• Payment for fence acceptable completed and measured as provided above will be made at the contract unit price per linear foot for “6’ High Ornamental Steel Fence” or “4’ High Ornamental Steel Fence”, as the case may be, which price shall be full compensation for all materials, including fences, post, gates & concrete, for all equipment, labor, tools and incidentals required to complete the work. By Submission of bid, bidder certifies that he has read all terms and conditions and that bid is submitted in accordance therewith.

1. Prices quoted will be considered to be net prices unless otherwise stated by the bidder. Cash discounts requiring payments

in less than 30 days will not be considered in making awards.

2. Prices quoted shall be FOB Conway unless otherwise specifically stated on proposal. In either case, delivery charges must

be prepaid.

3. All charges including taxes, shipping, freight, and any miscellaneous taxes shall be included in prices quoted, if applicable.

4. Bidder certifies that he will make delivery of items for which he bids within 10 days after receipt of award – unless

otherwise specifically stated. Time of delivery in excess of 10 days may be considered a factor in making awards.

5. In case of default of contractor in making deliveries as per contract, the City may procure the articles or services from other

sources and hold the contractor responsible for all excess costs occasioned thereby. Bidder’s record as to satisfactory

performance under previous contracts will be considered a factor in making awards and retention on bid lists.

6. The City reserves the right to reject any or all bids, in part or in whole and to waive information in bids received.

7. If not otherwise specified, bidder must furnish brand names with catalog number, if any, on items which are offered as

“equal.” In all such cases the burden of establishing equality is upon the bidder and failure to do so within a reasonable

time may result in rejection. Alternative bids will not be considered unless no other type bid for the item is received.

8. In the case of equal or tie bids, preference will be given to Arkansas bidders. Other than as stated in the first sentence,

awards on tie bids will be made at the discretion of the purchasing official. In such cases, “splitting” will be avoided and

awards of previous contract(s) to one or more of the bidders will not be a factor.

9. In the event that bidder is unable to furnish all of an item, bids on portions thereof may be considered.

10. Final inspections and acceptance or rejection will be made after delivery. Items rejected because of non-conformance shall

be removed and replaced immediately with those which meet specifications, all at the expense of the contractor. In the

event that necessity requires the use of non-conforming items, payment therefore will be made at a proper reduction in

price which shall be not greater than contractor’s actual cost by purchase, fabrication, manufacture or other production

method plus transportation paid to carriers. All costs in connection with testing items that do not meet specifications shall

be paid by contractor.

11. Quality, time of performance, probability of performance, and location of bidder will be factors in awards of all contracts.

12. The City reserves the right to purchase any, all or none of the items listed, in combinations thereof that may be in the best

interest of the City of Conway.

13. The City reserves the right to change any specifications, terms and/or conditions at any time, with adequate notice in

writing to bid invitees of those changes, if any.

14. The City is qualified for “GSA” pricing schedules, if available and applicable.

15. The City reserves the right to waive any informalities or minor defects, but this shall not be construed to indicate waiver of

any specification, term and/or condition unless in the best interest of the City in the judgment of the City.

16. CONSTRUCTION/INSTALLATION: Any construction work that is worth $20,000 or more must comply with Arkansas Code

Annotated § 22-9-204.

17. Arkansas Prevailing Wage Law A.C.A. §22-9-301 through 3-15: The City of Conway, general contractors or any

subcontractors is subject to the Arkansas Prevailing Wage Law, A.C.A. §22-9-301 through 3-15. The Labor Standards

Division enforces laws related to prevailing wage (PDF). Arkansas’s prevailing wage law is commonly referred to as the "little

Davis-Bacon Act." The law requires the division to issue a wage determination for each public works project where the cost

of all labor and materials exceeds $75,000. Exemptions are public school construction; work done for or by any drainage,

improvement, or levee district; highway, road, street or bridge construction and maintenance, or related work contracted for

