anticipated order on rooftop solar rates on Friday, �led a draftruling late Wednesday that suggested it would be unlikely for thethree-member body to let more than 17,000 existing solarcustomers keep their more favorable rates.

In a 124-page draft order, the commissioner presiding over thesolar proceedings proposed the board not grandfather existing customers for 20 years,which had been the recommendation of multiple parties involved in the case, includingNV Energy and the state’s consumer advocate. The draft order instead proposedextending the gradual implementation period for the increased solar bills from four yearsto 12 years, with four rate changes split into three-year increments.

Before its meetings, the Public Utilities Commission of Nevada, which regulates NVEnergy, issues a draft ruling written by the presiding o�cer in the case. The draft doesnot re�ect the opinion of the entire body, and other commissioners are allowed tosuggest modi�cations to be considered during the meeting, raising the possibility thatthe language released Wednesday could still be changed.

As it is currently written, however, the draft order represents a blow to the rooftop solarindustry, which was hoping the commission would at the very least reconsider itsdecision in December to increase bills when it tripled a �xed fee and cut the value ofincentive credits for customers.

The draft order also denies appeals that challenge the basis for the bill increases.

Bring Back Solar Alliance, which is organizing a ballot measure that would revoke thecommission’s authority and e�ectively restore the prior rates, criticized the decisionWednesday evening.

"If the Public Utilities Commission adopts the proposed decision, we urge the Legislatureto call a special session immediately to solve the problem that the unelected PublicUtilities Commission has created,” alliance spokesman Bob Greenlee said in a statement."The Legislature has the power to immediately bring back solar for all Nevadans and torestore fairness to the over 17,000 solar customers that today’s proposal would leave outin the cold.”

Several lawmakers have said they support grandfathering and are closely watching thedecision.

The commission had argued that the new rates were necessary to ensure that solarcustomers, who do not purchase as much energy from the grid and avoid paying some ofthe �xed costs wrapped into electricity rates, were not shifting costs to other ratepayers.The Bureau of Consumer Protection, headed by the consumer advocate, who represents

Solar advocates argued that the cost shifts were false and that the commission had notconsidered the bene�ts of solar for all ratepayers, such as its environmental impact, thereduction of strain on the utility grid, and a decreased need for NV Energy to invest incostly infrastructure projects.

Since the decision in December, solar advocates have waged a vocal campaign against thecommission, urging it to reconsider its decision. The draft order takes aim at theirorganizing.

“(The Alliance for Solar Choice), SolarCity, and Sunrun, as well as others, have engagedin an all-out campaign to in�uence the public perception of the commission’sratemaking process by claiming repeatedly that the commission is subject to regulatorycapture by NV Energy and that the commission’s decisions in this proceeding are illegal,all while the proceedings before the commission were ongoing,” Commissioner DavidNoble, the presiding o�cer, wrote in the draft.

He wrote the commission cannot base decisions “on misperceptions that are largely theproduct of an active e�ort to mislead ratepayers through the dissemination of inaccurateinformation.”

Noble argued that by the solar industry’s calculations, customers would still save about33 percent on their utility bills under the new rates. The solar industry has said that sucharguments are misleading because while customers might save on their utility bills bynot purchasing as much electricity from the grid, they would still be required to payother costs for solar. They have argued that the cost of both bills — the utility bill andthe solar bill — could therefore be greater for their customers than before they installedrooftop solar, a calculus that would discourage the technology.

Bryan Miller, president of the Alliance for Solar Choice, issued the following statement:"Noble’s contortionist twisting of the law belongs in a Vegas Cirque du Soleil show, notthe halls of government. (Gov.) Brian Sandoval's legacy will be letting his hand-pickedcommissioners eliminate a booming industry while he complicity stays silent."

Do you actually believe either company expected our PUC and governor going to such extremes? Incase you haven't noticed they both left town due to the decision. My solar company came through witheverything I expected and contracted for. It was the PUC decision that screwed us. total bait and switchfrom NVEnergy that was approved and added on by the PUC.

So after todays PUC meeting we are screwed. Governor Sandoval issued a weak statement that the PUCdid not go far enough in protecting our interests. 300%+ increase in service charge and 80% reduction inwhat we are paid for what we produce is what he calls not going far enough in protecting us.

Let the justice system work and hopefully undo what these people have done.

If someone bought a solar system they got the big tax credit and now mostly free of the electric companyrising rates. Of course basic fees wil l go up, and I think it should be the same fee, but there never couldbe a guarantee of repurchased power at prices unless you had a contract. Therein seems to be the biggerproblem. But you sti l l have your own electric source and saving money on not buying from NV so behappy. Not al l investments pan out. If you were not smart enough to get written contracts for the energyyou sell you are subject to whatever they want to pay. But the reason you bought solar was to save moneyon your own power bi l l , not to be a uti l i ty company? The PUC should go a step further and have ratesthat are based on peak and non peak so those who can avoid peak can save and those who need it pay al i ttle extra.

The definition of "net metering" of banking excess power on the grid l ike a battery 1 for 1."Using the grid l ike a battery" is STILL on the NV Energy website today.

NV Energy advertised specifical ly "Sign up NOW to get in under the 3% cap to get the currentnet metering rate. After the 3% cap would be subject to new rates decided by the PUC inDecember. " I got in on Net Metering in Feb last year well before the cap so to have my rateschanged is false advertising.

@joeobremski If you have a contract for a purchase price go see a lawyer. I amguessing much of this was "promised", kind of l ike when Obama said i f you l ike yourinsurance plan and doctor you can keep it but when the laws changed the promisewent out the window. Much should be learned about doing things without writtencontract,, watch Judge Judy :) AT least you don't have to rely on NV for power andare saving money on electric so is not exactly worthless. I have had much worsethings happen.

