SUBJECT: California Senate Bill 415 "Voter Participation" and Introduction of an Ordinance Aligning the Timing of the City's General Municipal Elections to the Required Statewide Election Date

SUMMARY Senate Bill 415 (SB 415) signed by the Governor on September 1, 2015, amended California's Elections Code (EC) pertaining to municipal election dates, which mandates all General Law cities to consolidate the local elections, for city council members and other officials with statewide elections,

DISCUSSION On September 1, 2015, Governor Brown signed into law SB 415 (Exhibit A), which prohibits local governments, beginning January 1, 2018, from holding an election on any date other than on a statewide election date if doing so has resulted in voter turnout being at least 25% below the average turnout in that jurisdiction in the previous four statewide general elections. Pursuant to Elections Code (EC) Section 1001, statewide election dates are recognized to occur in June and November of each even-numbered year.

The public policy behind SB 415 was to address waning civic engagement in politics as illustrated by declining voter turnout in federal, state, and municipal elections, The legislative analysis asserts that one major contributing factor to low voter turnout - the timing of elections - could be addressed by synchronizing municipal elections with statewide elections. The Public Policy Institute of California surveyed 350 California cities and found that moving municipal elections to coincide with statewide elections could result in a 20-36% boost in voter turnout

The City of Hawaiian Gardens ("City") general municipal elections are now held in November of odd-numbered years to elect five members of City Council, with staggered terms. Pursuant to EC Section 10403,5(b) the City Council may increase or decrease any terms of office by not more than 12 months.

In accordance with SB 415, the City Clerk's Office has conducted an analysis of voter turnout (Exhibit B) and has determined that the City will be required to coordinate future elections with the statewide general elections date.

Statewide Primary Elections vs. Statewide General Elections The City Clerk's Office has further analyzed voter turnout at statewide primary elections held in June versus statewide general elections held in November (Exhibit C) and determined there is a significant increase in voter turnout at statewide general elections. Moreover, since the City's current elections are held in the month of November, synchronizing the City's elections with the November statewide general election provides some continuity with the current election schedule and will likely result in greater voter participation, which is consistent with the intent of SB 415. Therefore, it is recommended that the City Council choose to synchronize with statewide general elections held in November of each even-numbered year,

Los Angeles County and Limitation on Election Consolidation EC Section 1301 (b)(1) requires that a City Council enacted ordinance to consolidate with a statewide election date be subject to approval by the Los Angeles County Board of Supervisors (Supervisors). The legislative analysis points out that existing law (EC Section 10402.5) allows the Supervisors to deny a request for consolidation with a statewide election, if the voting system used by the Registrar cannot accommodate the additional election. The Registrar has previously expressed concern that its voting system could accommodate only a limited number of contests at each election and that moves by cities to consolidate with statewide elections would exceed the capacity of its voting system. The Registrar has recently unveiled a new voting system, with sufficient technical and physical capacity to accommodate the influx of consolidations with local districts and municipalities, however, the voting system is not anticipated to be available for use until 2020.

Registrar staff has started work on preparing a preliminary consolidation impact analysis to determine if there are any ballot capacity issues or technological concerns with the City's potential move to the November 2018 election cycle. Registrar staff has stated that recent requests by municipalities and school districts have been approved for consolidation, noting that several of these requests were a result of lawsuit settlements or will become operative in 2020 to coincide with the launch of the new voting system.

CONCLUSION At the February 28, 2017 meeting, the City Council directed staff to begin synchronization of the City's general municipal elections to statewide election dates of November in even numbered years, beginning with the statewide election date of November 2018 and fully synchronized by November 2020, in accordance with California Senate Bill 415.

Attached for first reading and introduction is an ordinance to effectuate the synchronization of the City's general municipal elections with the even-year statewide election dates, starting in November 2018 by amending the election date established under Hawaiian Gardens Municipal Code Section 2.04.050, "Municipal Elections," moving the City's General Municipal Election date to the first Tuesday after the first Monday in November of even-numbered years beginning in November 2018.

FISCAL IMPACT

The fiscal impacts associated with this item are unknown at this time. Election costs vary based on the number of agencies consolidating in a particular election, number of candidates, number of polling sites, etc. It is possible that election costs could decrease as more jurisdictions are required to consolidate with statewide elections.

RECOMMENDATION It is recommended that-the City- Council introduce the--attached ordinance for first reading and direct staff to begin synchronization of the City's general municipal elections with statewide election dates in November of even numbered years, beginning with the statewide election date of November 2018 and fully synchronized by November 2020, in accordance with California Senate Bill 415.

Existing law generally-requires all state, county, municipal, dlstrlctl and school district elections be held on an established election date, ExistIng law also establlshes certain dates for statewide elections. Existing law requires any state, county, municipal, district, and schoo! district election held on a statewide election date to be consoUdated with a statewide election, except as provided.

This blH, commencing January 1, 2018, would prohibit a political subdivision, as defined, from holding an election other than on a statewide election date If holding an election on a nonconcurrent date has previously resulted In voter turnout for a regularly scheduled election in that political subdivision being at least 25% Jess than the average voter turnout within the political subdivision for the previous 4 statewide general elections, except as

specified.

CHAPTER 1.7. Voter Participation

14050. ThIs chapter shall be known and may be Cited as the California Voter Participation Rights Act.

14051. As used In this chapter:

(a) "Political subdivision" means a geographic area of representation created for the provision of government services, Including, but not limited to, a city, a schoo! district, a community college district, or other district

organized pursuant to state law.

(c) "Voter turnout" means the percentage of voters who are eligible to cast ballots within a given political subdivision who voted.

14052. (a) Except as provided In subdivision (b)r a political subdivision shall not hold an electIon other than on a statewide election date If holdIng an electIon on a nonconcurrent date has previously resulted In a significant decrease In voter turnout.

(b) A political subdIvisIon may hold an election other than on a statewide election date if, by January 1, 2018, the political subdivision has adopted a plan to consolidate a future election with a statewide election not later than the November 8, 2022, statewide general electron.

