Gujarat Council on Science and Technology (GUJCOST), working under the Department of Science & Technology, Government of Gujarat, is the nodal organization for promotion of science education and awareness, research and development through its various programmes and activities across the State. In order to take Science to the People and People to Science, GUJCOST has planned to introduce the Mobile Science Exhibition Van with interactive exhibits and activity modules based on hands-on demonstration and minds-on exposure for children and community members at large. For this, GUJCOST invites bid/offer (By e-Tendering) from eligible bidders / agency for the purchase of the Bus Chassis and its Body Building work. COUNCIL ON SCIENCE AND TECHNOLOGY, GANDHINAGAR
The Gujarat Council on Science and Technology (GUJCOST) was established in September, 1986, to play a catalytic role in promoting the use of Science and Technology in the development process of the State. The S&T Council was constituted with a view to develop technologies appropriate to and in harmony with present conditions. The Council has been catalyzing interaction between developers and users of technologies, by bringing on a common platform to training Scientists and Engineers on the one hand and policy makers as well as Administrators on the other Accordingly, the State Council is identifying the areas in which Science and Technology can be applied for development activities and achieve the goals of the State, with a particular emphasis to eliminate the prevailing backwardness, rural unemployment and poverty. It was also felt necessary to establish effective Communication and other links between, and Co-ordinate the activities of centres of Scientific and Technological Research, Government agencies and industries in order to promote the application of Science and Technology in the State The Council is an autonomous body registered under the Societies Registration Act from 1st February, 2000 and working under department of Science & Technology. Hon’ble Minister of Education is the Chairman of the Council. The Administration and Management affairs of the state Council is inducted by the Governing Board. The Board has constituted Executive Committee for fast Execution of work. The day to day affairs and administration of the State Council is looked after by its Advisor who is also Member Secretary of the Council. Presently GUJCOST is working at B/7, M.S. Building, Sector-11, Gandhinagar. GUJCOST is dedicated to educating young minds, assisting teachers and increasing public understanding of science and technology along with its research and development programs. The rural population of India could not harness the benefit of science and technology in
post independence era due to urban centric development creating economical and social
divide between the two sections. People there remain isolated and needed special efforts to
bridge the gap Gujarat Council on Science and Technology (GUJCOST) is introducing a
novel but standardized concept of science on wheels for its science outreach programme,

to harness the benefit of Science & Technology right to the doorsteps of people
creating scientific temper among those who needed it the most.
To achieve this goal, Gujarat Council on Science and Technology (GUJCOST) is planning to
procure four mobile Science Exhibition buses.

5 General instructions
5.1 The tender fee submitted for the on line tender is non refundable
5.2 EMD In the form specified in tender document only shall be accepted.
Tenders without Tender document fees, earnest money deposits (EMD)
and which do not fulfil all any or all the conditions or submitted incomplete
in any respect will be rejected.
EMD submitted is refundable (without interest) to unsuccessful bidders
after tendering process is completed and to the successful bidder after
completion of the project.

TENDER SPECIFICATIONS Specifications for materials and processing: The Vendor shall scrupulously follow the ‘Technical Specification’ given below, for dimensions, materials and workmanship. In case of any confusion or apparent incompleteness, the decision of the GUJCOST shall be final.
Specific Terms & Conditions:
The rates quoted shall include all taxes, levies, transportation and delivery and installation at site.
1) The vendor at his own cost shall replace any rejected Material.
2) The rates quoted shall be valid for at least 90 days from the last date for the submission
of tender.
Payment Schedule: Payment will be made on raising invoice after assessing that the
equipment satisfies all technical terms mentioned in the tender and as described below.
2. Acceptance or Rejection of Tender
The acceptance of the tender will entirely rest on the Advisor, GUJCOST who does not bind
himself to accept the lowest tender and reserves the right to reject the tenders or partially accept
any of them without assigning any reason.
3. Price:
The Price quoted shall include all incidental charges such as VAT, service charge, sales tax,
Octroi, excise duty (if any) or any other taxes to give free delivery at the premises of Gujarat
Council on Science and Technology, Gandhinagar. The rates shall also include the amount
of freight, transportation cost of the bus chassis including the drivers cost, diesel cost,
insurance charges or any other incidental charges. No extra claim will be admissible at a
later stage.
4. Earnest Money and Security Deposit

