NATIVE AMERICAN CONFERENCEON PETROLEUM ENERGYNOVEMBER 16-17, 1996,

1.0 INTRODUCTION

Thirty-three Native American tribal members, council members, and other interested partiesgathered in Bartlesville, Oklahoma, to attend the Native American Conference on PetroleumEnergy on October 16 and 17, 1996, sponsored by the U.S. Department of Energy and BDM-Oklahoma, Inc. Tribes represented at the workshop included the Cherokee, Chickasaw, Hopi,Jicarilla Apache, Osage, Seminole, and Ute. Representatives of the Bureau of Indian Affairs031A), the Bureau of Land Management (BLM), and the Minerals Management Service (MMS)also attended. A list of Attendees is listed in Appendix A.

BDM-Oklahoma developed and organized the native American Conference on PetroleumEnergy to help meet the goals of the U.S. Department of Energy’s Domestic Gas and OilInitiative to help Native American Tribes become more self-sufficient in developing andmanaging petroleum resources.

1.1 PLANNING/PRE-CONFERENCE ACTIVITIES

A flyer describing the conference was developed and mailed to Native American tribal leadersand tribal offices in targeted states (Oklahoma, New Mexico, Arizona, Colorado, Utah, andNorth Dakota). Flyers were available at the sixth annual native Indian Energy and MineralsConference in Denver in August. Follow-up telephone calls to tribal offices also were made.Information about the conference was made available on the BPO home page, and a pressrelease was sent to all major cities in the targeted states.

1.2 THE CONFERENCE

The conference provided introductory training in petroleum energy topics to members of NativeAmerican Tribes who manage tribal mineral holdings, set policy, or work in the oil and gas

industry. Participants gained a broad perspective in petroleum geology hydrocarbonexploration and technologies that enhance hydrocarbon production.

Presentations by BDM-Oklahoma and BDM Petroleum Technologies technical staff included anoverview of petroleum geology focusing on how oil is formed, trapped, and discovered. Geologictools and technologies employed in the discovery and recovery of petroleum were discussedusing field data and examples. An introductory session on production technology included ahistorical perspective, oil field terminology, information about leasing and owners’ rights, andan overview of primary and secondary production methods and new technologies.

On the second day of the conference, a workshop on managing and complying with federalenvironmental regulations that impact hydrocarbon exploration, drillin~ and productionoperations generated a great deal of interest. The final session on doing business with the U.S.Department of Energy included information on how to identify, evaluate, and respond tocontracting or subcontracting opportunities and an introduction to resources on the Internet.

BDM-Oklahoma supported the conference with a tabletop exhibit and several tables of reportsof technical work funded by BPO and conducted on Native lands. The technical reports andother materials were well received by participants.

2.0 INTRODUCTION TO PETROLEUM GEOLOGY

The first session of the two-day Native American Conference on Petroleum Energy wasconducted as an introduction to petroleum geology in exploration and exploitation operations.Development of oil and gas prospects for drilling were discussed by introducing partiapants tothe process that geologists use to generate and confirm prospects. Exploration prospectdevelopment begins with subsurface mapping of formation tops from geological data or electriclogs. The prospective area is confirmed with 2D seismic data and detailed with 3D seismicdata if economics justify the cost of conducting a 3D seismic survey. Examples of correlatedelectric logs and seismic profiles were presented by viewgraph to give participants an idea ofthe types of data that geologist evaluate and map. Potential targets for various areas are eitherknown from geology of hydrocarbon-producing formations in nearby fields or in frontier areas,by projecting surface geology into the subsurface from surface outcrops. Viewgraphs wereshown to the partiapants of schematic diagrams of seismic wave propagation from a surfacesource to a reflector bed in the subsurface back to surface geophones and recording devices.Photographs of Vibroseis vibrator trucks and recording trucks in the field were shown tofamiliarize participants with noninvasive methods of acquiring seismic data.

The NIPER reservoir characterization program that includes Patrick Draw field and Bell Creekfield, both deposited in a barrier island environment, were discussed. The process forcorrelating subsurface reservoir cores with surface outcrops for characterization of hydrocarbonreservoirs was presented. The value of integrating reservoir characterization data with structure

and isopach maps, 3D seismic data interpretation, and “4D” seismic data to predict flowpathways of hydrocarbons, development of recovery strategies, and recovery predictions bysimulation was presented. The concept of “4D seismic data collection is defined with thefourth dimension being time. A new 3D seismic survey taken a 3 to 5 years after discove~ andstart-up of production sometimes allows geologists and engineers to see the movement ofhydrocarbons through the reservoir in order to identify potential areas where bypassedoil can berecovered by additional driUingor placement of injectionwells while the oil is still economicallyrecoverable. During the presentation, time was allowed for questioning and discussion of topicsincluded in the workshop. Viewgraphs were shown of land and offshore drilling rigs during thepresentation.

