VEHICLE WEIGHT TAX
§249-1 Definitions. Asusedinthischapterunlessadifferentmeaningappearsfromthecontext,thefollowingtermsshallhavethefollowingrespectivemeanings.
“Antiquemotorvehicle”meansanymotorvehicle,includingamotorcycleoramotorscooterwhichproducesnotmorethantwelvehorsepower,oftheageofthirty-fiveyearsormorefromthedateofmanufacture,thatisoftheoriginalfactoryspecificationorrestoredtotheoriginalspecificationsinanunalteredorunreconstructedcondition,operatedormovedoverthehighwayprimarilyforthepurposeofhistoricalexhibitionorothersimilarpurposes.
“Bicycle”meanseverydevicepropelledsolelybyhumanpoweruponwhichanypersonmay ride,having twotandemwheelssixteeninchesindiameterorgreater,andincludinganydevicegenerallyrecognizedasabicyclethoughequippedwithtwofrontortworearwheels.
“Directoroffinance”meansthedirectoroffinanceofeachcountyorofthecountyconcerned,andincludesthedirector’sdulyauthorizeddeputiesandsubordinates.
“Moped”meansadeviceuponwhichapersonmayridewhichhastwoorthreewheelsincontactwiththeground,amotorhavingamaximumpoweroutputcapabilitymeasuredatthemotoroutputshaft,inaccordancewiththeSocietyofAutomotiveEngineersstandards,oftwohorsepower(onethousandfourhundredninety-twowatts)orlessand,ifitisacombustionengine,amaximumpistonorrotordisplacementof3.05cubicinches(fiftycubiccentimeters)andwhichwillpropelthedevice,unassisted,onalevelsurfaceatamaximumspeednogreaterthanthirtymilesperhour;andadirectorautomaticpowerdrivesystemwhichrequiresnoclutchorgearshiftoperationbythemopeddriverafterthedrivesystemisengagedwiththepowerunit.
“Motorvehicle”meanseveryvehiclewhichisself-propelledandeveryvehiclewhichispropelledbyelectricpowerbutwhichisnotoperateduponrails,butexcludesmopeds.
“Netweight”ofavehiclemeans theactualweightof thevehicle,asdeterminedonastandardscale, includingallequipmentandaccessoriesordinarilyattachedtoandusedonthevehicleand,inthecaseofamotorvehicle, themaximumfuel,oil,andwaterpossibleofbeingcarriedforitsoperation;providedthat“netweight”ofanewstandardequippedvehicle,other thanamotorvehicle,means theshippingweight thereofasestablishedby itsmanufacturer,and“netweight”ofanewstandardequippedpassengervehiclemeanstheshippingweightthereofasestablishedbyitsmanufacturer,plusonehundredpounds,and“netweight”ofanewstandardequippedmotorcycle,motorscooter,ormoped,meanstheshippingweightthereofasestablishedbyitsmanufacturer,plusthirtypounds,and“netweight”ofanewstandardequippedtruckmeanstheshippingweightthereofasestablishedbyitsmanufacturer,plustwohundredpounds. Oninitial registrationofastandardequippedvehicle,other thanamotorvehicle, forwhichthedirectoroffinancehasthemanufacturer’sestablishedweight,thedirectoroffinance,inlieuofrequiringthevehicletobeweighedandinordertodeterminethe“netweight”thereof,mayusesuchestablishedweightandmayrequiretheownertofurnishverificationofthefactoryserialnumberofthevehicle.Oninitialregistrationofstandardequippedpassengervehicles,motorcycles,motorscooters,mopeds,andtrucksforwhichthedirectoroffinancehasthemanufacturer’sestablishedweights,thedirectoroffinance,inlieuofrequiringsuchmotorvehiclestobeweighedandinordertodeterminethe“netweight”thereof,mayusesuchestablishedweights,addingonehundredpoundsinthecaseofstandardequippedpassengervehicles,thirtypoundsinthecaseofstandardequippedmotorcycles,motorscooters,andmopeds,andtwohundredpoundsinthecaseofstandardequippedtrucks,andmayrequiretheownerstofurnishverificationoffactoryserialandenginenumbersofsuchmotorvehicles.Astoavehicleforwhichthemanufacturer’sweightisnotavailableorwhosemakeandmodelcannotbedeterminedwithreasonablecertaintyorwhichhasbeensoalteredastoincreaseordiminishtheweightthereof,“netweight”meanstheactualweightofsuchvehicle,asdeterminedonastandardscale,includingallequipmentandaccessoriesordinarilyattachedtoandusedonthevehicleand,inthecaseofamotorvehicle,themaximumfuel,oil,andwaterpossibleofbeingcarriedforitsoperation.Inallcasesinformationshallbepresentedtoandinthemannerprescribedbythedirectoroffinance.
