1. School Calendar: I want to give the committee notice that there could be changes to theschool year based on guidance from the commissioner, and the calendar may need to bechanged in the near future. If the 180 day standard school year is altered, there may beanother calendar version to approve.

2. Summer Meetings: I would like to post the following dates as summer meetings:

Aug. 11th

Based on the nature of the work, I may not have a specific report for each meeting, but insteadan update on the work of reopening as a whole. Also, I would like to be flexible in the times ofthese meetings and have them start earlier than 7:30.

4. Reopening Guidelines: Based on conference calls, we are expecting re-opening guidelines

from the commissioner this week. There is considerable anxiety among students, faculty, andparents over these decisions. My commitment is to develop plans that work for Marlborough,and that we focus on making sure our schools are ready for the fall.

Assistant Superintendent of Teaching and Learning Report to School CommitteeRegular Session June 23, 2020

The CARES Act was signed into law on March 27, 2020. It includes the Elementary and Secondary SchoolsEmergency Relief (ESSER) funds to help K-12 educational entities prevent, prepare for, and respond to impactsof COVID-19. Funds may be used for a wide variety of purposes such as:

• Educational technology• Supplies and services that enable remote learning• Assessing learning gaps to inform teaching, and addressing those gaps• Planning and implementing summer learning and supplemental afterschool programs• Providing principals and other school leaders with resources to address individual school needs• Training and professional development for district staff on any topic from effective remote learning

strategies to sanitation and minimizing the spread of infectious disease when in-person school resumes• Supplies and services to sanitize district facilities; personal protective equipment (PPE)• Planning for and coordinating during long-term closures, including how to provide meals, technology

for online learning, guidance for carrying out IDEA requirements, and providing educational services

We identified the following priorities for this funding:

• LPNs for each K-12 building (one-year expense)• Stipends for a team to set up new Chromebooks and iPads for remote learning• Stipends for MHS summer and school year after school or Saturday school (not supported through Title

I)• Stipends for remote planning/training• Instructional technology: iPads, Chromebooks, hotspots (200), filters, software, licenses• Substitutes (planning for Covid related absences)

We will be required to report to the Department of Elementary and Secondary Education (DESE) on aquarterly basis projects supported with CARES Act funds. These reports will include the amounts spent oneach project and information about any subgrants or contracts.

1. Chairman Vigeant called the regular meeting of the Marlborough School Committee toorder at 7:30 p.m. at the District Education Center, 17 Washington Street, Marlborough,MA. Members remotely present included Heidi Matthews, Earl Geary, Michelle BodinHettinger, Denise Ryan, Katherine Hennessy, and Daniel Caruso. The AssistantSuperintendent of Teaching and Learning, Mary Murphy, was also remotely present. Theonly physically present individuals were Chairman Vigeant, Superintendent MichaelBergeron, and the Director of Finance and Operations, Douglas Dias.

This meeting is being recorded by local cable, WMCT-TV, and is available for review.

2. Pledge ofAllegiance: Chairman Vigeant led the Pledge of Allegiance.

6. Superintendent’s ReportSuperintendent Bergeron updated the committee on the delivery of meals throughout theCity. As of May 19th, over 130,000 meals have been prepared and delivered to residentsof Marlborough.On May 18th, the New York Times posted a photograph of the MPS senior portraits on theWalker Building lawn on their home page. The picture is attached to the Superintendent’sreport for anyone who has yet to see it.Superintendent Bergeron attached the guidelines/infographic for PK-12 schools inMassachusetts that Governor Baker provided the state. As of this report, there is nofurther guidance on reopening school in September yet. The Superintendent claimed thatthe district’s administration and teachers will soon begin to collaborate on the reopeningof schools in the district.

Superintendent Bergeron plans to pause the Akiruno exchange trip for next year due tothe current climate. He has been in contact with Ken Yoshioka and would like to write aletter to colleagues in Akiruno explaining the situation. The district still plans to renewthe student exchange program for the 2021-2022 school year. Superintendent Bergeron,Mrs. Hennessy and Mrs. Matthews briefly discussed the potential plans to consider the2020-2021 candidates for the 2021-2022 trip interviews/process since no students wereselected yet for this year’s cancelled trip.

Mr. Diaswill make this correction.

Mrs. Matthews has reviewed the warrant and will sign it tomorrow.Mrs. Bodin-Hettinger inquired about a name for the new elementary school. ChairmanVigeant presented some names to the Veterans Council and is giving them a few days toget back to him. Mr. Vigeant hopes to bring the top names to the City Council by themiddle of June.

