SUBCHAPTER I: BUILDING CODE

14.01 TITLE. Thissubchaptershall beknown asthe"B uilding C odeof theC ityof B araboo"and willbereferredto in thissubchapteras"thiscode".

14.02 PURPOSE. Thiscodeprovidescertain minimumstandards,provisionsand requirementsforsafeandstabledesign,methodsof construction and usesofmaterials in buildings and/or structures hereaftererected, constructed, enlarged, altered, repaired,moved,converted to otherusesordemolished,andregulates the equipment, maintenance, use and

occupancyof allsuch buildingsand/orstructures.Itspurposeisto protect and fosterthehealth,safety,and well being of personsoccupying orusing suchbuilding,andthegeneralpublic.

14.03 SCOPE. This code shall applyto all newcommercial, industrial and residential buildingsand auxiliary buildings and structures erectedwithin theC ityormovedinto theC ity.It shallalsoapplyto existing buildings when the code soprovides.

(1) N E W B UIL D IN GS. N ew buildingsorstructureshereaftererectedin theC ityshallconform to all the requirementsof thiscode.

(2) E X ISTIN G B UIL D IN GS.Thefollowingspecified requirements shall apply toexistingbuildingswhichdo not conform totherequirementsof thiscode:(a) M ajor_A lterations_and_Repairs.

A lterationsand repairsin excessof50% of thefairmarket valueof anexisting building, not deductingfrom such valueanylosscaused byfireorforanyotherreason,shallcausetheentirebuildingto bemadeto conform to therequirementsofthiscodefornew buildingsorshallbeentirelydemolished.

(b) M inor_A lterations_and_Repairs.E veryalteration or repair to anystructural part of any existingbuildingsshallbemadeto conformto therequirementsof thiscodefornew buildings,except energycodesshall not applyto alterationsandrepairsto existing buildingswherethe cost of such alterations orrepairsislessthan 50% of thefairmarket valueof thebuilding.

(c) C hanged Use.If theexisting useoroccupancyof anyexistingbuildingischanged to a use or occupancywhich will not be permitted in abuildinghereaftererected,theentirebuilding shall bemadeto conformto therequirementsgiven herein fornew buildings,provided,however,that if theuseof occupancyof onlya portion orportionsof anyexistingbuilding is changed, only suchportion orportionsof thebuildingneed to comply with therequirements;and provided furtherthat theB uildingInspectorisherebyauthorizedto approveanychangeinuse or occupancyof an existingbuilding even though such buildingisnot madeto conform fullyto therequirementsof thiscodewhen it is

obviousthat such a changein useoroccupancyof the existing buildingwill not extend or increase anynonconformity or hazard of thebuilding.

(3) M A IN TE N A N C E .The requirementsofthis code covering the maintenance ofbuildingsshall applyto all buildingsandstructures now existing or hereaftererected. A ll buildingsand structuresandall partsthereof shall bemaintained in asafe condition and all safeguards anddevicesthat arerequiredbythiscodeat theerection,alteration orrepairof anybuildingshallbemaintainedin goodworkingorder.Theprovisionsof thiscodeshall not beconstrued as permitting the removal ornon-maintenance of any devices orsafeguardsunlessauthorized in writing bytheB uildingInspector.

14.04 ORGANIZATION AND ENFORCEMENT

(1) D E P A RTM E N T O F B UIL D IN GIN SP E C TIO N .Thereisherebyestablisheda department of theCityto beknown astheD epartment of B uildingInspection andshallinclude a B uilding Inspector,a P lumbingInspector,an E lectrical Inspectorand suchotherinspectors,assistantsand employeesastheC ouncilmayfrom timeto timeappoint.A nyandallof suchofficesmaybecombinedand held by the same person. TheD epartment of B uilding Inspection shall beresponsible for the supervision of theplumbing,electricalandbuildingcodesof theCity,the safetyinspection of all premisesincluding structures and appurtenanceslocated thereon,and theenforcement of theZ oningC ode.

(2) B UIL D IN G IN SP E C TO R.

(a) A ppointment. See§1.03(7)of thisC ode.

(b) Q ualifications. The B uildingInspectorshall havethenecessaryability to supervise the generalconstruction of building and thepermanent equipment of buildings.H eshall havean officein theC ityH all and shall not be financiallyinterested, either directly orindirectly in the construction ofbuildings,orin thepreparation ofplansand specificationsthereof,orpermanent equipment. TheB uildingInspectorshallbecertifiedfor inspection purposes by theD epartment of C ommerce,Safety,and B uildingsD ivision and bytheD epartment of H ealth and Social

Services in the category ofplumbing.H issubordinates,if any,shallalso beso certified.

(c) P owers_and_D uties. E xcept asotherwiseprovided in thischapter,theB uilding Inspector shall have thegeneralmanagement and controlof allmatterspertaining to theD epartmentof B uilding Inspection and shallenforceall Statelaws,thisC odeandother lawful orders and regulationsrelatingto theconstruction,alterations,repair,removaland safetyof buildingsand structures, and permanentequipment. Such Inspector or anyproperlyauthorized deputyorassistantshallhavethepowerandauthority,at allreasonable times, for any properpurpose,to enterupon anypublic orprivatepremisesand makeinspectionsthereof and to requiretheproductionof the permit for any building,electrical orplumbing work requiringlicense therefore. A ny personinterfering with the said Inspectorwhile in performance of the dutiesprescribed in thischaptershall forfeitand pay to the City the penaltyhereafter provided. The B uildingInspector may refuse to approveconstruction in anycasein which theworkmanshipisnot of a workmanlikecharacter.In casethedefectiveworkissatisfactorilycorrected,he maythenissuetherequiredapproval.

(d) Records_and_Reports. TheB uilding Inspector shall keep arecord of all applications forbuilding permits in a book andregularlynumbereach permit in theorderof itsissue.H eshall keep arecord showing the number,description and sizeof allbuildingserected during the term of hisoffice, indicating the kind ofmaterialsused and thecost of allbuildingsof thevariousclasses.H eshallkeepa recordof allinspectionsmade. H e shall make monthlyreportsand an annualreport to theC ouncilof theabovematter.

(e) Inspections. N o structural portion ofanypart of anybuilding orstructureshall becovered orconcealed in anymannerwhatsoeverwithout havingtheapproval of the B uilding Inspector.Such approvalshallbegiven onlyafteran inspection hasbeen madebytheB uilding Inspector followingnotification bythepermit holderorhisagent. If anyportion of thework is

not approved by the B uildingInspector,the permit holder or hisagent shall be notified wherein thesamefailsto complywiththischapter.

(f) Inspection_P owers. The Inspectorsprovided forin thischaptershallhavethe power and authority at allreasonable time, for any properpurpose,to enterupon anypublic orprivatepremisesand makeinspectionthereof and to requiretheproductionof the permit for any building,electrical or plumbing work or torequirelicensetherefore.A nypersoninterferingwith orrefusingentrancetothe said Inspector while in theperformanceof hisprescribed dutiesshall forfeit and payto theCitythepenaltyhereafterprovided.

14.05 APPLICATION OF STATE CODES. TheUniform D welling C ode– D epartment of Safetyand P rofessional Services(D SP S)Chs.316,320through 325,360 through 366,and 375 through387, the State Flammable Combustible, andH azardousL iquidsC ode–A griculture,Trade,andConsumer P rotection (A TCP ) Ch.93,and theStateW ellD rillingC ode–N aturalResources(N R)812 of the W isconsin A dministrative Code areherebyadopted byreference and the B uildingInspectorshallenforcetheprovisionsthereof.A nyviolation of said codesor amendmentstheretoshall constitutea violation of thiscode,whetherunlawfulbuildingalteration,installation,movingorconstruction involvedisspeciallycoveredbyotherprovisionsof thiscodeornot,andshallrendertheviolator liable to the penaltiescontained herein.A ny future amendments, revisions, ormodificationsof thecodeprovisionsincorporatedherein are intended to be made a part of thischapter.(203912/19/2000,25463/10/2020)

14.06 DEFINITIONS OF TERMS. The buildingtermsin thischaptershallhavethemeaninggiventhem bytheStateB uildingC odeand bycommonusagein thebuildingtrades.

14.07 WORKMANSHIP REGULATED.W orkmanshipin thefabrication,preparation andthe installation of materials shall conform togenerallyacceptedgoodpractice.

14.08 BUILDING PERMITS ANDINSPECTION.

(1) P E RM IT RE Q UIRE D .N o buildingof anykindshall bemoved within orinto theCityand nonew building orstructure,oranypart thereof,shallhereafterbeerected,orground broken forthesame,oranyexisting building,oranypartthereof,enlarged,improved,altered,converted,moved,wrecked,ordemolished,except ashereinprovided,untila permit thereforeshallfirst havebeen obtained bytheowner,orhisauthorizedagent,from theB uildingInspector.

(2) A P P L IC A TIO N . A pplication for a buildingpermit shall bemadein writing upon a formfurnished bythe B uilding Inspector and shallstatethenameand addressof theownerof theland and also the owner of the building ifdifferent,thelegal description of theland uponwhichthebuildingisto belocated,thenameandaddressof thedesigner,theuseto which saidbuildingisto beput,andsuch otherinformationastheB uildingInspectormayrequire.

(3) D E D IC A TE D STRE E T RE Q UIRE D .N obuilding permit shall be issued unlessthepropertyon which thebuilding isproposedto be built abuts a street that has beendedicatedforstreet purposes.

(4) UTIL ITIE S RE Q UIRE D .N o building permitshall be issued for the construction of anyresidential building until sewer and water areinstalled and grading and graveling of thestreetnecessaryto servicethepropertyforwhich thepermit isrequirediscompleted,anda receipt forpayment of electricalhook-upispresentedto theB uilding Inspector.N o building permit shall beissued fortheconstruction of anybuilding otherthan residentialuntil contractshavebeen let forthe installation of sewer, water,grading andgraveling in thestreetsnecessaryto servicethepropertyforwhich thepermit isrequested.N operson shall occupyanybuilding until sewer,water,grading and graveling areinstalled in thestreetsnecessaryto servicethepropertyand acertificateof occupancyshallnot beissued untilsuchutilitiesareavailableto servicetheproperty.If sewer and/or water are not available,nopermit shallbeissueduntila welland/ora septictankorholdingtankpermit hasbeen issued.

(5) P L A N S.W ith such application there shall besubmitted a complete set of plans andspecifications,includinga plot plan showingthelocation of theproposedbuildingwithrespect toadjoiningroads,highways,streets,alleys,lot linesand buildings.P lansforbuildingsinvolving theState B uilding C ode shall bear the stamp ofapprovalof theStateD epartment of C ommerce.O neplan shallbesubmitted which shallremainon filein theofficeof theB uildingInspector.A llplansand specificationsshall besigned bythedesigner. P lans for all new 1- and 2-familydwellingsshall complywith theprovisionsofComm.C hapters20-25.

(6) A P P RO V A L O F P L A N S. If the B uildingInspector determines that the building willcomplyin everyrespect with all ordinancesofthe C ity and all applicable laws andadministrativerulesof theState,heshallissueabuilding permit which shall state the use towhich said building isto beput.A fterbeingapproved,theplansandspecificationsshallnotbealtered in anyrespect that involvesanyofthe above-mentioned ordinances, laws oradministrative rules, or which involves thesafetyof thebuildingoroccupants,except withthewritten consent of theB uilding Inspector.In caseadequateplansarepresentedforpart ofthebuildingonly,theB uildingInspector,at hisdiscretion,mayissuea permit forthat part ofthe building before receiving the plansandspecificationsfortheentirebuilding.

(7) GRA D E S.N o work shall commenceuntilthepropergradeshavebeen reviewed bytheC ity E ngineer, including the grade forsidewalks, streets, sewer and generalconstruction.

(8) P O STIN G O F P E RM IT. The buildingpermit shallbeposted on thebuildingsiteinplain view.

(9) W A IV E R O F P L A N S. If the B uildingInspectorfindsthat thecharacterof theworkissufficientlydescribed in theapplication,hemaywaivethefiling of plansforalterations,repairsormoving.

(d) Fees shall be based upon thephysical value of the work to bedone,based on current costs,asdetermined by the buildinginspector.

(e) A ll permit feesshall bedoubled ifwork commences before therequired permitsareobtained,andtheproperfeesarepaid.Thefeesshall bedoubled foreach violationand everydaya violation occursorcontinuesshallconstitutea separateoffense.

(11) M IN O R RE P A IRS A N DA L TE RA TIO N S.TheB uilding Inspectormayauthorizeminorrepairsoralterationswhich do not changetheoccupancyarea,structural strength, fire protection, exits,light or ventilation of the building andwhich cost is less than $350 withoutrequiringa buildingpermit to beissued.

(12) IN SP E C TIO N O F W O RK.ThebuildershallnotifytheB uildingInspectorwhen readyandthe B uilding Inspector shall inspect allbuildings upon the completion of thefoundation forms,orbeforethefoundation islaid,andagain when readyforlathandplaster,or before paneling is applied. A ftercompletion,heshallmakea finalinspection ofall new buildings, alterations, and existingbuildingsput to new uses.If hefindsthat theworkconformsto theprovisionsof thiscode,heshallissuea certificateof occupancywhichshall contain thedateand theresult of suchinspection,a duplicateof whichshallbefiledintheofficeof theB uildingInspector.

(13) P E RM IT L A P SE S.A building permit shalllapseand bevoidunlessbuildingoperationsare commenced within 6 months,or nosignificant progresshasbeen madewithinoneyear,from thedateof issuancethereof.

(14) STO P O RD E R.If theB uilding Inspectorshall find at any time that applicableordinances, laws, orders, administrativerules,plansandspecificationsarenot beingcomplied with and that theholderof the

permit refused to conform after writtenwarning orinstruction hasbeen issued tohim,heshallrevokethebuilding,electricalor plumbing permit by written noticeposted at thesiteof thework.W hen anysuch permit isrevoked,it shallbeunlawfulto do anyfurtherworkthereunderuntilthepermit isreissued,except such workastheB uilding Inspectormayorderto bedoneasa condition precedent to there-issuanceof thepermit of ashemayrequireforthepreservation of human lifeandsafety.

(15) RE P O RT O F V IO L A TIO N S.ThepoliceorotherC ityofficersshallreport at oncetotheB uilding Inspectoranybuilding whichisbeing carried on without a permit asrequiredbythischapter.

14.09 CERTIFICATES OF OCCUPANCY.

(1) CE RTIFIC A TE RE Q UIRE D . Uponwritten request from the owner or hisrepresentative,oron hisown initiative,theB uildingInspectorshallissuea certificateof occupancyforall new buildings or premises or part thereofhereafter created,constructed,erected,changed,converted or enlarged after verification byinspection of structuralcondition,plumbing,wiringand firehazards,bytheproperCityauthorities;provided that,at thetimeof theissuanceof thecertificate,thereareno violationsof thiscode,Statelaw ororderspending. N o building orstructureshallbeoccupiedorused,in wholeorin part,untila certificateof occupancyshallhavebeen issuedbytheB uildingInspectorandpostedon thepremises;statingthepurposeforwhich thebuildingmaybeused in itsseveral parts;in addition,theB uildingInspector mayin the interest of safety,specifypermissible live loadson the several floors,thenumberof occupantsthat maybeaccommodatedon theseveralfloorsin casesuch numberislimitedbyanyprovisionsof anylaw orbythepermit,andallspecialstipulationsof thepermit,if any.

(2) TE M P O RA RY C E RTIFIC A TE O FO CCUP A N C Y .Upon request of theholderof a permit or the owner, the B uildingInspectormayissuea temporarycertificateofoccupancyforpart of a building orstructureor,in caseof a residence,thewholebuilding;provided that such temporaryoccupancyoruse would not jeopardize life or property.Such permit shallnot beissuedformorethana period of 6 monthsand mayforcauseberenewedonceforan additional6months.

(3) CE RTIFIC A TE O F CH A N GE O FO CCUP A N C Y .N o changeof occupancyof abuildingorstructureshallbemadethat isnotconsistent with thelast issued certificate ofoccupancy for such building or structureunlessa new certificateof occupancyisissued.The occupancyof a building or structures

shallnot bedeemed to havechanged becauseof a temporary vacancy or change ofownershiportenancy.There-establishment ina building or structure,after a change ofoccupancyhasbeen made,of a priorusethatisnot permittedin a new buildingorstructureof thesametypeof construction isprohibited.Thechangefrom a specificallyprohibited useto anotherspecificallyprohibiteduseshallnotbemade.

(4) ISSUA N C E O F C E RTIFICA TE O FO C C UP A N C Y .A certificateof occupancyshallbeissuedwithin 5daysaftera writtenapplication therefore if the building orstructure,at thetimeof such application,shall be entitled thereto. C opies ofcertificatesof occupancyshallbefurnished,upon request, to persons havingproprietary interest in the buildingstructure.

14.10 STRUCTURAL REQUIREMENTS NOTCOVERED BY STATE CODES

(1) FO O TIN GS A N D FO UN D A TIO N S.Footingsand foundationsshall beplacedon level undisturbed earth that issuitableforbuilding and in all casesshall extendbelow thefrost line,herebydetermined tobe4 feet below finished grade,with thefollowingexceptions:

(a) Unattached residential framegarages and accessory buildingsshall havethefoundation extendednot lessthan 18inchesbelow grade.

(b) B uildingsdesignedforand usedforunheated warehouses where thebuildingconstruction isof steelandthe planshavebeen approved bytheD epartment of Industry,L aborand H uman Relations for thatoccupation intended may besupported bya suitablydesignedreinforced concreteslab,which hasbeen approved bytheD epartmentof Industry, L abor and H umanRelations.H owever,if thepurposeoruseof thestructureischanged,then compliance must be madewith the State and local building

requirementsapplicableto thenewuseorpurpose.

(c) A one-storybasement-lessdwellingof brick veneer construction mayhave the concrete slab laid on afoundation consisting of 10 inchconcreteblockslaid on 10 inch by22 inch footing, the bottom ofwhich shallbeat least 4feet belowgradelevel.

(d) W herea porch having 30 ormoresquarefeet of floorspaceisto beaddedto a dwellingin an R-lorR-2Residential D istrict, it shall beerected on a foundation consistingof an 8inch byl6inch footing andan 8inchpouredconcretewalloran8 inch concreteblock wall filled toground level on both sidesof wall,thebottom of thefooting being 4feet below grade and such porchshall conform to thestructural andsetback requirementsapplicable tothe house itself. The aboverequirementsshallalso applyto anyexisting porch before permissionwill be granted to enclose itpermanently.

(e) C oncretefootingsmaybeplaced ina trench without forms,providedsoil is of a stable condition.Foundation walls over 4 foot inheight shall bereinforced with notlessthan 4continuous#4orlargerre-bar, with 2 continuous barsplaced a minimum of 12 inchesabovebottom of wall,and2contin-uousbarsnot morethan 24inchesbelow topof wall.In no caseshallthe concrete for anyfooting orfoundation wallbepoured untiltheexcavation or forms have beeninspected and approved by theB uildingInspector.(165609/92)

(f) N o trench for sewer or otherexcavations shall be made belowanyfoundation wall nearerthan 3feet to anyinside corner of saidfoundation.N o trench forsewerorother excavations shall be madenearer to any column or pierfooting than l-l/2 timesthedepthof theexcavation below thebottomof thefooting.

(g) W hen masonryunitsare used forbasement walls below grade, theexterior surface shall be plasteredwith not less than l/4 inch ofP ortland cement plaster with a 3-

inch radius cover before theapplication of the requiredwaterproofing. W aterproofing shallbedonein an approvedmannerwithacceptablematerials.

(h) C oncreteblocksortilewallsshallbebonded with corrosion resistantmetal, D ur-A -W all or equal, atvertical intervals not exceeding 3courses.Thebonding materialshallbelapped at theendsnot lessthan4 inches and shall extendcontinuouslyaroundthebuilding.

(i) Foundation walls for frameconstruction shall extend at least 8inchesabove the adjacent groundsurface.

(j) A n outsidemeansof accessshallbeprovided to thecrawl spaceunderbasement-less buildings, whichopening shall benot lessthan 24inchesin width and 18 inchesinheight.

(k) A llexcavationsshallbegradedlevelunless otherwise required in theapproveddesign.

(2) FL O O R C O N STRUC TIO N .

(a) W here remodeling work is beingdone upon an existing buildingwhose floors are supported bywood beamsorgirders,eithersolidor built-up, there shall be nocutting,boring,notchingorpiercingof thosemembers.

(b) E ntering_M asonry_or_C oncrete.E ach wood member enteringmasonryorconcretewallsshall bebeveled so that thetop edgedoesnot enterthemasonryorconcretemorethan oneinch.

(c) E xterior_D ecks_or_B alconies. Joistsor beamsexposed to the elementsshallbemadeof heartwood,cedarorredwood,orpressuretreated lumberof sufficient size for the purposeintended.

(d) Concrete_Slab_Floor. W here anunsupported slabof concreteisto beused as a floor in anybuilding orstructure, such slab shall not beallowed unlessit hasbeen designedbya registered architect orengineer,except that an open accessorybuildingconsistingof a floorand roof,withoutsidewalls,such asa shelterhouse,with

not morethan 700squarefeet of floorspace,maybeconstructed on a 4inchconcreteslabwith thickenededgesandreinforced with wire mesh weighingnot lessthan 40poundsper100squarefeet.

(3) E X TE RIO R W A L L S. A ll frame buildingsexcept garages and accessory buildings,whethersided with wood siding,shinglesorbrick veneer,shall have the exterior wallssolidlysheathedwithoneof thefollowing:

(a) W ood sheathing shall not be lessthan 3/4 inchesin thicknessandnot morethan 10 inchesin width,doublenailed on each stud.W henwood sheathing is applieddiagonally,boardsshall extend at

45 in opposite directions fromeachcorner.

(b) P lywood,when used for exteriorwallsheathing,shallnot belessthan3/8inchesin thicknessand maybe3-plyinteriorC D orbettergrade.

(c) O neinch styrofoam maybeused,provided that adequate cornerbracingisapplied.

(d) Fiberboard sheathingshallbea boardtreated with asphalt or other waterrepellent and of a type definitelyapproved by the D epartment ofCommerceand theN ational B oard ofFireUnderwritersand shallnot belessthan 25/32 inches in thickness. Ifplywood corners are used, ½ inchthicknessmaybesubstituted in lieu ofthe 25/32 inch. Reflective solidfiberboard sheathing shall bea water-resistant laminated wood fiberboard,1/8 inch nominal thickness. B rightaluminum foil shall be bounded toboth faces.M aterialshallbeadequatelytreated to prevent waterpenetration atexposed edges and shall be ofsufficient strength to meet rackingresistance requirements of FH ATechnical B ulletin N o. 12. Cornerbracingmaybeomittedonlywhen thisboard isapplied in 4 by9 foot sheetsorof a sizesufficient to extend downto thetopof thefoundation wall.

(e) A ll exterior walls where boards,shiplap or other non-waterproofsheathing isused shall becoveredon theoutsidefacewith at least onelayerof waterproof building paperor asphalt saturated felt weighingnot lessthan 15poundspersquare,

applied and nailed shinglefashionwith horizontal joints lapped notless than 4 inches. Slips ofwaterproofing building paper orasphalt felt at least 6 incheswideshallbeinstalled behind allexteriortrim of exterioropenings.

(f) A ll openings4 feet wide or lessininteriorandexteriorbearingwallsshallbeprovided with doubleheadersnotlessthan 2inchesthickplacedon edgeand fastened securelytogether, andsuch headersshall have2 inch solidbearingto thefloororbottom places.A ll headersand lintelsoveropeningsin exterior bearing wall in masonryconstruction shall be of steel orreinforced concreteormasonryof thepropersize.

(4) RO O FIN G.

(a) The minimum ordinary roofcovering shallbeanyroof coveringwhich meets the requirementsspecified for the C lass "C "Specificationsof theUnderwriter'sL aboratories,Inc.W heneveranordinarycomposition roof isused,whetherrollroofingorshingles,theroof sheathing shall be solid. Adoublestartingrow shallbeusedonall shingleapplications.Gableandrakecornersshallprovidea weathertight joint. Fastenersforattachingroof coveringsshallbeof corrosionresistant material acceptableto theB uildingInspector.

(b) FireUnderwriterC lassA ,B orCshall appear on each bundle ofasphalt shingles.

(c) The minimum slope upon whichasphalt shingles shall be appliedshallbe4:12except on porchesthatmayhavea slopeof only3:12.

(d) The minimum weight of asphaltshinglesshall benot lessthan 235poundsper100squarefeet on newwork and 190 pounds per 100squarefeet when laid overexistingroofing.A llasphalt shinglesshallbeof a seal-down type.Theexposureshall be as required for FireUnderwritersClassC label and thelapshallbeasrecommended bythemanufacturer.O n thenew work oron re-roofing work wheretheoldroofing has been removed, anunderlayof asphalt saturated feltweighing not lessthan 15 pounds

per 100 square feet shall be laidunder all shingles, except whentriple thickness of shingles isprovided at all points.V alleysshallbe flashed with sheet metal or 2thicknesses of mineral surfacedroofing,but from rollsweighingnotlessthan 90poundsper100squarefeet.Thebottom sheet shall benotlessthan 12incheswideandthetopstripshallbenot lessthan 18inchesin width.

