WHEREAS. Section f:IJ of the Town~ provides that the Town Boardin first olass Towns shall oonsist of a Supervisor and four Counoilmen. whichBoards are vested with all the powers of· the Town.

THEREFORE BE IT,

RESOLVED, that the Supervisor when present, shall preside at themeetings of the Town Board. In the' absenoe of the Supervisor, the other membersshall designate one of their members to aot as temporary ohaiman. A .jority ofthe Board shall constitute a quorum for the transaction of business. but a lessermay adjourn. 1he vote upon every question shall be taken by ayes and noes andthe name of the members present and their votes shall be entered in the mi!Jl1tes.Every aot. motion or resolution shall require for its adoption the affirmativevote of a majority of all the members of the Town Board. The Board may determinethe rules of its prooedure. and the Supervisor may. fran time to time, appointone or more committees, consisting of members of the Board. to aid and assistthe Board in the performance of its duties, and

WHEREAS. a judgement for cost on confirmation ot:referee'sreport in a certain certiorari proceeding brOught by the NewYork Central Railro~d against the Town of Cheektowaga, was enteredin the Erie County lerk's Office on April l6t~ 1940 in the sumof $2579.80, and

WHEREAS. a Judgment for cost in the Appellate Divisionwas entered in the aforementioned proCeeding in the Brie CountyClerk's Office on March 14th, 1941, in the sum of $114.59, and

WHEREAS. jUdgment for the costs, in the Court of Appeals inthe aforementioned proceedfng was entered in the Erie County Clerk'aOffice on January 24th.. 1941, in the sum ot $22.75, and

WHEREAS, the New York Central Railroad throug\l ita attorneysRann, Brown, Sturtevant & Kelly have offered to settle' these judgmentaupon payment of the net amount, namely $2717.14 without any amountin addition thereto for intereat.

WHEREAS. there are now pending certain certiorariproceedings brought against the Assessors of the Town of Cheektowaga for the purpose of obtaining a reduction in the assessedvaluation of properties located in the ~own of Cheektowaga andowned by the Delawaref ~ckawanna & Western Railroad Company,and by the New York, "'ackawanna & Western Railroad Company, and,

WHEREAS. the aforementioned pro~eedings are based onthe contention that thE/-Assessors of the :l:own of Cheektowagafailed to take account of and properly evaluate the factor ofearnings, otherwise known as the factor of economic depreciationin determining the assessed valuations of the properties of thesaid railroads, and

WHERJ~AS. The courts of New York have decided that thefactor of economic depreciation must be considered in arrivingat a proper evaluation of properties, and

WHEREAS. the said railroads have offered to compromisethe controversies and to stipulate the discontinuance of all andany certiorari proceedings now pending, providing that the assessments of the properties of the said railroads located in theTown of Cheektowaga for the year 1938 be reduced in the sum of$401,687.50 and for the year 1939 in the amount of '396,337.50,and for the year 1940 in the amount of $389,912.50 and for theyear 1941 in the amount of $381,411.25, a total of $1,569,348.75and that this amount of assessed valuation be deducted fram theassessed valuations of the properties of the said railroads tothe extent of $523l 116.25 for the year 1942 and $523,116.25 forthe year 1943 and ~523.1l6.25 for the year 1944, and

\YHER~AS. the Town Board. in consideration of the decisions of the courts of New York State, the testimony of theBoard of Assessors, the arguments of counsel for the railroads,computations and other statements of the State Tax Commissionand advice of its own counsel and accountants,

BE IT RESOLVED that the Board of A~sessors of the 'fownof Cheektowaga be and it'hereby is authorized and directed to reduce the assessed valuation of the ~roperties of the said railroadsfor the year 1942 in the amount of '523,116.25 and for the year1943 by the amount of $523 116.25, and for the year 1944 by theamount of $523 116.25 it being specifically understood and agreedupon that suCh' reductIons are for the purpose of taking necessaryaccount of the factor of economic depreciation for the years 1938,1939," 1940, and 1941 and are not to be construed as in any wayagreeing, admitting, stipulating or otherwise showing the taxablevalues of the properties of said railroads and,

BE IT FURTHER RESOLVED, that this direction and authoriBation is conditioned upon the said railroads discontinuing anyand all certiorari proceedings now pending and agreeing furtherto the limitation of this agreement as set forth in the paragraphnext preceeding, and that the stipulation of discontinuance bedelivered to the Town of Cheektowaga, upon the carrying out by theBoard of Assessors the aforementioned directions.

