Pursuant to call and notice the Montrose City Council met in regular session on Monday, May 8, 2017 at 7:00 p.m. Those present were Mayor Michelle Otto, Council Members, Jill Menard, Melissa Gudvangen, Lloyd Johnson and Ben Kuehl. Also present were Pat Sweeney, City Attorney, Margaret McCallum, Sean Diercks, Public Works Director, and Wendy Manson, Deputy Clerk and City Engineer, Justin Kannas. Absent: None.

An open forum request was received and asked to address the Wright County Sheriff’s Office contract and Payment Service Networks charges.


Otto added to the consent agenda (Accounts Payable) and invoice for Varner Mobile. Councilmember Kuehl moved to approve the agenda with the changes. Gudvangen seconded. Motion passed 5-0.

Councilmember Kuehl moved to approve the consent agenda. Gudvangen seconded. Motion Passed 5-0.

7. WRIGHT COUNTY SHERIFF’S DEPARTMENT

A. April Monthly Report

A copy of the Sheriff’s report for the month of April was made available. B. 2016 Yearly Report

Sheriff Joe Hagerty presented a report of the 2016 year of the City of Montrose.

C. Increasing Hours Proposal Sheriff Hagerty and Captain Dan Anselment presented information and proposed increasing the contract hours for the City of Montrose. The Council asked staff to review the current budget for the Wright County Sheriff’s Office and to research information on what it would cost for the City to create its own Police Department. A workshop was scheduled for June 21, 2017 at 4:30 p.m. to review the information. Hagerty informed of a June 9, 2017 Open House for the Wright County Sheriff’s Office from 10:00 a.m. – 1:00 p.m.

8. REPORTS & RECOMMENDATIONS OF CITY DEPARTMENT, CONSULTANTS,

COMMISSIONS, AND COMMITTEES A. City Council Monthly Activity Report

Each City Councilmember provided updates with regards to meetings, events, etc. that each attended since the last regular meeting.

B. Fire Department

1. April 2017 Activity Report The report was available to the Council. Triplett thanked the House of Grace Church for providing dinner to the firefighters on April 18, 2017.

2. 2017 Annual Report

Triplett provided a review of the 2016 Annual Report to the Council.

3. Reinstatement of Jeff Daniels after 6 month leave of absence. (LOA 11-2-16 to 5-2-17) Kuehl moved for the reinstatement of Jeff Daniels after 6 months Leave of Absence. Johnson Seconded. Motion passed 5-0.

C. Park and Recreation

1. May 1, 2017 Park and Recreation Commission meeting minutes The Park and Recreation Commission thanked all those who helped with the Easter Egg Hunt. Otto moved to approve Matt Russell as a new member of the Park and Recreation Commission. Johnson Seconded. Motion passed 5-0.

D. WCAT 1. April WCAT meeting update

Manson provided an update on the April 18, 2017 WCAT meeting that she attended.

E. Planning and Zoning 1. April 19, 2017 Planning and Zoning Meeting Minutes The minutes were made available to the Council for their review. 2. Casey’s General Store Renderings Revisions

The Council was presented a request from Casey’s General Store (175 Nelson Boulevard) to change the look of their proposed building by eliminating the current blonde EIFS and adding brick in its place. In addition, a cultured stone would be added and a red façade would be added to the upper center portion of the store to the fuel canopy. Kuehl moved to accept the revised changes for the new Casey’s General Store to be located at 175 Nelson Boulevard.

F. Engineering 1. TH 25 Project with MnDOT – Resolution 2017-13

Kannas stated that at the March 13, 2017 Council meeting, the Council authorized the preparation of plans and specifications proceeding with right of way and easement acquisitions and with MnDOT on the preparation of a draft Cooperative Agreement for the Trunk Highway 25 Improvement Project. He informed that MnDOT requires a formal resolution to be passed that authorizes the preparation of a cooperative agreement between the City and the State. Kannas presented the resolution to the Council. Menard moved to pass Resolution 2017-13 Authorizing an Agreement Project with the Minnesota Department of Transportation for Work on and Adjacent to Trunk Highway 25. Gudvangen Seconded. Motion passed 4-0-1 (Johnson abstained).

