Meeting of the Parliament

2.00 pm Time for Reflection – Reverend David Gordon, Minister, Kirkintilloch Baptist Church

followed by Parliamentary Bureau Motions followed by Topical Questions 1. Christine Grahame: To ask the Scottish Government whether it will provide an update on its flood prevention programme. (S4T-00122)

2. Hugh Henry: To ask the Scottish Government when the Cabinet Secretary for Education and Lifelong Learning first became aware that there would be a reduction in college budgets for 2012-13. (S4T-00132) followed by Scottish Government Debate: Air Passenger Duty S4M-04874 Keith Brown: Air Passenger Duty—That the

Parliament notes with concern the recent report by York Aviation on behalf of Aberdeen, Edinburgh and Glasgow airports regarding the impact in Scotland of rises in the UK Government’s air passenger duty (APD); particularly notes that rates for short-haul services have increased by around 160% since 2007, with long-haul rates increasing by up to 360% over the same period and further increases planned, at a time when Scotland and the rest of the UK have been experiencing one of the worst recessions in living memory; further notes that APD is the most expensive aviation duty in Europe and that increases in rates since 2007 and those projected through to 2016 are estimated to result in a loss of 2.1 million passengers to Scotland’s main airports per year and that, as a consequence, by 2016 £210 million less will be spent in Scotland per year by inbound visitors; also notes that direct flights are more environmentally efficient than the multi-stop journeys via overseas hub airports that APD currently incentivises; believes that the only way to properly support the ambitions of Scotland’s aviation industry, the needs of passengers and the growth of Scotland’s economy is for APD to be devolved to Scotland, as has happened in large measure in Northern Ireland, and that this should take place as soon as possible, and further believes that, as a measure to provide some immediate respite to the aviation industry, passengers and businesses, the UK Government should announce a freeze in APD levels.

The Presiding Officer has selected the following

amendments S4M-04874.3 Richard Baker: Air Passenger Duty—As

an amendment to motion S4M-04874 in the name of Keith

Brown (Air Passenger Duty), leave out from ―the only way‖ to end and insert ―the Scottish Government should work with Scottish airports and airlines operating in Scotland to explore what further incentives might be put in place to reduce carbon emissions in the industry; notes that the previous Scottish administration introduced the route development fund to bring new routes to Scottish airports; recognises that the Calman Commission on Scottish Devolution recommended that APD should be devolved and that the Scotland Bill Committee found a strong case for devolving APD and that this will inform the work of the Devolution Commission; further recognises that APD on long-haul flights has already been devolved to the Northern Ireland Assembly, and believes that devolution of APD to Scotland should form part of an immediate wider review of APD by the UK Government, which should, as a first step to addressing the current concerns over APD in Scotland, take immediate action to resolve the anomaly whereby passengers in Scotland pay APD twice through making journeys to UK hub airports.‖

S4M-04874.2 Alex Johnstone: Air Passenger Duty—As

an amendment to motion S4M-04874 in the name of Keith Brown (Air Passenger Duty), leave out from ―also notes‖ to end and insert ―therefore encourages the UK Government to do what it can to help the industry, and calls on the Scottish Government to justify its refusal to use its existing powers to bring forward a suitable replacement for the route development fund.‖

S4M-04874.4 Willie Rennie: Air Passenger Duty—As

an amendment to motion S4M-04874 in the name of Keith Brown (Air Passenger Duty), leave out from ―with concern‖ to end and insert ―the debate around the future of air passenger duty (APD); agrees that APD should be a tax exercised at a Scottish level by the Parliament as part of a federal UK, with tax powers and responsibilities shared between different levels of government in the UK; notes that returning the level of APD to 2007 levels as discussed in a recent York Aviation report would result in a loss of around £90 million to the Scottish Government, and calls on those who advocate such a change to set out their proposals to reduce public spending to match the reduction in tax receipts.‖