(e) N o roof shallbecoveredwith morethan 2layersof anytypeof doublecoverageroofing.W henevera roofisto be re-roofed,when 2 layersexist,all such roofing shall first beremovedto thesheathing.

14.11 GARAGES.

(1) L O C A TIO N .

(a) A n attached garage is one that isconstructed asan integral part of thehouse or isin the basement of thehouseorwhich isso situated that anyportion of it lies in front of animaginarylineextendingacrossthelot,said linebeing 5 feet in back of andparallel to the rearmost portion orrearmost faceof thehousewhetherthegarageisconnected to thehousebyabreezewayordetachedfrom thehouse.A ll such attached garages shall besubject to the rules,regulationsandrestrictions relative to the distancefrom rearlot linesthat applyto thehouseproper.Framing of an attachedgarageshall beconsistent with that ofthedwelling of which it isa part.Aminimum fire resistant wall shall beconstructed between an attachedgarageand thedwelling to which it isattached, in compliance withD epartment of Commerce21.08 andTable21.08.

(b) A detached garage, no part ofwhich lieslessthan 5 feet back ofand5feet awayfrom therearof thehouse,maybeerected within 3feetfrom thesideorrearlot line,thisdistanceto bemeasured from theouteredgeof theeavesordripandnot from thefoundation.

(c) Regardlessof thebuilding setbacklinefrom anystreet line,no garageor carport, whether attached ordetached, shall be located closerthan 25feet to anystreet line.(147811/10/87)

(i) A fabricated wood beam of suchdesign to meet the loadingrequirements, subject to theapprovalof theB uildingInspector.

14.12 BUILDING_IN_BUSINESS_DISTRICT.

(a) N o new building or structure ofwood orothercombustiblematerialsshall beerected within thebusinessdistrict; no existing building orstructurewhoseoutsidewallsareofwood ormasonryveneeroverframeconstruction shall be added to,enlarged,improvedorchangedwithinthe business district; no existingbuilding orstructureof combustiblematerials now located within thebusiness district shall be moved,except it maybemoved outsideofthebusinessdistrict;no such buildingor structure of combustibleconstruction shall bemoved into thebusinessdistrict;and no combustiblematerialsshallbefastened to orusedon anyoutsidewallof anybuildingorstructure now existing or to beerectedin thefuture.

(b) W here store fronts are hereaftererected on new buildings orstructuresorarebeing replaced onexisting buildingsorstructures,theconstruction shall include onlynoncombustible materials and nocombustiblematerialsshallbeused,except in accordancewith C omm.51.02(15).

(c) N othing in this section shall beconstrued asprohibiting theuseofcombustible materials inside storebuildings such as display windowfloor and backing, shelving anddisplaycases.Therestrictionsof thisparagraph,prohibitinguseof woodorothercombustiblematerials,shallnotapply to single- family residenceproperty located in the businessdistrict provided that no commercialuse ismade of said property,andprovided that all otherrequirementsof thischapterand theZ oning Codearecompliedwith.

(3) RO O FS. A ll buildings or structureshereafter constructed within the saidbusiness district shall have roofs ofapproved materials equal in restrictingqualityto C lass"A " orClass"B " of theN ational FireUnder-writersspecifications.Topsand sidesof dormerwindowsshallhavethesamecoveringastheroof,in fireresistivequality.

(4) RE P A IR TO W O O D E N B UIL D IN GSD A M A GE D .N o wooden buildingsorpartof a wooden building within the businessdistrict which mayhereafterbedamaged byfireortheelementsto theextent of 50% ofthefairmarket valuethereof shallberepairedor rebuilt nor shall such building, whendamagesarelessthan 50% of itsfairmarketvalue,beso repaired asto beraised higherthan thehighest part left standingaftersuchdamage shall have occurred or so as tooccupya greater space than before thedamagethereto.

14.13 PRIVATE_SWIMMING_POOLS. N o personshall construct, install or enlarge a residentialswimming pool not enclosed in a permanentbuildingin theC ityexcept in accordancewith thefollowingregulations:

(1) D E FIN ITIO N ."Swimmingpool"meansanydepression in theground,eithertemporaryorpermanent,or a container of water,eithertemporaryorpermanent and eitheraboveorbelow theground,in which watermorethanl8inchesdeepiscontained andwhich isusedprimarily for the purpose of bathing orswimming.

(2) P E RM IT.(a) Required. N o person shall

construct,install,enlarge or alteranyprivateswimmingpoolunlessapermit therefore has first beenobtained from the B uildingInspector.

(b) A pplication.A pplication shall beonforms provided by the B uildingInspectorand shall beaccompaniedbyplansdrawn to scaleshowing thefollowing:

1. L ocation of pool on lot,distancefrom lot linesanddistancefrom structure.

2. L ocation of anyseptictank,filter bed and sewer andwaterlines.

3. P ool dimensions andvolumeof waterin gallons.

4. L ocation of proposed fence,andtype,sizegatelocation.

5. E xisting overhead wiringrelativeto proposedpool.

(c) Fees. See §14.08(10) of thischapter.

(3) C O N STRUC TIO N RE Q UIRE M E N TS.

(a) N o pool shall belocated,erected,constructed ormaintained closertoanysideorrearlot linethan allowed

by C h. 17 of this C ode forpermitted accessorybuilding uses,and thewaterlineof anypool shallnot belessthan 10feet from anylotlineorbuilding.

(b) N o connection shallbemadeto thesanitarysewerorsepticsystem.

(c) W here topography requires, apermanent wall of concrete,masonryormaterial approved bytheB uildingInspector shall be constructed toprevent ground and fill from spillingonto adjoiningproperty.

(d) Gaseouschlorination systemsshallnot be used for disinfecting poolwaters.

(e) N o above-ground poolshallbelessthan 5feet from anysepticsystem.

(4) FE N C E S A N D C O V E RS. (250210/09/18

(a) A ll swimming poolsnot enclosedwithin a permanent building shallcomplywith one or both of thefollowing:(i) B e completelyenclosed byafence of sufficient strength toprevent accessto thepool,not lessthan 5 feet in height and soconstructed asnot to havevoids,holes or openings larger than 4inchesin onedimension.Gatesordoorsshall beconstructed so astobe capable of being locked,andshallbeclosed and secured so astoprevent unlatching by personsoutsidethepool at all timeswhenthe pool is not in actual use.A bove-ground pools withself-provided fencing to preventunguarded entryshall bepermittedwithout separateadditionalfencing,provided theself-provided fenceisof theminimum height and designas herein specified. P ermanentaccessfrom gradeto above-groundpools having stationary ladders,stairsorrampsshallhavesafeguardfencing and gates equivalent tothoserequired herein,subject to allother applicable ordinances andsubject to thefollowing:

1. N o fence shall be located,erected, constructed ormaintainedcloserthan 3feetto a pool.

2. The wall of the house orbuilding facing a pool maybeincorporated as a portion ofsuchfence.

(5) P O RTA B L E P O O L S.P ortable poolsoveronefoot in depth must befencedasprovidedin sub.(4)above,orbedrained orcoveredaftereach day'susein such a mannerastoprovidepublicsafety.

(6) E L E C TRIC A L RE Q UIRE M E N TS.

(a) To_C omply_W ith_E lectrical_Codes.A ll electrical installationsshall requireseparatepermitsandshallbegovernedbytheC ityE lectricalC ode.

(b) P ool_L ights.If overhead flood orother artificial lights are used toilluminate the pool at night,suchlights shall be shielded to directlight onlyon thepool.

(7) O P E RA TIO N O F P O O L .N o pool shallbeso operated asto createa nuisance,ahazard oran eyesoreorotherwiseto resultin a substantial adverse effect onneighboringproperties.

14.14 CANOPIES_AND_MARQUEES. A nypermanent canopyormarqueeerected hereafteron anybuilding shall conform to thefollowingprovisions:

(1) L O C A TIO N .N o canopyor marquee shallhavelessthan 10feet clearbetween thegradeof thesidewalk at anypoint and thelowestpoint of anyprojection orappendageof anysuch canopyormarqueeand no part of anysuch canopyormarqueeshall extend furtheroverthestreet than a point 3feet backon theback edgeof thecurb.A nysuch canopyormarqueeshallbesuspendedfrom thebuildingwith no supportsrestingupon thesidewalkorpublichighway.

(2) M A TE RIA L S. C anopies and marqueesshall be constructed of incombustiblematerialsthroughout,shallslopeand draintoward thebuilding and shall beprovidedwith conductors connected in such amannerthat no waterisdischarged on anysidewalk.

(3) SIGN S.A nysign orotherappendageof atemporaryor permanent nature shall berigidlyattached to thecanopyormarqueein a manner approved bythe B uilding

Inspectorandswingingsignsoraccessoriesof anynatureareprohibited.

14.15 RADIANT_HEATING_UNITS.

(1) D E FIN ITIO N ."Radiant heatingunit"isaroom heater, stove or free standingfireplacenot intendedforduct connectionsused to heat a room orroomsusing thecombustion of such solid fuelsaswood orcoalasa sourceof heat.

(2) P E RM IT RE Q UIRE D . It shall beunlawfulforanyperson to installorcauseto beinstalled anyradiant heating unit inthe Citywithout first having obtained apermit from theB uildingInspector.

(3) A P P L IC A TIO N FO R P E RM IT.A pplication fora permit shallbemadeon aform provided bytheB uilding Inspector.The following data should be submittedwiththeapplication:

(a) The manufacturer's installation,maintenance and operationsmanual, and the manufacturer'sapprovalnumber.

(b) Typeandsizeof chimney.(c) Theproposed chimneyflueornew

chimneyfluesize.(d) The number and size of existing

vent connectionsto the chimneyflue.

(e) Thelocation of theheatingunit andthe fire resistant coveringsto beused, all of which shall be incompliance with C omm. Table23.04A .

(4) ISSUA N C E O F P E RM IT. Uponexamination of the application andaccompanying data by the B uildingInspector,the Inspector shall determinewhether or not the installation of theradiant heating unit complies with therequirements of this section and,if so,issue the permit; if not, the B uildingInspectorshallstate,in writing,hisreasonsfornot issuingthepermit.

(5) IN SP E C TIO N .N o person mayoperateorpermit theoperation of a radiant heatingunit until the B uilding Inspector hasinspected and approved the installationthereof.

14.16 NEW METHODS AND MATERIALS. A llmaterials,methodsof construction and devicesdesignedforusein buildingsorstructurescoveredbythiscodeand not specificallymentioned in orpermitted bythiscodeshall not beso used untilapproved in writing bytheStateD epartment ofC ommerce. Such materials, methods of

construction and devices,when approved,mustbeinstalled orused in strict compliancewith themanufacturer's specifications and anyrules orconditions of use established by the StateD epartment of C ommerce.Thedate,testsandotherevidencenecessaryto provethemeritsofsuch material,method of construction ordeviceshall bedetermined bytheStateD epartment ofC ommerce.

14.17 RESERVED.

14.18 FENCES.

(1) P E RM IT RE Q UIRE D .N o person shallconstruct a fencein theC ityuntila permitisobtainedfrom theB uildingInspector.

(2) A P P L IC A TIO N ;FE E .A pplication for apermit shall be filed with the B uildingInspector on a form sup-plied by theInspector, together with a sketch of theproposed fence and the payment of therequiredfee.

(3) GE N E RA L RE Q UIRE M E N TS.(a) N o fencealong propertylinesshall

beconstructed morethan 6 feet inheight and no morethan 4 feet inheight in thestreet yard.(Seealsovision clearance requirements forcornerlotsin C h.17of thisC ode.)

(b) A nyperson buildinga fenceon thepropertyof another person shallmove said fence to its correctlocation within 30 days afterdiscoveryof theencroachment.

(c) A ny fence constructed shall beconstructed a minimum of 4inchesfrom the property line on thepropertyof theperson constructingthefence.N o barbed wirefencingshallbepermitted in anyresidentialdistrict.A sketch showing thetypeof fence,location of cornersandthe spacing of posts shall besubmittedto theB uildingInspectoralong with the building permitapplication.

(d) M aximum spacingof postsshallbe12feet. P osts shall be of a durablematerial and shall be adequatelyanchored in theground in accordancewith good building practices.W oodpostsshallbetreated.

(e) In agricultural districts, a properfence maybe constructed on thepropertylineprovidingalladjoiningpartiesagreeto said fenceand saidfenceisconstructed in accordancewithStatelaw.

(f) Temporaryfencesmaybeerected invariousplacesif properlymaintained.Such fencesincludesnow protectionfences,fencesprotectingconstructionand fences temporarily protectinghazardouslocations.

(g) Security fences are permitted onpropertylinesin all districts,exceptresidential districts, but shall notexceed 10feet in height and shall beof an open typesimilarto woven wireor wrought iron fencing. (230004/14/2009)

(h) Thesmooth-finished sideof thefencemust faceneighboring properties or public rights-of-way,rather than the fenced property. A ll structuralmembersareto beon theinteriorsideof thefence,facing the propertyof the fence owner. (245401/24/2017)

14.19 UNSAFE_BUILDINGS. W henever the B uildingInspectorfindsanybuildingorpart thereof within theCityto be,in hisjudgment,so old,dilapidated orsoout of repairasto bedangerous,unsafe,unsanitaryorotherwiseunfit forhuman habitation,occupancyoruse,andso that it wouldbeunreasonableto repairthesame,heshallordertheownerto razeandremoveitat theowner'soption.Such orderand proceedingsshallbecarried out in themannerprescribed fortherazing of buildingsin §66.05,W is.Stats.W herethepublicsafetyrequiresimmediateaction,theB uildingInspectorshall enterupon thepremiseswith suchassistanceasmaybenecessary,andcausethebuildingorstructureto bemadesafeorto beremoved,andtheexpensesof such workmayberecovered bytheCityin an action against theownerortenant.

14.20 MOVING_BUILDINGS. See C h.8 of thisC ode.

14.22 VIOLATIONS_AND_PENALTY.

(1) FO RFE ITURE A C TIO N .A nyperson whoviolates,disobeys,neglects,omitsorrefusesto comply with, or who resists theenforcement of anyof theprovisionsof thischapter shall be subject to a penaltyasprovided in §25.04 of this Code. The

B uilding Inspectorshall promptlyreport allsuch violationsto a police officer,and apolice officer shall issue a citation to theviolator.E verydaya violation occursshallconstitutea separateoffense.

(2) A C TIO N TO A B A TE . A ny building orstructurehereaftererected,enlarged,altered,repaired or moved, or any use hereafterestablished, in violation of theprovisionsofthis chapter shall be deemed an unlawfulbuilding, structure or use. The B uildingInspector shall promptly report all suchviolations to the CityA ttorney,who shallbring an action to enjoin the erection,enlargement,alteration,repairormoving ofsuchbuildingorstructureof theestablishmentof such use, or to cause such building,structureoruseto beremoved and mayalsobesubject to a penaltyasprovided in §25.04of thisC ode.In anysuchaction,thefact that apermit was issued shall not constitute adefense.C ompliancewith theprovisionsofthis chapter may also be enforced byinjunctional orderat thesuit of theownerorowners of any real estate within thejurisdiction of thischapter.

SUBCHAPTER II: CONSTRUCTION SITEEROSION CONTROL CODE (162610/08/91,228105/27/08,243209/08/15)

14.23 AUTHORITY.

(1) This ordinance is adopted under theauthoritygranted by§62.234, W is. Stats.Thisordinancesupersedesall provisionsofan ordinance previously enacted under§62.23, W is. Stats., that relate toconstruction siteerosion control.E x cept asotherwise specified in §62.234 W is.Stats.,§62.23,W is.Stats.,appliesto thisordinanceandto anyamendmentsto thisordinance.

(2) Theprovisionsof thisordinancearedeemednot to limit any other lawful regulatorypowersof thesamegoverningbody.

(3) TheC ommon C ouncilherebydesignatestheB uilding Inspector or C ity E ngineer toadministerandenforcetheprovisionsof thisordinance.

(4) Therequirementsof thisordinancedo notpre-empt more stringent erosion andsediment control requirementsthat maybeimposedbyanyof thefollowing:

(a) W isconsin D epartment of N aturalResources administrative rules,permitsorapprovalsincluding thoseauthorized under §§281.16 and283.33,W is.Stats.

(b) Targeted non-agriculturalperformancestandardspromulgatedin rules by the W isconsinD epartment of N atural Resourcesunder §N R 151.004, W is. A dm.Code.

14.23.1 FINDINGS OF FACT. TheC ommon C ouncilfindsthat runoff from landdisturbingconstructionactivitycarriesa significant amount of sedimentand otherpollutantsto thewatersof thestateinCityof B araboo.

14.23.2 PURPOSE. It isthepurposeof thisordinancetomaintain safeandhealthfulconditions;prevent andcontrol water pollution;prevent and control soilerosion;protect spawninggrounds,fish andaquaticlife;control building sites,placement of structuresand land uses;preserveground coverand scenicbeauty;and promotesound economic growth byminimizing the amount of sediment and otherpollutantscarried byrunoff or discharged fromland disturbing construction activityto watersofthestatein theCityof B araboo.

14.23.3 APPLICABILITY AND JURISDICTION.

(1) A P P L IC A B IL ITY .(a) E xcept asprovided underSub.(b),

this ordinance applied to anyconstruction siteasdefined underSec.14.24(6):

(b) Thisordinancedoesnot applytothefollowing:

1. Transportation facilities,except transportation facilityconstruction projects thatarepart of a largercommonplan of development such aslocalroadswith a residentialorindustrialdevelopment.

2. A construction project that isexempted byfederal statutesor regulations from therequirement to have anational pollutant dischargeelimination system permitissued underCh.40,CodeofFederalRegulations,part 122,for land disturbingconstruction activity.

3. N onpoint dischargesfromagricultural facilities andpractices.

4. N onpoint dischargesfromsilvicultureactivities.

5. Routine maintenance forproject sitesunder5 acresofland disturbanceif performedto maintain the original lineandgrade,hydrauliccapacityororiginalpurposeof thefacility.

(c) N otwithstanding the applicabilityrequirements in paragraph (a), thisordinanceappliesto construction sitesof anysizethat,asdetermined bytheB uilding Inspector or CityE ngineer,are likely to result in runoff thatexceedsthesafecapacityof theexistingdrainagefacilitiesorreceiving bodyofwater, that causes undue channelerosion, or that increases waterpollution by scouring or thetransportation of particulates.

(2) JURISD IC TIO N .Thisordinanceappliestoland disturbing construction activities onlandswithin theboundariesand jurisdictionof theC ityof B araboo,and,optionallytothe public and private lands subject toex traterritorialreview under§§236.45(2)and(3),W is.Stats.

(3) E X CL USIO N S. This ordinance is notapplicableto activitiesconducted bya stateagency,asdefined under§227.01 (1),W is.Stats.

14.24 DEFINITIONS

(1) A D M IN ISTE RIN G A UTH O RITY meansagovernmentalemployee,ora regionalplanningcommission empowered under §62.234,W is.Stats., that is designated by the CommonCouncilto administerthisordinance.

(2) A GRIC UL TURA L FA C IL ITIE S A N DP RA C TIC E S has the meaning in§281.16(1),W is.Stats.

(3) B E ST M A N A GE M E N T P RA C TIC E orB M P means structural or non-structuralmeasures,practices,techniques or devicesemployed to avoid or minimize soil,sediment orpollutantscarried in runoff towatersof thestate.

(4) B USIN E SS D A Y meansa daytheofficeof the B uilding Inspector or C ityE ngineer is routinely and customarilyopen forbusiness.

(5) CE A SE A N D D E SIST O RD E R meansacourt-issued order to halt land disturbingconstruction activitythat isbeing conductedwithout therequired permit orin violation ofapermit issuedbytheC ityof B araboo.

(6) CO N STRUC TIO N SITE means an area

upon which one or more land disturbingconstruction activitiesoccur,including areasthat arepart of a larger common plan ofdevelopment orsalewheremultipleseparateand distinct land disturbing constructionactivitiesmaybe taking place at differenttimeson different schedulesbut underoneplan. A long-rangeplanning document thatdescribesseparateconstruction projects,suchas a 20-year transportation improvementplan,isnot acommon plan of development.

(7) D E SIGN STO RM means a hypotheticaldiscreterainstorm characterized bya specificduration, temporal distribution, rainfallintensity,return frequencyand totaldepth ofrainfall.

(8) D IV ISIO N O F L A N D meansthecreationfrom oneparcelof oneormoreparcelsorbuildingsites,regardlessof size,wheresuchcreation occursat one time or throughsuccessivepartition within a 5-yearperiod.

(9) E RO SIO N meanstheprocessbywhichthe land’ssurface isworn awaybytheaction of wind,water,iceorgravity.

(10) E RO SIO N A N D SE D IM E N TC O N TRO L P L A N means acomprehensiveplan developed to addresspollution caused by erosion andsedimentation of soil particles or rockfragmentsduringconstruction.

(11) E X TRA TE RRITO RIA L means theunincorporated area within 3 milesof thecorporatelimitsof a first,second,orthirdclasscity,orwithin 1.5 milesof a fourthclasscityorvillage.

(12) FIN A L STA B IL IZ A TIO N meansthat allland disturbing construction activitiesat theconstruction sitehavebeen completed andthat a uniform perennialvegetativecoverhasbeen established,with a densityof at least 70percent of thecover,fortheunpaved areasand areas not covered by permanentstructures, or that employ equivalentpermanent stabilization measures.

(13) GO V E RN IN G B O D Y meanstown boardofsupervisors, county board of supervisors,C ommon C ouncil,villageboardof trusteesorvillagecouncil.

(14) L A N D D ISTURB IN G CO N STRUCTIO NA C TIV ITY meansanyman-madealterationof theland surfaceresulting in a changeinthetopographyorexistingvegetativeornon-vegetativesoilcover,that mayresult in runoffand lead to an increasein soil erosion andmovement of sediment into watersof thestate.L and disturbing construction activity

includesclearing and grubbing,demolition,excavating,pit trench dewatering,filling andgradingactivities.

(15) L A N D O W N E R meansanyperson holdingfee title,an easement or other interest inproperty, which allows the person toundertake cropping,livestock management,land disturbing construction activity ormaintenanceof storm waterB M P son theproperty.

(16) M E P or M A X IM UM E X TE N TP RA CTIC A B L E means a level ofperformancethat isachievablebut isnotequivalent to a performance standardidentifiedin thisordinanceasdeterminedinaccordance with Sec. 14.25 of thisordinance.

(17) P E RFO RM A N C E STA N D A RD means anarrativeormeasurablenumberspecifyingtheminimum acceptableoutcomefora facilityorpractice.

(18) P E RM IT meansa written authorization madebytheB uildingInspectororC ityE ngineertothe applicant to conduct land disturbingconstruction activityor to discharge post-construction runoff to watersof thestate.

(19) P O L L UTA N T has the meaning given in§283.01(13),W is.Stats.

(20) P O L L UTIO N has the meaning given in§281.01(10),W is.Stats.

(21) RE SP O N SIB L E P A RTY means thelandownerorotherentityperformingservicesto meet therequirementsof thisordinancethrougha contract orotheragreement.

(22) RUN O FF meansstorm waterorprecipitationincluding rain,snow or ice melt or similarwaterthat moveson thelandsurfacevia sheetorchannelizedflow.

(23) SE D IM E N T meanssettleablesolidmaterialthat is transported byrunoff,suspendedwithin runoff ordeposited byrunoff awayfrom itsoriginallocation.

(24) SIL V IC UL TURE A C TIV ITY meansactivitiesincluding treenurseryoperations,treeharvestingoperations,reforestation,treethinning,prescribed burning,and pet andfirecontrol. C learing and grubbing of anarea of a construction siteisnot a silvicultureactivity.

(25) SITE meanstheentirearea included in thelegal description of theland on which theland disturbing construction activity is

proposedin thepermit application.

(26) STO P W O RK O RD E R means an orderissued bythe B uilding Inspector or CityE ngineerwhichrequiresthat allconstructionactivityon thesitebestopped.

(27) TE C H N IC A L STA N D A RD means adocument that specifies design, predictedperformanceand operation and maintenancespecifications for a material, device ormethod.

(28) TRA N SP O RTA TIO N FA C IL ITY meansahighway,a railroad,a public masstransitfacility,a public-useairport,a publictrail oranyother public work for transportationpurposes such has harbor improvementsunder §85-095(1)(b), W is. Stats.Transportation Facility does not includebuilding sitesfortheconstruction of publicbuildingsand buildingsthat are placesofemployment that are regulated by theD epartment pursuant to §281.33,W is.Stats.

(29) W A TE RS O F TH E STA TE includesthoseportions of L ake M ichigan and L akeSuperiorwithin theboundariesof thisstate,and all lakes,bays,rivers,streams,springs,ponds, wells, impounding reservoirs,marshes,watercourses,drainagesystemsandothersurfacewaterorgroundwater,naturalor artificial,public or private,within thisstateoritsjurisdiction.