14053. Upon a finding of a violatIon of subdivision -(a) of Section 14052, the court shall implement appropriate remedies, Including the ImpositIon of concurrent election dates for future elections and the upgrade of voting equipment or systems to do so. In ImposIng remedies pursuant to this section, a court may also require a county board of supervisors to approve conSOlidation pursuant to Section 10402.5.

14054. In an action to enforce subdivisIon (a) of Section 14052, the court shalt allow the prevailing plaintiff other than the state or political subdivision of the state, a reasonable attorney's fee consistent with the standards established In Serrano v. Priest (1977) 20 Cal.3d 25, 48-49/ and litigation expenses Including, but not limited to, expert witness fees and expenses as part of the costs, A prevailing defendant shall not recover any costs, unless the court finds the action to be frivolous, unreasonable, or without foundation.

14055. A voter who resides In a political subdIvision where a violation of subdivision (a) of Section 14052 Is alleged may fHe an action pursuant to that section in the superior court of the county In which the political

1) Provides that the following dates are "established election dates":

a) The second Tuesday of April in each even-numbered year;

b) The first Tuesday after the first Monday in March of each odd-numbered year;

c) The frrst Tuesday after the frrstMonday in June in each year; and,

d) The frrst Tuesday after the frrst Monday in November in each year.

2) Requires all state, county, municipal, district, and school district elections to be held on an established election date, except as specified. Provides that the following types of elections, among others, are not required to be held on an established election date:

a) Any special election called by the Governor;

b) Elections held in chartered cities or chartered counties in which the charter provisions are inconsistent with state election laws;

c) School governing board elections conducted pursuant to specified provisiQns of Jaw;

d) Elections required or permitted to be held by a school district located in a charter city or county when the election is consolidated with a regular city or county election held in a jurisdiction that includes 95 percent or more of the school district's population;

e) County, municipa~ district, and school district initiative, referendum, or recall elections;

f) Any election conducted solely by mailed ballot pursuant to specified provisions of Jaw; and,

g) Elections held pursuant to specified provisions of Jaw on the question of whether to authorize school bonds.

3) Requires a general Jaw city to hold its general municipal election on an established election date or on the second Tuesday in April of each odd­numbered year, except as specified.

4) Requires a school district, community college district, or county board of education to hold the regular election to select governing board members on the first Tuesday after the first Monday of November in each odd-numbered year, or at the same time as the statewide direct primary election, the statewide general election, or the general municipal election, except as specified.

5) Requires the general district election held to elect members of the governing board of a special district to be held on the first Tuesday after the first Monday in November of each odd-numbered year, unless the principal act of the district provides for the general district election to be held on a different established election date, or on an established mailed ballot election date, as specified. Permits a special district to adopt a resolution requiring its general district election to be held on the same day as the statewide general election, upon approval of the county board of supervisors, as specified.

6) Permits a county or a city to provide for its own governance through the adoption ofa charter by a majority vote ofits electors voting on the question.

7) Permits a city charter to provide for the conduct of city elections. Grants plenary authority, subject to limited restrictions, for a city's charter to provide for the marmer in which andthe method by which municipal officers are elected.

8) Provides that a legally adopted city charter supersedes all laws inconsistent with that charter with respect to municipal affairs.

This bill:

1) Prohibits a political subdivision from holding an election other t.1}an on a statewide election date if holding an election on a non-concurrent date has previously resulted in turnout that is at least 25% less than the average voter turnout within that political subdivision for the previous four statewide general elections. Permits a voter who resides,in a political subdivision where a violation of this requirement is alleged to me an action in the superior court in the county in which the political subdivision is located.

2) Permits a political subdivision to continue to hold elections on dates other than statewide election dates after January 1, 2018, notwithstanding the provisions of this bill, if the political subdivision adopts a plan not later than January 1, 2018, to consolidate future elections with the statewide election not later than the November 8, 2022, statewide election.

3) Requires a court, upon finding a violation of this bill, to implement appropriate remedies, including the imposition of concurrent election dates for future elections and the upgrade of voting equipment or systems to do so. Pennits a court to require a county board of supervisors to approve the consolidation of elections, as specified, when imposing remedies.

4) Permits a prevailing plaintiff party in an action brought pursuant to this bill, other than the state or a political subdivision of the state, to recover reasonable attorney's fees-and litigation expenSes, including, but not limited to, expert witness fees and expenses as part of the costs, as specified. Prohibits a prevailing defendant party from recovering any costs unless the court fmds the action to be frivolous, unreasonable, or without foundation.

5) Provides that the provisions of this bill do not apply to special elections.

6) Provides that this bill shall become operative on January 1, 2018.

Background

History of Established Election Dates: In 1973, the Legislature approved and Governor Reagan signed SB 230 (Biddle), Chapter 1146, Statutes of 1973, which created "regular election dates" (which subsequently were renamed "established election dates"). The concept behind having a regular election schedule that governed when most elections would be held was that such a schedule would encourage election consolidations, thereby potentially reducing election costs, and could encourage greater voter participation because voters would become used to voting on these regular election dates. SB 230 created five established election dates in each two-year cycle-three in even-numbered years (in March, June, and November), and two in odd-numbered years (in March and November).

One year after established election dates were first created, AB 4180 (Keysor), Chapter 1386, Statutes of 1974, added an additional established election date in May of odd-numbered years. The rationale for adding an established election date was that the eight-month gap between established election dates in March and November of odd-numbered years delayed many special local elections from taking place in a timely manner, including elections to fill vacancies, annexation elections, bond elections, and tax rate elections. Since that time, the exact dates that are established election dates have fluctuated, often moving to reflect changes in the date of the statewide primary election held in even-numbered years, though generally there have been at least three established election dates in each year.

Having multiple established election dates in each year, but specifying that many types of elections must be held on an established election date, reflects an attempt to balance the desire to hold most elections on a predictable, regular schedule, while still providing the flexibility to ensure that elections can occur in a timely manner when necessary.

