Newsletter 2018-20 May 18, 2018 WVU’S DR. JOHN DESKINS AND WVDOT SECRETARY TOM SMITH ADDED TO EXCITING CAWV ANNUAL MEETING PROGRAM West Virginia’s economy is finally starting to rebound. In February and March, West Virginia lead the nation in the highest percent of new construction jobs over the last year. Recently released information from the U.S. Department of Commerce Bureau of Economic Analysis shows that in 2017, West Virginia was tied for the 8th highest GDP growth in the nation. West Virginia's GDP grew at a rate of 2.6% for the year, far outpacing the GDP growth of all five of West Virginia's border states. CAWV members attending the CAWV Annual Meeting, July 12-15 at The Greenbrier, will find out if West Virginia’s economy is ready to bounce back after at least five straight years of decline. Dr. John Deskins Ph.D. is the Director of the Bureau of Business & Economic Research at West Virginia University. Dr. Deskins provides his insight to legislators, media, business groups and others during the annual West Virginia Economic Outlook. In December 2017, Dr. Deskins noted that gains in industrial diversification, entrepreneurialism, exports and workforce development, along with de-centralization of state government to accommodate the diverse needs of various regions, will be crucial for a strong state economy. From 2012 until late 2016, West Virginia lost 26,000 jobs. In 2017, 4,500 jobs were regained in the state and coal production has seen a small increase, Dr. Deskins reported, but trends suggest that the Mountain State will not see a full recovery from the severe economic downturn until 2021. "The good news is, we finally did hit bottom in the final part of 2016," he told conference attendees. "We're glad that we hit the bottom, and we're glad that we're growing again. The fact is, we're probably not growing as rapidly as we would hope," he added. "We should probably have a sense of urgency to make the changes that West Virginia needs to fulfill our economic potential." “We are glad Dr. Deskins is speaking at the CAWV Annual Meeting to give our members a perspective of where West Virginia is headed in the next six months of 2018 and what we can expect for 2019,” said CAWV Program Committee Chairman Nate Orders, Orders Construction Company. “He will also take a look at some of the obstacles and opportunities the construction industry will face next year in the form of possible tax reforms and labor shortages.” Dr. Deskins will be the keynote speaker at the Saturday morning General Business Session. Also added to the annual meeting program is West Virginia Transportation Secretary and Division of Highways Commissioner Tom Smith, who will speak at Saturday’s Highway/Heavy Division meeting following the General Business Session. “Secretary Smith has been a great partner with the CAWV in highway funding, developing policies and procedures, and with reorganizing our Joint Cooperative Committee and its subcommittee,” said Chairman Orders. “We are honored he can join us to detail WVDOH’s plans and issues for the second half of the construction season.

ANNUAL MEETING EVENTS REGISTRATION SHEET TO BE SENT TO ATTENDEES Members attending the July 12-15 CAWV Annual Meeting at The Greenbrier will receive a mailing next week to sign up for the golf, fishing and trap tournaments, the Early Bird reception, children’s programs and for seating at the popular President’s Banquet. ANALYSIS SHOWS VOTING FOR HIGHWAY FUNDING DIDN’T HURT REELECTION EFFORTS During the association’s campaign to push for increased highway funding, the CAWV took the position that the decision to vote for legislation to increase state gas taxes, drivers’ license fees and raising the sales tax on vehicles would have little impact on the reelection of elected officials. This position was confirmed after reviewing the results of the May 8 West Virginia Primary Election. Only one state legislator who stood for reelection and voted for S.B.1006 in June 2017 was defeated by voters. Two legislators who voted no on the highway bill were defeated last Tuesday. Of the 60 state senators and delegates who voted for increased highway fees and were up for reelection, 98.3 percent were given another term. Delegate Phil Isner, D-Randolph, was defeated in his reelection bid to represent voters in the 43rd District. By contrast, Bill Hartman, D-Randolph, an ardent supporter of Corridor H and highway funding, was easily reelected. Senator Robert Karnes, R-Upshur, a fiscal conservative who voted no on the tax and fee increases, was defeated in the primary by Delegate Bill Hamilton, R-Upshur, who fully supported the highway funding proposals. Senator Lynn Arvon, R-Beckley, voted no on S.B. 1006 as a member of the House of Delegates. She was appointed to the West Virginia Senate by Governor Jim Justice but was defeated by newcomer Rollan Roberts. Other senators and house members were defeated in the May 8 primary, but they were not in the legislature in June of 2017. The CAWV utilized analyses by ARTBA’s Transportation Investment Advocacy Center which researched the election of over 2,500 state legislators in the 16 states that raised their gas tax rates or equivalent measures between 2013 and 2016. Of the legislators who voted on those measures, 82 percent stood for reelection between 2013 and 2016. Nearly all (91 percent of the 1,300 state legislators were sent back to the state house by voters, TIAC reported. Of the 677 elected officials who voted against a gas tax increase, 93 percent were also given another term. GOVERNOR CALLS SPECIAL SESSION DURING MAY LEGISLATIVE INTERIMS The Legislative Interim Committees will hold their May monthly meetings beginning this Sunday, lasting through Tuesday. Also, a Special Session of the full Legislature is expected to be called on Sunday to simultaneously run through these three days in order to address a couple of items from this year’s Regular Session that need correction and/or expansion, including legislation making the Division of Culture and History a new department in the executive branch. The agency, which is expected to be called the Department of Arts, Culture and History, would be led by a curator, which would not be equivalent to a secretary position with the governor’s cabinet. House Bill 4006 — which Governor Justice signed in March — eliminated the Department of Education and the Arts and moved functions to existing agencies such as the Department of Education.