G. Personnel Committee 1. May 1, 2017 Personnel Committee Meeting Minutes

Minutes were made available to the Council for their review.

H. Public Works 1. Hiring of Seasonal Employee

Diercks recommended the hiring of Mitchell Menth for the third seasonal public works position. Otto moved to hire Menth for the third seasonal public works position. Menard seconded. Motion passed 5-0.

9. OLD BUSINESS

10. NEW BUSINESS A. Liability Coverage Waiver

Menard moved to approve to sign the liability coverage waiver. Kuehl Seconded. Motion passed 5-0.

B. “Open Book” Meeting Format The Council was presented information on the “Open Book” Meeting option instead of the Local Board of Appeal’s Meeting process. County Assessor Jim Borrett explained that advantages of switching. The Council was in favor of switching over. The Council asked staff to prepare a resolution that would support the change.

11. UPCOMING MEETINGS Planning and Zoning Commission – May 17, 2017 @ 7:00 p.m. Town Hall Meeting – May 22, 2017 @ 7:00 p.m.

12. OPEN FORUM Resident, Bru Ploog, asked about the Payment Service Network Fees with regards to making online payments for utility bills.

Staff explained that the City covers the processing fees to incentivize the use of online payments as it is more efficient. Ploog suggested having the residents pay for the processing fee.

13. ACKNOWLEDGEMENTS Angie Fude for being the photographer for the Egg Hunt Public Works for the cleanup at Veteran’s Park State Bank of Delano, Craft Pattern and Ugly Bar for their help with the School Carnival Fire Department for the use of the station for the Egg Hunt Fire Department for their help with the Beyond the Yellow Ribbon 5K Public Works for their help with the Beyond the Yellow Ribbon 5K Sponsors for the Beyond the Yellow Ribbon Event

PURPOSE

To outline requirements to remain in good standing (PERA PENSION) and to outline attendance benchmarks for discipline as it pertains to call response, training attendance, and special duty activities. The Montrose Fire Department cannot run successfully unless the personnel are properly trained, respond to calls for service when emergency and non-emergency situations arise and to assist with special duty activities sponsored by and/or put on by the Montrose Fire Department or Montrose Firefighters Relief Association (MFRA). Further, through PERA (Public Employees Retirement Association), the manager of the Fire Department pension, requires the city to create percentages that each member must attain to remain in good standing with the fire department and be eligible to receive pension credit for a given year.

POLICY

Yearly Pension Credit (PERA PENSION)

In the event a member does not meet the percentage requirements outlined below for a given year (Jan 1 – Dec 31) he/she will not receive credit for that year through the PERA pension plan

Quarterly percentage review

In the event a member does not meet the percentage requirements for any quarter (JAN-MAR, APR-JUN, JUL-SEP, OCT-DEC) period he/she may be subject to discipline per the Montrose Fire Department Discipline policy (Policy 111).

The following are the percentages a member must attain to remain in good standing with the Montrose Fire Department and are agreed upon by the City of Montrose, Montrose Fire Department, and Montrose Firefighters Relief Association.

Calls for Service (Incident Response) – 30% Trainings – 75%

Additionally, firefighters will be expected to work extra events and special details throughout a given year (MFRA events, fire prevention, public education, etc.). Lack of attendance at special events as compared to peers may result in discipline in accordance with Policy 111 as deemed necessary by Officers of the Montrose Fire Department.

Purpose: The purpose of this policy to outline the minimum requirements for training attendance.