CITY OF CONWAY, ARKANSAS ORNAMENTAL STEEL FENCE CONSTRUCTION NINA RUSS LANE & NORTH LINE OF MEADOWS CORPORATE CE NTER

SPECIFICATION for

Steel Ornamental Fence System

PART 1 - GENERAL 1.01 WORK INCLUDED The contractor shall provide all labor, materials and appurtenances necessary for installation of the welded ornamental steel fence system defined herein at the location specified on the attached plans or as directed by the City Engineer. The work is generally located along each side of Nina Russ Lane and along the northern boundary of the Meadows Corporate Center in Conway, Arkansas. The fence along the eastern side of Nina Russ Lane shall be a 6’ high fence with two double 10’ gates where shown on the plan or established in the field by the City Engineer. The fence along the west side of Nina Russ Lane and along the northern boundary of the Meadows Corporate Center shall be a 4’ high fence with two double 10’ gates located along Nina Russ Lane where shown on the plan or established in the field by the City Engineer. 1.02 BID BOND The bidder shall include a Bid Bond in the amount of 5% of his bid as surety that he will enter into a contract for the bid amount. If the Bidder is awarded the project work, but fails or refuses to execute the contract and furnish the required Performance and Payment bond within the prescribed ten (10) days of the notification of award, then this bid security is to become the property of the Owner as liquidated damages for the delay and additional expense to the Owner caused by such failure or refusal. 1.03 PERFORMANCE BOND Subsequent to the award and within ten days after the Notice of Award, the successful Bidder shall execute and deliver to the Owner four signed Agreements in the form included in the Project Specifications. Having satisfied all conditions of award as set forth elsewhere in these Documents, the successful Bidder shall, within the period specified above, furnish a surety bond in a penal sum not less than the amount of the Contract as awarded, as security for the faithful performance of the Contract, and for the payment of all persons, firms or corporations to who the Contractor may become legally indebted for labor, materials, tools, equipment, or services of any nature, including utility and transportation services employed or used by him in performing the work. Such bond shall be as included in the Contract Documents and shall bear the same date as, or a date subsequent to, that of the Agreement. The current power of attorney for the person who signs for any surety company shall be attached to such bond. The failure of the successful Bidder to execute such Agreement and to supply the required bond or bonds within ten (10) days after the prescribed forms are presented for signature, or within such extended period as the Owner may grant, based upon reasons determined sufficient by the Owner, shall constitute a default, and the Owner may either award the Contract to the next lowest responsible Bidder or readvertise for bids. 1.04 SITE WORK The contractor shall all the work necessary for the installation of the fencing. This work includes the following generally site work:

• Provided the construction layout for the fence based on plat and survey information provided by the owner. The referenced right of way line and boundary line shall be established by an Arkansas Registered Land Surveyor.

• The contractor shall provide all clearing and proper disposal of material removed by any clearing or shaping. The contractor shall avoid unnecessarily damaging trees located on property owned by Stanley Russ on each side of Nina Russ Lane and north of the Meadows Corporate Center.

• The contractor shall provide all earthwork and grading required for the proper installation of the fence. The area disturbed by construction shall be shaped and graded to a smooth uniform surface free of rocks, humps, holes and depressions and suitable for usual mowing with residential lawn mowing equipment.

• The contractor shall provide the necessary construction access to the fence construction location. The access may be across the private land owner by Conway Development Corporation between Ledgelawn Drive and the North boundary of the Meadows Corporate Center where necessary. At location along Nina Russ Drive the Access shall be from Nina Russ Drive and any use of the private property owned by Stanley Russ located beyond the limits of Nina Russ Drive shall be by permission only.

C. The manufactured panels and posts shall be subjected to an inline electrode position coating (E-Coat) process consisting of a multi-stage pretreatment/wash (with zinc phosphate), followed by a duplex application of an epoxy primer and an acrylic topcoat. The minimum cumulative coating thickness of epoxy and acrylic shall be 2 mils (0.058 mm). The color shall be Black. The coated panels and posts shall be capable of meeting the performance requirements for each quality characteristic shown in Table 2 (Note: The requirements in Table 2 meet or exceed the coating performance criteria of ASTM F2408). Any damage to the coating system during installation shall be repaired in accordance with manufactures specifications. D. The manufactured fence system shall be capable of meeting the vertical load, horizontal load, and infill performance requirements for Industrial weight fences under ASTM F2408. E. Gates shall be fabricated using fusion welded ornamental panel material and 1-3/4” sq. x 14ga. gate ends. All rail and upright intersections shall be joined by welding. All picket and rail intersections shall also be joined by welding. PART 3 - EXECUTION 3.01 PREPARATION All construction staking shall be by the contractor in accordance with the construction plans. 3.02 INSTALLATION Fence post shall be spaced according to Table 3, plus or minus ½”. For installations that must be raked to follow sloping grades, the post spacing dimension must be measured along the grade. Fence panels shall be attached to posts with brackets supplied by the manufacturer. Posts shall be set in concrete footers having a minimum diameter of 6” and a minimum depth of 36”. The Concrete shall be ready mix concrete conforming to AHTD “Class A” concrete mix design. Posts setting by other methods such as plated posts or grouted core-drilled footers are permissible only if shown by engineering analysis to be sufficient in strength for the intended application. 3.03 FENCE INSTALLATION MAINTENANCE When cutting/drilling rails or posts adhere to the following steps to seal the exposed steel surfaces; 1) Remove all metal shavings from cut area. 2) Apply zinc-rich primer to thoroughly cover cut edge and/or drilled hole; let dry. 3) Apply 2 coats of custom finish paint matching fence color. Failure to seal exposed surfaces per steps 1-3 above will negate warranty. Manufacture recommended spray cans or paint pens shall be used to prime and finish exposed surfaces; it is recommended that paint pens be used to prevent overspray. 3.04 GATE INSTALLATION Gate posts shall be spaced according to the manufacturers’ gate drawings, dependent on standard out-to-out gate leaf dimensions and gate hardware selected. Type and quantity of gate hinges shall be based on the application; weight, height, and number of gate cycles. The manufacturers’ gate drawings shall identify the necessary gate hardware required for the application. Gate hardware shall be provided by the manufacture of the gate and shall be installed per manufacturer’s recommendations. 3.05 CLEANING The contractor shall clean the jobsite of excess materials; post-hole excavations shall be scattered uniformly away from posts.
