COMMONWEALTH ACT NO. 137 AN ACT TO PROVIDE FOR THE CONSERVATION, DISPOSITION, AND DEVELOPMENT OF MINERAL LANDS AND MINERALS CHAPTER I Title of Act SECTION 1. The short title of this Act shall be "The Mining Act." ICaDHT CHAPTER II Definitions SECTION 2. The terms "person," "holder," "occupant," "locator," "licensee," "lessee," "permittee," "owner," whenever used in this Act, shall include an individual, a corporation, a sociedad anomina, a limited partnership and an unincorporated association, and words in the singular shall include the plural, and vice versa. The term "ton" as used in this Act shall mean a short ton of nine hundred seven and two tenths (907.2) kilograms. CHAPTER III Ownership of Minerals and Mineral Lands SECTION 3. All mineral lands of the public domain and minerals belonging to the State, and their disposition, exploitation, development, or utilization, shall be limited to citizens of the Philippines, or to corporations, or associations, at least sixty per centum of the capital of which is owned by such citizens, subject to any existing right, grant, lease, or concession at the time of the inauguration of the Government established under the Constitution. SECTION 4. The ownership and the right to the use of land for agricultural, industrial, commercial, residential, or for any purpose other than mining does not include the ownership of, nor the right to extract or utilize, the minerals which may be found on or under the surface. SECTION 5. The ownership of, and the right to extract and utilize, the mineral included within all areas for which public agricultural land patents are granted are excluded and excepted from all such patents. SECTION 6. The ownership of, and the right to extract and utilize, the minerals included within all areas for which Torrens titles are granted are excluded and excepted from all such titles. SECTION 7. With the exceptions of the soil which supports organic life, and of ordinary earth, gravel, sand, and stone which are used for building or construction purposes, the disposition of which is governed by Act Numbered Three thousand seventyseven, as amended by Act Numbered Three thousand eight hundred and fiftytwo of the Philippine Legislature, all inorganic substances found in nature in solid, liquid, gaseous, or any intermediate state are minerals within the purview of this Act. SECTION 8. Mineral lands are those in which minerals exist in sufficient quantity or quality to justify the necessary expenditures to be incurred in extracting and utilizing such minerals. SECTION 9. The exploitation of public and private lands for mining purposes shall be governed by existing laws, rules and regulations which may be promulgated thereunder. SECTION 10. Subject to any existing rights, all valuable mineral deposits in public or in private land not closed to mining location, and the land in which they are found, excepting coal, petroleum, and other mineral oils and gas, which are now governed by special laws, shall be free and open to exploration, occupation, location, and lease, by citizens of the Philippines of legal age, or by associations, or by corporations organized and constituted under the laws of the Philippines:Provided, That at least sixty per centum of the capital of such associations or corporations shall at all times be owned and held by citizens of the Philippines. SECTION 11. Upon the recommendation of the Secretary of Agriculture and Commerce, the President may set apart mineral land reservations, and he shall by proclamation declare the establishment of such reservations, and the boundaries thereof, and thereafter such reservations shall be closed or open to mining location or lease as the President may deem wise and may so provide in the proclamation. The President may, with the concurrence of the National Assembly, by proclamation alter or modify the boundaries of any mineral reserve from time or revoke any such proclamation, and upon such revocation, such reserve shall be and become part of the public domain as though no such proclamation had ever been made:Provided, however, that the President is hereby authorized to declare by proclamation any mineral reserve, closed to mining location: Provided, further, That all mineral reservations set aside by the Chief Executive prior to the approval of this Act shall remain in full force and effect and shall be administered and disposed of in accordance with the provisions of this Act. SECTION 12. From and after the date of proclamation of a mineral reserve, if the same has not been proclaimed closed to mining location, the lands thereby may be disposed of only for mining purposes as hereinafter provided. SECTION 13. Whenever lands are reserved for purposes other than for mining, the holders of mining locations or leases within any such new reserve, at the time the reservation is made, shall continue to enjoy all rights accorded them under existing law with respect to such locations or leases as if such reservation had never been made. SECTION 14. Lands within reservations for purposes other than mining, which, after such reservation is made, are found to be more valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from such reservations by the President with the concurrence of the National Assembly, and thereupon such lands shall revert to the public domain and be subject to disposition under the provisions of this Act. SECTION 15. Land leased for mining purposes shall be classified as follows: First group — Metals or metalliferous ores. Second group — Precious stones. Third group — Fuels. Fourth group — Salines and mineral waters.

    SECTION4. Theownershipand the right to theuseof land foragricultural, industrial,commercial, residential,or foranypurposeother thanminingdoesnot include theownershipof,nor the right toextractorutilize, themineralswhichmaybe foundonorunderthesurface.

    SECTION5. Theownershipof,and the right toextractandutilize, themineral includedwithinallareas forwhichpublicagriculturallandpatentsaregrantedareexcludedandexceptedfromallsuchpatents.

    SECTION6.Theownershipof,andtherighttoextractandutilize,themineralsincludedwithinallareasforwhichTorrenstitlesaregrantedareexcludedandexceptedfromallsuchtitles.

    SECTION7.Withtheexceptionsofthesoilwhichsupportsorganiclife,andofordinaryearth,gravel,sand,andstonewhichareusedforbuildingorconstructionpurposes,thedispositionofwhichisgovernedbyActNumberedThreethousandseventyseven,asamendedbyActNumberedThree thousandeight hundredand fiftytwoof thePhilippineLegislature, all inorganic substances found innatureinsolid,liquid,gaseous,oranyintermediatestatearemineralswithinthepurviewofthisAct.

    SECTION11.UpontherecommendationoftheSecretaryofAgricultureandCommerce,thePresidentmaysetapartminerallandreservations,andheshallbyproclamationdeclaretheestablishmentofsuchreservations,andtheboundariesthereof,andthereaftersuch reservations shall be closed or open to mining location or lease as the President may deem wise and may so provide in theproclamation.ThePresidentmay,withtheconcurrenceoftheNationalAssembly,byproclamationalterormodifytheboundariesofanymineralreservefromtimeorrevokeanysuchproclamation,anduponsuchrevocation,suchreserveshallbeandbecomepartofthepublicdomainas thoughnosuchproclamationhadeverbeenmade:Provided,however, that thePresident isherebyauthorized todeclarebyproclamation any mineral reserve, closed to mining location: Provided, further, That all mineral reservations set aside by the ChiefExecutivepriortotheapprovalofthisActshallremaininfullforceandeffectandshallbeadministeredanddisposedofinaccordancewiththeprovisionsofthisAct.