“Truck”meansanymotorvehicledesignedorusedprimarilyforthecarriageofpropertyotherthaneffectsofthedriverorpassengers,andincludesamotorvehicletowhichhasbeenaddedabox,platform,orotherequipmentforsuchcarriage.

§249-2 Impositionoftax. §249-4 Exemptionsfornewvehiclesandofficialvehicles. §249-5.5 Storedvehicles. Allvehiclestaxableundersections249-1,249-2,249-4and249-6to249-13,whicharestoredsothattheyarenotusedfortransportation,orfortheotherpurposescoveredbysection249-2,shallbeexemptfromthetaxfortheperiodofstorage;providedthattheownerofeachvehicleshallfirstpresenttothedirectoroffinanceasignedstatementofthefactofthestorage,togetherwithotherrelevantfactsasmayberequiredbythedirectoroffinanceandshallsurrenderthelastissuedcertificateofregistration,licenseplates,andemblemforthevehicle.Iftheaffidavit,certificateofregistration,licenseplates,andemblemarepresentedtothedirectoroffinanceaftertheexpirationofthevehicle’sregistrationperiod,thentheunpaidtaxforeachmonththelicenseplatescouldhavebeenvalidatedwithanemblemplusthefeeforthecurrentlyissuedlicenseplatesandemblemshallbepaidinfulluponpresentingtheaffidavit.
(b) Thedirectoroffinancemaydisposeofthelicenseplatesforanyvehiclewhoseregistrationhasexpiredandtheownershallberequiredtopurchasenewlicenseplatesandanewemblemuponremovingthevehiclefromstorage.
(c) Asaconditionprecedenttotheremovalofthevehiclefromstorage,theownerofthevehicleshallpresenttothedirectoroffinanceacertificateofinspectionthatwasissuedaftertherecordingofthestoragewiththedirectoroffinanceifthecertificateofinspectionexpiredduringtheperiodofstorage.[L1998,c3,§1;amL1999,c235,§1]
§249-6 Exemptionsforcertaincarsfurnishedtodisabledveterans. Passengercarsownedbypersonswho,byreasonoftheirservicedisability,havebeenfurnishedsuchcarsbythefederalgovernmentandhavebeensocertifiedbytheDepartmentofVeteransAffairs,shallbeexemptedfromthetaxhereinprovidedfor.Thisexemptionshallnotextendtovehiclesusedforcommercialpurposes,nortomorethanonevehicleofanydisabledveteran.[L1953,c21,§1;RL1955,§130-6;HRS§249-6;amL2017,c12,§1]
[249-6.5] Exemption for national guard, military reserves, and other active duty military personnel claiming Hawaiiastheirresidenceofrecord. Onenoncommercialmotorvehicleregisteredtoamemberofthenationalguard,militaryreserve,orarmedservice,includingtheCoastGuard,whois:
(1) AssignedtoaunitintheState;and(2) Amemberingoodstanding,
shallbeexemptfromthevehicleweighttaxprovidedforinthischapter.[L2008,c141,§1]

§249-7 Numberplates. (a)Uponreceiptofthetaxthedirectoroffinanceshallnumberandregisterthevehicleintheowner’snameinapermanentrecordorbooktobekeptbythedirectorforthispurpose,andshallfurnishtheownerthereofwithareceiptshowinguponitsfacethelicensenumberissuedforthevehicleandthefactthatthelicensetaxhasbeenpaidthereonforthewholeortheremainderofthecurrentyearinwhichthereceiptisissued.Thedirectoroffinanceshallalsofurnishtheowner,upontheoriginalregistrationofthevehicle,twonumberplatesforthevehicleoroneplateinthecaseoftrailers,semitrailers,ormotorcycleswiththeregistrationnumbermarkedthereon.Uponthepaymentofthetaxforeachyearatagoremblembearingaserialnumberandthemonthandyearofexpirationshallbeprovidedtotheowner.Transferofcurrentnumberplates,tag,oremblem,exceptasauthorizedbythischapterorbychapter286,ispunishablebyafineofnotmorethan$50foreachoffense.