On-Cycle vs. Off-Cycle Elections: Although existing law generally requires that regularly scheduled county elections be held at the same time as statewide elections, other local jurisdictions (e.g., cities, schooldistricts, and special districts) have greater flexibility when deciding when to hold regularly scheduled elections that are held to elect governing board members. Elections that are held at the same time as statewide elections are often referred to as "on-cycle" elections, while elections held at other times are often referred to as "off-cycle" elections.

The degree to which local governments hold their elections on-cycle or off-cycle varies significantly throughout the state. Roughly 30 percent of the counties in California do not have regularly-scheduled off-cycle elections, because all the local jurisdictions in those counties hold their governing board elections at the same time as statewide elections. In other coUnties, large numbers of cities, school districts, and special districts hold their governing board elections off-cycle in November of oda-numbered years. A smaller number oflocal jurisdictions hold their regularly scheduled governing board elections on other permitted off-cycle dates.

Charter Cities: As noted above, the California Constitution gives cities and counties the ability to adopt charters, which give those jurisdictions greater autonomy over local affairs. Charter cities, in particular, are granted a great deal of autonomy over the rules governing the election of municipal officers. In fact, the Constitution grants "plenary authority," subject to limited restrictions, for a city charter to provide "the manner in which, the method by which, the times at which, and the terms fer which the several municipal officers and employees ... shall be elected or appointed." The Constitution further provides that properly adopted city charters "shall supersede all laws inconsistent" with the charter.

Los Angeles County and Limitations on Election Consolidations: Existing law requires all state, county, municipal, district, and school district elections that are held on a statewide election date to be consolidated with the statewide election, except that the Los Angeles County Board of Supervisors is allowed to deny a request for consolidation of an election with the statewide election if the voting system used by the county cannot accommodate the additional election. This unique provision allowing Los Angeles County to deny consolidation requests was

created through the passage ofSB 693 (Robbins, Chapter 897, Statutes of1985), in response to attempts by a number of cities in Los Angeles to move their municipal elections to the same day as statewide elections. Los Angeles County sought the ability to deny consolidation requests because its voting system could accommodate only a limited number of contests at each election, and the county was concerned that the move by cities to hold their elections at the same time as the statewide election would exceed the capacity of that voting system. Los Angeles County still uses a variant of the votiog system that it used in 1985, though the county is currently developing a new voting system. One of the principles that the county has articulated to guide the development of its new votiog system is having a system that has "sufficient technical and physical capacity to accommodate ... consolidation of elections with local districts and municipalities." That voting system, however, may not be available for use countywide before 2020.

Some local jurisdictions have already taken steps to move the date of their elections in anticipation of Los Angeles County's new voting system. Earlier this year, voters in the city of Los Angeles and in the Los Angeles Unffied School District approved ballot measures to move those jurisdictions' general elections so that they are held at the same time as statewide elections, beginning in 2020. Arguments in support of those measures. indicated that such a timeline would allow local elections to be consolidated with federal and state elections.

While this bill will go into effect on January 1,2018, recent amendments taken by the author allow a political subdivision to contioue to hold its elections on dates other than statewide election dates after January 1,2018, notwithstanding the provisions of this bill, if the political subdivision adopts a plan not later than January 1,2018 to consolidate future elections with the statewide election beginning no later than November 2022. Based onLos Angeles County's current timeline for deploying its new voting system, these amendments should allow political subdivisions in that county to continue holding off-cycle elections until the county is able to accommodate additional election consolidations.

Special Elections: This bill explicitly provides that its provisions do not apply to special elections. As a result, special elections that are conducted by a political subdivision to fill a vacancy on that subdivision's governing board, or to vote on a local ballot measure, will not be required to occur at the same time as statewide elections, even if the turnout at special elections in the jurisdiction regularly is significantly lower than the turnout in that jurisdiction at statewide elections.

ARGUMENTS IN SUPPORT: According to California Cornmon Cause: One of the greatest barometers for waning civic engagement in American politics is declining voter turnout in federal, state, and municipal elections. There are many potential contributing factors: general cynicism about government and elected officials, a decline in investment in civics education, and an increasingly transient society. .

Yet there is one major contnbuting factor to low voter turnout - the timing of elections - that could be addressed with a relatively simple policy change. The Public Policy Institute of California surveyed 350 California cities and found that simply moving an election to be synchronized with the even year state elections can result in a 21-36 percent boostin voter turnout for municipal and other local elections. SB 415 accomplishes this goal by prohibiting municipalities from holding off-cycle elections if doing so results in a significant (25% or more) decline in voter turnout.

ARGUMENTS IN OPPOSITION: Tht) Desert Water Agency (DWA) writes: DWA holds an election for its governing board in November of odd-numbered years. The Agency was asked many years ago by the Riverside County Elections Department to change .. .its election sched1,l1e due to the large size of the ballot when all elections were consolidated on a statewide election date. The November 2013 election turnout for DWA was 32.32%; the November 2014 statewide turnout for Riverside County was 34.52%. In comparison, voter turnout in Riverside County in the 2012 presidential election was nearly 75%, which would significantly skew the comparative analysis called for by SB 415 (an average of the previous four statewide elections).

Nevertheless, combining the DW A election with the statewide election would not likely result in greater voter participation .... [A] review ofvoter analytics shows that voters are less likely to cast a vote as they move down the ballot, a phenomenon known as "roll-off." While this effect might be due to fatigue, it also might be due to the fact that contest saliency generally decreases with ballot positions. Voter fatigue would likely counteract any benefit of forcing local agencies to change election dates as they would fall to the end of a crowded ballot.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HAWAIIAN GARDENS, CALIFORNIA AM END I N G SEC T ION 2 .04.050 0 F C HAP T E R 2.04 OF THE HAWAIIAN GARDENS MUNICIPAL CODE SYNCHRONIZING THE CITY'S GENERAL MUNICIPAL ELECTIONS WITH THE STATEWIDE ELECTIONS ON THE FIRST TUESDAY AFTER THE FIRST MONDAY IN NOVEMBER OF EACH EVEN-NUMBERED YEAR COMMENCING IN NOVEMBER 2018.