@peterf If you change to time of use metering, you wil l automatically have your rates adjustedfor peak and non peak useage...However your leading analysis is a bit of a stretch...What i f youbought a new car with a bank loan and after a couple years, the bank contacted you and statedthat they were going to hold the engine for your car unti l you paid off your loan...This would beconsidered commercial fraud, which is much closer to what has occurred with the people whopurchase roof top solar...

Net metering was set up when solar was 50x more expensive. Set up for people who wanted to gogreen... Not save money.

Solar panel costs are down 99% in the last 20 years and wil l continue to fal l . The industry is mature andit is time to take the training wheels off...

Solar city's business model is based on these training wheels (above market prices, large governmentsubsides) and they need to adapt or go away.

Power costs on the open market are way down.

Many states (l ike Nevada) forced there uti l i ties to build lots of power plants postEnron. With al l these new plants peak power is a fraction of what i t use to be. 0.03 to0.08 on average.

Net metering is not a cost savings with power this cheap.

Very true we have already created a new class with net metering... But that is noreason to create a new class within the net metering class of customers..

Also I dont l ike the new fee. I think that is unfair.

I do l ike the new rate rooftop solar customers are compensated for the energy theygenerate. Power is cheap these days and we shouldn't force NVE to pay abovemarket prices to solar city with there 20-25% profit margins.

NVEnergy must be sued by every solar resident. They promoted residential solar and laid out everythingin detai l including the savings and payback time. Some people were online with solar just one monthbefore NVEnergy and the PUC changed all of the Rules. "Save $1000 a year, payback time for a $13000investment, ~ 13 years. I work for a smaller solar company, and the man in this video (he's in charge ofthe Solar Generations rebate system) was tel l ing us that the new rates wouldn't affect the solarindustry or customers. He went so far as to tel l us to continue sell ing solar in December. One ofour NEM2 customers was very skeptical as to i f he should instal ler solar, so he called the PUCNand NV Energy TWICE to confirm that i t was wise, and they told him yes, and that he shouldcontinue forward. Talk about "bait and switch"!!!

I am a net metering customer and I have a signed contract with NV Energy. The PUCis going to negate this contract. Of course you know this but seem to disregard it. How would you feel i f the state came in and negated your contract with your cellphone company, your internet provider, your tv provider or any other service. Howabout i f the state said you are not paying enough for your gardener and you need topay 300% more. You need to understand, the PUC commissioned a study thatshowed that net metering customers provide 36 mil l ion to NV ENergy. Not quiteenough for our esteemed governor or NV Energy.

Read the study - i t also says roof top solar provides no benefit and creates only $200mil l ion in costs i f large solar projects are $80 or lower. They are now $50. So theindependent study agrees with the findings in the case. There is no denying thissimple fact i f you support the study.

I have no problem with rate increases that are justified and fair. I am just saying that300% seems a l i ttle excessive added to the cut in what we are paid for what weproduce. Agreed. Small justi fied increase fine. I mean we do have a second meter. Charge mea fee for that but my "connection" to the grid is the same as any other house. Samewire buried in the ground that I used for 15 years pre solar and now a year on solar.

I love how the NV Energy reports talk about how much solar costs everyone but theyleave off al l the positive numbers. Reduced peak hours expasion of transmissionlines, l ine losses pushing power al l those miles to bring power in from outside the city,etc.

That new solar field way out I15... what is the cost of running power l ines all thosemiles to support that?

Anyone ever see NV Energy's cost pet kWh they pay during peak hours? All I everhear is them quote the low ball $.02kWh but I'm sure that is there lowest purchaseprice numbers.

Lastly, net metering is defined as excess power that is banked to be used at a latertime. Net Metering is NOT defined as I SELL my excess power to the power company.If i t was I would have fi l led every inch of my roof so I could A) cover my usage 100%and have basically a $0 NV Energy bi l l and further B) maybe even make a few bucks.

@DixieRaeSparx You are correct that the PUC can change the laws and tariffs in theexisting Net Metering Agreements...However, changing the electrical exchange ratevoids the existing Net Metering Agreements...It is no longer a Net MeteringAgreement unless the electrical power exchange rate remains at 1:1 (which reflectsthe basic definition of a net metering agreement)...

The PUCN failure to investigate smart meters fires as requested by the City of Renoand Sparks Fire Chiefs suggests the PUCN is more concerned about NV Energy'sunrecoverable costs that customer safety. See PUCN docket 14-09015. The PUCNattempted to close the investigation with no action in January 2015. This effort wasthwarted by a local reporter.

Four other uti l i ties stopped instal l ing the most common meter used by NV Energydue to fire safety concerns. They removed all 375,000 units and instal led anotherbrand.

Questionable PUCN Actions #2

Dockets 15-07041 and 15-07042. Paragraph 193 of the December 23 order providesdetailed bi l l ing instruction for applying credit for excess energy to the energyaccounts (BTER and DEAA). but is si lent on the energy service charges (BTGR). Research reveals that the "subsidy" is actually an unlawful bi l l ing calculation by NVEnergy. Prior to the order NV Energy violated NRS 702.775 2(c)4 by crediting BTGRfor attributes excess energy did not have. This was essential ly correction of a bi l l ingmistake and class misassignment.

The PUCN failed to clearly identify the root cause and to treat the problemaccordingly. As a long-standing bil l ing error, NV Energy is responsible for damagesdone to customers by the error.