    SECTION12.Fromandafterthedateofproclamationofamineralreserve, if thesamehasnotbeenproclaimedclosedtomininglocation,thelandstherebymaybedisposedofonlyforminingpurposesashereinafterprovided.

    SECTION13.Wheneverlandsarereservedforpurposesotherthanformining,theholdersofmininglocationsorleaseswithinanysuchnewreserve,atthetimethereservationismade,shallcontinuetoenjoyallrightsaccordedthemunderexistinglawwithrespecttosuchlocationsorleasesasifsuchreservationhadneverbeenmade.

    SECTION14.Landswithinreservationsforpurposesotherthanmining,which,aftersuchreservationismade,arefoundtobemore valuable for their mineral contents than for the purpose for which the reservation was made, may be withdrawn from suchreservationsbythePresidentwiththeconcurrenceoftheNationalAssembly,andthereuponsuchlandsshallreverttothepublicdomainandbesubjecttodispositionundertheprovisionsofthisAct.

    SECTION15.Landleasedforminingpurposesshallbeclassifiedasfollows:FirstgroupMetalsormetalliferousores.SecondgroupPreciousstones.ThirdgroupFuels.FourthgroupSalinesandmineralwaters.

  • FifthgroupBuildingstoneinplace,clays,fertilizers,andothernonmetals.SECTION 16. Lands of the first group shall be those which contain any of the metallic elements or minerals, or their

    combinations,suchasgold,silver,platinum,tin,chromium,iron,manganese,copper,nickel,lead,zinc,cinnabar,tungsten,andthelike.SECTION17.Landsofthesecondgroupshallbethosewhichcontainmineralsmainlyusedforornamentalpurposessuchas

    diamond,ruby,emerald,sapphire,topaz,amethyst,zircon,aquamarine,opal,jade,agate,tourmaline,beryl,garnet,turquoiseandthelike.SECTION18.Landsofthethirdgroupshallbethosewhichcontaincombustiblesubstancesinsolid,liquid,gaseousform,such

    aspeat,coal,mineraloils,naturalgas,oilshales,asphalt,andthelike,butnottherecentproductsoforganiclife.SECTION19.Landsofthefourthgroupshallbethosewhichcontainsurfaceorsubterraneansolublesubstancesorwaters

    whichbytheirmineralcontentsareclassifiedasmineralwaters,suchassalt,nitrates,sulphurated,carbonated,sodic,calcic,andotherwaters.

    SECTION20.Landsofthefifthgroupshallbethosewhichcontainnonmetallicsubstances,suchas:(a)Thoseusedforbuildingorconstructionpurposes,suchasmarble,granite,clay,andthelike.(b)Asbestos,feldspar,lime,mica,guano,phosphate,potash,saltpeter,niter,andthelike.(c)Othersubstancesusedinthemanufactureofpaints,ceramicsandfertilizersandforotherindustrialpurposes.

    SECTION21.AerolitesorotherbodiescomingfromsiderealspacearemineralswithinthemeaningofthisAct,thedispositionofwhichshallbedeterminedbyregulations.

    SECTION22.Minerallandsmaybeclassifiedundermorethanonegroup,dependinguponthenatureandusesofthemineralscontainedtherein.

    SECTION23. ThemineralswhicharenotspecificallymentionedinthisAct,andnewoneswhichmaybediscoveredinthefuture,shallbeclassifiedundertheirpropergroups,whenevernecessary,andshallbeincludedthereinbylaworregulations.

    CHAPTERIVExploitationandProspectingforMineralDeposits

    SECTION24. Prospectorsmayprospect for themselves,or forotherpersons,associations,corporations,orotherentities,qualified to locateminingclaimsand toacquire leasesofmineral landsunder theprovisionsof thisAct.Aproperpowerofattorney inwritingshall ineachcasebegivenbytheemployertohisprospector,whichpowerofattorneyshallbedulyacknowledgedandshallberecordedintheofficeoftheminingrecorderconcernedcoincidentwiththerecordingofadeclarationoflocation.Regardlessofthenumberofclaimslocatedbytheprospectorforthesameprincipleinthesameprovinceorminingdistrict,heshallberequiredtorecordbutonepowerofattorneyinanysuchprovinceordistrict.

    SECTION25.OfficersandemployeesoftheexecutiveoranyotherbranchoftheGovernmentwhosedutiesarerelatedtotheadministrationordispositionofmineralresourcesshallnotbeallowedtoprospect,locate,lease,orhold,directlyorindirectly,minerallandsinthePhilippines.SAHIaD

    SECTION26. Prospectingmaybecarriedonwithinpublic landsandprivatelandsinaccordancewiththeprovisionsofthisAct:Provided,however,ThatinthecaseofprivatelandsnoprospectingshallbeallowedexceptbytheownerthereofduringtheperiodofoneyearfromandaftertheeffectivedateofthisAct.

    SECTION27.Beforeenteringprivatelandstheprospectorshallfirstapplyinwritingforwrittenpermissionoftheprivateowner,claimant, or holder thereof, and in case of refusal by such private owner, claimant, or holder to grant such permission, or in case ofdisagreementas to theamountofcompensation tobepaid forsuchprivilegeofprospecting therein, theamountofsuchcompensationshallbefixedbyagreementamongtheprospector,theDirectoroftheBureauofMinesandthesurfaceowner,andincaseoftheirfailuretounanimouslyagreeastotheamountofcompensation,allquestionsat issueshallbedeterminedbytheCourtofFirstInstanceoftheprovinceinwhichsaidlandsaresituatedinanactioninstitutedforthepurposebytheprospector,orhisprincipal:Provided,however,Thattheprospector,orhisprincipalupondepositingwiththecourtthesumconsideredjointlybyhimandtheDirectoroftheBureauofMinesorbythecourttobejustcompensationforthedamagesresultingfromsuchprospecting,shallbepermittedtoenteruponandlocatethesaidlandwithoutsuchwrittenpermissionpendingfinaladjudicationoftheamountofsuchcompensationandinsuchcasetheprospector,orhis principal, shall have a prior right as against the world, from the date of his application. The court in its final judgment, besidesdeterminingthecorrespondingcompensationofthedamageswhichmaybecausedbytheprospecting,shallmakeapronouncementastothevalueofthelandandthereasonablerentalfortheoccupationandutilizationthereofforminingpurposesincasetheprospectordecidestolocateandexploitthemineralsfoundtherein.