WHEREAS, the City of Hawaiian Gardens ("City") general municipal elections are currently held on the first Tuesday after the first Monday in November of odd­numbered years;

WHEREAS, beginning January 1, 2018, Senate Bill 415 (SB 415), the California Voter Participation Rights Act, prohibits general law cities from holding a local general election on a date other than on a statewide election date if local elections held on non­concurrent dates has previously resulted in a significant decrease in voter turnout (i.e., at least 25% less than the average voter turnout within the city for the previous four statewide general elections);

WHEREAS, as the City has experienced a significant decrease in voter turnout as identified by the Los Angeles County Recorder, the City has determined that it must begin conducting its general municipal elections on statewide general election dates, as required by SB 415;

WHEREAS, Elections Code Sections 1301 and 10403.5 authorize the City to change the date of its general municipal election to coincide with the date of a statewide general election;

WHEREAS, the City Council wishes to consolidate its elections with the statewide general elections conducted by the County of Los Angeles on the first Tuesday after the first Monday in November of even-numbered years, beginning in November 2018;

WHEREAS, pursuant to Elections Code Section 10403.5(e), within 30 days after the Ordinance becomes operative, the City Clerk shall cause a notice to be mailed to all registered voters, within the City, informing the voters of the change in the election date and the extended terms of the current elected Mayor and City Council members; and

WHEREAS, the adoption of this Ordinance shall cancel the City's November 7, 2017, general municipal election and set th.e next general municipal election of the City on November 6, 2018, and every election thereafter on the first Tuesday after the first Monday in November of even numbered years.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF HAWAIIAN GARDENS DOES ORDAIN AS FOLLOWS: P. 26

SECTION 1. The recitals set forth above are incorporated herein and by this reference made an operative part hereof.

SECTION 2. Section 2.04.0S0 entitled "Municipal Election" of the Hawaiian Gardens Municipal Code is hereby repealed in its entirety and replaced as follows:

Pursuant to Sections 1301 and 1000 of the Califomia Elections Code, the City of Hawaiian Gardens' general municipal election date shall be held on the first Tuesday after the first Monday in November of even-numbered years to coincide with the statewide election.

SECTION 3. Pursuant to Elections Code Section 10403.S(b), and in order to accomplish the change in election date set forth in Section 2 hereof, the City's general municipal election currently scheduled for November 7,2017, is hereby cancelled, and the terms of all current incumbent City Council members shall be increased by 12 months as follows:

A. The three Council members whose terms of office would have, prior to the adoption of this Ordinance, expired following the November 2017 general municipal elections shall, instead, continue in their offices until certification of the results and administrations of the oaths of office after the November 2018 City general election; and

B. The Mayor and Council member whose terms of office would have, prior to the adoption of this Ordinance, expired following the November 2019 general municipal election, shall instead, continue in their offices until certification of the results and administration of the oaths office after the November 2020 City election;

SECTION 4. Severability. If any section, subsection, subdivision, sentence, clause of phrase of this Ordinance is for any reason held to be unconstitutional or otherwise invalid, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this ordinance and each section, subsection, subdivision, sentence, clause and 'phrase thereof, irrespective of the fact that anyone or more sections, subsections, subdivisions, sentences, clauses or phrases be declared unconstitutional.

SECTION 5. Effective Date. This Ordinance shall take effect 30 days after its adoption. The City Clerk or his duly appointed deputy shall certify to the adoption of this Ordinance and shall cause this Ordinance to be published as required by law.

RESOLUTION NO. 014-2017 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HAWAIIAN GARDENS, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, SUPPORTING THE ABC UNIFIED SCHOOL DISTRICT IN PROVIDING ALL CHILDREN EQUAL ACCESS TO EDUCATION, REGARDLESS OF IMMIGRATION STATUS AND CITIZENSHIP.

On February 28, 2017, ABC Unified School District ("ABCUSD") President and Trustee Area 7 Representative, Chris Apodaca, made a presentation to the City Council regarding the ABCUSD's pOlicies and practices as it pertains to providing children equal access to education regardless of immigration status and/or citizenship. He informed the City Council and the community that families are to send their students to school and for families to be reassured that students will not be released to any federal, state or local law enforcement agency, in accordance with the laws, which includes, release to a parent or legal guardian of record or in compliance with a verified court order or warrant signed by a judge to be legal. The ABCUSD in its efforts to protect the rights of families and their students, will reaffirm this policy and procedure by adoption of ABCUSD Resolution No. 16-73, to be presented for adoption by the ABCUSD Board at its regular meeting on March 21, 2017.

As a result of the recent information presented by ABCUSD President Apodaca, Councilmember Maravilla and Councilmember Rios have requested that a resolution in support of the ABCUSD resolution be presented for the City Council's consideration.

FISCAL IMPACT There is no fiscal impact relating to this resolution at this time.

RECOMMENDATION Staff respectfully recommends that the City Council adopt proposed Resolution No. 014-2017 and staff to forward appropriate correspondence as directed in the proposed resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HAWAIIAN GARDENS, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, SUPPORTING THE ABC UNIFIED SCHOOL DISTRICT IN PROVIDING ALL CHILDREN EQUAL ACCESS TO EDUCATION, REGARDLESS OF IMMIGRATION STATUS AND CITIZENSHIP.