No objections, Supervisor Zalemskl ordered the communjcatlon from the International Railway Co. relative to theoperation of buses on William, Clinton, Porter Best or Sycamoreroutes received and filed.

No.objections, the Supervisor, referred the petitionfrom the Tax Payers and Residents in and along Cayuga Creek Rd.relative to unsanitary conditions caused by burning of garbagein that territory, to the Public Health Committee, Town Atty.,Chief of Police and Health Officer for investigation.

WT1F.REAS, this Town Board believes that the exclusionfrom the definition Qf the term "special franchise" as providedfor in Section 2, sub-division 7 of the Tax Law reading as follows:

"The Term 'special franchise' shall not be deemed toinclude the crossing of a street, highway or public place outsidethe limits of city or incorporated Village where such crossing isless than two hundred and fifty feet in length, unless such crossing be the c··.ntinuation of an occupancy of another street, highway or public place. This sub-di'lision shall not apply to anyelevated railroad."

WHEREAS~ it is the thOUght of this board that suchfactor should not properly be considered in the making of suchvaluation, ,

The Town Clerk then read the order from the Public Service Commission and being Case No. 6582, No objections, the Supervisor ordered this order received and tiled.

Communication from the New York Telephone Co. was read.Stating that nothing could be done relative to changing the ratesin the U-Crest District as per request from Mrs. Edward Fisher,during the War Emergency, but they would be glad to study the situation after the war to see what can be done to help the matter inquestion, No objections, Sup~rvisor Zalemski ordered this communication tabled for further consideration.

The William Street Citizens And Taxpayers ProtectiveAssln., entered a complaint about snow and ice on the sidewalkson South side of William Street between Medina and Wagner Streets.No objections, Supervisor Zalemski referred this complaint to theSupt. of Highways, Mr. Zablotny.

The Secretary of the Rescue Volunteer Hose Co. No. 1Inc., presented a lett~r to the members of the Town Board thankingthem- iii'behalf of, the .(}&mpany for the appointment of one of theirmembers to the Police Department, Supervisor Zalemski ordered thisletter received and filed, No. objections.

WT-lEREAS, the Inter.national Ranway Company has petitionedthis Town Board for consent to operate Motor Buses in Delavan Ave.between the Westerly Town line of the Town of Cheektowaga and PineRidee Road; in Pine Rid~e Road between Delavan Ave. and GeneseeStreet; and in Genesee treet between Pine Ridge Road and a loopon private property west of Pine Ridge Road.

. WUltRFAS Civilian Defense Authorities have requested·that the Town of Cheektowaga, maintain a separate telephone for thereceipt and transmission of Defense information from the Defense .Headquarters to the Town Hall and from there to the various FireHouses in the Town of Cheektowaga.

NOW, THEREFORE,

BE IT RFSOLVED, that the Supervisor be and he hereb7 isauthorized to write the New York Telephone Company to arrange forthe installation of a telephone in the Town Hall for the exclusivereceipt and transm'ssion of Defense information and for the installation of Police Call Boxes outside each fire house, togetherwith a telephone extension inside each Fire House, and to pay theinstallation charge of $21.00, to~ether with the monthly ~harge ot$47.50. This arrangment and agreement to be made by the ~pervisorwhen and if the Fire Commissioners of each Fire District enter intocontracts with the Town of Cheektowaga by Which each District shallpay to the Town of Cheektowaga the sum of $5.50 each month, whichsum shall then be paid over by the Supervisor to the New York Telephone Company, except Doyle .I;"ire District Which shall pay the sumof $.11..00.


Supervisor Zalemski stated that this was the time andplace to open advertised bids for Trucks for the Garbage departmentand cars for the Police Department and as advertised in the DepewHerald and Cheektowaga News.

A petition for the creation of a drainage district in theTown of Cheektowaga, Erie County, New York, pursuant to provisionsof Article 12 of the Town Law of the State of New York was presentedand read.