    SECTION28.Noprospectingshallbeallowed:(a)Inamineralreservewhichhasbeenproclaimedclosedtomininglocations.(b)Inlandscoveredbypatentedminingclaims.(c)InlandsinwhichmineralshavebeendiscoveredpriortotheeffectivedateofthisActandareclaimedbythediscovererorhissuccessorsininterest.(d)InlandswhichhavebeenlocatedforminingleasesbyotherprospectorsundertheprovisionsofthisAct.(e)Nearorunderbuildings,cemeteries,bridges,highways,waterways,railroads,reservoirs,dams,oranyotherpublicorprivateworks.

    TheregulationstobepromulgatedunderthisActshallprescribeindetailthevariousrestrictionsunderthissection.CHAPTERV

    DiscoveryofMineralDepositsandLocationofMiningClaimsSECTION29.Therighttolocateaminingclaimshallinallcasesbebaseduponthediscoveryofmineraltherein.SECTION30.Thefindingofmineralormineralsinplaceorpositionwhereoriginallyformedintherock,whetherassayinghigh

    orlow,shallconstituteavaliddiscoveryforthelocationofalodemineralclaim.Thefindingofmineralormineralsinloose,fragmentaryorbrokenrocks,boulders,floats,bedsordepositswhetheringreaterorlesserquantities,orthefindingofthesameinformsotherthanthose

  • abovedescribedforlodemineralclaims,shallconstituteavaliddiscoveryforthelocationofaplacerminingclaim.SECTION31.Alodemineralclaimisaparcelofminerallandcontainingavein,lode,ledge,lens,ormassoforeinplacewhich

    hasbeenlocatedinaccordancewithlaw.Aplacerclaimisthatwhichdoesnotcomeunderthedefinitionoflodemineralclaim.SECTION32.Incaseofconflictinglocations,priorityofdiscovery,followedbycontinuousoccupationandprospectingofthe

    land,shalldetermine the right to lease theclaims,subject toanyquestionas to thevalidityof the locationandrecordof theclaimandsubject totheholder'shavingcompliedwithall therequirementsof the law:Provided,however,ThatactualdiscoveryofmineralsmadepriortotheeffectivedateofthisAct,beforeoraftertheenforcementoftheConstitution,shallconstituteavaliddiscovery,andthepersonsmakingsuchdiscoveryshallhavethepreferentialrighttolocateandleasetheminingclaimscoveringthemineralsdiscovered,subjecttotheprovisionsofthisAct.

    SECTION33.Immediatelyuponthediscoveryofmineralorassoonaspossiblethereafter,butnotmorethanthirtydaysafterthedateofthesaiddiscovery,thediscovererorlocatormaylocateaminingclaiminaccordancewiththeprovisionsofthisAct,coveringthelandwherethemineralhasbeendiscovered.Ifnosuchlocationismadewithinsuchperiod,therighttolocateaminingclaimcoveringsuchlandshallbedeemedtohavebeenwaived.

    SECTION34.Withinsixtydaysafterthecompletionoftheactsoflocationofaminingclaim,ashereinafterprovided,thelocatorthereofshallrecordthesamewiththeminingrecorderoftheprovinceordistrictwithinwhichtheclaimissituated.Aclaimwhichshallnothavebeenrecordedwithintheprescribedperiodshallbedeemedtohavebeenabandoned.

    SECTION35.ThemaximumareawhichmaybeacquiredunderaminingclaimlocatedundertheprovisionsofthisActshallbe:Firstgroup:

    (a)Metalsormetalliferousoresinlodedeposits,ninehectaresforanindividual,anunincorporatedassociation,asociedadanonima,alimitedpartnershiporacorporation.(b)Metalsormetalliferousoresinplacerdepositsnottoexceedeighthectaresforanindividualnorsixtyfourhectaresforacorporation,sociedadanonima,orlimitedpartnership:Provided,Thatinthecaseofanunincorporatedassociationtheareashallnotexceedeight(8)hectaresforeachmember,norsixtyfour(64)hectaresfortheentireassociation.

    Secondgroup:Preciousstoneswhetherinlodeorplacerdeposits,nottoexceedfourhectaresforanyqualifiedlocatororapplicant.Fourthgroup:Salinesandmineralwaters,nottoexceedfourhectaresforanyqualifiedlocatororapplicant.Fifthgroup:

    (a)Buildingstone,clay,fertilizer,andothernonmetalsinplacerdepositsnottoexceedeighthectaresforanindividualnorsixtyfourhectaresforacorporation,sociedadanonima,orlimitedpartnershipProvided,Thatinthecaseofanunincorporatedassociationtheareashallnotexceedeight(8)hectaresforeachmembernorsixtyfour(64)hectaresfortheentireassociation.(b)Nonmetalsinlodedepositnottoexceedninehectaresforanindividual,unincorporatedassociation,asociedadanonima,alimitedpartnershiporacorporation.

    SECTION36.Thedispositionofthethirdgroupofminerallands,orlandscontainingmineralfuels,whetherpublicorprivate,shallbegovernedbyActNumberedTwothousandsevenhundrednineteen,asamended,entitled"AnActtoprovidefortheleasinganddevelopmentofcoallandsinthePhilippineIslands"andtheregulationspromulgatedthereunder,andbyActNumberedTwothousandninehundredthirtytwo,asamended,entitled,"AnActtoprovidefortheexploration,locationandleaseoflandscontainingpetroleumandothermineraloilsandgasinthePhilippineIslands"andtheregulationspromulgatedthereunder:Provided,Thatthegrantingofpermit,license,lease,orconcessionofsuchcoal,orpetroleum land,shallbe limited tocitizensof thePhilippinesof legalage,or toassociationsor tocorporations organized and constituted under the laws of thePhilippines:Provided, further, That the provisions of ActsNumbered Twothousand seven hundred and nineteen, as amended, and Two thousand nine hundred and thirtytwo, as amended, to the contrarynotwithstanding,atleastsixtypercentumofthecapitalofsuchassociationorcorporationshallatalltimesbeownedandheldbycitizensofthePhilippines.Alllicenses,concessions,orleasesfortheexploitation,development,orutilizationofsuchcoallands,orlandscontainingpetroleum and other mineral oils and gas, shall be for a period not exceeding twentyfive years, renewable for another period notexceedingtwentyfiveyears.