WHEREAS, the City Council of the City of Hawaiian Gardens is interested in the well being of all members of the community and particularly as it pertains to the health, safety and education of children; and

WHEREAS, recently ABC Unified School District ("ABCUSD") President Chris Apodaca, Trustee of Area 7 representing the local schools in Hawaiian Gardens and throughout the District, addressed the community at the Hawaiian Gardens City Council Meeting on February 28,2017, informing families of the ABCUSD's policy that all children have a right to a public and free education regardless of the students immigration status or citizenship; and

WHEREAS, ABCUSD President Apodaca also encouraged families to send their students to school, where they will continue to be provided with a quality education; and

WHEREAS, the ABCUSD, in accordance with the California Department of Education has declared to provide public schools that welcome and provide safe learning places for students, which includes not releasing children to any federal, state, or local enforcement agency, such as U. S. Immigration and Customs Enforcement ("ICE"); unless it is a parent or legal guardian of record; and

WHEREAS, the ABCUSD, in accordance with the law, has the legal right to keep and not release a student until a parent or legal guardian of record, or the ABCUSD has verified a court order or a warrant signed by a judge to be legal; and

WHEREAS, the ABCUSD, in accordance with the law, has had and currently retains the practice, policy, and commitment to provide and contintle providing a public, free, safe and quality learning environment and education for all children, regardless of the students imrnigration status or citizenship; and

WHEREAS, the ABCUSD ("District"), in accordance with the law and pursuant to the practices, policies, and procedures has informed, reminded, and instructed District administration, staff, and teachers, of students rights to attend and remain in school and receive an education, regardless of the students immigration status or citizenship.

WHEREAS, the City Council of the City of Hawaiian Gardens, is in support of the ABCUSD's policy, practices and procedures, and in particular ABCUSD Resolution No. 16-73, recently adopted by the Board on March 7, 2017, relating to providing all children equal access to education, regardless of irnmigration status and citizenship.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF HAWAIIAN GARDENS AS FOLLOWS:

SECTION 1. That the City of Hawaiian Gardens does hereby support the families represented in our local schools and their students, the ABC Unified School District, in its policies, practices and procedures and specifically supports approval of ABCUSD Resolution No. 16-73, to be presented for adoption by the Board on March 21, 2017, and hereby attached as Exhibit "A."

SECTION 2. Be it further resolved, that a copy of this resolution be transmitted to the Superintendent and the Boardmembers of the ABC Unified School District.

SECTION 3. The Mayor or his/her presiding officer is hereby authorized to affix his/her signature to this resolution signifying its passage and adoption by the City Council of the City of Hawaiian Gardens.

SECTION 4. The City Clerk or his/her designee shall attest and shall certify to the adoption of the Resolution and shall cause this Resolution and his/her certification to be entered into the Book of Resolutions of the City of Hawaiian Gardens.

PROVIDING ALL CHILDREN EQUAL ACCESS TO EDUCATION, REGARDLESS OF IMMIGRATION STATUS

WHEREAS: The U.S. Supreme Court has held, in Plyler v. Doe, 457 U.S. 202 (1982), that local school districts have a constitutional mandate to educate all students residing within their jurisdictional boundaries, regardless of their immigration status;

WHEREAS: All students have a right to attend school free of bullying, intimidation, and discrimination;

WHEREAS: The Governing Board is committed to the success of all students irrespective of their immigration status or citizenship, and believes that every school site should be a welcoming place for all students and their families;

WHEREAS: The California Department of Education (CDE) has declared California public schools as welcoming, safe places for learning and teaching for all students, regardless of immigration status, reaffirming federal regulations and state law that prohibit educational agencies from disclosing personally identifiable student information to anyone, including law enforcement, without consent of a parent or guardian, or a court order or lawful subpoena, or in the case of a health emergency;

WHEREAS: The CDE recommends that local educational agencies do not collect or maintain documents that may be related to immigration status including, but not limited to, passports, visas, and social ~ecurity numbers, as they are not needed by school districts, and place student privacy at an unnecessary risk;

WHEREAS: The U.S. Immigration and Customs Enforcement (ICE) 2011 policy states that immigration enforcement activity will not be conducted at any "sensitive" location, which includes schools, without special permission by specific federal law enforcement officials, unless exigent circumstances exist that are related to national security, terrorism, public safety, or where there is imminent risk of the destruction of evidence material to an ongoing criminal case; and

WHEREAS: ICE activities in and around schools and school facilities would be a severe disruption to the learning environment and educational setting for students;

NOW, THEREFORE, BE IT RESOLVED: The Governing Board reaffirms that pursuant to federal and state law, every stUdent has the right to attend school regardless of the child's immigration status;

BE IT FURTHER RESOLVED: That the Governing Board confirms that all District students who are eligible to receive school services, including free or reduced price lunch and breakfast, transportation, and educational services, regardless of their immigration status, are entitled to receive those school services, and that staff shall not take any steps that would deny students access to education or the services provided based on their immigration status;

BE IT FURTHER RESOLVED: In order to provide a public education, regardless of a child's or family's immigration status, absent any applicable federal, state, local law or regulation, local ordinance, or court decision that may lawfully provide otherwise, the District shall act consistent with the following practices:

1. District personnel shall not treat students differently for residency determination purposes on the basis of their actual or perceived immigration status and shall treat all students equitably in the receipt of all school services for which they are eligible.

2. District personnel shall not inquire about a student's immigration status or require documentation of a student's legal status, such as asking for a visa or passport, during enrollment or at any other time.

3. District personnel shall review the list of documents that are currently used to establish residency and shall ensure that any required documents would not unlawfully bar or discourage a student who is undocumented or whose parents are undocumented from enrolling in or attending school.

4. District personnel shall neither require students to apply for Social Security numbers nor require students to provide a Social Security number, passport or visa.

5. District personnel shall not to allow any immigration enforcement officer or agent to enter a school site without first signing in with the school administration and making a request to enter campus, and shall forward any request by immigration enforcement agents to enter a school site (including for the services of lawful subpoenas, petitions, complaints, warrants, etc.) to the Superintendent's office for review, in consultation with District legal counsel.

6. District personnel, when encountering immigration enforcement agents who are 01'1 school grounds on account of urgent or "exigent" circumstances, shall direct them to the school office and alert an administrator to contact the Superintendent's office and legal counsel.

