4. Community and Corporate Services, Community Services Division, Report No. 2016-53, Subject: Increase Seasonal Slip vs. Transient Slip Count at Sugarloaf Marina

Committee of the Whole recommends:

a. That the Council of The Corporation of the City of Port Col borne receives this report for information purposes with regard to an operational increase cif the seasonal slip count to 450 docks and reduction of the transient slip count to 250, which will accommodate the new seasonal boaters and provide additional revenue; and

b. That the Marina will begin marketing the increased seasonal docks availability and adjust in anticipation of achieving capacity with the option to revisit and increase the seasonal slip count as necessary to meet demand.

5. Community and Corporate Services, Corporate Services Division, Report No. 2016-43, Subjeci: Port Colborne Community Bus Rate Increase

That the Council of the City of Port Colborne approves the attached Port Colborne Transit Fare Structure effective July 1, 2016.

That Council approves the applications pursuant to Section 357 of the Municipal Act, 2001, numbered 2015-13, and 2015-18 to cancel or reduce taxes in the total amount of $1,573.33.

7. Community and Corporate Services, Corporate Services Division, Report No. 2016-54, Subject: 2016 Operating/Capital Budget

Committee of the Whole recommends:

1. That Council, in compliance with Ontario Regulation 284109, hereby confirms and approves that the 2016 Budget was developed using the cash basis and has excluded the following accrual expenses: a portion of the amortization expense which amounts to approximately $2,007,240 and the amount of post-employment benefits expense which amounts to approximately $163,000.

2. That the Council of the City of Port Colborne approves the 2016 Budget, as presented.

3. That Council adopt the by-law for the budget estimates for all sums required for the operations for the year 2016.

4. That Counci l directs the City Treasurer to amend the City's operating budget and increase the levy by a corresponding amount to any reduction regulated by the Province for the Education Tax rate to an overall blended tax increase of 1.8%, with such amount to be allocated to the debenture reserve for the new Operations Centre.

8. Community and Corporate Services, Clerk's Division, Report No. 2016-35, Subject: Application for a Kennel Licence - Romeo Dube, 3768 Babion Road

12. Delegations:

(a) Laura Hills, President and Chief Executive Officer, and Bob Romeo, Director of Marketing, Goodwill Niagara, regarding the new Goodwill Niagara Retail and D?nation Centre opening in Port Colborne

Laura Hills, President and Chief Executive Officer, and Bob Romeo, Director of Marketing, Goodwill Niagara, were in attendance and provided an overview of Goodwill Niagara. Ms. Hills advised that Goodwill Niagara wil l be opening a new retail and donation centre in Port Colborne at 45 West Side Road in May.

13. Mayor's Report:

A copy of the Deputy Mayor's report is attached.

14. Regional Councillor's Report:

Regional Councillor Barrick advised that the Region is in the process of reviewing options for revenue tools including the continuation of prudent fiscal management and strategic investment in social services and critical infrastructure.

Regional Councillor Barrick advised that at its meeting of February 25, 2016, Regional Council enacted a motion to not support the implementation of a vehicle registration tax in Niagara.

Regional Councillor Barrick referred to item 14, correspondence from the Niagara Central Airport Commission, and recommended Council support the request for the Region of Niagara to commit matching funds in support of the Niagara Central Airport Commission's application for funding under the Canada 150 Community Infrastructure Program.

Regional Councillor Barrick informed that he has been re-elected chair of the Region's budget committee for the next two budget cycles. Regional Councillor Barrick advised that the Region will continue the value for money audits and taxpayer affordability strategies.

Regional Counci llor Barrick advised that the Region is exploring options regard ing collective procurement for municipal insurance providers in Niagara.

Regional Councillor Barrick advised that nominations are open for the T. Roy Adams Humanitarian of the Year Award until March 31 , 2016.

15. Councillors' Items:

(a) Door to Door Sales (Mayne) Councillor Mayne expressed concern regarding sales methods used by door to door salespersons. Councillor Mayne recommended the City begin licensing door to door sales.

