Re: Transfer Request - Capital Improvement

Honorable President Ossing and Councilors:

I have enclosed a transfer request for your review and approval for $2,500,000.00 to fund various projects, upgrades, and new equipment. This package, comprised of transfers from free cash, continues our investments into our infrastructure and assets while keeping in mind the challenges we face due to the outbreak of COVID-19. I have attached the updated Capital Improvement Plan.

A large portion of this transfer from free cash will fund vehicle and equipment upgrades at the Department of Public Works, Marlborough Police, and Marlborough Fire. Below you will find a brief description regarding capital improvement item requests.

• $65,250 for the Marlborough Fire Department to replace I/5th of the department's inventory of Personal Protective Equipment (PPE). This request is based on a fixed schedule to replace 75 sets of gear over five years at 15 sets per year at $4,350 per set.

• $65,000 for Public Facilities to set up camera systems at the two-fire stations. Additional security cameras aide in the safety of employees and visitors.

• In addition to our annual mills and overlay efforts, we are investing $1,930,810 million to fund the milling and overlaying of various streets, furthering our commitment to city streets and infrastructure.

• $218,000 for the Marlborough Police Department to replace four Police Cruisers and the communications equipment within. This is part of an annual rotating investment to ensure the quality of our municipal and law enforcement vehicles.

• $220,940.00 for a new Freightliner and Lift as the "bucket truck" used to handle tree emergencies is past its useful life. This is a major piece of equipment used during weather events.

I. By amending Chapter 125, entitled "Personnel", by adding to the salary schedule referenced in Section 125-6, the following:

This ordinance shall supersede and replace any existing rate for said position (if applicable) in the current salary schedule.

Please find enclosed for your review an amendment to the City's salary ordinance and a job description pertaining to the Director of Civil Defense. The director is tasked with leading the emergency management operations of the City and performing emergency management functions as authorized, directed, or required. The Director of Civil Defense administers the City of Marlborough's Civil Defense Department and coordinates the administrative, financial, and information systems necessary for the department to function per state and local guidance.

The Director of Civil defense will be paid $15,000.00 per year except during a declared state of emergency by the governor of the Commonwealth. During a state of emergency (snowstorm, flood, pandemic, etc.,) in addition to the above annual salary rate, an hourly rate of pay of $60.00 per hour could be authorized by the Mayor, subject to the rate being at least 75% reimbursable to the City by the federal or state government programs, available appropriation; and prior approval as to hours and duties to be performed.

This position has recently proven to be of the utmost importance as the incumbent has worked with the Massachusetts and Federal Department of Emergency Management on grants and securing Personal Protective Equipment during the outbreak of COVID-19.

Please find enclosed for your review an amendment to the City's salary ordinance and a job description pertaining to the Director of Civil Defense. The director is tasked with leading the emergency management operations of the City and performing emergency management functions as authorized, directed, or required. The Director of Civil Defense administers the City of Marlborough's Civil Defense Department and coordinates the administrative, financial, and information systems necessary for the department to function per state and local guidance.

The Director of Civil defense will be paid $15,000.00 per year except during a declared state of emergency by the governor of the Commonwealth. During a state of emergency (snowstorm, flood, pandemic, etc.,) in addition to the above annual salary rate, an hourly rate of pay of $60.00 per hour could be authorized by the Mayor, subject to .the rate being at least 75% reimbursable to the City by the federal or state government programs, available appropriation; and prior approval as to hours and duties to be performed.

This position has recently proven to be of the utmost importance as the incumbent has worked with the Massachusetts and Federal Department of Emergency Management on grants and securing Personal Protective Equipment during the outbreak of COVID-19.

Position Purpose:

CITY OF MARLBOROUGH DIRECTOR OF CIVIL DEFENSE

The purpose of this position is to have charge of emergency management as defined in section 1, chapter 639, Acts of 1950, and to perform emergency management functions as authorized or directed by that chapter or by the executive orders or general regulations promulgated thereunder, and to exercise any authority delegated to it by the governor under chapter 639 and performs all other related work as required. The Director of Civil Defense administers the City of Marlborough's Civil Defense Department and coordinates the administrative, financial and information systems necessary for the department to function in accordance with state and local directives.

Supervision: Supervision Scope: The director shall have direct responsibility for t he organization, administration and operation of Emergency Management subject to the direction and control of the Mayor who is the appointing authority for this position.

Supervision Received: Works under the policy direction of the Mayor, and in accordance with the provisions of federal regulations and Massachusetts General Laws.

Supervision Given: Supervises volunteers.