7. District personnel shall immediately send all requests by immigration enforcement agents for information or documents to the Superintendent, who in consultation with District legal counsel, shall consider all legally permissible actions that may be taken to respond to such requests to protect the privacy rights of students and their families.

8. District personnel shall not enter into any agreement with ICE to enforce federal immigration law, and shall not participate in any ICE or Border Patrol enforcement actions.

9. District personnel, as designated by the Superintendent, along with District legal counsel, shall review the impact of any changes in federal immigration laws, state laws, and policies or programs that may impact students, and develop solutions aimed at preventing

and/or mitigating the impact on both students and employees that may arise from the collection of, storage of, or access to any personally identifiable information for immigration enforcement purposes.

10. District personnel shall take all reasonable measures so that after-school program providers and other service providers that have access to student or family information will also follow the actions described herein.

BE IT FURTHER RESOLVED: That the Superintendent shall ensure that all teachers, school administrators and school and District office staff will be adequately trained on how to implement this Resolution;

SUMMARY The Southeast Los Angeles County (SELACO) WIB Board of directors approved funding recommendations for the Earn and Learn Work Experience Program. This program provides work experience for youth of our community. The Board approved program funding to be dedicated to the City of Hawaiian Gardens for the Spring Phase.

SPRING PHASE: • The program period is from March 1, 2017 and June 30, 2017. • The target population will meet the characteristics matrix set by the county as follows:

o Cal Work slots: 8! Low Income Slots: 17 • The program is only available to Hawaiian Gardens residents, who qualify under one of the

two eligibility categories: o Cal Works: Ages 16-18 and if 19 must be in CalLEARN Program o Non-CaIWORKs Youth (Low Income) ages 14-24

• Participants must be citizens of the United States; • All participants will receive a minimum of 100 hours of work experience and 20 hours of

personal enrichment training; • Participants will be paid $10.50 per hour.

FISCAL IMPACT The program inciudes funding to support the participant wages, training materials and the administration of the program.

1. CONDUCT BUDGET WORKSHOP.

COUNCIL ACTION: City Council direction.

Ernie Hernandez, City Manager, provided a brief summary of the budget workshop. He stated that this was basically a third quarter fund review to update the budget. City Manager Hernandez stated that the budget information presented today would let the City Council know where the City was currently, and where the City would finish financially. He stated that the Department requests are at a bare minimum and that only items requiring immediate attention have been included and the others would be addressed at the next fiscal year's budget cycle. He stated that overall all the Department Heads have done a really good job for the City. City Manager Hernandez stated that the City Council should think of the budget as their plan for the City and the meeting today would focus on the general fund. He highlighted that the State was proposing decreases that may affect tax revenue and there were increases to the Card

Club, as original estimates were very conservative. City Manager Hernandez state.d67 that in the future, changes will be presented to the City Council in approximately six month intervals to keep the budget and the City Council updated.

City Manager Hernandez continued by presenting an over view of the budget with a power point presentation on the following:

1. 15-17 Fund Balances 2. 15-17 Revenue Review 3. 15-17 Expenditure Review 4. 15-17 Capital Improvement Projects 5. FY2016-17 Proposed Amendments 6. Projected Ending Unassigned Fund Balance 7. Future Fiscal Issues

During the budget presentation, it was discussed that staff would prepare a schedule of deadlines for the processing of the proposed 24 Hour Fitness. Also, a timeline of Capital Improvement Projects (CIPs) would be prepared.

City Manager Hernandez briefly discussed the following: options for City Council offices, increase use of the City's Public Safety Center, build a better working relationship with the Los Angeles County Sheriff's Department, and further future discussions on various City programs.

The following items to be discussed at a later date included the Hawaiian Gardens Casino temporary reserve, CaIPERs, Sheriff's liability insurance increase from .5% to 10%, future labor negotiations of MOUs, and Health Insurance Costs. The City Council also wanted to discuss Business Revitalization Program, upcoming Homeless Proposition, and the use of the former MAOF Norwalk Boulevard facility, at a future date. Other items to be considered include: the YAL. Program, the Y.M.CA Program, the contract with the P.R. Firm, Englander, Knabe and Allen, to include termination clauses and a breakdown of all contract services and the Fedde Sports Complex.

City Manager Hernandez stated that in the future, Special Events and programs would be itemized with actual totals per program which will include all cost, such Public Works staff, Sheriff's Department personnel, contractors/vendors, City staff and any/all overtime paid. Also, there would be a consideration to include funding for staff development and a review of publicity, and the City's newsletter.

The City Council was interested in a Hawaiian Gardens Chamber of Commerce proposal and Cable TV program, Graffiti removal procedures, participant registration for sports, the City's community garden, mentoring program, and an internship program.

City Manager Hernandez will meet with staff to discuss ATGM program and make any appropriate budget changes.

Pedro Amaro, a Hawaiian Gardens resident and Commissioner, thanked staff for contacting him after the last City Council meeting regarding the problem he had brought regarding the MTA and OCT public buses parking in areas that were not designated as layover areas.

Carolyn Reed, City Librarian, announced the upcoming events at the Library.

ORAL PRESENTATION AND UPDATE BY ABC UNIFIED SCHOOL DISTRICT (ABCUSD) TRUSTEE AND PRESIDENT CHRIS APODACA.

Chris Apodaca, ABCUSD President and Area 7 Trustee, reported that the ABCUSD had received phone calls from parents regarding concerns with immigration and customs enforcement. He stated that it had been a long standing policy at ABCUSD to not release any student to anyone who was not the parent or legal guardian, without a verified warrant or a court order signed by a judge. He stated that at the March 21 sl

ABCUSD meeting that he would be proposing a resolution to his colleagues on the Board, and he would also like the City Council's support to remind the public, as well as educators, what the policy was when -it comes to releasing any student to any government agency. He continued that several parents are keeping their children from school. He encouraged the parents to send their children to- school, as it is the safest place they could be.

President Apodaca stated that Congresswoman Linda Sanchez was holding a "Know You Rights" event on Wednesday, March 1, at the Norwalk Arts and Sports Complex. He interpreted the same information in Spanish.