A tender fee of 5000/- (Rupees five thousand only and an earnest money amounting to Rs
50,000/- (Rupees fifty thousand only) is to be by Bank Draft in favour of Gujarat Council on
Science and Technology, Gandhinagar along with the technical bid of the tender document.
The earnest money of the unsuccessful bidders will be released soon after the finalisation of
the bid process. The successful bidder shall be required to pay a Security Deposit, by Bank
Draft or by Bank Guarantee valid for 12 months, drawn in favour of Gujarat Council on
Science and Technology, Gandhinagar to the extent of 10% of the total value of the tender
immediately on receiving the work order and intimation of readiness of the bus chassis. At
that stage their earnest money shall be refunded. The Security Deposit will be released after
satisfactory completion of the defect liability period i.e. 6 months from the date of acceptance
of the vehicle by GUJCOST.
5. Delivery Schedule:
a) The chassis will be handed over to the successful vendor within one week from the date of placing order against a Bank Guarantee for the entire cost of the chassis. The Bank Guarantee is to be submitted by the successful vendor in approved form. The Bank Guarantee shall remain valid for six months which shall be extended by the vendor in case the delivery is delayed.
b) The work shall be completed in different stages as indicated below:
Stage 1: Completion of the frame work including anti-rust coating and painting of the
frame of driver’s cabin and exhibition area within 2 months from the date of order
Stage 2: Completion of body, roofing, driver’s cabin, electrical and fittings of fans
within 3 months from the date of order.
Stage 3: Completion of panelling including polishing and all other details and painting
of the body within 4 months from the date of order
c) The Museobus complete in all respect, shall be delivered to the Gujarat Council on Science and Technology in Gandhinagar within 4 months from the date of order failing which the supplier will be liable to pay liquidated damages @ 1% for every week or part thereof subject to a limit of 10% of the total cost. For good and sufficient reasons the GUJCOST may extend the time limit of delivery.
6. Inspection
The Vendor shall have to arrange inspection at their premises whenever desired by the
authorised officers of GUJCOST. All defects or shortcomings pointed out by the GUJCOST
Officers during such inspections have to be promptly rectified to ensure desired quality of
work.
7. Defect liability period
After delivery, the bus will be thoroughly inspected by competent officers of the GUJCOST, if
necessary in presence of a representative from the Vendor. Any defect identified at this stage
will be pointed out to the supplier for rectification within a reasonable period which is to be
stipulated by the employer. After getting such defects rectified, the bus will be accepted by

the employer. The Vendor will be responsible for all manufacturing defects including leakage,
noise, loose parts, breakage etc. for a period of 6 months from the date of acceptance. Such
defects will have to be promptly repaired by the Vendor free of cost of material and labour
within the defect liability period (6 months from the date of acceptance).
8. Payment
Payment shall be released according to the following schedule:
(a) 20% of the total value of the tender will be paid on satisfactory completion of Stage -I.
(b) Another 20% of the total value will be paid on satisfactory completion of Stage -II.
(c) Another 20% will be paid on satisfactory completion of Stage - III.
(d) 30% will be paid after delivery, inspection of the bus by GUJCOST Officers and
acceptance of the bus by the GUJCOST.
(e) Remaining 10% will be paid after satisfactory completion of defect liability period of 6
months.
9. Drawing and Specifications
The drawings and specifications are given for guidance. If any deviation of the drawings
become necessary or any discrepancy in drawings is detected it should be promptly brought
to the notice of the GUJCOST authority for clarification. No deviation from the approved
drawings should be made by the tenderer without written approval from the GUJCOST. Minor
alterations, if found necessary by the GUJCOST shall be done by the tenderer without extra
cost.
Specifications for the Fabrication of Museobus
General description:
A specially designed bus body for holding Mobile Science Exhibitions with necessary inside
panelling work to be built on Tata LP/LPO – 1512 TC - BSIII having provision to
accommodate 24 exhibit cabinets of size 990mm x 734mm x 305mm in 4 rows -- 2 facing
inside on the upper deck and 2 facing outside on the lower deck, mounted on a special
structure. Provision is to be made to accommodate additional exhibit panels and
demonstrations, as indicated in the drawings.
Chassis:
a) Ladder type heavy duty frame with riveted and bolted cross members. Side member dimension = 223 X 60 X 7 mm.
b) Make - Tata c) Type – LP/LPO – 1512 TC - BSIII d) Wheel base – 5545 mm.