Policy:

1. All active members of the department are required to attend a minimum of 75% of trainings for each year of service.

2. The personnel committee shall examine training attendance every 6 months. a. Members who are marked as unexcused/absent from 3 consecutive regularly scheduled trainings shall be

disciplined per the discipline policy (no-call/no-show) 3. Those members who did not meet the minimum requirements for any given 6 month period may be subject to

discipline per Policy #111 4. Trainings during a leave of absence shall not be included for the purpose of determining the percentage of

trainings attended. 5. Each member is responsible for ensuring their attendance is recorded at trainings. 6. The Fire Chief may reschedule any training when it conflicts with a holiday or other occasion. The Fire Chief

may also schedule additional trainings throughout the year as needed. 7. Members should notify an officer prior to the training if they are unable to attend for any reason.

a. Members who fail to advise an Officer of any absence from a regularly schedule training shall be marked as unexcused/absent from that given training

8. Trainings will normally be held at the Montrose Fire Department at 18:30 hours, unless members are notified of a different start time

9. Training attendance may be excused if work and/or personal issues exist (CONTACT AN OFFICER) proof may be requested by an officer and he/she will determine if the reason for your absence is excused or unexcused and you must notify them prior to the training. Below is a list of examples which may get your excused from a particular training event.

- Work - Family Emergency - Medical Emergency - Planned Vacation (1 per year allowed)

10. If you wish to make up a training or truck maintenance you must be marked as excused on the regular attendance roster for that particular date. People marked as absent shall not be allowed to make up missed trainings/truck maintenance

11. All makeup for a given year must be completed by the end of the calendar year a. Only in house training and maintenance shall be allowed to be made up by individuals b. Other classes/trainings missed may be made up and members may receive credit if the member provides

a certificate of successful completion of a similar course offered elsewhere 12. A make up form must be completed and singed off by an officer to gain credit for a missed event 13. You must show proof of makeup by certificate or by having an officer present while you made up your missed

event(s) 14. Truck Maintenance will be conducted on the first Tuesday of each month starting at 18:30 (unless notified

otherwise)

Purpose: The purpose of this policy to outline the minimum requirements for call response. It is the intention of this policy to ensure the department always maintains a roster that allows for adequate personnel response.

Policy:

1. All active members of the department are required to respond to a minimum of 30% of total calls for each year of service.

2. Response statistics shall be examined by the Personnel Committee quarterly. 3. Those members who did not meet the minimum requirements for the year may be subject to discipline per

Policy 111 4. Members who are struggling to make or keep their response requirements at or above 30% will be notified of

problems found during the personnel committee’s quarterly check. 5. Calls occurred during a leave of absence shall not be included for the purpose of determining the percentage of

calls attended. 6. Standby attendance shall be included as a call response for the purpose of determining the percentage of calls

attended. 7. Each member is responsible for ensuring they get signed in the call sheet for call attendance. 8. Members are encouraged to participate in as many extra duties throughout the year as possible including

Montrose Days, Fireman’s Dance, Calendar handout, fire prevention week, regional meetings/trainings

Minutes

June 5, 2017

Pursuant to call and notice the Park & Recreation Commission met on June 5, 2017 at 5:30pm at Montrose City Hall. Those present were Commission Members Sylvia Henry, Bru Ploog, and Christina Bentfield, Matt Russell, City Council liaison Mayor Otto, Kurt Andersen, Jill Menard, and Public Works Director Sean Diercks.

Call to Order The meeting was called to order at 5:30 p.m. by Commission Chair Ploog.

Approval of June 5, 2017 Meeting Agenda Motion by Henry, second by Bentfield to approve agenda with the addition of Oath of Office for Matt Russell. Motion carried 3-0. Oath of Office Oath of office was conducted for new Commission member Matt Russell. Approval of May 1, 2017 meeting minutes Motion by Henry, second by Ploog to approve minutes as written. Motion carried 4-0. Regional Park The public works director provided an update to the commission regarding the Regional Park grading operations for the project. In addition the commission held a recap discussion of the recent town hall meeting regarding the regional park. The public works director also informed the commission that the City of Montrose was not selected for any DNR grant funding for this year. Summer Splash The commission held further prep discussion regarding the Summer Splash Event in Northridge Park on July 15. 2017 from 3pm to 5pm. Bark in the Park Event The commission held a brief discussion regarding the Bark in the Park Event on October 7, 2017 from 2pm to 4pm. Commission Applicant Kurt Andersen The commission held a discussion regarding commission applicant Kurt Andersen. Motion by Henry to recommend approval to the City Council to appoint Kurt Andersen to the Park and Rec. Commission, second by Bentfield. Motion carried 4-0. Forrest Creek Park The commission heard a presentation by Jill Menard which was representing the residents of Forrest Creek sub division regarding any potential development of Forrest Creek Park. The commission then discussed the potential development of the park.