Members remotely present included Heidi Matthews, Michelle Bodin-Hettinger,Denise Ryan, Katherine Hennessy, and Daniel Caruso. The Assistant Superintendent ofTeaching and Learning, Mary Murphy, and MEA Representative Rupal Patel were alsoremotely present. The only physically present individuals were Chairman Vigeant,Superintendent Michael Bergeron and the Director of Finance and Operations, DouglasDias.

6. Superintendent’s ReportSuperintendent Bergeron attached his self-evaluation to the agenda for the committee toreview. The purpose of this self-evaluation is for the Superintendent to consider many ofthe components of his position and how he can better serve the community.Superintendent Bergeron asked the committee to consider scheduling meetings in thesummer to be updated on reopening and to review financial information from theCommonwealth or Federal Government. He proposed July 14th, July 28th, and August 11th

as dates to hold meetings so that the administration can create a plan for Marlboroughbased on the guidance that the Commissioner of Education may provide by the regularlyscheduled June 23rd School Committee meeting.The Superintendent foresees the need for a school census to gauge students’transportation methods for the upcoming school year, as well as whether they have movedduring this time period without notice. This information needs to be gathered beforeschool so that any plans or issues can be presented to parents before reopening.

Superintendent Bergeron directed his staff to begin working groups to address the fallreopening; it is most likely that some type of hybrid model will be in place for theeducation of students. A hybrid model will cause significant disruption to families andtheir schedules as this is not a traditional school day model. The working groups willbrainstorm as many solutions for the issues that arise as possible to create the bestpossible learning environment.The Superintendent finished his report by speaking out about the murder of GeorgeFloyd, institutional racism, and violence against the black community. Mr. Bergeronreaffirmed his commitment to protecting our constitutional right to free speech.Mrs. Bodin-Hettinger explained to the public that the School Committee members allreceived a blank evaluation form to fill out regarding the Superintendent, and theseevaluations should be sent to her by June l6th so they can be compiled and prepared forthe next meeting.Superintendent Bergeron thanked the entire community for coming together this pastweekend in supporting the seniors during their graduation ceremonies.

A. Assistant Superintendent of Teaching & Learning Report

Mary Murphy, the Assistant Superintendent of Teaching and Learning, reported onthe MCAS graduation requirement to the committee. During the COVID-19emergency, the Department of Education created a system that enabled seniors, whohave not passed one or more of the MCAS tests, to earn the competency determinationthrough successfully completing a relevant high school course.On May 26th, the Board of Elementary and Secondary Education also voted to modifythe science and technology/engineering (STE) portion of the competencydetermination requirement for current high school freshmen, sophomores, andjuniors. In order for a student to be awarded the competency determination in STE,that student must have earned credit for a course in the relevant subject matter anddemonstrated competency during high school in one of the four tested disciplines:biology, chemistry, introductory physics, technology/engineering.Mrs. Murphy explained that students in the class of 2024 (currently in 8t grade) areexpected to participate in STE testing in 2021 and 2022 according to their school ordistrict plan for this testing. During the 2020-2021 school year, members of the classof 2022 (currently sophomores) will take the 10th grade English language arts andMath MCAS tests.

Mrs. Murphy went on to state that Special Education Extended Year Services will beoffered, as well as summer programming for K-8 Title I students, K-12 EnglishLearners, and MHS credit recovery students. All classes will be “live” remote learninginstruction and one-on-one tutoring sessions as needed.Mrs. Murphy spoke about her and Jody O’Brien’s Reopening Working Group whichconsists of administrators and teachers being regular contributors of the instructioncommittee. Due to new regulations/guidelines, there has been a transition from afocus on enrichments to remote instruction that is introducing new content andreinforcing targeted curriculum standards. The Reopening Working Group ispreparing a flexible plan that could apply to in-person instruction, full-time remotelearning or a hybrid model consisting of both methods of learning. The committeemeets three times per week and will be requesting groups of teachers andadministrators to join throughout the next few weeks.Mrs. Murphy and Mrs. Hennessy discussed potential priority students: sophomoresand juniors.

