validity of all petition signatures. Please note that a candidacy filing via nominating petition is not considered complete until all signatures have been submitted during the filing period and have been verified to contain the required number of valid City or Portland registered voters. All signature sheets must be submitted in time to be verified before the filing deadline of March 10, 2020.

Chapter 3: Withdrawal of Candidacy or Nomination

To withdraw from candidacy or nomination, a candidate must file a Withdrawal of Candidacy or Nomination (SEL 150), available in appendix B of this packet, with the Elections Office. On this form, the candidate provides a reason for the withdrawal and must sign the form attesting that the information is accurate (ORS 249.170 and 249.180).