(b) Uponanoriginalregistrationthedirectoroffinanceshallfix,andshallchargetotheowner,afeeequaltothecostofthenumberplateandtagoremblemplustheadministrativecostoffurnishingtheplateandtagoremblemandeffectingtheregistration.Upontheissuanceofanewseriesofnumberplatesasdeterminedbythedirectorsoffinanceofeachcountythroughmajorityconsent,thedirectoroffinanceshallchargetheownerafeeequaltothecostsofthenumberplateplustheadministrativecostoffurnishingtheplates.Uponissuingatagoremblem,thedirectoroffinanceshallchargetheownerafeeof50cents.Theownershallsecurelyfastenthenumberplatesonthevehicle,oneonthefrontandtheotherontherear,atalocationprovidedbythemanufacturerorintheabsenceofsuchalocationuponthebumpersofthevehicleandinconformancewithsection291-31,insuchamannerastopreventtheplatesfromswinging.Numberplatesshallatalltimesbedisplayedentirelyunobscuredandbekeptreasonablyclean.Inthecaseoftrailers,semitrailers,ormotorcycles,oneplateshallbeusedanditshallbefastenedtotherearthereofatalocationprovidedbythemanufacturerorintheabsenceofsuchalocationattherearthereof,andinthecaseofmotorcyclesinconformancewithsection291-31.
(c) Upontheissuanceofthetagoremblemtheownershallaffixthetagoremblemtothetoprightportionoftherearnumberplate,exceptthatallvehiclesownedbytheState,anycountygovernment,anyboardofwatersupply,andofficialrepresentativesofanyforeigngovernmentsshallbeissuedregistrationswhichneedberenewedonlyinthenewplateissueyear.
(d) After the initialpaymentof the taxand theoriginal registrationofavehicleashereinspecified,amotorvehicleshallnotberequiredtobereweighedinanysucceedingyearunlessithasbeensoalteredorchangedastoincreaseordiminishitsweight.Nonewnumberplatesshall,however,beissuedtoanewownerexceptasprovidedinsections249-7.5and249-8.

§249-7.5 Newmotorvehiclewithatemporarynumberplate. §249-8 Replacementsforlostordamagedplates,tags,oremblems. §249-9 Numberplates;purchase. (a)Thenumberplateshereinabovereferredtoshallbeuseduponallvehiclesforwhichataxhasbeenpaidpursuanttosections249-1to249-13.Allsuchplatesshall:
(1) Beartheword“Hawaii”alongtheupperportionoftheplateandthewords“AlohaState”alongthelowerportionoftheplate;
(2) Haveadistinctcontrastbetweenthecoloroftheplateandthenumeralsandlettersthereon;and(3) Beofsuchshape,size,andcolor,andwithsucharrangementsoflettersandnumbersasmay,subject to
sections249-1to249-13,bedeterminedbythedirectorsoffinanceofeachcountythroughmajorityconsent.Thenumeralsonallsuchplatesshallbenotlessthanthreeinchesinheightandthestrokesthereofnotlessthanthree-eighthsinchinwidth,exceptinthecaseofmotorcycles,inwhichcasethenumeralsshallnotbelessthanoneinchinheightandthestrokesthereofnotlessthanone-eighthinchinwidth.
Thedirectoroffinanceof thecityandcountyofHonolulushallcontractannuallyonbehalfof thecountiesforthepurchaseofallnumberplates,tags,oremblemsrequired.ThecouncilofeachcountyshallappropriateandcausetobepaidovertothepartywithwhomthedirectoroffinanceofthecityandcountyofHonolulushallcontract,ortothedirectoroffinanceofthecityandcountyofHonoluluasthedirectormaydirect,suchsumorsumsasthedirectoroffinanceofthecityandcountyofHonolulushalldeterminetobethecounty’sproportionateshareoftheexpenseofsuchcontractandthechargesconnectedtherewith.ThecontractshallbemadebythedirectoroffinanceofthecityandcountyofHonoluluasagentoftheseveralcounties,andtheproportionateliabilityofeachcountyshallbestatedinthecontract.Notwithstandinganyotherprovisionofthelaw,thecontractshallconstituteavalidobligationofeachcountyforitsproportionateshare.
(b) Thenumberplatesformembersof theCongressof theUnitedStatesfromtheStateshalldesignate theirofficeandbeofthetypeandcolorauthorizedformotorvehiclesintheState;providedthatthenumberontheplatesoftheUnitedStatessenatorandtheUnitedStatesrepresentativeshallbeassignedintermsofseniorityofservicewiththesenatororrepresentativehavingthegreaterlengthofservicehavingthenumber“1”andconsecutivelythereafterfortheothers.ThedirectoroffinanceofthecityandcountyofHonolulushall,inthedirector’sprocurementofthenumberplatesonbehalfofthecounties,contractforthenumberplatesofthemembersofCongressandallexpensesconnectedtherewithshallbepaidbytherespectivemembersofCongress.