July Park and Rec Commission meeting date: The commission discussed changing the meeting date in July from Monday, July 3rd to Thursday, July 6th. Pursuant to call and notice, the Montrose Planning and Zoning Commission met in regular session on Wednesday, May 17, 2017. Those present were Commissioners Sylvia Henry, Catherine Neiberger, Kurt Andersen, and Tracy Gurneau. Also present were Council Liaison Lloyd Johnson, City Clerk/Treasurer Margaret McCallum, and City Planner Mark Kaltsas. Absent: Chuck Smallwood. The meeting was called to order at 7:02 p.m. by Henry.


Commissioner Gurneau moved to approve the agenda. Commissioner Henry seconded. Motion passed 4-0.

4. APPROVAL OF MINUTES

a. April 19, 2017 Planning Commission Minutes

Commissioner Neiberger moved to approve the April 19, 2017 minutes. Commissioner Gurneau seconded. Motion passed 4-0.

5. PUBLIC HEARINGS

a. Recreational Vehicle Parking Ordinance

Kaltsas informed that the Planning Commission is being asked to hold a public hearing to consider draft amendments to the recreational parking ordinance provisions. He stated that at the April 19, 2017 Planning Commission meeting, the commission reviewed concerns expressed by

residents pertaining the recent enforcement of the current code. He said that direction was provided to staff to prepare revised language and publish notification for a public hearing that would further clarify several provisions of the recreational vehicle parking ordinance. Kaltsas informed that in 2016, the language was reviewed and amended to provide some relief from recreational parking standards that allowed for parking on the side and rear yard of residential properties. He said that with this discussion, some areas were further defined. Kaltsas said that public input has been received at previous meetings and directly to staff. Kaltsas said that an additional option that the commission could consider, that is not presented in the proposed revision, is seasonal parking. Kaltsas reviewed the proposed clarifications of the code. He said that language has been drafted that references approved engineer details for driveways. He highlighted that language was drafted to further define “parking area”. Kaltsas said that language was also drafted to further define accessible. Kaltsas said that staff is seeking a discussion from the Planning Commission and direction relating to the parking of recreational vehicles changes and whether or not that City should consider seasonal parking of recreational vehicles. He informed that there are different ways in which the City could allow for seasonal parking of recreational vehicles. Kaltsas said that the most popular method is to allow seasonal parking of certain recreational vehicles during specified dates (i.e. from June 1 to September 1). He said, in other cases, that some cities just specified a period of time (i.e. 30 days) that a recreational vehicle is permitted to be located on the driveway in the front yard. He said that there are some concerns as to how enforcement would be conducted. He said that this was for discussion purposes only at this meeting. McCallum informed that a resident asked if the code should have a section that states that recreational vehicles cannot be stored on the City streets. Kaltsas said that the Planning Commission was being asked to conduct a public hearing to accept input on the proposed amendments to sections 1016-15 and 1019-4 A 12, and to prepare a recommendation to adopt all or portions of the proposed amendments, or to leave the code as currently written. Gurneau moved to close the meeting and open the public hearing at 7:21 p.m. Henry seconded. Motion passed 4-0. James Kirk, resident at 203 Garfield, asked what if the definition of recreational vehicle could be changed to not include utility trailers. He said that he did not feel that it should be considered a recreational vehicle or equipment. Bru Ploog, resident at 707 Brook Circle West, said that the existing ordinance is good with the limitations on allowing the recreational vehicles only on the side or in the back of the yard. She expressed concern regarding recreational vehicles being parked in the public sidewalks and that parking in the front yards is not aesthetically pleasing. She said that no changes need to be made to the proposed code.