Over all dimension: The bus body after construction will measure as follows;
a) Overall length: 9525 mm (excluding the rear ladder) b) Overall breadth: 2495 mm c) Height: 3430 mm (including exhaust fan top cover) d) Floor height above ground: 1175 mm
Structural materials: (drawings no: Exhibit Bus no 2 and no 7)
a) Built up channel for body frame and roof frame from 16 swg black sheet. b) Aluminium sheet 18 SWG for inside covering. c) Aluminium chequered plate of 16 SWG used for outside covering up to the height
of the window and the rest portion will be covered by 18 swg aluminium sheet. d) Angles and channels.
� Vertical inside members are 50 X 25 X 4 mm. R.S. channel. � Exhibit supporting members 25 X 25 X 3 mm. R. S. Angles
e) Both the sides of the body will be provided with heavy duty rubber guard with
aluminium housing.
Floor: (drawing no: Exhibit Bus no 2)
Floor to be covered with 20 mm thick well seasoned teak wood (or some other durable
variety) planks, free from knots and holes, supported on M.S. channel frame work over which
3 mm thick aluminium chequered plate to be fixed.
Ladder: (drawing no: Exhibit Bus no 3)
20 NB ERW Tube (heavy duty) ladder to be fitted to the rear end of the bus body for climbing
to the roof of the vehicle
Rear Stair: (drawing no: Exhibit Bus no 4)
A rolled steel angle stair case covered with 3mm thick aluminium chequered plate will be
provided at the rear end of the bus for the visitor’s entrance inside the exhibition. The stairs
will have provision to be accommodated inside the chassis and will be pushed into it and
locked firmly when the unit moves.
Rear Door:
The sliding rear door will be provided with ball bearing for free sliding. It is also to be provided
with two sliding window made of triplex toughened glass. The outer side of the door is
covered with 16 swg aluminium chequered plate and inside with 18 swg aluminium sheet.
The door is also to be provided with good locks.

Driver's Cabin: (ignore such items that come along with the Tata chassis – refer drawings
no: Exhibit Bus no 2 and 3)
a) Adjustable driver’s seat (adjustable for height, back and forward movement) and one double seat on left side. All the seats will have 100 mm foam covered with best quality durable foam rexin.
b) Two observation mirrors (450 X 250 mm) will be provided on both sides. c) Fire Extinguishers – 2 nos. to be fixed in Driver’s cabin.
� One suitable for electric fire - 1 lit capacity CTC type or nearest available
standard unit � One foam type – 7.5 litre capacity or nearest available standard unit
d) Two doors to be provided on each side of the cabin with good locks and chromium plated handles. It is to be provided with ‘Triplex’ toughened glass sliding window in aluminium frame.
e) A tool box of standard size which can be accommodated in the cabin to be provided with locking arrangements.
f) A door 1500 mm X 600 mm single flap in between the storage space and exhibition space will be provided.
g) A four pieces standard (Triplex make toughened type) wind shield (5.5mm thick) with bottom pieces adjustable for ventilation purpose to be provided. Overall size of the front wind screen 2434 X 1100 mm (approx).
h) A pair of heavy duty standard wiper with motors to be provided on the front wind shield.
i) One direction indicator will be provided at the driver’s side.
Maintenance Cabin: (drawing no: Exhibit Bus no 2)
a) One berth and one adjustable seat will be provided. Seat and berth will have 100 mm foam covered with foam rexin (leatherite). The berth will be provided with two heavy duty chains hanging from the roof.
b) One door to be provided on the left hand side of the cabin with good locks and chrome plated handles with sliding ‘Triplex’ make toughened glass window in aluminium channel.
c) One window to be provided on the right hand side of the cabin. It will be provided with “Triplex” make toughened glass sliding in aluminium channel.
Panelling: (drawing no: Exhibit Bus no 6)
a) For door frame –Teak wood, well seasoned, free from knots and holes shall be used b) Front side of the panel frame will be covered by laminated sheet of approved shade
and the backside shall be covered by 6mm thick phenol bonded Century make ply board. Locking arrangement at the top and bottom of total 12 nos. of doors shall be provided.
c) Each door shall have opening as per drawing for exhibits on upper deck.
Exhibit Window Lid: (drawing no: Exhibit Bus no 2)