(c) Notwithstandinganyotherprovisionofthelaw,anyantiquemotorvehicleshallbeissuedaspecialnumberplateforafeeof$10whichplateshallbepermanentandvalidforuseonsuchvehiclessolongasthevehicleisinexistenceinlieuoftheuniformstatenumberplates.Thedirectoroffinancemaydiscardandallowfornewapplicationsofinactivespecialnumberplatesthathavenotbeenassignedorregisteredduringtheprecedingthreeyears.Inadditiontothepaymentofanyotherfeerequiredbylaw,applicabletoantiquemotorvehicles,theownerofanysuchvehicleshallpaythefeefortheissuanceofthespecialnumberplate.Theregistrationnumeralsandspecialnumberplatesassignedtoantiquemotorvehiclesshallbelabeled“HorselessCarriage”and“Permanent”andshallruninaseparatenumericalseries,commencingwithHorselessCarriageNo.1.[RL1935,ptof§2157;amL1937,c214,§1,subs6;RL1945,§5710;amL1947,c33,§1;amL1951,c162,§4;RL1955,§130-9;amLSp19592d,c1,§9;amL1961,c11,§1;amL1967,c137,§3;HRS§249-9;amL1982,c237,§2;amimpL1984,c90,§1;gench1985;amL1990,c132,§2;amL1997,c326,§2;amL1999,c208,§1]

In addition to thenumberplates contractedonbehalf of the counties by thedirectoroffinanceofthecityandcountyofHonolulu,thedirectoroffinancemayprovide,uponrequest,specialnumberplates.Thespecialnumberplatesshallconformtotherequirementsprovidedfortheuniformnumberplatesexceptthattheownermayrequestthechoiceandarrangementoflettersandnumbers.Themaximumnumberoflettersandnumbersshallbesixandonlyonehyphenwillbeallowedinadditiontoandinlieuofthesixlettersandnumerals.Nootherpunctuationmarksshallbeallowed.Thedirectoroffinanceshallnotissuespecialnumberplateswhichhavetheletterandnumeralcombinationofregularplates,aremisleadingorpubliclyobjectionable.Thefeeforspecialnumberplatesshallbe$25uponinitialapplicationand$25uponeachannualrenewalofthevehicleregistration.Thisfeeshallnotberefundable.Re-applicationforspecialnumberplatesmustbemadeuponachangeindesignofregularplates.Thedirectoroffinancemaydiscardandallowfornewapplicationsofinactivespecialnumberplatesthathavenotbeenassignedorregisteredduringtheprecedingthreeyears.Thedirectoroffinanceshalladoptrulespursuanttochapter91tocarryoutthissection.[L1969,c121,§1;amL1982,c237,§3;amL1990,c37,§1;amL1999,c208,§2]

§249-9.3 Specialnumberplates;designandissuancebycounties. Thedirectoroffinanceof thecityandcountyofHonolulu, inconsultationwith thedirectorsoffinanceof thecountiesofKauai,Maui,andHawaii,shallestablishspecialdesignparametersandrestrictionsfordecalsorgraphicrepresentationsaffixabletospecialnumberplates;providedthatthedecalshallnotbelargerthanthreeincheswidebythreeincheshigh.
(b) Forthepurposesofthissection,thefollowingtermsshallhavethefollowingmeanings:“Director”unlessindicatedotherwisebyitscontext,meansthecountydirectorsoffinance.“Organization”means:(1) Anot-for-profitorganizationrecognizedassuchbytheInternalRevenueServiceandwhoseprimarypurpose
istoprovidethecommunitywithspecificprogramstoimprovethepublic’shealth,education,orgeneralwelfare;
(2) Amilitaryserviceveteransgroup;(3) Astateorcountyagencyapprovedbythedirector;or(4) Anyschooloraccreditedinstitutionofhigherlearningoracollegeorrecognizedprogramthereof.
“Specialnumberplate”meansalicenseplatewithadecalonitsfacethatrepresentsanorganizationasdefinedinthissection.
(c) Organizationsasdefinedundersubsection(b)mayapplyforaspecialnumberplatewiththedirector.Theorganizationshalldesignadecaltobeplacedonthelicenseplatethatrepresentstheorganizationandcomplieswiththissection.
AllorganizationsshallbeheadquarteredintheState;providedthatanorganizationthatisachapterorbranchofan international,national,or regionalorganizationshallbe ingoodstandingandauthorized inwritingby theparentorganizationtousethedecaldesignappliedforbytheorganization.
(d) Anorganizationshallapplyforaspecialnumberplatewiththedirectoronanapplicationformprescribedbythedirector.Theapplicationshallinclude:
(1) Adesignoftheorganization’sdecal;(2) Asignednotarizedstatementbyanofficerordirectoroftheorganizationthattheorganizationwillacquireat
leastonehundredfiftyspecialnumberplates;and(3) Thedollaramounttheorganizationplanstoraisefromeachspecialnumberplate.
