Page 1 of 60 CHARTER OF THE CITY OF ALBUQUERQUE PREAMBLE We, the people of the City of Albuquerque, under the law of the State of New Mexico, do ordain and establish this form of government for the City of Albuquerque, New Mexico. (Adopted at Special Election, June 29, 1971.) ARTICLE I. INCORPORATION AND POWERS The municipal corporation now existing and known as the City of Albuquerque shall remain and continue to be a body corporate and may exercise all legislative powers and perform all functions not expressly denied by general law or charter. Unless otherwise provided in this Charter, the power of the city to legislate is permissive and not mandatory. If the city does not legislate, it may nevertheless act in the manner provided by law. The purpose of this Charter is to provide for maximum local self government. A liberal construction shall be given to the powers granted by this Charter. (Adopted at Special Election, June 29, 1971.) ARTICLE II. ELECTIONS Section 1. ELECTION DATES. The Councillors representing evennumbered Districts shall be elected by the voters to four year terms at the regular municipal election held on October 7, 1975. The Mayor and the Councillors representing oddnumbered Districts shall be elected by the voters to fouryear terms at the regular municipal election held on October 4, 1977. Thereafter, regular municipal elections shall be held on the first Tuesday after the first Monday in October of oddnumbered years. Section 2. REFERENCE TO STATE LAW. (a) The Municipal Election Code, Chapter 3, Articles 8 and 9, NMSA 1978, as amended and as supplemented from time to time, shall govern the conduct of all aspects of municipal elections, except where inconsistent with the terms of this Charter, in which event this Charter shall control. (b) Any ordinance adopted subsequent to the effective date of this Section by a majority of the entire membership of the Council plus two additional members thereof voting in favor of such ordinance, and said ordinance being otherwise governed by Article XI of this Charter,

    ARTICLEII. ELECTIONS

    Section1. ELECTIONDATES.

    TheCouncillorsrepresentingevennumberedDistrictsshallbeelectedbythevoterstofouryeartermsattheregularmunicipalelectionheldonOctober7,1975. TheMayorandtheCouncillorsrepresentingoddnumberedDistrictsshallbeelectedbythevoterstofouryeartermsattheregularmunicipalelectionheldonOctober4,1977. Thereafter,regularmunicipalelectionsshallbeheldonthefirstTuesdayafterthefirstMondayinOctoberofoddnumberedyears.

    Section2. REFERENCETO STATELAW.

    (a) TheMunicipalElectionCode,Chapter3,Articles8and9,NMSA1978,asamendedandassupplementedfromtimetotime,shallgoverntheconductofallaspectsofmunicipalelections,exceptwhereinconsistentwiththetermsofthisCharter,inwhicheventthisChartershallcontrol.

    (b) AnyordinanceadoptedsubsequenttotheeffectivedateofthisSectionbyamajorityoftheentiremembershipoftheCouncilplustwoadditionalmembersthereofvotinginfavorofsuchordinance,andsaidordinancebeingotherwisegovernedbyArticleXIofthisCharter,

    whichordinanceexpresslyprovidesthatitistotakeprecedenceovertheMunicipal ElectionCode,shalltakeprecedenceoversuchCodeexceptwheresuchordinanceisinconsistentwiththetermsofthisCharter,inwhicheventthisChartershallcontrol.

    Section3. QUALIFICATIONSFORMAYORANDCOUNCILLORS.

    PersonsdesiringtobecomecandidatesforMayorshall,beforebeingplacedontheballot,filewiththeCityClerkapetitioncontainingsignaturesoftwopercent(2%)ofregisteredcityvoters.PersonsdesiringtobecomecandidatesforDistrictCouncillorshall,beforebeingplacedontheballot,filewiththeCityClerkapetitioncontainingsignaturesoftwopercent(2%)oftheregisteredvotersresidinginthedistrictwhichthepersondesirestorepresent.Thenumberofregisteredvotersshallbedeterminedasofthedatepetitionsmaybegintobecirculated.(AmendedataSpecialElectionheldinconjunctionwith aRegularMunicipalElection,October5,1999,asQuestion#3.)

    Section4. DESIGNATIONOFCANDIDATES.

    Theballotsshallbeprintedbythecityandshallcontainthenamesofthecandidateswithoutpartyorotherdesignation.Incityelections,paperballotsmaybeusedexclusivelyiffoundmoreexpedientordesirable.Wherevotingmachinesareused,anyreferencestoballotswillapplyequallytovotingmachines.

    Section5. DEFINITION.

    Theterm"elector"or"voter"whenusedinthisChartermeansapersonwhoisaresidentofthecityandwhoisentitledtovoteforcandidatesformunicipalofficeinamunicipalelectionundertheConstitutionandstatutesofNewMexicoasamendedandsupplementedfromtimetotimeandwhoisregisteredpursuanttotheapplicablestatutesofNewMexicoasamendedandsupplementedfromtimetotimeorwhoisregisteredpursuanttoanyordinanceoftheCouncilwhichexpresslyprovidesthatitistotakeprecedenceoversuchstatutesandwhichisenactedaftertheeffectivedateofthisSection.

    Section6. FORTY PERCENTMINIMUMVOTE.

    ThosepersonswhoarecandidatesforMayororCouncillorandreceivethelargestnumberofvotescastfortheofficeinquestionareelected,providedthenumberofvotesequalsorexceeds40%ofthetotalnumberofvotescastfortheoffice.

    Section7. RUNOFFELECTIONS.

    (a) Ifnocandidatereceives40%ofthevotescastfortheparticularofficeinquestion,arunoffelectionshallbeheldwithinfortyfivedaysaftercertificationoftheresultsoftheelectioninquestionasnowprovidedbylawandasamendedandsupplementedfromtimetotime.UnlessotherwisespecifiedinthisCharter,thetwocandidateswhoreceivethehighestnumberof

    votescastfortheofficeinquestionshallautomaticallybecomethecandidatesattherunoffelectionandthefilingofdeclarationsofcandidacyisdispensedwith.

    (b) TheCouncilshallbyresolutionfixthedateoftherunoffelectionandspecifytheofficestobefilledandthenamesofthecandidatestherefor. Theresolutionshallbepublishedonce,atleastsevendaysbeforetherunoffelectiondate.Otherwise,nopublicationsarerequiredinconnectionwithrunoffelections.

    (c) Onlysuchvotingprecinctsandprocedureswillbereactivatedforarunoffaswillberequired,onacitywidebasisifofficialstobevotedonbytheentirecityelectorateareinvolved,otherwiseonlysuchDistrictCouncillordistrictsasmay beinvolved.

    (ArticleIIamendedatRegularMunicipalElection,October3,1989,aspartofProposition#1.)(TheSecondJudicialDistrictCourtoftheStateofNewMexico,inthecaseof Campbellv.Santillanes,CV9704851,declaredtheportionofSection6concerningtherequirementofobtaining40%ofthetotalvotescastandSection7concerningrunoffelectionsviolativeofArticleVII,Section5,oftheNewMexicoConstitution. Thisrulingwasnotappealed.)

    ARTICLEIII. RECALLELECTIONS,REFERENDAANDDIRECTLEGISLATION

    Section1. RECALL.

    (a) Anyelectiveofficerofthecityshallbesubjecttoarecallelectionatanytime,exceptashereinafterprovided. Arecall maybeinitiatedbythefollowingprocedures:

    1. NoticeofintenttocirculateapetitionforrecallmustbesignedbyfivequalifiedvotersandfiledwiththeCityClerk

    2. Thenumberofqualifiedvotersrequiredtosignthepetitionshallbeanumbermorethan25%ofthetotalnumberofvotescastattheelectionoftheofficerwhoserecallisproposed

    3. Beforeanysignaturesareaffixedthereon,theformofsuchpetitionmustbeapprovedbytheCityClerkasprovidedbylawandthedateoffilingthenoticeofintentshownthereon

    4. Nosuchpetition,oranypartthereof,maybefiledmorethansixtydaysafterthedateoffilingthenoticeofintent

    5. Theelectionmustbeheldwithinninetydaysafterthedateoffilingthepetition.

    (b) Atsuchelection,thereshallbeaspecialballotcontainingthenameoftheofficer,thepositionwhichtheofficerholds,andthedatesofthebeginningandterminationoftheofficialterm. Belowthenameoftheofficershallbethetwophrases"FortheRecall"and"AgainsttheRecall",onebelowtheother,withaspaceaftereachfortheplacingofacrossoracheckwheredesired.