Total 12 nos. of windows lid - 6 on each side will be provided. It should stand erect at the
time of exhibition by prop as shown in drawing. Each lid will be provided with two universal
lock with square key at the bottom corner of the covers.
Body Painting:
Best quality automotive paint, as approved by the GUJCOST, shall be used
23. Ventilations: (drawings no: Exhibit Bus no 1 and no 2)
Two forced fans and one exhaust fan on the ceiling will be fitted as per scheme (300 mm
sweep dia, 220v, single phase 50 Hz with dome on top to prevent rain water entry) and
protected by grill from inside. Controlling switch to be fitted on main switch board.
Insulation:
Thermcol insulation 25mm thick all along the roof between upper and lower sheet.
Roof:
Roof will be covered with 2 mm tar felt leaving space for 3 fans. Corners of tar felt shall be
screwed to the roof with aluminium flats all round. Roof shall be made totally leak proof.
Electrical Fittings:
a) Outside corner lights: - 4 Nos. connected to Battery with separate single switch. b) Twin 20 watt tube lights with grill inside the bus - 3 nos. (220 V Ac) c) Driver’s and maintenance cabin ceiling light, back light, brake and turning light to be
provided. d) An electrical switch panel, for connecting the exhibits to external power source, is to
be installed at the rear side of the bus with the followings: � One DB of 5 KVA capacity with protective circuit breaker against overload, and five
outlets each of 5 amp capacity with individual fuse or circuit breaker. � 3 nos of 5/15 amp 3-pin plug base, with third pins firmly connected to a ground
terminal by lug strips. � Two interconnected ground terminals shall be fixed on the switch panel. One shall
be firmly connected, by a sturdy lug strip, to the metal frame of the bus body and the other shall have provision for connection to external ground when needed.
� The DB and plug bases and the ground terminal are to be mounted on 12 mm insulated hylam board, which shall be mounted by a suitable iron angle frame on the bus body structure.
Storage Space: (drawing no: Exhibit Bus no 2)
Storage space shall be provided inside the vehicle along its length above the exhibits and
outside the vehicles under the chassis. Each lid of the storing space shall be provided with
two universal lock with square key at the bottom.
Waterproofing: All joints shall be waterproof
Drawings for the bus body as per GUJCOST requirement are enclosed for guidance.

Decisions: The Employer shall have the right to accept or reject, partially or wholly, any offer
without assigning any reason. All decisions of the Employer relating to this tender shall be
final.
Definitions:
The term ‘Employer’ shall mean Gujarat Council On Science And Technology, department of
Science and Technology, Government of Gujarat the term ‘Vendor’ shall mean the tenderers,
the contractor shall mean the bidder whose tender has been accepted and awarded work the
term ‘Site’ shall mean Gujarat Council on Science and Technology at Gandhinagar, or any
other place in Ahmedabad/Gandhinagar as to be indicated by the Employer.
GENERAL CONDITIONS OF THE TENDER
IN CASE OF ANY DISPUTES Except where otherwise specified in the contract the decision of the Advisor, GUJCOST
shall be final, conclusive and binding on all parties to the contract upon all questions
relating to the meaning of the specifications, designs, drawings and instructions herein
before mentioned and as to the quality of workmanship, or materials on the work, or as to
many other questions, claim, right, matter or thing whatsoever. If any way arising out of, or
relating to the contract, designs, drawings, specifications estimates, instructions order, or
these conditions, or otherwise concerning the works, of the execution or failure to
execute the same, whether arising during the progress of the work, or after completion or
abandonment thereof.
TIME SCHEDULE OF WORK The time limit of the work s h a l l be 4 month from the date of issue of purchase order.
EXTENSION OF TIME If the contractor shall desire an extension of the time from completion of the work on the
grounds of his having been unavoidably hindered in its execution or on any other grounds,
he shall apply in writing to the employer within three working days of the date at the
hindrance on account of which he desires such extension as aforesaid, and the Advisor,
GUJCOST shall, if in his opinion reasonable grounds have been shown therefore
recommended, such extension of time as may, in his opinion be necessary or proper
TECHNICAL SPECIFICATION 1) Contractor shall have to submit al l detailed technical specifications and drawings if
any to the employer for the approval before the supply.