    SECTION37.Inthecaseofthefirst,second,fourth,andfifthgroupsofminerallands,nolocator,applicantorlesseeshallbeentitledtoholdorleaseinhis,itsortheirownnamesorinthenameofanyperson,association,corporation,asociedadanonima,orlimitedpartnershipmore than three lodemineral claimson thesameveinor lode,ormore than threeplacerminingclaims, in thecaseofanindividual, or more than three placer mining claims in the case of a corporation, an association, a sociedad anonima, or a limitedpartnershiponthesameplacerground.

    SECTION38. Miningclaimsof the first,second, fourth,and fifthgroupsmaybe locatedeitheras lodeorasplacerclaims,dependinguponwhetherthemineraldepositsthereinarefoundinlodeorinplacerform:Provided,however,That ifaparcelof land,byreasonof thenatureof themineraldeposits found therein, issubject toeither lodeorplacer location, theprior locationofeitherclass,validlymade,shallprevail:Provided,further,That incaseaplacer location ismadefirst, the locator thereofmust thereaftermakea lodelocationinordertosecuretheminingrightstolodedepositsfoundwithintheboundariestoallmineralsofthegroupforwhichthemininglocationoftheplacerclaim:Provided,further,Thatincaseaplacerlocationismadefirst,thelocator,thereofmustthereaftermakealodelocationinordertosecuretheminingrightstolodedepositsfoundwithintheboundariesoftheplacerclaim:Provided,further,Thatinsuchcasesthelocator,orhissuccessorsininterest,shallbeentitledtoallmineralsofthegroupforwhichthemininglocationorlocationshavebeenmadeortheleasegranted,whichmayliewithinhisclaims,butheshallnotbeentitledtomineoutsidetheboundarylinesofhisclaimcontinuedverticallydownward:Andprovided,finally,Thattheholderorlesseeshallhavepreferentialrighttolocateandleaseanymineraldepositsofanyothergroupfoundtherein.AHTICD

    SECTION39.Lodeclaims,whetherlocatedbyoneormorepersonsqualifiedtolocateminingclaimsunderthisActshallbelocatedinthefollowingmannerandunderthefollowingconditions:

    Anypersonsoqualifieddesiringtolocatealodemineralclaimshall,subjecttotheprovisionsofthisAct,enteruponthesameandlocateaplat of ground,measuringnotmore than threehundredmeters in lengthby threehundredmeters in breadth, in asnearly as

  • possible a rectangular form that is to say, all angles shall be right angles, except in cases where the boundary line of a previouslysurveyedclaimisadoptedascommontobothclaims,butthelinesneednotnecessarilybemeridional. Indefiningthesizeofamineralclaim,itshallbemeasuredhorizontallyirrespectiveofinequalitiesofthesurfaceoftheground.

    SECTION40.Alodeclaimshallbemarkedbytwoposts,placedasnearlyaspossibleonthelineordirectionofthelodeorvein, and the posts shall be numbered one and two, and the distance between posts numbered one and two shall not exceed threehundredmeters,thelinebetweenpostsnumberedoneandtwotobeknownasthelocationlineanduponpostsnumberedoneandtwoshallbewrittenthenamegiventothelodemineralclaim,thenameofthelocator,andthedateofthelocation.Uponpostnumberedonethereshallbewritten,inadditiontotheforegoing"Initialpost,"theapproximatecompassbearingofpostnumbertwo,andstatementofthenumberofmeterslyingtotherightandtotheleftofthelinefrompostnumberonetopostnumbertwo,thus:"Initialpost.Directionofpostnumber two___________metersof thisclaim lieontherightand___________metersonthe leftof the linefromnumberonepost tonumbertwopost."

    SECTION41.Whenaclaimhasbeenlocatedthelocatorshallimmediatelymarkthelinebetweenpostsnumberoneandtwosothatitcanbedistinctlyseen.Thelocatorshallalsoplaceapostatthepointwherehehasfoundmineralsinplace,oronthesurfaceverticallyabovesuchpoint if thediscoverybeunderground,onwhichshallbewritten"Discoverypost":Provided,Thatwhentheclaimissurveyedthesurveyorshallbeguidedbytherecordsoftheclaim,thesketchplaninthedeclarationoflocationmadebythelocatorwhentheclaimwaslocatedandrecorded,postsnumberoneandtwo,andthenoticeonnumberone,theinitialpost.Incaseswhere,fromthenatureorshapeoftheground,itisimpossibletomarkthelocationlineoftheclaimasprovidedinthisAct,thentheclaimmaybemarkedbyplacingpostsasnearlyaspossibletotheproperpositionofnumberoneandnumbertwoposts,andnotingthereonthedistanceanddirectionofsuchpostsfromsuchpositions,whichdistanceanddirectionshallbesetoutinthedeclarationoflocationoftheclaim.

    SECTION44.Thelocationlineshallgovernthedirectionofonesideoftheclaim,uponwhichthesurveyshallbeextendedaccordingtotheprovisionsofthisAct.

    SECTION 45. Placer mining claims may be of an irregular pattern following the meanderings of a creek, river, orstreamProvided,Thatonplacergroundsnotconfinedto thebedsofsuchcreeks,rivers,orstreams,oronthoseextendingbeyondthebanksthereof,placerclaimsshallbelocatedinasnearlyaspossiblerectangularform.

    SECTION46.Thelocatorofaplacerclaimshallpostuponthesameanoticecontainingthenameoftheclaim,designatingitasaplacerclaim,thenameofeachlocator,thedateoflocation,thenumberofthecornersoftheclaim,andthenumberofhectaresclaimed.Heshallalsodefinetheboundariesoftheclaimbymarkingastandingtree,orrockinplace,orbysettingapost,stone,ormonumentateachcornerorangleoftheclaim.Thetrees,rocksinplace,stakes,stones,ormonumentsusedtomarkthecornersoranglesofaplacerminingclaimmustbe inscribedwithaseriesof consecutivenumbers, thusCornerNo.1,CornerNo.2,CornerNo.3,andso forth, inclockwisedirection,andatleastthefourendcornersoftheplacerminingclaimshallbemarkedwiththenameoftheclaim,thenameofthelocator,andthedateoflocation.Theposts,stones,ormonumentsusedtomarkthecornersofaplacerminingclaimmustbeofthedimensionsrequiredbysectionfortytwoofthisActfortheposts,stones,ormonumentstobeusedinmarkingthecornersoranglesofalodemineralclaim.