14.25 APPLICABILITY OF MAXIMUM EXTENTPRACTICABLE.

M ax imum ex tent practicableappliesw hen a personwho issubject to a performancestandardof thisordinancedemonstratesto the[administeringauthority]’ssatisfaction that a performancestandardisnot achievableandthat a low erlevelofperformanceisappropriate.In makingtheassertionthat a performancestandardisnot achievableandthat a levelof performancedifferent from theperformancestandardisthemaximum ex tentpracticable,theresponsiblepartyshalltakeintoaccount thebest availabletechnology,costeffectiveness,geographicfeatures,andothercompetinginterestssuch asprotection of publicsafetyandwelfare,protection of endangeredandthreatenedresources,andpreservation of historicproperties.

14.26 TECHNICAL STANDARDS.

14.27 PERFORMANCE STANDARDS FORCONSTRUCTION SITE UNDER ONE ACRE.

(1) RE SP O N SIB L E P A RTY .The responsiblepartyshallcomplywiththissection.

(2) E RO SIO N A N D SE D IM E N TC O N TRO L P RA C TIC E S. E rosion andsediment control practices at each sitewhereland disturbing construction activityisto occur shall be used to prevent orreduceallof thefollowing:

(a) Thedeposition of soilfrom being

trackedonto streetsbyvehicles.

(b) Thedischargeof sediment from

disturbedareasinto on-sitestorm

waterinlets.

(c) Thedischargeof sediment from

disturbedareasinto adjacent

watersof thestate.

(d) Thedischargeof sediment from

drainagewaysthat flow off the

site.

(e) Thedischargeof sediment by

dewateringactivities.

(f) Thedischargeof sediment

erodingfrom soilstockpiles

ex istingformorethan 7days.

(g) Thetransport byrunoff intowatersof thestateof chemicals,cement,andotherbuildingcompoundsandmaterialson theconstruction siteduringtheconstruction period.H owever,projectsthat requiretheplacement of thesematerialsinwatersof thestate,such asconstructingbridgefootingsor

B M P installations,arenotprohibitedbythissubdivision.

(3) L O C A TIO N . The B M P s shall be solocated that treatment occurs prior torunoff enteringwatersof thestate.

(4) IM P L E M E N TA TIO N . TheB M P susedto comply with this section shall beimplementedasfollow s:(a) E rosion andsediment

controlpracticesshallbeconstructedorinstalledbeforelanddisturbingconstruction activitiesbegin.

(b) E rosion andsediment controlpracticesshallbemaintaineduntilfinalstabilization.

(c) Final stabilization activity shallcommencewhen land disturbingactivitiesceaseandfinalgradehasbeen reached on anyportion ofthesite.

(d) Temporary stabilizationactivity shall commencewhen land disturbingactivities have temporarilyceased and will not resumefor a period ex ceeding 14calendardays.

(e) B M P sthat areno longernecessaryforerosion andsediment controlshallberemovedbytheresponsibleparty.

14.27.1 PERFORMANCE STANDARDS FORCONSTRUCTION SITES OF ONEACRE OR MORE.

(1) RE SP O N SIB L E P A RTY .The responsiblepartyshall complywith this section andimplement the E rosion and SedimentControl P lan developed in accordancewithSec.14.28.1.

(2) E RO SIO N A N D SE D IM E N T CO N TRO LP L A N .A written site-specific E rosion andSediment C ontrolP lan shallbedeveloped inaccordance with Sec. 14.28.1andimplementedforeachconstruction site.

(3) E RO SIO N A N D O TH E R P O L L UTA N TC O N TRO L RE Q UIRE M E N TS. TheE rosion and Sediment C ontrol P lanrequired under sub.(2)shall include thefollowing:

Thetransport byrunoffinto watersof thestateof chemicals,cement,andotherbuildingcompoundsandmaterialson theconstruction siteduringtheconstruction period.H owever,projectsthatrequiretheplacement ofthesematerialsin watersof thestate,such asconstructingbridgefootingsorB M Pinstallations,arenotprohibitedbythissubdivision.

9. Thetransport byrunoff into watersofthestateof untreatedwash waterfromvehicleandwheelwashing.

(b) SE D IM E N T P E RFO RM A N C ESTA N D A RD S.In addition to theerosion andsediment controlpracticesunderpar.(a),thefollowingerosion andsedimentcontrolpracticesshallbeemployed:

1. B M P sthat,bydesign,dischargeno morethan 5tonsperacreperyear,orto themaximum extentpracticable,of thesediment loadcarriedinrunoff from initialgradingto finalstabilization.

2. N o person shallberequiredto employmoreB M P sthan areneededtomeet a performancestandardin ordertocomplywith maximumex tent practicable.E rosionandsediment controlB M P smaybecombinedtomeet therequirementsofthisparagraph.C redit maybegiven towardmeetingthesediment performancestandardof thisparagraphforlimitingtheduration orarea,orboth,of landdisturbingconstructionactivity,orforotherappropriatemechanisms.

3. N otwithstandingsubd.1.,if B M P scannot bedesignedandimplementedto meet thesediment performancestandard,theE rosion andSediment C ontrolP lanshallincludea written,site-specificexplanationof whythesedimentperformancestandardcannot bemet andhowthesediment loadwillbereducedto themax imumex tent practicable.

(c) P RE V E N TIV E M E A SURE S.TheE rosion andSedimentC ontrolP lan shallincorporateallof thefollowing:

(4) IM P L E M E N TA TIO N .TheB M P susedto complywith thissection shallbeimplementedasfollows:

(a) E rosion and sedimentcontrol practices shall beconstructed or installedbefore land disturbingconstruction activitiesbeginin accordance with theE rosion and SedimentC ontrol P lan developed inSec.14.27.1(2).

(b) E rosion andsediment controlpracticesshallbemaintaineduntilfinalstabilization.

(c) Finalstabilization activityshallcommencewhen landdisturbingactivitiesceaseandfinalgradehasbeen reachedon anyportion ofthesite.

(d) Temporarystabilizationactivityshallcommencewhen landdisturbingactivitieshavetemporarilyceasedandwillnot resumefora periodexceeding14calendardays.

(e) B M P sthat areno longernecessaryforerosion andsediment controlshallberemovedbytheresponsibleparty.

14.28 PERMITTING REQUIREMENTS,PROCEDURES, AND FEES.

(1) P E RM IT RE Q UIRE D .N o responsiblepartymaycommence a land disturbingconstruction activity subject to thisordinance without receiving priorapproval of an E rosion and SedimentC ontrol P lan for the site and a permitfrom the B uilding Inspector or C ityE ngineer.

(2) P E RM IT A P P L IC A TIO N A N D FE E S.A t least one responsible partythat willundertakea land disturbing constructionactivitysubject to this ordinance shallsubmit an application fora permit and anE rosion and Sediment C ontrol P lan thatmeetstherequirementsof Sec.14.28.1andshall payan application feeasset bytheB uilding InspectororC ityE ngineerandasshown in theO fficialFeeSchedule.B ysubmittingan application,theapplicant isauthorizing the B uilding Inspector orC ityE ngineerto enterthesiteto obtaininformation required for the review oftheE rosion andSediment C ontrolP lan.

(3) P E RM IT A P P L IC A TIO N RE V IE WA N D A P P RO V A L . The B uildingInspector orC ityE ngineershall reviewanypermit application that issubmittedwith an E rosion and Sediment C ontrolP lan,and therequired fee.Thefollow ingapprovalprocedureshallbeused:

(a) W ithin 45 business days of thereceipt of a complete permitapplication, as required bySub.(2),theB uilding InspectororC ityE ngineer shall inform theapplicant w hethertheapplicationand plan are approved ordisapproved based on therequirementsof thisordinance.

(b) If thepermit application and E rosionand Sediment C ontrol P lan areapproved, the B uilding Inspector orCityE ngineershallissuethepermit.

(c) If the permit application orE rosion and Sediment ControlP lanis disapproved, the B uildingInspector or C ityE ngineer shallstate in writing the reasons fordisapproval.

(d) The B uilding Inspector or C ityE ngineer may request additionalinformation from the applicant.Ifadditional information issubmitted,the B uilding Inspector or C ityE ngineer shall have 30 businessdaysfrom the date the additionalinformation is received to informtheapplicant that theplan iseitherapprovedordisapproved.

(e) FailurebytheB uilding Inspectoror C ityE ngineer to inform thepermit applicant of a decisionwithin 45 business days of arequiredsubmittalshallbedeemedto mean approval of thesubmittaland theapplicant mayproceed asif a permit hadbeen issued.

(4) SURE TY B O N D . A s a condition ofapproval and issuanceof the permit,theB uilding Inspector or C ityE ngineer mayrequire the applicant to deposit a suretybond or irrevocable letter of credit toguarantee a good faith execution of theapproved E rosion and Sediment C ontrolP lan andanypermit conditions.

(5) P E RM IT RE Q UIRE M E N TS. A llpermitsshallrequiretheresponsiblepartyto:

(a) N otifytheB uilding InspectororCityE ngineer within 48 hours ofcommencing any land disturbingconstruction activity.

(b) N otifytheB uilding InspectororCityE ngineerof completion of anyB M P swithin 14daysaftertheirinstallation.

(c) O btain permission in writingfrom theB uilding InspectororCityE ngineerpriorto anymodification pursuant toSec.14.28.1(3)of the E rosion andSediment C ontrolP lan.

(d) InstallallB M P sasidentifiedin theapproved E rosion and SedimentControlP lan.

(e) M aintain all road drainage systems,storm waterdrainagesystems,B M P s,and other facilitiesidentified in theE rosion andSediment ControlP lan.

(f) Repairanysiltation orerosion damageto adjoining surfaces and drainagewaysresulting from land disturbingconstruction activities anddocument repairs in a siteinspection log.

(g) Inspect theB M P swithin 24hoursaftereach rain of 0.5inchesormorewhichresults in runoff during activeconstruction periods,and at least onceeach week. M akeneeded repairsandinstall additional B M P s as necessary,and document these activities in aninspection log with the date ofinspection, the name of the personconducting the inspection, and adescription of thepresent phaseof theconstruction at thesite.

(h) A llow the B uilding Inspector orC ityE ngineerto enterthesiteforthe purpose of inspectingcompliancewith theE rosion andSediment C ontrol P lan or forperforming anywork necessarytobringthesiteinto compliancewiththeE rosion and Sediment C ontrolP lan at theconstruction site.

(6) P E RM IT CO N D ITIO N S. P ermits issuedunder thissection mayinclude conditionsestablished byB uilding Inspector or C ityE ngineerin addition to therequirementssetforth in Sub.(5),where needed to assurecompliancewith theperformancestandardsin Sec.14.27or14.27.1.

(7) P E RM IT D URA TIO N . P ermits issuedunderthissection shallbevalid fora periodof 180 days,orthelength of thebuildingpermit orotherconstruction authorizations,whichever is longer, from the date ofissuance. (8) M A IN TE N A N C E . Theresponsiblepartythroughout the duration of theconstruction activities shall maintain allB M P snecessaryto meet therequirementsof this ordinance until the site hasundergonefinalstabilization.

14.28.1 EROSION AND SEDIMENT CONTROLPLAN, STATEMENT, ANDAMENDMENTS.

(1) E RO SIO N A N D SE D IM E N T CO N TRO LP L A N STA TE M E N T. For eachconstruction site identified under Sec.14.26(1)(c),an E rosion andSediment C ontrolP lan Statement shall be prepared. Thisstatement shall besubmitted to theB uildingInspectororCityE ngineer.TheE rosion andSediment C ontrolP lan Statement shallbriefly

describethesite,thedevelopment schedule,and theB M P sthat will beused to meet therequirementsof theordinance. A sitemapshall also accompany the E rosion andSediment C ontrolP lan Statement.

(2) E RO SIO N A N D SE D IM E N TC O N TRO L P L A N RE Q UIRE M E N TS.

(a) P reparation and Submission. A nE rosion and Sediment C ontrol P lanshall be prepared and submitted tothe B uilding Inspector or CityE ngineer.

(b) P erformance Standards. TheE rosion and Sediment ControlP lanshall be designed to meet theperformancestandardsin Sec14.27or14.27.1 and otherrequirementsof thisordinance.

(c) P ollution.TheE rosion and SedimentControl P lan shall addresspollutioncaused by soil erosion andsedimentation during constructionandupto finalstabilization of thesite.TheE rosion and Sediment C ontrolP lan shallinclude,at a minimum,thefollowingitems:

1. Thename(s)and address(es)of theownerordeveloperofthe site, and of anyconsulting firm retained bythe applicant,together withthenameof theapplicant’sprincipal contact at suchfirm. The application shallalso include start and enddatesforconstruction.

2. D escription of the site andthe nature of theconstruction activity,including representation ofthelimitsof landdisturbanceon a United StatesGeological Service 7.5minute series topographicmap.

3. A description of theintendedsequence of major landdisturbing constructionactivitiesformajorportionsof the construction site,including stripping andclearing; rough grading;construction of utilities,infrastructure,and buildings;and final grading andlandscaping.Sequencingshallidentifytheexpected dateon

which clearingwillbegin,theestimated duration ofexposure of cleared areas,areasof clearing,installationof temporary erosion andsediment control measures,and establishment ofpermanent vegetation.

4. E stimatesof thetotal areaof thesiteand thetotalareaof thesitethat isex pectedto be disturbed byconstruction activities.

5. C alculations to showcompliance with theperformance standard ofSec.14.27.1(3)(b).

6. E xisting data describing thesurface soil as well assubsoils.

7. D epth to groundwater,asindicated by N aturalResources C onservationService soil informationwhereavailable.

8. N ame of the immediatenamedreceivingwaterfromthe United StatesGeological Service 7.5minute series topographicmaps.

(d) SiteM ap.TheE rosion and SedimentControlP lan shallincludea sitemap.Thismapshall includethefollowingitems and shall be at a scale notgreaterthan 100feet perinchandat acontourinterval not to ex ceed fivefeet.

1. E x isting topography, vegetativecover, natural and engineereddrainage systems, roads, andsurface waters. L akes, streams,wetlands, channels, ditches, andother watercourses on andimmediatelyadjacent to the siteshall be shown. A ny identified100-year flood plains, floodfringes,and floodwaysshall alsobeshow n.

2. B oundariesof theconstructionsite.

3. D rainage patterns andapproximate slopes anticipatedaftermajorgradingactivities.

(e) Controlsand M easures.E ach E rosionand Sediment C ontrol P lan shallinclude a description of appropriatecontrols and measures that will beinstalled and maintained at theconstruction siteto prevent pollutantsfrom reaching watersof thestate.TheE rosion and Sediment Control P lanshall clearlydescribe the appropriateerosion andsediment controlB M P sforeachmajorlanddisturbingconstructionactivity and the timing during theperiod of land disturbing constructionactivitythat theE rosion and SedimentControl B M P s will be implemented.The description of erosion andsediment control B M P sshall include,when appropriate, the followingminimum requirements:

1. D escription of interim andpermanent stabilizationpractices, including a B M Pimplementation schedule. TheE rosion and Sediment C ontrolP lan shall ensure that existingvegetation is preserved whereattainable and that disturbedportions of the site arestabilized.

2. D escription of structuralpractices to divert flow awayfrom exposed soils,storeflowsor otherwise limit runoff andthedischargeof pollutantsfromthe site. Unless otherwisespecificallyapproved in writingbythe B uilding Inspector orCity E ngineer, structuralmeasuresshall be installed onuplandsoils.

3. M anagement of overland flowat all areasof theconstructionsite, unless otherwisecontrolledbyoutfallcontrols.

4. Trapping of sediment inchannelizedflow.

5. Staging land disturbingconstruction activities tolimit exposed soil areassubject to erosion.

6. P rotection of downslopedrainage inlets where theyoccur.

7. M inimization of tracking atall vehicle and equipmententryand exit locationsontheconstruction site.

8. Clean upof off-sitesedimentdeposits.

9. P roper disposal of buildingandwastematerials.

10. Stabilization of drainageways.

11. Installation of permanentstabilization practices assoon aspossible after finalgrading.

12. M inimization of dust to themaximum extent practicable.

(f) V elocityD issipation D evices.TheE rosion and Sediment ControlP lanshallrequirethat velocitydissipationdevices be placed at dischargelocationsand along the length ofanyoutfallchannel,asnecessary,toprovidea non-erosiveflow from thestructureto a watercourseso thatthe natural physical and biologicalcharacteristics and functions aremaintainedandprotected.

(3) E RO SIO N A N D SE D IM E N TCO N TRO L P L A N A M E N D M E N TS.The applicant shall amend the E rosionand Sediment C ontrol P lan if anyof thefollowingoccur:

(a) There is a change in design,construction, operation ormaintenanceat thesitewhich hasthe reasonable potential for thedischarge of pollutantsto watersof the state and which has nototherwise been addressed in theE rosion andSediment ControlP lan.

(b) The actions required by theE rosion and Sediment ControlP lanfail to reduce the impacts ofpollutantscarried byconstructionsiterunoff.

(c) The B uilding Inspector or C ityE ngineernotifiestheapplicant ofchangesneeded in theE rosion andSediment C ontrolP lan.

14.28.2 FEE SCHEDULE. Thefeesreferredto in othersectionsof thisordinanceshallbeadopted by theCity of Baraboo Common Council and mayfrom timeto timebemodified byresolution.Ascheduleof thefeesshallbeavailableforreview inCityH all.

14.29 INSPECTION. If land disturbing constructionactivitiesareoccurring without a permit requiredbythisordinance,theB uilding InspectororC ityE ngineer mayenter the land pursuant to theprovisionsof §§66.0119(1),(2),and(3),W is.Stats.

14.30 ENFORCEMENT.

(1) TheB uilding InspectororC ityE ngineermaypost a stopwork orderif anyof thefollowingoccurs:

(a) L and disturbing constructionactivity regulated under thisordinance isoccurring without apermit.

(b) The E rosion and Sediment ControlP lan snot being implemented in agoodfaith.

(c) Theconditionsof thepermit arenotbeingmet.

(2) If theresponsiblepartydoesnot ceaseactivityasrequired in a stopworkorderposted underthissection orfailsto complywiththeE rosionand Sediment C ontrol P lan or permitconditions, the B uilding Inspector or CityE ngineermayrevokethepermit.

(3) If theresponsibleparty,whereno permithasbeen issued or the permit hasbeenrevoked,doesnot ceasetheactivityafterbeingnotified bytheB uildingInspectororCityE ngineer,or if a responsible partyviolatesa stop work order posted underSub.(1),the B uilding Inspector or C ityE ngineermayrequest theCityA ttorneytoobtain a ceaseanddesist orderin anycourtwithjurisdiction.

(4) TheB uilding InspectororCityE ngineermayretract thestopwork orderissued underSub.(1)orthepermit revocation underSub.(2).

(5) A fterpostinga stopworkorderunderSub.(1),theB uilding Inspectormayissuea noticeofintent to theresponsiblepartyof itsintent toperform work necessaryto complywith thisordinance. The B uilding Inspector or C ityE ngineermaygo on theland and commencetheworkafterissuingthenoticeof intent.Thecosts of the work performed under thissubsection by or at the direction of theB uilding Inspector or C ity E ngineer, plusinterest at therateauthorized bytheB uildingInspectororC ityE ngineershall bebilled tothe responsible party. In the event aresponsiblepartyfailsto paytheamount due,theclerkshallentertheamount dueon thetaxrollsandcollect asa specialassessment againstthepropertypursuant to Subch.V IIof C h.66,W is.Stats.

(6) A nyperson violating anyof theprovisionsofthisordinanceshall besubject to a penaltyasprovided in §25.04of thiscodeand thecostsof prosecution foreach violation.E ach dayaviolation exists shall constitute a separateoffense.

(7) Compliance with the provisions of thisordinancemayalso beenforced byinjunctionin anycourt with jurisdiction.It shall not benecessaryto prosecuteforforfeitureora ceaseand desist order before resorting toinjunctionalproceedings.

14.31 APPEALS.

(1) B O A RD O F Z O N IN G A P P E A L S.Theboard of zoningappealscreated pursuantto Sec. 1.17 of the city's ordinancepursuant to §62.23(7)(e),W is.Stats.:

(a) Shallhearand decideappealswhereit isalleged that thereiserrorin anyorder, decision or determinationmadebytheB uilding InspectororCityE ngineerin administering thisordinance except for cease anddesist orders obtained under Sec.14.30(3).

(b) Upon appeal, may authorizevariancesfrom theprovisionsof thisordinancewhich arenot contrarytothepublicinterest and whereowingto special conditions a literalenforcement of the provisionsofthe ordinance will result inunnecessaryhardship;and

(c) Shall use the rules, procedures,dutiesand powersauthorized bystatute in hearing and decidingappealsandauthorizingvariances.

(2) W H O M A Y A P P E A L . A ppealsto theB oardof Z oning A ppeals maybe taken byanyaggrieved person orbyanyoffice,department,board, or bureau of the Cityof B arabooaffected by any decision of the B uildingInspectororCityE ngineer.

14.32 SEVERABILITY. If a court of competentjurisdiction judgesanysection,clause,provision,orportion of this ordinance unconstitutional orinvalid,theremainderof theordinanceshallremainin forceandnot beaffectedbysuch judgment.

14.33 EFFECTIVE DATE. Thisordinanceshallbeinforceand effect from and afteritsadoption andpublication.Theaboveand foregoing ordinancewasdulyadopted bytheC ommon C ouncilof theCityof B araboo on the25th dayof A ugust,2015.

SUBCHAPTER III: HOUSING CODE

14.34 PURPOSE AND INTENT. The C ity hasdetermined that there are or may be dwellingstructures which are so dilapidated, unsafe,dangerous,unhygienicorunsanitaryasto constituteamenaceto thehealth and safetyof thepeopleof theCity.Thepurposeof thissubchapteristo establishminimum standards governing the condition andmaintenance of dwellings; establish minimumstandardsgoverning supplied utilitiesand facilitiesand other physical conditions essential to makedwellingssafe,sanitaryand fit forhuman habitation;establishminimum standardsgoverningtheconditionof dwellings offered for rent; fix certainresponsibilitiesof ownersandoccupantsof dwellings,and thecondemnation of dwellingsunfit forhumanhabitation;coordinatetheactivitiesof theB uildingInspector;fix penaltiesforviolationsand fix a timewhen thesameshalltakeeffect.

14.35 DEFINITIONS. Thefollowingdefinitionsshallapplyin theinterpretation andenforcement of thissubchapter:

(1) A C C E SSO RY B UIL D IN G means anydetached building orstructurenot used asa dwellingunit,but whoseuseisincidentalto that of theprincipalbuildingand whichislocatedon thesamelot orparcel.

(2) B A SE M E N T meansa spaceof full storyheight below thefirst floorwhich isnotdesignated or used primarily foryear-aroundlivingaccommodations.Space,partlybelow thegrade,which isdesignedand finished as habitable space is notbasement space.

(3) B UIL D IN G IN SP E C TO R means theB uilding Inspector of the C ity or hisauthorizedrepresentative.

(4) C E L L A R meansa portion of a buildinglocated partly or wholly underground,having 2/3 or more of its clearfloor-to-ceiling height below the averagegradeof theadjoiningground.

(5) D W E L L IN G meansanybuildingwhich iswhollyor partlyused or intended to beused for living or sleeping by humanoccupants; provided temporary housingshallnot beregardedasa dwelling.

(6) D W E L L IN G UN IT meansanyroom orgroupof roomslocated within a dwelling,forming a singlehabitableunit with facili-tiesthat areusedorintendedto beusedforliving,sleeping,cookingandeating.

(7) E X TE RM IN A TIO N means the controland elimination of insects, rodents, orother pests by removing or makinginaccessible materials that mayserve astheir food, by poisoning, spraying,fumigating, trapping, or by any otherrecognized,legal pest elimination methodsapprovedbytheB uildingInspector.

(8) GA RB A GE means the animal andvegetable waste resulting from thehandling, preparing, cooking andconsumingof food.

(9) H A B ITA B L E RO O M meansa room orenclosed floorspaceused orintended tobe used for living,sleeping,cooking,oreating,excluding bathrooms,waterclosetcompartments,laundries,pantries,foyers,or communicating corridors,closetsandstorespaces.

(10) IN FE STA TIO N means the presence,within orarounda dwelling,of anyinsects,rodentsorotherpests.

(11) M UL TIP L E D W E L L IN G means anydwelling containing more than twodwellingunits.

(12) O C C UP A N T meansanyperson,overoneyearof age,livingsleeping,cooking,eating

in, or having actual possession of adwellingunit orroomingunit.

(13) O P E RA TO R meansanyperson who hascharge or care of a building, or partthereof, in which dwelling units orroomingunitsareofferedforrent.

(14) O W N E R meansanyperson who,alone,jointlyorseverally:

(a) Shallhavelegaltitleto anydwellingordwelling unit, with or withoutaccompanying actual possessionthereof; provided, whenever thedwelling ordwelling unit issubject toconditional salescontract,lease withoption to purchase,oranyotherformof written contract underthetermsofwhich any person is entitled to aconveyanceof legaltitleupon paymentof a specifiedsum,"owner"shallmeanthe person who shall have such acontractualright orequitabletitle,ratherthan theperson holdingthelegaltitle;or

(b) Shall have charge or care of anydwelling or dwelling unit,asowner,agent of theowner,aspersonalrepre-sentative, administrator, trustee,receiverorguardian of theestateof theowner.A nyperson representing theownershallcomplywiththeprovisionsof thissubchapterandof therulesandregulationsadopted pursuant thereto,asif heweretheowner.A nypersonacting astheagent of theownershallnot be construed to be the ownerwithin the termsof thissubchapter,but shallbeboundto notifytheowner,by means of a registered letteraddressed to the owner at his lastknown address,of anyorderornoticeto beissued bytheB uildingInspectorrelatingto thepropertyof theowner.