Issues affecting CAWV members at this month’s interim meetings include: Water and Development Authority and WV Infrastructure Council will appear before the Select Committee on Infrastructure; the Joint Committee on Flooding will hear how the School Building Authority is planning to rebuild schools damaged or destroyed in last year’s flooding; the Parks, Recreation and Natural Resources Subcommittee will hear Division of Natural Resources Director Stephen McDaniel outline his agency’s $100 million construction and repair program at state parks; the Joint Standing Committee on Finance will be updated on state revenues and on the allocations of the Historic Tax Credits since the passage of H.B. 203; and the Post Audits Committee will hear from the WV Division of Highways. JUSTICE ANNOUNCES UPCOMING ROADS TO PROSPERITY BOND SALE AND INVESTOR RELATIONS WEBSITE Governor Justice announced this week that the State of West Virginia will be offering $800 million in General Obligation State Road Bonds for the Roads to Prosperity Program beginning on Monday, May 21, with the sale of Series 2018A Bonds prioritizing West Virginia residents. The bonds carry the State’s strong credit ratings of “Aa2”, “AA-”, and “AA” by Moody’s, S&P Global Ratings and Fitch Ratings, respectively, and have maturities ranging from 1 to 25 years. “These bonds are part of a program that will finance over $2 billion dollars in road infrastructure improvements,” said Gov. Justice. “The projects will rebuild and reconstruct West Virginia’s aging roads and bridges as well as starting up several new highways projects. This is your chance as a West Virginian to invest directly in the Mountain State’s future and help move our state forward for generations to come.” West Virginia residents can purchase tax-exempt bonds by contacting one of 15 firms in the underwriting syndicate and selling group led by Bank of America Merrill Lynch. VECELLIO FAMILY INDUCTED INTO ARTBA HALL OF FAME The Vecellio family of Vecellio & Grogan are one of the 2018 inductees to the ARTBA Foundation’s Transportation Development Hall of Fame. Inductees were honored, along with the 2016 and 2017 class inductees, at a May 14 gala dinner in Washington, D.C. Launched in 2010, the Hall “honors individuals or families from the public and private sectors who have made extraordinary contributions to U.S. transportation development during their careers.” Honorees are recognized as either “Innovators,” or “Leaders” (Individuals or Families). CAWV JOINT ARCHITECTS COMMITTEE MEETS WITH NEW SBA EXECUTIVE DIRECTOR The CAWV Joint Architects Committee met on May 10 at the CAWV Headquarters. Committee members discussed several industry issues during the meeting. In addition to the regular task force reports from the SBA Task Force and the Bid Procedures Task Force, an update was given on the AIA A201 Document Task Force by Adam Krason, ZMM Architects. Krason said that current 2007 AIA A201 Document will no longer be available after October of this year and that, as it has done with the past versions of the document, the task force will need to develop new supplemental conditions. He noted that the task force will meet immediately after the CAWV Joint Architects Committee Meeting and plans on meeting several times over the next few months to develop the new supplemental conditions for the 2017 AIA A201 document that will be required after October. Krason said an update will be given at the next CAWV Joint Architects Committee meeting. Matt Yeager, District Administrator, and Don Bailey, Engineer from the West Virginia Division of Natural Resources, attended the meeting to give an update on the DNR’s plan to spend $57 million dollars on state park and state forest facilities. Bailey reported that the bonds for the project funding will be sold in August of this year. He said that several of the projects are smaller in scope such as infrastructure repairs, roof repairs and HVAC repairs and upgrades. Most of these projects are under $250,000 and have an estimated value of $5 million. The larger projects that range from $250,000 to around $5 million include lodge and cabin upgrades, elevator replacements, full roof replacements and electrical upgrades. There will be an estimated $39 million in the larger project category that will go to bid. Bailey also reported that roughly $13 million will be spent on clean water and waste water projects for state park and state forest facilities. Yeager added that the bonding allows the DNR to add the estimated $57 million to their regular budget which already included some funding for projects that were already scheduled over the next couple of years. Attendees at the meeting also met David Roach, the new Executive Director of the School Building Authority of West Virginia. Mr. Roach, who worked his way up through the school system to become a superintendent in several counties, has been involved in the construction of several schools in his years as a superintendent. “I am excited to have been appointed to this position and I believe that we can accomplish the SBA’s mission of building quality school projects at a fair cost by working together,” the director said. He noted that the SBA is in the process of reviewing their Policy and Procedure Handbook to make sure that it fits within the mission of the SBA to provide funding to counties, which are the owners, to build and remodel schools without including unneeded policies that drive up cost. Tripp Dailey, W. Harley Miller and CAWV Building Division Director, said that “we have had a great relationship with the SBA for a long time and that the industry is excited to work with him to make sure the SBA can in fact deliver on their mission.” Mr. Roach noted that this year’s funding is around $50 million but he expects that to increase in the next couple of years. The next meeting of the CAWV Joint Architects Committee will be announced at a later date and committee members will receive notice of the schedule. ACCIDENT PREVENTION
As a construction worker you are part of a team of skilled professional craft workers, and accident prevention is part of your job. It takes everyone's effort to keep a jobsite safe. There are many things you can do to help prevent accidents. Come to work fully rested; wear proper clothing and sturdy footwear; jewelry, watches and rings must be left at home. Use the correct personal protective equipment when the task requires it, and keep this safety gear in good condition and replace it as necessary. Damaged or lost equipment should be reported to your supervisor. Keep your work area clean and neat. Don't let your housekeeping get out of hand.
