Project Name: Empanelment of agencies for conducting cluster level activities under GEF-

UNIDO-BEE project “Promoting energy efficiency and renewable energy in

selected MSME clusters in India”.

The Bureau of Energy Efficiency (BEE), under the GEF-UNIDO-BEE project, intends to

empanel agencies for a period of one (1) year for conducting cluster level activities like

comprehensive energy audits, preparation of best operating practices document, designing

& implementing training programs and other similar activities in ceramic and dairy sectors.

The “Request for Proposal (RfP)” applies to all firms/agencies/organizations having a proven

track record in the field of energy efficiency and sufficient resources to undertake energy

audits, establishing baselines, technological assessments, organizing workshops & training

programs, in order to be able to conduct the cluster level activities. Detailed information

regarding the services required is given in the section 3 - Terms of Reference (ToR).

2 BACKGROUND INFORMATION

2.1 About the project

Bureau of Energy Efficiency (BEE), a statutory body under Ministry of Power, Government of India, in collaboration with United Nations Industrial Development Organization (UNIDO) is executing a Global Environment Facility (GEF) funded national project “Promoting energy efficiency and renewable energy in selected MSME clusters in India”. Presently the project is being executed in following 11 clusters in 5 varied sectors:

2.2 Project objective

The aim of the project is to develop and promote a market environment for introducing energy efficiencies and enhanced use of renewable energy technologies in process applications in 12 selected energy-intensive MSME clusters in India with expansion to more clusters later. This is to improve the productivity and competitiveness of units, as well as to reduce overall carbon emissions and improve the local environment.

2.3 Project component

Increased capacity of suppliers of EE/RE product suppliers/ service providers/ finance providers.

Increasing the level of end-use demand and implementation of EE and RE technologies and practices by MSMEs.

Scaling up of the project to a national level.

Strengthening policy, Institutional and decision making frameworks

Creating a scope for energy savings, by increasing the level of end-use demand and implementation of energy efficiency and renewable energy technologies and practices by MSMEs

Encouraging the use of renewable energy in various industrial applications

3 TERMS OF REFERENCE

3.1 Scope of work

1. One pre-activity workshop in each cluster defining the agenda of this engagement.

2. Comprehensive energy audits in the units decided in mutual agreement with the

respective cluster association. Agency needs to make a presentation to the

respective units on energy audit findings so as to take their consent on EE & RE

findings and include the same in the final energy audit report.

3. Based on above energy audit activity, prepare cluster specific energy benchmarking

report covering complete product range with comparison to international

standards.

4. Enumeration of common regularly monitorable parameters (CMP) at the process

level which have impact on energy performance, and listing of appropriate

instrumentation for the same with 3 options including make, supplier, indicative

costs, specifications and accuracy of measurements. Based on the CMP document,

a high quality poster has to be designed to disseminate the information at unit

level.

5. Development of cluster specific high quality ready to publish Best Operating

Practices (BOP) document for the energy consuming equipment/ process in the

industry cluster on the basis of

a. process / technology used in the cluster

b. above energy audits

c. discussions with at least 3 subject matter experts in/around the cluster

d. discussions with at least 2 equipment suppliers of each equipment

6. Identification of set of energy auditing instruments that should be used for carrying

out periodic energy audits in the units, with minimum 3 options including make,

supplier, indicative costs, specifications, accuracy of measurements including

quotations.

7. Based on preceding outputs of this activity, post energy audit training workshops

in the cluster.

8. Preparing and designing of ready to print case-studies prepared under the project.

The content for case-studies shall be provided by the PMU.

NOTE: Above mentioned is the scope of work which is to be carried out in the clusters; however,

details of the cluster, number of units in the cluster where energy audits are to be carried out

and number of post-audit workshops shall be informed later when cluster specific financial

quotations will be invited.

3.2 Deliverables

1. Proceedings of pre-activity workshop

2. Unit specific comprehensive energy audit reports, with copies submitted to unit and

BEE.

3. Cluster specific benchmarking report with complete product range with comparison

to international standards.

4. Cluster specific list of common regularly monitorable parameters with ranges and

suggested instrumentation to monitor, and also compile the information in the form

of high quality poster.