2) The employer may choose to appoint a Third Party agency for inspection of materials the charges shall be paid by the employer. COMPLIANCE OF LAWS
The contractor shall respect and comply with all Nation, State and Local laws affecting the
works under this contract and shall bear the cost of any claim or damage or loss due
to violation or all such laws, ordinances etc
COMPENSATION FOR DELAY AND PENALTY The time allowed for carrying out the work as entered in the tender shall be strictly observed
by the contractor and shall be reckoned from the date of which the order to commence work
is given to the contractor. The work shall throughout the stipulated period of the contract be
proceeded with, with all due diligence (time being deemed to be of the essence of the
contract on the part of the contract) and the contractor shall pay as compensation and or
penalty for delay. Further contractor shall to ensure good progress during the execution of
the work. The work shall be completed stage wise as per the schedule given at the time of
tender submission before award of the job to contractor, and which will form the part of
the contract, failing which intermediate compensation shall be levied. In case contractor
have not submitted it is confirmation the schedule of work progress, on part of contractor
follow the schedule of work decided by the employer. In the event of the contractor failing to
comply with these conditions of Contract is liable to be terminated at any stage and / or
an amount equal to one half (0.5) percent of contract amount of whole work per week
shall be levied as a penalty for every week that the delay or penalty provided always that the
total amount of compensation to be paid under the provision of this clause shall not
exceed 10% of the contract value of the work.
The decision of Advisor, GUJCOST will be final for all such delay compensation.
ACTION WHEN THE PROGRESS OF ANY PARTICULAR PORTION OF THE WORK IS
UNSATISFACTORY
If the progress of any particular portion of the work is unsatisfactory the Advisor,
GUJCOST shall, notwithstanding that the general progress of the work is satisfactory and
the contractor is unable to rectify the same, GUJCOST may get the work done from any
other agency and debit the expenses to the contractor.
ACTION WHERE NO SPECIFICATION ISSUED In case of any class of work for which there is no such specification supplied by the owner
as mentioned in Tender document such work shall be carried out in accordance with Indian
Standard Specifications and if the Indian Standard Specification do not cover the same the
work should be carried as per standard Engineering practice subject to the approval of The
Advisor, GUJCOST.

PERIOD OF LIABILITY & GUARANTEE
The Contractor shall be liable for a period of one year after the date of issue of the certificate
of completion of work issued by GUJCOST. This period shall be deemed as guarantee
period during which, the contractor shall be responsible for rectifying any defects that may
develop in his workmanship & materials (against manufacturing defect) within the time
specified by the Owner. If contractor fails to rectify that defect, owner reserves the right to
complete that job at the risk and cost of the contractor. The contractor shall be liable during
guarantee period of one year to rectify any defects that may develop after erection of
supplied materials at the risk and cost of the contractor.
SETTLEMENT OF DISPUTES BY ARBITRATION
Any dispute or differences that may arise between GUJCOST on one hand and the
contractor on the other hand regarding the contract, meaning of effect of contract
documents, design drawings, specification, estimates, rates of schedule of item of
otherwise, quality of materials, workmanship employed during the execution, failure the
execute the instructions of GUJCOST relating to the works, etc. shall be referred to the
arbitration for decision. The venue of the arbitration shall be the place where the contract
agreement signed Arbitration proceeding will be initiated on receipt of written notice from the
contractor addressed to any matter wherein he intends to go in for arbitration. The
arbitration proceeding will be conducted and settled in accordance with the rules of
arbitration of the Indian Council Arbitration and the award made in pursuance thereof shall
be binding on both parties.
INSUREANCE IN RESPECT OF DAMAGE TO PERSONS AND PROPERTY
The Contractor shall be responsible for all injury to persons, animals or things and for all
structural and decorative damage to the property, wh i c h may arise, from the operation or
negligence of contractor or of any nominated Sub-contractor’s employees whether such
injury or damage arise from carelessness, accident or any other cause whatever in any
way connected with the carrying out of this contract. This clause shall be held to include,
INTER ALIA, any damage to building whether immediately adjacent or otherwise, and any
damage to roads, streets, foot-paths, bridges or ways as well as damage caused to the
buildings and works forming the subject of this contract by frost or other inclemency of
weather. The contractor shall indemnify the Owner and hold him harmless in respect of all
and expenses arising from any such injury or damage to person or property aforesaid and
also in respect of any claim made in respect of injury or damage under any Acts of
Government or otherwise and also in respect of any Award of compensation or
damages consequent upon such claim. The Contractor shall reinstate all damage of every
sort mentioned in this clause so as to deliver up the whole of the contract works completed
and perfect in every respect and so as to make good or otherwise satisfy all claims for
damage to the property of third parties.
The Contractor shall indemnify the Owner against all clams which may made against the