That the City Clerk be directed to prepare a report regarding licensing of door to door sales, including an examination of fines and a summary of the practices of other municipalities and their success rate.

(b) Sugarloaf Marina ·- Early Opening (Mayne) Councillor Mayne requested an update about whether Sugarloaf Marina could be opened earlier for boating season. The Manager of Community Services advised that staff are working on the docks and support staff are required for their installation. The Manager advised that he would report back regarding when Sugarloaf Marina will be ready to open. Councillor Bodner recommended the City establish an early opening procedure. The Manager advised that currently there are budget constraints associated with an early opening, however the City could build a contingency for such circumstances.

(c) Sugarloaf Marina Retail Store - Business Plan (Mayne) Councillor Mayne requested staff prepare a business plan for the retail store at the Sugarloaf Marina.

(d) Asphalt Repair on King Street (Elliott) Councillor Elliott expressed concern regarding the cold patch asphalt repair on King Street, south of St. Patrick's Church, because the asphalt cuts are creating noise from transport trucks traveling on the roadway. Councillor Elliott enquired when the street would be repaired . The Director of Engineering and Operations advised that asphalt production plants will open on April 18, 2016 and repairs will commence after that time.

(e) Road Paving (Elliott) Councillor Elliott enquired whether the Department of Engineering and Operations is still accepting input regarding the allocation of the roads budget for the 2016 road repairs. The Director of Engineering and Operations advised that input from Council is still being accepted and that, at th is time, the only confirmed project is Lakeshore Road West.

16. Consideration of Items Requiring Separate Discussion:

1. Planning and Development, Report No. 2016-40, Subject: Revised Recommendation Report for a Proposed Zoning By-law Amendment (File No. D14-13-14) 485 Northland Avenue

In response to a Councillor enquiry, the Director of Planning and Development advised that the City's Zoning By-law stipulates that each bachelor apartment must be self-contained and include cooking and washroom facilities.

Councillor Butters enquired about the timeline for current tenants to be vacated. The Director informed that, if the application is approved, the proponent would be required to vacate the current tenants in accordance with the Residential Tenancies Act. The Director advised that assistance for tenants could be obtained from local agencies. The Director advised that the proponent has been granted two months in which to vacate the tenants, failing which the City will proceed with enforcing the provisions of the City's Zoning By-law.

The Director advised that the holding provision for the future block townhouse developm(:int would be affixed until the required technical studies are completed. The Director advised that Council's approval is required to lift the holding provision, and after the completion of technical studies, staff will prepare a report for Council's consideration.

1. That Council of the City of Port Colborne approves the Zoning By­law Amendment, attached hereto as Appendix "E" for:

• Six (6) street townhouses fronting Northland Avenue. • Future block townhouse residential development in the

southern portion of the property with an affixed Holding Provision.

• 10 bachelor dwelling apartments. • 33 two-bedroom dwelling apartments. • 11 one-bedroom senior citizen house apartments with

supportive care. • 11 one-bedroom senior citizen house apartments with no

care.

2. That the City Clerk is hereby authorized and directed to proceed with the giving of notice of passing of the by-laws, in accordance with the Planning Act.

3. That pursuant to the provisions of Section 34(17) of the Planning Act, no further notice of public meeting be required.

2. Planning and Development, Report No. 2016-49, Subject: Information Report on the Prohibition of Sea/Shipping Containers/Railroad Cars/Truck Body/Trailers with Wheels (File No. 014-02-16)

In response to an enquiry from Councillor Bodner, the Director of Planning and Development informed that a public meeting will be held as part of the process to approve a Zoning By-law Amendment and that written comments can also be submitted.

Councillor Butters advised that shipping containers are also being used for the purposes of third party advertising. The Director advised that the By-law Enforcement Division will investigate under the provisions of the City's Sign By-law.

That the rules respecting delegations, as outlined under Section 1 O of the Procedural By-law, be suspended in order permit members of the public to speak retiarding shipping containers.