Paula Thompson, resident at 365 Garfield, stated that she has had a bump out on their driveway for many years and they have parked their boat there. She asked if this would change where she can park her boat. Kaltsas said that according to the code, it hasn’t been allowed since the change in 2011. Michelle Otto, resident at 205 Garfield said that direct complaints are not the only way that code enforcement is conducted, but that it is the City Clerk/Treasurer’s job to actively seek out violations. Henry suggested that some properties should be grandfathered in. Neiberger said that it has to be equal throughout the town. She said that the Planning Commission has to look out for what’s best for the City. The public hearing was closed at 7:35 p.m. and the meeting reopened. Johnson said that other communities should be looked at to see what they do. Kaltsas informed that the ordinance has been in place for some time and that it hasn’t been enforced fully. He said that front yard parking has not been permitted and that it would be difficult to grandfather some properties in. Henry said that older people should not have to make changes on their older properties that have followed old code. Otto said that the previous planning commission made the change to the code. Neiberger said that they need to do what’s best for the community. Gurneau moved to accept the proposed changes to the ordinance and forward to City Council for their review. Andersen seconded. Motion passed 3-1 (Henry voted against). Neiberger disagreed with having a provision in the ordinance that would allow for seasonal parking. Kaltsas explained that the current code prohibits recreational vehicles in the front yard and that this would provide a temporary storage option in the front yard. He asked the commission to discuss and provide direction. Gurneau said that it would help some residents. Neiberger said it would be detrimental to the neighborhoods. Andersen said that he liked the current ordinance and would not like to see different language with seasonal parking. Kaltsas said that it would possibly be a challenge to enforce. He said that it varies between cities.

Neiberger moved to not allow a seasonal parking provision, directing staff to not move forward with their research on seasonal parking. Andersen seconded. Motion failed 2-2 (Gurneau and Henry voted against).

a. Rental Housing Ordinance Draft

Kaltsas said that at the previous meeting, staff was asked to draft a draft ordinance pertaining to rental properties. He said that staff researched and reviewed how nearby cities handle rental properties. He informed that cities vary widely on how they regulate rental housing. Kaltsas said that many cities had a rental registration process/requirement. He said that only one city had a full inspection program/requirement. Kaltsas presented the draft ordinance to the commission. He explained that the proposed ordinance is based on what would be considered a phased approach to rental property enforcement for Montrose. He said the draft ordinance requires rental properties to register with the City and that upon registration, a property manager would have to be designated as a primary contact with the City. Kaltsas further explained that the process of registering would ensure that the City has a point person to contact in the event that a violation is discovered. He said that this would allow for an initial dialogue between rental property owners and the City. He said that the process would provide a platform for the City to educate property owners about the general maintenance and upkeep criteria as well as programs like the crime/drug free addendum. Kaltsas said that following the implementation of the rental registration ordinance, the City may then decide to amend the ordinance to implement an inspection component as a second phase of the rental ordinance. He explained that the draft ordinance does not require a Crime/Drug Free Lease Addendum. He said that it is anticipated that the City will provide property owners with a copy of a sample lease addendum that includes crime/drug free terminology. Kaltsas said that the draft registration form includes acknowledgement/waiver that would allow the City to conduct inspections if determined by the City. He said that this would allow the City some latitude to inspect properties if the City suspected they were in violation with the minimum property requirements. Neiberger moved to send the rental housing ordinance for a Public Hearing. Andersen seconded. Motion passed 4-0.

Equal Opportunity Provider and Employer DATE: June 6, 2017 TO: City Council FROM: Mark Kaltsas, City Planner SUBJECT: Recreational Vehicle Parking Ordinance Amendment ACTION TO BE CONSIDERED: Adoption of an amendment to the recreational vehicle parking ordinance. FACTS: At the regularly scheduled May17, 2017 Planning Commission Meeting, Commissioners reviewed the proposed amendment to the recreational vehicle parking ordinance. Commissioners recommended approval of the amendment to the ordinance. The ordinance is proposed to be amended to clarify various provisions of the recently updated ordinance that was adopted in 2016. Following an effort by the City to enforce the 2016 ordinance update, many residents sought clarification relating to certain provisions. Staff prepared language that would clarify many of the questions and issues that were expressed by residents. A draft ordinance was prepared for consideration and discussion by the Planning Commission at their regularly scheduled meeting in April. Following discussion and direction provided by Commissioners, staff revised the language and prepared a draft ordinance for consideration at the May Planning Commission Meeting. The City adopted the following standards pertaining to recreational vehicle parking in 2016:

