CALL TO ORDER: (00:00) Mayor Briney called the meeting to order. The Pledge of Allegiance was

recited. Roll call was taken.

APPROVAL OF PROPOSED AGENDA (00:39) –Prior to the motion to approve the Proposed

Agenda, Mayor Briney made an amendment to Agenda Item #7. The Ordinance Number should read

2020-001. Commissioner Martin motion to approve the proposed agenda. Commissioner Moll

second. Commission discussion: none Public comment none. VOTE: Unanimous Motion carried

Commissioner Moll motion to approve the Consent Agenda. Commissioner Martin second. Commission discussion: Commissioner Martin asked about the claim for $16,000.00 by the Sewer

Department for a new engine. City Planner Kyle Roberts explained it was for a replacement engine.

CITY MANAGER COMMENTS (03:33)-City Planner Kyle Roberts is filling in for Interim City

Manager Nash. Mayor Briney commended the Polson Fire Department for their efforts response to the

fire this morning. There were a total of 40 firefighters from 4 departments: Polson, Finley Point, Ronan,

and Polson Rural that worked together to extinguish the 2 homes. No one was injured. City Planner

Roberts commented that Sargeant George Simpson of the Polson Police Department had provided the

press release to the Commission and the Mayor. Positive comments were made about the workshop that

was conducted on February 18th. Mayor Briney thanked Kyle and Janet Cornish for a very well presented

workshop on the subject of Tax Increment Funding Districts. This was a joint workshop with the Polson

Redevelopment Agency. City Planner Roberts also updated the Commission on the City Manager search.

Mr. Mercer is anticipating receiving 40-60 applications. The posting closes in 9 days. There will be a

meeting in early March. Commissioner Pardini asked if the Commission would be the hiring body and

how the process would work. City Planner Roberts explained the process the best to his knowledge.

CITY OF POLSON ORDINANCE 2020-001, REPEAL AND REPLACE ORDINANCE 2015-005

WHICH HAS BEEN CODIFIED AS CHAPTER 11, ARTICLE 1 OF THE POLSON MUNICIPAL

CODE (12:43)-City Attorney Clinton J. Fischer presented this agenda item. For decades the City of

Polson and Spectrum have had a Franchise Agreement in place. The existing Agreement expired

December 31, 2019. The new Agreement will take effect April 1, 2020. Charter re-negotiated the new

Franchise Agreement. The new Ordinance has been changed to lay out the terms but does not name a

company. The Resolution names a party and confirms the terms. The recommendation is to adopt the

Ordinance and to pass the Resolution. The previous commission was 3%. The new commission will be

5%.

Commissioner Howlett motion to approve Ordinance 2020-001, repeal and replace Ordinance

2015-005 which has been codified as Chapter 11, Article 1 of the Polson Municipal Code.

CITY OF POLSON RESOLUTION 2020-TBD, FRANCHISE AGREEMENT WITH CHARTER

COMMUNICATIONS (17:47)-City Attorney Clinton J. Fischer presented this agenda item in

conjunction with the previous item. Commissioner Isbell motion to approve Resolution 2020-TBD,

Franchise Agreement with Charter Communications. Commissioner Howlett second. Commission

discussion: none Public comment: none VOTE: Unanimous Motion carried

Prior to adjournment Mayor Briney asked if Action Minutes would be agreeable. The Commission stated

yes Action Minutes are agreeable.