Thedirectorshalldetermine,basedoncriteriainthissection,andthedirector’sdiscretion,whetheranorganization’sapplicationhasbeenacceptedorrejected.Thedirectorshallalsoseektheapprovalofanorganization’sdecaldesignfromthecountychiefofpolicewheretheapplicationismade.
Ifthedirectorrejectsanapplication,thedirectorshallstatethereasonsfortherejectioninwritingandshallallowtheapplicanttoreapplywithinareasonableperiodaftertherejection.

Afteranorganization’sapplicationhasbeenapproved,amotorvehicleownermayapply for theorganization’sspecialnumberplate.Thedirectormayrequirethecompletionofaformasprescribedbythedirector.Specialnumberplatesshallbeissuedonlytotheregisteredownerofanapplicantmotorvehicle.
(e) Thedesignofthedecalusedonanorganization’sspecialnumberplateshallnot:(1) Infringeorotherwiseviolateanytrademark,tradename,servicemark,copyright,orotherproprietaryor
propertyright;(2) Representanyobsceneordegradingimage,idea,word,orphrase;(3) Advertiseorendorseaproduct,brand,orservicethatisprovidedforsale;(4) Promoteanyreligiousbelief;or(5) Promoteanyphilosophybasedonprejudiceorthatiscontrarytostatecivilrightslaws;
providedthatthedecaldoesnotobstructthevisibilityofthenumberorlettersoranyotherinformationthatisrequiredbylawtobeonthelicenseplateandisreadilyidentifiableanddistinguishableunderactualtrafficconditions.
(f) Thedirectorshallchargeaspecialnumberplatefeeequaltothecounty’scostofprovidingthespecialnumberplateplustheorganization’sfundraisingamountappliedforundersubsection(d).Thefeeshallbeinadditiontoanyotherstateorcountyfeescollectedforamotorvehicleregistrationorlicenseplate.Thefundraisingportionofthefeeshallbedepositedinthenameoftheorganizationinaseparatecountybudgetaccount.Thedirectorshalldeterminethemostefficientmeansofreimbursingorganizationsfortheirfundraisingportionofthefee.
(g) Thedirectormayrevoketheapprovalofanorganization’sapplicationforspecialnumberplatesifthetotalnumber of registered vehicles that obtained the special number plates is less than one hundredfiftywithin threeyearsofreceivingapprovaltoissuetheorganization’sspecialnumberplate.Upontherevocationoftheapproval,thedirectorshallreturntheunuseddecalstotheorganization.
(h) Nothinginthissectionshallbeconstruedtoapplytospecialnumberplatesissuedpursuanttosection249-9.2.[L1997,c326,§1;amL1999,c208,§4;amL2000,c13,§1,amL2005,c8,§1]
§249-9.4 Specialseriesnumberplates. Aqualifiedhouseholdmember,asdefinedinsection291E-1,oraco-ownerofamotorvehicleownedbyarespondentunderpartIIIofchapter291E,whohasbeengrantedaspecialmotorvehicleregistrationundersection291E-48,shallapplytotheappropriatecountydirectoroffinanceforspecialnumberplatesthatshallbearaspecialseriesofnumbersorlettersoastobereadilyidentifiablebylawenforcementofficersandreadilydistinguishablefromnumberplatesorspecialnumberplatesissuedundersections249-9.1,249-9.2,and249-9.3.Thedirectoroffinancemayissuethespecialseriesnumberplatesonlyif:

(a)Notwithstandinganylawtothecontrary,thedirectoroffinanceshallissuetoanyregisteredownerofamotorvehicle,whoisaresidentoftheState,uponcompletedapplicationandpaymentofrequiredfees,aspecialnumberplatefortheregisteredowner’smotorvehiclecommemoratingHaleakalaNationalParkorHawaiiVolcanoesNationalPark,orboth,toobservetheimportanceofthenationalparksinHawaii.
(b) ThedirectoroffinanceofthecityandcountyofHonolulu,inconsultationwiththedirectorsoffinanceofthecountiesofKauai,Maui,andHawaii,thechiefsofpoliceofthecityandcountyofHonolulu,andthecountiesofKauai,Maui,andHawaii,andthesuperintendentsofHaleakalaNationalParkandHawaiiVolcanoesNationalPark,shallestablishaspecialnumberplatedesignthat:

(2) Issimilarinshapeandsizetotheuniformstatenumberplateprescribedbylaw;and(3) Doesnotobstructthevisibilityofthenumberorlettersoranyotherinformationthatisrequiredbylawtobe
onanumberplateandarereadilyidentifiableanddistinguishableunderactualtrafficconditions.(c) Thespecialnumberplatedesignshallnot:
(1) Infringeorotherwiseviolateanytrademark,tradename,servicemark,copyright,orotherproprietaryorpropertyright;

(d) Eachspecialnumberplateshallbesecurelyfastenedtothemotorvehicleinlieuoftheuniformstatenumberplate.
