AMENDED STANDING ORDER REGARDING TEMPORARY PROTECTIVE ORDERS

A meeting was held in Athens, Georgia on January 23, 2013 with all six Superior Court

Judges present. Among other matters, there was a discussion concerning filing and judge

assignment of Temporary Protective Orders before signing of an Ex Parte order by the assigned

judge.

After a vote that was not unanimous.OOOOO three in favor of changing, two against and

one in-between, I as Chief Judge pursuant to O.C.G.A. 15-6-2 as amended, hereby amends The

Standing Order Regarding Temporary Protective Orders, dated January 8, 2013 as follows:

(a) The Petitioner shall complete the form petition in its entirety and take it to any

Superior Court Judge in the circuit or any authorized State Court Judge or Senior Judge in the

circuit for said judge's review and signature on the Temporary Protective Order. The Petitioner

shall be responsible for informing the Judge whether the case that is the subject of the petition is

a companion or related case as defined in USCR 3.2 by completing and filing an Affidavit

Regarding Companion and Related Actions in a form that substantially complies with Exhibit

"A" to this order. Next, the Petitioner shall take said petition and signed Temporary Protective

Order to the Clerk of Superior Court (hereafter "Clerk") for filing.

(b) At the time of filing, the Clerk shall, pursuant to the random case assignment system,

assign a judge to preside over the case. If the first judge assigned will not have a regular non-

jury hearing date in the county within thirty (30) days of the date of filing the petition, the Clerk

shall, again using the random case assignment system, re-assign the case to another judge,

repeating this process until the judge randomly assigned has a regular non-jury hearing date that

is within thirty (30) days of the date of filing the petition. Once the assigned judge is known, the

Clerk shall fill in the date, time and place for the hearing on the first page of the Ex Parte

Protective Order, and return a copy of the order along with a copy of the petition to the

Petitioner.

In any case in which the Petitioner is seeking an award of child support, the Petitioner

shall bring to court on the day of the hearing a child support worksheet prepared pursuant to

O.C.G.A. § 19-6-15.