    (c) Ifamajorityoftheballotsandanumberequaltoamajorityoftheballotscastattheelectionoftheofficerwhoserecallisproposed,showavotefortherecall,theofficeinquestionshallbethenceforthvacant.

    (d) Ifanofficerisrecalledasprovidedforabove,theofficershallnotbeeligibleforreelectionuntilthetermforwhichtheofficerwasoriginallyelectedshallhaveexpired.

    (e) Ifarecallelectionresultsinafailuretosecureamajorityofvotesinfavoroftherecall,theofficerinquestionshallnotagainbesubjectedtorecalluntilaftertheexpirationofsixmonthsfromthetimeatwhichthefirstrecallelectionwasheld.

    (f) VacanciescreatedbyarecallelectionshallbefilledinthesamemannerasisprovidedforthefillingofvacanciesintheofficeofCouncillororMayorduetoothercausesprovided,thatifalltheCouncillorsarerecalledatoneelection,theCityClerk,oriftherebenoCityClerk,theJudgeoftheDistrictCourtoftheCountyofBernalillo,shallwithinthreedayscallanelectiontobeheldinaccordancewiththeprovisionsspecifiedinthisCharterfortheelectionofCouncillorsatregularelections.

    (g) WhenaCouncillorissubjectedtorecallproceedings,onlyvotersregisteredasresidingintheDistrictwhichtheCouncillorrepresentsmayparticipate,signpetitionsandvoteintherecallproceedings.

    Section2. REFERENDUM.

    (a) Exceptasprovidedin(d)ofthisSection,anyordinancemaybesubjecttoareferendumonsuchordinanceasfollows:

    1. Ifsuchordinanceisnotanemergencymeasure,thefilingofsuchpetitionshallsuspendtheeffectivedateoftheordinanceuntilanelectionshallhavebeenheldaspetitioned. Ifsuchordinanceisanemergencymeasure,itshallgointoeffectatonce,subjecttorepealbyanadversemajorityattheelection.

    2. Thenumberofqualifiedvotersrequiredtosignthepetitionshallbeanumbermorethan20%oftheaveragenumberofvoterswhovotedatthefourregularmunicipalelectionspriortopublicationoftheordinanceormorethan20%ofthenumberofvoterswhovotedattheregularmunicipalelectionpriortopublicationoftheordinance,whicheveristhegreater.

    3. Beforeanysignaturesareaffixedthereon,theformofsuchpetitionmustbeapprovedbytheCityClerkasprovidedbylaw.

    4. Nosuchpetitionoranypartthereof,maybefiledmorethanthirtyfivedaysafterpublicationoftheordinance.

    5. Anelectionon theissuemustbeheldwithinninetydaysafterthedateoffilingthepetition.

    (b) Atsuchelectiontheballotshallcontainthetextofthemeasureinquestionandbelowthesamethephrases:"FortheAboveMeasure"and"AgainsttheAboveMeasure"followedbyspacesformarkingwithacrossoracheckthephrasedesired.

    (c) Ifamajorityofthevotescastareagainstthemeasure,itshallbeofnoeffect. Ifamajorityofthevotescastbenotagainstthemeasure,itshallgointoeffectforthwith.

    (d) ThereferendumprocedureofthisSectionshallnotbeavailablefor:

    1. Anyordinanceauthorizingbondsorotherobligationswheresuchordinance,bondsorotherobligationsappropriatelyhavebeenapprovedatan electioninthecity

    2. Anyordinancelevyingorotherwiserelatingtospecialassessmentsor

    3. Anyordinancewhichimposes,levies,increasesorotherwiseamendsrates,tolls,feesandchargesforservicesrenderedbyanymunicipalutilityoranymunicipalrevenueproducingprojectifbondsorotherobligationspayablefromthedesignatedsourcearethenoutstanding.

    Section3. DIRECTLEGISLATIONBYVOTERINITIATIVE.

    (a) Exceptasprovidedin(d)ofthisSection,ameasuremaybeproposedtothegoverningbodyforenactmentasfollows:

    1. NoticeofintenttocirculateapetitionproposinganymeasuremustbesignedbyfivequalifiedvotersandfiledwiththeCityClerk

    2. Concurrentlywiththefilingofthenoticeofintent,theproposedmeasureshallbefiledwiththeCityClerk

    3. Thenumberofqualifiedvotersrequiredtosignthepetitionshallbeanumbermorethan20%oftheaveragenumberof voterswhovotedatthefourregularmunicipalelectionspriortofilingthenoticeofintentormorethan20%ofthenumberofvoterswhovotedattheregularmunicipalelectionpriortofilingthenoticeofintent,whicheverisgreater

    4. Beforeanysignaturesareaffixedthereon,theformofsuchpetitionmustbeapprovedbytheCityClerkasprovidedbylawandthedateoffilingthenoticeofintentshownthereon

    5. Nosuchpetitionoranypartthereof,maybefiledmorethansixtydaysafterthedateoffilingthenoticeofintent

    6. IftheCouncilfailstoactuponameasuresoproposedwithinfourteendaysaftertheCityClerkfilesacertificationwiththeCouncilthatthepetitionhasbeensignedbytherequirednumberofvoters,ortheCouncilactsadverselythereonoramendsitanelectionontheissuesmustbeheldwithinninetydaysafterthedateoffilingthepetition.

    (b) Atsuchelectiontheballotshallcontaintheproposedmeasureasoriginallysubmittedandthemeasureasamended,ifamendedbythegoverningbodyofthecity. Beloweachofthesemeasures,thereshallbeprintedthewords:"For"and"Against"followedbyspacesformarkingwithacrossorachecktheworddesired.

    (c) Themeasurereceivingamajorityofthevotescastonthatmeasureinitsfavorisadopted. Ifeachmeasurereceivesamajorityofvotescastonthatmeasureinitsfavor,themeasurereceivingthegreatestnumberofvotescastinitsfavorisadopted. Ifneithermeasurereceivesamajorityofthevotescast,neithershallbeineffect.

    (d) TheinitiativeprocedureofthisSectionshallnotbeavailabletoamendorrepeal,directlyorindirectly:

    1. Anyordinanceauthorizingbondsorotherobligationswheresuchordinance,bondsorotherobligationsappropriatelyhavebeenapprovedatanelectioninthecity

    2. Anyordinancelevyingorotherwiserelatingtospecialassessments

    3. Anyordinancewhichimposes,levies,increasesorotherwiseamendsanyexcisetaxpledgedtoanybondsorotherobligationsthenoutstanding

    4. Anyordinancewhichimposes,levies,increasesorotherwiseamendsrates,tolls,feesandchargesforservicesrenderedbyanymunicipalutilityoranymunicipalrevenueproducingprojectifbondsorotherobligationspayablefromthedesignatedsourcearethenoutstandingor

    5. Anyordinanceauthorizingorotherwiserelatingtoanycitybondsorother obligationsthenoutstanding.

    ARTICLEIV. COUNCIL

    Section1. AUTHORITYANDMEMBERSHIPOFTHECOUNCIL.

