“Because of those reforms, 90 percent of the people who are charged with non-violent offenses will remain out of jail,” said David. “We effectively ended cash bail for all misdemeanors and non-violent felonies.”

The elimination of cash bail, particularly as used for misdemeanors and non-violent offenses, has long been a principal initiative of criminal justice reform advocates who argue that it unfairly impacts low-income residents.

And when the latest New York State budget was approved on March 31, many hailed the provisions that effectively did away with cash bail for minor offenses.

Speaking to reporters at a media roundtable on April 12, Alphonso David, Chief Counsel to Governor Andrew Cuomo, agreed that the measures reflected a change in course, one

length of pre-trial detention. “We’ve seen over the past several decades

that individuals are staying incarcerated and waiting to see judges for several years,” remarked David. “We have now implemented reforms to prevent that from happening.”

During the roundtable, the Chief Counsel was joined by Elizabeth de León Bhargava, Director of State Operations and Infrastructure and Kenita Lloyd, Assistant Secretary for Intergovernmental Affairs.

“This is the broadest, most sweeping state budget that we have done and for the ninth straight year it was both timely and fiscally responsible,” said Governor Cuomo upon the budget’s passage on April 1st. “We are not here to do the easy issues - we are here to do the hard ones, the ones that gave you unease in the pit of your stomach, because those are the ones that need to be achieved.”

The $175.5 billion budget includes several mechanisms to increase revenue for the cash-strapped Metropolitan Transit Authority (MTA), including congestion pricing, internet sales tax and a tax on luxury real-estate transactions.

“The Governor has been saying it’s not only about money, it’s about management,” David said of the MTA. The new budget includes provisions to enhance oversight of the MTA and improve the efficiency of its contractors to ensure more timely and efficient work.

“The MTA was going through a process of working with contractor after contractor even though they were not performing,” David explained. “We now have in the budget that if a contractor is late by 10 percent or if the costs are over 10 percent, they can be barred doing business from the MTA in the future.”

The budget also makes permanent the 2 percent property tax cap, increases school aid by $1 billion and includes a ban on single-use plastic bags. In addition, the budget codifies provisions of the Affordable Care Act (also known as Obamacare), guarantees the right to organize and collectively bargain, and reinforces reproductive rights.

Just above Moon River, there is a mission.

An unassuming string of storefront shops, including Moon River Wine and Liquors, the New Wave Beauty Salon and a multiservice insurance agency, lines West 207th Street. Just above the colorful awnings is the Centro Evangelistico Pentecostes del Movimiento Misionero Mundial (MMM).

The center is an outpost of an international faith-based organization, which runs a food pantry at the 207th Street location.

The non-profit provides food to about 500 people each week.

And now, local property owners are partnering to assist the MMM Food Pantry in its operations.

The Community Housing Improvement Program (CHIP) has partnered with the MMM Food Pantry in Inwood to bolster the pantry’s operations.

A trade association of approximately 4,000 owners and managers of rent-stabilized rental properties across all five boroughs, CHIP provides educational programs for its members and offers

The budget also mandates health coverage of In vitro fertilization (IVF) and egg freezing procedures for women with fertility challenges. The budget additionally removes some of the barriers for domestic violence victims to receive assistance.

“In the past, you had to essentially go to a shelter in order to receive domestic violence services. You no longer have to go through that process,” he said.

The FY 2020 budget also includes $641 million in restorations for Medicaid and $14.7 million for voter reforms. New Yorkers will now be able to take three hours from work, without loss of pay, to go to the polls and vote.

The budget included $27.9 billion for education, the highest amount in the nation, according to David – an amount that represents an increase of $1 billion from last year. Included

are measures to maintain equity in public education, by requiring school districts to prioritize funding for poor schools, explained David. He said the move came after it was discovered that school districts were not allocating state money to certain schools properly.

“What we found last year, after we required that those school districts supply us with data, is that there was a lack of transparency and certainly a lack of equity,” he said. “So, the poor schools were not receiving more money, which is what people were assuming.”

