CASE
The Amazing Case of 2016 is a series of events hosted by Janet Reigle and Megan Oakley. This Season, all teams will embark on a trek from Case Initiation to Case Closure. Along the way to every destination each team must compete in Road Block Challenges, while being mindful of the LOCATION (of all parties) Road Blocks can be overcome with the help of Prior Seasons’ Winners!

The first leg of the race is “Case Initiation”, sit back, turn on the radio, and listen to our guest speaker.. We are here today with Janet Reigle….

Case Initiation: The purpose of Case initiation is to assess the case status and determine if the case is
ready for establishment, enforcement, or modification.
Some Actions Taken:CSE case is set up in CHARTS
Essential Parental and Adult relationships are investigated and added to CHARTS
BOOW indicator set. (* Born out of Wedlock, YES/ NO)
Birth records obtained.
Questionnaires requested/obtained as needed.

Race Against the Clock: Case InitiationFederal timelines allow 10 business days to acknowledge the receipt and notify initiating state where the case was sent for action.Federal timelines allow 20 days in which to establish a CSE case file and then 75 days to bring a CSE case to disposition.

We interrupt your normal programming to bring you this alert.. this is not an actual emergency; it is just a warning that detours exist.
Lets Learn about Detours: A Detour can happen at any leg of the race; from case initiation all the way to case closure. A detour happens when you can’t find one of your parties. It’s crucial to know where all of the parties are. Location is so important in being able to move through each leg of this race. As you travel on this journey, always be on the look out for this specific detour.

Paternity Establishment: Overview
Paternity is “the legal determination of fatherhood
of the child.”
CSE will institute a paternity action when
appropriate for any child until the child’s 18th
Birthday.
Race Against the Clock: ESTABLISHMENT
PATERNITY ESTABLISHMENTFederal regulations have established expedited processing performance standards for paternity establishment and establishment of support orders. States must establish paternity and/ or an order for support or exclude the alleged father by genetic testing:• Within 6 months of successful service of process in 75% of all cases; and• Within 12 months from the date of successful service of process in 90% of all cases

Paternity: Paternity is Deemed Established: Parents are married when child is conceived/ born
Parents sign a notarized Hospital Paternity Acknowledgment• At the hospital
• Any time after the birth through any Nebraska CSE office. (DHHS pays the
filing fee if we have an open IV-D CSE case. We do not pay this fee for a non
IV-D Paternity Ack. One of the parties would need to apply for CSE Services
or pay themselves.)
• At Vital Records (filing fee is charged)
The court determines that the Alleged Father is the legal Father.

NEBRASKA PATERNITY ACKNOWLEDGMENTAfter a 60- day rescission period, signing of a notarized paternity acknowledgment is considered a legal finding of paternity in Nebraska.
WE KNOW WHO DAD ISCSE, through the County/ Authorized Attorney, has 90 calendar days from the date of locating the alleged father to complete one of the following:• File a complaint and complete service of process to establish paternity and a child/ medical
support order; or• File a stipulated agreement; or• Document unsuccessful attempts of service of process.

Paternity: Voluntary Acknowledgment of Paternity
Send
• Create and send event 4042, Paternity NCP First Contact Letter (CSE0153) to the alleged father. (This letter asks the person to call to schedule an appointment to discuss a matter or extreme importance. It also advises the alleged father that failure to do so could result in further legal action.)
AF’s Response
• The alleged father can sign a declaration of paternity, sign a paternity acknowledgment, deny paternity, or not respond.
Send
• IF the alleged father does not sign a declaration of paternity or a paternity acknowledgment, offer the alleged father to opportunity to request genetic testing. EVENT ID 4059 (Voluntary Agreement for Genetic Tests).
• If the alleged father does not respond to the contact letter, and you have all other documents needed to proceed, make a referral to the CA/ AA for filing a paternity petition with the court.
GT results
• If GT excludes the alleged father and a petition has been filed, the petition must be dismissed before you can close the CSE case.
• If the GT indicates 99%, you will refer the case to the CA/AA (if the case is not already there)

Establishment of a Support Order and Medical Support Orverview:
Establishment of a support order occurs when paternity is not an issue and there
is no current CS/MS order. (In cases where Paternity also needs established, the
CS/ MS can be addressed at the same time that paternity is addressed in court.)
CSE will institute a CS/ MS action when appropriate in situations such as:• A married couple living separate and apart.• A court order that establishes paternity but child and/ or medical support
was not ordered or addressed.• A hospital acknowledgment of paternity was signed by the parties.• A non-custodial party (NCP) who was incarcerated and establishment of a
support order was reserved until the NCP’s release.• Parties who share split/ joint custody of the DEP children.

ESTABLISHMENT OF SUPPORT ORDER
Within 90 Calendar days of location the alleged father or NCP, Child Support Enforcement must establish an order for support or complete service of process.