    ThelegislativeauthorityofthecityshallbevestedinagoverningbodywhichshallconstitutethelegislativebranchofthecityandshallbeknownasaCouncil,consistingofninemembersfromseparateCouncilDistricts,eachmembertobeknownasaCouncillor. EachoftheCouncilDistrictsshallelectoneCouncillor,whoshallbeaqualifiedvoteroftheDistrict.(AmendedatRegularMunicipalElection,October8,1991,asProposition#1AmendedataSpecialElectionheldinconjunctionwithaRegularMunicipalElection,October5,1999,asQuestion#7.)

    Section2. COUNCILDISTRICTS.

    (a) ThetotalareaofthecityshallbedividedintonineCouncilDistricts,numberedonetonineinclusive,andeachdistrictshallelectoneCouncillor. AnymemberoftheCouncil

    representingoneofthedistrictsshallbeelectedbytheregisteredqualifiedelectorsofthatdistrictonly.

    (b) Theboundaries,1980CensuspopulationandnumericaldesignationoftheCouncilDistrictsarespecifiedin AppendixAofthisCharterandshallremainineffectuntilalteredorchangedinaccordancewiththeprovisionssetforthinthisCharter.

    Section3. DISTRICTBOUNDARYREVISIONS.

    (a) AftereachFederalCensus,theCouncilshallappointacommitteecomposedofanequalnumberofrepresentativesfromeachCouncilDistrict,noneofwhomshallbeelectivecityofficers,toreviewandmakerecommendationsconcerningthenineCouncilDistricts. Inmakingsuchappointments,theCouncilshall,asnearlyasispracticable,providefairandbalancedrepresentationofallgeographicalareasoftheCityintheredistrictingprocessandprovideatotalmembershipthatreflectstheracial,ethnicandgendermakeupoftheCity'spopulation.Anyrecommendedchangeswillcomplywithconstitutionalprinciplesgoverningvotingrights,populationandsimilarrelatedproblemsasdeterminedbyjudicialdecisionfromtimetotime.ThedistrictboundariesmaybealteredbytheCouncilandMayoroncefollowingeachFederalCensus. Suchactionshallrequiretheapproval oftheMayorandshallnotconstituteanamendmenttotheCharter.

    (b) Thedistrictboundariesmaybealteredasnecessarytoincorporateareaswhichareannexedtothecity. SuchactionshallnotconstituteanamendmenttothisCharter.

    Section4. TERMSOFOFFICE.

    ThetermsoftheofficeofaCouncillor,unlesssoonerrecalledorremoved,shallbeginonDecember1stoftheyearofelectionandbefouryearsoruntilasuccessorisdulyelectedandqualified. TheCouncillorsmaysucceedthemselvesinoffice. ThetermsofofficeofCouncillorsshallbestaggeredwithfourorfivedistrictedCouncillorselectedeverytwoyears.

    Section5. COUNCILORGANIZATION.

    TheCouncilshallelectapresidentfromitsnumberandshalldetermineitsorderandprocedure.

    Section6. COMPENSATIONOFTHECOUNCIL.

    CouncillorsshallreceiveannualsalariesequaltoonetenthoftheannualsalaryreceivedbytheMayor. TheCouncilPresidentshallreceivedoubletheannualsalaryreceivedbyotherCouncillors.

    Section7. MEETINGSOFTHECOUNCIL.

    (a) TheCounciloranyofitscomponentcommitteesshallmeetasfrequentlyasitsbusinessmayrequire. TheCouncilshall establishregularCouncilmeetingtimesbyordinance. BetweenofficialCouncilmeetingstheCouncilshallformitselfintocommitteesforconsiderationofspecificareasofgovernment,usingcitizenshipparticipationincommitteeworkiffoundadvisable.

    (b) AllmeetingsofboththeCouncilandthecommitteesshallbeopentothepublicandduenoticethereofgiven. RecordsshallbekeptofallvotingbyeachCouncillorandcommitteemember. PublicityshallbegiventotheminutesofallmeetingsoftheCouncilandcommittees,andtheofficialrecordsofsuchmeetingsshallbeopentoinspectionatallconvenienttimes.

    Section8. COUNCILPOWERS.

    TheCouncilshallhavethepowertoadoptallordinances,resolutionsorotherlegislationconducivetothewelfareofthepeopleofthecityandnotinconsistentwiththisCharter,andtheCouncilshallnotperformanyexecutivefunctionsexceptthosefunctionsassignedtotheCouncilbythisCharter.

    Section9. VACANCIESINOFFICE.

    (a) A vacancyintheofficeofCouncilloroccursupontheCouncillor'sdeath,disability,recall,resignation,removalorterminationofresidencyinthedistrictrepresented.

    (b) IfavacancyoccursintheofficeofCouncillor,theMayorshallappointaregisteredqualifiedelectoroftheDistricttofillthevacancy. Anyoneappointedtofillavacancyshallserveuntilthenextregularelection,atwhichtimeapersonshallbeelectedtofilltheremainingunexpiredterm,ifany.

    Section10. COUNCILDUTIES.

    TheCouncilshall:

    (a) Bethejudgeoftheelectionandqualificationofitsmembers

    (b) Establishandadoptbyordinanceorresolutionfiveyeargoalsandoneyearobjectivesforthecity,whichgoalsandobjectivesshallbereviewandrevisedannuallybytheCouncil

    (c) ConsultwiththeMayor,seekadvicefromappropriatecommittees,commissionsandboards,andholdoneormorepublichearingsbeforeadoptingorrevisingthegoalsandobjectivesofthecity

    (d) Review,approveoramendandapproveallbudgetsofthecityandadoptpolicies,plans,programsandlegislationconsistentwiththegoalsandobjectivesestablishedbytheCouncil

    (e) Preserveameritsystembyordinance

    (f) HirethepersonnelnecessarytoenabletheCounciltoadequatelyperformitsduties

    (g) PerformotherdutiesnotinconsistentwithorasprovidedinthisCharterand

    (h) Faithfullyexecuteandcomplywithalllaws,ordinances,regulationsandresolutionsofthecityandalllawsoftheStateofNewMexicoandtheUnitedStatesofAmericawhichapplytothecity.

    Section11. DEFINITIONS.

    WheneverusedinthisCharter:

    (a) Theword"Commission"means"Council""Commissioner"and"DistrictCouncillor"mean"Councillor""Commissioners"means"Councillors".

    (b) "Quorum"meansamajorityoftheentireCouncil,committeeorotherbodyinvolved.

    (c) Themasculinetermrefersequallytothefeminine.

    Section12. OFFICEROREMPLOYEEOFACOUNTY.

    EffectiveDecember1,1993,noCouncillorshallbeanofficeroremployeeofanycountyoftheStateofNewMexicowhileinoffice,exceptapersonwhoonOctober3,1989,isbothaCouncillorandanofficeroremployeeofacountyoftheStateofNewMexicomaythereafterholdandbeelectedtotheofficeofCouncillorwhilesoemployed.

    Section13. TERMLIMITS.

    EffectiveJanuary1,1994,Councillorsmaynotservemorethantwoelectedterms.Councillorswhohaveservedmorethantwotermsonthatdatemayremaininofficeuntiltheirtermexpires.

    (Section13adoptedatSpecialMunicipalElection,January11,1994,asProposition#7. ThisSectionhasbeendeclaredunconstitutionalbytheNewMexicoCourtofAppealsonJuly18,1995. TheNewMexicoSupremeCourtdeniedcertiorariandthereforetheNewMexicoCourtofAppealsdecisiondeclaringthissectionunconstitutionalstands.)

    ARTICLEV. MAYOR

    Section1. ELECTIONOFTHEMAYOR.

    TheMayorshallbearegisteredqualifiedelectoronthedate offilingofthedeclarationofcandidacyfortheofficeofMayor. TheMayorshallbeelectedbytheregisteredqualifiedelectorsofthecity.

    Section2. MAYOR'STERMANDSALARY.