Job Environment: Work is performed in typical office conditions, with frequent interruptions, to provide assistance and information to the general public on a walk-in basis and on the telephone. Scheduled hours include

evening meetings and an extended workday when emergencies or drills arise.

Operates computer and general office equipment such as copier, fax, and telephone.

Makes frequent contacts with city departments, boards and committees, federal, state and county officials and the general public, to provide information and solve problems. Contact usually involves the provision of information of a technical or factual nature to the public or interested parties.

Essential Functions: (The essential functions or duties listed below are intended only as illustrations of the various types of work that may be performed. The Director is responsible for the recruiting, appointment, training and equipping of volunteers in certain categories of service, for the coordination of civil defense efforts of other City departments and other agencies charged with emergency functions for civil defense in the event of a hostile action or natural disaster.

The Director is responsible for certain financial arrangements having to do with Marlborough Civil Defense Department for emergency duties and for the integration of a local civil defense plan and operations with the Massachusetts Civil Defense Agency Office of Emergency Preparedness.

The Director shall be responsible for coordinating the local Emergency Planning Committee certification process pursuant to the Massachusetts State Emergency Response Commission directives.

The Director is responsible for the direction and control of Increased Readiness Plans which include the increased inventory of public shelter, marking of unmarked shelters, accelerated training of emergency personnel and plans for improvement on short notice of public and private shelter locations and to put into operation the Crisis Relocation Plans and the evacuation of people to designated area.

The Di rector is responsible for obtaining signed licenses for public shelter facilities in the City of Marlborough, making arrangements for the delivery of supplies to the shelter, coordinating, supervising and directing the work of volunteers engaged in this function .

The Director shall disseminate public information brochures, pamphlets and Emergency Action Packages for use by schools, businesses and elderly and handicapped care facilities and group homes.

The Director is responsible for coordinating the Civil Defense Preparedness Plans for the Municipality with the duly authorized Chief of Police, Fire, Rescue, Engineering, Health, Medical and Welfare Departments for the preparation of plans with appropriate authorities in the files of evacuation, resources, management, decontamination and transportation.

The Director shall create and maintain a computerized data base of emergency response plans, emergency routes and shelters and update and disseminate the same.

Actively pursues grant funding for all aspects of Emergency management operations and obtaining capital assets.

Serves at the City's Liaison and works closely with both State and Federal emergency management agencies (MEMA/FEMA). Attends required meetings with emergency management agencies.

Advises the Mayor of courses of action available to prepare for, respond to and recover from major emergencies or disasters, and of mitigation strategies to lessen the impact of future occurrences.

The Director is required to attend all seminars, all courses offered in the aspect of civil defense; and, to attend all meetings and briefings that are required by Emergency Management Agencies at the State, Federal, regional and local levels.

During actual emergencies and disasters, works with the Mayor coordinating local government response and recovery operations; conducts post-disaster damage assessment activities; and, if there is a disaster declaration, coordinates FEMA Public Assistance Program's financial reimbursement process.

Performs similar or related work as directed.

Recommended Minimum Qualifications:

Education, Training and Experience: Bachelor's Degree in general or applied liberal arts and sciences, management, communications or public relations is required. The employee must have extensive experience in a supervisory position

Additionally, the Paralegal is the City employee that administers most of the Freedom of Information Request from the media and the general public. The new salary structure returns to the former practice of tying the Paralegal to the salary of the Mayor's Executive Secretary.

Municipal salaries need to be updated and studied continuously to stay competitive, and we will continue to update on an as needed basis. If approved, these increases would take place on September 28, 2020. I have attached the most recent job descriptions for both positions.

POSITION AVAILABLE Director of Veterans' Services

Position assists and advises veterans, their dependents and beneficiaries regarding their entitled benefits under state and federal law, ensuring that accurate records are maintained, applicants receive valid information and sound advice. Position is responsible for maintaining and improving upon the efficiency and effectiveness of all areas under his/her control. Responsible for outreach to veterans and dependents, assisting with finding employment for unemployed veterans and easing transition of veterans into civilian life.

Performs varied and responsible duties requiring a high level of initiative and independent judgment in the administration and execution of department services and the administration of benefits and other assistance services to veterans and their dependents. Duties require strict adherence to state and federal laws and for completing administrative requirements monthly to ensure state reimbursement to the City.

Position requires interaction with City departments, federal, state and private agencies, community groups, the general public, and veterans' organizations; responsible for coordinating parades and ceremonies with veterans' organizations.

As the Director of Veterans Services for the City of Marlborough, this position oversees the Marlborough-Sudbury Veterans District, which includes working for the Town of Sudbury one day each week.

