Right-of-Way (ROW) Access: The subject property has frontage and ROW access along SE 20th Place. Background: The subject property has an area of approximately 10,600 ft2 and is located along SE 20th Place in southeastern Cape Coral. The site accommodates a single-family home that has a living area of 2,651 ft2. The property is located in Block 5370, where a majority of parcels are built-out with single-family homes. The property abuts the Heddon canal to the east; overall the property has approximately 90 feet of canal frontage. A former boat tram is located across the canal from the subject property, which reduces the width of the canal from approximately 150’ to 80’ across from the subject property’s canal waterfrontage. Based on aerial data from the City’s GIS, 18 of 23 residential properties with frontage on the Heddon Canal within ¼ mile of the subject property support a water dependent structure. It should be noted that no deviations for a second boat canopy have been sought by any property owner within 500 ft. of the subject property. The proposed canopy to be installed would have the dimensions of 26 ft. in length and 16.5 ft. in width, which are well within the maximum dimensional limits for boat canopies. The existing boat canopy, which is in the process of replacement, is 30 ft. in length, 11.5’ in height, and 17 ft. in width. Applicable Regulations: LDR, Section 3.16.2.E.6 states “No more than one boat canopy shall be located on a marine improvement that project from a single-family residential use at any given time unless the Board of Zoning Adjustment and Appeals approves a deviation to allow one additional boat canopy to be permitted pursuant to § 3.16.9.”

Analysis: The Planning Division has reviewed this application based on LDR, Section 3.16 which provides guidance in evaluating deviation requests associated with marine improvements. LDR, Section 3.16.9.C.1 states that “a deviation from the limitation that no more than one boat canopy shall be located on a marine improvement … may be approved by the Board of Zoning Adjustment and Appeals provided that such deviation will not be contrary to the public interest and will be in harmony with the general intent and purpose of this section.” This section further states that the Board shall consider factors such as whether the applicant has a present need to cover more than one boat that could not be protected from the elements unless a second boat canopy were to be permitted, the design, size, and proposed location of the second canopy, and the effect of such second boat canopy on the waterway in which it is proposed to be located and on the use and enjoyment of surrounding properties. The applicant currently has a present need to cover an additional boat as the applicant owns two marine vessels. It is reasonable to think that the ordinance would never permit a second boat canopy if a boat or mooring cover is a solution for every boat owner; however, the appearance of a wrap-around dock for the second canopy makes the placement of such a cover relatively feasible, and as a result, a solution for the applicant. According to the letter of intent, the deviation for the second boat canopy is sought in order to protect a second boat from sun and environmental damage. The applicant states in the letter of intent the wish to protect the gelcoat, upholstery, canvas, and electronics of the marine vessel. This second canopy is proposed to be located on the northern end of the water-dependent structure, on a boat lift which is perpendicular to the seawall, where the canal width is approximately 150 feet. The canal narrows from 150 feet to 80 feet due to the location of a former boat tram across the canal; while the property across the canal is too small to permit residential development, the property is operated by the City’s Parks and Recreation Department as part of Four Mile Cove Eco Park and as a result, there may be an ability to provide marine improvements on the other side of the canal. It may be prudent to restrict the property from receiving an additional canopy for the purposes of reducing “clutter” at the mouth of the narrowing canal, and to also reduce obstructions to views for safety reasons. The enjoyment of surrounding properties may be reduced by the restriction on views from the proposed canopy. There are concerns about the impacts of canal views between the perpendicular nature of the second boat canopy and narrowing of the canal width. While staff finds that the applicant has adequately demonstrated a need for a second boat canopy based on the criteria within Section 3.16, the impacts on canal views that is exacerbated by the narrowing canal provides a negative impact upon the community far in excess to the benefit provided to the applicant. Furthermore, the applicant has means of relief due to the wrap-around nature of the dock.

Recommendation: To conclude, the size of the boat to be covered and the appearance of a wrap-around dock make it apparent that a boat or mooring cover would suffice for the purposes of boat protection, thus not requiring a second boat canopy. Furthermore, the perpendicular orientation (to the seawall) of the canopy and boat lift, in addition to the narrowing of the canal, results in a blocking of canal views from the north, and potential safety issues may arise as a result. Based on the above analysis, the information provided in the application, and the physical condition of the property, Planning Staff finds that the requested deviation pursuant to a second boat canopy will be contrary to the public interest. The purpose of this request is to obtain a deviation for a second Boat Lift Canopy to be installed on the Marine Improvement Area as specified in Section 3.16.N.l of the City of Cape Coral Land Use and Development regulation. This canopy would be 26 ft. in length and 16 ft.6 in.in width which is well within the size restrictions for the City Of Cape Coral.
My dock has two boat lifts and two boats. I'm having a canopy installed on one lift and I'm requesting that you allow me to have a canopy installed on the second one. This canopy will not give me special privileges and will not affect navigation. I have made a huge investment in my boats and I would like to protect both of them from the damage that the sun and elements does to the gelcoat, upholstery, canvas and electronics.