    ThetermofMayor,unlesssoonerrecalledorremoved,shallbeginonDecember1stoftheyearofelectionandshallbeforfouryearsoruntilasuccessorisdulyelectedandqualifiedafterhavingservedtwoconsecutiveterms,theincumbentMayorshallbeineligibletoholdofficeforfouryearsthereafter. Thesalaryshallbethirtyfourthousanddollarsperyear. TheCouncilmayapproveapercentageincreaseuptotheaveragepercentageincreaseprovidedforemployeesofthecity.

    Section3. POWERSPERFORMANCEAPPOINTMENTS.

    Theexecutivebranchofthecitygovernmentiscreated. Theoffice ofMayoriscreated. TheMayorshallcontrolanddirecttheexecutivebranch. TheMayorisauthorizedtodelegateexecutiveandadministrativepowerwithintheexecutivebranch. TheMayorshallbethechiefexecutiveofficerwithallexecutiveandadministrativepowersofthecityandtheofficialheadofthecityforallceremonialpurposes. TheMayorshalldevotefulltimeandattentiontotheperformanceofthedutiesofofficeandshallholdnootherpaidpublicorprivateemployment.

    Section4. DUTIESOFTHEMAYOR.

    TheMayorshall:

    (a) Organizetheexecutivebranchofthecity

    (b) Exerciseadministrativecontrolandsupervisionoverandhireorappointdirectorsofallcitydepartments,whichappointmentsshallnotrequiretheadviceorconsentoftheCouncilexceptasprovidedin(d)ofthisSection

    (c) Beresponsiblefortheadministrationandprotectionofthemeritsystem

    (d) WiththeadviceandconsentoftheCouncil,hireorappointtheCityAttorney,anofficertoadministerthemeritsystem,andallothersenioradministrativeorcabinetlevelofficersofthecity,includingwithoutlimitationanychief,assistantordeputyadministrativeofficers,andspecifythedutiesandresponsibilitiesofthoseofficers

    (e) WiththeadviceandconsentoftheCouncil,appointthemembersofallcitycommittees,commissionsandboards

    (f) Formulatethebudgetsofthecityconsistentwiththecity'sgoalsandobjectives,asprovidedinthisCharter

    (g) Establishandmaintainaprocedureforinvestigationandresolutionofcitizencomplaints

    (h) Prepareawrittenstateofthecityreportannually,withinthirtydaysafterfinalapprovaloftheoperatingbudgetofthecity,whichreportshallbefiledwiththeCityClerk,madeapartofthepermanentrecordsofthecityandavailabletothepublic

    (i) PerformotherdutiesnotinconsistentwithorasprovidedinthisCharterand

    (j) Faithfullyexecuteandcomplywithalllaws,ordinances,regulationsandresolutionsofthecityandalllawsoftheStateofNewMexicoandtheUnitedStatesofAmericawhichapplytothecity.

    Section5. VACANCYINTHEOFFICEOFMAYOR.

    (a) IftheMayorshalldie,resignorterminateresidenceintheCityofAlbuquerqueduringhistermofoffice,orberemovedfromoffice,theofficeoftheMayorshallbecomevacant.

    (b) Ifaregularelectionwilloccurwithinoneyearofthedateonwhichthevacancyoccurs,thePresidentoftheCouncilshallserveasMayorProTemuntilasuccessoriselectedandqualified. IfthePresidentoftheCouncilshalldeclinetoserve,theCouncilshallselectfromamongitsmembershipthepersontoserveasMayorProTemuntilasuccessoriselectedandqualified. IfthePresidentoftheCounciloranyCouncillorbecomesMayorProTem pursuanttothisSection,theMayorProTemshallceasetobeaCouncillorduringthetermasMayorProTemandtheseatontheCouncilshallbecomevacant. TheMayorProTemshallreceivethesamesalaryonaproratabasisasthatprovidedfortheformerMayor.

    (c) AvacancyintheofficeofMayorwhichoccursmorethanoneyearpriortothenextregularelectionshallbefilledfortheremainderoftheunexpiredtermbyaspecialelection.Duringtheinterimbetweenthedatetheofficeisvacatedandthedateofthespecialelection,theMayor'spositionshallbefilledbyaMayorProTemdeterminedbythesameprocedurespecifiedinSubparagraph(b)above. However,inthisevent,theMayorProTemshalltemporarilyceasetobeaCouncillorduringthetermasMayorProTemandtheseatontheCouncilshallremainvacantuntilreassumed. Likewise,inthiseventtheMayorProTemisexemptfromtheprovisionofSection3abovethattheMayorshallholdnootherpaidpublicorprivateemployment.     Thecityshallnotappropriatefundsforaperformingartscentercostingmorethanten(10)milliondollarswithoutpriorapprovalofamajorityofvotescastontheproposedperformingartscenterinamunicipalelection. Thecitymay,however,appropriatefundstostudy,toanalyzethefeasibilityof,andtoundertakepreliminarydesignofanysuchcenterpriortotheelectionrequiredbythissection.

    Section1. DECLARATIONOFPOLICY.

    Theproperadministrationofdemocraticgovernmentrequiresthatpublicofficialsbeindependent,impartial,andresponsibletothepeoplethatgovernmentdecisionsandpolicybemadeinthebestinterestofthepeople,thecommunityandthegovernmentandthatthepublichaveconfidenceintheintegrityofitsgovernment. Inrecognitionofthesegoals,thefollowingCodeofEthicsshallapplytoallofficialsofthecity.

    (a) BoardmeanstheBoardofEthicsandCampaignPracticesestablishedpursuanttoArticleXIIofthisCharter.

    (c) Candidatemeansanyindividualwhohas(1)obtainedanominatingpetitionfromtheCityClerkpursuanttoSection4(c)1.D.oftheElectionCodefortheofficeofMayororCouncillor,(2)filedanaffidavitonaformapprovedbytheCityClerk,statingthatheorsheisacandidateforeithertheofficeofMayororCityCouncilloror(3)filedasacandidateforelectedofficeasrequiredbylaw,whicheverfirstoccurs.

    (d) Considerationmeanssomethingofvalueorawrittenpromisetopayorotherwiseprovidesomethingofvaluewhichisenforceablethroughthecourts.

    (e) ContractwiththeCitymeansawrittencontractto(1)purchaserealpropertyfromthecity,(2)sellrealpropertytothecity,(3)rentrealorpersonalpropertytoorfromthecity,or(4)provideservicesand/orgoodstothecity. A contractwiththecityshallalsoincludeallsubdivisionimprovementagreementsfortheprivatedevelopmentofpublicinfrastructureandassociatedeasementsandrevocablepermits. Contractsexcludedfromthisdefinitionarethoseforservicesprovidedbythecitysuchaswater,wastewaterorsolidwastecollectionintergovernmentalagreementssuchasajointpowersagreementoramemorandumofunderstanding. PermitsandlicensesissuedbythecityshallnotbedeemedcontractswiththecityforpurposesoftheEthicsCode.

    (f) DirectInterest,PrivateInterestorPrivateFinancialInterestmeansaninterestconcerning(1)apartnership,limitedliabilitypartnership,orlimitedliabilitycompanyinwhichanofficialhasinvestedcapital orotherwiseownsaninterest(2)acorporationinwhichanofficialowns(i)tenpercent(10%)ormoreoftheoutstandingcapitalstockor(ii)capitalstockwithacumulativevalueof$25,000ormoreor(3)acorporation,partnership,limitedliabilitypartnership,orlimitedliabilitycompanyinwhichtheofficialisanofficer,director,oragent.DirectInterest,PrivateInterestorPrivateFinancialInterestdoesnotmeananinterestinstockownedindirectlythroughamutualfund,retirementplan,orothersimilarcommingledinvestmentvehicletheindividualinvestmentsofwhichtheOfficialdoesnotcontrolormanage.

