In June 2010 home secretary Theresa May announced the scaling back of the Criminal Records Bureau (CRB) regime ‘to common sense levels’. The government’s Protection of Freedoms Bill limits obligatory CRB checks to those working frequently or intensively with children, in an unsupervised capacity.
Yet this significant shift in government policy has had a negligible effect on vetting practice on the ground. As the table below illustrates, there were in total over four million CRB checks in 2011. Worse, many of these CRB checks are being carried out by, or demanded by, state-funded bodies, including Ofsted, Sport England, and local authorities.

At a time when the Protection of Freedoms Bill is in its final stages – abolishing the vetting database and limiting the number of people to be vetted – many state agencies are continuing with an over-cautious approach.
This report exposes over-vetting by local authorities, who collectively are responsible for nearly a million CRB checks a year, a quarter of the total.
Our FOI requests to the highest checking authorities reveal that these CRB checks are being carried out for a broad range of positions, including: parent volunteers, arboreal assistants, burger van sellers, art therapists, countryside wardens, sewage pump engineers and foreign exchange hosts.
We will be submitting this data to the CRB, calling on it to investigate these authorities’ vetting practice.
total local authority CrBs
607 local authority bodies have processed CRB checks at some point since 2004: these registered bodies include county, city and borough councils, and also specific local authority departments. These 607 bodies have together carried out 6,058,470 CRB checks.
In the most recent year of complete statistics, 2010–11, 490 local author-ity registered bodies in England and Wales1 carried out 942,329 CRB checks, 24% of which were on volunteers.2
In total, there has been a 51% increase in local authority checks since 2004–5, when there were 627,197 CRB checks.
In 2010–11, the highest checking councils were Hertfordshire (21,680 checks), Essex (21,610) and Devon (20,095 checks) county councils. Several others – including Birmingham, North Yorkshire and Lancashire – carried out over 15,000 CRB checks (see Appendix for a full breakdown).
Some of these councils are checking thousands of volunteers. In 2010–11, Devon checked 6062 volunteers, and Hertfordshire checked 7737.1 Scottish local authorities carry out CRB checks with Disclosure Scotland, not the CRB2 These registered bodies do not correspond to individual local authorities, since one
local authority could represent one, several or no registered bodies. A registered body is an organisation with authority to process CRB checks. In addition, some of these local authorities are umbrella bodies, meaning that they also have authority to process CRB checks on behalf of external individuals or organisations, for example, contractors who work in schools or local authority buildings.

The shift in government vetting policy has had some effect on local author-ity practice: 2010–11 CRB check figures were lower than the all-time high of 1,136,947 checks in 2009–10.
Yet current levels remain far too high, and our research suggests that un-necessary and illegal checking continues at a significant level within local authorities.
Provisional figures for the calendar year 2011 suggest little change in CRB check levels. Indeed, some local authorities are slightly increasing CRB checks: Essex County Council carried out 21,811 checks in the calendar year 2011, compared to 21,610 in the financial year 2010–11.3
the Cost of local authority CrBs
For the period covered by this data, the CRB charged £36 for a CRB check;4 in addition to which there are administration costs of around £20 per check.
Volunteers are not charged by the CRB for checks: instead, the cost of their check is borne by other, fee-paying CRB checks. The ‘real cost’ of each CRB check is therefore around £27 per check;5 plus the £20 admin fee, therefore £47.
The total cost of local authority CRB checks since 2004 is therefore £284,748,090.6

We sent FOI requests to the 15 highest checking authorities, asking for the job titles for which they had processed CRB checks in the previous year. The results are summarised below.
Schools
Current government guidance recommends CRB checks for anyone who has unsupervised, intensive contact with children. Yet we found that many local authorities are checking, not only teachers and others with immediate responsibility for pupils, but also occasional volunteers such as reading buddies or storytellers, and contractors who do not work at all with children.
One of the largest portions of CRBs is carried out on parent and grand-parent volunteers in schools. Most of these volunteers are listening to chil-dren reading, helping out on school trips, and walking children to school, and indeed these essential activities could not continue without their help. Parent volunteers also help out with gardening clubs, school discos, and host students on foreign exchange visits.
In general these are informal roles, carried out by children’s parents or grandparents under the supervision of teachers, or else in private ar-rangements in the home. Therefore, these checks are burdensome and unnecessary.