President Apodaca also reported that he recently visited Sacramento and announced that Haskell Middle School has been designated as a "School to Watch," which means they have been recognized at a national level for which the District is very proud.

Mr. Apodaca invited and encouraged the community to attend a Study Session on March 7, as the District has received $3.3 million dollars and must make budgetary decisions for the funds.

Mr. Apodaca also clarified and briefly discussed the dissolution of the Rap, not the Southeast Academy. He stated that the SEROP can save the District between $2-3 million dolalrs, while retaining teachers, increasing their wages, providing benefits, including them in the local Union and have a Licensed Vocational Nurse ("LVN") program, for example.

He also reported that the District will revamp its lunch policy to include that no student be denied receiving a lunch.

Council member Rodriguez also asked about the Mathobotix Program that would cost $20,000. Director Hollinsworth responded that the funding was allocated, but the program was never implemented.

Mayor Pro Tem Bruce requested that the Mathobotix Program be eliminated from the budget, and made a motion to amend the resolution.

After discussion, it was moved by Mayor Pro Tem Bruce to amend Resolution No. 012-2017, by eliminating the Mathobotix Program from the budget, seconded by Mayor Trimble. A roll call vote was conducted.

1. A REQUEST FROM COUNCILMEMBER MARAVILLA TO DISCUSS THE CITY COMMISSIONS: PLANNING COMMISSION, PARKS AND RECREATION

Ernie Hernandez, City Manager, presented a power point of the structure of the Commissions.

Councilmember Maravilla asked for some clarification regarding the Commission terms, as the hand book stated a four (4) year term or an unexpired term.

Sue Underwood, City Clerk, explained that an unexpired term meant, if someone resigned from the Commission before the term expired. She continued that it was very difficult to find people who wanted to be a part of a Commission, and that there have been openings on Commissions in the past that would be vacant for several years before someone applied.

Councilmember Maravilla stated that she would like to see opportunities given to more residents, as some Commissioners had been on a Commission for several years. She requested that a change be made so that every Councilmember would have the opportunity to appoint someone to the Commissions.

Mayor Trimble asked if it was correct that it was the consensus of the entire City Council to appoint people to the Commissions. City Clerk Underwood responded that that was correct.

Councilmember Rodriguez stated that if each Councilmember appointed P. 76 Commissioners, then each person appointed would be a friend of each Councilmember.

City Clerk Underwood explained the current process for appointments to Commissions. She responded that when the Commissioners' terms were about to expire, that she would announce it at the City Council meeting that there would be an opening, and also put the information in the City Newsletter, City Marquee, and website. She stated that she requested letters of interest be sent to the City Clerk, which she would give to the Mayor and a member of the City Council. She also would set up interviews with the Mayor, and then the names would be presented to the City Council.

It was moved by Mayor Trimble, seconded by Councilmember Maravilla and approved by unanimous voice vote to receive and file this agenda item.

2. A REQUEST FROM COUNCILMEMBER RIOS FOR AN UPDATE ON PUBLIC SAFETY AT LEE WARE PARK. (This Agenda Item was continued from the February 14, 2017 meeting).

COUNCIL ACTION: Council directive.

Linda Suniga, Administrative Analyst, presented the staff report stating that the Sheriff's Deputies have indicated that there was less graffiti at the park. She also reported that all the fences had been repaired and the lighting was in working order. She also stated that the Sheriff's Deputies patrolling that the area reported that it had been very quiet in the area. She continued-that the Capital Improvement Project Committee had toured the park and made recommendations to upgrade the park, which included installing a patio cover, improving lighting, and adding security cameras. She stated that funding for these recommendations was approved in the budget amendment.

Mayor Trimble asked Joe Colombo, Community Development Director, if the shade structure was ready to be installed.

Director Colombo responded if it was the desire of the City Council, then he would get an estimate for the structure, and that the major cost would be for the shade structure and security cameras.

Council member Rios asked for the picture of the shade structure to be placed on the website for the residents to view, so the residents would be able to give input on the improvements.

It was moved by Mayor Trimble, seconded by Councilmember Maravilla and approved by unanimous voice vote to receive and file this agenda item.

3. DISCUSSION REGARDING CALIFORNIA SENATE BILL 415 "VOTER PARTICIPATION" AND COUNCIL DIRECTION FOR TRANSITIONING TO A STATEWIDE ELECTION DATE.

Noel Tapia, Deputy City Attorney, presented the staff- report stating that it was a State Law that the elections needed to be changed to even years to coincide with State elections, and implemented by January 2020. He continued that the City Clerk's Office had conducted an analysis on the even years June elections and the November elections and concluded that the greater voter turnout was in November of even years. The City Clerk's Office also concluded that the City would need to change to the even year's elections due to the fewer than 25% voter turnout from City elections in odd numbered years. He requested that the City Council direct staff on when to implement the changes.

It was moved by Mayor Trimble, seconded by Mayor Pro Tem Bruce and approved by voice vote to direct staff to provide an Ordinance for first reading at the next City Council meeting to change the City election date from November 2017 to November 2018, and move the November 2019 election to November 2020 to synchronize the City elections Statewide election. A roll call vote was taken.

Director Colombo responded that the City does contract with John Hunter and Associates and they would be able to present the information to the City Council at a

later date.