    (j) Indirectinterestorindirectprivatefinancialinterestmeansanyinterestinwhichlegaltitleisheldbyanotherastrusteeorotherrepresentativecapacity,buttheequitableorbeneficialinterestisheldbytheofficialortheofficial'simmediatefamily. Indirectinterestshallincludeapecuniaryorcompetitiveadvantagethatexistsorcouldforeseeablyaccrueasaresultoftheactorinactionoftheofficial.

    Section3. BOARDOFETHICSANDCAMPAIGNPRACTICES.

    (a) TheBoardshallbemadeupofsevenmembers,whoshallbechosenasfollows: TheCouncilshallappointthreemembersandtheMayorshallappointthreemembers. ThesixmemberssoappointedshallselectaseventhpersontoserveasChairpersonoftheBoard.TheappointmentofaBoardmemberbyoneappointingauthorityshallnotbeapprovedordisapprovedbytheothertwoappointingauthorities.Eachmembershallbeaqualifiedelectorofthecity,andnomembershallbeanofficialoremployeeofthecityorthespouse,parentorchildofanofficialorcityemployee.ThereshallbeapubliccommentperiodforanyindividualproposedformembershipontheBoardofEthicsandCampaignPracticesbytheMayor,theCouncilandfortheseventhmemberselectedbytheBoard. Thenameandresumeofanyindividualproposedformembershipshallbepostedonthecity'swebsiteatleasttwoweekspriortothedatewhenfinalactionistakentoappointthatindividual. Anypersonshallbeallowedtosubmitcommentsabouttheproposedmemberbywrittensubmission,electronicallyorotherwise,totheCityClerk. ThemembersoftheBoardofEthicsandCampaignPracticesshallreceiveatleastsixhoursoftrainingpriortoactinginthecapacityofaBoardmember.     (c) NoviolationoftheCodeofEthicsshallbefoundbytheBoardofEthicsandCampaignPracticesexceptupontheconcurrenceofamajorityoftheBoard.

    (d) TheBoardshallhavetheauthoritytoissueadministrativesubpoenastocompelwitnessestotestifyandproducedocumentationbeforetheBoard. TheBoardmaypromulgaterulesandregulationsestablishingproceduresforissuanceofsubpoenas. TheBoardmayrequesttheCityAttorneytoenforcesuchsubpoenasinacourtofproperjurisdiction.

    (e) TheBoardmayissuetocandidatesandofficialsadvisoryopinionsconcerningtheCodeofEthicsandtheElectionCode.ArequestforanadvisoryopinionandtheopinionapprovedbytheBoardshallbecomepublicrecordsatthetimetheBoardvotesonsuchopinion. Advisoryopinionsshallonlyconcernprospectivematters.Specifically,noadvisoryopinionshallbeissuedwithrespecttoaneventthathasalreadyoccurred. Advisoryopinionsshallonlybeissuedwithrespecttoconductinwhichtherequestoroftheopinionintendstoengage. NoadvisoryopinionshallbegivenunlessapprovedbyfourmembersoftheBoard. Approvedopinionsshallbekept

    Section5. DISCLOSURE.

    (a) Anofficialofthecitywhoshallhaveanyprivatefinancialinterestinanycontractorothermatterpendingbeforeorwithinthegovernmentalbodyofwhichtheofficialisemployedorofwhichtheofficialisamember,shalldisclosesuchprivatefinancialinteresttothegovernmentalbody.

    (b) AnyCouncillorwhohasadirectorindirectinterestinanymatterpendingbeforetheCouncilshalldisclosesuchinterestontherecordsoftheCouncil.TheexistenceofadirectorindirectprivatefinancialinterestonanymattercomingbeforetheCouncil,includingapprovalofacontract,shalldisqualifyaCouncillorfromdebatingandvotingonthematter.     (c) TheMayorandeachCityCouncillor,duringtheirtermofoffice,shallfiledisclosurestatementsonJanuary15,April15,July15,andOctober15ofeachyearsettingoutallcontributionsandexpenditures,asdefinedintheCityElectionCode,duringthepreviousquarter,raisedorspentinconnectionwithanycampaignorprecampaignactivityforanyelectedoffice.ExpendituresofpublicfundsintheregularcourseoftheMayororCouncillor'sofficialdutiesarenotcontributionsandexpendituressubjecttosuchdisclosureunderthissection.TheMayorandCouncillorsarenotrequiredtofileaquarterlystatementiftherehavebeennocampaignorprecampaigncontributionsorexpendituresduringthepreviousquarterbyorfortheparticularMayororCouncillor.ThesereportingrequirementsshallbeinadditiontothereportingrequirementsoftheElectionCode,providedthatanyinformationfiledwiththeCityClerkpursuanttoCityCharterArticleXIII,Section4(c)neednotbeincludedin thesubsequentquarterlyreportsrequiredinthissection. ThecontributionsandexpendituresidentifiedinquarterlystatementsthataretobeappliedtoacampaignforelectiontoacityofficeshallbeincludedinthefirstcampaigndisclosurereportthatthecandidatefilespursuanttotheElectionCode.

    (d) AllelectedofficialsshallfilewiththeCityClerkanannualstatementlistingallofthechangesoradditionstothedisclosureinformationprovidedbytheelectedofficialatthetimeoffilinghisorherdeclarationofcandidacy,pursuanttoSection3oftheElectionCode.Ifnochangeshaveoccurred,theelectedofficialshallsostateintheannualstatement. Nocampaignactivitiesshallbeconductedinthoseportionsofcityfacilitiesthatarededicatedasworkareasforcityemployees.Officialsareprohibitedfromusinganymethodofcommunicationpaidforwithcityresources,includingbutnotlimitedtopublicserviceannouncements,signage,officialwebsitesormailduringthethreemonthspriortotheirelectiondate,ifsuchadvertisingstatesorimpliespersonalresponsibilityoftheofficialforanycityaccomplishment.     Noofficialshallparticipateinthefollowingtypesofpoliticalactivity:

    (A) Usinghisorherpositionoremploymentwith thecitytoinfluencesupportofemployeesofthecityfororagainstanycandidate,issueorMeasureFinanceCommitteeorothersimilarorganizationinanyelectionorpreelectionactivityprovided,however,thatnothinghereinshalldenytherightof anofficialofthecitytoexpresshisorherviewsonanyissue.

    (B) Acceptingand/orsolicitingcampaigncontributionsforanycandidateorMeasureFinanceCommitteeorothersimilarorganizationinanyelectionorpreelectionactivity,duringworkinghours,atacityworkplaceorinthescopeoftheircityemployment.

    (C) Acceptingand/orsolicitingcontributionsforthebenefitofacityemployeeorofficialforpoliticalpurposesduringworkinghours,atacityworkplaceorinthescopeofhisorhercityemployment.

    (D) Thissectionshallnotapplytoelectioneeringcommunications,providedthatnoelectioneeringcommunicationsmaybesenttoacityemployeeathisorherplaceofworkbyleafleting,mail,phone,emailorbyotherelectroniccommunication.

    (E) NoadverseemploymentactionshallbetakenagainstanyemployeeforreportingtotheBoardofEthicsandCampaignPracticesanyviolationofthissection,includingbutnotlimitedtodirectsolicitation.

    Section8.ENFORCEMENT[ VIOLATIONPENALTYREMOVALFROMOFFICEAPPEAL].

    (a) AnychargeofviolationsofthisCodeofEthicsshallbebroughtbeforetheBoardofEthicsandCampaignPractices. AnyprivatecitizenmayinitiatesuchachargeinaccordancewithregulationsestablishedbytheBoardofEthicsandCampaignPractices.

    (b) ShouldtheBoardfind,afterduehearing,thataviolationhasoccurred,itmaymakeapublicreprimandorimposeafineofnottoexceed$500foreachviolationordoboth.

    Section9. INVESTIGATION.