The final portion of the introduction to geology focused on developing a reservoir managementprogram for new and old hydrocarbon reservoirs. It was pointed out to all participants that thesooner in the life of an oil and/or gas field that a reservoir management strategy is developedand periodically revised as new data is collected, the better the potential for higher recovery.All of the data gathered during exploration, drillin~ loggin~ corina reservoir analysis/reservoircharacterization, and production operations are used in development of a reservoirmanagement strate~ and update of it. BDM/DOE /NIPER reservoir management projects werebriefly discussed in the final portion of the first session. The introduction to geology was wellreceived by participants at the workshop.

3.0 OIL AND GAS PRODUCTION

The second session on the first day of the conference opened with an overview of the oil andgas industry from Colonel Drake’s oil discovery in Pennsylvania in 1858 to current dayoperations. The overview included a history of the petroleum industry and the function of atypical oil company. It was pointed out that the majority, by far, of the wells currentlyproducing in the United States are marginal and stripper wells owned and operated by smallindependents. .

Petroleum industry practices were discussed along with examples. Government regulations,petroleum imports, exploration practices for oil and gas, drilling techniques and methodologies,production methodologies, marketin~ recent technology advances, and the future were covered.Drilling rigs, producing wells, and subsurface diagrams were shown and discussed in thecontext of how do producers find and produce petroleum. It was pointed out that well spacingon regular 5-, 10-, 20-, 40-, 80-, 160-, 320-, or 640-acre units is regulatory spacing rather thanspacing for the architecture of the reservoir. Mineral rights, drainage, and severed minerals fromthe surface were defined and described, as these pertain to non-Native American lands andNative American lands, along with some of the problems that can arise under variousconditions. The importance of insurance, bonds, and liability for regulatory control overenvironmental contamination, blow-out while drillin~ injury, abandonment of produced outwells, etc., provided areas for instruction and discussion. Petroleum and the environment were

touched upon as an introduction to increased regulatory control over the petroleum industry.Subsurface well construction of wells for production was described and shown on a viewgraph,along with a brief description that “oil pools” are not really pools but hydrocarbons in the porespace of rocks. The basics of petroleum production were touched upon in this session, alongwith drillingand production costs to operators and the price of domestically produced oil.

International aspects of the petroleum industry were covered in the later part of this session.U.S. and world production trends, reserves, supply and demand, consumption, and energyresources were the final topics of this session. It was pointed out that with domestic petroleumproduction declining that imports will continue to increase. Participants in this session wereinterested in how all of these factors would affect thefi tribes and/or production on tribal landsin a few years. There was a good response to this session with questioning throughout thesession and at the end of the session.

4.0 FEDERAL ENVIRONMENTAL REGULATIONSIMPACTING HYDROCARBON EXPLORATION, DRILLING,AND PRODUCTION OPERATIONS

Federal environmental regulations impacting hydrocarbon exploration, drillin~ and productionoperations were discussed along with examples of violations, penalties and fines for violations,and some economic impacts of implementing environmental regulations. Federal environmentalregulations covered in the workshop are the Resource Conservation and Recovery Act (RCRA),Safe Drinking Water Act (SDWA), Clean Water Act (CWA), Comprehensive EnvironmentalResponse, Compensation, and Liability Act (CERCLA), Superfund Amendments andReauthorization Act (SARA), Clean Air Act (CAA), Toxic Substances Control Act (TSCA), OilPollution Act of 1990 (OPA), Migratory Bird Treaty Act, Endangered Species Act, andHazardous Materials Transportation Act (HMTA).