— Councils checking host families for foreign exchanges included Bristol City Council, hertfordshire County Council, north yorkshire County Council, devon County Council and essex County Council.8
— Bristol City Council checked hundreds of parent volunteers in schools, including: 144 governor/parent helpers, 196 parent helpers, 120 parent volunteers and 169 reading buddies.9
— out of 672 volunteer job positions checked by hertfordshire County Council, a quarter were for parents or grandparents, includ-ing a parent helper for the school disco, and a volunteer father Christmas.10
Many local authorities also check any contractor who works at all in schools or old people’s homes.
— north yorkshire County Council checks lift engineers, sewage pump engineers, and asbestos monitors who may visit schools, old people’s homes or care homes.11
— Bolton Council says that it ‘requires all contractors working within settings where vulnerable groups are present to have an enhanced CrB check in place.’12
One director of a company that installs renewable energy systems, based in south-west England, says that he is generally asked for CRB checks for work in schools. He describes this as a ‘stealth tax’:
‘We do not work with children. We do not talk to them. We prefer to work during school holidays and half terms. this is a stealth tax on doing business.’13
Many local authorities are also checking occasional visitors to schools, including storytellers (including Devon and Durham county councils),

and entertainers (including Essex). Hertfordshire County Council checks vicars who visit schools.14 This is clearly a contentious issue: after several children’s authors refused to undergo CRB checks, government officials gave assurances that occasional visitors to schools would not have to be checked.
Public Services
Many councils also check workers or volunteers who have general public service roles, which the council estimates would provide the individual with ‘opportunity for contact with vulnerable groups’.
Those being checked include employees in public parks, including tree surgeons and arborists, park rangers, wildlife volunteers and countryside wardens. It also includes people who work in archives and the historic en-vironment, as well as beach cleaners and public rights of way inspectors.
— Swale Borough Council in kent carries out CrB checks on people including beach cleaners and park rangers, on the basis that they may ‘come into contact with children’.15
— Warwickshire County Council checks tree surgeons (arborists), archives and historic environment managers.16
— hampshire County Council checks countryside rangers, social history demonstrators, and frontline administrative and reception staff in the countryside service.17
— the london Borough of Bromley checks: arboricultural officers, countryside managers, countryside officers, countryside team administrative assistants, and volunteer conservation assistants.18

Many local authorities check employees of public libraries and mobile libraries, as well as people who work in leisure centres, including leisure centre managers and swimming pool attendants.
— essex County Council checks mobile library supervisors; while gloucester Country Council checks library volunteers, library man-agers, and library customer assistants.
— Cheshire Council checks pool attendants and first aiders, as does derbyshire County Council; while Warwickshire County Council checks assistant swimming pool managers and leisure centre as-sistants, as well as breathing apparatus instructors and swimming pool caretakers.19
Local authorities also CRB check businesses who have potential ‘contact with children’.
East Riding Council requires mobile street traders to be CRB checked, including ice cream vans and burger vans. One burger van seller, who trades off a busy lay-by unlikely to be frequented by solitary children, com-plains about having to complete his second CRB check in a year:
‘it’s bureaucracy gone mad. i think it is just basically another money-making scheme to justify people’s jobs. if we get a child [at the burger van], which is rarely, they are usually in the arms of their mum or dad.’ 20
Looking at local authority job adverts, a large proportion of general public service positions require CRB checks. For example, Camden Council’s recent advert for a ‘passenger services manager’ stated that ‘this is a safeguarding position and is subject to an enhanced Criminal Records Bureau check’.21