B. Director of Student Services Report

Jody O’Brien, Director of Student Services, updated the committee on the progressionof Special Education while schools are closed. The district has provided consultationsto parents on how best to support their special needs child and has maintainedcommunication throughout this time. The MPS Special Education staff collaboratedwith general education teachers throughout the closure and phases of remote learningto provide support to students and families. Some of the areas they have struggledwith the most include Occupational Therapy and Physical Therapy, because thoseservices are very hands on and usually need to be done in-person.Every week, the Associate Commissioner, Russell Johnston, has held meetings withSpecial Education administrators to provide additional information and guidance.Once school resumes, Mrs. O’Brien explained that parents could potentially bringforth claims for compensatory services. The process for how to figure out whatcompensatory services to provide students with has not yet been created by the IEPTeam, but it most likely will be based on the impact that the school closure and lack ofdifferent services has had on the student.Mrs. O’Brien went on to explain that Educational Team Leaders have used MicrosoftTeams to hold virtual IEP Team meetings with agreement from parents to maintaincompliance with IEP timelines at the start of the closure. Initial evaluations or reevaluations of students have been on hold since they require in person assessments.

Mrs. O’Brien is going to see if School Psychologists can come in during the summer,while following safety protocols, to do these assessments via appointments withstudents to reduce the backlog of assessments when school resumes. DocuSign hasbeen utilized to send out TEPs for parents to view and sign electronically; thisprocedure will continue moving forward.Mrs. O’Brien stated that the plan for remote summer programs, based on the guidancefrom DESE, has changed since submitting her report on Thursday. Originally, asstated in her report, the MPS summer programs would have been remote due toseveral factors, one being that group transportation is not possible. Parents could havebeen reimbursed for transportation mileage according to the Commissioner ofEducation, but many parents in Marlborough are not able to transport theirchild/children to school. PPE is also in short supply and the district did not want tocompete with first responders for such supplies, which is another factor that wasconsidered. It would also have been difficult to maintain safety protocols, such associal distancing, for many students with special needs, who are at a high health risk.The district had come to the decision of remote summer programs due to the lack ofguidance from the state on how to service this population in person.This needed guidance came in stages, beginning on Friday, as DESE stronglyrecommended that more in-person services should be provided to students if thehealth and safety guidelines can be followed. Mrs. O’Brien still had believed it wouldbe extremely difficult to meet the standards at the time.Sunday night, however, more detailed guidance highly encouraging districts to targetthe most vulnerable and high need students for some in-person instructions wasprovided.Today, Mrs. O’Brien, John Fletcher and Patty Brown joined a phone-call with JohnGarside, from the Board of Health, to discuss the guidance and any concerns withsuch. From this phone-call it was realized that a summer program with some in-person services, for students with the highest needs, could be possible after someplanning, but the in-person portion could not be in effect until mid-way through theprogram due to time constraints. This new plan/program would also allow foradministrators and teachers to potentially solve problems that could arise during thefall.If parent(s)/guardian(s) have questions they may contact Mrs. O’Brien or JohnFletcher.

C. Director of Finance & Operations Report

Douglas Dias, Director of Finance and Operations, informed the committee that theprocess of moving teachers to their new FY21 schools finished on June 3rd Before thisschool year is over, teachers will be able to unpack at the New Elementary School.Commissioner John Ghiloni and his team are now preparing the new DistrictEducation Center (DEC) offices at Whitcomb, and the central office staff areanticipated to occupy that space in mid-August.Mr. Dias updated the committee on the new Transportation Coordinator, StephenPhalen, and his plans to implement a bus-pass system K-12 for FY21. It is expectedthat he will have a tangible impact on communication and service improvements inFY21.

Mr. Dias explained that over 170,000 meals have been served to Marlboroughresidents thus far. The food service program would not be possible without thecollaboration between City and District leaders and our NRT and Aramark partners.Jenna Janson, the Food Services Director, is developing a meal continuity plan for thesummer. Mr. Dias briefly mentioned the draft plan, and stated that he hopes to utilizethe New School as a production site to test the site’s systems.The district has moved to acquire PPE items, especially those that will likely bebackordered once the official guidance from the state is released, to maintain safetyprotocols when schools reopen. Before the order was finalized, administrators metwith other departments in the city.Mr. Dias reported that there is not an update on the state budget yet. However, theapproval of the FY21 budget for the City will allow the district to continue operatingnormally past June 30th• The eventual FY21 state budget may impact the district’sFY21 budget, however.

Approval of Overnight Football TripSuperintendent Bergeron read the recommendation by the Athletic Director, JeffRudzinsky, asking the School Committee to grant approval for the MHS Football teamto attend an overnight at Eagle Hill School on Friday, August 21st pending guidelinesfrom Governor Baker.