Ideal candidate will be an energetic self-starter with a passion for helping fellow veterans. Attention to detail and excellent customer service, communication, and computer skills required . Education, Training and Experience: Bachelor's degree in business administration or social services; five years of experience in social welfare or related work; experience in veterans' benefits administration highly desirable; or any equivalent combination of education and experience. Special Requirements:

Incumbent must be an honorably discharged United States veteran {with wartime service as defined by M.G.L. Chapter 4, §7, Clause 43). Possession of a valid motor vehicle operator's license is required.

I have attached for your review two amendments to the City's salary ordinance and a job description regarding two positions that have been identified through salary surveys to be in need of increase per their job description, the experience of the incumbents, and services rendered.

The Veterans Director is tasked with leading the Veterans Service operations in Marlborough and Sudbury. The Veterans Director administers the City of Marlborough's Chapter 115 Veterans Subsidies and coordinates the administrative, service, and information systems necessary for the department to function per state and local guidance. We are still in a contract with the Town of Sudbury, which is scheduled to be re-negotiated in January, this increase will be taken into consideration at that time and an increase will be requested.

The position of Paralegal serves as the legal aide in the Office of the City Solicitor. This position handles a variety of complex administrative and legal matters. Additionally, the Paralegal is the City employee that administers most of the Freedom of Information Request from the media and the general public. The new salary structure returns to the former practice of tying the Paralegal to the salary of the Mayor's Executive Secretary.

Municipal salaries need to be updated and studied continuously to stay competitive, and we will continue to update on an as needed basis. If approved, these increases would take place on September 28, 2020. I have attached the most recent job descriptions for both positions.

SUPERVISION: This position works under the general direction of the City Solicitor and performs work for the Assistant City Solicitor.

I have attached for your review an order to adjust the Marlborough Fire Department Permit Fees per the recommendation of Fire Chief Kevin Breen, as well as, a comparative fee schedule study of surrounding communities.

As overviewed in the attached letter, the proposed order would make considerable adjustments to several permitting fees while remaining cost-effective for our residents. Raising prices is something I try to avoid; however, the last review and adjustment of these rates were completed in 2004. Since that time, the costs to provide these services have increased exponentially. I feel this is a cost-effective strategy to increase the price for these mainly commercial permits in order to leave most citizens unaffected. In addition to the changes recommended by the Chief, I would like to make Burning Permits and the receipt of Insurance Reports free for residents.

This is the first section of a comprehensive fee adjustment that I hope to take place on January 1, 2021. Throughout the fall, I will be sending down several more adjustments for review and approval. Please accept this letter seeldng your support to initiate fee increases for listed services and/or permits here at Marlborough Fire Department. I have enclosed several items concerning our department's existing fee schedule along with other supporting documents. Specifically, I have included, for comparison, a spreadsheet identifying various fees charged by the following communities: Marlborough; Hudson; Northborough; Shrewsbury and Berlin.

It is impmtant to emphasize a couple of points related to this subject matter. First, Marlborough Fire Department has an existing fee schedule as included in this packet and collects approximately $50,000 per year in revenue. However, I have learned the last rate increase occurred sixteen (16) years ago in 2004. We think it is time to raise ce1iain permit fees, not simply to increase revenue, but because our cost to provide these services exceed what we are charging consumers. For example, the fee for conducting an inspection when removing an underground storage tank (UST) is currently fifty dollars ($50.00). This hardly covers costs associated with time required to complete any such review/inspection including processing paperwork, driving to and from any site and time spent on scene during the actual tank removal and/or soil collection/sampling. The same can be said about 26F inspections. These inspections cost $50 for every residence being sold/purchased. A typical 26F inspection requires paperwork be completed before and after an inspection, along with coordination and scheduling, and an on­site inspection of the subject prope1iy often carried out by three on-duty persons arriving in a department vehicle.

Re: Transfer Request - 481 Elm Street

Honorable President Ossing and Councilors:

Please find enclosed for your review and approval a transfer in the amount of $440,000.00 to fund the purchase by the Marlborough Economic Development Corporation of 481 Elm Street, a 1.23 acre+/- parcel of land and house. This piece of property recently came up for sale and a portion of it has been identified as part of a potential site of a west-side fire station project. Prior to final approval there will be a hearing for both the public and the City Council input.

After acquisition and determination of needed lot size, the MEDC will work with the City to sell the existing house and remainder of the lot, and proceeds will be returned to the City. This transfer would move the funds from the Economic Development (Rooms Tax) account into the Marlborough Economic Development Corporation for the purchase of the property.