Regulations for Native American Tribes with oil and gas production are contained in severalCode of Federal Regulations (CFRS) for the various federal agenaes administering theseregulations. Leasin& drillin~ and production operations are regulated by the BIA, MMS, andthe BLM. BIA regulations for leasin~ drillin~ and production operations are on public record in25 CFR for various Native American Tribes (Utes, Apache, Navajo, Shashone, Arapaho, Osage,etc.). The MMS regulates and distributes royalties for Native American Tribes with oil and/orgas production other than the Osage Tribe. MMS regulations for royalties are of public record in30 CFR Part 200. The BLM regulates operations and inspection of produang and storagefacilities on Native American Tribal lands other than the Osage Tribe. BLM regulations foroperations and inspection are of public record in 43 CFR Part 3160. Water contractrequirements on Native American Tribal lands are of public record in 25 CFR Part 159.Environmental affairs and inspections are administered by the Environmental ProtectionAgency (EPA), and the regulations are found in 40 CFR. Some of the participants requested

that these regulations be included in future workshops. These could be easily incorporated intoan expanded “on the road workshop.

It is also suggested that environmental regulations for downstream operations (gas processingplants, refineries, and chemical plants) be included in an expanded environmental workshop.Some of the Native American Tribes are investigating the feasibility of downstream processingand sales from hydrocarbons produced by the Tribe or produced by operators on Tribal lands.Adding a section on downstream environmental regulations will make the workshop of interestto a larger audience. An increase in length of the workshop will allow more time for interactionwith participants, more time for questions, and time to cover an expanded curriculum. Whenthis workshop is taken “on the road,” part of a second day could be devoted to fieldinvestigationto draw on a larger audience.

5.0 HOW TO DO BUSINESS WITH THE U.S. DEPARTMENTOF ENERGY

The fourth session addressed how to do business with the federal government. It dealt withprocurements funded directly by the government or via subcontracts with prime contractors. Itconsisted of three segments. The first segment was a general overview of the federalprocurement process, including some of the special provisions and the types of soaoeconomicprograms which might be of interest to the target audience. The second was a detailed look at agovernment solicitation and how to prepare and submit proposals in response to thesolicitation in order to maximize the potential of winning an award. The third segment was anintroduction to the variety of resources available on the World Wide Web for small businessesinterested in government procurement opportunities. It included a hands-on demonstration withthe use of a laptop computer projected on the overhead screen. Each segment wasapproximately one hour in length with a 15-minute break between the first and secondsegments. The participants were encouraged to ask questions at any point in the presentationsin order to promote meaningful dialogue and increase the dissemination of useful information.

In addition to the presentations, the participants received a number of handouts for referencematerials. Each attendee received a copy of the brochure “Doing Business with BDM-Oklahoma,” a listing of regional Small Business Administration offices, and a listing of Internetprocurement search sites. In addition, there was a variety of information which was availablefor viewing at display tables due to limited quantities. This material included the DOE Guide to

Submission of Unsolicited Proposals, samples of the home pages for procurement at a number ofDOE labs, and other topical material. The attendees were able to request additional copies ofthe “view only” data for forwarding upon availability.

6.0 EVALUATION/FOLLOW=UP

Evaluation forms were passed out to participants following each workshop session. The formsare compiled in Table 6-1. In general, the participants were pleased with the content of theconference and recognized the potential to tailor presentations if the audience were morehomogeneous in its technical background or training needs. A follow-up packet with a letter,certificate, list of attendees, and handouts and other requested materials was sent to eachconference attendee. Copies of the evaluation sheets filled out by the attendees are in AppendixB, and a summary of these comments for each session is in Appendix C.

7.0 FUTURE PLANS

The training offered at the conference is the first in a series of workshops that will bedeveloped. Through contacts made at the conference, BDM-Oklahoma will work closely withindividual tribes, tribal councils, and tribal energy companies to bring training tailored to theirparticular needs to them. The training team has the capability and the resources to developintroductory modules for nontechnical staff, as well as technical modules that focus on thegeological characteristics of the tribes’ holdings.

Provide better introduction and transition between speakers-prepare us for what’scoming.The material on offshore operations didn’t seem relevant to Tribal interests, I suggestthat you drop it.Follow along handouts.Have handouts to follow the lecture.A bigger and louder TV.Focus and direct the material towards a specific audience instead of broad base.Need more handouts on how production takes place.Overhead handouts for taking notes during presentation would help.It’s pretty good just as it is.More emphasis on onshore production and lesson offshore.

Enjoyed presentation, would recommend to anyone associated with oil and gas.Breakdown of costs/operations components of Environmental Management—industry-wide or case by case.This is an area where my staff and I have very limited knowledge and need moretraining and also keep up to date on changes. Hope you can do presentations of thiskind in the Southwest. I would liketo suggest that your conferences should bescheduled in other months except October. This is the time of the year thatgovernment employees have no money for trainin~ travel, etc.Very good topic of discussion, and very good presentation.