(15) P L UM B IN G means all of the followingsupplied facilitiesand equipment gaspipes,gas-burning equipment,waterpipes,garbagedisposal units, waste pipes, water closets,sinks,installed dishwashers,lavatories,bath-tubs,showerbaths,installed clotheswashers,catch basins, drains,vents, and anyothersimilar supplied fixtures, together with allconnectionsto water,sewerorgaslines.

(16) RUB B ISH means combustible andnoncombustible waste materials, exceptgarbage;and the term shall include theresiduefrom theburning of wood,coal,coke, and other combustible material,paper,rags,cartons,boxeswood,excelsior,rubber, leather, tree branches, yard

trimmings,tin cans,metals,mineralmatter,glasscrockery,anddust.

(17) SUP P L IE D meanspaid for,furnished,orprovided byorunderthecontrol of theowneroroperator.

(18) TE M P O RA RY H O USIN G means anytent,trailer,or other structure used forhuman shelter designated to betransportablewhich isnot attached to theground,to another structure,or to anyutilitiessystem on thesamepremisesformorethan 30consecutivedays.

(19) M E A N IN G O F C E RTA IN W O RD S.W henever the words "dwelling", "dwellingunit", or "premises" are used in thissubchapter,theyshallbeconstrued asthoughtheywerefollowed bythewords“oranypartthereof.”

(20) E xcept forthosetermsspecificallydefinedinthissub-chapter,thedefinitionsset forth inthe State B uilding C ode, State P lumbingCode,and StateE lectrical C ode,which areadopted byreferencein Chs.14,15and 16,respectively,of thisC ode,areherebyadoptedbyreference.

14.36 INSPECTION OF DWELLINGS,DWELLING UNITS, ACCESSORYBUILDINGS, NURSING UNITS, HOTELUNITS, AND PREMISES.

(1) IN SP E C TIO N B Y B UIL D IN GIN SP E C TO R.

(a) The B uilding Inspector may makeinspectionsto determinetheconditionof dwellings,dwelling units,accessorybuildings, nursing units,hotel units,andpremiseslocatedwithin theCitytosafeguardthehealth andwelfareof theoccupantsof dwellingsandthegeneralpublic.

(b) For the purpose of making suchinspections, the B uilding Inspectormayenter,examine, and survey, atproper times after due notice, alldwellingunits,accessorybuildings,andpremises.Theownerortheperson inchargeshallgivetheB uildingInspectoraccessto such dwellingunit,accessorybuilding and its premises at propertime after due notice, for suchinspection,examination,andsurvey.

(2) A CC E SS B Y O W N E R O R O P E RA TO R.E veryoccupant of a dwelling,dwelling unit,nursing unit,hotelunit orpremisesshall givetheowneroroperatorthereof,orhisagent oremployeeaccessto anypart of such dwelling,

dwellingunit,accessorybuilding,nursingunit,hotel unit,or itspremisesat all reasonabletimes for maintenance, making repairs oralterationsasnecessaryto effect compliancewith theprovisionsof thissubchapterorwithanylawful ruleorregulation adopted oranylawful noticeororderissued pursuant to theprovisionsof thissubchapter.

14.37 ENFORCEMENT; SERVICE OFNOTICES AND ORDERS; HEARINGS.

(1) SE RV IC E O F N O TIC E S.W henevertheB uilding Inspector determinesthat therehas been a violation or that there arereasonable groundsto believe that therehasbeen a violation of thissubchapterorof anyruleorregulation adopted pursuantthereto, he shall give notice of suchviolation oralleged violation to thepersonresponsibletherefore.Suchnoticeshall:

(a) B ein writing;(b) Include a description of the real

estatesufficient foridentification;(c) Includea statement of thereason

whyit isbeingissued;(d) A llow a reasonable time for the

performanceof anyact isrequires;(e) B eserved upon theowner,operator,

ortheoccupant;provided such noticeshallbedeemed to beproperlyservedupon such owner, operator oroccupant if a copythereof isdeliveredto him personally,orsent bycertifiedmailreturn receipt requestedto hislastknown address, or posted in aconspicuous place in or about thedwellingaffectedbythenoticeorif heisservedbyanyothermethodauthorizedor required under State laws. Suchnotice may contain an outline ofremedial action which,if taken,shalleffect compliancewith theprovisionsof thissubchapterand with rulesandregulationsadoptedpursuant hereto.

(2) P E TITIO N FO R H E A RIN G;O P P O RTUN ITY TO B E H E A RD ;O RD E R IF N O P E TITIO N .A nynoticeserved pursuant to this sub-chapter shallautomaticallybecome an order if a writtenpetition fora hearingisnot filed in theofficeof theB uildingInspectorwithin 10daysaftersuch noticeisserved.A nyperson affected byanynoticethat hasbeen issued in connectionwith theenforcement of thissubchapter,oranyruleorregulation adoptedpursuant heretomayrequest andshallbegranteda hearingonthe matter before the Z oning B oard ofA ppealsprovideda written petition requestingsuch hearing and setting forth a statement ofthe groundstherefore shall be filed in theofficeof theB uildingInspectorwithin 10daysafterthedaythenoticewasserved. Upon

receipt of suchpetition,theB uildingInspectorshalltransmit to theZ oningB oardof A ppealsthe petition and all papersconstituting therecord upon which theaction appealed fromwastaken.TheB oard shall set a timeandplaceforthehearing of theA ppeal and shallgivethepetitionerwritten noticethereof. A tsuch hearing,thepetitionershall begiven anopportunityto beheard and show causewhysuchnoticeshouldnot becompliedwith.

(3) B O A RD O F Z O N IN G A P P E A L S TOSUSTA IN , M O D IFY O R W ITH D RA WN O TIC E S.A fterthehearing on theappealtheB oard of Z oning A ppealsshall sustain,modifyor withdraw the notice dependingupon itsfindingasto whethertheprovisionsof this subchapter and the rules andregulations adopted pursuant hereto havebeen compliedwith.If theB oardsustainsormodifiessuch notice,it shall bedeemed anorder.

(4) RE V IE W B Y CIRC UIT C O URT B YCE RTIO RA RI. The proceedings at ahearingon an appealunderthissub-chapter,including thefindingsand decision of theB oard of Z oning A ppeals,shall bereducedto writing,and entered asa matterof publicrecord in the office of the B oard.Suchrecord shall also include a copyof everynoticeororderissuedin connection with thematter.A copyof thewritten decision of theB oard shall then beserved in themannerprescribedunder§§14.37(1)(e)on thepersonwho filed the petition for hearing. A nyperson aggrieved bythe decision of theB oardof Z oningA ppealsoranytaxpayer,oranyofficer,department,board orbureau oftheCity,mayseekjudicialrelief therefrom byhaving thedecision reviewed bycertiorariasprovidedbylaw.

(5) ISSUA N C E O F O RD E R W H E NE M E RGE N C Y E X ISTS. W henever theB uilding Inspector findsthat an emergencyexists which requires immediate action toprotect thepublic,hemay,without noticeorhearing,issuean orderstatingtheexistenceofan emergencyand requiring that such actionbetaken ashedeemsnecessaryto meet theemergency. N otwithstanding the otherprovisionsof thissubchapter,such ordershallbeeffectiveimmediately,but upon petition tothe B uilding Inspector a hearing shall beafforded assoon aspossible,in themannerprovided in sub. (2). A fter such hearing,dependingupon thefindingsasto whethertheprovisions of this subchapter have beencomplied with,theB oard shall continuesuchorderin effect,modifyit,orrevokeit.

14.38 MINIMUM STANDARDS FOR BASICEQUIPMENT AND FACILITIES. N operson shall occupyasowner-occupant orlet toanotherforoccupancyanydwelling ordwellingunit for living,sleeping,cooking and/or eating

mealstherein which doesnot complywith thefollowingrequirements:(1) KITCH E N SIN K RE Q UIRE D . E very

dwelling unit shallcontain a kitchen sink andlaundry tray in good working condition,properlyconnected to a water and sanitarysewer system approved by the B uildingInspector'soffice.

(2) E verydwelling unit shall contain a room,separatefrom thehabitablerooms,whichaffords privacy to a person which isequipped with a flush water closet, alavatorybasin,bathtuborshowerand thenecessaryaccessories therefore in goodworking condition,properlyconnected tohot andcoldwaterlinesandsanitarysewersystem approved by the B uildingInspector.

(3) E verykitchen sinkand lavatorybasin shallbesupplied with adequaterubbish storagefacilities.

(4) RUB B ISH FA C IL ITIE S. E verydwellingunit shall be supplied with adequaterubbishstoragefacilities.

(5) GA RB A GE D ISP O SA L FA CIL ITIE S.E verydwelling unit shall have adequategarbagedisposalfacilitiesorgarbagestoragecontainers.

(6) E X ITS.E verydwellingunit shallhavesafe,unobstructed meansof egressleading tosafe, open space at ground level, asrequiredbyStateandC itylaws.

14.39 MINIMUM STANDARDS FOR LIGHT,VENTILATION, AND HEATING. N operson shall occupyasowner-occupant orlet toanotherforoccupancyanydwelling ordwellingunit forlivingtherein which doesnot complywiththefollowingrequirements:

(1) RE Q UIRE D W IN D O W A RE A . E veryhabitable room shall have at least onewindow orskylight facing directlyto theoutdoors. The minimum total windowarea,measured between stops,for everyhabitableroom shall be10 percent of thefloorarea of suchroom.

(2) A D E Q UA TE V E N TIL A TIO NRE Q UIRE D . E veryhabitableroom shallhaveat least onewindow orskylight that caneasilybeopened orsuch otherdeviseaswilladequatelyventilate the room. The totalopenable window area in everyhabitableroom shall beequal to at least 4 percent ofthefloorarea,except wherethereissupplieda mechanical device affording adequateventilation per current Federal H ousingA dministration Regulations.

(3) L IGH T A N D V E N TIL A TIO NRE Q UIRE M E N TS FO R B A TH RO O M SA N D TO IL E T RO O M S.E verybathroomand toilet room shallcomplywith thelightand ventilation requirementsforhabitableroomscontained in subsection (1)and (2),except no window or skylight shall berequired in adequately ventilatedbathroomsandtoilet roomsequippedwithan adequate ventilation system which iskept in continuousoperation.

(4) H E A TIN G FA CIL ITIE S. E very dwellingshall haveheated facilitieswhich areproperlyinstalled,are maintained in safe and goodworking condition and arecapableof safelyand adequatelyheating all habitable rooms,bathrooms,and watercloset compartmentsinevery dwelling unit located therein to atemperatureof at least 70°F 30"abovefloorlevel.

(5) L IGH TIN G O F P UB L IC H A L L S A N DSTA IRW A Y S. E very public hall andstairwayin everymultipledwellingshallbeadequatelylighted in conformitywith thecurrent N ational E lectrical C ode andFederal H ousing A dministrationRegulations.

(6) B A SE M E N TS A N D C E L L A RS. E verybasement shallreceivenaturaland artificiallight and shall beventilated according tocurrent Federal H ousing A dministrationrequirements or equal minimum. E verybasement or cellar window used orintended to be used for ventilation andeveryotheropening to a basement whichmight providean entryforrodentsshallbescreened with a wiremesh of not lessthan#16 or other device as will effectivelyprevent theirentrance.

14.40 RESPONSIBILITIES OF OWNERSRELATING TO THE MAINTENANCEOF DWELLINGS AND DWELLINGUNITS. N o person shall occupy asowner-occupant orlet to anotherforoccupancyanydwelling unit or portion thereof for livingtherein,whichdoesnot complywith thefollowingrequirements:

(1) M A IN TE N A N C E O FFO UN D A TIO N S,E X TE RIO R W A L L S,RO O FS.E veryfoundation,exterior walland roof shallbereasonablyweather-tight,watertight,rodent-proof and insect-proofandshallbekept in a reasonablygoodstateof repair.

(2) M A IN TE N A N C E O F IN TE RIO RW A L L S, FL O O RS, C E IL IN GS. E veryinterior partition,wall,floor,and ceilingshall becapableof affording privacy,keptin a reasonablygood stateof repair,and

maintained to permit them to bekept in aclean,sanitarycondition.

(3) M A IN TE N A N C E O F W IN D O W S,E X TE RIO R D O O RS, B A SE M E N TH A TC H W A Y S. E verywindow,exteriordoor, and basement hatchwayshall bereasonablyweather-tight and rodent-proof,kept in reasonablygoodworkingconditionandreasonablygoodstateof repair.

(4) M A IN TE N A N C E O F STA IRW A YS A N DP O RC H E S. E very inside and outsidestairway,porchandappurtenancethereto shallbeconstructed to bereasonablysafeto useand capable of supporting the load thatnormal usemaycauseto beplaced thereon;and kept in sound condition and in areasonablygoodstateof repair.

(5) M A IN TE N A N C E O F SUP P L IE DP L UM B IN G FIX TURE S.E verysuppliedplumbingfixtureand waterandwastepipeshall beproperlyinstalled and maintainedin goodsanitaryworkingcondition.

(6) M A IN TE N A N C E O F B A TH RO O M A N DTO IL E T RO O M FL O O RS. E very toiletroom floor surface and bathroom floorsurfaceshallbeconstructedandmaintainedsoas to be reasonablyimpervious to water,permitting such floorto bekept in a clean,sanitarycondition.

(7) SA FE A N D E FFE C TIV EFUN C TIO N IN G O F SUP P L IE DFA C IL ITIE S.E verysuppliedfacility,pieceof equipment,orutilitywhich isrequiredunder this subchapter shall be soconstructedorinstalledthat it willfunctionproperly and shall be maintained inreasonablygoodworkingcondition.

(8) D ISC O N TIN UA N C E O F RE Q UIRE DSE RV IC E S, FA C IL ITIE S, E Q UIP -M E N T,O R UTIL ITIE S.N o owner oroperator shall cause anyservice facility,equipment,orutilitywhich isrequired tobesupplied under the provisions of thissubchapterto beremovedfrom,orshutofffrom,or discontinued for anyoccupieddwellingordwellingunit let oroccupiedbyhim, except for such temporaryinterruption as maybe necessarywhileactual repairs,replacements,oralterationsarebeingmade.

(9) V A C A N T D W E L L IN G UN ITS TO B EC L E A N A N D SA N ITA RY B E FO REB E IN G L E T FO R O CC UP A N C Y .N oownershall occupyorrent to anyotherperson foroccupancyorallow anyotherperson to occupyanyvacant dwelling unit

unlessit isreasonablyclean,sanitary,andcomplies with all provisions of thissubchapter and all rulesand regulationsadoptedpursuant thereto.

14.41 MINIMUM SPACE, USE, ANDLOCATION REQUIREMENTS. N o personshall occupyorlet to anotherforoccupancyanddwelling anyunit,forliving therein that doesnotcomplywiththefollowingrequirements:

(1) M IN IM UM FL O O R A RE A FO RD W E L L IN G UN IT.E verydwelling unitshall contain a minimum grossfloorareaof not lessthan 150squarefeet forthefirstoccupant,100 squarefeet forthesecondoccupant, and 75 square feet for eachadditionaloccupant.Thefloorarea shallbecalculated on thebasisof thetotal area ofallhabitablerooms.

(2) M IN IM UM H O T W A TE RRE Q UIRE M E N TS.E verydwellingunit shallbesupplied with waterheatingfacilitieswhichareinstalled in an approved manner,properlymaintained and capableof heating watertosuch a temperature to permit an adequateamount of waterto bedrawn at everyrequiredkitchen sink,lavatorybasin,bathtub,shower,and laundryfacilityorothersimilarunits,at atemperature of not lessthan 130° F whenneeded.

(3) E L E C TRIC A L SE RV IC E ;N UM B E R O FE L E C TRIC A L O UTL E TS A N D /O RFIX TURE S.W hilethereiselectricserviceavailableto thebuildings,everyhabitableroom of a dwelling unit shall contain atleast two separateremoteoutlets,oneofwhich maybea ceilingorwall-typeelectriclight fix ture.E verypublic hall,bathroom,laundry room or furnace room shallcontain at least oneelectriclight fix ture.Inaddition, every bathroom and laundryroom shall beprovided with at least oneelectricoutlet.

(4) SCRE E N RE Q UIRE M E N TS.From June1 to O ctober1,in everydwelling unit forprotection against mosquitoes, flies andotherinsects,everydooropening directlyfrom a dwellingunit to outdoorsshallhavesupplied and installed screens and aself-closing device;and everywindow orother device with openingsto outdoors,usedorintendedto beusedforventilation,shall likewise be supplied with screensinstalled.

(5) FL O O R A RE A FO R SL E E P IN GRO O M S.In everydwellingunit of two ormore rooms, occupied for sleepingpurposesbyoneoccupant shallcontain at

least 80 square feet of floor space,andeveryroom occupied bymorethan oneoccupant shall contain at least 40 squarefeet of space for each occupant thereofovertheageof 12 yearsand at least 30squarefeet foreach occupant undertheageof 12years.

(6) A RRA N GE M E N T O F SL E E P IN G,B A TH A N D TO IL E T RO O M S. N odwelling unit containing two or moresleeping rooms shall have such roomarrangementsthat accessto a bathroom ortoilet room intended forusebyoccupantsof morethan onesleeping room can behad only by going through anothersleeping room; nor shall roomarrangements be such that access to asleeping room can behad onlybygoingthrough anothersleeping room,bathroomora toilet room.

(7) M IN IM UM C E IL IN G H E IGH T.A t least½ of thefloorarea of everyhabitableroomshall havea ceiling height of at least 7'6";and thefloorarea of that part of anyroomwheretheceiling height islessthan 5 feetshall not beconsidered part of thefloorarea in computing thetotal floorarea todetermine the maximum permissibleoccupancythereof.

(8) CE L L A R SP A C E N O T H A B ITA B L E .N o cellarspaceshallbeused asa habitableroom ordwellingunit.

(9) B A SE M E N T SP A C E M A Y B EH A B ITA B L E .N o basement space shallbeused asa habitableroom ordwellingunit unless:

(a) The floor and walls are ofwaterproof and damp-proofconstruction;

(b) Thetotalof window area in eachroomis equal to at least the minimumwindow area sizes as required in§§14.39(1);

(c) Such required minimum windowarea islocated entirelyabove thegradeof theground adjoining suchwindow area;and

(d) Thetotal of openablewindow area ineach room is equal to at least theminimum asrequiredunder§§14.39(2),except wherethereissupplied someother approved device affordingadequateventilation.

(10) O C C UP A N TS TO H A V E A CC E SS TOSA N ITA RY FA C IL ITIE S. E veryoccupant of every dwelling shall haveunrestricted accessto a kitchen sink,toilet,bathandlavatorybasin.

14.42 RESPONSIBILITIES OF OCCUPANTSRELATING TO THE MAINTENANCE OFDWELLINGS AND DWELLING UNITS.

(1) E veryownerof a dwellingcontainingfourormoredwelling unitsshall maintain in aclean and sanitarycondition theshared orpublic areasof thedwelling and premisesthereof.

(2) E veryoccupant of a dwelling ordwellingunit shall keep in a clean and sanitarycondition that part of the dwelling,dwelling unit,and premisesthereof whichheoccupiesandcontrols.

(3) E veryoccupant of a dwelling ordwellingunit shall disposeof all hisrubbish in aclean and sanitarymannerbyplacing it intherubbishcontainers.

(4) E veryoccupant of a dwellingordwellingunitshall dispose of hisgarbage and anyotherorganic wastewhich might providefood forrodentsin a clean,sanitarymannerbyplacingit in garbagedisposal facilitiesorcon-tainersforall dwelling unitsin a dwelling containingmore than four dwelling unitsand for alldwelling units located on premises wheremorethan fourdwellingunitssharethesamepremises.In allothercases,theoccupant shallfurnishsuchfacilitiesorcontainers.

(5) E veryoccupant of a dwellingordwellingunitshall hang all screensand double or stormdoorsand windowswheneverrequired undertheprovisionsof thissubchapterorof anyruleorregulation adopted pursuant thereto,except wheretheownerhasagreed to supplysuchservice.

(6) E veryoccupant of a dwelling containing asingle dwelling unit shall exterminate anyinsects,rodents,orotherpeststherein oronthepremises;andeveryoccupant of a dwellingunit in a dwelling containing morethan onedwelling unit shall be responsible for suchextermination whenever hisdwelling unit isthe onlyone infested.N otwithstanding theforegoing provisions of this subsection,wheneverinfestation iscaused byfailureoftheownerto maintain adwellingin arat-proofor reasonably insect-proof condition,extermination shallbetheresponsibilityof theowner.W heneverinfestation existsin two ormoreof thedwellingunitsin anydwelling,orin theshared orpublicpartsof anydwellingcontaining two or more dwelling units,extermination thereof shall be theresponsibilityof theowner.

(7) E veryoccupant of a dwelling unit shallkeepallplumbingfixturestherein in a clean

and sanitary condition and shall beresponsiblefortheexerciseof reasonablecare in the proper use and operationthereof.

14.43 RESPONSIBILITIES OF OWNERS ANDOCCUPANTS RELATING TO THEMAINTENANCE OF ACCESSORYBUILDINGS. E veryownerand/oroccupant ofan accessory building shall maintain thefoundation, exterior walls, roof, windows anddoors in a reasonably weather tight andwaterproof condition and in a reasonablygoodstateof repair.

14.44 CONDEMNATION OF UNFITDWELLINGS AND DWELLING UNITS,LEGAL PROCEDURE OFCONDEMNATION AND PLACARDINGFOR HUMAN HABITATION. Thedesignationofdwellings or dwelling units as unfit for humanhabitation and theprocedureforthecondemnationand placarding of such unfit dwellingsordwellingunitsshall becarried out in compliancewith thefollowingrequirements:

(1) C O N D E M N A TIO N O F D W E L L IN GSA N D D W E L L IN G UN ITS A S UN FITFO R H UM A N H A B ITA TIO N . A nydwelling or dwelling unit which theB uildingInspectorshallfindto haveanyofthefollowing defectsshall becondemnedasunfit forhuman habitation:

(a) O ne which is damaged,decayed,dilapidated,unsanitary,difficult toheat, unsafe, or vermin infested,creating a hazard to thehealth orwelfare of the occupants or thepublic,or

(b) O ne which lacks illumination,ventilation or sanitary facilitiesadequate to protect the health orwelfareof theoccupantsorthepublic,or

(c) O newhich,becauseof itsgeneralcondition orlocation,isunsanitaryorotherwisedangerousto thehealthorwelfareof theoccupantsorthepublic.

A ny dwelling or dwelling unit may becondemned asunfit forhuman habitation bytheB uilding Inspectorif theowneroroccu-pant failedto complywith anyorderbasedontheprovisionsof thissubchapterorrulesorregulations adopted pursuant hereto;provided,such dwellingordwellingunit is,intheopinion of theB uilding Inspector,unfitforhuman habitation.

(2) N O TIC E TO O W N E R O FCO N D E M N A TIO N A N D IN TE N T TOP L A C A RD . W henever the B uild-ingInspector has condemned a dwelling ordwellingunit asunfit forhuman habitation,heshall give notice to the owner of suchcondemnation andof hisintent to placardthedwelling unit asunfit forhuman habitation.Suchnoticeshall:

(a) B eput in writing;

(b) Include a description of the realestatesufficient foridentification;

(c) Includea statement of thereasonwhyit isbeingissued;

(d) Includea description of therepairsand improvements required tobring the condemned dwelling ordwelling unit into compliancewiththeprovisionsof thissection andanyrulesand regulationsadoptedpursuant hereto;

(e) Include an explanation of theowner'sright to seek modificationor withdrawal of the notice bypetition to theB uildingInspectorinaccordance with the provision of§§14.37(2)and(3);and

(f) B eserved upon theowner;provided,such notice shall be deemed to beproperlyserved upon such ownerif acopy thereof is delivered to himpersonallyorbysendingacopythereofbycertified mail with return receiptrequestedto hislast known address,or,if thecertified letterwith thecopyisreturned with a receipt showing it hasnot been deliveredto him,bypostingacopythereof in a conspicuousplaceinorabout thedwelling affected bythenotice. C opies of all condemnationnotices shall be forwarded to theB uildingInspector,but failureto fulfillthis notification to the B uildingInspector shall not invalidate thecondemnation procedure.

(3) A P P E A L O F N O TIC E RE L A TIN G TOCO N D E M N A TIO N .A nyowneraffectedbyanynoticerelating to thecondemnation of adwelling ordwelling unit asunfit forhumanhabitation mayrequest and shall begranted ahearing on the matter before the B oard ofZ oningA ppealsundertheprocedureset forthin §§14.37.

(4) P L A C A RD IN G O R CO N D E M N IN GD W E L L IN GS A N D D W E L L IN G UN ITSA S UN FIT FO R H UM A N H A B ITA TIO N .A fter the condemnation notice which isrequired under sub.(2) hasresulted in anorderin accordancewith§§14.37,theB uilding

Inspectorshallplacardtheaffecteddwellingordwelling unit asunfit forhuman habitation.The B uilding Inspector shall post, in aconspicuousplaceupon theaffected dwellingordwellingunit,a placardbearingthefollowingwords: "Condemned as Unfit for H umanH abitation."