The resolution states that there can be no unfunded mandates for COVIDi; states must reimburse every school district for the expenses required to follow statemandates.This resolution will be sent to Governor Baker as well as the Massachusetts Secretary ofEducation, Commissioner, Senate President and House Speaker. Senator Jamie Eldridge,Representative Danielle Gregoire and Representative Carmine Gentile are cc-ed on thisdocument.Chairman Vigeant stated that he could not support this resolution in part due to the state’sinability to produce an FY21 budget currently.

Mrs. Matthews stated that she supports the intent of the resolution, but she does notbelieve any action would or could be taken by the state at this time to uphold thisresolution.Mrs. Hennessy vocalized her pride in Marlborough for being prepared thus far, yet she isconcerned for other districts that are not. She is also concerned for the state and theirinability to create a budget. While she is not against the resolution, Mrs. Hennessybelieves it may be to soon to request this from the state.Mrs. Bodin-Hettinger explained that she still believes it is their responsibility, as localleaders, to communicate this resolution even if action may not be taken by the state. Shesupports this resolution.Mr. Caruso noted that many groups are pushing for education funding, and he believesthey should wait and work things out together when things become clearer. He is notanxious to support this resolution.Mrs. Bodin-Hettinger explained that this resolution is probably going to be sent out soonas other School Committees are taking it up at their meetings this week or next week.Mrs. Hennessy suggested to table this item for voting until the next meeting in case thingsevolve over the next two weeks with the state and current climate.Chairman Vigeant stated that this agenda item will be put on next meeting’s agenda.

Should restrictions related to Covid 19 be lifted, the MHS varsity & junior varsity soccer teams wouldtake a day trip to East Hartford for a soccer scrimmage. They would travel by NRT bus, scrimmage,and head home.

REVIEW of PRIVATE SCHOOL APPLICATIONS(School Administration & Fiscal Management)

Review of Private School Applications

The School Committee recognizes that many worthwhile contributions are made to thecommunity by parochial and other private schools.

Any person seeking to establish a private school within the Marlborough community mustsubmit an application to the Chair of the School Committee. Any such application shallinclude a detailed plan, along with any supporting documentation, with regard to thefollowing criteria:

1. Population to be Served

A. Admissions criteria; documentation of school’s enrollment

2. Physical PlantlSafety

A. The school shows evidence of current:

i) Certificate of Occupancy

ii) Fire inspection

iii) Safety inspection

iv) Elevator inspection, if applicable

v) Compliance with lead paint poisoning prevention (for children under 6years old)

vi) Compliance with other applicable federal and state health and safetystandards (e.g., PCB, asbestos inspections, handicap accessibility)

vii) Copies of valid safety and health inspection certificates

B. The site, plant, and equipment adequately support the program and are operatedto ensure the safety and health of the students.

3. Curriculum

A. The curriculum offered is “equivalent” to that offered in the local school systemgenerally and, specifically, in terms of the following instructional areas:

i) mathematics

4. Educational Materials

A. Textbooks and individual instructional materials, including computers and othertechnology, are adequate.

5. School Staff

A. The instruction provided is ‘thorough and efficient” based on:

i) teacher qualifications

ii) adequate student/teacher ratio

iii) regular evaluation of staff

iv) the school principal reviews criminal offender record information(CORI) of current and prospective employees and volunteers, asrequired by law

6. Administration

A. The school has a clearly defined organization that facilitates its objectives.

7. Records

A. The school maintains an adequate system of student records (e.g., attendance,health, discipline, progress reports).

B. The student records are kept in a secure and organized manner that is consistentwith federal and state student record laws to the extent applicable.

C. The school maintains and timely provides transcripts in response to requests ofstudents and former students in accordance with G.L. c. 71, § 34A.

D. The school is prepared efficiently to transfer transcripts of all students and formerstudents to the Massachusetts Department of Elementary and SecondaryEducation and/or other schools should it cease operation, in accordance withG.L. c. 71, § 34G.

8. Student Services

A. The school provides adequate pupil personnel services for all students (e.g.,health care procedures, guidance and counseling programs, discipline policy).

9. Financial Support

A. The school provides evidence of financial solvency and resources to sustain theeducational program.

B. The school presents documentation of its legal status. These may include copiesof the articles of incorporation and the certification of tax exempt status.

10. Student Learning Time

A. The school provides adequate student learning time (length of school year andschool day) and hours of instruction in each subject.

