The condition that must be met

and subsequent l y removed ,

requires the investment project to

create or preserve at least 10 full-

time jobs over two years. Only

then can investors and their

families already living in the U.S.

become Permanent Residents of

U.S.

The Key to JTH Lawyers clients’

immigration success are the public

school projects in which our clients

invest.

Education is one of the main

motivations for individuals and

families seeking permanent, legal

residency in the U.S., JTH Lawyers

supports investment projects

completely in line with client’s

immigration goals.

A public charter school is an

independently run, tuition-free

public school offering primary and

secondary education. Build and

managed by a private group, public

charter schools receive state

g o v e r n m e n t f u n d i n g .

Public charter schools are among

the fastest growing school choice

options in Florida.

Frequentl y Asked Quest i ons

How do I certify the legal source of my$500,000 investment?

I would like to visit the project andpersons involved in the U.S. Is thispossible?

What kind of job creation isrecognizedbytheUSCIS?

When applying for removal ofconditional status, what must bestablished?

Charter School Projects’ team is

comprised of professionals with

highest-level executive and

internat ional banking and

finance backgrounds. Members

also bring highly specialized,

successful track records in the

legal, commercial real estate,

economic and governmental

domains. With more than 25

years in the EB-5 Visa arena,

ours are some of the most

experienced individuals in the

profession.

We work closely with state

gove rn me nt o f f i c i a l s and

representatives leading our

Florida public charter school

investment projects. This model

and these relationships are

important as essentially all of

Char ter Schools are s ta te

government backed projects.

JTH Lawyers has helped over

thousands of applicants over 70

countries to immigrate to North

America by Investments (Canada

& U.S.). JTH Lawyers has been

involved in EB-5 Charter Schools

since the first project in 2011.

JTH Lawyers also work closely

with established U.S. attorneys

throughout the application

process.

Many sources are accepted as legal: Capital earned from a legitimate business, appreciation of real estate investments, inheritance, lottery winnings, and so on. For more details, inquire with our lawyers.

You can vis i t the completed p r o j e c t s a n d t h o s e u n d e r construction. Our Florida team can introduce you to the key partners of the project. Should you wish to visit us, give us your tentative visit date and we will arrange your visit.

investment, the program requires

the completion of 10 full-time jobs

created directly by the project

( exc lud ing the ind i rec t jobs

calculated by economic modeling).

However, if the project is from a

regional center (such as the EB-5

Charter School Projects) , the

calculation of indirect and induced

jobs based on an approved

e c o n o m i c m e t h o d o l o g y i s

accepted, making the criteria much

easier to meet.

EB-5 Charter School Projects

mandate an independent analyst

to estimate the job creation

required to remove the condition

attached to the Green Card (report

available).

USCIS bases its decision on a

comparison between the investor’s

job creation forecast indicated in

the I-526 petition and the actual

job creat ion at the t ime of

submission of the petition for the

removal of the condition (I-829

petition).

Full-time means working 35 hours

or more per week Workers must be

ide nt i f i e d as U . S . qua l i f i e d

workers.

What kind of benefits andconveniences doesa U.S. Green Cardprovide?

The immigration officer assesses

wh e t h e r t h e in v e s t m e n t o f

$500,000 has indeed been invested

in the manner indicated in the

I-526 and has led to the creation of

the least 10 full-time jobs and

whether it is realistic to expect that

the jobs created will be sustained

for a reasonable period. If the

answers to those questions are

positive, the I-829 petition should

be approved and the condition

removed.

E v e r y o n e h a s t h e i r o w n

motivations for resettling in the

U.S. Having a Green Card greatly

facilitates this plan and brings

many conveniences. People with

the permanent right to settle in the

U.S. through the EB-5 Immigrant

Investor Visa Program are granted

the same rights as other U.S.

citizens. The Green Card also gives

you, your spouse and children

under 21 the right to sett le

anywhere in the U.S. and exit and

visit the country as you please.

The United States is home to many

of the world’s best international

institutions for basic education and

post-graduate study. As a U.S.

res ident , inves to r s can pay

relatively lower tuition fees at these

elite schools. The cost of living in

the United States is less than many

other large, advanced countries.

Consumer goods, services, and

housing are also much cheaper

than in many countries.

American citizens are entitled to

many social rights and goods, such

as public schooling, health and

medical assistance, social security

for retirement and more. As a

permanent Green Card holder, you

are granted these same basic

entitlements.

Permanent residents do not need

to update and reapply for work or

residence status in the U.S. Other

U . S . n o n - i m m i g r a n t v i s a

categories, such as E-2 and H, are

not often granted permanent

residency. These visa categories

usually have time limits, which

require you to resubmit additional

materials to the Department of

I m m i g r a t i o n o r e x t e r n a l

departments for visa renewal. And

there is always the chance that

your renewal will not be approved.

Permanent residency with an

unrestricted green card means

your status never needs to be

renewed.