    SECTION47.Therecordofalodeorplacerclaimshallconsistofadeclarationoflocationwhichshallcontain,amongothers,thenameoftheclaim,thenameofeachlocator,thedateoflocation,thenamesofthesitio,barrio,municipality,provinceandisland,inwhichtheclaimissituated,thewordswrittenonthenumberoneandnumbertwopostsinthecaseoflodeclaims,andatruecopyofthenotice posted on the placer claimand shall recite all the facts necessary to the identification of the lode or placer claim, aswell as adescriptionoftheclaimasstakedandmonumented,showingthelengthandapproximatecompassbearing,asnearasmaybe,ofeachsideorcourse thereof,andstating inwhatmanner therespectivecornersaremarked,whetherbystanding tree, rock inplace,post,orstone,andgivingindetailthedistinguishingmarksthatarewrittenorcutoneach,andalsostatingasaccuratelyaspossible,preferablybybearinganddistance,thepositionoftheclaimwithreferencetosomeprominentnaturalobjectsorpermanentmonuments.

    CHAPTERVISurveyandLeaseofMineralLands

    SECTION64. TheDirectorof theBureauofMinesmaydesignatecompetentmineralordeputymineral landsurveyors tosurveyminingclaimsforanynecessarypurposeundertheprovisionsof thisAct.He isalsoherebyempoweredtofix thebondsofdulyqualified deputymineral land surveyors and to issue the necessary regulations governing the execution and verification of surveys ofminerallandsinthePhilippines.AllapplicationsforofficialsurveysofminingclaimsshallbefiledwiththeDirectoroftheBureauofMinesandtheexpensesofsuchsurveysshallbepaidbytheapplicants.Theyshallbeatlibertytoemployanysuchdeputymineralsurveyortomakethesurveyatthemostreasonablerate.

    SECTION65.Atthetimeoftheofficialsurveythecornersofminingclaimsshallbemarkedwithconcretemonuments, ironpipes,orwithsuchotherobjectsofapermanentnatureasmaybeprescribedbyregulations.

    SECTION66.Inallsurveystheastronomicalmeridianshallbemadewithinthelimitsofaccuracyprescribedbyregulations.Afterthetechnicaladjustmentshavebeenmadetheresultingbearingsanddistancesbetweenconsecutivecornersascomputedfromtheadjusteddata,shallbeadoptedandrecognized.

    SECTION67.AnypersonauthorizedtolocateaminingclaimunderthisAct,havingclaimedandlocatedapieceoflandforminingpurposeswhohascompliedwiththetermsofthisAct,mayfilewiththeDirectoroftheBureauofMinesanapplicationunderoathforamining leasethereon,showingsuchcompliance.Aplanandatechnicaldescriptionof theminingclaimcoveredbytheapplicationshallbefiledtherewithorassoonthereafterasthesamemaybeobtainedfromtheBureauofMinesundertheprovisionsofthisAct.Inthecaseofanapplicationtoleaseaminingclaimlocatedonprivatelands,thesameshallbeaccompaniedbyawrittenauthorityoftheowneroftheland:Provided,however,Thatincaseofrefusaloftheownerofthelandtograntsuchwrittenauthority,thesameshallbegrantedbythecourtassoonastheapplicantdepositstheamountfixedasthevalueofthelandandascompensationforanyresultingdamageorfilesabond tobeapprovedby theCourtsufficient to insure thepaymentof the rentalof the landasdetermined inaccordancewithsectiontwentysevenofthisAct.Shouldtherehavebeennoproceedinginstitutedbytheapplicant,asprovidedforundersectiontwentysevenofthisAct, theCourtshalldeterminethevalueof the landandthecompensation foranyresultingdamageor its reasonablerental for thepurposesabovementionedandgrantthewrittenauthorityrequiredherein.

    SECTION68.Applicationforaleaseonminingclaimshallbefiledwithintwoyearsfromthedateoftherecordingoftheclaimintheofficeof themining recorderorwithin twoyears from thedateof theapprovalof thisAct.Failure to filesuchapplicationwithin theperiodabovementionedshallbedeemedanabandonmentoftheminingclaim,andthelandembracedwithinsuchclaimshallthereuponbeopentorelocationinthesamemannerasifnolocationofthesamehadeverbeenmade:Provided,Thattheoriginallocator,hisheirs,orhisassigns,whohasorhavethusfailedtofilealeaseapplicationontheclaimshallnotbeentitledtorelocate,directlyorindirectly,thelandembracedwithinsuchclaim,oranypartthereof.

    SECTION 69. A single application may be filed, and a single lease may be granted covering one or more miningclaims:Provided,Thatallsuchclaimstobeincludedunderoneleaseareadjoiningorcontiguoustoeachother,andareheldbythesameholder:Provided,further,Thatthetotalareaornumberofthesaidclaimstobecoveredbyasingleleaseshallnotexceedthemaximumarea,orthemaximumnumberofclaimsauthorizedtobeheldorleasedinanyprovinceordistrict,oronthesamevein,oronthesameplacergroundbyanyoneperson,association,orcorporation.

    SECTION70.AllapplicationsforminingleaseshallbeaddressedtotheDirectorofMines,sworntoandshallstate,amongothers:

    (a)Thenameandpostofficeaddressoftheapplicant,statingwhetherheisanindividual,hisfirstnameandsurnamebothpaternalandmaternal,hisbirthplace,ageandcitizenship,andcapitalintendedfortheexploitationoftheland,andifitisacorporationorassociation,statingitscompletetitleandaccompanying(1)acertifiedcopyofthedeedofpartnership,itsbylawsandrules(2)acertifiedlistofthestockholdersandpartners,withthedetailsabovespecifiedinsofarastheindividualapplicantsareconcerned,thenumberofshareshepossessesandtheamounthepaidforthem(3)acertifiedlistofitsboardofdirectorsandexecutiveofficers,withtheaddressoftheirofficesandresidencesand(4)incasethereareforeignstockholdersorpartners,thetotalamountofthesharesofeachoneoftheminthecapitalstock.(b)Thattheapplicationismadefortheexclusivebenefitoftheapplicantandnot,directlyorindirectly,forthatofanyotherpersonwhethernaturalorjuridicalwhoisdisqualifiedtoacquireaminingleaseunderthelaw.