Section 1019-4 A. Design Standards, 12. Surfacing e. Up to two recreational vehicles, including a camping trailer, motor home,

pick-up coach, travel trailer or park trailer, recreational vehicle (RV), snowmobile or water craft, or recreational equipment (ice fishing houses, utility trailers and other equipment generally towed behind another vehicle used for non-commercial purposes), may be stored on any residential property provided:

on a parking area in a rear or side yard of the property which is constructed with concrete, asphalt, concrete pavers, brick set in compacted sand, class 5 gravel, or other impervious or semi-impervious surface material that has been approved by the City Engineer, provided it is accessible from a driveway;

(2) The recreational vehicles or recreational equipment are a minimum of 5 feet from an interior lot line or rear lot line and at least 15 feet from a street side lot line. The parking pad may be allowed to encroach within the required five foot (5’) side yard setback if the following conditions are met:

a. The encroachment does not impact drainage, utilities or

city maintenance access to public improvements.

b. The placement of a parking pad within the five foot setback must be pre- approved by the City Engineer.

c. The adjacent property owner shall provide a written

statement to the applicant/owner and the City approving the placement of the parking pad within the five foot setback.

The 2016 ordinance amendment did not change the base recreational vehicle parking requirements (recreational vehicles were not permitted to be parked in the front yards or driveways prior to the 2016). It did; however, provide for a side or rear yard parking area to be installed to accommodate the parking of recreational vehicles. The City discussed clarifying the following points of the ordinance:

What constitutes a class 5 gravel parking pad? Language has been prepared which references approved engineer details for driveways.

What constitutes a parking area? Language has been prepared which further defines “parking area”.

What does the City consider the statement “accessible from a

driveway “to mean? Language has been prepared to further define accessible.

In addition to the above clarifications being considered, the City received feedback from residents and elected officials pertaining to the recent enforcement of the recreational vehicle ordinance. One concern expressed by residents was the prohibition of seasonal parking on the existing designated

driveway in the front yard of the property. Planning Commissioners did not make a recommendation pertaining to seasonal parking to the City Council. ACTION: The Planning Commission recommended approval of the ordinance amendment to the City Council:

1. Council can approve the recommended amendment, direct staff to

revise the amendment or leave the ordinance as currently written. The recommended ordinance is attached.

5. Recreational Vehicle Parking. Recreational Vehicles shall not be permitted to be parked on a public street within residential zoned districts except for the specific purpose of temporary loading or unloading.

1019-4: PARKING STALL, AISLE AND DRIVEWAY DESIGN: A. Design Standards:

12. Surfacing, is amended as follows: e. Up to two recreational vehicles, including a camping trailer, motor home, pick-up

coach, travel trailer or park trailer, recreational vehicle (RV), snowmobile or water craft, or recreational equipment (ice fishing houses, utility trailers and other equipment generally towed behind another vehicle used for non-commercial purposes), may be stored on any residential property provided:

(1) The recreational vehicles or recreational equipment are located on a

parking areaa in a rear or side yard of the property. The parking area shall be constructed in accordance with the City’s approved driveway details. The parking area shall be constructed which is constructed with concrete, asphalt, concrete pavers, brick set in compacted sand, class 5 gravel, or other impervious or semi-impervious surface material that has been approved by the City Engineer, provided it is accessibleb from a driveway;

(2) The recreational vehicles or recreational equipment are a minimum of 5

feet from an interior lot line or rear lot line and at least 15 feet from a street side lot line. The parking pad may be allowed to encroach within the required five-foot (5’) side yard setback if the following conditions are met:

accordance with the City’s Fee Schedule, to cover the costs of the City Engineer’s inspection.

a For the purpose of this section, “parking area” shall be defined as follows; a dedicated area that fully covers the entire ground surface beneath the recreational vehicle to be stored. Impervious surface beneath just the tires shall not constitute a parking area. b For the purpose of this section, “accessible” shall be defined as follows; the parking area shall be located such that the recreational vehicle can use the existing driveway to access the side or rear yard where the parking area is located. The parking area is not accessible if access requires traversing any portion of the front yard that is not the designated driveway or directly from the street at a point that is not the designated driveway. If a property is a corner lot or a lot located on an improved alley then the parking area can be accessed directly via the street or alley if approved by the City Engineer.

