Councilman Pawlak, moved the following resolution; RESOLVED, that all appointive offioes be deolared vacant beoause of the expiration of the term of the Official appointees by virtue of the authority vested in the Jloard to terminate said offices. THEREFORE BE IT, RESOLVED, that the Supervisor when present, shall preside at the meetings of the Town Board. In the' absenoe of the Supervisor, the other members shall designate one of their members to aot as temporary ohaiman. WHEREAS. a Judgment for cost in the Appellate Divisionwas entered in the aforementioned proCeeding in the Brie CountyClerk's Office on March 14th, 1941, in the sum of $114.59, and

WHEREAS. jUdgment for the costs, in the Court of Appeals inthe aforementioned proceedfng was entered in the Erie County Clerk'aOffice on January 24th.. 1941, in the sum ot $22.75, and

WHEREAS. there are now pending certain certiorariproceedings brought against the Assessors of the Town of Cheek­towaga for the purpose of obtaining a reduction in the assessedvaluation of properties located in the ~own of Cheektowaga andowned by the Delawaref ~ckawanna & Western Railroad Company,and by the New York, "'ackawanna & Western Railroad Company, and,

WHEREAS. the aforementioned pro~eedings are based onthe contention that thE/-Assessors of the :l:own of Cheektowagafailed to take account of and properly evaluate the factor ofearnings, otherwise known as the factor of economic depreciationin determining the assessed valuations of the properties of thesaid railroads, and

WHERJ~AS. The courts of New York have decided that thefactor of economic depreciation must be considered in arrivingat a proper evaluation of properties, and

WHEREAS. the said railroads have offered to compromisethe controversies and to stipulate the discontinuance of all andany certiorari proceedings now pending, providing that the as­sessments of the properties of the said railroads located in theTown of Cheektowaga for the year 1938 be reduced in the sum of$401,687.50 and for the year 1939 in the amount of '396,337.50,and for the year 1940 in the amount of $389,912.50 and for theyear 1941 in the amount of $381,411.25, a total of $1,569,348.75and that this amount of assessed valuation be deducted fram theassessed valuations of the properties of the said railroads tothe extent of $523l 116.25 for the year 1942 and $523,116.25 forthe year 1943 and ~523.1l6.25 for the year 1944, and

\YHER~AS. the Town Board. in consideration of the de­cisions of the courts of New York State, the testimony of theBoard of Assessors, the arguments of counsel for the railroads,computations and other statements of the State Tax Commissionand advice of its own counsel and accountants,

BE IT RESOLVED that the Board of A~sessors of the 'fownof Cheektowaga be and it'hereby is authorized and directed to re­duce the assessed valuation of the ~roperties of the said railroadsfor the year 1942 in the amount of '523,116.25 and for the year1943 by the amount of $523 116.25, and for the year 1944 by theamount of $523 116.25 it being specifically understood and agreedupon that suCh' reductIons are for the purpose of taking necessaryaccount of the factor of economic depreciation for the years 1938,1939," 1940, and 1941 and are not to be construed as in any wayagreeing, admitting, stipulating or otherwise showing the taxablevalues of the properties of said railroads and,

BE IT FURTHER RESOLVED, that this direction and authori­Bation is conditioned upon the said railroads discontinuing anyand all certiorari proceedings now pending and agreeing furtherto the limitation of this agreement as set forth in the paragraphnext preceeding, and that the stipulation of discontinuance bedelivered to the Town of Cheektowaga, upon the carrying out by theBoard of Assessors the aforementioned directions.

BE IT RFSOLVED, that the Supervisor be and he hereb7 isauthorized to write the New York Telephone Company to arrange forthe installation of a telephone in the Town Hall for the exclusivereceipt and transm'ssion of Defense information and for the in­stallation of Police Call Boxes outside each fire house, togetherwith a telephone extension inside each Fire House, and to pay theinstallation charge of $21.00, to~ether with the monthly ~harge ot$47.50. This arrangment and agreement to be made by the ~pervisorwhen and if the Fire Commissioners of each Fire District enter intocontracts with the Town of Cheektowaga by Which each District shallpay to the Town of Cheektowaga the sum of $5.50 each month, whichsum shall then be paid over by the Supervisor to the New York Tele­phone Company, except Doyle .I;"ire District Which shall pay the sumof $.11..00.

~TEREAS, a petition was duly presented to this Town Board onthe 24th day of February 1942, for the establishment, as a drainagedistrict, of certain territory wholly'situate in this Town outside ofany incorporated city or village, and,

WHEREAS, said petition also ~equests and proposes the acqui­sition by purchase, wholly at the expense of said district, of the .~

xistin~ drainaGe system, ri~hts of way and appurtenances shown uponthe Map and plan, which accompanied the petition heretoibre filed inthe office of the Town Clerk SUbject to the terms and conditions oftwo certain agreements for rights of way, or easements respectively,one of which agreements was entered into between Mary Lorenz and KatieFrie's as l!:xecutors or' the Last Will and Testament of George Lorenz,deceased, and Curtiss-Wright Corp8ration, dated January 13, 1941, whichagreement was recorded in the Erie County Clerk's Office January 13,1941, in Liber 3068, at Page 65, and the other of which agreements wasentered into between the New York Central Railroad Company and Curttas­Wright Corporation, dated February 26, 1941, and which arrangement wasrecorded in the Erie County Clerk's Office March 20, 1941, in Liber3084 of Deeds at Page 103, and,

WHEREAS, the maximum amount proposed to be expe~ded'for suchimprovement, as stated in said petition, is One Hundred and Ten Thou­sand Dollars ($l~O,OOO.OO), and

Fields, Engineer, to com-­plete the Zoning Map, and such other work as may be required in order ",to properly adopt a Zoning Ordinance and map for the Town of' Cheektowaga.