(5) V A C A TIO N O F C O N D E M N E D A N DP L A C A RD E D D W E L L IN GS A N DD W E L L IN G UN ITS. A nydwelling ordwelling unit which hasbeen condemnedand placarded as unfit for humanhabitation bytheB uilding Inspectorshallbe vacated within a reasonable time asrequired bythe B uilding Inspector.N oowneroroperatorshall let to anypersonforhuman habitation and no person shalloccupyanydwellingordwellingunit whichhasbeen condemnedand placarded bytheB uildingInspectorafterthedateon whichthe B uilding Inspector hasrequired theaffected dwelling or dwelling unit to bevacated.

(6) P L A C A RD N O T TO B E RE M O V E DUN TIL D E FE CTS A RE E L IM IN A TE D .N o dwelling ordwelling unit which hasbeencondemned and placarded asunfit forhumanhabitation shall be occupied until writtenapprovalissecured from,and such placard isremoved by, the B uilding Inspector. TheB uilding Inspectorshall removesuch placardwheneverthedefect ordefectsupon whichthecondemnation and placardingaction werebasedhavebeen eliminated.

(7) P L A C A RD TO B E RE M O V E D O N L YB Y B UIL D IN G IN SP E C TO R. N operson shall defaceorremovetheplacardfrom anydwelling ordwelling unit whichhasbeen condemned asunfit forhumanhabitation andplacardedassuch,except asprovidedin sub.(6).

14.45 SUBCHAPTER DOES NOT IMPAIRAUTHORITY OF BUILDING INSPECTORAND/OR CITY TO ACT ON NUISANCESOR TO RAZE BUILDING UNDER §66.05WIS. STATS. N othing in thissubchaptershall beconstrued to impairorlimit theCityin defining anddeclaring nuisances or the B uilding Inspector inremoving orabating nuisancesbysummaryorotherappropriate proceedings or the Cityand/or theB uildingInspectorto razebuildingswithin theCityasauthorized byW isconsin Statutes(see§66.05,W is.Stats).

14.46 SUBCHAPTER DOES NOT ABROGATEPROVISIONS OF BUILDING CODE. Theprovisionsof thissubchaptershall not abrogatetheresponsibilityof anyperson to complywithanyprovisionsof theStateB uildingC odeand theB uildingandZ oningC odesof theC ity.

14.47 DISCLAIMER ON INSPECTIONS. Thepurpose of the inspectionsunder thiscode istoimprove the qualityof housing in the City.Theinspectionsand thereportsand findingsissued aftertheinspectionsarenot intendedas,noraretheyto beconstrued,asa guarantee.In order to so adviseownersand other interested persons,a disclaimershallbeincludedin each inspection report asfollows:“The findings of inspection contained herein areintendedto report conditionsof noncompliancewithcodestandardsthat arereadilyapparent at thetimeofinspection.Theinspection doesnot involvea detailedexamination of themechanicalsystemsortheclosedpremises. N o warrantyof the operation, use ordurabilityof equipment and materialsnot specificallycitedherein isexpressedorimplied.”

14.48 PENALTIES. A nyperson violating anyorderoftheB uildingInspectorbasedon theprovisionsof thissubchapteroranyprovisionsof anyruleorregulationadopted by this B uilding Inspector pursuant toauthority granted by thissubchapter,shall uponconviction thereof,be subject to a forfeiture asprovided by§25.04 of thisM unicipal C ode.E achviolation andeachdaya violation continuesoroccursshall constitutea separateoffense.A fterconvictionand punishment forviolation of such orderof theB uildingInspectorbased upon theprovisionsof thissubchapteroranyprovisionsof anyruleorregulationadopted bytheB uilding Inspector,if such personcontinuesto violatesuch order,such person shallbeliable for further prosecution, conviction, andpunishment upon such order,without theB uildingInspectorissuing a new order,until such orderhasbeen compliedwith.

14.49 ACTION TO ABATE. Upon request bytheB uilding Inspector,the CityA ttorneyshall beempowered to bring an action to enjoin theuseand/or occupancyof a dwelling unit,dwelling,accessorybuilding orotherbuilding covered bythissub-chapteralleged to bein violation of thissub-chapter and such action mayinclude thepenaltiesasprovidedin §14.47.

14.61 AUTHORITY.

(2) The provisions of this ordinance aredeemed not to limit anyother lawfulregulatorypowersof thesamegoverningbody.

(b) Targeted non-agriculturalperformance standardspromulgated in rules by theW isconsin D epartment of N aturalResources under §N R 151.004,W is.A dm.C ode.

14.62 FINDINGS OF FACT. TheCommon C ouncilfindsthat uncontrolled,post-construction runoffhasa significant impact upon waterresourcesandthe health, safety, and general welfare of thecommunityand diminishesthepublic enjoymentand use of natural resources. Specifically,uncontrolledpost-construction runoff can:

(1) D egrade physical stream habitat byincreasingstream bankerosion,increasingstreambed scour, diminishinggroundwaterrecharge,diminishing streambase flow s and increasing streamtemperature.

(2) D iminish the capacity of lakes andstreams to support fish, aquatic life,recreational and water supply uses byincreasing pollutant loading of sediment,suspended solids,nutrients,heavymetals,bacteria, pathogens, and other urbanpollutants.

(3) A lter wetland communitiesbychangingwetland hydrology and by increasingpollutant loads.

(4) Reduce the qualityof groundwater byincreasingpollutant loading.

(5) Threaten public health,safety,property,and general welfarebyovertaxing stormsewers,drainage ways,and other minordrainagefacilities.

(6) Threaten publichealth,safety,property,andgeneral welfare byincreasing major floodpeaksandvolumes.

(7) Undermine floodplain managementefforts byincreasing the incidence andlevelsof flooding.

14.63 PURPOSE AND INTENT.

(1) P URP O SE .Thegeneral purposeof thisordinanceisto establish long-term,post-construction runoff managementrequirementsthat willdiminish thethreatsto public health,safety,welfare,and theaquatic environment. Specific purposesareto:

(a) Further the maintenance of safeandhealthfulconditions.

(b) P revent and control the adverseeffects of stormwater; prevent andcontrol soil erosion; prevent andcontrol water pollution; protectspawning grounds,fish,and aquaticlife;controlbuildingsites,place-ent ofstructures and land uses; preserveground coverand scenic beauty;andpromotesoundeconomicgrowth.

(c) C ontrol exceedance of the safecapacityof existingdrainagefacilitiesand receiving waterbodies;preventundue channel erosion; controlincreases in the scouring andtransportation of particulate matter;and prevent conditions thatendangerdownstream property.

(d) P romote the public health, safety,prosperity, and general welfare ofthecitizensof theC ityof B araboo byconserving thesoil,water,and relatedresources and control erosion andsedimentation.

(2) IN TE N T.It istheintent of theC ommonCouncil that thisordinance regulatespost-construction storm-waterdischargesto watersof thestate.Thisordinancemaybeappliedona site-by-site basis.The C ommon C ouncilrecognizes, however, that the preferredmethod of achieving the stormwaterperformance standards set forth in thisordinance is through the preparation andimplementation of comprehensive,systems-level stormwater management plans thatcoverhydrologicunits,suchaswatersheds,ona municipal and regional scale.Such plans

mayprescribe regional stormwater devices,practicesorsystems,anyof which maybedesigned to treat runoff from morethan onesitepriorto dischargeto watersof thestate.W heresuch plansarein conformancewiththeperformancestandardsdeveloped under§281.16,W is.Stats.,forregional storm-atermanagement measures and have beenapproved bytheC ommon C ouncil,it istheintent of thisordinance that the approvedplan be used to identifypost-constructionmanagement measures acceptable for thecommunity.

14.64 APPLICABILITY AND JURISDICTION.

(1) A P P L IC A B IL ITY .

(a) W here not otherwise limited bylaw, this ordinance applies afterfinal stabilization to a siteof landdisturbing construction activitymeeting anyof thecriteria in thisparagraph, unless the site isotherwiseexempt underparagraph(b).

1. A post-developmentconstruction site with one ormoreacresof land disturbingconstruction activity.

2. A post-developmentcommercial or industrialconstruction site with agrossaggregatearea of 0.5acresormore.

(b) A sitethat meetsanyof thecriteria inthisparagraph isexempt from therequirementsof thisordinance.

1. A redevelopment post-construction site with noincrease in exposed parkinglotsorroads.

2. A post-construction site withless than 10% connectedimperviousness based oncompletedevelopment of thepost-construction site,provided the cumulative areaof allparkinglotsandrooftopsislessthan oneacre.

3. N onpoint discharges fromagricultural facilities andpractices.

4. N onpoint discharges fromsilvicultureactivities.

5. Routine maintenance forproject sitesunder 5 acresof land disturbance ifperformed to maintain theoriginal line and grade,

hydraulic capacity ororiginal purpose of thefacility.

6. Underground utilityconstruction such as water,sewer,andfiberopticlines.Thisexemption doesnot applytotheconstruction of anyaboveground structures associatedwithutilityconstruction.

(c) N otwithstanding the applicabilityrequirementsin paragraph (a),thisordinance applies to post-construction sitesof anysizethat,intheopinion of theC ityE ngineer,islikelyto result in runoff that exceedsthe safe capacity of the existingdrainagefacilitiesorreceiving bodyof water,that causesunduechannelerosion, that increases waterpollution by scouring or thetransportation of particulate matterorthat endangerspropertyorpublicsafety.

(2) JURISD ICTIO N .Thisordinanceappliesto post construction sites within theboundariesand jurisdiction of theC ityofB araboo and,to theextent allowedbylaw,to lands subject to extraterritorial platapprovaljurisdiction asprovidedbyC h.18of thisCode if said landsare within adrainage basin or watershed thatdischargesstormwaterinto theC ity.

(3) E X CL USIO N S. This ordinance is notapplicableto activitiesconducted bya stateagency,asdefined under§227.01 (1),W is.Stats.,but also includingtheofficeof districtattorney,which issubject to thestateplanpromulgated or a memorandum ofunderstanding entered into under §281.33(2),W is.Stats.

14.65 DEFINITIONS.

(1) A D M IN ISTE RIN G A UTH O RITYmeans the C ity of B araboo E ngineer,empowered under §62.234, W is. Stats.,that is designated by the C ommonC ouncilto administerthisordinance.

(2) A GRIC UL TURA L FA C IL ITIE S A N DP RA C TIC E S hasthe meaning given in§281.16,W is.Stats.

(3) A GRIC UL TURA L L A N D S are landsusedfortheproduction of foodandfiber,including but not limited to, generalfarming, livestock, and poultryenterprises, grazing, nurseries,horticulture, viticulture, truck farming,

forestry, sod production, cranberryproduction,and wild cropharvesting andincludeslandsused foron-sitestructuresnecessaryto carryout such activities.

(4) A V E RA GE A N N UA L RA IN FA L Lmeans a calendar year of precipitation,ex cluding snow, w hich is consideredtypical.

(5) "B E ST M A N A GE M E N T P RA C TIC E "or "B M P " means structural or non-structural measures,practices,techniquesordevicesemployed to avoid orminimizesediment orpollutantscarriedin runoff towatersof thestate.

(6) B USIN E SS D A Y meansa daytheofficeof the C ityE ngineer is routinelyandcustomarilyopen forbusiness.

(7) C E A SE A N D D E SIST O RD E R meansacourt-issued orderto halt land disturbingconstruction activity that is beingconductedwithout therequiredpermit.

(8) CITY E N GIN E E R means thegovernmental employeedesignated bythegovernmental body to administer thisO rdinance, and includes any othergovernmental employees who aresupervisedbytheadministrator.

(9) C L O SE D W A TE RSH E D shall mean adrainagebasin orwatershed which doesnotdischarge storm-water during a storm oftwenty-four(24)hourduration and two-(2)year recurrence interval occurring over thebasin with the land in itspredevelopmentcondition.

(10) CO M B IN E D SE W E R SYSTE M means asystem forconveyingboth sanitarysewageandstormwaterrunoff.

(11) C O M M E RC IA L L A N D USE shall meanuseof theland fortheretailorwholesaleofgoodsorservices.

(12) CO N N E C TE D IM P E RV IO USN E SSmeansan impervioussurfacethat isdirectlyconnected to a separate storm sewer orwaterof thestatevia an imperviousflowpath.

(13) C O N TRO L P L A N is a writtendescription approved by the C ityE ngineer’s authority, of methods forcontrolling sediment pollution fromacceleratederosion on a development areaand/or from erosion caused byaccelerated runoff from a developmentarea andcontrollingrunoff.

(14) C UB IC Y A RD S means the amount ofmaterial in excavation and/or fillmeasured bythemethod of "averageendareas."

(15) C URV E N UM B E R shallmean asused inthe runoff calculation methodologypromulgated bythe United States SoilC onservation Service N ationalE ngineeringH andbook(seeA pp.B ).

(16) D E SIGN STO RM meansa hypotheticaldiscrete rainstorm characterized by aspecific duration, temporal distribution,rainfall intensity, return frequency, andtotaldepth of rainfall.

(17) D E V E L O P M E N T means residential,commercial, industrial or institutional landuses,andassociatedroads.

(18) D IV ISIO N O F L A N D means thecreation from oneparcel of [number]ormoreparcelsorbuildingsitesof [number]or fewer acreseach in area where suchcreation occursat onetimeorthrough thesuccessivepartition within a 5-yearperiod.

(19) E FFE CTIV E IN FIL TRA TIO N A RE Ameansthearea of theinfiltration system thatisused to infiltrate runoff and doesnotincludethearea used forsiteaccess,bermsorpretreatment.

(20) E RO SIO N meanstheprocessbywhich theland'ssurfaceisworn awaybytheaction ofwind,water,iceorgravity.

(21) E X C E P TIO N A L RE SO URC EW A TE RS means waters listed in §N R102.11,W is.A dm.C ode.

(22) E X C A V A TIO N meansanyact bywhichorganic matter,earth,sand,gravel,rock oranyothersimilarmaterial iscut into,dug,quarried, uncovered, removed, displaced,relocated orbulldozed and shallincludetheconditionsresultingtherefrom.

(23) E X TRA TE RRITO RIA L means theunincorporated area within 3 milesof thecorporatelimitsof a first,second,orthirdclasscity,orwithin 1.5 milesof a fourthclasscityorvillage.

(24) E X ISTIN G GRA D E means the verticallocation of theexisting ground surfacepriorto excavation of filling.

(25) FIL L meansanyact bywhich earth,sand,gravel,rockoranyothermaterialisdeposited,placed,replaced,pushed,dumped,pulled,transported ormoved byhumansto a newlocation and shall include the conditionsresultingtherefrom.

(26) FIN A L STA B IL IZ A TIO N meansthat allland disturbingconstruction activitiesat theconstruction sitehavebeen completed andthat a uniform,perennial,vegetativecoverhasbeen established,with a densityof atleast 70% of the cover,for the unpavedareasand areasnot covered bypermanentstructures, or employment of equivalentpermanent stabilization measures.

(27) FIN A N C IA L GUA RA N TE E means aperformance bond, maintenance bond,suretybond,irrevocableletterof credit,orsimilar guarantees submitted to the CityE ngineerbytheresponsiblepartyto assurethat requirements of the ordinance arecarried out in compliance with thestormwatermanagement plan.

(28) GO V E RN IN G B O D Y means theB araboo C ityC ouncil.

(29) GRA D IN G isaltering theelevation of theland surfacebystripping,excavating,filling,stockpiling of soil materials or anycombination thereof and shall includetheland from which thematerial wastaken orupon whichit wasplaced.

(30) H YD RO L O GIC SO IL GRO UP shallmean as used in the runoff calculationmethodologypromulgated bythe UnitedStatesSoil C onservation Service N ationalE ngineeringH andbook(seeA ppendix C ).

(31) IM P E RV IO US SURFA C E meansan areathat releasesasrunoff all ora largeportionof theprecipitation that fallson it,exceptfor frozen soil. Rooftops, sidewalks,driveways, parking lots, and streets areexamples of areas that typically areimpervious.

(32) IN D USTRIA L L A N D USE shall meanexteriorstorageareas,loading and unloadingareas,equipment washing areasorotherareaor surface directly associated with anindustrial process or a land use activitycovered under the W isconsin P ollutantD ischargeE limination System.

(33) IN -FIL L A RE A meansan undevelopedarea of land located within ex istingdevelopment.

(34) IN FIL TRA TIO N means the entry ofprecipitation orrunoff into orthrough thesoil.

(35) IN FIL TRA TIO N SYSTE M meansa deviceor practice such asa basin,trench,raingarden or swale designed specificallytoencourageinfiltration,but doesnot includenaturalinfiltration in pervioussurfacessuch

aslawns,redirectingof rooftopdownspoutsonto lawns or minimal infiltration frompractices, such as swales or road sidechannels designed for conveyance andpollutant removalonly.

(36) KA RST FE A TURE means an area orsurficialgeologicfeaturesubject to bedrockdissolution so that it islikelyto provideaconduit to groundwater,and mayincludecaves, enlarged fractures, mine features,ex posed bedrock surfaces, sinkholes,springs,seeps,orswallets.

(37) L A N D D ISTURB IN GC O N STRUC TIO N A C TIV ITY meansany man-made alteration of the landsurface resulting in a change in thetopographyorex isting vegetativeornon-vegetative soil cover,that mayresult inrunoff and lead to an increase in soilerosion and movement of sediment intowaters of the state. L and disturbingconstruction activityincludesclearing andgrubbing, demolition, ex cavating, pittrench dewatering, filling, and gradingactivities.

(38) L A N D O C C UP IE R O R O C C UP IE RO F L A N D means any person,partnership,firm orcorporation that hasafee simple interest in the land either assoleowner,asa tenant in common orajoint tenant orholdsasa trustee,assignee,orholdsasa landcontract vendee.

(39) L A N D USE RS are those w ho use land,individually or collectively as ow ners,operators,lessors,renters,occupierswhoareproviding a servicethat requiresaccessor alterations of the land in order toperform the service, or by otherarrangement which gives them theresponsibilityof privateorpubliclanduse.

(40) M A IN TE N A N C E A GRE E M E N Tmeansa legal document that providesforlong-term maintenance of stormwatermanagement practices.

(41) "M E P " or M A X IM UM E X TE N TP RA CTIC A B L E means a level ofimplementing best management practicesinorder to achieve a performance standardspecified in thisordinancewhich takesintoaccount the best available technology,costeffectivenessandothercompetingissuessuchashuman safetyand welfare,endangered andthreatened resources,historic propertiesandgeographicfeatures.M E P allowsflexibilityinthewayto meet theperformancestandardsand mayvarybased on the performancestandardandsiteconditions.

(42) N E W D E V E L O P M E N T meansdevelopment resulting from theconversion

of previously undeveloped land oragriculturallanduses.

(43) O FF-SITE means located outside theproperty boundary described in thepermit application.

(44) O N -SITE means located within theproperty boundary described in thepermit application.

(45) O RD IN A RY H IGH -W A TE R M A RKhasthemeaning given in §N R 115.03(6),W is.A dm.C ode.

(46) O UTSTA N D IN G RE SO URC EW A TE RS means waters listed in §N R102.10,W is.A dm.C ode.

(47) P A RC E L isallcontiguouslandsundertheow nership orcontrol of a land occupierorlanduser.

(48) P E A K FL O W isthe maximum rate offlow of water at a given point in achannel,watercourse,orconduit resultingfrom thepredeterminedstorm orflood.

(49) P E RC E N T FIN E S meansthepercentageof a given sample of soil,which passesthrougha # 200sieve.

(50) P E RFO RM A N C E STA N D A RD meansanarrative or measurable numberspecifying the minimum acceptableoutcomefora facilityorpractice.

(51) P E RM IT meansa written authorizationmade by the C ity E ngineer to theapplicant to conduct land disturbingconstruction activityorto dischargepost-construction runoff to watersof thestate.

(52) P E RM ITTE E means any person towhom a permit is issued under thisO rdinance.

(53) P E RM IT A D M IN ISTRA TIO N FE Emeansa sum of moneypaid to theCityE ngineer bythe permit applicant for thepurposeof recoupingtheexpensesincurredbytheauthorityin administeringthepermit.

(54) P E RSO N is anyindividual, corporation,partnership, joint venture, agency,unincorporated association, municipalcorporation,county,orstateagencywithinW isconsin,thefederal government,oranycombination thereof.

(55) P E RV IO US SURFA C E means an areathat releasesasrunoff a small portion oftheprecipitation that fallson it.L awns,gardens,parks,forests or other similarvegetated areasareex amplesof surfacesthat typicallyarepervious.

(56) P O L L UTA N T hasthemeaning given in§283.01(13),W is.Stats.

(57) P O L L UTIO N hasthemeaning given in§281.01(10),W is.Stats.

(58) P O ST-C O N STRUC TIO N SITE meansaconstruction sitefollowing thecompletionof land disturbing construction activityandfinalsitestabilization.

(59) P RE -D E V E L O P M E N T C O N D ITIO Nmeanstheextent and distribution of landcovertypespresent beforetheinitiation ofland disturbing construction activity,assuming that all land uses prior todevelopment activityare managed in anenvironmentallysound manner. For thepurposesof thisordinance,predevelopmentconditionsshallmean landwhich hasrunoffcharacteristics equivalent to runoff curvenumbersof:30,58,71,and78.

(60) P RE V E N TIV E A C TIO N L IM IT hasthemeaning given in §N R 140.05(17),W is.A dm.C ode.

(61) P UB L IC L A N D S mean all landsthat aresubject to regulation bytheC ity,including,but not limitedto:

(a) A ll landsow ned orcontrolled bytheC ity,and

(b) A ll land, within the boundaries orextraterritorialcontrolof theC ity,whichare owned by another unit ofgovernment if that unit of governmentisacting in a proprietaryrather thangovernmentalfunction.

(64) RE C URRE N C E IN TE RV A L of a stormof given intensityand duration is theaverageperiod of timebetween stormsofthe same duration and equal or greaterintensity.

(65) RE D E V E L O P M E N T meansareaswheredevelopment is replacing olderdevelopment.

(66) RE M O V A L means cutting vegetation totheground orstumps,completeextraction,orkillingbyspraying.

(67) RE SP O N SIB L E P A RTY means anyentityholding feetitleto thepropertyorother person contracted or obligated byother agreement to implement andmaintain post-construction stormwaterB M P s.

(68) RUN O FF means stormwater orprecipitation includingrain,snow oricemeltor similar water that moveson the landsurfacevia sheet orchannelizedflow.

(69) SE D IM E N T issolidmaterial,both mineraland organic,that isin suspension,isbeingtransported,orhasbeen moved from itssiteof origin byair,water,gravityorice,and hascometo rest on theearth'ssurfaceat a different site.

(70) SE D IM E N TA TIO N isthetransportationand deposition of sediment that mayultimately degrade water quality by thepresence of suspended solid particles,derived from soilsbyerosion ordischargedinto surfacewatersfrom othersources;orthedepositionof water borne sediments in streamchannels,lakes,reservoirs,oron floodplains,usuallybecauseof a decreasein thevelocityof thewater.

(71) SE P A RA TE STO RM SE W E R meansaconveyance or system of conveyancesincluding roads with drainage systems,streets, catch basins, curbs, gutters,ditches, constructed channels or stormdrains,which meetsall of thefollowingcriteria:

(a) Isdesigned orused forcollectingwaterorconveyingrunoff.

(c) Is not draining to a stormwatertreatment deviceorsystem.

(72) SITE meansthe entire area included inthelegaldescription of theland on whichthe land disturbing construction activityoccurred.

(73) STO P W O RK O RD E R means an orderissued bytheC ityE ngineerwhich requiresthat all construction activityon thesitebestopped.

(74) STO RM (W A TE R)RUN O FF isthewaterderived from rains falling within atributarydrainagebasin,flowing overthesurface of the ground or collected inchannels,watercoursesorconduits.

(75) STO RM SE W E R isa closed conduit forconductingcollectedstormwater.

(76) STO RM W A TE R D RA IN A GEFA C IL ITY isanyelement in a stormwaterdrainagesystem that ismadeorimprovedbyhumans.

(77) STO RM W A TE R D RA IN A GE SY STE Mis all facilities used for conductingstormwater to, through, and from adrainagearea to thepoint of final outlet,including but not limited to,anyof the

following:conduitsandappurtenant features,canals,channels,ditches,streams,culverts,streetsandpumpingstations.

(78) STO RM W A TE R M A N A GE M E N T P L A Nmeans a comprehensive plan designed toreduce the discharge of pollutants fromstormwaterafterthesitehasundergonefinalstabilization following completion of theconstruction activity.

(79) STO RM W A TE R M A N A GE M E N TSY STE M P L A N isa comprehensiveplandesignedto reducethedischargeof runoffand pollutantsfrom hydrologicunitson aregionalormunicipalscale.

(80) STRUCTURA L M E A SURE S areworksofimprovement for land stabilization toprevent erosion,sediment orrunoff whichincludes,but arenot limitedto,gullycontrolstructures,grasswaterways,riprap,detentionbasins, sediment basins, flood retentiondams,diversions,liningchannelswith rock,concreteorothermaterials.C ontourstripcroppingisnot a structuralmeasure.