Section 2. This Ordinance shall be effective immediately upon its passage and publication. ADOPTED this 12th day of June, 2017, by the City Council of the City of Montrose. CITY OF MONTROSE

Subject: Garfield Avenue Street and Drainage Improvements

Plans have been completed for the Garfield Avenue Street and Drainage Improvement project. The

project scope includes the installation of a storm sewer system with inlets along the existing ditch on the

west side of the road. The storm sewer will connect to the existing storm sewer on the north end and

discharge into the existing storm water pond adjacent to the water tower. The ditch along the west side of

Garfield Avenue would be mostly filled in with dirt, leaving a slight swale that would be much more

subtle than the existing ditch. The existing bituminous surface of the roadway would be removed and a

new full depth bituminous surface would be placed on the roadway.

Additionally the street condition within the Montrose Meadows Phase 1 development located on 3rd St. S.

(Emerson Ave to Fieldcrest Ave), Fairmont Ave. (cul-de-sac to 250’ north of 3rd St. S.), Fieldcrest Ave.

(cul-de-sac to 250’ north of 3rd St. S.) and Fieldcrest Ct. has rapidly deteriorated since last Fall.

Improvements to these streets are included in the City’s Capital Improvement Plan for 2021. However,

that schedule will need to be expedited based upon the recent deterioration of the bituminous surface. I

would recommend including the re-paving of these streets in the Garfield Avenue project. This would be

bid as a separate section that would allow the City Council to either award this section of the project or

reject bids on this section of the project while still moving forward with the Garfield Avenue portion.

If the City Council would like to proceed, I recommend that you approve the plans for Garfield Avenue

and authorize us to advertise for bids for the Garfield Avenue and Montrose Meadows street repairs.

Following is a proposed project schedule:

1) Advertise for Bids – June 27, July 3 and July 11, 2017

2) Open Bids – July 18, 2017

3) Award Contract – July 24, 2017

4) Substantial Completion Date – October 31, 2017

5) Final Completion Date – June 1, 2018

PERSONNEL COMMITTEE MEETING MINUTES

Mayor Michelle Otto Council member Jill Menard Fire Chief Kevin Triplett Public Works Director Sean Diercks City Clerk/Treasurer Margaret McCallum

The meeting was called to order on June 5, 2017, at 3:40 PM

Diercks, McCallum, Triplett, Menard, and Otto were present. Also present was City Attorney, Andy Pratt. Absent: None.

1. Approve May 1, 2017 Personnel Committee Meeting Minutes Triplett moved to approve the May 1, 2017 Personnel Committee Meeting Minutes. Otto seconded. Motion passed 4-0. (Diercks Absent at this time).

2. Fire Department Attendance Policy Triplett presented a draft Fire Department Attendance Policy to the Committee for their review. He said that he would like it to go to the Council at their June meeting for approval. He said that the policy was reviewed by the City Attorney and comments were provided. Triplett explained that within the policy, there is a 30% calls for service requirement and a 75% training attendance requirement. He said that these numbers were determined by the department. He stated that some departments to more and some do less. He explained that the standards help keep the firefighters and personnel on track. Triplett said that quarterly reviews will likely be performed moving forward to ensure that people are staying on track. Menard moved to recommend to Council approving the Fire Department Attendance Policy. McCallum seconded. Motion passed 4-0. (Diercks Absent at this time).

3. Firefighter Discipline

Triplett informed of two firefighters that will be receiving written reprimands due to failure to meet the attendance requirements of either call events or training/sponsored events. Pratt entered the meeting at 3:47 p.m. Triplett stressed the importance of all firefighters meeting the attendance requirements.

4. Fire Department – New Policies Triplett presented draft policies and standard operating guidelines (SOG’s) for the Committee’s review. Triplett said that he was hoping that a final draft would be presented to the Council at an upcoming Council meeting. The Committee offered feedback and comments.