Social Care
Local authorities are also being over-cautious about checking those involved in social care. When a child is placed in foster care, it is common practice to check not only the foster carer, but also the carers’ children (even if they are under 18), as well as friends or other visitors to the home. When a child is being looking after by an aunt or other relative, members of that relative’s family will also be checked.
— hertfordshire County Council checked the ‘daughter of a foster carer’; as well as ‘daughter of kinship carer’ and ‘family members of kinship carer’.22
— north yorkshire County Council checked ‘mother of foster carer’, ‘daughter of foster carer’; while gloucestershire County Council checked several ‘babysitter of fostered child’.
Similarly, when recipients of social care appoint a personal assistant (PA) to help them with their care, the assistant is often CRB checked, even if they are family member or a close friend. Sandwell Council advises recipi-ents of social care:
‘We recommend a CrB (Criminal records Bureau) check is com-pleted and we will ask your Pa to attend one of our Safeguarding adults training course… you should not employ anyone who says they don’t want a CrB check or doesn’t need one, or a person who says they have had one but cannot show you their certificate’.23

Many local authorities also check anybody with access to information about children or other vulnerable groups – a category that includes large numbers of administrators and managers, who rarely meet members of the public as part of their work.

— hertfordshire County Council checks: benefits interviewers, data inputters, data managers, data officers.24
— essex County Council checks: quality and development officers, trading standards officers.25
— hampshire County Council checks all workers in it services with access to information about adult service users, or children’s edu-cation records.26
health/Wellbeing/Community
Another category of over-cautious CRB checking involves those who have a caring or community role.
This includes those who work in art or music therapy; massage; volunteers on cycle rides or walks; mentors, mediators, personal assistants, disagree-ment resolution officers, empowerment officers; self-protection or fitness officers.
Any job or volunteer with ‘community’ in the title also qualifies, including community safety coordinators, community development officers, and so on. Volunteers or workers with specific communities, such as a mosque development workers, are also CRB checked.
— hertfordshire County Council checks: ‘breastfeeding counsellor’, ‘empowerment coach’, enrichment leader’, ‘person centred planner’, ‘self-protection instructor’, ‘zumba instructor’, ‘life coach’.27 it also checks artists in residence and art therapists, baby massage and antenatal class teachers.

— derbyshire County Council checks: ‘access officer’, ‘achievement coordinator’, ‘art therapist’, ‘fitness and self-protection [worker]’, ‘refugee advice support worker’.29
— durham County Council checks smoking cessation volunteers, volunteers on cycle rides and walks, and volunteers at a garden group.30
— north yorkshire County Council checks: ‘breastfeeding peer mentor volunteer’, and ‘breastfeeding peer supporter volunteer’.31
— Sheffield City Council checks ‘community support assistant’, and ‘antenatal peer support worker’.32
Public Performers
Finally, some local authorities check public performers, even those per-forming for adult audiences.
Hertfordshire County Council checks ‘life models’, presumably for nude art classes. It also carried out checks on disc jockeys and actors.33
Caerphilly County Borough Council demanded that authors and perform-ers be CRB checked before getting up on stage in front of an adult audi-ence.34 The council only backed down after protests from the speakers.
In another incident, a 16-year-old Bath comedian was told by his local council that adults at the venues he performed had to be CRB checked. The council contacted him after seeing an article in the local paper,35 as he reported on a comedy forum:

that i will not be able to perform comedy until 1st July next year without the person running the gig applying for a license 3 months before the gigs and loads of checks being done on them.’ 36
This shows that local authority departments are not just carrying out CRB checks on their own workers, but also taking a proactive approach to demand them of others – even those without local authority contracts.
This was also the case for councils demanding checks on mobile traders such as burger vans: in one case, the request was initiated by the coun-cil’s public services and protection department.

Our research indicates that local authorities are carrying out many unnecessary CRB checks. Indeed, it is likely that these checks are illegal, under the Rehabilitation of Offenders Act 1974, which limits requests for criminal records information.
We will therefore be submitting our data to the Criminal Records Bureau, in order that they can investigate local authority bodies on the charge of over-checking.
We call on the government to make a firm statement about unnecessary checks. We also call for inde-pendent procedures for investigating over-checking authorities – and penalties for unnecessary checks, as recommended in Sunita Mason’s review of the criminal records regime.37