(81) TE C H N IC A L STA N D A RD means adocument that specifiesdesign,predictedperformance, and operation andmaintenancespecificationsfora material,deviceormethod.

(82) TO P O F TH E C H A N N E L means anedge,orpoint on thelandscape,landwardfrom theordinaryhigh-water mark of asurfacewaterof thestate,w heretheslopeof the land beginsto be lessthan 12%continuallyforat least 50 feet.If theslopeof theland is12% orlesscontinuallyforthe initial 50 feet, landward from theordinaryhigh-water mark,the top of thechannelistheordinaryhigh-watermark.

(83) TR-55 means the United StatesD epartment of A griculture, N aturalResources C onservation Service(previously Soil C onservation Service),Urban H ydrologyfor Small W atersheds,Second E dition, Technical Release 55,June1986.

(84) TYP E IID ISTRIB UTIO N meansa rainfalltypecurveasestablished in United StatesD epartment of A griculture, SoilConservation Service,Technical P aper149,published 1973. The Type II curve isapplicableto allof W isconsin andrepresentsthemost intensestorm pattern.

14.66 TECHNICAL STANDARDS. Thefollowingmethods shall be used in designing the waterquality, peak flow shaving and infiltrationcomponentsof stormwater practicesneeded tomeet thewaterqualitystandardsof thisordinance:

(1) Technical standardsidentified,developedor disseminated by the W isconsinD epartment of N atural ResourcesunderSubch.V of C h. N R 151, W is. A dm.C ode.

(2) W here technical standardshavenot beenidentified or developed bythe W isconsinD epartment of N atural Resources, othertechnical standardsmaybeused providedthat themethodshavebeen approved bytheCityE ngineer.

(3) In thisordinance,the follow ing year andlocation hasbeen selectedasaverageannualrainfall:M adison,1981(M ar.12-D ec.2).

14.67 PERFORMANCE STANDARDS.

(1) RE SP O N SIB L E P A RTY .The responsiblepartyshall implement a post-constructionstormwatermanagement plan.

(2) P L A N . A written stormwater managementplan in accordance with 14.69 shall bedeveloped and implemented for each post-construction site.

(3) RE Q UIRE M E N TS. The plan requiredundersub.(2)shallincludethefollowing:

(a) Total Suspended Solids.B M P sshallbedesigned,installedandmaintainedto control total suspended solidscarried in runoff from the post-construction siteasfollows:

1.For new development, bydesign,reduceto themaximumextent practicable, the totalsuspended solidsload by80% ,based on the average annualrainfall, as compared to norunoff management controls.N o person shall berequired toexceed an 80% total suspendedsolids reduction to meet therequirements of thissubdivision.

2.Forredevelopment,bydesign,reduceto themaximum extentpracticable,thetotal suspendedsolidsload by40% ,based onthe average annual rainfall,ascompared to no runoff

management controls. N operson shall be required toexceed a 40% total suspendedsolids reduction to meet therequirements of thissubdivision.

3.For in-fill development under 5acresthat occurswithin 10 yearsafterO ctober1,2002,bydesign,reduce to the maximum extentpracticable, the total suspendedsolidsload by40%,based on anaverage annual rainfall, ascompared to no runoffmanagement controls.N o personshall berequired to exceed a 40%totalsuspendedsolidsreduction tomeet the requirements of thissubdivision.

4.Forin-filldevelopment that occurs10ormoreyearsafterO ctober1,2002, bydesign, reduce to themaximum extent practicable,thetotal suspended solids load by80%,based on an averageannualrainfall,ascompared to no runoffmanagement controls.N o personshallberequiredto exceedan 80%totalsuspendedsolidsreduction tomeet the requirements of thissubdivision.

5.N otwithstandingSubs.1.to 4.,ifthe design cannot achieve theapplicabletotal suspended solidsreduction specified, thestormwater management planshall includea written and site-specificexplanation whythat levelof reduction isnot attained andthe total suspended solids loadshallbereducedto themaximumextent practicable.

(b) P eakD ischarge.

1.B y design, B M P s shall beemployedto maintain orreducethepeak runoff dischargeratesfrom thepost-construction site,according the followingstandards:

a.L imit peak flow rates ofstorm runoff afterdevelopment to seventyfivepercent (75% )of that whichwould haveresultedfrom thesame storm occurring overthesitewith theland in itspredevelopment condition,for storms of twenty-four(24) hour duration and

recurrence intervals of two(2), five (5), ten (10), andtwenty-five(25)years

b.N ot increase the peak flowrates of storm runoff afterdevelopment to that whichwould haveresulted from thesamestorm occurring overthesite with the land in itspredevelopment condition,forstormsof twenty-four(24)hourduration and a recurrenceintervalof 50-years.

c.O n sites w here on-sitedetention isused for runoffcontrol, safely contain andsafelypass the runoff of a100- year storm of anyduration.

2.P redevelopment C onditionsshall mean land w hich hasrunoff characteristicsequivalentto runoff C urveN umbers(C N )in Table1:

3.This subsection of theordinance does not applytoanyof thefollowing:

a.A post-construction sitewhere the change inhydrology due todevelopment does notincrease the existing surfacewater elevation at anypointwithin the downstreamreceiving waterbymorethan0.01 of a foot forthe2-year,24-hourstorm event.

b.A redevelopment post-construction site.

c.A n in-fill development arealessthan 5acres.

(c) Runoff V olume.In thecaseof closedwatersheds, the volume of stormrunoff resulting from the ten-(10)yearstorm of twenty-four(24)hourduration shall not be greater afterdevelopment than would haveresulted from the same stormoccurring overthesitewith thelandin itspre-development condition.

(d) Infiltration.B M P sshall bedesigned,installed,and maintained to infiltraterunoff to the maximum ex tentpracticable in accordance with thefollowing, except as provided inSubs.5.through 8.

1. For residentialdevelopments one of thefollowingshallbemet:

a.Infiltrate sufficient runoffvolume so that the post-development infiltrationvolume shall be at least90% of the pre-development infiltrationvolume, based on anaverage annual rainfall.H owever,when designingappropriate infiltrationsystems to meet thisrequirement,no morethan1% of the project site isrequired as an effectiveinfiltration area.

b.Infiltrate25% of thepost-development runoff fromthe two-year -24 hourdesign storm with a typeIIdistribution.Separatecurvenumbersforperviousandimpervious surfaces shallbeused to calculaterunoffvolumesandnot compositecurve numbersasdefinedin TR-55.H owever,whendesigning appropriateinfiltration systemsto meetthisrequirement,no morethan 1% of theproject siteisrequired asan effectiveinfiltration area.

2. For non-residentialdevelopment, includingcommercial,industrial,andinstitutional development,one of the following shallbemet:

a.Infiltrate sufficient runoffvolumeso that thepost-development infiltrationvolume shall be at least60% of the pre-development infiltrationvolume, based on anaverage annual rainfall.H owever,when designingappropriate infiltration

systems to meet thisrequirement,no morethan2% of the project siteisrequired as an effectiveinfiltration area.

b. Infiltrate10% of therunofffrom thetwo-year-24hourdesign storm with a typeIIdistribution.Separate curvenumbers for pervious andimpervioussurfacesshall beused to calculate runoffvolumes,andnot compositecurvenumbersasdefinedinTR-55. H owever, whendesigning appropriateinfiltration systemsto meetthisrequirement,no morethan 2% of theproject siteisrequired as an effectiveinfiltration area.

3. P re-development conditionshall bethesameasin par.(b).

4. B efore infiltrating runoff,pretreatment shallberequiredforparkinglot runoff andforrunoff from new roadconstruction in commercial,industrial, and institutionalareas that will enter aninfiltration system. Thepretreatment shall bedesigned to protect theinfiltration system fromclogging prior to scheduledmaintenance and to protectgroundwater quality inaccordance with Sub. 8.P retreatment options mayinclude,but are not limitedto, oil/grease separation,sedimentation, biofiltration,filtration, swales or filterstrips.

5. E xclusions.Therunoff fromthe following areas areprohibited from meeting therequirements of thisparagraph:

a. A reas associated withtier1 industrial facilitiesidentified in §N R216.21(2)(a),W is.A dm.C ode,including storage,loading, rooftop, andparking.

b. Storageand loading areasof tier 2 industrialfacilitiesidentifiedin §N R216.21(2)(b),W is.A dm.C ode.

c.Fueling and vehiclemaintenanceareas.

d.A reas within 1000 feetupgradient or within 100feet downgradient of karstfeatures.

e. A reas with less than 3feet separation distancefrom thebottom of theinfiltration system to theelevation of seasonalhigh groundwaterorthetop of bedrock, exceptthis Sub.5.e.does notprohibit infiltration ofroof runoff.

f. A reas with runoff fromindustrial, commercial,and institutional parkinglots and roads andresidential arterial roadswith less than 5 feetseparation distance fromthe bottom of theinfiltration system to theelevation of seasonalhighgroundwaterorthetopofbedrock.

g.A reaswithin 400feet of acommunitywater systemwell asspecified in §N R811.16 (4), W is. A dm.Code,orwithin 100 feetof a private well asspecified in §N R812.08(4), W is. A dm.Code, for runoffinfiltrated fromcommercial, industrial,and institutionalland usesor regional devices forresidentialdevelopment.

h.A reas wherecontaminants ofconcern, as defined in§N R 720.03(2), W is.A dm.C ode are presentin the soil throughwhich infiltration willoccur.

i.A nyarea wherethesoildoesnot exhibit one of thefollowing soil characteristicsbetween thebottom of theinfiltration system and theseasonal high groundwaterand topof bedrock:at leasta 3-foot soillayerwith 20%finesorgreater;orat least a5-foot soil layer with 10percent fines or greater.Thisdoesnot applywherethesoil medium within theinfiltration system providesan equivalent level ofprotection. This Sub. 5.i.does not prohibitinfiltration of roof runoff.

6. E xemptions.Thefollowingarenot required to meet therequirements of thisparagraph:

a. A reaswheretheinfiltrationrateof thesoilislessthan 0.6inches/hourmeasuredat thesite.

b.P arking areasand accessroads less than 5,000square feet forcommercialand industrialdevelopment.

c.Redevelopment post-construction sites.

d.In-filldevelopment areaslessthan 5acres.

e.Infiltration areasduringperiodsw hen thesoilonthesiteisfrozen.

f. Roads in commercial,industrial and institutionalland uses, and arterialresidentialroads.

7. W here alternate uses ofrunoff areemployed,such asfortoilet flushing,laundryorirrigation,such alternateuseshall be given equal credittoward the infiltrationvolume required by thisparagraph.

a.Infiltration systemsdesigned in accordancewith thisparagraph shall,tothe extent technicallyandeconomically feasible,minimize the level ofpollutants infiltrating toground water and shall

maintain compliance withthepreventiveaction limitat a point of standardsapplication in accordancewith C h. N R 140, W is.A dm. C ode. H owever, ifsite specific informationindicates that compliancewith a preventive actionlimit isnot achievable,theinfiltration B M P maynotbe installed or shall bemodified to preventinfiltration to themaximumextent practicable.

b.N otwithstanding Sub.par.a.,thedischargefromB M P sshallremain belowtheenforcement standardat thepoint of standardsapplication.

(e) P rotectiveA reas.

1."P rotectivearea"meansan area ofland that commencesat thetopofthechannel of lakes,streams,andrivers, or at the delineatedboundaryof wetlands,and that isthe greatest of the followingwidths,as measured horizontallyfrom the top of the channel ordelineatedwetlandboundaryto theclosest impervious surface.H owever, in this paragraph,"protectivearea"doesnot includeanyarea of land adjacent to anystream enclosed within a pipeorculvert,such that runoff cannotentertheenclosureat thislocation.

a.For outstanding resourcewaters and exceptionalresource waters, and forwetlandsin areasof specialnatural resource interest asspecified in §N R 103.04,75feet.

b.For perennial andintermittent streamsidentifiedon a UnitedStatesgeologicalsurvey7.5-minuteseriestopographicmap,oracounty soil survey map,whichever ismore current,50feet.

c.Forlakes,50feet.

d.For highly susceptiblewetlands, 50 feet. H ighlysusceptible wetlands includethe following types: fens,sedge meadows, bogs, lowprairies, conifer swamps,shrubswamps,otherforestedwetlands,fresh wet meadows,shallow marshes, deepmarshes, and seasonallyflooded basins. W etlandboundarydelineationsshallbemadein accordancewith §N R103.08(1m). This paragraphdoes not applyto wetlandsthat have been completelyfilled in accordance with allapplicable state and federalregulations.Theprotectiveareafor wetlandsthat have beenpartiallyfilled in accordancewith all applicable state andfederal regulations shall bemeasured from the wetlandboundarydelineation afterfillhasbeen placed.

e.Forlesssusceptiblewetlands,10 percent of the averagewetland width,but no lessthan 10 feet normorethan30 feet. L ess susceptiblewetlands include degradedwetlands dominated byinvasivespeciessuch asreedcanarygrass.

f. In §1.a., d. and e.,determinationsof theex tentof the protective areaadjacent to wetlandsshallbemade on the basis of thesensitivity and runoffsusceptibilityof thewetlandin accordance with thestandards and criteria in§N R 103.03.

g.For concentrated flowchannelswith drainageareasgreater than 130 acres, 10feet.

2.Thisparagraph appliesto post-construction sites locatedwithin a protectivearea,exceptthoseareasex empted pursuantto Sub.4.

3.The following requirementsshallbemet:

a.Impervious surfaces shall bekept out of theprotectiveareato the maximum extentpracticable. The stormwatermanagement plan shallcontaina written site-specificexplanation for anypartsofthe protective area that aredisturbedduringconstruction.

b.W here land disturbingconstruction activity occurswithin a protectivearea,andwhereno impervioussurfaceis present, adequate sod orself-sustaining vegetativecoverof 70% orgreatershallbeestablishedandmaintained.The adequate sod or self-sustaining vegetative covershall besufficient to provideforbankstability,maintenanceof fish habitat and filtering ofpollutants from upslopeoverland flow areas undersheet flow conditions.N on-vegetative materials,such asrockriprap,maybeemployedon thebank asnecessarytoprevent erosion,such asonsteep slopes or where highvelocityflowsoccur.

c.B est management practicessuch asfilterstrips,swales,orwet detention basinsthat aredesignedto controlpollutantsfrom non-point sourcesmaybe located in the protectivearea.

4.Thisparagraph doesnot applyto:

a.Redevelopment post-construction sites.

b.In-fill development areaslessthan 5acres.

c.Structuresthat crossoraccesssurface waters such as boatlandings,bridges,andculverts.

d.Structures constructed inaccordance with§59.692(1v),W is.Stats.

e.P ost-construction sites fromwhich runoff doesnot enterthesurfacewater,except to theextent that vegetative groundcoverisnecessaryto maintainbank stability.

(f) D RA IN A GE SYSTE M . W hereconditionsaresuch that thedepth to

thewatertableisthree(3)feet orgreater during at least nine (9)monthsof theyear,thestormwaterdrainage system for the site shallinclude grassed swales for areadrainage and undergroundperforated drainage pipefor stormrunoff conveyance, except onindustrial and commercial sites,orsiteswheretheCityE ngineerfindstheaboveto beimpracticable.

(g) FUE L IN G A N D V E H IC L EM A IN TE N A N CE A RE A S. Fuelingand vehiclemaintenanceareasshall,tothemaximum extent practicable,haveB M P s designed, installed andmaintained to reducepetroleum withinrunoff,such that therunoff that enterswatersof thestatecontainsno visiblepetroleum sheen.

(h) SW A L E TRE A TM E N T FO RTRA N SP O RTA TIO NFA C IL ITIE S.

1. A pplicability.E xcept asprovidedin Sub.2.,transportation facilitiesthat use swales for runoffconveyance and pollutantremoval meet all of therequirementsof thissection,ifthe swalesare designed to themaximum extent practicable todo allof thefollowing:

a. B e vegetated. H owever,where appropriate, non-vegetative measuresmaybeemployed to prevent erosionor provide for runofftreatment,suchasrockriprapstabilization orcheckdams.

b. Carryrunoff through a swalefor200feet ormorein lengththat isdesigned with a flowvelocityno greater than 1.5feet persecond forthepeakflow generated using eithera2-year,24-hourdesign stormor a 2-year storm with aduration equalto thetimeofconcentration asappropriate.If a swale of 200 feet inlength cannot be designedwith a flow velocityof 1.5feet persecond orless,thenthe flow velocity shall bereduced to the maximumextent practicable.

2. E xemptions.TheC ityE ngineermay, consistent with water

qualitystandards,require otherprovisionsof thissection bemeton a transportation facilitywithan averagedailytravelof vehiclesgreaterthan 2,500and wheretheinitial surfacewaterof thestatethat therunoff directlyentersisanyof thefollowing:

a. O utstanding resourcewaters.

b. E x ceptional resourcewaters.

c. W aterslisted in §303(d)ofthefederal clean wateractthat are identified asimpaired in w hole or inpart, due to nonpointsourceimpacts.

d. W aters where targetedperformance standardsare developed under§N R 151.004,W is.A dm.C ode, to meet waterqualitystandards.

(4) GE N E RA L CO N SID E RA TIO N S FO R O N -SITE A N D O FF-SITE STO RM W A TE RM A N A GE M E N T M E A SURE S. Thefollowing considerationsshall beobserved inmanagingrunoff:

(a) N aturaltopographyand land coverfeatures such as natural swales,natural depressions, native soilinfiltrating capacity, and naturalgroundwater recharge areas shallbe preserved and used, to theex tent possible, to meet therequirementsof thissection.

(b) E mergency overland flow for allstormwater facilities shall beprovided to prevent exceeding thesafecapacityof downstream drainagefacilitiesand prevent endangermentof downstream propertyor publicsafety.

(5) L O C A TIO N A N D RE GIO N A LTRE A TM E N T O P TIO N .

(a) TheB M P smaybelocated on-siteor off-site as part of a regionalstormwater device, practice orsystem.

(b) P ost-construction runoff within anon-navigable surface water thatflowsinto a B M P ,such asa wetdetention pond,isnot required tomeet theperformancestandardsofthis ordinance. P ost-construction

B M P s may be located in non-navigablesurfacewaters.

(c) E xcept asallowed underpar.(d),post-construction runoff from newdevelopment shall meet thepost-construction performancestandards prior to entering anavigablesurfacewater.

(d) P ost-construction runoff from anydevelopment within a navigablesurface water that flows into aB M P isnot required to meet theperformance standards of thisordinanceif:

1.TheB M P wasconstructed priorto the effective date of thisordinance and the B M P eitherreceived a permit issued underCh.30,Stats.,ortheB M P didnot requirea C h.30,W is.Stats.,permit;and

2.The B M P is designed toproviderunoff treatment fromfutureuplanddevelopment.

(e) Runoff from existing development,redevelopment and in-fill areasshallmeet the post-constructionperformance standards inaccordancewith thisparagraph.

1.To the maximum extentpracticable, B M P s shall belocated to treat runoff prior todischarge to navigable surfacewaters.

2.P ost-construction B M P s forsuch runoff maybelocated in anavigable surface water ifallowable under all otherapplicable federal, state, andlocal regulations such as C h.N R 103,W is.A dm.C odeandC h.30,W is.Stats.

(f) The discharge of runoff from aB M P , such as a wet detentionpond, or after a series of suchB M P sissubject to thischapter.

(g) TheC ityE ngineermayapproveoff-site management measuresprovidedthat allof thefollowingconditionsaremet:

1.TheC ityE ngineerdeterminesthatthe post-construction runoff is

covered by a storm-watermanagement system plan that isapproved bytheCityof B arabooand that contains managementrequirementsconsistent with thepurpose and intent of thisordinance.

2.Theoff-sitefacilitymeetsallofthefollowingconditions:

a.Thefacilityisin place.

b.The facilityisdesigned andadequatelysized to providealevel of stormwater controlequal to orgreaterthan thatwhich would beafforded byon-sitepracticesmeeting theperformancestandardsof thisordinance.

c.The facility has a legallyobligated entityresponsiblefor itslong-term operationandmaintenance.

(h) W here a regional treatment optionexists such that the City E ngineerexemptstheapplicant from allorpartof the minimum on-site stormwatermanagement requirements, theapplicant shallberequired to paya feein an amount determined innegotiation with theC ityE ngineer.Indetermining the fee for postconstruction runoff,theCityE ngineershallconsideran equitabledistributionof the cost for land, engineeringdesign,construction,and maintenanceof theregionaltreatment option.

(6) A L TE RN A TE RE Q UIRE M E N TS. TheCityE ngineerhasestablished thefollowingstormwatermanagement requirementsmorestringent than thoseset forth in ordertoprovide an added level of protection forsensitiveresources.

14.68 PERMITTING REQUIREMENTS,PROCEDURES AND FEES.

(1) P E RM IT RE Q UIRE D . Unless specificallyexcluded bythisO rdinance,no land occupierorland usermayundertakea land disturbingactivity subject to this O rdinance withoutreceivinga permit from theCityE ngineerpriorto commencing the proposed activity. TheB uilding Inspector shall not issue a buildingpermit orconstruction sitepermit involvinganyland disturbing activity unless and until adetermination has been made bythe CityE ngineerwhethera permit isrequired underthissubchapter.E ach land occupier or land

userdesiring to undertakea regulated activitysubject to thisordinanceshall submit to theCityE ngineer an application for a permittogetherwith theappropriatefeerequired bythe fee schedule asadopted bythe C ityofB araboo C ommon C ouncil.

(2) P E RM IT A P P L IC A TIO N A N D FE E S.Unless specifically excluded by thisordinance,anyresponsiblepartydesiring apermit shall submit to theC ityE ngineerapermit application madeon a form providedbytheCityE ngineerforthat purpose.

(a) E xceptionsto theserequirementsareasfollows:

1.The owner and occupier ofpublic landsare exempt frompayment of anypermit fees;

2.For its convenience, the C ityE ngineer may enter into anagreement with public or privateutilitiesand governmental unitstowaive the need for a permit foreach individual land disturbingactivity, if the utility orgovernmental unit will agree toadopt and follow a procedureforeach land disturbing activitythatmeets all applicable standardscontained in this O rdinance.Further, the agreement shallprovide that in the event that autilityorgovernmentalunit activityfails to meet the standard, theagreement shall terminateand theutilityor governmental unit shallbesubject to thepenaltiesset forthherein.

(b)Unless otherwise excepted by thisordinance,a permit application must beaccompanied by a storm-watermanagement plan, a maintenanceagreement, and a non-refundablepermit administration fee.

(c) Thestormwatermanagement plan shallbeprepared to meet therequirementsof14.67 and 14.69, the maintenanceagreement shall beprepared to meet therequirements of 14.70, the financialguaranteeshallmeet therequirementsof14.71,and feesshallbethoseestablishedbytheC ommon C ouncil asset forth in14.72.

(3) RE V IE W A N D A P P RO V A L O F P E RM ITA P P L IC A TIO N . The C ity E ngineer shallreview anypermit application that issubmittedwith a stormwater management plan,

maintenanceagreement,and therequired fee.The following approval procedure shall beused:

(a) W ithin 30calendardaysof thereceipt ofa completepermit application,includingallitemsasrequired bySub.(2),theCityE ngineer shall inform the applicant inwritingwhethertheapplication,plan,andmaintenanceagreement areapproved ordisapproved based on therequirementsof thisordinance.

(b)If the stormwater permit application,plan,and maintenanceagreement areapproved, or if an agreed uponpayment of feesin lieu of stormwatermanagement practicesismade,theC ityE ngineershallissuethepermit.

(c) If the stormwater permit application,plan or maintenance agreement isdisapproved,the C ityE ngineer shalldetail in writing the reasons fordisapproval.

(d)The City E ngineer may requestadditional information from theapplicant. If additional information issubmitted,theCityE ngineershall have30 business days from the date theadditional information is received toinform theapplicant that theplan,andmaintenance agreement are eitherapprovedordisapproved.

(e) FailurebytheC ityE ngineerto informthe permit applicant of a decisionwithin 30 businessdaysof a requiredsubmittal shall be deemed to meanapproval of the submittal and theapplicant mayproceed asif a permithadbeen issued.

(4) P E RM IT RE Q UIRE M E N TS. A ll permitsissued underthisordinanceshallbesubject tothefollowingconditions,andholdersof permitsissued underthisordinanceshallbedeemed tohave accepted these conditions. The C ityE ngineermaysuspend orrevokea permit forviolation of a permit condition, followingwritten notification of the responsible party.A n action bytheC ityE ngineerto suspend orrevoke this permit may be appealed inaccordancewith14.75.

(a) Compliancewith thispermit doesnotrelieve the responsible partyof theresponsibility to comply with otherapplicablefederal,state,and local lawsandregulations.

(b)Theresponsiblepartyshall design andinstall all structural and non-structuralstormwater management measuresinaccordance with the approvedstormwatermanagement plan and thispermit.

(c) The responsible partyshall notifytheCityE ngineer at least 2 businessdaysbefore commencing any work inconjunction with the stormwatermanagement plan, and within tenbusinessdaysupon completion of thestormwater management practices. Ifrequired as a special condition underSub.(5),theresponsiblepartyshallmakeadditional notification according to ascheduleset forth bytheC ityE ngineerso that practice installations can beinspectedduringconstruction.