S4M-04874.1 Patrick Harvie: Air Passenger Duty—As

an amendment to motion S4M-04874 in the name of Keith Brown (Air Passenger Duty), leave out from ―the recent report‖ to end and insert ―that greenhouse gas emissions from the aviation sector in Scotland have risen relentlessly

and were 118% higher in 2009 than in 1990; considers that continual aviation growth is incompatible with the climate change targets that were agreed unanimously by the Parliament in 2008 and reaffirmed unanimously in 2012, and supports the use of financial measures such as air passenger duty, alongside other approaches, to restrain the growth of aviation emissions within limits that do not threaten the goal of a low-carbon Scotland.‖

with Duchenne Muscular Dystrophy—That the Parliament commends the work of Action Duchenne in supporting boys and men across the Lothians and the United Kingdom who are living with Duchenne muscular dystrophy (DMD), which affects one in every 3,500 male births in the UK; welcomes what is considered groundbreaking research such as the AAV U7 trial being conducted at Royal Holloway College, University of London, into potentially highly effective ―exon skipping‖ treatment for the currently incurable muscle-wasting disease; recognises that DMD is caused by a genetic variation in the dystrophin gene and can result in boys affected requiring a wheelchair by the ages of 8 to 11; notes that the current research is expected by Action Duchenne to produce the first wave of genetic medicines by 2014, with the potential to benefit at least 14% of patients, and has the potential to realise even more successful treatments in the future; believes that a simplified means of clinical trials for genetic medicines should be explored to promote further research, and looks forward to continued work toward improvements in the care and treatment of the boys and men living with DMD and the ultimate goal of an effective cure.

Section F – Motions and Amendments

Motions and amendments are normally printed the day after they are lodged. If an amendment is lodged to a motion then the original motion will appear alongside the amendment, along with any support lodged that day, in this section.

Each Monday, this section also contains all motions and amendments lodged the previous week that are still live and any motions and amendments that have been lodged for debate in the coming week. A motion or amendment is live if it has not been debated, withdrawn or otherwise deleted from the list.

Where a motion or amendment has been withdrawn, it is indicated in this section the day after it has been withdrawn. Support for motions and amendments received after they are lodged is shown at the end of this section the day after such support is received.

Motions and amendments can be published with various symbols:

Asterisks before the motion or amendment number indicate a motion or amendment published for the first time;

Asterisks also identify alterations to the text of a motion or amendment made since it was first published;

A hash symbol identifies motions eligible for debate at Members’ Business;

A diamond symbol identifies motions lodged for Members’ Business that have not yet attracted the required cross-party support;

An "R", identifies motions or amendments in which the Member who lodged it has a registrable interest.

The Parliamentary Bureau periodically deletes motions or amendments not scheduled for debate and which are over six weeks old.

A search facility is also available on the Scottish Parliament web site at http://www.scottish.parliament.uk/parliamentarybusiness/28877.aspx.

Any questions in relation to this section should be directed to the Chamber Desk, for which contact details are provided at the end of the Bulletin.

that, since 1998, FET has secured and allocated around £3.5 million toward local environmental projects; further notes that in the past year grants have been awarded to various projects, including Dunmore Pineapple Greater Crested Newts, Stepping Stones for Wildlife, Dollar Park Walled Garden, Westquarter Glen Environmental Improvements, Blinkbonny Sensory and Wildlife Gardens, Dale Bridge Replacement, Furnace Lade Access Improvements, River Avon Restoration, River Carron Invasive Species, River Carron Clean-up, Jupiter Urban Wildlife projects and Drumbowie Sensory Walkways, and looks forward to continued support for many more environmental improvement projects in future years.

*S4M-04875♦ Adam Ingram: Scottish Coal Industry—That the Parliament recognises the importance of the coal industry, which it considers has been and remains a significant contributor to local and rural economies in East Ayrshire, Fife, South Lanarkshire, Dumfries and Galloway, North Lanarkshire, Midlothian and West Lothian; considers the industry a mainstay occupation in the Scottish economy, generating £450 million of economic value to Scotland every year and, with its wider supply chain, employing on average 4,000 people; welcomes the fact that two Scottish projects are being considered to take forward the next phase of the UK Government’s £1 billion carbon capture and storage programme to demonstrate the potential to greatly reduce the carbon impact of fossil fuel power generation as Scotland moves to a low-carbon future, but is concerned that future investment in the industry is being threatened by an adverse and unintended effect of the carbon reduction commitment and proposals by the Office of the Rail Regulator to hike freight access charges for Scottish coal producers.