CARRIED.

Carol Brady, 111 Oakwood Street, was in attendance and advised that she owns a property which is over one acre in size and that her shipping container is located more than 150 feet from the roadway. Ms. Brady advised that shipping containers should be permitted on large properties. Ms. Brady informed that she would reserve further comment until the public meeting.

Deb Britten, on behalf of Dan Couture, 925 Killaly Street East, was in attendance and advised that the above property is large and a shipping container should be permitted for this reason , and because it is environmentally friendly. Ms. Britten informed that she would reserve further comment until the public meeting.

3. Community and Corporate Services, Community Services Division, Report No. 2016-44, Subject: Friends of Roselawn Centre Request for a Facility Fee Waiver

Moved by Councillor R. Bodner Seconded by Councillor B. Butters

That Council directs staff to waive the appropriate facility fees and endorse the fundraising event an Evening at Roselawn Silent Auction of local artists' work at the Roselawn Centre in support of the Friends of Roselawn Centre capital campaign.

15. Memorandum from Janice Peyton, Executive Assistant to the Director of Engineering and Operations, on behalf of the Environmental Advisory Committee Re: Motion Regarding the 2016 Traffic Operations Study

In response to an enquiry from Councillor Elliott, the Director of Engineering and Operations advised that further information is required regarding the intent of the motion from the Environmental Advisory Committee.

GRANT PRESENTATIONS

MARCH 29, 2016

Good evening ladies and gentlemen.

We are here this evening to present several

community grants to non-profit organizations who

serve the residents of Port Colborne.

You may remember that this was done by Port

Colborne Hydro Inc. for many years.

With the sale of the hydro company and

subsequent sale of our fibre company, this

responsibility was turned back to council.

Council decided to form a committee who now

oversee the semi-annual review of the applications.

There are three members of council and two

members of the public on this committee - myself,

Councillor Angie Desmarais, Mayor John Maloney,

with Gary Bruno and Brenda Haymes from the

public.

In 2016, council set aside a maximum of $40,000 to

be distributed.

The first round of applications were received by

January 31st and we are here this evening to present

5 grants totalling $12,600.

The next round of applications must be submitted

by June 30th and information is available on our

website.

Niagara Antique Power Association will use their

grant of $3,600 to furnish sanitary, modern

washroom units that can be used for all visitors

attending the Antique Power show on the Canada

Day Weekend.

Port Colborne & District Conservation Club will use

their grant of $2,000 to renovate and improve their

hatchery tank including the installation of a battery

backup system.

Port Colborne Operatic Society will use their grant

of $1,500 to pay for the live musicians program for

students. These professional musicians

accompanied the students in the orchestra pit of

this year's performances of Mary Poppins.

Women's Place of South Niagara will use their

grant of $2,000 to provide safe emergency shelter

and food for women and their children escaping

domestic violence.

I would like to invite Stephanie Thomson to come

YMCA of Niagara will use their grant of $4,000 to

operate the YMCA Youth Action program. This

program is currently at Dewitt Carter School on

Wednesday nights. If you know of a youth between

the ages of 9 - 14, suggest they stop by Dewitt

Carter School to see what it's all about.

Deputy Mayor's Report to the

March 29, 2016 Council Meeting

Mayor Maloney I am pleased to report that the Mayor is progressing well with his rehabilitation and we hope to have him back here soon .

Opening of the Welland Canal Last week saw the opening of the Welland Canal.

We welcomed Captain Josh Penney and Chief Engineer Gerald Flynn of the tug and barge, Victorious and John J. Carrick into Lock 8 for our annual top hat ceremony.

Their vessel is owned by McAsphalt Marine Transportation Ltd. and was heading to Hamilton.

I would like to thank our Fair Trade Committee members - Jane Nigh, Nancy Salvage, Rosemary Armstrong and Lisa Bowers for putting on an excellent Fair Trade pancake breakfast.