Though many advocates and lawmakers criticized the fact that the new budget only included $20 million for outreach surrounding the 2020 Census, David noted that the state was willing to provide additional money going forward.

“The Census is a two-year process. To the extent we need additional funding for next year, we’ll allocate those funds,” he remarked.

Despite the budget provisions touted by David, he said there were still other priorities still to accomplish, including a regulated adult-use cannabis program.

“We worked with the legislature over the last few weeks but were unable to reach

a consensus,” he said. “We’re going to be working with them over the legislative session.”

State Assembly Speaker Carl Heastie had signaled early in the budget discussion that a marijuana program was likely to be determined outside of the budget process, as it was a complicated issue. Many lawmakers are seeking to tie pot legalization into criminal justice reforms, so that those charged with marijuana-related offenses would have their records expunged.

“More than getting things done quickly, it’s better to get things correctly,” Heastie said.

Marijuana legalization would be decided on within the current legislative session, said David, who stressed that rent reform was also a top priority for the current session, as the state’s current rent laws expire in June.

Another much-discussed issue that failed to get in the budget was the issuance of driver’s licenses to undocumented immigrants.

Lawmakers and advocates continue to push for passage of stand-alone legislation, known as the Green Light bill – that would provide licenses to all New Yorkers regardless of immigration status.

Young children in the care of Catholic Charities, one of various service providers for the unaccompanied minors and separated children in New York City, have experienced stressful – and often painful – situations.

Luz Tavarez, the Director of Government and Community Relations for Catholic Charities, said that many of the children have

Caravan of Caremental health issues due to the trauma of their separation and violence they’ve witnessed in their home countries.

“A lot have PTSD (Post-Traumatic Stress Disorder). They’ve experienced trauma,” said Tavarez. “Many of these children have witnessed people die.”

In light of current projections, Catholic Charities will likely provide care for 8,000 unaccompanied children in 2019 – a high water mark.

Tavarez is ready to learn more.She will take part in a fact-finding team

the organization is leading to determine why Central American refugees continue to come to the United States.

“We hope to hear about some of the push factors that are bringing the children and their families here,” she explained.

The delegation will also include Catholic Charities Executive Director Monsignor Kevin Sullivan, New York State Comptroller

Thomas DiNapoli, and Stuart Applebaum, President of the Retail, Wholesale and Department Store Union (RWDSU), among others.

Leaving on Mon., April 22, the day after Easter, the team will visit Honduras, Guatemala, and El Salvador. These Central American countries — together dubbed the “Northern Triangle” — serve as the point of origin for the majority of the unaccompanied minors and separated children that end up in the care of in

New York City service organizations such as Catholic Charities after crossing the American southern border.

Tavarez said the group will meet with church officials, labor leaders and heads of state during the trip, which will end on April 26.

“We’re out to learn as much as we can about what is going on there,” she said. “I don’t think people think about the root causes of what drives these children here.” Sullivan said that the number of unaccompanied minors coming into the care of Catholic Charities continues to grow, and added that the mission was intended to further enlighten service providers.

Those caring for refugees in the city, he stressed, don’t have all the answers.

“We know the global issues, but we are going to learn things that are surprising, and hopefully what we learn can impact what we’re doing here and how we can help families to reunite,” he remarked.

DiNapoli traveled to Bangladesh with Monsignor Sullivan a few years ago on a similar fact-finding mission in the wake of the Rana Plaza disaster.

The 2013 collapse of the eight-story commercial building killed over 1,100 Bangladeshi workers in the garment industry.

T he news has been filled with grief and confusion emanating

from a spate of recent high-profile deaths.

These include the violent murder of popular hip-hop artist and entrepreneur Nipsey Hussle (née Ermias Joseph Asghedom), the attacks targeting mosques in New Zealand as well as the recent suicides of a father of a child who was killed in the Sandy Hook shootings and two Parkland students. These events prompt an important conversation about what can follow in the shadow of collective trauma.

