Methodology
As part of Burnleys biodiversity action plan all sites visited were surveyed for protected species.
Site surveys recorded detail of :
Grid reference, Size in hectares ( if known), given a Green infrastructure (GI) typology using the Burnley green
infrastructure typology,* Ownership (if known) Lancashire Biodiversity Action Plan Species, Protected Species and
Birds of Conservation Concern with guidance from
Species listed on S41 of the NERC Act or on the Lancashire BAP Long Lists, where these intersect Burnley
The protected Species List, The Conservation of Habitats and Species Regulations 2010 (Natural England)
Birds of Conservation Concern 2009 update
Probability of protected species was also recorded and highlighted , especially Bat species
Each survey consisted of thorough coverage (where possible) and habitat description of the site. Boundary GI
typology noted to 200 metres of the site. Protected species recorded for all site observations
*A Greenspace (GS) typology is given for comparison.

BURNLEY WILDLIFE AND HABITAT SURVEY
I refer to the duty to conserve biodiversity under section 40 of the Natural Environment and Rural Communities Act 2006 and our recent instructions to you to carry out the above survey within the borough of Burnley.
Please take this letter as formal written authority from Burnley Borough Council, as the Local Planning Authority, to your officers, servants, employees, contractors and agents pursuant to section 324(1)(a) of the Town and Country Planning Act 1990, to enter any land within the borough at any reasonable time, for the purpose of surveying it in connection with the Council’s duty to prepare and revise a Local Development Document under Part 2 of the Planning and Compulsory Purchase Act 2004. Please note that:
The above express statutory right to enter land and to undertake a survey includes a right, if required, to search and bore for the purpose of ascertaining the nature of the subsoil or the presence of minerals in it.
If damage is caused to the land or chattels in the exercise of the above right, damages may be recovered from the Council.
Pursuant to section 325(2) of the Town and Country Planning Act 1990 it is a criminal offence to wilfully obstruct a person acting in the exercise of the right.

Notes
Western side of site made up of factory and out buildings. The East side
consisting of Agricultural Land.
The agricultural land consists of grazed grassland and wet Juncus sp.
areas intersected by two drainage channels.
Bordered on its Southern boundary by the River Calder, the eastern side
by irregularly spaced mature trees forming a boundary edge onto privately
owned agricultural land and the northern edge by mature woodland which
forms part of the Grove Lane woodland.
The factory side of the site is bordered by the river Calder on its Southern
boundary and by Housing on the southern and northern edge.
The factory and outbuildings could be probable Bat sites.
An ecological survey is being carried out on site by an independent
consultancy for bats and reptiles throughout the site.

To the South by the Padiham Greenway a linear footpath, and beyond that
Shuttleworth mead Industrial estate.
To the west by the Padiham Greenway and the A678 and the River Calder.

Site of old chemical works. North eastern side is capped and seeded and
block planted with native tree species. Derelict area to west of site has
regeneration growth of Buddleia, Rosebay Willowherb Chamerion
angustifolium and Ragwort Senecio jacobaea.
Leeds & Liverpool canal corridor to the south bordered by semi mature and
mature trees. Northern and eastern edges bordered by Scrubland and
block planted with Native tree species.
North western corner holds a mature tree block. Western edge bordered by
housing and Agricultural land.

All three school sites are fenced off with no access, all the other areas are
accessible general amenity space.
Mature woodland section on southern side, Linear footpath runs alongside
southern edge.

housing, southern edge by mature woodland and stream. Western edge by

The southern side is disturbed land, overgrown ephemeral / short
perennial
Bordered to the north by Housing, the east by road, housing and a Sports
area, the south and west by amenity grassland.
The mill building remaining could be a probable Bat site.

Incorporate existing trees on northern boundary into development. Trees

Type Definition
Public parks
and gardens
Public parks and gardens Areas of land normally enclosed, designed,
constructed,managed and maintained as a public park or garden. These may be
owned or managed by community groups
Private gardens or
grounds
Areas of land normally enclosed and associated with a house or institution
and reserved for private use.
Amenity greenspace
Landscaped areas providing visual amenity or separating different
buildings or land uses for environmental, visual or safety reasons and
used for a variety of informal or social activities such as sunbathing, picnics
or kickabouts
Playspace for
children and
teenagers
Areas providing safe and accessible opportunities for children’s play
usually linked to housing areas.
Sports areas

Lancashire Biodiversity Action Plan Species (LBAPS) Provisional Long List
The Lancashire Biodiversity Action Plan (BAP) is made up of many individual species and habitat plans. Each plan
gives information on the status and threats to the species or habitat. The most important section of the plan details
the conservation action required and the organisations responsible.
The Natural Environment and Rural Communities (NERC)
Section 41 (S41) of the Act requires the Secretary of State to publish a list of habitats and species which are of
principal importance for the conservation of biodiversity in England. The list has been drawn up in consultation
with Natural England, as required by the Act.
The S41 list is used to guide decision-makers such as public bodies, including local and regional authorities, in
implementing their duty under section 40 of the Natural Environment and Rural Communities Act 2006, to have
regard to the conservation of biodiversity in England, when carrying out their normal functions.