    (a) TheBoardmaychoosetoaskforaninvestigationofallegationsbroughtbeforeitratherthansimplyhearingchargestodothis,itmaytemporarilyemployorcontractwithinvestigatorsandrequireinvestigationbycitystaffassignedtotheBoardorbytheOfficeofInternalAuditandInvestigationsuponacceptanceofthecomplaintafterholdingapreliminaryhearing. TheBoardshalldirectandlimitthescopeandnatureofallsuchinvestigations. Incurredorreceivedbyacandidate, thecandidate'streasurer,theCandidateFinanceCommittee,oramemberthereofonbehalfofthecandidate,orbyaMeasureFinanceCommitteeoramemberthereofonbehalfoftheCommittee.ForthepurposesofthisSubsection,adebtorobligationshallbeconsideredincurredatthetimeauthorizationisgivenorcontractmadeforthedebtorobligation.

    Section4. CAMPAIGNFINANCING.

    (a) OneCandidateFinanceCommittee. EachcandidateshallestablishnomorethanoneCandidateFinanceCommitteeandshallappointatreasurerwhoshallnotbethecandidate.

    (b)OneBankAccount FilingRequirements.

    1. Eachcandidateorthecandidate'streasurerandeachMeasureFinanceCommitteeshallestablishoneandonlyonecampaignbankcheckingaccountforeachelection.All partieshavingsignatureauthorizationforthecheckingaccount,thecheckingaccountnumber,andthebankbranchnameshallberegisteredwiththeBoarduponfilingaDeclarationofCandidacyorformationofaMeasureFinanceCommittee.

    2. Allcontributionsofmoniesreceivedforthebenefitofthecandidate'scampaignortheMeasureFinanceCommitteeshallbedepositedinthataccount,andalldisbursementsshallbemadefromthataccount.

    3. EachcandidatefortheofficeofMayororCouncillorandeachMeasureFinanceCommittee,shallfilewiththeBoardthestatementsrequiredinSection4(c)2.ofthisElectionCode,eachofwhichshallbecumulative,signedunderoathbythecandidateorthecandidate'streasurerorbythechairpersonortreasureroftheMeasureFinanceCommittee,settingforthto5:00p.m.ofthedayprecedingthefilingofeachstatement:

    A. Thetotalofallcontributions,whichshallincludeallcontributionsreceived,regardlessofwhetherthecontributionhasbeendepositedinthecandidate'sorMeasureFinanceCommittee'scampaignbankcheckingaccount. AcontributionisdeemedreceivedwhenacandidateoraMeasureFinanceCommitteeoranyagentofacandidateoraMeasureFinanceCommitteereceivesacontributionorthebenefitoftheservicesdonated.

    B. Whenthecontributorisanindividual,thenameofthecontributor,thecontributor'sprincipalbusinessoroccupation,thenameandaddressofthecontributor'semployer,ifselfemployed,theaddressofthecontributor'sbusiness,andthenatureofthecontributor'sorthecontributor'semployer'sbusiness.Ifthecontributorisretiredornotemployed,theresidentialaddressofthecontributorshallbedisclosed. Whenthecontributorisanentityotherthananindividual,thenameandaddressofthecontributor,thebusinessoractivitiesconductedbythecontributorandtheownersandmanagersofthecontributor.Theamountofeachcontributionandthecumulativevalueofallcontributionscontributedbythecontributor. MeasureFinanceCommitteesthatsupportoropposemorethanonecandidateormeasureshallspecifyinseparatesectionsineachdisclosurestatementthecandidateormeasuretowhicheachcontributionandexpenditureapplies. Intheeventacontributionorexpenditureappliestomorethanonecandidateormeasure,theproratashareofsuchcontributionorexpenditureshallbeclearlyidentifiedforeachcandidateormeasure.

    C. Allexpendituresmadeonbehalfofthecampaign,includinganyreimbursementsandthenaturethereof,andthenameandaddressofthepersonorbusinesstowhichpaymentwasmade.

    D. ApersonseekingtoqualifytobeontheballotfortheofficeofMayororCouncillorshallincludeanypersonwhohasobtainedanominatingpetitionformapprovedby

    theCityClerk.TheCityClerkshallissueanapprovednominatingpetitiononlytothepersonseekingtobeontheballot. Suchapprovednominatingpetitionformsshallstatethenameofthepersonandthecityofficeforwhichsuchpersonispetitioningtoqualifytobeontheballot.Peoplewhohavesoughttobeontheballotasdescribedabove,butwhodonotqualifyfortheballotordonotfileadeclarationofcandidacyarerequiredtofileasprovidedinthissectionontheFridayofthetwelfthweekprecedingtheelectionandtofileafinalreportonorbeforetheFridayofthefourthweekprecedingtheelection.

    E. Within48hoursofthereceiptofastatementlistingcampaigncontributors,orassoonthereafterasreasonablypossible,thePurchasingOfficeshalldetermineifanycontributorhasbusinessdealingswiththecity. Forthepurposesofthissection,apersonisdeemedtohavebusinessdealingsifthepersonorin thecaseofanindividual,thecontributor'sprincipalbusinessorthecontributor'semployerhasreceived$20,000ormorepursuanttoacontractwiththecityinthe24monthspriortothedateofcontribution. ThePurchasingOfficeshallimmediatelynotifytheCityClerkofanycampaigncontributorswhohavebusinessdealingswiththecityandtheCityClerkshallpostthatinformation(including:contributionamount,recipientandbusinessrelationship)onthecity'swebsite.

    F. ThePurchasingOfficeshallmaintainalistofallcontributorstothecampaignofanyelectedMayororCouncillorand,foraperiodofoneandonehalfyearsfollowingtheelectionofthatOfficial,shallnotifytheCityClerkofanycampaigncontributorswhoformbusinessdealingswiththecity,asdefinedintheprecedingparagraph,andtheCityClerkshallpostthatinformation(including:contributionamount,recipientandbusinessrelationship)onthecity'swebsite.

    G. InadditiontoothercampaigndisclosurerequirementsoftheElectionCode,acandidateshalldesignateinhisorherdisclosurereportsthosecontributorswhohavecontractspursuanttowhichtheyreceivefundsfromtheemployerofthecandidateifthecandidatewassolelyorpartiallyresponsiblefortherecommendationorawardofthecontractorfortheadministrationofthecontract. TheCityClerkshallpostthisdesignationseparatelyfromtheothercontributionsonthecity'swebsite.

    2. Thesixstatementsrequiredbythissubsectionshallbefiledasfollows:thefirststatementontheFridayofthetwelfthweekprecedingtheelectionthesecondstatementontheFridayofthefourthweekprecedingtheelectionthethirdstatementontheFridayimmediatelyprecedingtheelectionthefourthstatementontheMondayimmediatelyprecedingtheelection,thefifthstatementontheseventhdayfollowingtheelectionandthesixthandfinalstatementnotearlierthantheseventhdaynorlaterthanthefortyfifthdayaftertheelection.EachstatementshallbefiledwiththeBoardnolaterthannoononthespecifiedday.

    3. ExceptiontoFirstFilingbyMeasureFinanceCommittee.InasmuchasthissubsectionrequiresthatthefirststatementbefilednotlaterthanontheFridayofthetwelfthweekprecedingtheelection,andaMeasureFinanceCommitteemightinfactcomeintoexistenceaftersuchdate,intheseinstancestheMeasureFinanceCommitteewillbeexcusedfromfilingitsfirststatementonthedatespecifiedbythisElectionCodebutwillactasfollows:AMeasureFinanceCommitteeformedbetweenthetwelfthweekprecedingtheelectionandtheFridayfourweeks

    precedingtheelectionshallfileitsfirststatementassoonaspossibleaftertheCommitteehasbeenformed,butnotlaterthanfivedaysafterithascompliedwiththerequirementsofSection6ofthisElectionCode.MeasureFinanceCommitteesshallotherwisecomplyinallrespectswiththerequirementsofthisElectionCode.A MeasureFinanceCommitteeformedaftertheFridayfourweeksprecedingtheelectionshallfileitsfirststatementatthetimeitregisterswiththeCityClerk,notwithstandinganyothertimeallowedforfilinginthisElectionCode,andshallfileallsubsequentstatementsatthetimesrequiredinSection4(c)ofthisElectionCode.