5. Cluster specific custom designed ready to publish best operating practices document

6. Cluster specific list of energy audit equipment along with minimum three quotations

7. Proceedings of 3 post energy audit training workshops

8. Custom designed, ready to publish case-studies.

All deliverables to be submitted in soft (both word and pdf format) and hard copies.

3.3 Time-Line (in terms of calendar weeks from the date of work order)

3.4 Contracting & Monitoring

1. Selected agency shall be responsible for drafting the contract document to be signed

with BEE as per the BEE format. It shall submit the draft document within 7 days of

the issuance of LoI.

2. Fortnightly updates to be submitted in soft copy on [email protected].

3.5 Financial Bidding

There is no restriction on taking up work in more than one cluster. However, the

work shall be awarded on cluster basis. Each empanelled agency will be invited to

submit the cluster-wise financial bid at later stage.

The financial bids will be requested only from those empanelled agencies which

shall be found technically suitable.

The cluster specific details of work and the details on submission of financial bids

shall be informed at the time of inviting financial bids.

3.6 Pre-bid meeting

A pre-bid meeting shall be organized on 22nd August, 2017 at 1500 hrs at BEE office for the

interested agencies/bidders to discuss and clarify any concerns which bidders may have

regarding the documents required, scope of work and other details of the requirement of

work.

In order to arrange for gate pass(es), bidders who wish to participate in the pre-bid meeting

3.7 Terms of payment

The payment process is linked with the deliverables. BEE shall process the payment after

the receipt of the invoice at each stage. The payment process might take some extra time,

however work shall not be affected due to payment related process.

4 ELIGIBILITY CRITERIA FOR BIDDING AGENCY

Agency interested in the above work must fulfil the following eligibility criteria for

participation in the bidding process:

Must be a firm/company registered/incorporated in India.

Must be reputed agency/organization with credible background with at least 8 years of

experience in the field of energy audit, cluster level assessment, establishing baseline,

development of benchmarking reports & dissemination material, implementing

training programs in MSMEs, preferably in Ceramic and Dairy sectors.

Agency must have carried out at least 50 detailed energy audits in MSME units

preferably in ceramic and dairy sectors and should have sufficient experience in

preparation of high quality detailed project reports, case studies & visual dissemination

training material in ceramic and dairy sectors.

Should have been profitable over last three financial years with minimum annual

turnover of INR 5 Crore (or its equivalent in foreign currency) from EE consulting or

energy auditing in last three (3) financial years i.e. 2013-14, 2014-15 and 2015-16.

The proposal must be submitted as a sole agency. No consortium with other agency/

organization shall be allowed. Further, subletting of work to other agency or contractor

is also not allowed. A declaration in this regard must be submitted.

Agency should not be debarred/ blacklisted by any of the government

organizations/agencies. Further the agency should not be involved in any major

litigation that may have an impact of affecting or compromising the delivery of services

as required under this RfP.

Agency should have at least 10 nos. of professional manpower on its permanent pay-

roll, out of which at least 2 professional should be Accredited Energy Auditor and 4

professional should be Certified Energy Auditor/Manager. A photocopy of the

certificates of BEE Accredited Energy Auditor and Certified Energy Auditor/Manager

should be enclosed.

The agency must have at least 2 sector experts having experience of more than 15 years

in MSME specific to ceramic and dairy sectors (one expert specific to process &

technology and other expert specific to energy audit, EE and RE technologies &

techniques). The agencies may hire/associate with ceramic and dairy sector experts, if

required. The complete details of the sector experts must be furnished.

Separate teams should be proposed for each sector. It is also mandatory that the same

team composition should be available to carry out the activities.

5 GENERAL TERMS AND CONDITIONS

5.1 Cost of RfP

The agency shall bear all costs associated with the preparation and submission of its RfP. BEE will in no case be responsible or liable for those costs, regardless of the conduct or outcome of the tendering process.

5.2 Contents of the RfP

The agency is expected to examine all instructions, forms, terms & conditions and scope of work in the RfP document. Failure to furnish all information required or submission of an RfP document not substantially responsive to the RfP in every respect will be at the agency’s risk and may result in the rejection of the proposal.

5.3 Language of RfP

The technical proposal and financial bids submitted by the agency and all correspondence and documents relating to this assignment exchanged by agency and BEE shall be written in English language, provided that any printed literature furnished by the agency may be written in another language so long the same is accompanied by an English translation in which case, for purposes of interpretation, the English translation shall govern.