(e) Thedirectoroffinanceshallchargeaspecialnumberplatefeeatleastequaltothecounty’scostofprovidingthespecialnumberplateandadministrativecosts,ifany,plusafundraisingfeetobedeterminedbythedirectoroffinanceinconsultationwiththesuperintendentsofHaleakalaNationalParkandHawaiiVolcanoesNationalPark.Thefundraisingfeeshallbeinadditiontoanyotherstateorcountyfeescollectedforamotorvehicleregistrationorlicenseplate.
(f) Thedirectoroffinancemaychargeanadditionalfundraisingfee,ofthesameoradifferentamountasthefundraising fee establishedpursuant to subsection (e), for the renewalof a special numberplate. If an additionalfundraisingfeeisimplementedpursuanttothissubsection,thedirectoroffinanceshallrevokethespecialnumberplate of the registered owner of amotor vehiclewho fails to pay the additional fundraising fee imposed by thissubsection.
(g) Therevenuegeneratedbythefundraisingfees,oraportionoftherevenuegeneratedbythefundraisingfeesasdeterminedbythedirectoroffinance,shallbedepositedinthenameoftheHaleakalaNationalParkandHawaiiVolcanoesNationalParkinaseparatecountybudgetaccount.Thedirectoroffinanceshalldeterminethemostefficientmeansofdirectingtherevenuegeneratedbythefundraisingfeestotherespectivenationalpark,oritsnonprofitpartnerorganization,asappropriate.
(h) The director of financemay revoke all special number plates issued pursuant to this section if the totalnumberofregisteredowner’sofmotorvehiclesthatobtainthespecialnumberplatesislessthanonehundredfiftywithinthreeyearsofissuanceofthefirstspecialnumberplate.
(i) Nothinginthissectionshallbeconstruedtoapplytoanyplatesissuedpursuanttosection249-9.2.(j) Forthepurposesofthissection,unlessadifferentmeaningappearsfromthecontext,“specialnumberplate”
meansalicenseplatethatrepresentsHaleakalaNationalParkandHawaiiVolcanoesNationalPark.[L2015,c145,§1]
§249-10 Delinquentpenalties;seizureandsalefortax. (a)Anytaximposedbysections249-1to249-13foranyyearandnotpaidwhendue,shallbecomedelinquentandapenaltyshallbeaddedto,andbecomepartof,thedelinquenttax.Theamountofthedelinquencypenaltyshallbeestablishedbythecounty’slegislativebody.IfthedatethatthetaxisdueisaSaturday,Sunday,orlegalholiday,thetaxshallbecomedelinquentattheendofthenextdaythatisnotaSaturday,Sunday,orlegalholiday.Thedirectoroffinancemayrequirethepaymentofanydelinquenttaxandpenaltyasaconditionprecedenttotheregistration,renewal,ortransferofownershipofsuchvehicle.Anyvehiclenothavingthenumberplatesrequiredbysections249-1to249-13,oranyvehicleuponwhichtaxesaredelinquentasprovidedinthissection,maybeseized,whereverfound,bythedirectoroffinanceorbyanypoliceofficer,andheldforaperiodoftendays,duringwhichtimethevehicleshallbesubjecttoredemptionbyitsownerbypaymentofthetaxesdue,togetherwiththedelinquentpenaltiesandthecostofstorageandotherchargesincidenttotheseizureofthevehicle.Thedirectoroffinance,chiefofpolice,oranypoliceofficershallbedeemedtohaveseizedandtakenpossessionofanyvehicle,afterhavingsecurelysealeditwherelocatedandpostedanoticeuponthevehicle,settingforththefactthatithasbeenseizedfortaxesandwarningallotherpersonsfrommolestingitunderpenaltyprovidedbysection249-11.