Supported by: Bill Kidd*, Bill Walker*, Brian Adam*, David Torrance*, Gordon MacDonald*, Joan McAlpine*, Colin Beattie*, George Adam*, Roderick Campbell*

*S4M-04874 Keith Brown: Air Passenger Duty—That the Parliament notes with concern the recent report by York Aviation on behalf of Aberdeen, Edinburgh and Glasgow airports regarding the impact in Scotland of rises in the UK Government’s air passenger duty (APD); particularly notes that rates for short-haul services have increased by around 160% since 2007, with long-haul rates increasing by up to 360% over the same period and further increases planned, at a time when Scotland and the rest of the UK have been experiencing one of the worst recessions in living memory; further notes that APD is the most expensive aviation duty in Europe and that increases in rates since 2007 and those projected through to 2016 are estimated to result in a loss of 2.1 million passengers to Scotland’s main airports per year and that, as a consequence, by 2016 £210 million less will be spent in Scotland per year by inbound visitors; also notes that direct flights are more environmentally efficient than the multi-stop journeys via overseas hub airports that APD currently incentivises; believes that the only way to properly support the ambitions of Scotland’s aviation industry, the needs of passengers and the growth of Scotland’s economy is for APD to be devolved to Scotland, as has happened in large measure in Northern Ireland, and that this should take place as soon as possible, and further believes that, as a measure to provide some immediate respite to the aviation

industry, passengers and businesses, the UK Government should announce a freeze in APD levels.

Supported by: Fergus Ewing*

*S4M-04874.4 Willie Rennie: Air Passenger Duty—As an amendment to motion S4M-04874 in the name of Keith Brown (Air Passenger Duty), leave out from ―with concern‖ to end and insert ―the debate around the future of air passenger duty (APD); agrees that APD should be a tax exercised at a Scottish level by the Parliament as part of a federal UK, with tax powers and responsibilities shared between different levels of government in the UK; notes that returning the level of APD to 2007 levels as discussed in a recent York Aviation report would result in a loss of around £90 million to the Scottish Government, and calls on those who advocate such a change to set out their proposals to reduce public spending to match the reduction in tax receipts.‖

*S4M-04874.3 Richard Baker: Air Passenger Duty—As an amendment to motion S4M-04874 in the name of Keith Brown (Air Passenger Duty), leave out from "the only way" to end and insert "the Scottish Government should work with Scottish airports and airlines operating in Scotland to explore what further incentives might be put in place to reduce carbon emissions in the industry; notes that the previous Scottish administration introduced the route development fund to bring new routes to Scottish airports; recognises that the Calman Commission on Scottish Devolution recommended that APD should be devolved and that the Scotland Bill Committee found a strong case for devolving APD and that this will inform the work of the Devolution Commission; further recognises that APD on long-haul flights has already been devolved to the Northern Ireland Assembly, and believes that devolution of APD to Scotland should form part of an immediate wider review of APD by the UK Government, which should, as a first step to addressing the current concerns over APD in Scotland, take immediate action to resolve the anomaly whereby passengers in Scotland pay APD twice through making journeys to UK hub airports.‖

*S4M-04874.2 Alex Johnstone: Air Passenger Duty—As an amendment to motion S4M-04874 in the name of Keith Brown (Air Passenger Duty), leave out from "also notes" to end and insert "therefore encourages the UK Government to do what it can to help the industry, and calls on the Scottish Government to justify its refusal to use its existing powers to bring forward a suitable replacement for the route development fund."

*S4M-04874.1 Patrick Harvie: Air Passenger Duty—As an amendment to motion S4M-04874 in the name of Keith Brown (Air Passenger Duty), leave out from ―the recent report‖ to end and insert ―that greenhouse gas emissions from the aviation sector in Scotland have risen relentlessly and were 118% higher in 2009 than in 1990; considers that continual aviation growth is incompatible with the climate change targets that were agreed unanimously by the Parliament in 2008 and reaffirmed unanimously in 2012, and supports the use of financial measures such as air passenger duty, alongside other approaches, to restrain the growth of aviation emissions within limits that do not threaten the goal of a low-carbon Scotland.‖

*S4M-04873 Linda Fabiani: 10th Anniversary of Scottish Language Dictionaries—That the Parliament acknowledges that 2012 marks the 10th anniversary of Scottish Language Dictionaries, formed in 2002 as a successor to A Dictionary of the Older Scottish Tongue and the Scottish National Dictionary Association; recognises that Scottish Language Dictionaries aims to ensure the future of the writing, editing and compiling of Scots language dictionaries; commends its achievements, including the launch of the online Dictionary of the Scots Language and the expansion of its outreach programmes to promote Scots dictionaries to a wider audience and the building of relationships with schools, universities and community groups, and appreciates its commitment to increasing understanding, awareness and preservation of the Scots language.