Owner by any member of the public or other third party in respect of anything which may
arise in respect of the works or in consequence thereof and shall at his own expenses
arrange to effect and maintain, until actual handing, over works to the owner with an
approved Policy o f i n s u r a n c e , against such risks from time to time during the currency
of this Contract. The contractor shall similarly indemnify the owner against all claims
which may be upon the owner whether under the Workmen’s Compensation Act
or any other Stature in force during the currency of this contract or at common law in
respect of any employee effect & maintain until the actual completion and handling over of
the Project. The contractor shall be responsible for anything which may be excluded from
the insurance Policies above referred to & also for all the other damages to any property
arising out & incidental of the negligence or defective carrying out of this contract. He
shall also indemnify the Owner in respect of any costs charges or expenses arising out of
any claim or proceedings & also in respect of any Award of compensation of damage arising
there from.
The Owner shall be at liberty & is hereby empowered to deduct the amount of any damage,
compensation, costs charges & expenses arising or occurring from or in respect of any
such claim or damage from any sum due or to become due to the contractor.
FORCE MAJURE CLASUE
Should the failure or delay in execution contract arise from the flood, restrain, imposed by
the Government Act of Legislature or other authority, stoppage, delay or hindrance in the
supply of raw materials fuel explosion, accident, riot or any other inevitable or unforeseen
conditions beyond the control directly or indirectly interfering with the work which may
be reasonable ground for granting the stoppage, the contractor shall be allowed such
stoppage upon such application being made by the contractor. The contractor shall not be
allowed to claim for any compensation for loss or damage that would be suffered to him
directly or indirectly on this account.
WORKS TO BE EXECUTED IN ACCORDANCE WITH SPECIFICATIONS,
DRAWINGS, ORDERS
The contract shall execute the whole and every part of the work in the most substantial and
workman like manner, and both as regards materials and in every other respect in strict
compliance with the specifications. The contractor shall also confirm exactly full and faithfully
to the designs, and instructions in writing relating to work assigned by GUJCOST
DECISION OF GUJCOST TO BE FINAL Except where otherwise specified in the contract the decision of the Advisor, GUJCOST shall be final conclusive and binding on all parties to the contract upon all question relating to the meaning of the specifications, designs, drawings and instruction herein before mentioned and as to the quality of workmanship or material used on the work or as to any other question, claim, right, matter or thing whatsoever, in anyway arising out of or relating to the contract designs, drawings, specifications estimates, instructions, orders or these conditions or otherwise concerning the works or the execution of failure to execute the