11.Student Performance Assessment

A. The school periodically evaluates students’ skills, competencies, and knowledgeand documents their progress.

Upon submission of an application, the School Committee will endeavor to review anyapplication materials and/or take a vote on whether to approve the application at its nextregularly scheduled meeting or in a timely manner thereafter. A review of any applicationto establish a private school may include, at the School Committee’s sole discretion,without limitation, a review of the applicant’s detailed plan with regard to the above-listedcriteria. The School Committee or its designated representative may conduct one or moresite visits as part of its review of any application for approval or re-approval or to ensurecompliance with this policy.

In accordance with state law, the School Committee will approve a private school within theMarlborough community when it is satisfied that the instructional program of the schoolequals that of the town’s public schools in thoroughness, efficiency, and progress made.Approval of any private school is subject to the sole discretion of the School Committee,and is conditional upon the private school’s approval by and maintenance of good standingwith any other public agency with jurisdiction over of the private school, including but notlimited to the Department of Elementary and Secondary Education.

The School Committee’s approval of any private school within the Marlborough communityshall remain valid until substantial changes are made in the private school’s program, atwhich point the private school must seek re-approval from the School Committee. If theSchool Committee determines that any private school previously approved by the SchoolCommittee has deviated from the criteria upon which its approval was based or hasotherwise failed to comply with the requirements of this policy or applicable law, the SchoolCommittee, at its sole discretion, may decide not to reapprove or may revoke the approvalof such private school.

Upon approval of any private school within the Marlborough community, the SchoolCommittee will provide timely notice of such approval to the Department of Elementary andSecondary Education in the manner specified by the Department. The School Committeewill further provide timely notice to the Department if it has decided not to re-approve, orhas revoked approval of, a private school, or if the school has closed.

The School Committee’s responsibility under this policy is limited to acting reasonably andin good faith in carrying out its approval function. The School Committee shall not be liablefor any acts or omissions of a private school and/or its students.

SUBSTITUTE TEACHER POLICY(Personnel and Management)

SUBSTITUTE TEACHERS1. General provisionsA. Human Resources (HR) shall be responsible for e’-general administration of substitutesteachers and nurses whether provided by the school district or by an outside contractor.

B. Substitute teachers shall have a minimum educational background of two years ofcollege. Substitute nurses shall have the required certifications/licenses for such positions.

C. Principals shall be responsible to interview all of the substitutes and makerecommendations for hire in writing to HR. Issues relative to substitutes shall be forwardedto the Human Resources Department, Superintendent or Superintendent designee.

D. HR has recommended that All substitutes must MUST fill out paperwork completestandard district hiring paperwork be appointed prior to being placed on the substitute list.This paperwork must include, but not limited to CORI, fingerprinting, as well as MPSPolicies.

E. Substitutes shall be paid in accordance with a rate scheduled approved by the SchoolCommittee as part of the budget.

2. Long-Term substitutesA. Long-term substitutes must be licensed by the MA Department of Elementary andSecondary Education as a Teacher in the area that they are teaching for assignments ofmore than 90 consecutive school days, same subject, same classroom. The long-termsubstitutes shall be designated by the Superintendent for leaves or vacancies situationsinvolving leaves or openings of more than thirty (30) consecutive days in length. Thesubstitute may be paid at the appropriate level on the long-term rate schedule from the firstday of that assignment if he/she they are serving serves in a full teaching capacity toinclude the day-today to-day planning responsibility of that position.

B. Preferably, substitutes teachers with an appropriate teaching certificate will be employedin all long-term teaching assignments situations. If a long-term substitute teaching morethan 90 consecutive school days is not certified for an assignment in a Title 1-fundedschool, a four-year accredited college degree is required and parents must be properlynotified. When no properly certified substitutes are available, however, substitutes with adegree from a four-year accredited college may be employed in long term situations, aslong as parents are properly notified.

C. A long-term substitute, starting a school year, may be paid for up to five (5) days, prior toopening day in order to set up a classroom and attend orientation.

ADDITIONAL SUPERVISION NEEDS FOR STUDENTS

Supervision outside the classroom is necessary to protect the physical safety of thestudents. Each Pprincipal or designee will be responsible to draw up a list of supervisoryduties and assign staff members within the building to cover them. The duties specificallyshall include: breakfast, lunch, recess, hall monitoring, bus duties, as well as other dutiespeculiar unique to a particular building or educational level. The numbers of staff membersrequired for a particular duty or set of duties will be determined by the Principal ordesignee. The Principal or designee will assign duties fairly amoung the staff.
