the Commission shall ensure that the imposition,collection, and increase in tuition, other school fees,and the introduction of new school fees shall be allowedprovided they are transparent and compliant with therequirements set forth by law and this regulation

Other factors of reasonableness may be considered, towit: Regional Inflation Rate (RIR) as may be determined byNEDA (Prevailing economic conditions as shown byvarious economic indicators such as the consumer price

index, incidence of poverty); Financial standing of the HEI; Financial capacity of the general studentry; Impact of force majeure or calamities; Quality track record of the school; and Mission and vision of the school

Salient Features4. Coverage. Fees for Educational Visits and

Field Trips - Shall not be covered by this CMOsince they are already included in theGuidelines and Procedures for EducationalTours and Field Trips of college and graduatestudents that would be promulgated by the

Commission upon compliance with therequirements of public consultation.

5. Obligations of CHED Offices: O ff i c e o f t h e E x e c u t i v e D i r e c t o r

responsibilities such as: cause the provisionof systematic and technical assistance toRegional Offices to capabilitity building inresolving issues arising from application of

the policies, guidelines and procedures, etc.;

Salient Features7. Complaints and Grievances:

All complaints and grievances regardingincreases in tui3on, other school fees and newfees without the benet of consulta3on shall beendorsed by the recognized and legi3matestudent council to the CHEDRO concernedwithin 0 days a er consulta3on period.

Charges and impositions on miscellaneousand other school fees collected found to bewithout the benefit of consultation or inviolation of the provisions of this regulation,shall be disallowed, and/or ordered to returnthe already collected fees to the students

In case of any viola3on of the provisions of theseguidelines, the concerned CHED Regional Office, a ercomplying with the foregoing procedures, and uponrecommenda3on of the Regional Mul3-Secto ralCommiKee on Tui3on and Other School Fees, may bar theHEI or cancel its applica3on for fees increase andintroduc3on of new fees of HEl from effec3ng other schoolfee increases and new fees, without prejudice to the lingof administra3ve and criminal charges against it and/or its

responsible officers ac3ng knowingly under exis3ng laws.The imposi3on of penal3es such as revoca3on of permits,downgrading of status, phase-out and such other penal3esmay likewise be validly imposed by the Commission to theconcerned HEIs a er due process.

Any HEI that shall refuse to furnish copies of its latestaudited financial statements as requested byauthorized parties in the process of consultation shallforfeit its right to increase its other school fees andintroduce new fees, in addition to other penalties orsanctions as may be imposed by the CHED RegionalOffice upon recommendation of the Regional Multi-Sectoral Committee on Tuition and Other School Fees.

9. New CMO shall take effect upon publication innewspaper of general circulation and enforcedstarting AY 2013-2014.