(b) Allvehiclesseizedandsealedshallremainattheplaceofseizureoratanyotherplacethatthedirectoroffinancemaydirect,attheexpenseandriskoftheowner.Iftheownerofthevehiclefailstoredeemitwithintendaysafterseizure,thevehiclemaybesoldbythedirectoroffinanceatpublicauctiontothehighestbidderforcash,aftergivingtendayspublicnoticeinthecountyandbypostingnoticesinatleastthreepublicplacesinthedistrictwherethevehiclewasseized;providedthattherequirementsofpublicauctionmaybewaivedwhentheappraisedvalueofanyvehicleislessthan$250asdeterminedbythedirectoroffinanceorauthorizedrepresentative,inwhichcasethevehiclemaybedisposedofinthesamemanneraswhenavehicleisputupforpublicauctionandforwhichnobidisreceived.Theamountrealizedatthesale,lesstheamountofthetaxandpenaltydue,togetherwithallcostsincurredingivingpublicnotice,storing,andsellingthevehicleandallotherchargesincidenttotheseizureandsale,shallbepaidtotheownerofthevehicle.Ifnoclaimforthesurplusisfiledwiththedirectoroffinancewithinsixtydaysfromthedateofthesale,thesurplusshallbepaidintothecountytreasuryasagovernmentrealizationandallclaimtothatsumshallthereafterbeforeverbarred.

§249-13 Determinationofrate. [§249-14.1] Numberplatesformopeds;registration. [Section effective January 1, 2017.](a)ThedirectoroffinanceshallcausetobeproducednumberplatesandtagsoremblemsfortheregistrationofmopedsoperatedintheState.
(b) Thedirectoroffinanceshallnumberandregisterthemopedintheowner’snameinapermanentrecordorbooktobekeptbythedirectoroffinanceforthispurpose,andshallfurnishtheownerthereofwithareceiptshowinguponitsfacethelicensenumberissuedforthemoped.Theregistrationofmopedsshalloccuronastaggeredbasisasagreeduponbythecounties’directoroffinance.Theregistrationfeeshallbe$27peryear.Thedirectoroffinanceshallalsofurnishtheowner,upontheoriginalregistrationofthemoped,oneplatewiththeregistrationnumbermarkedthereon.Uponthepaymentofaregistrationfeeforeachyear,atagoremblembearingaserialnumberandthemonthandyearofexpirationshallbeprovidedtotheowner.Transferofcurrentnumberplates,tag,oremblem,exceptasauthorizedbythischapter,ispunishablebyafineofnotmorethan$50foreachoffense.
(c) Uponanoriginalregistrationthedirectoroffinanceshallfix,andshallchargetotheowner,afeeequaltothecostofthenumberplateandtagoremblemplustheadministrativecostoffurnishingtheplateandtagoremblemandeffectingtheregistration.Upontheissuanceofanewseriesofnumberplates,thedirectoroffinanceshallchargetheownerafeeequaltothecostsofthenumberplateplustheadministrativecostoffurnishingtheplate.Uponissuingatagoremblem,thedirectoroffinanceshallchargetheownerafeeof50cents.Theownershallsecurelyfastenthenumberplateontherearofthemopedatalocationprovidedbythemanufacturerorintheabsenceofsuchalocationuponthebumperofthemopedandinconformancewithsection291-31,insuchamannerastopreventtheplatefromswinging.Thenumberplateshallatalltimesbedisplayedentirelyunobscuredandbekeptreasonablyclean.

[§249-14.2] Procedure when registration of a bicycle or moped transferred. (a) Upon transfer of registeredownershipinortoabicycleormoped,thepersonwhoseinterestistobetransferredandthetransfereeshallwritetheirsignatureswithpenandinkuponthecertificateofregistrationissuedforthebicycleormoped,togetherwiththeaddressofthetransfereeintheappropriatespaceprovideduponthecertificate.
(b) Withinthirtycalendardaysofthetransferofregisteredownershipofabicycleormoped,thetransfereeshallforwardthecertificateofregistrationsoendorsedtothedirectoroffinancewhoshallfilethecertificate.Thedirectoroffinancemaychargeafeeof$5whichshallbedepositedintothecountybikewayfundforeachnewcertificateofregistrationissued.Wheneveratransfereefailstocomplywiththeseprovisions,thedirectoroffinanceshallchargeafeeof$10,inadditiontothefeeprovidedinthissection,fortheissuanceofanewcertificateofregistration.
(c) Thedirectoroffinance,uponthereceiptofthecertificateofregistrationproperlyendorsedandtherequiredfee,shallregisterthebicycleormopedandshallissuetotheownerthereofbyreasonofthetransferanewcertificateofregistrationinthemannerandformprovidedforinanoriginalregistration.
(d) Until the director of finance has issued the new certificate of registration as providedby subsection (c),deliveryofsuchbicycleormopedshallbedeemednottohavebeenmadeandregistrationtheretoshallbedeemednottohavepassed,andtheintendedtransfershallbedeemedtobeincompleteandnottobevalidoreffectiveforanypurpose.