same, whether arising during the progress of the work or after completion of abandonment thereof.
DEFINITION OF WORK
The expressions “Work” or “Works” whenever used in these conditions shall unless, there be
something in the subject or context repugnant to such construction be constructed to mean
the work or the works contracted to the executed under or by virtue of the contract, where
temporary or permanent and whether original altered substituted or additions.
IMPLEMANTATION OF PROVIDENT FUND ACT& LABOUR ACT:
It is to be noted that the subject contract would be awarded only to those contractor that
have fulfilled having P.F.
JURISDICTION
The Contract shall be governed and be constituted according to laws in India. The
Contractor will submit to the jurisdiction of the courts situated at Ahmedabad/Gandhinagar
for the purpose of disputes, actions, and proceedings arising out the contract and the courts
at Site location only will have the jurisdiction to hear and decide such disputes, actions, and
proceedings.
ALTERATIONS IN SPECIFICATIONS AND DESIGNS NOT TO BE INVALIDATE
CONTRACTS. RATES FOR WORKS NOT ENTERED OR SCHEDULE RATE.
The employer shall have power to make any alteration in or addition to the original
specifications, drawings and instructions that may appear to them to be necessary or
advisable during the progress of the work and the contractor shall be bound to carry out the
work in accordance with any instruction in this connection which may be given to him in
writing signed by a competent authority and such alteration shall not invalidate contract. Any
additional work which the contractor may be directed to do in the manner above specified as
part of the work shall be carried out by the contractor on the same conditions in all respect
on which he agreed to do the main work, and at the same rates as are specified in the
tender for the main work. And if the additional and altered in the tender for the work, and if
the additional and altered work includes any class of works for which no rate is specified
in this contract, then such class of works shall be carried out at the rates entered in the PWD
SOR rates or at the calculated rates/approved rates whichever are lower. If the additional or
altered work for which no rate is entered in the Schedule of Rates in ordered to be carried
out before the rates are agreed upon then contractors, within seven days of the date of
receipt by him of the order to carry out the work, shall have to inform the competent authority
of the rate which he is intention to charge for such class of work, and to arrange to carry out
in such manner as he may consider advisable provided always that if the contractor shall
commence work or incurred any expenditure in regard there to before the rates shall have

been determined as lastly here in before mentioned then in such cases, he shall only be
entitled to be paid in respect of the work carried out or expenditure incurred by him
prior to such date of the determination of the rate as aforesaid according to such rates
as shall be fixed by competent authority.
In the event of a dispute, the decision of the Advisor, GUJCOST will be final. Where
however, the work is to be executed according the designs, drawings and specifications
recommended by the contractor and accepted by competent authority, the alteration above
referred shall be within the scope of such design, drawings and specifications appended to
the tender. The time limit for completion of works shall be extended in the proportion that the
increase in cost occasioned by alterations or additions bears to the cost of the original
contract work, and the certificate of the competent authority as such proportion shall be
conclusive.
NO CLAIM TO COMPENSATION ON ACCOUNT OF LOSS DUE TO DELAY IN
PROCUREMENT OF MATERIAL FROM MARKET
The contractor shall not be entitled to claim any compensation from the GUJCOST for the
loss suffered by him on account of delay in the procurement of material from market by
contractor where such delay is caused by
1. Force Majeure
2. Act of God
3. Act of enemies of the State or any other reasonable cause beyond the control of the employer
ACTION AND COMPENSATION PAYABLE IN CASE OF BAD WORK
If at any time before the earnest money deposit is refunded to the contractor, it shall appear
to the employer that any work has been executed with unsound, imperfect or unskilled
workmanship or with materials of inferior quality, or that any materials or articles provided by
him for the execution of the work are unsound or of a quality inferior to that contracted for, or
are otherwise not in accordance with the contract, it shall be lawful for the employer to
intimate this fact in writing to the contractor and then notwithstanding the fact that the work
materials or whole or part of the work to be carried out at all or to be carried out by
the contractor, he shall give notice in writing of the fact to the contractor, who shall there
upon suspend or stop the work totally or partially, as the case may be. In any such case,
except as provided here under, the contractor shall have no claim to any payment or
compensation what so ever on account of any profit or advantage which he might have
derived from the execution of the work in full but which he did not so derive in consequence
of the full amount of the work not having been carried out, or on account of any loss that
he may be put on account of materials purchased or agreed to be purchased, or for
unemployment of labour recruited by him. He shall not have also any claim for
compensation by reason of any alteration having been made in the original specifications,