    SECTION72.Uponreceiptoftheapplication,andprovidedthattherequirementsofthisActhavebeensubstantiallycompliedwith, theDirectorof theBureauofMinesshallpublishanoticethatsuchapplicationhasbeenmade,onceaweekforaperiodof threeconsecutiveweeks, in theOfficialGazetteand in two newspapers, one published inManila either inEnglish orSpanish, and the otherpublished in themunicipalityorprovince inwhich theminingclaim is located, if there is suchnewspaper, otherwise, in thenewspaperpublishedinthenearestmunicipalityorprovince.Thefirstpublicationofsuchnoticeshallbemadewithinthirtydaysafterthefilingoftheapplicationforlease,ifsuchapplicationisaccompaniedbyanofficialplanandtechnicaldescriptionoftheclaimorclaimscoveredbytheapplication,andthirtydaysafterthefilingoftheofficialplanandtechnicaldescriptionoftheclaimorclaimscoveredbytheapplication,ifsuchapplicationwasfiled inadvanceof thefilingofsuchplanandtechnicaldescription.TheDirectorof theBureauofMinesshallalsocausetobepostedonthebulletinboardoftheBureauofMinesthesamenoticeforthesameperiod.Theapplicantshallpostforthesame

    SECTION74.LeasesundertheprovisionsofthisActshallbeforaperiodnotexceedingtwentyfiveyearsfromthedateoftheexecutionoftheleasecontract,andshallberenewableundersuchtermsandconditionsasmaybeprovidedbylawforanotherperiodnotexceedingtwentyfiveyears.Thetotalperiodofanyleaseandtheextensionthereofshallnotexceedfiftyyears.Suchleasesshallprovidethat the lesseemay at any time during the life of the lease apply for the cancellation of the same, and surrender the property leasedwhenever,becauseofforcemajeure,orforothercauses,itisimpossibletocontinueprofitableminingoperationsthereon.Nosuchleaseor renewal thereof shall be assignedor subletwithout the prior consent of theSecretary ofAgriculture andCommercewhich shall begranted if theassignment or sublease is to suchpersons, associations, or corporationsashave thequalifications requiredof locators,holders,orlesseesundertheprovisionsofthisAct.

    SECTION 75. Leases may be granted covering mining claims located on private lands:Provided, That any exploration,occupation,useorleaseofanyprivatelandpursuanttothisActshallbesubjecttothepaymentofcompensationtotheownerthereofasprovidedinthisAct.

    SECTION76.SubjecttotheprovisionsofArticleXIIoftheConstitution,themaximumareathatmaybeleasedtoaperson,association,orcorporationundertheprovisionsofthisActinanyoneprovinceshallbeasfollows:

    SECTION77.EveryleasegrantedunderthisActshallcontainaclausebywhichthelesseeshallbindhimselftocomplywiththeprovisionsof thisActandwithsuchrulesandregulations for thepolicingandsanitationofmines,easements,drainage,disposalofwaste or tailings,water rights, rightofway, right ofGovernment survey and inspection, and other necessarymeans to their economicutilization,aswellassuchrulesforthepurposeofinsuringtheexerciseofreasonablediligence,skill,andcareintheminingoperationonthelandcoveredbythelease,asmaybepromulgatedbytheDirectoroftheBureauofMinesandapprovedbytheSecretaryofAgricultureandCommerce,underandpursuanttotheprovisionsofthisAct.

    SECTION78.EveryleasegrantedunderthisActshallbeconstruedasgrantingtothelessee,hissuccessorsorassigns,therighttoextractallmineraldepositsofthegroupforwhichtheleaseorleaseshadbeengrantedwithintheboundarylinesoftheclaimorclaims covered by the lease, continued vertically downward to removeandutilize the same for his ownbenefit, and to use the landscovered by the lease for the purpose or purposes specified therein:Provided, That in the case of leases covering placer locations thelesseeshallnotbeentitledtoextractmineralsfromanylodeorveindepositfoundwithintheboundaryofhis,its,ortheirplacerclaimsbut

  • the lessee shall have the preferential right to locate and lease such lode deposits. The same privilege shall be granted to lessee formineralsormineralproductsbelongingtodifferentgrouporgroupsfoundthereinupontheconditionthatthelesseeshallfirstcomplywiththerequirementsofthelaw.Anysuchlocation,occupation,use,orleasepermittedunderthisActshallreservetotheGovernmenttherightto grant or use such easements in, over, under, through, or upon lands so entered, located, occupied, leased or used, as may benecessarytotheworkingofthesame,orofothermineral lands:Provided,ThattheSecretaryofAgricultureandCommerce, ingrantinganyleaseunderthisActmayreservetotheGovernmenttherighttolease,sell,orotherwisedisposeofthesurfaceofthelandsembracedwithinsuchlease,underexistinglaworlaws,insofarassaidsurfaceisnotnecessaryforusebythelesseeinextractingandremovingthemineraldepositsfromthelandcoveredbysuchlease,orinbeneficiationoftheoresextractedtherefrom,orfromanyotherminingclaim.TheSecretaryofAgricultureandCommerce,duringthelifeofthelease,isauthorizedtoissuepermitsforeasementshereinprovidedtobereserved,andtopermittheuseofthelandscoveredbythelease,orofsuchotherpubliclands,asmaybenecessaryfortheconstructionandmaintenanceofmills,miningcamps,orotherworksincidenttotheminingandmillingoperationsonthelandscoveredbyanyleasegrantedunderthisAct,oronanyotherminerallands.