*S4M-04872 Kenneth Gibson: The 21st Century Hazards of Smoking and the Benefits of Stopping—That the Parliament highlights a recent study published by The Lancet of over 1.3 million women in the UK from 1940 to 2011 that analysed smoking habits and mortality; understands that, because smoking rates peaked in the 1940s, this study allows an accurate survey of the effects of prolonged smoking and cessation on mortality; notes that it indicated that, of the 30 most common causes of death, 23 increased significantly in smokers and that, if the results were combined with 2010 UK national death rates, 53% of smokers died before they reached 80 compared to 22% of never-smokers and that a smoker’s lifespan was shorter by 11 years on average; understands that the study suggests that the hazards of continuing smoking after age 40 are 10 times greater than quitting, and believes that, in order to reduce the harmful effects of smoking, it is important to target and improve cessation services.

Supported by: John Finnie*

*S4M-04871 Alison Johnstone: Gaza—That the Parliament condemns the missile attacks on Gaza by Israel, which have resulted in many deaths, including children; supports the call from the Secretary-General of the United Nations for an immediate de-escalation of tensions and for both sides to respect their obligations under international humanitarian law; believes that a repeat of the conflict four years ago in which an estimated 1,400 Palestinians died can be avoided; supports the efforts of the Scottish Palestine Solidarity Campaign to raise awareness of the rights of the Palestinian people, and calls on the UK Government to stop arms sales to Israel.

Elimination of Violence against Women, which will be marked on 25 November 2012; notes that this date was selected by women’s rights activists, and ultimately ratified by the UN General Assembly, to commemorate the assassination on that day in 1960 of three of the four Mirabel sisters, who were political dissidents in the Dominican Republic; unequivocally condemns domestic abuse and all other forms of violence against women and celebrates the courage shown by women of all ages and backgrounds who overcome violence to make extraordinary contributions to human society, from the 74-year-old Liberian president and Nobel Peace Prize winner, Ellen Johnson Sirleaf, who survived domestic abuse before becoming the first democratically elected female head of state in Africa, to 14-year-old Pakistani girls’ rights activist, Malala Yousafzai, who survived being shot in the head by Taliban militants on 9 October 2012 for having spoken out in favour of a girl’s right to education and who, it believes, has subsequently become an inspiration for many around the world; believes that society is greatly enriched by the contribution made by such prominent women and millions of others in Scotland and throughout the international community, and considers that society is left all the more impoverished when it allows violence in any form to hinder any girl or woman from realising her full potential.

*S4M-04869 Stuart McMillan: Cruse Bereavement Care Scotland Celebrates 10 Years—That the Parliament congratulates Cruse Bereavement Care Scotland (CBCS) on 10 years as an independent charity supporting communities; understands that CBCS has 333 active volunteers who, in 2011 alone, worked 38,921 hours in providing 7,800 bereavement support sessions on a one-to-one basis and 65 hours per week of support by telephone; praises CBCS on its work in providing training to volunteers as well as bereavement e-courses for NHS staff; commends CBCS on its constant efforts to improve its services through developing high standard resources and training for volunteers so that they can provide special support to bereaved children as well as conduct research projects about the most effective means of providing support; understands that CBCS has developed a national phone line that offers immediate bereavement support for about 1,000 calls every month; acknowledges that CBCS provides services that help many people of all ages through difficult times in their lives, and wishes CBCS continued success in supporting bereaved people in Scotland in the future.

Bills in Progress

A list of all Bills in progress can be accessed via the Scottish Parliament website at:

http://www.scottish.parliament.uk/parliamentarybusiness/Bills/576.aspx

For each Bill, the date of the next (or most recent) event in the Bill’s passage is given. Other relevant information, e.g. about lodging amendments, is given in italics. As soon as a Public Bill (i.e. a Government, Committee or Member’s Bill) has completed Stage 1, amendments for consideration at Stage 2 may be lodged; and as soon as Stage 2 is completed, amendments for Stage 3 consideration may be lodged. The last lodging day for amendments at Stage 2 is three sitting days before the meeting at which those amendments will be considered (e.g. Thursday for a meeting on Tuesday); at Stage 3 it is four days before. Amendments may be lodged until 4.30 pm on any sitting day, except on the last lodging day for Stage 2, when the deadline is 12 noon. A Hybrid Bill is subject to the same rules except in the case of Stage 2 where amendments for consideration may be lodged no earlier than the completion of any consideration of evidence at Stage 2. Amendments to Private Bills are subject to different deadlines. These are set out in Rule 9A.12 of Standing Orders. Members are advised to lodge amendments in good time before the beginning of a Stage and as early as possible during the day. (G) = Government Bill; (M) = Member’s Bill; (C) = Committee Bill; (P) = Private Bill; (H) = Hybrid Bill.