    (d) LimitstoCampaignFinancing.Nocandidateshallalloworacceptcontributionsormakeexpendituresinexcessofthefollowingforanyelection:

    1. ToacandidatefortheofficeofCouncillor,contributionsorexpendituresequaltotwicetheamountoftheannualsalarypaidbytheCityofAlbuquerquetoCouncillorsasofthedateoffilingoftheDeclarationofCandidacy.

    2. ToacandidatefortheofficeofMayor,contributionsorexpendituresequaltotwicetheamountoftheannualsalarypaidbytheCityofAlbuquerquetotheMayorasofthedateoffilingoftheDeclarationofCandidacy.

    (e) LimitstoContributions.Nocandidateshall,foranyoneelection,allowtotalcontributionsfromanyonepersonwiththeexceptionofcontributionsfromthecandidatehimselforherselfofmorethan5%oftheannualsalaryforsuchofficeatthetimeoffilingtheDeclarationofCandidacy.

    (f) UnexpendedContributions. Anycontributionsnotexpendedonthecampaignshallbedisposedof,attheoptionofthecandidate,byoneofthefollowingmethods:

    1. Retainedinthecampaignbankcheckingaccountforapossiblerunoffelectionforthatoffice,

    2. Returnedtothepersonwhomadethecontribution,

    3. PlacedintheCity'sGeneralFund,or

    4. Giventoacharityidentifiedbythecandidate.

    Thefourthandfinalcampaignfinancingstatementshallreflectthefinaldispositionofsuchcontributions.

    (g) AnonymousContributions.

    1. AllanonymouscontributionsshallbedisposedofbyacandidateorthechairpersonofaMeasureFinanceCommitteeeitherbyplacingthecontributionintheCity'sGeneralFundorbygivingthecontributiontoacharity.

    2. Ananonymouscontributionshallnotbeconsideredtobeacontributiontoorexpenditureofthecampaignhowever,arecordofallanonymouscontributionsshallbekeptbythecandidateorthecandidate'streasurer,orbythechairpersonortreasureroftheMeasureFinanceCommitteeandthereceiptanddispositionofeveryanonymouscontributionshallbereportedtotheBoard,inwriting,atthetimethecampaignfinancingdisclosurestatementsrequiredbysubsection(c)ofthissectionarefiled.Suchdeportmustdisclosethegoodsservices,moneys,orothercontributionsreceived,itsvalue,thedateofreceiptandthedateandmethodofdisposition.

    (h) Forthepurposesofthissection,contributionsandexpendituresincludethosecontributionsreceivedandexpendituresmadebyoronbehalfofanindividualatanytimepriortotheindividualfilingaDeclarationofCandidacyfortheofficeofMayororCouncillorthroughthetimethefinalcampaignfinancingdisclosurestatementisdue,orbyoronbehalfofaMeasureFinanceCommitteeatanytimepriortotherelevantelectionthroughthetimethefinalcampaignfinancingdisclosurestatementisdue.

    (i) CampaignFinanceRecords.

    1. Allcampaignfinancerecordsandstatementsshallbeopentoinspectionand/orauditbytheBoard,itsdesignatedrepresentative,oritsauditorstatementsshallbepresentedtotheBoardforinspectionoraudit,orboth.TheCityClerkshallcreateanelectronicdatabaseforallcampaignreportingrequiredinthisElectionCodeandplacethatinformation ontheCity'swebsite.

Eachcandidateorthecandidate'streasurerandeachchairpersonortreasurerofaMeasureFinanceCommitteeshall keepfinancialrecordsofthecampaignforaperiodofoneyearfollowingthedateofelection,toassuretheiravailabilityintheeventofcomplaint orinquiryby theBoard.Suchcampaignfinancialrecordsshallincluderecordsofallcontributions, regardless ofamount,expenditures,cancelled checks,invoices, receipts,bankstatements,billsof sales,statements ofaccounts,leases,rentalagreements,andallotherfinancialrecordspertinenttothecampaign.

    B. Inpreparingandmaintainingfinancialrecords,ledgers,journals,orotherwise,andinrecordingcontributionsandexpendituresonthestatementsrequiredbysubsection(c)ofthissection,eachcandidateorthecandidate'streasurerandeachchairpersonortreasurer ofaMeasureFinanceCommitteeshall:

    1) Recordinkindcontributionsasbothcontributionsandexpendituresequaltothefairmarketvalueofthegoodsorservicesreceived.

    2) Recordcampaignloansascontributions,withsubsequentrepaymentofloanscreditedagainstcontributions.

    4) Recordnamesofcontributorsonthebankdepositslips.

    3. DuringtheperiodbetweennoonontheFridayimmediatelyprecedingtheelectionandthedayoftheelection,eachcandidateorthecandidate'streasurer,andthechairpersonortreasurerofeachMeasureFinanceCommittee,shallappearbeforetheBoardatatimeandplacedesignatedbytheBoard.Theappearanceofthecandidate'streasurerortheCommittee'streasurerbeforetheBoardonthecandidate'sorCommittee'sbehalfdoesnotrelievethecandidateortheCommittee'schairpersonoftheultimateandcompleteresponsibilityfortheaccuracyofallreportsfiledandthecontrolofthecandidate'sorCommittee'scampaign.Atthedesignatedtimeandplace,thecampaignfinancialrecordsofeachcandidateandeachMeasureFinanceCommitteerequiredthroughthesecondstatementpursuanttoSection4ofthisElectionCodeshallbesubmittedtotheBoardforinspectionandaudit,orboth.EachcandidateandthechairpersonofeachMeasureFinanceCommitteeshallbegivenatleastthreedayswrittennoticeofthedesignatedtimeandplace.

    (j) FundRaisingActivity.

    1. Thegrossreceiptsofafundraisingactivityonbehalfofacandidateareconsideredtobecampaigncontributions,andallexpendituresassociatedwithsuchafundraisingactivityareconsideredtobecampaignexpenditures.Asusedinthissubsection,theterm"grossreceipts"includesallmoniesanddonationsofanykindwhicharereceivedaspartofthefundraisingactivity.

    2. ThehostofafundraisingactivityonbehalfofacandidateorCommitteeshallberesponsibleforreportingthecontributionsresultingfromtheactivityunlesscontributorsareidentifiedintherequiredmannerontheDisclosureofCampaignFinancingStatement,andthelimitstocontributionsspecifiedinsubsection(e)ofthisSection4shallapplyasifthetotalcontributionsatthefundraisingactivity,nototherwisereported,weremadebythehost.

    (k) MeasureCampaignFinancing. AnypersonorgroupwhichhascontributedinexcessofthirtypercentoftheMayor'ssalarytosupportoropposeameasureshallhavethenameofsuchpersonorgroupinsertedintothenameoftheMeasureCampaignCommitteetowhichthefundswerecontributedorshallcreateanewcommitteewiththenameofthecontributorinthecommitteename.ItistheobligationoftheMeasureFinanceCommitteetoimmediatelyinformtheBoardoftheCommittee'srequirednamechangetheCommitteeshallsimultaneouslyreporttheamountofthecontributionwhichtriggersthenamechange.Forthepurposesofthissubsection,"Mayor'ssalary"meansthesalarypaidbytheCityofAlbuquerqueasofthedateofthecontributionsupportoropposeameasurecoversqualificationfortheballotplusvoterapprovalordisapprovalofagivenmeasure.