drawings, designs and instructions which may involve any curtailment of the work as
originally contemplated. Where however, materials have already been purchased or agreed
to be purchased by the contractor before receipt by him of the said notice, the
contractor shall be paid for such materials at the rates determined by the employer, they
are not in excess of requirements and are of approved quality and / or shall be
compensated for the loss if any, that he may be put to, in respect of materials agreed to be
purchased by him, the amount of such compensation to be determined by the employer
whose decision shall be final. If the contractor suffers any loss on account of his having to
pay labour charges during the period during which the stoppage of work has been ordered
under this clause, the contractor shall, on application be entitled to any compensation on
account of labour charge as the Advisor, GUJCOST whose decision shall be final may
consider reasonable. Provided that the contractor shall not be entitled to any compensation
on account of labour charges if, in the opinion of the employer, the labour could have been
employed by the contractor elsewhere for the whole or part of the period during which the
stoppage of the work has been ordered as aforesaid. articles complained of may have
been inadvertently passed, certified and paid for the contractor shall be bound forthwith to
rectify or remove and reconstruct the work so specified in whole of or in part as the case
may require, or if he is required, shall remove the material or articles so specified and
provided other proper and suitable materials or articles at his own charge and cost; and in
the event of his failing to do so within a period to be specified by employer in the written
intimation aforesaid the contractor shall be liable to pay compensation at the rate of one per
cent on the amount of the contract sum for every day not exceeding ten days, during which
the failure so continues, and in the event of any such failure as aforesaid the employer may
rectify or remove and re-execute the work or remove and replace the materials or articles as
complained of as the case may be at the risk and expense in all respect of the contractor. If
the employer considers that any such inferior work or materials as described above may be
accepted or made use of, it shall be within his discretion to accept the same at such reduced
rates as he may fix here for.
WORKS TO BE OPEN FOR INSPECTION: CONTRACTOR OR REASONABLE AGENT
TO BE PRESENT
All works under or in course of execution in pursuance of the contract shall at all times
be open to the inspection and supervision of the employer and his subordinates or agents
appointed by the employer and the contractor shall at all times during the usual working
hours and at all other times at which reasonable notice of the intention of the employer or his
subordinate or agents appointed by the employer to visit the works shall have been given to
included. In the specification or other documents forming part of the contract referred to in
these conditions or not and which may be necessary for the purpose of satisfying or
complying with the requirements of the employer as to any matter on which under these
conditions he is entitled to be satisfied or which he is entitles require together with
carriage, therefore, to and for the work.
The contractor shall also supply without charge the requisite number of persons with the
means and materials necessary for the purpose of setting out works, and counting, weighing
and assisting in the measurement or examination at any time of the work or materials, failing

this the same may be provided by the employer at the expense of the contractor and the
expense may be deducted from any money due to the contractor under the contract or from
his payment / earnest money Deposit.
SAFETY CODE:
Contractor shall adhere to safe practice and guard against hazardous unsafe working
condition and shall comply with central / State Government safety Rules. Safety Regulations
in respect of all labour, directly or indirectly employed in the work for the performance of
Contractors part of this agreement, Contractor shall at his own expense arrange to all
safety provision as per safety code of Bureau of Indian Standard, The Electricity Act, and
such other acts as applicable. Suitable scaffolding will be provided for workmen for all
works that cannot be safely done from the ground up to any height as required for
working ,Scaffolding should be strong enough to prevent any collapse/Accident .The
contractor is responsible for the stability of scaffolding.
DETAIL DRAWINGS
The drawing accompanying the tender document is indicative of work and issued for
tendering purpose only. Purpose of these Drawings is to enable the Tendered to make
an offer in line with the requirement of the project. However no extra whatsoever shall be
entertained for any variation in the “Approved for construction” and “tender drawing”
regarding any changes /units. Construction shall be as per Drawings/specifications
issued/approved by the employer during the course of execution of which actual
execution is to proceed will be furnished to the contractor progressively based on the
detailed construction programmed evolved after the award of work and also based on
construction progress achieved. Three copies of the drawings furnished to the Contractor
shall be kept at the site and the same shall at all reasonable times be available for
inspection & use by employer or his representative & by other person
PROGRAM OF WORK (BAR CHART)
Within 15 days after the award of Contract, the Contractor shall submit to the employer for
his approval a program to match with the planned whole job showing the order of a
procedure and method in which he proposed to carry out the works and shall whenever
required by the employer furnish further detailed program in writing of contractors
arrangements for carrying out the works. The submission to and approval, if any, by the
employer or his representation of such program or particulars shall not relieve the contractor
for any of his duties or responsibilities under the contract.