5. Quarterly Review Menard reminded that quarterly reviews for the public works department are due at the end of June.

6. Organization Positivity Menard stated that in an organization, people need to work together. She said that many of the city and non-city committees have been very negative and full of complaints lately. She asked for suggestions as to what could be done to get the commissioners/committee members to do what’s in the best interest of the City. McCallum said that those who serve on City committees/commissions need to be reminded that they are representatives of the City and need to act accordingly. She explained that it is important to show respect for other people’s opinions and to try and redirect negative meetings into something positive. McCallum suggested doing a refresher workshop every year to reiterate goals and the vision for the committees/commissions. McCallum said that the City has in place Rules of Civility for Public Participation. Menard said it would be worth reviewing again and having those rules presented at meetings. Menard also suggested making copies of the personnel policy for all members to have.

Diercks entered the meeting at 5:00 p.m.

7. Adjournment Triplett moved to adjourn the meeting at 5:05 p.m. Menard seconded. Motion passed 5-0.

RESOLUTION 2017 - 14

APPROVING MOVE TO OPEN BOOK ASSESSMENT MEETINGS

WHEREAS the City Council of the City of Montrose can change to an “Open Book” meeting format instead of the standard Local Board of Appeals and Authorization format. This will go into effect for the 2018 assessment. WHEREAS the change in format would allow for more flexibility for residential property owners to schedule a time for the assessor to review their property, the setting is less intimidating, property owners can compare their values to the values of similar properties, questions and concerns resolved more quickly, and property owners may appeal to the Council Board of Appeal and Equalization and/or to Tax Court. WHEREAS the change in format would benefit the Local Board in that it reduces the need to have a trained board member, saves time for local board members, saves money for local jurisdictions due to the cost of holding the meeting, and eliminates the need for the local board to become familiar with the local real estate market. WHEREAS the change in format would benefit Wright County in that is allows for immediate consideration of issues, is an efficient use of resources due to the ability to combine several jurisdictions into one meeting, and fewer deadlines and an extended period of time to work with property owners on resolving issues. THEREFORE BE IT RESOLVED that the City Council of the City of Montrose, Minnesota, hereby approves changing the annual assessment meeting by moving away from the Local Board of Appeal and Equalization format and replacing it with the Open Book Meeting format offered by Wright County. Adopted by the Montrose City Council this 12th day of June, 2017. ORDINANCE NO. 2017-04

ORDINANCE AMENDING CHAPTER 80: INTOXICATING LIQUOR SPECIFICALLY 80.02C AND 80.02D

THE MONTROSE CITY COUNCIL, WRIGHT COUNTY, MINNESOTA ORDAINS AS FOLLOWS:

80.02 LICENSE REQUIRED.

C) Sunday.

1) A Sunday on-sale license authorizes the licensee to sell or serve liquor between the hours of 8:00 a.m. Sunday and 1:00 a.m. Monday.

2) Sunday on-sale licenses shall be issued only to a hotel or restaurant having facilities for serving at least 30 guests at a time, and which has an on-sale license.

3) No Sunday on-sale license shall be valid unless a valid on-sale license is also in effect for the same premises.

D) Off-sale licenses shall be issued only to exclusive liquor stores and for a permit off-sale of liquor only. An exclusive liquor store shall include an on-sale or a combination on-sale and off-sale establishment at which food is sold for consumption on the premises.

1) No sale of intoxicating liquor me be made by an off-sale licensee:

a) on Sundays, except between the hours of 11:00 am and 6:00 pm;

b) before 8:00 am or after 10:00 pm on Monday through Saturday;

c) on Thanksgiving Day;

d) on Christmas Day, December 25; or

e) after 8:00 pm on Christmas Eve, December 24.

2) No delivery of alcohol to an off-sale licensee may be made by a wholesaler or accepted by an off-sale license on a Sunday. No order solicitation or merchandising may be made by a wholesaler on a Sunday.

Effective Date. This ordinance shall take effect from and after its passage and publication but not before July 1, 2017.