A special thanks to the other local businesses - Bremfields, Smokin' Buddha, Bodners, Agape Valley, ADM Milling and Ten Thousand Villages for their support with the breakfast.

Over 100 people attend on that chilly morning.

If you missed the breakfast this year, they plan to be back next year.

Thanks also to St. James St. Brendan Anglican Church for a fun filled Mariner's Service the night before.

Our thoughts and prayers are with all the sailors and their families as they head into the 2016 season.

Water Budget On Monday, March 2ist we held a special meeting of council concerning the water/wastewater budget. There will be an average annual increase of $35 per household or $8. 75 per quarter or 2.58% increase.

The report, which can be found on our website, was passed by council with some funds coming from reserves to cover major work currently being completed around the city, namely completing the Lakeshore Road watermain, replacement of frozen services and water meter replacements, new west side bulk water station, start of Elm St watermain and storm sewer outlet

I do want to point out that there was a second report dealing with a fixed charge for storm sewer drainage fees for future new and replacement of storm sewers in the urban area.

This report calls for a couple of public meetings over the next six months to receive your input, so please go to our website, read the report and make sure you come out to the public meetings.

Council received this report for information purposes only.

These proposed charges, if passed by council, would not be implemented until 2017.

Door to Door Salesmen

Residents have recently contacted the City about door-to-door water filtration marketers who have been visiting homes in Port Colborne and asking to check people's water shut offs and water meters, and trying to sell them filters.

Some residents indicate that the marketers are implying that Health Canada requires these filters and are also implying that the City's drinking water is somehow compromised, and that a filtration system is required to further treat the water.

The City would like to reassure residents that the water delivered to their homes meets or exceeds strict provincial guidelines and is safe to drink.

Residents concerned about the safety of their water are asked to contact the Public Works Department at 905-835-5079.

There are no City staff going door-to-door presently; however Neptune Technology Group is currently replacing water meters throughout the City.

Neptune staff are wearing Neptune uniforms and carry Neptune ID, and will have a Neptune placard on their vehicle.

Neither the City nor it's contractor is selling or installing filters, nor is it mandated by Health Canada that residents install these filters.

There was also a further complaint to the city about door-to­door salespersons wanting to inspect furnaces and hot water tanks and telling residents that they are obsolete and need to be replaced.

Should any residents feel uncomfortable with a door-to-door marketer's sales approach, they should contact the Ministry of Government and Consumer Services.

The City cannot contact the Ministry to complain on a resident's behalf; the resident that was approached by the company must make the complaint before the Ministry will investigate.

It's important to remember that you do not have to allow a

salesperson to enter your home, nor should you unless you are

confident in the credentials and intentions of the person at

your door.

Should you have any apprehension, suspicions or uneasy

feelings about the salesperson's credibility or motive, it's best

that you do not let them in your house and ask them to leave

the property.

In the event, that the salesperson refuses to leave the property

upon request, or attempts to force their way into your home,

you should call the police.

Southern Tier Mayors' Luncheon The area Chambers of Commerce hosted the Southern Tier Mayors' Luncheon at the Italian Hall last week.

It was wel l attended and provided each of us with an opportunity to let business leaders know what is happening in our communities and in South Niagara as a whole.

Port Cares Fundraiser

I would like to thank the members of the Port Col borne Fire Department and employees of Sobey's for the great food drive and BBQ that was held over the East er weekend to support the Port Cares Reach Out Centre.

On Thursday and Saturday they raised $4,400 and filled two trucks full of food donations.

Thank you to everyone in Port Colborne who supported this great cause.

Federal Budget

The Federal budget was announced last week and council will

be working with our Directors to ensure that the City of Port

Colborne applies for any new funding programs that have

become available.

It will take a bit of time for the details of these programs to be

announced, however, we plan to be ready to apply and with

the assistance of our MP, Mr. Badawey, benefit from these

funds.

Regional Council

I attended my first Regional Council meeting on March 24th and

my first regional committee meetings earlier today.