1. The effects of trauma

grief can follow many different losses. Reminders such as anniversaries can prolong

complicated grief or even reactivate grief and trauma. On the anniversary of the Parkland school shooting, dozens of media outlets re-posted information about the original shooting in combination with memorials. Columbia epidemiologist Dr. Madelyn Gould researches suicide contagion, and the impact of reporting on suicide on others. After the recent Parkland and Sandy Hook suicides, she warns that these first

Each of us needs time and space to fully feel what is unique to our evolving emotional and psychological journeys, and trying to rush to some imagined "finish line" will be more elusive than recovering the holy grail.

Though the $25 billion redevelopment has billed itself as the city’s new retail destination, Public Advocate Jumaane Williams is no fan.

At a press conference on Tues., Apr. 16th, Williams noted that several eateries and stores at the Hudson Yards complex do not accept cash, which he said discriminates against the 12 percent of New York City residents who are unbanked and 25 percent that are underbanked.

Though the gargantuan residential, office and retail complex on Manhattan’s West Side opened to great fanfare on March 15, Williams is denouncing its inclusion of cashless businesses and accusing its developers of exploiting a visa program intended to help distressed neighborhoods.

The cash-free businesses “are rubbing salt in the wounds to a project that we all knew was not for the majority of this city to begin with,” Williams said, remarking that many Hudson Yards stores are luxury retail shops that many New Yorkers cannot afford.

He expressed strong support for pending City Council legislation

sponsored by Bronx Councilmember Ritchie Torres that would ban cashless businesses in the city.

Known as Intro 1281, the bill would prohibit retail and food establishments from adopting policies in which they refuse to accept payment in cash from consumers.

On February 14, the Committee on Consumer Affairs held a hearing on the bill, which features 19 co-sponsors.

“A cashless business model is a discriminatory model that excludes the unbanked and people without access to credit,” Torres said at the hearing.

Williams said that cashless businesses are sending an “unacceptable message” that a percentage of New Yorkers are not welcome to shop or eat there.

“We are seeing a substantial increase in fare evasion, which means the MTA is making

including placing extra staff at stations to thwart turnstile jumpers and reinforcing entry doors to prevent riders from slipping through.

“There’s a concern about over-criminalizing people who evade the tolls,” he said. “At the same time, you can’t have a voluntary transit system.”

“If we have more people refusing to pay to get on the train,” said David, “we have less funding dedicated to the trains, so we have to address this problem in some way.”

Applebaum noted that many RWDSU members, including Assistant to the President Jessica García, who is of Honduran heritage, come from the Northern Triangle.

“They are worried every day,” he remarked. “They’re worried about themselves, they’re worried about their families.”

“We need to raise awareness of what it is that is really going on and why people are leaving their homes despite knowing all the risks they’re going to be facing,” said Applebaum, who highlighted that the trip would take place during important religious holidays.

“Passover was the story of a migration of people from their homes leaving in desperation,” he noted. “What happened so long ago should resonate with all of us in terms of what is happening today.”

Members of the delegation announced their mission during a press conference in lower Manhattan on April 11, following

a visit with immigrant families and unaccompanied minors being cared for by Catholic Charities.

Also in attendance were Cardinal Timothy Dolan and City Council Speaker Corey Johnson.

“I’m proud and grateful of being a citizen of this state because I realize the legacy of New York State in welcoming immigrants,” Dolan said.

Officials said that child separations are still happening at the border, despite a mandate in June 2018 by a federal judge that the Trump administration stop the practice.

“The zero tolerance policy was suspended, but the separation of children from parents still happens if ICE says

they think the parent is a security threat,” said Mario Russell, Director of Immigrant and Refugee Services for Catholic Charities.

An investigation by the legal nonprofit

Texas Civil Rights Project (TCRP) screened over 9,000 adults prosecuted for illegal entry at the border between June and December of 2018, and discovered 272 instances of family separation.

According to TCRP, children are often not traveling their parents but are separated from aunts and uncles, siblings, grandparents or cousins.

