    1. CIP Half Percent for Art Public Art Project BudgetsThe Public Art and Design Board (PADB) has selected two sites, the Buffaloe RoadAquatic Center and Halifax Park and Community Center, for public art as part of the CIPHalf Percent for Art program. The PADB recommends that Half Percent for Arts fundsbe pooled from nine projects identified as possible sites for public art, all of which wouldbe funded by the 2007 Parks and Recreation Bond. The estimated total of pooled fundsfor the current fiscal year (FY 09-10) and next fiscal year (FY 10-11) is $115,246. PerOrdinance 2009-563, City Council approval is required for use of pooled funds to enablethe increase of project budgets for a particular project above estimated one-half percentof construction costs. The recommended budgets for these two projects of $71,500 forpublic art at the Buffaloe Road Aquatic Center and $32,100 for Halifax Park andCommunity Center should be established now so that artists can be engaged as soon aspossible in order to maximize design integration and cost savings.

    Recommendation:

    Approve funds based on information in the agenda packet.

    2. City Employees - Military Service Call-UpManagement Policy 100-39 provides for a leave of absence and continuation ofsupplemental salary and benefits for up to one year for City employees called to activeduty in the National Guard or in one of the reserve branches of the military as part of theEnduring Freedom campaign; Iraqi Freedom campaign; and for natural disaster recoveryefforts. Council approval is requested to extend the current policy to December 31, 2010.

    Recommendation:

    Approve the extension as requested.

    3. North Carolina State University (NCSU) Police Territorial Jurisdiction ExpansionThe Raleigh Police Department has developed a close working relationship with theNorth Carolina State University (NCSU) Police Department. Recently both departmentshave discussed the possibility of the expansion of the territorial jurisdiction of NCSUPolice pursuant to N.C.G.S. 116-40.5(a). This statute allows a municipality to grant jurisdiction to a Campus Law Enforcement agency affiliated with the North CarolinaUniversity System.

    Under the terms of the proposed agreement NCSU Police officers would be granted thefollowing additional authority: Limited extra-territorial jurisdiction on streets andproperty immediately surrounding campus; jurisdiction at certain, specified, addressesthat are not on campus but serve as campus housing; the ability to arrest or charge for anymisdemeanor or felony committed in the presence of on-duty NCSU Police Officer whileinside the City of Raleigh; and the ability to serve arrest and search warrants for crimes

    committed on campus with the express consent of the Raleigh Police Department WatchCommander. Under the terms of the proposed agreement NCSU officers would beprohibited from conducting routine patrol beyond their currently existing territorial jurisdiction. Approval of this agreement would result in a more efficient utilization ofresources for both agencies. There is no cost to the City associated with this agreement.

    Recommendation:

    Authorize execution of the agreement by the City Manager.

    4. Road Races4.1 400 Block of Fayetteville Street

    Butch Robertson, representing the Bank of America Raleigh Rocks, requests tohold a race on Saturday, March 27, 2010, from 6:00 a.m. until 2:00 p.m.

    Recommendation:

    4.2 Delta Lake VicinityJeff Zamba, representing the Delta Ridge Subdivision, requests to hold a race onSaturday, May 1, 2010, from 9:30 a.m. until 11:00 a.m. for National HIV/AIDSAwareness Day.

    Approve subject to conditions on the report in the agenda packet.6. Grant - CAMPO STP-DA Grant Applications

    The Capital Area Metropolitan Planning Organization (CAMPO) is acceptingapplications for the use of Federal Surface Transportation Program - Direct Allocation(STP-DA) funds. CAMPO is making portions of these funds available on both acompetitive and non-competitive basis. The City of Raleigh is eligible for a non-competitive grant allocation of $78,000, and staff is recommending applying for$300,000 in funding from the competitive program grant. The non-competitive fundingallocation will permit the City to advance several high priority bicycle striping projects asidentified in the Citys Bicycle Transportation Plan. The competitive funding will helpfund several priority sidewalk improvement projects. This is a matching grant program

    requiring 50% participation by the City, which will be addressed in the development ofthe next Capital Improvement Program.

    Recommendation:

    Authorize staff to apply to CAMPO for STP-DA grants of $78,000 for non-competitiveallocations and $300,000 for competitive allocations for the purpose of completingpriority bicycle and sidewalk projects.

    7. Contract Amendment - Wilders Grove Service Center Solid Waste Services FacilityA supplemental agreement with the Consultant for the Wilders Grove Service CenterSolid Waste Service Facility Project, Hazen & Sawyer, has been negotiated in the amountof $1,180,887. This agreement will complete the construction inspection and contract

    administration, LEED documentation, materials testing, commissioning support, as-builtdrawings and warranty service effort to complete the Wilders Grove Service Center SolidWaste Service Facility. This agreement will also provide for additional services relatedto grant assistance in investigating and pursuing further system design and performingadditional construction and monitoring investigations for possible enhancements to thegeothermal energy system once grant requirements are established.

    Recommendation:

    Authorize the City Manager to execute a supplemental agreement with Hazen & Sawyerto perform the construction and warranty period services. Funding will be through

    8. Personnel Changes - Information Technology - Development Services - ITApplications Support Project Manager

    The Citys plan for providing adequate technology support to the Development Services(DS) is to establish a full-time Project Manager who will concentrate on development-related applications. This position will be an Information Technology (IT) divisionposition and responsible for management of the IRIS system, the new Electronic Plansapplication in development with Mecklenburg County, any support systems for theCustomer Service Center and technical support for the Records Manager as well as all thehardware support for the division. The Personnel Department has reviewed theresponsibilities of this new position and recommends that subject position be establishedas an Information Technology Applications Support Project Manager; PG 40; code 0353.This position will be funded for the remainder of this fiscal year with surplus DS salaryfunds and next fiscal year by canceling one of DS project management contracts. TheBudget Office has vetted this request and will administratively transfer the remainingFY10 salary funding from DS to IT.

The bid also included an addalternate. Due to the bid prices, the Citys architect, DTW is recommending thatthe add alternate be included in the award. With the base bid and the alternate,the project contract amount will be $288,010. Riggs-Harrod Builders, Inc.,submitted a 0.6% MWBE participation plan.

In addition to those proposed changes whichhave already been authorized for public hearing, the Committee recommends adding anew subsection (4) to Section 10-2082.14(c), Existing Tree Cover Required, to reduce thecost of preparing tree conservation plans.     1. Honeycutt Park Greenway - ConcernsBy split vote, the Committee recommends upholding staffs recommendation to approvedesign Alternative 4 for the portion of the greenway that crosses through theSummerfield North Subdivision as outlined on pages 21 and 22 of design consultantsreport dated January 10, 2010. Design Alternative 4 is the same as the 60% ProposedDesign with the exception that the sidewalk section within Summerfield North will not bewidened and will not have the addition of decorative borders. A copy of the excerpt ofthe January 10, 2010, report pertaining to Alternative 4 is in the agenda packet.

    The Committee further recommends approaching NCDOT regarding installing a fullysignaled pedestrian crossing mid-block of Strickland Road in conjunction withconstruction of the Honeycutt Park Greenway with the understanding the City will fundthe installation and maintenance of the signal.
