Petition to Ban “Circus Pages” from performing at the Delaware County Fairgrounds
As a child, I am sure most, if not many of you attended the Circus. It was exciting,
thrilling, and amazing. Unfortunately, what we enjoyed watching as children has been
exposed to be animal cruelty, neglect, and abuse. The circus that is scheduled to come
to Delaware in a few short weeks, "Circus Pages", has been cited numerous times for
the poor treatment of the animals in their show. Why, as a community, would we want to
support such ill treatment of animals? The reality is, as kids...we did not "know better".
Well...now WE DO. Once you know better, it is only ethical to DO BETTER. Please sign
this petition to request Delaware County Commissioners and the Delaware County Fair
Board cancel the contract with Circus Pages, as well as Delaware City Council to not
provide the permit required. We asked that these three entities ban any circus from
coming into the county or the city of Delaware

BACKGROUND: The City of Delaware sent out to qualified firms a request for qualifications and received three qualification statements. From the three, one firm withdrew due to anticipated new business. A committee comprised of Chief John Donahue, Scott Stowers, Sean Hughes, Dave Efland, Jerry Warner and Jackie Walker the remaining two firms and ranked them according to1) Experience with similar projects of size and nature 2) Approach to the project 3) Key Staff dedicated to this project as well as the total number of staff employed with the successful firm and 4) Timeline Completion. The highest ranked firm was determined to be Triad.
At the completion of the project, Triad will include in their deliverables:
Construction drawings for all buildings, including a phasing plan and associated construction costs taking all local, state and federal laws into consideration due to the City of Delaware no more than 90 calendar days after execution of the agreement.
The successful firm will have access to the facilities and staff as needed to complete the project.
In order to accomplish these tasks, Triad will include several professionally accepted tasks to include but not limited to: conduct a kick off meeting, meetings with stakeholders (staff), and a review by mechanical and structural engineer. The total project is expected to take 90 days from the date of execution of the contract. REASON WHY LEGISLATION IS NEEDED: This legislation is needed in order to execute a contract with the successful firm. ORDINANCE NO. 16-25 AN ORDINANCE SUPPLEMENTING THE 2016
APPROPRIATIONS ORDINANCE TO PROVIDE FUNDING FOR CONCEPT DRAWINGS AND CONSTRUCTION ESTIMATES FOR THREE CITY FACILITIES, AND DECLARING AN EMERGENCY.
WHEREAS, the City of Delaware is charged to provide safe facilities for
the citizens and employees of Delaware, and WHEREAS, a protective purchase of 18 East William Street was made in
2013, and the Engineering Department was relocated from 20 East William Street to 440 East William Street in late 2015,
WHEREAS, City Council has expressed interest in the development of an
entrepreneurial center; WHEREAS, City staff wishes to provide City Council with complete
information and recommendations regarding the use and the associated renovation costs of the facilities as well as the second floor of City Hall;
WHEREAS, City staff believes that contracting with an outside
professional design firm is the best option to achieve these goals; WHEREAS, the cost to complete the study as proposed is $25,000, and WHEREAS, a supplemental appropriation to the 2016 budget will be
necessary to complete the project.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DELAWARE, OHIO THAT: SECTION 1. That there is hereby appropriated from the unencumbered balance of the Capital Improvement Fund $25,000 increasing the following account:

BACKGROUND: Under Section 737.01 of the Delaware Codified Ordinances, a circus may not operate within the City without a license authorized by Council. Approval is to be granted unless it appears that the Circus will in any way endanger or threaten the public peace, property, health, safety, or welfare of the City. Once permission is granted by Council, the circus must provide a license fee, a bond certifying that the circus will remedy any and all damages and will clean up any refuse, litter, debris or dirt, proof of sufficient liability insurance. A request has not been formally submitted by the Circus. The issue arose because it came to the City’s attention on 3/24/16 that the Circus is scheduled to come to Delaware on Wednesday. Per a representative of the circus, the circus was unaware that it needed a permit. To date, the City has not received any of the remaining required documentation (bond, insurance). REASON WHY LEGISLATION IS NEEDED: The Circus cannot operate without a permit from the City. The Circus indicated that it has a show scheduled for Wednesday and that it did not know it needed a permit. Based on City Manager Homan’s conversation with the circus, staff agreed to place this on the agenda for Council consideration.

WHEREAS, the Circus Pages has scheduled a circus to be held on March
30, 2016 at the Delaware County Fairgrounds in the City of Delaware, and
WHEREAS, Section 737.01 of the Codified Ordinances of the City of Delaware require that any operator of a circus secure the permission of Council, and,
WHEREAS, Circus Pages has demonstrated the ability to meet or has met all of the bond and insurance requirements of Section 737.01 of the Delaware City Code.