    SECTION79. For the privilege of exploring, developing,mining, extracting, and disposing of theminerals from the landscoveredbyhis lease, the lesseeshallpay to theGovernmentof thePhilippines, through theCollectorof InternalRevenue, the rentals,royalties,andtaxesprovidedbylaw.Therentalsshallbedueandpayableinadvanceonthedateofthegrantingofthelease,andonthesamedateeveryyearthereafterduringthelifeoftheleaseoranyrenewalthereoftheroyaltiesshallbedueandpayablewithinsixtydaysaftertheshipmentofthemineralormineralproductsfromtheminesandthetaxatthetimeandinthemannerallotherrealestatetaxesarepayableunderthelaw.Beforethemineralormineralproductsareremovedfromthemines,theCollectorofInternalRevenueorhisrepresentativesshallfirstbedulynotifiedthereof.Therentals,royalties,andtaxes,shallbeasfollows:

    (a)Rentals.Onallminerallandsofthefirst,second,fourth,andfifthgroupsprovidedforunderthisActonepesoperhectareorfractionthereof.Fiftypercentumofalltherentalscollectedshallaccruetotheprovince,andfiftypercentum,tothemunicipalityinwhichtheminingclaimorclaimsisorarelocated:Provided,Thatincaseofcharteredcitiesthefullamountshallaccruetothecityconcerned.(b)Royalties.Onallmineralsextractedfrom,ormineralproductsof,minerallandsofthefirst,second,fourthandfifthgroupsasprovidedforinthisActaroyaltyofoneandonehalfpercentumoftheactualmarketvalueofgrossoutputthereofProvided,Thatinthecaseofgoldmines,theirannualgrossoutputshallbesubjecttoaroyaltyofoneandonehalfpercentumwhenthevalueofthesaidoutputdoesnotexceedfivehundredthousandpesostwopercentumwhenthevalueexceedsfivehundredthousandpesosbutdoesnotexceedonemillionpesostwoandonehalfpercentumwhenthevalueexceedsonemillionpesosbutdoesnotexceedonemillionfivehundredthousandpesosthreepercentumwhenthevalueexceedsonemillionfivehundredthousandpesosbutdoesnotexceedtwomillionpesosthreeandthreeeighthspercentumwhenthevalueexceedstwomillionpesosbutdoesnotexceedtwomillionfivehundredthousandpesosthreeandthreefourthspercentumwhenthevalueexceedstwomillionfivehundredthousandpesosbutdoesnotexceedthreemillionpesosfourandoneeighthpercentumwhenthevalueexceedsthreemillionpesosbutdoesnotexceedthreemillionfivehundredthousandpesosfourandonehalfpercentumwhenthevalueexceedsthreemillionfivehundredthousandpesosbutdoesnotexceedfourmillionpesosfourandthreefourthspercentumwhenthevalueexceedsfourmillionpesosbutdoesnotexceedfourmillionfivehundredthousandpesosfivepercentumwhenthevalueexceedsfourmillionfivehundredthousandpesosbutdoesnotexceedfivemillionpesosfiveandoneeighthpercentumwhenthevalueexceedsfivemillionpesosbutdoesnotexceedfivemillionfivehundredthousandpesosfiveandonefourthpercentumwhenthevalueexceedsfivemillionfivehundredthousandpesosbutdoesnotexceedsixmillionpesosfiveandthreeeighthspercentumwhenthevalueexceedssixmillionpesosbutdoesnotexceedsixmillionfivehundredthousandpesosandfiveandonehalfpercentumwhenthevalueexceedssixmillionfivehundredthousandpesos:Provided,further,Thatthefollowingratesofdeductionfromtheroyaltiesontheannualgrossoutputofgoldpayableundertheprovisionsofthissectionshallbeallowed:

    (1)Fifteenpercentuminthecaseoflodeminesproducinggoldfromoreswhichaveragelessthantenpesos,butmorethansevenpesospertoncSEaDA

    (2)Twentyfivepercentuminthecaseoflodeminesproducinggoldfromoreswhichaverageslessthansevenpesosperton.Theaveragevaluepertonoforeshallbedeterminedbythetotalnumberoftonsmilledduringthatyearforanyparticularlodemine.(3)Thirtyfivepercentuminthecaseofgoldplacermines.Theterm"grossoutput"ofminesorminerallandsshallbeinterpretedastheactualmarketvalueofmineralormineral

    products,orofbullionfromeachmineorminerallandsoperatingasaseparateentitywithoutanydeductionformining,milling,refining,transporting,handling,marketing,oranyotherexpenses.Theoutputofanygroupofcontiguousminingclaimsshallnotbesubdivided.AlltheroyaltieshereinprovidedtobechargedshallaccruetothegeneralfundofthePhilippineTreasury,andshallbeinlieuoftheadvaloremtaxonthemarketvalueoftheoutputofminesprovidedtobeleviedandcollected,undersectionfifteenhundredthirtyfouroftheRevisedAdministrativeCode,asamendedbyActNumberedFourthousandfiftyeight.Incasemining iscarriedonuponprivate lands, theroyaltydueonthevalueof theoutputofsuchminesunderanyandallleases granted for the purposes shall be reduced by five per centum of the amount due to the Government under theprovisionsofthisAct,whichreductionshallbepaidbythelesseetothelandowner.Thisprivilegeshallnotbegrantedtoanypersonacquiringanoptiononthesurfacerightafteranymininglocationhasbeenmadeonthemineralfoundtherein.(c)Taxes.Allbuildingsandotherimprovementsbuiltinthelandleased,exceptmachines,mechanical,electricalandchemicalcontrivances,instruments,tools,implements,appliancesandapparatus,usedinconnectionwiththeminingandmillingoperationsonthelandleased,shallbesubjecttoanannualrealestatetaxwhichshallbepaidattherateandinthemannerallotherrealestatetaxesarepaidunderthelaw.Fiftypercentumoftherealestatetaxcollectedashereinprovidedshallaccruetotheprovince,andfiftypercentumofthesameshallaccruetothemunicipalityinwhichtheminerallandleasedislocated:Provided,Thatinthecaseofcharteredcitiesthefullamountshallaccruetothecityconcerned.

    IncontractsofleasegrantedunderthisAct,itshallbeprovidedthattherentals,royalties,andtaxes,shallbepayableinaccordancewiththeprovisionsofexistinglaw.

    SECTION80.FailuretopaytheannualrentalsorroyaltiesrequiredbythisActforaperiodofninetydaysafterdemandshallcausetheleaseconcernedtolapseandtheclaimorclaims,withrespecttowhichsuchfailuretopaywasmade,shallthereuponbeopentorelocationandleasebyotherpersonsqualifiedtolocateandleaseminingclaimsundertheprovisionsofthisActinthesamemanneras

  • ifno locationof thesamehadeverbeenmade,unless the lessee,hisheirs,executors,administrators,assignsor legal representativesshallhavepaidallsuchannualrentalsandroyaltiesdueandhaveresumedworkontheclaimorclaimsaftersuchfailureandbeforesuchrelocation:Provided,Thatnopersonwhomaybedelinquentinthepaymentofanyrentalorroyaltyhereinaboverequiredtobepaidonanyminingclaimorclaimsheldunderleasemayrelocatethesameoranyportionthereof:Provided,further,ThatnothinghereincontainedshallprecludetheGovernmentfromcollectinganyrental,royalties,ortaxesdue.