Follow the warnings written on labels. Observe signs, regulations and procedures; ask your supervisor about any you don't understand. Never bypass safety valves or devices. Follow lock out - tag out practices where required to do so. Remove protruding nails or bend them over. Wipe up spills of oil, water, or grease. Keep walkways, aisles, traffic lanes and fire exits clear of debris and other materials. When working in new areas of the jobsite take a few minutes to look around to locate obvious hazards. Don't leave any floor openings unprotected. Cover floor holes securely or guard with standard guardrails. Make sure you have the right type and size of ladder. Climb it facing the rungs and be sure your hands are free to hold onto the ladder.
Check your electrical tools prior to use. Whenever possible plug into electrical outlets that are protected with GFCI'S. Do not use tools with split, broken, or loose handles. Watch out for overhead power lines. Always store flammable liquids in approved containers. Shut off engines and let them cool down prior to refueling; and never smoke around flammables. Report any accidents to your supervisor. If you get injured get proper first aid and seek medical assistance if necessary. Keep your mind on your work. Drugs and alcohol don't have a place on the job. Horseplay and practical jokes cause accidents so keep them off the job. Practice accident prevention. Try your best to follow these guidelines and all of us will have a safer place to work.

SENATE COMMITTEE UNVEILS LATEST WATER RESOURCES DEVELOPMENT ACT On May 14, AGC urged the U.S. Senate to make important changes to the authorizing biennial water resources bill, entitled America’s Water Infrastructure Act of 2018 (WRDA). While not a spending bill, WRDA authorizes billions in funding for U.S. Army Corps of Engineers Civil Works (USACE) projects, including about $2.4 billion of new federal spending on six projects involving disaster recovery. Among other recommendations to the bill, AGC proposed the following:
• Exclude Section 3111 – authorization of appropriations for purchase of a hopper dredge by USACE;
• Include Securing Required Funding for “Water Infrastructure Now Act” – a fiscally responsible approach to providing states over $10 billion annually for critical improvements to the country’s rural and urban water infrastructure. The act will provide state financing authorities WIFIA loans to support water and wastewater construction projects;
• Include Regulatory Streamlining – Congress should require federal agencies to follow a one federal decision process, so there is just one NEPA review for a project that ends with a single record of decision issued by the lead agency;
• Include Regulatory Transparency – AGC put forth its support for two regulatory transparency items: (1) a public database of USACE real property holdings as a means to help states, localities, and private industry to better plan for—or avoid entirely—issues any construction project could face under Section 408 of the Rivers and Harbors Act; and (2) a public database for USACE district and regional offices to disclose and accept public comments on changes to regulatory and general policies impacting water resources projects or state water quality certifications, as such policy changes can occur at the local or regional USACE office level with little or no input from the public.

As requested by AGC and our partners in the Transportation Construction Coalition (TCC), the bill provides funding levels authorized by the FAST Act for highways ($45.27 billion) and transit ($9.939 billion plus $2.614 billion for Capital Investment Grants). Additionally, the bill provides an extra $4.25 billion highway supplement from the general fund. Of that amount, $3.8 billion will be distributed via formula as apportioned under the Surface Transportation Block Grant Program, and $250 million is for highway safety projects. This new money equates to an 11% increase, $49.5 in highway formula funding in fiscal year 2019. The bill also includes $750 million for BUILD Grants (formerly known as TIGER), representing a $250 million cut from fiscal year 2018 but a $250 million increase over 2017 levels. In terms of aviation, the bill is status quo, with a $500 million exception. The additional $1 billion included in the fiscal year 2018 bill has been cut to $500 million in 2019. The bill is likely to be considered by the Full Appropriations Committee next week, where AGC will continue to weigh-in and ensure that these significant increases are realized.