Eachchargeofanyallegedviolationshallspecifythespecificprovisionallegedtohavebeenviolatedoraclearandconcisestatementofwhythecomplainantbelievesaviolationhasoccurred,andshallincludedocumentationastotime,place,facts,andthenamesofanywitnessestotheallegedviolation.Nochargeshallbeacceptedunlessthecomplaintissignedandunlessthedocumentationreferredtoabove, thestatementoftheprovisionallegedtohavebeenviolated,orthereasonforthecomplaint,ispresentedatthesametimethecomplaintisfiled.

    3. Exceptasprovidedinsubsection(d)ofthissection,theBoardshallgivewrittennoticeofsuchchargeorchargestothecandidateorchairpersonbeforetakingfurtheraction.

    (b) TheBoard,initsdiscretion,mayestablishaComplaintCommitteetoreviewthecomplaintforcompleteness,andtheComplaintCommitteeshalleitherreferthecomplainttotheBoardorrejectthecomplaintandgivewrittennoticetotheBoardandthecomplainantofthereasonsfortherejection. ThecomplainantmayappealtheComplaintCommittee'srejectiontotheBoard.

    (c) UponreferralofanycomplaintbytheBoard,theCampaignandElectionAuditorshallinvestigatethechargeorchargesandreporttotheBoard.

    (d) Notwithstandinganyotherprovisioninthissection,theBoardmay,onitsowninitiative,initiateachargeorchargesthatacandidateorthechairpersonofaMeasureFinanceCommitteeoranyothergrouphascommittedaviolationofthisElectionCodeoroftheRulesandRegulationspromulgatedbytheBoard. Intheeventthatinspectionand/orauditofthecandidatesorMeasureFinanceCommitteescampaignfinancialrecordsmadepursuanttoSection4(i)3.resultsinachargeorchargesagainstacandidateorMeasureFinanceCommittee,writtennoticetothecandidateorchairpersonofthechargeorchargesshallnotberequiredbeforetheBoardtakesfurtheraction.

    (e) ShouldtheBoardfind,afterduehearing,thataviolationofthisElectionCodeortheRulesandRegulationsoftheBoardhasoccurred,itmay,foreachviolation,issueapublicreprimandorimposeafinenottoexceedthemaximumamountauthorizedbystatelaw,ordoboth.

    (f) AutomaticFines. Notwithstandingsubsection(e)ofthissection,afailuretofileorlatefilingshallsubjectthecandidateorthechairpersonoftheMeasureFinanceCommitteeoranyotherobligatedperson,whichevermaybethecase,toanautomaticfineandpublicreprimandaccordingtotheschedulesestablishedintheRulesandRegulationsoftheBoard.InsituationswherethereisanincompletefilingthecandidateorthechairpersonoftheMeasureFinanceCommitteeshallbenotifiedofthefailureandshallhavetendaysfromthedateofnoticetocorrectthefailure. Iftheincompletefilingisnotcorrectedwithintendaysthereshallbeanautomaticfineandpublicreprimand. IfthefailureiscorrectedwithintendaysandtheBoarddeterminesfromthefaceofthefilingsthatanyfailureappearstohavebeeninadvertentandmadeingoodfaith,theBoardshallfindthattherehasbeennoviolation.

    (g) Inadditiontoimposingsuchsanctions,orasanalternativethereto,andiftheviolatorbeasuccessfulcandidateintheelection,theBoardmayrecommendtotheCouncilthattheviolatorberemovedfromoffice.

    (h) TheCouncilmay,upontherecommendationoftheBoard,andafterduehearingofthecharge,orderthesuspensionorremovalofanelectedofficialprovided,however,thatnoofficialshallberemovedorsuspendedexceptupontheconcurrenceoftwothirdsoftheCouncillorsqualifiedtovotethereon.

    (i) AnappealmaybetakenfromanyfindingsandactionoftheBoardpursuanttosubsections(e)and(f)ofthissectionandfromanyorderoftheCouncilpursuanttosubsection(h)ofthisSectiontotheDistrictCourtoftheSecondJudicialDistrict,byfilingNoticeofAppealinthesaidDistrictCourtwithinfivedaysofthedateoftheactionororderappealedfrom,andbyfilingwithsaidDistrictCourtwithinthirtydaysatruetranscriptandrecordoftheproceedingsuponwhichsaidactionororderisbased.ThehearinginDistrictCourtshallbeheldonsaidtranscriptandrecordonly,andnewtestimonyshallnotbetaken.

    (j) Allfinesnottimelypaidshallbeassessedinterestatthemaximumrateallowedbystatelawcommencingonthethirtyfirstdayfollowingthedatethatthefinewasimposed.

    (k) AnyfinescollectedunderthissectionshallbeplacedintotheCity'sGeneralFund.

    Section11. NONWAIVEROFPENALTIES.

    NothinghereinsetforthshallbeconstruedtoaffectorotherwisediminishanypenaltiesotherwiseprovidedbylawforviolationofthisElectionCodeortheRulesandRegulationspromulgatedbytheBoard,norshallpreventtheBoardfrombringingtotheattentionoftheproperauthorityanyallegedviolationcomingtoitsattentionwhichmaybesubjecttootherpenalties.

    Section12. AMENDMENTS.

    ThisElectionCodemaybeamendedwithoutrequiringcompliancewithArticleVIofthisCharterbyordinanceadoptedbyamajorityplustwooftheentiremembershipoftheCouncilvotinginfavorofsuchamendmentoramendments,andsaidordinancebeingotherwisegovernedbyArticleXIofthisCharter.

    Section13. REPRESENTATIVEINSPECTIONS.

    (a) CertificationofRepresentatives. Alldeclaredandcertifiedcandidatesformunicipaloffice,measurefinancecommitteeorcommitteeororganizationdedicatedtoturningoutthevotersonelectiondayshallbeentitledtodesignaterepresentativeswhomayenterprecinctpollingplacesforthesolepurposeofobservingvotersignaturerosters. Eachcandidate,measurefinancecommitteeorcommitteeororganizationdedicatedtoturningoutvotersonelectiondayshallrequestfromtheCityClerkthenumberofrepresentativeauthorizationpassesthatarewishedforuseonelectionday. Theauthorizationpassesshalldesignatethenameofthecandidate,measurefinancecommitteeorcommitteeororganizationdedicatedtoturningoutvotersonelectiondayandmaybeusedatanyprecinctwithintheCityCouncildistrictthataCouncillorcandidateisseekingoralldistrictsforMayoralcandidates. Theauthorizationpassesmaybeusedbythosepeopledesignatedbythecandidate,measurefinancecommitteeorcommitteeororganizationdedicatedtoturningoutvotersonelectionday. Thecandidates'representatives'nameneednotappearontheauthorizationpass.

    (b) AccesstoSignatureRosters. Candidate,committeeand/ororganizationrepresentativeswhohavereceivedanauthorizationpassmayenterthepollingprecinctstoobservethevotersignaturerostersduringthehoursthepollingplaceremainsopentovoters. Thoserepresentativesmayobservethevotersignaturerostersattimesandinaplaceandmannerthatthepresidingelectionjudgedeterminesshallnotinterfereintheorderlyandtimelyprocessofvoting. Onlymembersoftheprecinctboardshallhandlesignaturerosters. Theprecinctelectionjudgesshallfacilitatetherepresentativesinobservingeachpageofthevoterroster. Nomorethanonerepresentativeforaparticularcandidate,committeeororganizationshallbepresentataprecinctatatime. Shouldrepresentativesformorethanonecandidate,committeeor

    organizationwishtoobservethevoterrosteratthesametime,thepresidingelectionjudgeshalldeterminethemannerinwhichsuchobservationshalltakeplace.

    (c) OrderlyConduct. Intheeventacandidate,committeeororganizationrepresentativeisdisorderlyorfailstoobeytheinstructionsofaprecinctelectionjudge,therepresentativeshallsurrenderhisauthorizationpassandshallnolongerbeentitledtobepresentatthepollingplaceasarepresentative.(Ord.402003)