5.4 Amendment of RfP

At any time prior to the last date for receipt of bids, BEE, may, for any reason, whether at its own initiative or in response to a clarification requested by a prospective agency, modify the RfP document by an amendment. In order to provide prospective agency reasonable time in which to take the amendment into account in preparing their bids, BEE may, at their discretion, extend the last date for the receipt of bids and/or make other changes in the requirements set out in the invitation for proposals.

All future information regarding amendments and/or clarifications shall be uploaded on the BEE website (www.beeindia.gov.in) only.

5.5 Power of attorney

The "Consultant" as used in this RfP shall mean the one who has signed the RfP document forms. The Consultant should be the duly Authorized Representative of the agency/organization, for which a certificate of authority should be submitted. All certificates and documents (including any clarifications sought and any subsequent correspondences) received hereby, shall, as far as possible, be furnished and signed by the Authorized Representative.

The power or authorization, or any other document consisting of adequate proof of the ability of the signatory to bind the Consultant shall be annexed to the bid. BEE may reject outright any proposal not supported by adequate proof of the signatory’s authority.

5.6 Force Majeure

Force Majeure shall mean and be limited to the following: a) War/hostilities b) Riot or Civil commotion c) Earthquake, flood, tempest, lightening or other natural physical disaster. d) Restrictions imposed by the Government or other statutory bodies which prevents or

delays the execution of the Contract by bidder.

In the event of any force majeure, the bidder or the BEE shall not be liable for delays in performing their obligations under this order and the completion dates may be extended, for a period not exceeding the period of delay attributable to the causes of force majeure. Neither BEE nor bidder shall be liable to pay extra costs provided it is mutually established that force majeure conditions did actually exist.

5.7 Indemnity

The Bidder shall at all times keep indemnified BEE and its officers/ employees, from and against all/any claims whatsoever, arising as a consequence of, or in the course of execution of the work (including but not limited to property loss and damage, personal accident, injury or death of or to property or person or agents of the agency/bidder).

5.8 Copyright

BEE will hold the copyrights over any of the data collected, documents, DPRs, reports, training materials etc. prepared under or as a part of this assignment.

5.9 Confidentiality

BEE shall hold the copyrights over any of the data collected or compiled during the course of the work. The agency/agencies selected for the work will have to maintain the confidentiality of the information compiled. In no case the agency/agencies would be allowed to use the data or share the information with anyone else without written permission by BEE.

5.10 Disqualification

BEE at its sole discretion and at any time during the process of bidding may disqualify any bidder from the tendering process if the bidder has –

Submitted the proposal after the schedule date and time.

Firms not meeting eligibility criteria.

Made misleading or false representations in the forms, statements and attachments submitted in proof of the eligibility requirements.

If found to have a record of poor performance such as abandoning works, not properly completing the contract, inordinately delaying completion, being involved in litigation or financial failures, etc.

Failed to provide clarifications related thereto, when sought.

5.11 Termination of contract

Bureau have its rights, under the conditions of this RfP, to terminate the contract of the agency at any time. The contract may also be terminated if the agency’s performance or competence fails to meet the standards required for the assignment.

5.12 Bank Guarantee

To ensure due performance of the contract and in lieu of liquidated damages, the selected agency shall be required to submit a bank guarantee amounting to 15% of the total contract value and it should remain valid for a period of sixty days beyond the date of completion of all contractual obligations.

5.13 Penalty for delay in deliverables

A penalty of 1% per week or part of the week, subjected to a maximum of 10% of the total work order value, will be imposed for delay in submission of deliverables after the stipulated timeframe of 26 weeks from the date of issue of work order.

5.14 Others

BEE reserves the right to cancel the RfP process at any time/stage or relax/amend/withdraw any of the terms and conditions relating to scope of work, deliverables, time-line, eligibility criteria etc. without giving any reason whatsoever. No enquiry, after submission of the quotation, shall be entertained.