For separated or unaccompanied children brought to New York City, Catholic Charities provides legal assistance, and healthcare and other social services.

Russell said that kids are connected with toys, games and comfort pets to help ease their stress. The children may be staying with a foster family, but will visit Catholic Charities for services.

“If kids come to a place for a couple of hours a week where they feel safe, these are things that help keep them on track,” he said.

Russell said while the projection of 8,000 children was a new high, it was largely due to the restructuring of facilities and beds by the Office of Refugee Resettlement (ORR), the office created within the Department of

4. Collective trauma. After a mass shooting, trauma manifests not only individually, but also collectively, as the community grieves together. In the case of collective trauma, not only are we united in our exposure to the traumatic event, but we share a common psychological experience in the aftermath. Such is the case for veterans who battled together and survivors of the Holocaust, for example. Collective trauma is evident among survivors of the terrorist attacks of 9/11. More than five years later, 4 of 10 people described full-scale complicated grief, and 3 of 10 reported suicidal ideation. In the case of mass shootings, survivors are at great risk for mental health difficulties, with those

most directly exposed to the shooting most likely to develop depression, anxiety and post-traumatic stress disorder.

5. How to help. Recognizing that trauma has a long shadow is the first step. Perhaps in our "hurry-up" world, these most recent deaths remind us that community supports matter not only in the immediate aftermath of traumatic events but also for individuals who continue to suffer over time.

The Public Advocate also complained that the Hudson Yards project raised $1.2 billion of its financing through a visa program known as EB-5, which allows foreign investors in a real estate project to purchase visas for their families.

“The state is using low income people in order to fund a playground for the wealthy,” charged Williams.

Congress created the EB-5 program in 1990 to stimulate the U.S. economy through job creation and capital investment by foreign investors.

Investors must contribute between $500,000 and $1 million into a project to be eligible, reported the urban city newsletter CityLab.com, making it a favorite for wealthy families abroad.

In order to qualify for the EB-5 financing, a development project must reside within a Targeted Employment Area (TEA) that meets certain unemployment levels.

The map that New York State’s Empire State Development (ESD) used to qualify Hudson Yards for EB-5 financing goes up the West Side of Manhattan and includes Central Park and Harlem. Inclusion of public housing facilities in the TEA provided a higher unemployment rate for Hudson Yards to qualify for another $1.2 billion in financing.

“They created a gerrymandered district that goes all the way up to 110th Street to include New York City Housing Authority (NYCHA) houses so that rich people who live in other countries can purchase visas to get their families here,” stated Williams, who lamented that none of the financing would assist public housing families.

“So quite literally, this project was built on the backs of people who need the most help,” he remarked. “This is astonishing.”

Williams questioned if any of the jobs at Hudson Yards even went to NYCHA residents.

“Even if they are employed here, they probably can’t afford to shop here. And if they go to lunch, they’d better not have cash,” he said.

Visa also recently announced a partnership with Hudson Yards, calling itself a “driving force behind the dream of a cashless future for everyone, everywhere.”

The company announced it was “the official payment technology partner” of the complex, and said it “plans to develop programs to pilot and promote unique, ‘only at’ payments experiences for cardholders on the property.”

In a statement, a spokesperson for Hudson Yards said that the project’s use of the EB-5 program was done by the rules.

“We utilized a program set up by the federal government and followed the applicable rules,” the statement said. “By utilizing the EB-5 program we were able to finance the critical infrastructure for the project, the platform, where traditional financing was all but non-existent in the post-recession marketplace.”

Williams called on the state to reconsider standards for redrawing districts related to EB-5.

“I’m definitely calling on the state to review this, because this makes no sense. This shouldn’t be allowed,” he said.

“It is quite clear that this project was not of the majority of this city. To the extent that it’s beautiful and can help with tourism, it’s awesome,” Williams stated. “But we can’t do it on the back of New York City people who are fighting for housing, trying to buy food to eat.”
