Thanks for meeting with me and Bill Cain on January 12, 2007. During our meeting, we discussed several issues. These included watershed education, flooding associated with mainstem Powhatan Creek, a localized groundwater/drainage issue·at the building units closest to the site entrance, a localized surface drainage problem area in the west part of the site and general maintenance associated with the onsite storm drainage piping system.

Watershed Education

I am forwarding you some ''first contact" information for your community association to use relative to watershed education. As a note, the entire development site is situated in the tidal mainstem of the Powhatan Creek watershed. The Board of Supervisors adopted the Powhatan Creek Watershed Management Plan on February 26, 2002 and revised/readopted certain other aspects of the plan (which were not originally acted upon) in October 2006. Education about aspects of watershed awareness and the prevention of pollution into storm drainage systems should be a prime objective for the association. Of importance for this development is education about the overuse of nutrients in yard turf areas and proper disposal of grass clippings and yard wastes. I've attached our "watershed awareness tips" and also suggest that you visit the County's PRIDE water quality education website at www.protectedwithpride.org for other useful information.

Mainstem Powhatan Flooding

Although we briefly discussed this topic at our meeting, the situation with tidal and riverine flooding associated with the mainstem of Powhatan Creek is not able to be addressed within the framework of this correspondence. However, I have attached some floodplain map information from our County GIS system and from FEMA for informational purposes.

Localized Groundwater/Drainage Issue - Front of Site

The drainage situation in front of the building unit at 901 through 905 London Company Way was explained to us in detail at the time of our site visit. It appears that the association retained the services of a professional engineer to assess the situation and has spoken with representatives from the County and the JCSA previously on this issue. It appears that a high or

seasonal groundwater table may be the cause of water left standing within the gutter pan. Although the area was disturbed during development of the site, based on information available · from Map 2 of the County Soil Survey, underlying soils at this location consist of Augusta fine sandy loam. This soil is deep, nearly level and somewhat poorly drained and a seasonal high water table is present at a depth of 1 to 2 feet during winter and spring.

It is recommended that the association follow specific recommendations from the engineering assessment and report prepared at this location as this would be more thorough in nature than guidance that County Environmental Division staff could provide.

Localized Drainage Issue - West Part of Site

The drainage situation at the west end of the site at/near the building unit at 401 through 406 London Company Way was explained to us in detail at the time of our site visit. The association noticed increased runoff from upslope areas at this location more so than ever observed in the past. Upon investigation, it appeared that an existing stormwater conveyance channel situated within the Pointe at Jamestown, along the border common between Section 1-B Pointe at Jamestown and Jamestown 1607 was obstructed by fences and other landscaping measures by several residences along the south side of Prince Trevor Drive. This storm water conveyance channel is situated within a 20 ft. drainage easement under the control of the homeowner's association for the Pointe at Jamestown. The result of these obstructions is that instead of the channel properly diverting runoff from within the Pointe at Jamestown away from Jamestown 1607, the channel overtops quickly and flow is being directed in a south and southeast direction to and through Jamestown 1607. Please be clear that this situation is not the cause for tidal/riverine flooding associated with mainstem Powhatan Creek.

Following our meeting, County Environmental Division staff made contact with representatives from County neighborhood connections and subsequently the homeowner association at the Pointe at Jamestown and their property management representatives from United Property Associates. The management company responded quickly and subsequent forwarded letters to applicable property owners on March 15, 2007. Copies of these letters were forwarded to you before the date of this letter. Our Division will keep you posted as we receive additional information.

Interior Storm Drainage System:

Based on information found in County records (Jamestown 1607; County Plan No. S-51-94; revision date November 12, 1974), there is no stormwater management /BMP facility within the development site. This is termed "uncontrolled" meaning that increased runoff from the site flows directly into Powhatan Creek in an increased manner compared to predevelopment conditions and without any stormwater management control. This is typical of development sites that were constructed before stormwater management requirements were enacted by the County erosion and sediment control and Chesapeake Bay Preservation ordinances.

There is a storm drainage piping system within the site, scattered throughout the development, along both public and private roadway areas. Storm drainage pipes range in size from 12-inch at the west end to 36-inch at the east end and outfall. In general, based on information on the approved plan, invert elevations of the onsite storm drainage system range from EL 14.51 at the west end of the site to El. 1.0 at the outfall at the east end of the site and most of the interior storm drainage piping system on the site is below the I 00-year base flood elevation of Powhatan Creek. Based on our observations, many of the inlets in yard areas and

along roadways had trash, debris, sediments, leaves and grass clippings within the structures. Inlet# 14 which is located nearest to the building unit at 901through905 London Company Way was nearly completely blocked with surface vegetation. All inlets should be inspected on a routine basis and any such materials and obstructions removed to prevent blocking of the pipes and to prevent ponding at the inlets which could cause minor flooding in the parking/roadway areas. (Note: A copy of the approved plan is attached with the interior storm drainage piping system highlighted in yellow.)

An inspection conducted March 20, 2007 of your rear fence found you have indeed dammed up the easement swale and blocked storm water from flowing back to the retention pond.

Please remove all material installed below your rear fence in the easement swale within 10 days. Also be advised that easement swales are to be kept open and debris fee at all times in order that they may work as designed. Your prompt attention to this matter is greatly appreciated.

On March 7, 2007 James City County Engineer Scott Thomas notified the association that the fence in the rear yard on your property is installed over a drainage easement (swale). This easement swale provides for storm water drainage for both The Pointe Homes and our neighboring community, Jamestown 1607. The engineer further noted you had filled in the area between the fence bottom and the bottom of the swale, creating a dam that redirects significant storm water onto the Jamestown 1607 community .

An inspection conducted March 20, 2007 of your rear fence found you have indeed dammed up the easement swale and blocked storm water from flowing back to the retention pond.

Please remove all material installed below your rear fence in the easement swale within 10 days. Also be advised that easement swales are to be kept open and debris fee at all times in order that they may work as designed. Your prompt attention to this matter is greatly appreciated.

Hi Scott-

Bill Nicholson from Mulberry Place was in today and discussed that his neighborhood would be doing some work on their detention pond. I suggested he contact you for assistance in what they could do in order to maintain it for the future.

Bruce Grove from Lake Powell Forest was also in today regarding the common area behind his house. He said he has spoken with Wayland Bass several times. Seems he wanted to remove some downed trees in the common area behind his house. He said Wayland made his $3000 project a $9000 project. Not sure why. I also recommended that he speak with you. Bruce apparently was not pleased with Wayland. He called the County attorney but his call has not been returned. Seems he is frustrated.