    SECTION81.Anyperson,association,orcorporationholdingaleaseundertheprovisionsofthisActshallperformduringeachyear,whiletheleaseisinforce,notlessthantwohundredpesosworthoflabor,orofimprovements,oneachminingclaimofthefirstandfifthgroup,andonehundredpesosworthoflabor,orofimprovementsoneachclaimofthesecondandfourthgroup:Provided,Thatinthecaseof a lease coveringagroupof twoormoremining claims leasedor held in common, the total amount of labor or improvementsrequiredforthesaidgroupmaybeconcentratedonanyoneofthesaidgroup,eitheronthesurfaceorundertheground.TheperiodwithinwhichtheworkrequiredtobedoneannuallyonallminingclaimsshallcommenceonthefirstdayofJanuarysucceedingthedateofthegranting of the lease on the said claim or claims, and shall be completed on or before the thirtyfirst day of December of the sameyear:Provided,further,Thatfailuretoperformtheannuallabororimprovementsrequiredhereinshallconstituteabandonmentonthepartoftheholderandthelandshallbesubjecttorelocationbyotherpersons.

    SECTION82.Actualexpendituresandcostofminingimprovementsbytheholderofaleaseorhisgrantors,havingadirectrelationtothedevelopmentoftheclaimorgroupofclaims,shallbeincludedintheestimateofassessmentwork.Theexpendituresmaybemade from the surface, or in running a tunnel, drifts, crosscuts, or trenches for the development of the claim or group of claims.Improvementsofanyothercharacter,suchasbuildings,machinery,orroadways,mustbeexcludedfromtheestimate,unlessitisclearlyshown that they are associatedwith actual excavations, such as cuts, tunnels, shafts, and so forth, and are essential to the practicaldevelopmentof,andactuallyfacilitate,theextractionofmineralsfromtheclaim,ortheleasehold.Laborperformedorimprovementsmade,ifany,duringtheperiodfromthedateoftherecordingoftheclaimtotheissuanceoftheleasethereon,ifthelocatororholderthereofortheir successor in interestshouldacquire the lease,maybecredited forassessmentworkon thesaidclaimorclaimsonly for the firstperiodoryearwithinwhichtheworkisrequiredtobedoneundertheprovisionsofthisAct.

    SECTION83.Atanytimeaftertheperformanceoftheannuallabororthemakingofimprovementsuponaminingclaim,butnotlaterthansixtydaysaftertheexpirationoftheperiodfixedbythisAct,thelesseeorsomepersoninhisbehalfcognizantofthefacts,shallmakeandfileforrecordwiththeminingrecorderoftheprovinceordistrictinwhichtheclaimissituatedanaffidavitinsubstanceasfollows:

    SECTION85.Intheeventthatanyminingleaseiscancelledbytheprocedureprescribedinthenextprecedingsectionhereof,theDirectorofBureauofMinesshall,withinthirtydaysafterthedateofsuchforfeitureorcancellation,causeanoticethereoftobeposted

  • onthebulletinboardoftheBureauofMinesandintheofficeoftheminingrecorderoftheprovinceordistrictinwhichsuchclaimorclaimscoveredby suchmining leaseare situated, and the lands covered thereby shall be thereuponopen to relocation and leaseunder theprovisionsofthisAct.STaCcA

    Theterms"grossoutput"ofminesorminerallandsshallbeinterpretedastheactualmarketvalueofmineralormineralproducts,orofbullionfromeachmineormineral landsoperatedasaseparateentitywithoutanydeductionformining,milling,refining,transporting,handling,marketing,oranyotherexpenses.Theoutputofanygroupofcontiguousminingclaimsshallnotbesubdivided.

    ThesaidadvaloremtaxshallbedueandpayabletotheGovernmentofthePhilippinesthroughtheCollectorofInternalRevenuewithinsixtydaysaftertheshipmentofthemineralormineralproductsfromthemines:Provided,Thatbeforeanymineralormineralproductmaybeshippedfromthemine,theCollectororInternalRevenueorhisrepresentativeshallfirstbedulynotifiedtothateffect:Provided,further,Thatuponfailuretopaytheadvaloremtaxhereinleviedwithinthetimeprescribed,thesamepenaltiesorliabilitiesasprovidedbyexisting laws for thecollectionofsuch taxesshallbe imposed:Provided, finally,That theadvalorem taxhereinprovided tobepaidandcollectedshallaccruetothegeneralfundofthePhilippineTreasuryandshallbeinlieuofanyroyaltyorotheradvaloremtaxesimposedbythisAct,andbysectiononethousandfivehundredandthirtyfouroftheRevisedAdministrativeCodeasamendedbyActNumberedFourthousandfiftyeight.

    CHAPTERVIITimberandWaterRights,RightsofWay,MinePersonnelandOfficersChargedwiththeExecutionoftheProvisionsofthisActSECTION89.AbonafideholderofaminingclaimorgroupofcontiguousclaimsunderthisAct,shallhavethegratuitousright

    tocuttreesortimberwithinsuchminingclaimorclaimsforuseinthedevelopmentoroperationofonlythesaidclaimorclaims:Provided,ThatthecuttingofsaidtimbershallbeinaccordancewiththerulesandregulationsprescribedbytheBureauofForestry:Andprovided,further,ThatthelandorlandscoveredbysuchminingclaimorgroupofclaimsarenotcoveredbyanyexistingtimberconcessiongrantedbytheBureauofForestry.

    SECTION90. Bona fideholders of amining claim or group of contiguous claims under this Act shall also be allowed agratuitous water right or rights for the development and operation of such claim or claims upon filing an application therefor with theDirector of the Bureau of Public Works in accordance with the existing law of waters and the rules and regulations promulgatedthereunder:Provided,Thatwaterrightsalreadygrantedorvestedthroughlonguse,recognizedandacknowledgedbythelocalcustoms,lawsanddecisionsofcourts,shallnot therebybe impaired:Provided, further,That theGovernment reserves the right to regulatewaterrightsandthereasonableandequitabledistributionofwatersupplysoastopreventthemonopolyoftheusethereof.

    SECTION91.Whenanymine,orminingclaimissosituatedthatforthemoreconvenientenjoymentofthebeneficialrightsonthesame,aroad,arailroad,tramway,electrictransmission,telephoneortelegraphline,oraerialtransportationtheretoortherefrom,o