5.15 Disclaimer

BEE and/or its officers, employees disclaim all liability from any loss or damage, whether foreseeable or not, suffered by any person acting on or refraining from acting because of any information including statements, information, forecasts, estimates or projections contained in this document or conduct ancillary to it whether or not the loss or damage arises in connection with any omission, negligence, default, lack of care or misrepresentation on the part of BEE and/or any of its officers, employees. Except where otherwise specified in the contract, the decision of BEE shall be final, conclusive and binding on all the agencies upon all questions relating to the meaning of the RfP specifications, scope of work, terms & conditions etc. herein before mentioned or thing whatsoever in any way arising or relating to the contract, specifications, terms & conditions, orders, or otherwise concerning the works or the execution or failure to execute the same, whether arising, during the progress of the work or after the completion or abandonment thereof. Further, BEE shall not be responsible for non-receipt / non-delivery of the proposals due to any reason whatsoever.

6 PROPOSAL

6.1 Preparation of proposal

The agencies are requested to submit technical proposals and financial bids as detailed in

the subsequent clauses.

Technical Proposal:

The technical proposal shall comprise the following components:

RfP Form 1: RfP letter proforma (refer section 7).

RfP Form 2: Prior experience (refer section 7.1.1).

RfP Form 3: CV of the members in the proposed team (refer section 7.1.2).

RfP Form 4: Eligibility & other details (refer section 7.2).

RfP Form 5: Capability statement including the proposed team structure (refer section

7.3).

RfP Form 6: Approach & methodology (refer section 7.4).

RfP Form 7: Time schedule & work-plan (refer section 7.5)

RfP Form 8: Registered Power of Attorney executed by the agency in favour of the

principal officer or the duly authorized representative, certifying him/her as

an authorized signatory for the purpose of this document.

6.2 Submission of Technical proposal

The proposal should be typed and signed by the head or a person duly authorized to bid by

bidding agency. All pages of the offer, except for un-amended printed literature, shall be

initialled by the person(s) signing the offer. The original hard copy of the complete set of

technical proposal must be putted in sealed envelope clearly superscripted as “Technical

Proposal for conducting cluster level activities under GEF-UNIDO-BEE project”.

The technical proposal should be submitted in one original set (hard + soft copies) and must

be delivered to - Secretary, Bureau of Energy Efficiency, 4th Floor, Sewa Bhawan, Sector -1,

R.K. Puram, New Delhi-110066 latest by 1300 hrs on 11/09/2017. Non-compliance to the

above process will be liable to rejection.

BEE shall not be responsible for non-receipt / non-delivery of the bids due to any reason

whatsoever. Consultants are advised to study the RfP document carefully. Submission of

bids shall be deemed to have been done after careful study and examination of the RfP

document with full understanding of its implications.

6.3 Preliminary scrutiny

Preliminary scrutiny of the proposals will be made to determine whether they are complete,

documents have been properly signed, and the bids are in order. Proposals not conforming

to such preliminary requirements will be prima facie rejected.

6.4 Evaluation of the proposal

Each bidder would be required to comply with the requirements of Section 4 and should

agree in-principle with the scope of work mentioned in Section 3. The technical evaluation

would be done as per the criteria mentioned below and the minimum technically qualifying

score shall be 80.

6.5 Selection of the bidder

To assist in the scrutiny, evaluation and comparison of offers, BEE, at its discretion, may ask for any technical clarification/presentation to be submitted by the agency. BEE reserves the right to analyse and alter the evaluation/selection criteria.

On completion of the evaluation of the technical bids, BEE shall empanel the technically qualified bidders for a period of one year. The list of agencies empanelled under this RfP shall be uploaded on BEE’s website and no separate communication shall be made.

The financial bids for work detailed in section 3 earlier, shall be invited from the bidders so empanelled. The cluster specific details of work and the details on submission of financial bids shall be informed at the time of inviting financial bids.

The financial bid should only include a lump sum quote, inclusive of all taxes, for the work in the cluster. The work will be awarded to the lowest price bidder (i.e. on L-1 basis).

BEE shall issue Letter of Intent (LoI) to the selected bidder. Upon the acceptance of the LoI by the successful bidders, BEE shall issue work order. Within ten days of receipt of the work order, the selected bidder shall enter into a contract with the BEE in the prescribed format. The selected bidder shall also commence the work within fifteen days from the date of issue of work order.

If the bidder, upon selection, fails to enter into a contract, BEE may invite the technically qualifying bidder who has financially ranked next/lower for financial negotiations to award the work. Further BEE may also exclude the former from all future assignments.

7.1 Technical proposal details