Processing the Establishment Case: Gather Information Needed to Make a Referral
LOCATE
• Research/ update address/ contact information for NCP, CP, DEP (Determine Jurisdiction)
• Where to look: compare this info in CHARTS/ N-FOCUS/ DMV/ with Employers/ send PML’s, look on Questionnaires etc. (If CP lives in a county or the NE order is out of a county where your office does not provide the CSE services, you may need to transfer the case.
INCOME
• Research employment information, send employment verification with ASD0060 (Event 2018/ Document CSE0008), Gather information about sources of income
• Where to look: Review income tab in CHARTS. Income information will later be used on the guideline calculation.
Vital Stats
• Ensure correct vital statistics information is determined and documented for EACH dependent in CHARTS.
• Where to look: Review N-Focus/ Vital Stats, and ask CP if needed: locate Birth Certificates, Death Certificates, Adoption, and Guardianship papers for each DEP when possible.
Adult Relationships
• Ensure marriage/ divorce documentation for CP/ NCP is reviewed and correctly documented in CHARTS.
• Where to look: Review N-Focus/Vital Stats; try to obtain documents such as marriage certificate, divorce certificate, death certificate, birth certificate, ID Cards etc. Review the adult relationships tab.
BOOW
• Ensure BOOW information for each Dependent is correct.
• Where to look: Associate to each Dependent’s ARP tab and update the Paternity Tab with the correct BOOW information.
PAT
Ack
• Check imaging for a paternity acknowledgment for each Child. If it is not there, email CSE operations to request the paternity acknowledgment be imaed.
• Where to look: CHARTS DEP event log. The PATERNITY ACKNOWLEDGMENT is tied to the DEPENDENT.

Establishment Referrals To County/ Authorized Attorneys:
When the case is referred to the CA or AA, the case owner has
prepared the case for the attorney’s involvement and indicates
whether paternity and establishment are needed or just establishment
of Child support and Medical support
A list of documents needed for a referral is located in the Establishment
Procedure manual.
A Case worker will make the referral to the attorney by following
Document Event 8003 in CHARTS (CSE Attorney Referral).

The Importance of HI/ Medical Support
Health Insurance needs to be addressed in every IV-D case. • The cost of HI for the dependents can be factored in when you are
using the guideline calculation.• HI is considered reasonable if it is available through the employer
and at the time of enrollment the actual cost will need to pass the CCPA (Consumer Credit Protection Act) guidelines.
• The employer completes the calculation.Cash Medical instead of being ordered to provide HI
Who provides HI? CP/ NCP
Establishment: File the Complaint
PATERNITY: To establish an order for paternity you will file the Paternity Complaint (CSE0098)
SUPPORT: To file an order for support, you will file a Complaint to Establish Support (CSE0099)
(Selecting the Event 4063 “Establishment Packet”, allows you to select either one of these options.)

Prepare the Pleading that will be filed with the clerk of the District Court:
Establishment Packet: Event 4063 (CSE0162), consists of a collection of CHARTS documents for multiple establishment events.
Document Caption: Legal Documents pass through the Caption Folder in CHARTS. A caption is created once per court order and reused for other court documents. Creating a new caption will automatically assign a Court Case Identifier and print the number on the bottom right-hand side of the second page and all subsequent pages of the complaint. These documents are filed and entered into the JUSTICE system by the clerk. This creates a bridge between JUSTICE and CHARTS caption. See CHARTS for different types of captions.
Service of Process:
Documents are filed with the Clerk of the
District Court. (E-Filing is encouraged)
The praecipe you created asks the CDC to serve the NCP. The CDC gives the
documents to the Process Server who will attempt to
serve the NCP.
The Process Server will return information to
the Clerk whether service was perfected
or not.
The Clerk should notify the attorney’s office with an
update regarding if service was perfected, the method of service,
number of attmpts, and how and where.
CDC Involvement
• Successful Service: • Information is interfaced from JUSTICE to CHARTS and displayed in the court case folder.• In order for service to be considered successful, there must be a date in the Service Date
field and a service method entered into the Service Method field. (Certified mail, personal or residential, publication, voluntary appearance.)
• Failed Service:• If SOP has failed and it has been at least 60 days since the SOP was started, the SOP tickler
process will send an Action tickler when a new verified address or employer are identified. The purpose is to restart the process when court cases have been stalled for lack of SOP.

Scheduling a Hearing:A hearing will be scheduled.
Once a hearing is scheduled, update the CSE case folder, Court Hearing tab with the date, time and reason for the hearing.
Create the Hearing Notice to the ARP (CSE0125), Event 4082, and the Hearing Notice to the Attorney (CSE0140), Event 4033.
To enter the results of the hearing, complete Event 8084, Hearing Information
End of the LegFiling the complaint was the first judicial action to establish an order. After the filing and service has been completed, update the Legal Tracking Dates. Complete any necessary updates to CHARTS. Congratulations on completing this leg of the race!

•The best source of collecting Child Support is yourself.
•A caseworkers ability to communicate with Non-Custodial Parents is vital to collecting payments on a caseload.
•Being Proactive in Calling NCP’s will help payments come in consistently and will limit future phone calls that you will receive.

Enforcement Continued
• Some enforcement actions are put in place automatically. CHARTS assesses the case to determine that it qualifies and generates the required documents. The action is entered into Event Log.
• Some enforcement actions are automatically terminated based on a change in circumstances.
• Some enforcement actions are worker- generated. After the caseworker determines which case needs enforcement, they will review the case and determine the most effective action to take.