(e) Intheeventofthetransferbyoperationoflawinortoabicycleormoped,asuponinheritance,devise,orbequest,orderinbankruptcy,orinsolvency,executionsale,repossessionupondefaultinperformanceofthetermsofaleaseorexecutorysalescontract,orotherwisethanbythevoluntaryactofthepersonwhoseinterest is tobetransferred,thecertificateofregistrationshallbesigneduponthespacesprovidedbythepersonalrepresentativeof,orsuccessorininterestofthepersonwhoseregisteredownershiporinterestissotransferredinlieuofsuchperson.Everypersonalrepresentative,receiver,trustee,sheriff,orotherrepresentativehereinabovereferredtoshallfilewiththedirectoroffinanceanoticeofanytransferbysale,lease,orotherwisebytheperson,ofanysuchbicycleormoped,togetherwithevidencesatisfactory to thedirectoroffinanceofall factsentitlingsuch representative tomake thetransfer.
(f) Anypersonwhorefusesofneglectstodeliveracertificateofregistrationtoatransfereeentitledtheretounderthissection,shallbepunishedasprovidedinsection249-14.6.
(g) Everydealerormanufacturer,upontransferringabicycleormoped,whetherbysale,lease,orotherwise,shallimmediatelygivenoticeofthetransfertothedirectoroffinanceupontheofficialformprovidedbythedirectoroffinance.Everysuchnoticeshallcontain thedateof the transfer, thenamesandaddressesof the transferorandtransferee,andsuchdescriptionofthebicycleormopedasmaybecalledforintheofficialform.
(h) Everyperson,otherthanadealer,upontransferringabicycleormoped,whetherbysale,lease,orotherwise,shallwithintendaysgivenoticeofthetransfertothedirectoroffinanceupontheofficialformprovidedbythedirectoroffinance.Everynoticeshallcontainthedateoftransfer,thenamesandaddressesofthetransferorandtransferee,andsuchdescriptionofthebicycleormopedasmaybecalledforintheofficialform.Anypersonwhoviolatesthissubsectionshallbefinednotmorethan$100.
(i) Whenevertheregisteredownerofabicycleormopedoranydealerormanufacturerhasgivennoticetothedirectoroffinanceofatransferoftheregisteredownershiptothebicycleormoped,asprovidedinsubsection(g)or(h),andhasdeliveredthecertificateofregistrationbearingthetransferor’ssignaturetothetransfereeasrequiredbysubsection(a),thetransferorshallberelievedfromliability,civilorcriminal,whichthetransferormightsubsequentlyincurbyreasonofbeingtheregisteredownerofthebicycleormoped.
(j) Anypersonwho falselyor fraudulentlygivesnotice to thedirectoroffinanceof a transferof registeredownershiptoabicycleormopedshallbesubjecttothepenaltyprovidedinsection249-14.6.[L1998,c188,§1]
§249-14.3 Exemptionfromfeeandtag. (b) ThetaxshallbecomedueandpayableonJanuary1andshallbepaidbeforeApril1ineachyeartogetherwithallother taxesandfees leviedbythischapter;providedthatshouldanycountyelect torenewmotorvehicleregistrations on a staggered basis as authorized by section 286-51, the state vehicleweight tax shall likewise bestaggeredsothatthestatevehicleweighttaxiscollectedtogetherwiththecountyfee.Thestatevehicleweighttaxshallbedeemeddelinquentifnotpaidwiththecountyregistrationfee.Thetaxshallbepaidbytheownerofeachvehicletothedirectoroffinanceofthecountyinwhichthevehicleisregisteredandshallbecollectedbythedirectoroffinanceofsuchcountytogetherwithallotherfeesandtaxesleviedbythischapterfromtheownerofeachvehicleandmotorvehicleregisteredinthecounty.
Bythefifteenthdayofthemonthfollowingthemonthinwhichtaxesunderthissectionarecollected,thedirectoroffinanceofeachcountyshalltransmitthetaxescollectedtothestatedirectoroffinancefordepositintothestatehighwayfund.
(c) Theexemptionsprovidedbysections249-3to249-6shallapplytothissection.Theprovisionsforrefunds,andtaxesforfractionofyearsforvehiclesremovedfromorbroughtintotheStateandforjunkedvehicles,containedinsections249-3and249-5shallapplytothetaxleviedbythissection.
(d) IfitisshowntothesatisfactionofthedepartmentoftransportationoftheState,baseduponproperrecordsandfromsuchotherevidenceasthedepartmentoftransportationmayrequire, thatanyvehiclewithanetvehicleweightofsix thousandpoundsorover isusedforagriculturalpurposestheownerthereofmayobtainarefundofalltaxesthereonimposedbythissection.Thedepartmentoftransportationshallprescriberulestoadministersuchrefunds.