SUMMARY Requested by Councilmember Rios and approved by the City Council, Resolution 069-2016 was approved at the Regular City Council meeting of October 11, 2016. Said Resolution added a bucjget amount of $30,000 to be available for Hawaiian Garden school donations. Start-coordinated with Dr. Sieu, Superintendent ABC Unified School District and received input from the different designated schools on how they would utilize their funds. The designated schools are Aloha, Furgeson, Hawaiian, Melboume, Fedde and Artesia High School. Based on her input the following is a recap of how City funds will be utilized and the amounts provided to each school:

• Aloha - Attendance Incentives - $2,000

• Artesia High School - Attendance Incentives - $5,000

• Fedde - Attendance Incentives - $5,000

• Furgeson - Science Camp - $5,000

• Hawaiian - Science Camp - $5,000

• Melboume - Attendance Incentives - $5,000

The programs are intended to encourage students to have perfect attendance and/or to help offset costs associated with putting together the Science Camp program. In addition to the above school donations, a donation to the Hawaiian Gardens Library in the amount of $3,000 for Library Week activities in April 2017 is included as the library serves students attending the various schools serving City residents;

FISCAL IMPACT The FY2015-17 Approved Budget includes funds of $30,000 for this purpose.

RECOMMENDATION Direct staff to donate to the identified schools and library as provided in the staff report.

Based on the options presented below staff is requesting authorization to proceed with the preparation of plans, specifications and contract documents for installation of skate ramps and other improvements in Clarkdale Park as directed by the City Council.

DISCUSSION

On November 17, 2016, this item was presented to the City Council for direction. It was referred back to the CIP Committee to meet with representatives of the Parks & Recreation Committee and skateboarder representatives to consider reduced scope and lower cost options. This CIP Committee meeting was held on January 23,2017. No skateboarder representatives showed up to the meeting. The members present gave staff direction to bring back the options presented here.

Option A - Basic Skate Park is a basic replacement of the same existing skate park elements with upgraded materials that are more durable and with more noise reduction capabilities. The total estimated cost based on the tabulation below is $290,719. Cost savings of $102,281 below existing budget of $393,000.

Option B - Concrete Skate Park is with all elements to be concrete. The total estimated cost based on the tabulation below is $472,600. Exceeds available budget of $393,000 by $79,600.

Option C - Hybrid Skate Park is a hybrid of modular upgrades with additional elements and 25% of the elements to be concrete. The total estimated cost based on the tabulation below is $578,240. Exceeds available budget of $393,000 by $185,240.

Staff contacted a vendor that provides these elements and received the preliminary design and cost estimates.

Any final costs and designs would be brought back to the City Council prior to authorizing construction.

The Special Joint meetings of the City Council of the City of Hawaiian Gardens and the Successor Agency RDA were called to order by Mayor/Chairmember Trimble on Tuesday, February 21,2017, at 5:10 p.m. in the Public Safety Center, 11940 Carson Street Hawaiian Gardens, California.

1. CONDUCT BUDGET WORKSHOP.

COUNCIL ACTION: City Council direction.

Ernie Hernandez, City Manager, provided a brief summary of the budget workshop. He stated that this was basically a third quarter fund review to update the budget. City Manager Hernandez stated that the budget information presented today would let the City Council know where the City was currently, and where the City would finish financially. He stated that the Department requests are at a bare minimum and that only items requiring immediate attention have been included and the others would be addressed at the next fiscal year's budget cycle. He stated that overall all the Department Heads have done a really good job for the City. City Manager Hernandez stated that the City Council should think of the budget as their plan for the City and the meeting today would focus on the general fund. He highlighted that the State was proposing decreases that may affect tax revenue and there were increases to the Card

Club, as original estimates were very conservative. City Manager Hernandez stalp.d88 that in the future, changes will be presented to the City Council in approximatly six month intervals to keep the budget and the City Council updated.

City Manager Hernandez continued by presenting an over view of the budget with a power point presentation on the following:

1. 15-17 Fund Balances 2. 15-17 Revenue Review 3. 15-17 Expenditure Review 4. 15-17 Capital Improvement Projects 5. FY2016-17 Proposed Amendments 6. Projected Ending Unassigned Fund Balance 7. Future Fiscal Issues

During the budget presentation, it was discussed that staff would prepare a schedule of deadlines for the processing of the proposed 24 Hour Fitness. Also, a timeline of Capital Improvement Projects (CIPs) would be prepared.

City Manager Hernandez briefly discussed the following: options for City Council offices, increase use of the City's Public Safety Center, build a better working relationship with the Los Angeles County Sheriff's Department, and further future discussions on various City programs.

The following items to be discussed at a later date included the Hawaiian Gardens Casino temporary reserve, CaIPERs, Sheriff's liability insurance increase from .5% to 10%, future labor negotiations of MOUs, and Health Insurance Costs. "fhe City Council also wanted to discuss Business Revitalization Program, upcoming Homeless Proposition, and the use of the former MAOF Norwalk Boulevard facility, at a future date. Other items to be considered include: the YAL. Program, the Y.M.C.A. Program, the contract with the P.R. Firm, Englander, Knabe and Allen, to include termination clauses and a breakdown of all contract services and the Fedde Sports Complex.

City Manager Hernandez stated that in the future, Special Events and programs would be itemized with actual totals per program which will include all cost, such Public Works staff, Sheriff's Department personnel, contractors/vendors, City staff and any/all overtime paid. Also, there would be a consideration to include funding for staff development and a review of publicity, and the City's newsletter.

The City Council was interested in a Hawaiian Gardens Chamber of Commerce proposal and Cable TV program, Graffiti removal procedures, participant registration for sports, the City's community garden, mentoring program, internship program.

City Manager will meet with staff to discuss ATGM program and make any appropriate budget changes.

AGENCY ACTION: Waive further reading and adopt Resolution No. 2017-002. P. 91

Joe Colombo, Community Development Director, requested that this agenda item be continued to the Tuesday, May 23,2017 meeting.

It was moved by Chairmember Trimble, seconded by Vice Chairmember Bruce and approved by voice vote to continue the Public Hearing until Tuesday, May 23, 2017.

Motion carried 5-0.

Deputy City Attorney, Noel Tapia reported that all five Directors were present during the Closed Session. He continued that staff had given a presentation, and City staff was given directions by the City Council, but that there was no reportable action taken on 1a, and no reportable action taken on 1 b.

Chairmember Trimble adjourned the meeting at 6:07 p.m. to the next Meeting to be held on Tuesday, February 28,2017 at 6:00_p.m.