(d) P racticeinstallationsrequired aspart ofthisordinanceshallbecertified"asbuilt"by a licensed professional engineer.Completed stormwater managementpracticesmust passa finalinspection bythe C ityE ngineer or its designee todetermineif theyarein accordancewiththe approved stormwater managementplan and ordinance.TheCityE ngineeror its designee shall notify theresponsible party in writing of anychanges required in such practices tobring them into compliance with theconditionsof thispermit.

(e) Theresponsiblepartyshall notifytheCity E ngineer of any significantmodificationsit intendsto maketo anapproved stormwater managementplan.TheCityE ngineer mayrequirethat the pro-posed modifications besubmitted to it forapproval priortoincorporation into the storm-watermanagement plan andexecution bytheresponsibleparty.

(f) Theresponsiblepartyshallmaintain allstormwater management practices inaccordance with the stormwatermanagement plan until the practiceseitherbecometheresponsibilityof theCommon C ouncil,oraretransferredtosubsequent privateownersasspecifiedin the approved maintenanceagreement. The responsible partyauthorizes the C ity E ngineer toperform any work or operationsnecessary to bring stormwatermanagement measures intoconformance with the approvedstormwater management plan, andconsents to a special assessment or

charge against the property asauthorizedunderSubch.V IIof Ch.66,W is.Stats.,orto charging such costsagainst thefinancial guaranteepostedunder14.71.

(g)If so directed bytheC ityE ngineer,the responsible partyshall repair attheresponsibleparty'sow n expenseall damage to adjoining municipalfacilitiesand drainagewayscaused byrunoff,w heresuch damageiscausedby activities that are not incompliancewith theapproved storm-watermanagement plan.

(h)The responsible partyshall permitpropertyaccessto theC ityE ngineeror its designee for the purpose ofinspecting the property forcompliance with the approvedstormwater management plan andthispermit.

(i) W here site development orredevelopment involves changes indirection, increases in peak rateand/ortotalvolumeof runoff from asite,the C ityE ngineer mayrequirethe responsible party to makeappropriate legal arrangements withaffected propertyowners concerningthe prevention of endangerment topropertyorpublicsafety.

(j) The responsible partyissubject tothe enforcement actions andpenalties detailed in 14.74, if theresponsiblepartyfailsto complywiththetermsof thispermit.

(5) P ermit C onditions. In addition to therequirementsneeded to meet theperformancestandardsin 14.67 ora financial guaranteeasprovided forin 14.71,all permitsissued underthisO rdinance shall beissued subject to thefollowing conditionsand requirementsand anypermittee who begins to perform anylanddisturbingactivityauthorized bypermit shallbedeemedto haveacceptedallof theseconditions:

(a) That all land disturbances,construction anddevelopment willbedonepursuant to thecontrol plan asapprovedbytheC ityE ngineer.

(b) That thepermitteeshallfilea noticeofcompletion of all land disturbingactivities and/or the com-pletion ofinstallation of all on-site detentionfacilities within 10 days aftercompletion.

(c) That approval in writing must beobtained from the C ity E ngineerprior to any modifications to theapprovedcontrolplan

(d)That thepermitteewill beresponsibleformaintaining allroads,road rightsofway, streets, runoff, and drainagefacilitiesand drainagewaysasspecifiedin the approved plan until theyareacceptedandbecometheresponsibilityof a governmentalentity.

(e) That thepermitteewill beresponsibleforrepairing anydamageat hisorherexpenseto all adjoining surfacesanddrainagewayscaused byrunoff and/orsedimentation resulting from activitieswhich arenot in compliancewith theapprovedplan.

(f) That the permittee must provide andinstallat hisorherexpenseall drainage,and runoff control improvements asrequired by this O rdinance and theapproved control plan,and also mustbearhisorherproportionateshareof thetotal cost of off siteimprovementstodrainagewaysbased upon theexistingdeveloped drainage area or planneddevelopment of the drainage area,asdeter-mined bythe C ityE ngineer,inaccordancewithC h.18of thisC ode.

(g)That no w orkwillbedoneon thesiteduring anyperiod of time that theaverage hourlywind velocityat thelocation of the land disturbingactivityexceedstwenty(20)milesperhour,unlessprovision hasbeen madeto eliminatedust andblowingdirt.

(h)That no portion of the land whichundergoes the land disturbing activitywillbeallowedto remain uncovered forgreaterthan two (2)weeksafternoticeisgiven to theC ityE ngineerthat thelanddisturbingactivityiscompleted.

(i) That thepermitteeagreesto permit theC ityE ngineerto enteronto thelandregulated underthisO rdinanceforthepurpose of inspecting for compliancewith the approved control plan andpermit.

(j) That thepermitteeauthorizestheC ityE ngineer to perform any work oroperations necessary to bring thecondition of thelandsinto conformitywith theapproved controlplan orplanasmodified bytheC ityE ngineerand

furtherconsentsto theCityof B arabooplacing the total of the costs andex pensesof such w ork and operationsupon the tax roll as a special taxagainst theproperty.

(6) P ermit D uration. P ermits issued under thissection shall bevalid fora period beginningwith thedateof issuancebytheCityE ngineerand extending six monthsfrom the date ofissuance.A llworkmust becompleted priortotheexpiration dateof thepermit.H owever,theCityE ngineer is authorized to extend theexpiration dateof thepermit if heorshefindsthat such an extension will not cause anincreasein runoff.TheC ityE ngineerisfurtherauthorized to modifytheplansif necessarytoprevent anyincreasein runoff resulting fromanyextension.

14.69 STORMWATER MANAGEMENT PLAN.

(1) P L A N RE Q UIRE M E N TS.Thestormwatermanagement plan required under14.67(2)shall contain anysuch information thattheC ityE ngineermayneed to determinerequirementsforrunoff control.Theplanshall contain at a minimum thefollowinginformation:

(a) N ame,address,and telephonenumberfor the following or their designees:landowner;developer;project engineerfor practice design and certification;person(s)responsibleforinstallation ofstormwatermanagement practices;andperson(s)responsibleformaintenanceof stormwater management practicesprior to the transfer, if any, ofmaintenance responsibility to anotherparty.

(b) A proper legal description of thepropertyproposed to bedeveloped,referenced to the U.S.P ublic L andSurveysystem or to block and lotnumbers within a recorded landsubdivision plat.

(c) P re-development site conditions,including oneormoresitemapsat ascaleof not lessthan oneinch equals100 feet.The site mapsshall showthefollowing:

1.Site location and legal propertydescription;

2.P redominant soil types andhydrologicsoilgroups;

3.E x isting cover type andcondition;

4.E x isting impervioussurfacesandstructures;

5.Topographic contoursof thesiteat a scalenot to exceedfivefeet;

6.Topographyand drainagenetworkincludingenough of thecontiguouspropertiesto show runoff patternsonto,through,andfrom thesite;

8.Flow path and direction for allstormwaterconveyancesections;

9.W atershed boundaries used inhydrologydeterminationsto showcompliance with performancestandards;

10.L akes, streams, wetlands,channels, ditches, and otherwatercourseson and immediatelyadjacent to thesite;

12.L ocation of wells and wellheadprotection areas covering theproject area and delineatedpursuant to §N R 811.16, W is.A dm.C ode.

(d) P ost-development site conditions,including:

1.N ame, address, and telephonenumber of the land occupier,along with the name andtelephone number of the partyresponsible for maintainingerosion controlstructures.

2.L imits of natural floodplain(s),basedon a 100-yearflood,if any.

3. A timing scheduleindicating theanticipated starting andcompletion dates of thedevelopment sequence and thetimeof exposureof each area ofsoildisturbingactivitypriorto thecompletion of effectivemeasuresforerosion andsediment control.

4. E xplanation of theprovisionstopreserve and use naturaltopography and land coverfeaturesto minimize changesinpeak flow runoff rates andvolumes to surface waters andwetlands.

5. E xplanation of anyrestrictionsonstormwatermanagement measuresin thedevelopment area imposedbywellhead protection plansandordinances.

6. O neormoresitemapsat a scaleofnot lessthan 1inch equals100feetshowingthefollowing:

a.P ost-construction perviousareasincluding vegetativecovertypeandconditions(descriptionshall bein such termsas:lawn,turfgrass, shrubbery, trees,forest cover,riprap,mulch,etc.);

b.M akeupof proposed surfacesoil(upper six inches)on areasnotcovered bybuildings,structures,or pavement (description shallbe in such terms as: originalsurface soil, subsoil, sandy,heavyclay,stony,etc.);

c.Impervious surfaces includingall buildings, structures, andpavement,shown in squarefeetorto scaleon a plan map;

d.P ost-construction verticaltopography at a contourintervalsuitableto thesiteandas approved by the C ityE ngineer up to a maximumfive(5)foot contourinterval;

e.P ost-construction drainagenetw ork including enough ofthe contiguous properties toshow runoff patterns onto,through, and from the site;locations and dimensions ofdrainageeasements;

f. L ocations of maintenanceeasements specified in themaintenanceagreement;

g.Flow path and direction forallstormwater conveyancesections;

h.L ocation and type of allstormwater managementconveyance and treatmentpractices,including theon-siteand off-sitetributarydrainagearea;

i. L ocation and type ofconveyance system that willcarryrunoff from thedrainageand treatment practicesto thenearest adequateoutlet suchasacurbed street,storm drain,ornaturaldrainageway;

j. W atershed boundariesused inhydrologyand pollutant loadingcalculationsand anychangestolakes, streams, wetlands,channels, ditches, and otherwatercourses on andimmediatelyadjacent to thesite;

k.L ocation of proposed landdisturbing activity, proposeddisturbance of protective cover,anyproposed additionalstructureon thesite,areasto beseeded ormulched,areasto bevegetativelystabilized and areas to be leftundisturbed;

l.E levations, dimensions,locationsof all proposedsoil disturbing activitiesincluding where topsoilwillbestockpiled,so it willnot contribute to erosionandsedimentation;

m.The finished grade,stated infeet horizontal to thevertical,orcut andfillslopes;

n.Kinds of utilities andproposedareasof installation;

7. H ydrology and pollutantloadingcomputationsasneededto show compliance withperformance standards. Thecomputationsshallbemadeforeach discharge point in thedevelopment, and thegeographicareasusedin makingthecalculationsshall beclearlycross-referenced to therequiredmap(s). This section shouldinclude:

a.E stimated peak flow ratesand surface runoff of thearea based on two (2),five(5), ten (10), twenty-five(25), fifty (50), and onehundred (100) yearrecurrence interval stormevents. P eak flows basedupon therecurrenceintervalof syntheticstorm frequencyeventsshall berequired intheevent that storm runofforstream flow data isnotavail-ablein thearea;

b.A reas used in the TR-55computations, clearlymarked and labeled in aconsistent manner;

c.The storm event recurrenceinterval and dischargerateincubic feet persecond whichthe design of plansfor thesitelocation isbasedupon;

d.P roposed provisions to carryrunoff to thenearest adequateoutlet,such asa curbed street,storm drain ornaturaldrainageway,including the routing ofroof drainage;

e.D esign computations andapplicableassumptionsfor allstructural measurers forerosion and sediment pollutioncontrol and watermanagement. V olume andvelocityof flow must begivenfor all surface waterconveyancemeasuresand pipeoutfalls. Surface runoffcomputations shall besubmitted to theC ityE ngineerin accordance with currentadministrative guidelinesapproved bytheP ublic SafetyCommittee;

f. E stimate of cost of erosionand sediment control andwater management structuresandfeatures;

g.P rovisionsformaintenanceofcontrol facilities includingeasementsto insure short aswell aslong term stormwatermanagement. The futuremaintenanceplan shalldescribetherecommended periodsforinspection and maintenanceaswell as list the responsiblepartiesto perform the work.A nticipated costs for regularmaintenanceshall beincludedin theplan;

h.Seeding mixtures and rates,lime,and fertilizer applicationrates,and kind and quantityofmulching forboth temporaryand permanent vegetativecontrolmeasures.

8. Results of investigations ofsoilsand groundwater required for theplacement and design of stormwatermanagement measures.D etaileddrawingsincludingcross-sectionsandprofilesof allpermanent stormwater conveyance andtreatment practices.

(e) A description and installation schedulefor the stormwater managementpractices needed to meet theperformancestandardsin 14.67.

(f) A maintenanceplan developed forthelife of each stormwater managementpractice including the requiredmaintenanceactivitiesandmaintenanceactivityschedule.

(g) Cost estimatesfor the construction,operation,and maintenance of eachstormwatermanagement practice.

(h) O ther information requested inwriting by the City E ngineer todetermine compliance of theproposed stormwater managementmeasureswith theprovisionsof thisordinance.

(i) A ll site investigations,plans,designs,computations,and drawings shall becertified by a licensed professionalengineerto beprepared in accordancewith accepted engineering practiceandrequirementsof thisordinance.

(2) A L TE RN A TE RE Q UIRE M E N TS. TheCity E ngineer may prescribe alternativesubmittalrequirementsforapplicantsseekingan exemption to on-site stormwatermanagement performance standards under§14.67(5).

(3) P L A N S P RE P A RE D B Y C ITYE N GIN E E R.A san alternativeto submittingthecontrolplan forparcelsof 0.5acreorless,asspecified in §14.64(1)the CityE ngineermay,if timepermits,preparea runoff controlplan for the applicant's proposed landdisturbing activity, adequate to meet theappropriate standards of §14.67.The CityE ngineermayrequiretheapplicant to submitanydata orinformation that isnecessarytopreparesuch a plan.A lso,theapplicant mustsubmit thepermit application andappropriateapplication fee as specified in §14.72. Inaddition to the permit application fee,theapplicant must paytheplan preparation feeasspecified in thescheduleasadopted bytheCommon C ouncil.

14.70 MAINTENANCE AGREEMENT.

(1)M A IN TE N A N C E A GRE E M E N TRE Q UIRE D . The maintenance agreementrequired under §14.68(2) for stormwatermanagement practicesshall bean agreementbetween the City E ngineer and theresponsiblepartyto provideformaintenanceof stormwaterpracticesbeyond thedurationperiod of this permit. The maintenanceagreement shall be filed with the C ountyRegister of D eeds as a property deedrestriction so that it is binding upon allsubsequent ownersof theland served bythestormwatermanagement practices.

(2) A GRE E M E N T P RO V ISIO N S. Themaintenanceagreement shall contain thefollowing information and provisionsandbeconsistent with themaintenanceplanrequiredby§14.69(1)(f):

(a) Identification of thestormwaterfacilitiesand designation of the drainage areaservedbythefacilities.

(b) A scheduleforregularmaintenanceofeach aspect of the stormwatermanagement system consistent withthe stormwater management planrequiredunder§14.67(2).

(c) Identification of theresponsibleparty(s),organization or city,county,town orvillage responsible for long termmaintenance of the stormwatermanagement practicesidentified in thestormwatermanage-ment plan requiredunder§14.67(2).

(d)Requirement that the responsibleparty(s), organization, or city, county,town orvillageshallmaintain stormwatermanagement practices in accordancewiththescheduleincludedin par.(b).

(e) A uthorization fortheCityE ngineertoaccess the property to conductinspectionsof stormwatermanagementpracticesasnecessaryto ascertain thatthepracticesarebeing maintained andoperated in accordance with theagreement.

(f) A requirement on theC ityE ngineer tomaintain public recordsof theresultsofthe site inspections, to inform theresponsible party responsible formaintenanceof theinspection results,andto specifically indicate any correctiveactionsrequired to bring thestormwater

management practiceinto properworkingcondition.

(g) A greement that the partydesignatedunderpar.(c),asresponsibleforlongterm maintenance of the stormwatermanagement practices,shallbenotifiedbytheCityE ngineerof maintenanceproblems which require correction.Thespecifiedcorrectiveactionsshallbeundertaken within a reasonable timeframeasset bytheCityE ngineer.

(h)A uthorization of the CityE ngineer toperform thecorrected actionsidentifiedin theinspection report if theresponsiblepartydesignated underpar.(c)doesnotmake the required corrections in thespecified timeperiod.TheC ityE ngineershall entertheamount dueon thetaxrollsand collect themoneyasa specialchargeagainst thepropertypursuant toSubch.V IIof C h.66,W is.Stats.

14.71 FINANCIAL GUARANTEE.

(1) E STA B L ISH M E N T O F TH EGUA RA N TE E .TheCityE ngineermayrequirethesubmittal of a financial guarantee,theformandtypeof which shallbeacceptableto theCityE ngineer.Thefinancialguaranteeshallbein anamount determined bytheCityE ngineerto bethe estimated cost of construction and theestimated cost of maintenance of thestormwater management practicesduring theperiod which the designated party in themaintenance agreement has maintenanceresponsibility.Thefinancial guaranteeshallgivetheCityE ngineertheauthorization to usethefundsto completethestormwatermanagementpracticesif theresponsiblepartydefaultsordoesnot properly implement the approvedstormwater management plan, upon writ-tennotice to the responsible party by theadministeringauthoritythat therequirementsofthisordinancehavenot been met.

(2)C O N D ITIO N S FO R RE L E A SE .C onditionsfor thereleaseof thefinancialguaranteeareasfollows:

(a) The City E ngineer shall release theportion of the financial guaranteeestablished underthissection,lessanycostsincurred bytheCityE ngineertocompleteinstallation of practices,uponsubmission of "as built plans" byalicensed professionalengineer.TheC ityE ngineer maymake provisionsfor apartial pro-rata releaseof thefinancialguaranteebased on thecompletion ofvariousdevelopment stages.

(b)The CityE ngineer shall release theportion of the financial guaranteeestablished under this section to assuremaintenance of stormwater practices,lessanycostsincurred bytheC ityE ngineer,atsuch timethat theresponsibilityforpracticemaintenanceispassed on to anotherentityviaan approvedmaintenanceagreement.

14.72 FEES.

(1) FE E SC H E D UL E . Thefeesreferred to inother sections of this ordinance shall beestablishedbytheC ityE ngineerandmayfromtime to time be modified byresolution.Ascheduleof thefeesestablished bytheC ityE ngineershall beavailableforreview in theCityClerk’soffice.

(2)CO N SUL TA N T SE RV IC E S.If theC ityretainsthe services of professional consultants,including,but not limitedto planners,engineers,architects,attorneys,environmental specialists,and/or otherexpertsto assist theCityin itsreview of a proposed permit application and/orrunoff controlplan,and/orif theCityE ngineerpreparesorassistsin thepreparation of a runoffcontrolplan forthedevelopment,theapplicant/developermayberequiredto reimbursetheCityfortheC ityE ngineer’stimeand forthecostsincurred bytheC ityto retain theservicesofsuch professional consultants and suchreimbursement shallbein addition to thepermitfees and other fees paid by theapplicant/developer.Theapplicant/ developershallreimbursetheC ityforsaid costspromptlyupon being invoiced forthesameand theC itymaywithholdissuanceof a permit ordelayfinalapprovalof a permit untilthesaidcostsandfeesarereimbursed to theCityin full.If thecostsand feesarenot reimbursed to theCitywithin30 daysof the date of billing,an additionaladministrativecollection chargeof 10% of thechargeshall beadded to theamount due,plusinterest shall accruethereon at therateof 1%permonth until paid and such chargeshall beextended upon thecurrent ornext tax rollasachargeagainst thesubject propertyforcurrentservicesasprovided in §66.60(16),W is.Stats.TheCitymayrequiretheapplicant/developertoenter into an agreement providing for thereimbursement to theC ityforsaidcostsandthesaid agreement may require theapplicant/developer to file with the CityanIrrevocableL etterof Credit orotherappropriatesureties meeting the approval of the CityA ttorneyequal to the estimated cost of saidservices.

14.73 ADMINISTRATION. In theadministration andenforcement of thisO rdinance,theC ityE ngineershallperform thefollowingduties:

(1) Keep an accurate record of all plan datareceived, plans approved, permits issued,inspectionsmadeandotherofficialactionsandmakea periodic permit activityreport to theP ublicSafetyC ommittee.

(2)P repare plans for runoff control w henrequested to do so bythepermit applicationpursuant to §14.68, but only after theappropriatefeeisreceived.

(3) Review all plans and permit applicationsreceivedwhen accompaniedwiththenecessaryinformation and theappropriatefeeand issuethepermitsrequired by§14.68(1)of thisCodein accordancewith theprocedureasset out inthis C ode, but only when the erosion,sedimentation andrunoff willbecontrolled tomeet thestandardsof §14.67.

(4)Investigate all complaints made to theapplication of thisO rdinance.

(5) Revoke any permit granted under thisO rdinanceif it isfound that theholderof thepermit hasmisrepresented anymaterialfact inhisorherpermit application orplan;orhasfailed to complywith theplan asoriginallyapproved or as modified in writingsubsequentlybythe C ityE ngineer;or hasviolated anyof theother conditionsof thepermit asissuedto theapplicant.

14.74 ENFORCEMENT.

(1) A nyland disturbing construction activityorpost-construction runoff initiated after theeffective date of this ordinance by anyperson, firm, association, or corporationsubject to theordinanceprovisionsshall bedeemed a violation unless conducted inaccordance with the requirements of thisordinance.

(2)TheC ityE ngineershallnotifytheresponsiblepartybycertified mail of anynon-complyingland disturbing construction activityorpost-construction runoff.Thenoticeshalldescribethenatureof theviolation,remedial actionsneeded,a scheduleforremedial action,andadditional enforcement action that maybetaken.

(3)Upon receipt of written notification fromthe C ity E ngineer under Sub. (2), theresponsible partyshall correct work thatdoes not comply with the stormwatermanagement plan orotherprovisionsof thispermit.The responsible partyshall makecorrections as necessary to meet thespecificationsand scheduleset forth bytheC ityE ngineerin thenotice.

(4)If theviolationsto a permit issued pursuant tothisordinancearelikelyto result in damagetoproperties,public facilities,or watersof thestate,theC ityE ngineermayenterthelandand take emergency actions necessary toprevent such damage.Thecostsincurred bytheC ityE ngineerplusinterest and legalcostsshallbebilledto theresponsibleparty.

(5)TheC ityE ngineerisauthorized to post astop w ork order on all land disturbingconstruction activitythat isin violation ofthis ordinance, or to request the C ityA ttorneyto obtain a ceaseand desist orderin anycourt with jurisdiction.

(6)TheC ityE ngineermayrevokea permit issuedunderthisordinancefornon-compliancewithordinanceprovisions.

(7) A nypermit revocation,stop work order,orceaseand desist ordershall remain in effectunlessretracted bytheC ityE ngineerorbyacourt with jurisdiction.

(8)TheC ityE ngineerisauthorized to referanyviolation of thisordinance,orof a stopworkorder or cease and desist order issuedpursuant to this ordinance, to the C ityA ttorneyfor thecommencement of furtherlegal proceedings in any court withjurisdiction.

(9) A ny person, firm, association, orcorporation who doesnot complywith theprovisionsof thisC odeshallbesubject to aforfeitureof not lessthan $50ormorethan$500peroffense,togetherwith thecostsofprosecution. E ach daythat the violationex istsshallconstitutea separateoffense.

(10)C ompliance with the provisions of thisordinance may also be enforced byinjunction in anycourt with jurisdiction.Itshall not be necessary to prosecute forforfeitureora ceaseand desist orderbeforere-sortingto injunctionalproceedings.

(11)W hen theCityE ngineerdeterminesthat theholder of a permit issued pursuant to thisordinance hasfailed to follow practicessetforth in thestormwatermanagement plan,orhasfailedto complywithschedulesset forthinsaid stormwater management plan,the C ityE ngineer or a partydesignated bythe C ityE ngineer may enter upon the land andperform the work or other operationsnecessaryto bring thecondition of said landsinto conformance with requirementsof theapproved plan.TheCityE ngineershallkeepadetailed accounting of thecostsand expenses

of performing this work.These costs andexpensesshallbededucted from anyfinancialsecurityposted pursuant to §14.61 of thisCode.W here such a securityhasnot beenestablished, or where such a security isinsufficient to coverthesecosts,thecostsandexpensesshall beentered on thetax roll asaspecial charge against the property andcollected with anyothertaxeslevied thereonfortheyearin whichtheworkiscompleted.

14.75 APPEALS.

(1) B O A RD O F P UB L IC W O RKS.TheB oardof P ublic W orks(P ublic SafetyC ommittee)shallhearanddecideappealswhereit isallegedthat thereiserrorin anyorder,decision ordetermination madebytheC ityE ngineerinadministering thisordinance.Thecommitteeshall use the rules,procedures,duties,andpowersauthorized by§62.l4,W is.Stats.,§1.24of this C ode,and such other powers anddutiesassigned bytheCouncil.Upon appeal,thecommitteemayauthorizevariancesfromthepro-visionsof thisordinancethat arenotcontraryto the public interest,and whereowing to special conditions a literalenforcement of the ordinance will result inunnecessaryhardship.

(2) W H O M A Y A P P E A L . A ppeals to thecommitteemaybetaken byanyaggrievedperson orbyan officer,department,board,orbureau of theC ityof B araboo affectedbythe order, requirement, decision ordetermination made bythe C ityE ngineer.For the purpose of this O rdinance,aggrieved person shall includeapplicant andproperty owners who ow n land that issubject to theO rdinance.

