Question for Study #1
1. The Federal Trademark Act of 1946, also known as the “Lanham Act,” governs the laws
of trademarks, registration of trademarks, and solvents for violations of already registered
trademarks. In 1989, Congress revised the antiquated Lanham Act with the Trademorks
Law Revision Act. The revisions provided more specific clarity regarding the laws of
sport trademark registrations and licensing.
2. In the late 1880’s Congress enacted the first federal trademark law. The law considers
trademarks to be a form of property and is governed by both state and federal law.
Trademark owners that choose to not register their trademark(s) and conduct business
over the course of an extended period of years are protected by the “tort of passing off”
In 1989 the Trademarks Law Revision Act went into effect. This law was Congress’s first overall
revision of the Lanham Act since 1946. As a result of this revised Lanham Act, the sports trademark
registration and licensing process was directly effected as a result of the revision in regards to the
federal trademark law.