14.76 SEVERABILITY. If any section, clause,provision orportion of thisordinanceisjudgedunconstitutionalorinvalidbya court of competentjurisdiction,theremainderof theordinanceshallremain in force and not be affected bysuchjudgment.

14.76 EFFECTIVE DATE.Thisordinanceshallbeinforceand effect from and afteritsadoption andpublication.Theaboveand foregoing ordinancewasdulyadopted bytheCommon Councilof theCityof B araboo on the13th dayof M ay,2008.

SUBCHAPTER V: ILLICIT STORMWATERDISCHARGE

14.80 GENERAL PROVISIONS

(1) A UTH O RITY . This chapter is adoptedundertheauthoritygranted by§283.33,W is.Stats.and required by§N R 216.07(3)(a),W is.A dm.C ode.

(2) L E GISL A TIV E FIN D IN GS. TheC ommonCouncil of the C ityof B araboo finds thatdischarges to the municipal separate stormsewersystem that arenot composed entirelyof stormwaterrun-off contributeto increasednonpoint sourcepollution anddegradation ofreceiving waters. The impacts of thesedischargesadverselyaffect public health andsafety, drinking water supplies, recreation,fish and other aquatic life,propertyvaluesandotherusesof landsandwaters.

(3)P URP O SE A N D IN TE N T. Thisordinanceestablishes methods for controlling theintroduction of pollutantsinto themunicipalseparatestorm sewersystem (M S4)in orderto complywith requirementsof theW isconsinP ollutant D ischarge E limination System(W P D E S)permit process.Theobjectivesofthisordinanceare:

(a) To regulate the contribution of nonstormwaterpollutantsto themunicipalseparatestorm sewersystem (M S4)bystormwaterdischargesbyanyuser;

(b) To prohibit illicit connections anddischarges to the municipal separatestorm sewersystem.

(c) To establish legal authorityto carryout all inspection,surveillance andmonitoring proceduresnecessarytoensure compliance with thisordinance

(4) A B RO GA TIO N A N D GRE A TE RRE STRIC TIO N S. It isnot intended bythisC hapterto repeal,abrogate,annul,impairorinterfere with any existing easements,covenants,deedrestrictions,agreements,rules,regulations,ordinances,orpermitspreviouslyadopted orissued pursuant to law.H owever,wherever this C hapter imposes greaterrestrictions,the provisionsof thisC haptershallgovern.

(5) IN TE RP RE TA TIO N . In theirinterpretation andapplication,theprovisionsof this C hapter shall be held to be theminimum requirements and shall not bedeemed a limitation orrepeal of anyotherpower granted bythe W isconsin Statutes.W here anyterms or requirements of thisC haptermaybeinconsistent orconflicting,the more restrictive requirement orinterpretation shallcontrol.

14.81 DEFINITIONS.

(1) A C C ID E N TA L D ISC H A RGE meansa dischargeprohibited bythis ordinance that occurs bychanceandwithout planningorthought priortooccurrence.

(2) B E ST M A N A GE M E N T P RA C TIC E(B M P ) means a practice, technique, ormeasure that is an effective, practicalmeans of preventing or reducing thedischarge of pollutants directly orindirectlyto stormwater,receiving waters,or stormwater conveyance systems.Thiscan include a structural or operationalpractice,scheduleof activities,prohibitionof practices,general good housekeeping,pollution prevention and educationalpractices, maintenance procedures, andother management practices systems. AB M P mayalso bea practicethat controlssite runoff, spillage or leaks, sludge orwater disposal, or drainage from rawmaterialsstorage.

(3) C L E A N W A TE R A C T meanstheFederalW ater P ollution C ontrol A ct (33 U.S.C .§1251 et seq.), and any subsequentamendmentsthereto.

(4) C O N STRUC TIO N A C TIV ITY meansanyland alterationsor disturbancesthatmayresult in soil erosion,sedimentation,or change in runoff including but notlimited to removal of ground cover,grading,excavating,andfillingof land.

(5) D IRE C TO R O F P UB L IC W O RKS meanstheindividual,ortheindividual'sdesignee,orthefirm,ora representativeof thefirm,appointed or retained bythe C ityC ouncilassigned orcharged with theresponsibilityof directingC itypublicworksprogramsandprojects, including street maintenance,sewerand waterconstruction,and garbage,recyclingandyardwastecollection.

(6) H A Z A RD O US M A TE RIA L means anymaterial,includinganysubstance,waste,orcombination thereof,which becauseof itsquantity, concentration, or physical,chemical,orinfectiouscharacteristicsmaycause, or significantly contribute to, asubstantial present orpotential hazard tohuman health, safety, property, or theenvironment w hen improperly treated,stored, trans-ported, disposed of, orotherwisemanaged.

(7) IL L IC IT D ISC H A RGE meansanydirectorindirect non-stormwaterdischargeto themunicipal separate storm sewer system,except asexempted in 14.84(1)(b)of thisordinance.

(8) IL L E GA L C O N N E C TIO N meanseitherof thefollowing:

anyconveyanceswhich allow anynon-stormwaterdischargeincludingsewage, process wastewater, andwash waterto enterthestorm drainsystem,regardlessof whethersuchpipe, open channel, drain orconveyance has been previouslyallowed,permitted,orapproved byan authorized enforcement agency;or

(b) A nypipe,open channel,drain orconveyance connected to themunicipal separate storm sewersystem w hich has not beendocumented in plans, maps, orequivalent recordsand approved byan authorizedenforcement agency.

(9) IN D USTRIA L A C TIV ITY meansactivities subject to N P D E S IndustrialP ermits as defined in 40 C FR,§122.26(b)(14).

(10)M UN IC IP A L SE P A RA TE STO RMSE W E R SY STE M (M S4) means anyfacilitydesigned or used for collectingand/or conveying stormwater, includingbut not limited to anyroadsw ith drainagesystems, highways, C ity streets, curbs,gutters,inlets,catch basins,piped stormdrains, pumping facilities, structuralstormwater controls, ditches, swales,natural and man-madeoraltered drainagechannels, reservoirs, and other drainagestructures,andwhich is:

(a) O wned and maintained bytheC ityofB araboo;

(b) N ot a combinedsewer;and(c) N ot part of a publicly ow ned

treatment w orks.

board,publicorprivateinstitution,utility,cooperative,city,countyorotherpoliticalsubdivision of the State, anyinterstatebodyoranyotherlegalentity.

(14)P O L L UTA N T meansanythingthat causesorcontributesto pollution.P ollutantsmayinclude, but are not limited to: paints,varnishes, and solvents; petroleumhydrocarbons;automotivefluids;cookinggrease; detergents (biodegradable orotherwise);degreasers;cleaning chemicals;non-hazardousliquid and solid wastesandyardwastes;refuse,rubbish,garbage,litter,orotherdiscarded orabandoned objectsand accumulations, so that same maycauseorcontributeto pollution;floatables;pesticides,herbicides,and fertilizers;liquidand solid wastes;sewage,fecal coliformand pathogens;dissolved and particulatemetals;animal wastes;wastesand residuesthat result from constructing a building orstructure; concrete and cement; andnoxiousoroffensivematterof anykind.

(15)P O L L UTIO N meansthecontamination orother alteration of any water’s physical,chemical or biological properties bytheaddition of anyconstituent and includesbutisnot limited to,a changein temperature,taste, color, turbidity, or odor of suchwaters, or the discharge of any liquid,gaseous, solid, radioactive, or othersubstanceinto anysuch watersaswill orislikelyto createa nuisanceor render suchwatersharmful,detrimental orinjurioustothe public health, safety, welfare, orenvironment,or to domestic,commercial,industrial,agricultural,recreational,orotherlegitimate beneficial uses,or to livestock,wildanimals,birds,fish orotheraquaticlife.

(16)P RE M ISE S meansanybuilding,lot,parcelof land, or portion of land whetherimproved or unimproved includingadjacent sidewalksandparkingstrips.

(17)STO RM D RA IN A GE SY STE M meanspublicly-owned facilities by which stormwateriscollected and/orconveyed,includingbut not limited to anyroadswith drainagesystems, municipal streets, gutters, curbs,inlets,piped storm drains,pumping facilities,retention and detention basins,natural andhuman-madeor altered drainagechannels,reservoirs,andotherdrainagestructures.

(18)STO RM W A TE R meanstheflow of waterthat resultsfrom,and w hich occursduringand immediatelyfollowing,a rainfall,snow-orice-melt event.

(19)STO RM W A TE R P O L L UTIO NP RE V E N TIO N P L A N meansa documentwhich describes the best management

practicesand activitiesto beimplemented bya person orbusinessto identifysourcesofpollution orcontamination at a siteand theactions to eliminate or reduce pollutantdischarges to stormwater, stormwaterconveyance systems, and/or receivingwatersto themaxi-mum ex tent practicable.

(20)STO RM W A TE R RUN O FF means thewaters derived from rains falling orsnowmelt or icemelt occurring within adrainagearea,flowingoverthesurfaceof theground and/or collected in channels,watercoursesorconduits.

(21)STRUC TURA L STO RM W A TE RC O N TRO L meansa structural stormwatermanagement facilityordevicethat controlsstormwater runoff and changes thecharacteristicsof that runoff including,butnot limited to,thequantityand quality,theperiodof releaseorthevelocityof flow.

(22) W A STE W A TE R means any water orother liquid, other than uncontaminatedstorm water,dischargedfrom a facility.

(23) W A TE RS O F TH E STA TE has themeaninggiven in §281.01(18),W is.Stats.

14.82 APPLICABILITY. Thischapterappliesto allsubstancesenteringtheC ityM S4generatedon anydeveloped orundeveloped landsunlessotherwiseauthorized underand explicitlyexempted bythisordinanceortheW N D R.

14.83 ULTIMATE RESPONSIBILITY. Thestandards set forth herein and promulgatedpursuant to this ordinance are minimumstandards; therefore this ordinance does notintend norimplythat compliancebyanypersonwill ensurethat therewill beno contamination,pollution, nor unauthorized discharge ofpollutants.

14.84 DISCHARGE PROHIBITIONS.

(1) P RO H IB ITIO N O F IL L IC ITD ISC H A RGE S(a) P rohibition. N o person shall throw ,

drain, discharge, cause to bedischarged,orallow othersundertheircontrolto dischargeinto themunicipalseparate storm sewer system orwatercourse anymaterialsother thanstormwater,including but not limitedto pollutants or waters containingpollutants.

(b) E xemptions. The following non-stormwater discharges are ex cludedfrom 14.84(1)(a)of thisordinance:

1.W aterlineflushing orotherpotablewatersources;

2.L andscape irrigation or lawnwatering;

3.D iverted, natural riparian habitatand/orwetlandflow s;

4.Rising ground water,ground waterinfiltration to storm drains,and/oruncontaminated pumpedgroundwater;

5.Foundation orfooting drains(notincluding active ground w aterdewatering systems) and crawlspacepumps;

6.A irconditioningcondensation;

7.Springs;

8.N on-commercial washing ofvehicles;

9.D echlorinated (less than oneP P M chlorine) swimming poolwater;

10.Firefighting/training activities andotherdischargesspecifiedin writingbytheD irectorof P ublicW orksasbeing necessaryto protect publichealth andsafety;and

11.O therwatersourcesdetermined bythe D irector of P ublic W orks inwriting asnot containing pollutantsthat causeorcontributeto waterwaydegradation, including, but notlimited to,a violation of applicablewater quality standards and/ordegradation of thebioticintegrityofsurface water bodies and theirfloodplains.

(2) P RO H IB ITIO N O F IL L E GA LC O N N E C TIO N S.(a) Theconstruction,use,maintenanceor

continued existence of illicitconnectionsto thestorm drain systemis prohibited. This prohibitionex presslyincludes,without limitation,illicit connectionsmade in the past,regardlessof whethertheconnectionwaspermissibleunderlaw orpracticesapplication orprevailingat thetimeofconnection.

(b)A person is in violation of thisordinanceif theperson connectsalineconveying sewageto theM S4,or allows such a connection tocontinue.

(c) A nydrain orconveyancethat hasnotbeen documented in plans,mapsorequivalent, and w hich may beconnected to thestorm sewersystem,shall be located by the owner oroccupant of that propertyupon receipt

of written noticeof violation from theD irectorof P ublicW orksrequiringthatsuch locating be completed. Suchnotice will specifya reasonable timeperiod within which the location ofthe drain or conveyance is to becompleted, that the drain orconveyance be identified as stormsewer,sanitarysewerorother,and theoutfalllocation orpoint of connectionto the storm sewer system,sanitarysewersystem orotherdischargepointbe identified. Results of theseinvestigationsare to be documentedandprovidedto theD irectorof P ublicW orks.

14.85 SUSPENSION OF MS4 ACCESS.

(1) SUSP E N SIO N D UE TO IL L IC ITD ISC H A RGE S IN E M E RGE N C YSITUA TIO N S.(a) TheD irectorof P ublic W orksmay,

without prior notice,suspend M S4discharge accessto a person whensuch suspension isnecessaryto stopan actual or threatened dischargethat presents or may presentimminent and substantial dangertotheenvironment,orto thehealth orwelfareof persons,orto theM S4orwatersof thestate.

(b)If theviolatorfailsto complywith asuspension order issued in anemergency, the authorizedenforcement agencymaytake suchstepsasdeemednecessaryto preventorminimizedamageto theM S4 orwatersof thestate,orto minimizedangerto persons.

(2) SUSP E N SIO N D UE TO TH ED E TE C TIO N O F IL L IC ITD ISC H A RGE .

(a) A nyperson discharging to theM S4 inviolation of this ordinance mayhavetheir M S4 access terminated if suchtermination would abateor reduceanillicit discharge. The authorizedenforcement agencywillnotifya violatorof theproposed termination of itsM S4access.The violator maypetition theauthorized enforcement agencyfor areconsideration andhearing.

(b)A person commitsan offenseif theperson reinstates M S4 access topremisesterminated pursuant to thisSection,without thepriorapproval oftheauthorizedenforcement agency.

14.86 INDUSTRIAL OR CONSTRUCTIONACTIVITY DISCHARGES. A ny personsubject to an industrial or construction activityW P D E S stormwater discharge permit shallcomplywith allprovisionsof such permit. P roofof compliancewith saidpermit mayberequiredina form acceptable to the D irector of P ublicW orkspriorto theallowing of dischargesto theM S4.

14.87 BEST MANAGEMENT PRACTICES.

(1) TheD irectorof P ublic W orksmayadoptrequirementsidentifying B est M anagementP ractices for anyactivity, operation, orfacilitythat maycause or contribute topollution orcontamination of storm water,thestorm drain system,orw atersof theU.S.

(2) Theow neroroperatorof a commercialorindustrial establishment shall provide,attheir ow n ex pense,reasonable protectionfrom accidental discharge of prohibitedmaterials or other wastes into themunicipal storm drain system orwatercoursesthrough theuseof structuraland non-structural B M P sidentified bytheD irectorof P ublicW orksunderSub.(1).

(3) A nyperson responsiblefora propertyorpremise,which is,ormaybe,thesourceof an illicit discharge,mayberequired toimplement, at said person's ex pense,structural and non-structural B M P s, inadditional to thoserequired bysub.(2),to prevent the further discharge ofpollutants to the municipal separatestorm sewersystem.

(4) C ompliancewith all termsand conditionsof a valid W P D E S permit authorizing thedischarge of storm water associated withindustrial activity,to theextent practicable,shall be deemed compliance with theprovisionsof thissection. These B M P sshall be part of a stormwater pollutionprevention plan (SW P P )asnecessaryforcompliance with requirements of theN P D E S permit.

14.88 WATERCOURSE PROTECTION. E veryperson ow ning property through w hich awatercoursepasses,orsuch person'slessee,shallkeep and maintain that part of the watercoursewithin thepropertyfreeof trash,debris,ex cessivevegetation,and otherobstaclesthat would pollute,contaminate,or significantlyretard the flow ofwater through the watercourse.In addition,theow ner or lessee shall maintain existing privatelyow ned structures within or adjacent to awatercourse, so that such structures will not

becomea hazard to theuse,function,orphysicalintegrityof thewatercourse.

14.89 ACCESS AND INSPECTION OFPROPERTIES AND FACILITIES. TheD irectorof P ublic W orksorhis/herdesigneeshall be permitted to enter and inspectpropertiesand facilitiesat reasonabletimesandasoften asnecessaryto determinecompliancewith thisordinance.

(1)If a property or facility has securitymeasuresin force which require properidentification and clearance before entryinto itspremises,the owner or operatorshall makethenecessaryarrangementstoallow access to representatives of theD irectorof P ublicW orks.

(2)The owner or operator shall allow theD irector of P ublic W orks or his/herdesignee readyaccess to all parts of thepremises for the purposes of inspection,sampling, photography, video-taping,examination andcopyingof anyrecordsthatare required under the conditions of anW P D E S permit to dischargestormwater.

(3)The D irector of P ublic W orksor his/herdesigneeshall havetheright to set up onanypropertyorfacilitysuch devicesasarenecessaryin theopinion of theD irectorofP ublic W orks or his/ her designee toconduct monitoring and/or sampling offlow discharges.

(4)The D irector of P ublic W orksor his/herdesigneemayrequiretheowneroroperatorto install monitoring equipment andperform monitoring asnecessary,and makethe monitoring data available to theD irector of P ublic W orks or his/herdesignee. This sampling and monitoringequipment shallbemaintainedat alltimesina safeandproperoperatingcondition bytheow neroroperatorat his/ herow n ex pense.A lldevicesusedto measureflow andqualityshallbecalibratedto ensuretheiraccuracy.

(5)A nytemporaryorpermanent obstructionto safeand easyaccessto thepropertyorfacilityto be inspected and/or sampledshallbepromptlyremovedbytheowneroroperatorat thewritten ororal request oftheD irectorof P ublic W orksorhis/herdesigneeand shall not bereplaced. Thecosts of clearing such access shall bebornebytheow neroroperator.

(6)Unreasonable delays in allowing theD irector of P ublic W orks or his/herdesigneeaccessto a facilityisa violationof thisordinance.

(7)If theD irectorof P ublic W orksorhis/herdesigneehasbeen refused accessto anypartof thepremisesfrom w hich stormwaterisdischarged, and the D irector of P ublicW orks or his/her designee is able todemonstrateprobablecauseto believethattheremaybea violation of thisordinance,or that there isa need to inspect and/orsampleaspart of a routineinspection andsampling program designed to verifycompliancewith thisordinanceoranyorderissued here-under,orto protect theoverallpublic health, safety, environment andwelfareof thecommunity,then theD irectorof P ublic W orksorhis/herdesignee mayseek issuanceof a search warrant from anycourt of competent jurisdiction.

14.90 NOTIFICATION OF ACCIDENTALDISCHARGES AND SPILLS.

(1)N otwithstanding other requirements oflaw,assoon asanyperson responsiblefora facility, activity or operation, orresponsibleforemergencyresponseforafacility, activity or operation hasinformation of anyknown orsuspectedrelease of pollutants or nonstormwaterdischargesfrom that facilityoroperationwhich areresulting ormayresult in illicitdischargesorpollutantsdischarging intostormwater,theC ity’smunicipal separatestorm sewersystem,watersof thestate,orwatersof theU.S.,said person shall takeallnecessarystepsto ensurethediscovery,containment,and cleanupof such releaseso as to minimize the effects of thedischarge.

(2)Said person shall notify the authorizedenforcement agencyin person orbyphone,facsimileorin person within no morethan24hoursof thenature,quantityand timeofoccurrenceof thedischarge.N otificationsinperson orbyphoneshall beconfirmed bywritten noticeaddressed and mailed to theD irector of P ublic W orks within threebusinessdaysof the phone or in personnotice. If the discharge of prohibitedmaterialsemanatesfrom a commercial orindustrial establishment, the owner oroperator of such establishment shall alsoretain an on-sitewritten recordof thedischargeandtheactionstaken to prevent itsrecurrence.Such recordsshall be retained for at leastthree years. Said person shall also takeimmediatestepsto ensureno recurrenceofthedischargeorspill.

(3)In the event of such a release ofhazardousmaterials,emergencyresponse

agencies and/or other appropriateagenciesshallbeimmediatelynotified.

(4)Failureto providenotification of a releaseasprovided aboveisa violation of thisordinance.

14.91 VIOLATIONS, APPEALS, ANDENFORCEMENT.

(1) N otice of V iolation. W henever theD irector of P ublic W orks or his/herdesignee findsthat a violation of thisordinancehasoccurred,theD irectorofP ublic W orksor his/her designee mayordercompliancebya written noticeofviolation to theresponsibleperson.

(a) The notice of violation shallcontain:

1.Thenameand addressof theallegedviolator;

2.Theaddress,when available,or a description of thebuilding, structure or landupon which the violation isoccurring,orhasoccurred;

3.A statement specifying thenatureof theviolation;

4.A description of theremedialmeasuresnecessaryto restorecompliance with thisordinance and a timeschedule for thecompletionof suchremedialaction;

5.A statement of thepenaltyorpenaltiesthat shallormaybeassessedagainst theperson towhom thenoticeof violationisdirected;and

6.A statement that thedetermination of violationmaybeappealedto theP ublicW orksC ommitteebyfiling awritten notice of appealwithin five (5) days of theserviceof noticeof violation.

(b) Such notice mayrequire withoutlimitation:

1.The performance ofmonitoring,analyses,and/orreporting;

2.The elimination of illicitdischarges and illegalconnections;

3.That violating discharges,practicesor operationsshallceaseanddesist;

4.The abatement orremediation of stormwaterpollution or contamination

hazardsandtherestoration ofanyaffectedproperty;

5.P ayment to coveradministrativeand abatementcosts;and

6.The implementation ofpollution preventionpractices.

(2) A P P E A L O F N O TIC E O F V IO L A TIO N .

(a) A nyperson receiving a N otice ofV iolation may appeal thedetermination of the D irector ofP ublicW orks.

(b) The notice of appeal must bereceived within five(5)daysfromtheN oticeof V iolation

(c) H earing on theappeal beforetheP ublicSafetyC ommitteeshalltakeplace within 10 days from thereceipt of thenoticeof appeal.

(d) Thedecision of theP ublic SafetyC ommitteeshallbefinal.

(3) E N FO RC E M E N T/A B A TE M E N TM E A SURE S A FTE R A P P E A L .

(a) If the violation has not beencorrected pursuant to therequirementsset forth in theN oticeof V iolation,orin theevent of anappeal,within 5 daysof theP ublicSafety C ommittee upholding thedecision of theD irector of P ublicW orks,then representativesof theD irectorof P ublicW orksshallenterupon the subject private propertyand areauthorizedto takeanyandallmeasures necessary to abate theviolation and/orrestoretheproperty.

(b) It shall beunlawful foranyperson,ow ner,agent,orperson in possessionof anypremisesto refuseto allow thegovernment agency or designatedcontractorto enterupon thepremisesforthepurposesset forth above.

(4) C O STS O F A B A TE M E N T O F TH EV IO L A TIO N(a) W ithin 30daysafterabatement of the

violation,theownerof thepropertywill be notified of the cost ofabatement including administrativecosts.

(b) The propertyow ner mayfile awritten objection to the amountof the assessment within fifteen(15)days.

(c) If theamount dueisnot paid withinthirty(30)daysafter receipt of thenotice,orif an appealistaken,within

thirty(30)daysafter a decision onsaid appeal,thechargesshall becomea special assessment against thepropertyand shallconstitutea lien onthepropertyfortheamount of theassessment.

(d) A nyperson violating anyof theprovisions of this section shallbecome liable to the C ity byreason of such violation.

14.92 PENALTIES.(1) C IV IL P E N A L TIE S. In the event the

alleged violator failsto take the remedialmeasuresset forth in thenoticeof violationor otherwise fails to cure the violationsdescribed therein within ten days,or suchgreater period as the local permittingauthorityshall deem appropriate,afterthelocal permitting authorityhastaken oneormoreof theactionsdescribed in §14.91,thelocal permitting authoritymayimpose apenalty,not to ex ceed $1,000 (dependingon theseverityof theviolation)foreachdaytheviolation remainsunremedied afterreceipt of thenoticeof violation.

(1)C RIM IN A L P E N A L TIE S. Forintentionaland flagrant violationsof thisordinance,thelocalpermittingauthoritymayissuea citationto thealleged violatorrequiring such personto appear in municipal court to answerchargesforsuchviolation

14.93 VIOLATIONS DEEMED A PUBLICNUISANCE. In addition to theenforcementprocessesand penaltiesprovided,anyconditioncaused orpermitted to ex ist in violation of anyof theprovisionsof thisordinanceisa threat topublic health,safety,welfare,and environmentand isdeclared and deemed a nuisance,andmaybeabated byinjunctiveorotherequitablerelief asprovidedbylaw.

14.94 REMEDIES NOT EXCLUSIVE.

(1)Theremedieslisted in thisordinancearenot exclusive of any other remediesavailable under any applicable Federal,State,orlocal law and theC itymayseekcumulativeremedies.

(2)The C ityof B araboo mayrecover in fullattorney’s fees, court costs, and otherexpenses associated with enforcement ofthis ordinance, including sampling andmonitoringexpenses.

14.95 SEVERABILITY. If any section, clause,provision or portion of thisordinance isjudgedunconstitutionalorinvalid bya court of competentjurisdiction,theremainderof theordinanceshallremain in force and not be affected bysuchjudgment.
